♪ it was the state of the union address overshadowed by political tension. president trump spoke for nearly 80 minutes with remarks that seemed like a press conference. and nancy pelosi ripping up his speech. pete buttigieg and bernie sanders leading the back but not all precincts are reported yet. it could be a pivotal moment for the president as the senate seems poised to acquit him on abuse of power and obstruction of congress.

good morning, everyone. it's wednesday, february 5th i'm ayman mohyeldin with yasmin vossoughian. we begin with the state of the union, unlike any other, impeached president addressing a bitterly divided congress while also seeking re-election. those divisions were on vivid display last night. with the president looking away from the house speakers outstretched hand to nancy pelosi ripping up the president's speech when he finished. at times it felt more like a campaign rally than a formal address with republican lawmakers chanting four more years. and democrat s jeering the president. trump's showmanship was on full display by reuniting an army sergeant with his wife and kid. promoting school choice for announcing a scholarship for a pennsylvania student. and awarding rush limbaugh with the presidential medal of freedom. also noted the president did not

mention impeachment once during the entire speech. >> for more on dramatic moments we just mentioned watch what happened when the president announced legislation to lower drug care costs as if such legislation had not been passed by the house. >> i'm calling for bipartisan legislation that dramatically lowers the prescription health prices. get a bill on my desk and i will sign it into law immediately. with unyielding commitment, we are curbing the opioid epidemic. >> democrats are chancing hr3. there was a bill named after late congressman elijah cummings. as ayman mentioned the tensions between the president and house speaker pelosi were on full display during last night's address. as soon as the president reached the lectern last night.

he appeared to ignore pelosi's offer of a hand shake as you see there. moments later, pelosi omitted the customary language about it being a high privilege and distinct honor to introduce the president. merely saying the president of the united states. on a different point throughout the night, pelosi could be seen shaking her head and appearing to mouth the words that's not true in reaction to the president's words. the night ends with pelosi ripping up her copy of the president's address as soon as he was finished speaking. reporters asked her about that moment after she left the floor. >> madam speaker, what did you think of trump's speech tonight? >> i tore it up. >> because it was the courteous thing to do. >> and conservative radio show host rush limbaugh who recently revealed he was suffering from stage 4 lung cancer was awarded

the presidential medal of freedom during trump's state of the union address last night. rush, in recognition of all that you have done for our nation, the millions of people a day that you speak to and you that inspire, and all of the incredible work that you have done for charity, i am proud to announce tonight that you will be receiving our country's highest civilian honor, the presidential medal of freedom. >> so, first lady melania trump then presented the medal to limbaugh who was seated next to her in the gallery in the house of representatives. the medal is usually bestowed during a ceremony at the white house. and the father of a slain parkland high school student was removed from the house chamber state of the union after he yelled at the president. nbc news can confirm that fred guttenberg was escorted out for shouting during the president's remarks on the second amendment. according to "newsweek,"

gutenberg yelled what about my daughter in response to the president's defense of gun rights. his daughter jamie was among the 17 killed in the mass shooting in marjory stoneman douglas high school. and president he'trump's approval rate is the highest. up since mid-january. 50% disapprove. that is down three points. broken down by party lines, trump's approval rating among republicans, a staggering 94%, 42% among independents. 63% with the economy. foreign trade, 50%. at least said they disapprove of trump's handling of iran and foreign affairs. >> this morning we still don't have the results of the iowa

caucus, two days later. with 71% of precincts reporting right now, pete buttigieg holding a slim lead over bernie sanders. senator elizabeth warren is in third place, followed by joe biden. of course, he's positions may change once the votes are eventually counted. the iowa democratic party is blaming the issue on a coding issue with a new app that was meant to help speed up the caucus results. let's get into this a bit. reporter of the "washington post," eugene scott, some of the best stuff i saw coming out of twitter with regard to the release of some of those results. at that point, i believe it was 62% of the release of the results. one tweet i saw someone saying i just watched 62% -- what was that movie with jack and rose -- >> "titanic." >> "titanic." seemed like jack and rose were doing pretty well which i thought was funny. what do you make out of the latest numbers out of iowa?

