good monday morning, everybody. it is may 25th, memorial day. we are remembering those who lost their lives during a battle we're still trying to win against the coronavirus. the u.s. death toll from the virus is now approaching 100,000. eclipsing that of the wars in vietnam, the persian gulf and afghanistan. the "new york times" covered the front page with the names of americans who lost their lives to covid-19. just a fraction, 1% of the deaths so far. another headline that sums up the weekend comes from "the

washington post," quote, on weekend dedicated to war dead, trump tweets insults, promotes baseless claims and plays golf. the president visited his golf club in virginia on saturday and sunday. he said nothing about the rising death toll, but he did find tweets to most nancy pelosi and stacey abrams and continued to promote a baseless conspiracy theory about any colleague, joe scarborough that has been de-bunked several times over. the biden campaign wasted no time in putting out this ad.

and biden tweeted the presidency is about a lot more than tweeting from your golf cart. it requires taking to the ultimate responsibility for the biggest decisions in the world. donald trump simply wasn't prepared for that. i promise you, i will be. the president tweeted in part this, sleepy joe's representatives just put out an ad saying i went to play golf, exercise, today. they think i should stay in the white house at all times. heading into the holiday, dr. stevens hans tweeted this, the

coronavirus is not yet contained. >> but president trump tweeted yesterday, cases, nbts and deaths a numbers and deaths are all going down across the country. meantime, a new research study highlighting the risk of a second wave of infections in places that are opening too quickly or without precautions. researchers at imperial london created a model using cell phone data showing the coronavirus may still be spreading at epidemic rates. in 24 states, particularly in the south and in the midwest, as well. according to the report, the model, which has been peer reviewed shows potentially ominous scenarios. if people move around without taking some of those guidelines, some of those precautions, for example, the study suggests that in california and florida, the death rate could spike to roughly 1,000 a day by july without efforts to mitigate the

spread. joining me now, political editor for the washington examiner, david mark. david, good morning to you. thanks so much for joining us so early on this memorial day. very much appreciate it, my friend. memorial day taking on an even more somber tone than normal as we reach this terrible milestone of 100,000 deaths. it is staggering to think about from the coronavirus. the president, however, golfing over the weekend, retweeting, not necessarily seem to go accept the gravity of what is happening under his watch in this country. what are your thoughts? >> this is an extension of the strategy, if you want to call it that that the president has employed going on three months now where he makes it seem like he has to do something in response to the spread of this terrible deadly coronavirus. but he always wants an out.

he always wants to be able to say you know what? it's not a big of a deal. even a number approaching 100,000 deaths, it's just a small fraction of the u.s. population. i don't know that he said that, but many of his supporters have. and so it's an extension of that and it's the kind of thing that is going to get litigated in this election coming up in november. either people support that point of view or they throw it out and they said we need a president who takes this thing really seriously 24 hours a day. >> the president is also tweeting that schools should be open across the country. i want to circle back to joe biden's ad that i played earlier and the president's defense for playing golf this weekend. what are you hearing in

washington with regard to the president's choices over the weekends? >> remember, the president has not worn a face mask in public. he's taken a number of other steps that don't seem to comply or comport with the safety guidelines that his own agencies are issuing, when it's the centers for disease control, a lot of the doctors, physicians advising him. so no great surprise that he is going to do this. president trump said in that tweet, it's just exercise. no problem. i think everybody needs some exercise, but you can probably do it inside the grounds of the white house, not in front of the cameras. that is what is giving former vice president biden some political ammunition there. >> david mark, thank you, as always, my friend. i hope you're able to enjoy your day ladies. still ahead, the department

welcome back, everybody. on friday, the white house and state department failed to hand over to congress documents related to the firing of inspector general steve linick. house foreign affairs committee chair elliott wrangle and bob menendez called for all documents relate to go linick's removal to be turned over by friday, may 22nd. linick was fired a week earlier at the request of mike pompeo after investigating the secretary's use of a political appointee to run personal ashds and the sale of arms to saudi arabia without congressional

approval. linick's investigations led to a lot of lawmakers on both sides of the aisle to suspect the firing was retaliatory, prompting the request for related documents. secretary pompeo denies any retaliation. and a federal judge ruled yesterday that it is unconstitutional to prevent felons from florida for voting because they can't afford to pay backcourt fees, fines and restitutions to victims. the law, passed last year, would have forced felons to pay all court fines and legal fees before they could register to vote. republicans and governor ron desantis pushed the measure after floridans overwhelmingly approved a measure to expand voting rights to felons who completed all their requirements.

this is coming just months after the state could play a deciding role in the election for the president of the united states. also, the department of justice is adding its support to an illinois lawsuit challenging coronavirus related stay-at-home restrictions. on friday, doj lawyers filed a state of interest against congressman derrick ballon of illinois. in a press release, the doj says it was taking the action as part of attorney general bill barr's initiative to review state and lolg policies to ensure that civil liberties are being protected during this pandemic. there have been over 110,000 recorded cases of the coronavirus in that state and

nearly 5,000 deaths. joining me now to talk more about this, msnbc analyst danny cevallos. good to see you on this monday morning. >> good morning. >> let's talk about some of these lawsuits. given that there are lawsuits against several governors over their covid-19 restrictions, is there any sense, danny, of why the illinois case is the one that the doj decided to join? >> generally speaking, the fact that the doj is even involved based on its argument is fascinating. essentially, the doj, a federal agency, is arguing to a federal court that this does not belong in federal court, this issue belongs in state court because the federal courts have no jurisdiction. yet the doj, a federal agency, is getting involved in a dispute in federal court that it thinks federal courts should not be involved in essentially. so it's an interesting argument that the doj is making to begin with. anytime a defendant removes a

case to federal court out of state court, it's a purely strategic maneuver. it could be that this state representative files