>> well, you know, they're still coming in. but it certainly suggests that there was a lot of support in iowa for a new face, specifically pete buttigieg's. and i think that in addition to the idea that many voters do want a moderate, as far as his lead goes, is telling. now, obviously, his lead right now is not lead to imbalance ahead of bernie sanders who is not a moderate so that also suggests that a sizable percentage of voters so far are interested in a more progressive direction for the democratic party. and so, i think people right now, are still waiting. and cannot draw any sweeping conclusions about the direction of the party based on iowa. until the final results are in. >> let's talk a little bit, eugene, about the state of the union and how republicans, after seeing what happened yesterday, as well as the white house being on and responding to speaker pelosi's actions of ripping up the president's speech.

is this seen as further tensions between the political parties given the fact that also as you mentioned did not shake her hand and offered her that courtesy and respect walking into the house? >> well, it certainly didn't bring about unity. but that wasn't really the expectation. anyone paying attention to where the parties are right now. what they do during the daytime. the hours leading up to this speech would not have expected them to be on the same page, despite the fact that the state of the union generally is viewed as a unifying moment for the parties. it hasn't been for a while. and that goes before the trump administration, as anyone who covered the obama administration has seen. but it will be really interesting to see what could happen at the next state of the union, because it will be following, obviously, the 2020 election. >> but i want to circle back to the iowa results here, eugene. because i feel like the overarching theme that we have heard so far is joe biden really dodged a bullet here. if these results had come out

within the 12 hours or so after the caucuses began, we would be talking specifically about the fact that joe biden was in fourth place, if that's in fact where he remains once all of these results are released. but in fact that's not what we're talking about, instead, we're talking about what took place in iowa. the fact that we're still two days later waiting for all of the results to be released. >> it definitely would have been a big day one story had joe biden come in fourth place. that would not have been as big as his critics hope because that would not have been the end of the joe biden campaign. we know that joe biden is doing really well in south carolina and doing well in nevada as well. while i'm sure his team would have loved to win they did not need this win the sway over some other candidates attracting a lot of doubt outside of their bubble such as the buttigieg campaign really did need it.

welcome back. speeches on the senate floor will continue today before the vote on the articles of impeachment when the trial resumes at around 4:00 p.m. it's still unclear whether senator doug jones of alabama will break from democrats on impeachment. he told reporters just yesterday that he will announce his

decision ahead of this afternoon's vote. meanwhile, republican senator susan collins of maine said on the floor yesterday that she will vote to acquit on both articles. >> it was wrong for president trump to mention former vice president biden on that phone call. and it was wrong for him to ask a foreign country to investigate a political rival. i do not believe that the house has met its burden of showing that the president's conduct, however flawed, warrants the extreme step of immediate removal from office. i will vote to acquit on article 1. house managers described impeachment as a last resort for the congress. in this case, however, the house chose to skip the basic steps of

judicial adjudication and, instead, led straight to impeachment as the first resort. therefore, i will vote to acquit on article 2. >> so collins later told reporters she would have considered supporting a censure, had the house not moved forward first with impeachment. and republican ben sasse told the omaha world herald that it was wrong but trump did ultimately the right thing by releasing that aid. >> joining us here on set, msnbc legal analyst danny cevallos. danny, pretty straightforward, obviously that counts are known publicly that the president will be acquitted on both of these charges. but are we likely to see fireworks today or over in a few

minutes? >> look for a vote straight along party lines, 53 to 47 in favor of acquittal which, of course, is nowhere near the two-thirds majority required to actually convict and then remove a president. no surprising today. perhaps arguably no surprises from the outset of this trial. because unlike a normal trial in the judicial branch, this trial has a bunch of jurors that we already knew their leanings before the trial began. >> i want to talk about what i just spoke about with regard to report ben sasse, we heard from senator susan collins. we heard from lisa murkowski with regarding to the way she was going to vote. all of them basically saying the president did something wrong here, but yet i will not vote to remove this president from office. i'm wondering what you make of the significance of all of this? is this them basically saying i want to get on the record saying the president did something wrong here, but not be on the

record with my vote? >> it's a way of having their cake and eating it, too. by saying that the president did something wrong they can arguably saying we're talking about maladministration, being bad at his job, doing something with questionable purpose and that is argue aboably acceptabl the constitution. the framers accepted maladministration being terrible at your job as that. they can conclude that the president did something wrong but can conclude that it doesn't rise to the level of a removable offense. that is something that is really critical because if they do vote to convict, if they say i do think the house has met its burden, but i want to convict the president but not remove him, they can thought do that, because a mandatory removal, on any conviction, no matter how serious or not serious is mandatory removal of the president. >> let me get your thoughts

quickly. i'm not sure the country has the appetite for another impeachment trial. in a normal process a person cannot be charged for the same crime twice. going forward, if there's new evidence that emerges if the house is able to get john bolton in front, and they realize there's something there. and if the president wins a second term, could there potentially be another round brought by the house? >> virtually, none of the protections that apply to a criminal defendant in the judicial brarcnch in the articl3 courts have any application to the article 1 impeachment trial which has virtually no established rules of lower inclui procedure, including the double jeopardy clause. there is no double jeopardy clause you could impeach the president arguably again on exactly the same conduct because there is so such protection as afforded criminals. if new evidence arises

welcome back, everyone. a new poll shows a three-way base between senator bernie sanders, joe biden and pete buttigieg. the suffolk tracking poll shows sand bers ers is holding steady 24%. biden and buttigieg tied at 15%. elizabeth warren falling at 10%. and meanwhile, saint ansem shows

biden and sanders at 19%. buttigieg at 14%. senators klobuchar and warren tied at 11%. and notably, 11% said they were undecided into next week. and in the emerson college, sanders, 32%. buttigieg and biden tied for second place. >> hitting the campaign trail, former vice president joe biden pounces on senator bernie sanders health care record. >> senator sanders and others who attacked my health care plan they say it's too small. first of all, they're dead wrong about what it covers. it was historic achievement that this party should be proud to defend but look, bernie has talked about the single payor medicare system for health care system for the country for 30

♪ welcome back, everybody. i'm yasmin vossoughian alongside ayman mohyeldin. we begin this half hour with continued uncertainty in iowa this morning. as we still don't have the full results from monday night's democratic caucus. with 71% of precincts right now, former south bend mayor pete buttigieg holds a slim lead over bernie sanders, followed by senator elizabeth warren and followed by former vice president biden. they're blaming the issue on a new app with coding that was meant to speed up the results. a statement released yesterday from tom perez, we have staff working around the clock to

assist the iowa democratic party to ensure that all vote counted. it is clear that the app in question did not function adequately. as frustrating as the last 24 hours have been, let us not lose sight of our ultimate goal, to defeat donald trump to take back our democracy. >> the tech company that built the app that failed in iowa monday night the official said although it contracts with shadow for text messaging service it does not contract for the app used in the democratic party. according to official records, buttigieg is not the only one who contracts with shadow. former joe biden had contracted with hem and kirsten gillibrand. >> and the biden campaign said

it felt uncomfortable with the app and stopped using it entirely on, one biden aide issued a statement writing in part this, our campaign used shadow only once on a very small zale for sending text messages to voters about our campaign kickoff in philadelphia. our i.t. team expressed security concerns about it and it ultimately did not pass our checklist so we declined to use it again. we should note that the biden used it to report results but the biden campaign is declining to use the app of their own volition. >> and nevada's democratic party announced they would not be using the same app for their own scheduled on february 22nd. shadow inc. developed the app for both states but following monday night's coding issue, nevada's democratic party instead it created backup plans for the system. in a statement issued yesterday, nevada democratic party chair

writes, nevada dems can confidently say what happened in the iowa caucus last night will not happen in nevada on february 22nd. we have already developed a series of backups. >> amit the chaos surrounding the iowa caucuses, democratic candidates are pushing ahead to the next state victory. >> you know, 24 hours later, they're still trying to figure out what happened in iowa. at this rate new hampshire might get the first thing after all. i'd like to make sure you rocket me out of here to make this thing works because if i come out of here well, you guys are going to set the tone for the whole race. >> obviously, we don't have the numbers, but we're coming out of iowa in the top three and straight into new hampshire. also remember, we're 55 states and territories after this. >> i don't blame them for trying to be really careful after what

mike bloomberg is doubling campaign ads. bloomberg was authorized to double add spending on areas where he's currently spending and expand the staff by 2,000 people. the mood comes after the outcome of the iowa caucuses, as he tried to ignore the first four states in february but aggressively with the states beginning in march. >> joining us now, a reporter for "the washington post" eugene scott. eugene, i want to talk about this app shadow inc. we heard that kirsten gillibrand had used his app. and pete buttigieg and iowa using this app as well. what do you make that all of these campaigns are using this obscure tech firm called shadow inc. and subsequently, this

happening in iowa. and of course we heard reports that there was not ample testing done leading up to the iowa caucuses. >> we know it wasn't an app that necessarily came out of nowhere. it was created by a former obama administration aide. so the relationships that many of these campaigns probably have with people on the shadow team made them feel comfortable with it and confident that the people involved had been involved in other digital products and experiments. and that would benefit elections and be helpful ultimately in iowa and nevada. but now, after the fact, of course, obviously, there are more questions that people have and less confidence people are having in technology. and it actually furthers the conversation we've seen, some act it visits and just voters say how the party and elections as a whole have become overly dependent on technology. perhaps efforts need to be put in place to just count votes and tallies by hand with security that could lead to more

confident and trust in the outcomes. >> eugene, the conventionals wi with wisdom, you come out of iowa and use that to launching the other states. now, we're in new hampshire without any clear cut winner. how does that chaotic outcome impact what we see play out on tuesday and the candidates themselves, the front-runners? >> well, certainly, it obviously depends on the candidate. i mean you have people like bernie sanders and elizabeth warren who are really hoping to stronger finishes in new hampshire due to their proximity in serving of communities close to new hampshire. then you probably have other candidates like biden who are just hoping they can do really strong and hurry up and get to south carolina or nevada. so the outcome of what you want to happen tuesday very much varies depending how well you did in iowa. and what you believe your path to victory is going to be. >> we know mike bloomberg now doubling down with regards to a

ads here. if you're mike bloomberg, how do you see this? >> well, this is not all that surprising in the sense he made it clear he was not going to lean in or participate in the early contests and he has the resources to do so. he also has a win, you now that he very well be participating in a debate and able to get his message to more voters including some of those who may have felt ignored by his absence in iowa and new hampshire. so ultimately the response from the president himself seems to be one of concern in terms of adding mike bloomberg to the list of people that he attacks regularly. and i think that is something worth paying attention to. >> eugene scott live in d.c. thanks. >> thanks. still ahead, a number of democrats decided to boycott the state of the union address, why several others walked out during president trump's speech. your "first look" at "morning joe" is back in a moment. ♪

tennessee we don't have any flash flood warnings yet but we will eventually get into those. the areas of concern as far as flash flooding goes. it's a slight risk, including all of the deep south and tennessee valley and portions of the appalachians, that's for today. today looks especially dangerous from asheville to boone, to charlotte and virginia. this is where it could rain so quickly and the ground is a little wet anyway, that we could have significant flash flood threat. our computers are hinting at the pact of 3 to 4 inches of rain from pensacola, all the way from central georgia on up. flash flooding kills more people than any weather threat, more than tornadoes or hurricane. as far as a slight risk of weather threat, we do have a slight risk of storms from alexandria and new orleans, through central mississippi right into alabama and the panhandle of florida.

about 12 million people at risk this afternoon, this evening. then tomorrow, this line of storms will march right through georgia and south carolina. wind damage, significant wind damage. we could have wind gusts up to 80 miles per hour possible with these thunderstorms and isolated tornadoes. so that will be the concern tomorrow. and that heavy rain threat along with it. so, very active weather, dangerous weather in the southeast over the next two days. so for today's forecast, snowy travel right now, oklahoma city. this evening in st. louis. overnight in chicago. and then we're going to have a snowstorm for northern new england come friday, one of the most significant ones we've had. it misses all of the big cities, rain from new york to boston but northern new england over a foot of snow. slumping sales lead to cuts and closures for one retail giant. and a new warning what to be leading the stock surge for tesla. the stories driving your business day, yeckes. next. always gaming

welcome back. a lot of big business headlines to get to including major news about retail giant macy's. willem marx is joining us from london on this. give us the latest on this. >> it's no secret sales at macy's have struggled in recent years and they are resorting to a time honored technique to goose their growth, that is closing stores. they have closed 100 in the last five years, they are announcing now they will close 125 in the next three years. they will focus on smaller

format stores going forward, closing the headquarters in cincinnati, tech offices in san francisco. another big u.s. firm watching closely, disney, they have earning out yesterday. investors focused on the subscriber numbers for the streaming service disney plus for the final three months of 2019 they came in at 26.5 million. the ceo telling cnbc they are at 28 and change in terms of their subscribers. that's a key metric. important to note that a fifth of those come from a partnership with verizon and there is no guarantee people getting that deal through verizon at the end of the year a free service will resubscribe. one other story, amazon founder jeff bezos has sold more than 900,000 shares in the company, it's doing particularly well in the stock market that equates to $1.8 billion worth. not the first time he's done this. he says he uses that windfall to fund his rocket startup blue

origin. >> let me talk to you about another billionaire, tesla owner elon musk, stock surging, experts are comparing it to a bitcoin spike in 2017. not sure if that is a good comparison or not. what is the concern about tesla's stock soaring there? >> well, you look at the price graph it's not a bad comparison to bitcoin. just yesterday tesla shares jumped 13% and they are up 110% this year alone. we are only early in february, don't forget. people are concerned that the fundamentals of the business, the ability to generate revenue, to make profit, does not justify this price. a lot of analysts out there saying that this is just investors piling in trying to make sure they don't miss out on this upside, each former presidential candidate ralph nader saying that the zeal behind this buying in tesla could lead to the next stock market implosion.

checked just about every republican group and then that spike the football moment where in a surprise worthy of a reality show melania trump put the presidential medal of freedom around rush limbaugh's neck. why it matters is numerically the president is getting stronger at the very time that he's about to have a vote on his acquittal for impeachment. amazing. yesterday gallup poll number coming out the president's highest approval number of his whole presidency 49%. 49% and the republican party has the highest number since 2005, 51%. you can imagine democrats shaking their heads. >> it was incredible to see some of those numbers as the president was heading into his state of the union amidst all that was happening in the last couple weeks or so. let's talk about iowa, mike. mayor pete buttigieg a good night in iowa to say the least.

what impact is that going to have on joe biden's electability message? >> yeah, so iowa is going to have a long shadow on this race even though the results are going to wash away. top biden supporters that we talked to were in kind of a dire mood after the night. his weakness there, whatever the numbers turn out to be, really was a sign of danger. a big challenge for vice president biden is how does he keep democrats floating him. at the same time pete buttigieg was robbed of what would have been an incredible national momentum triumph story if numbers on election night had showed him as the apparent victor in iowa. he came out 12:20 in the morning eastern time giving a speech claiming victory, not quite the same as the numbers coming out for you. the question can mayor pete convert. going to new hampshire

whereabouts looks best positioned to win. she's a neighbor to elizabeth warren also strong. can he get the money, excitement, media momentum that would normally come with a real iowa win when you don't have an app debacle. >> let me get your thoughts quickly on that. how will iowa likely affect candidates ground game in the state of new hampshire ahead of next week's primary? usually there is a little momentum coming out of iowa. nobody can certainly claim that. >> that's right. usually candidates split more of their time. these candidates have really gone heavily into iowa, have spent surprisingly little time in new hampshire. we will have a big debate in the next couple of weeks about these early states. a number of top democrats told me yesterday that they think that in the end these four early states will wind up going on one day instead of iowa, new hampshire. today "the boston globe," a neighborhood paper in new hampshire out with an editorial
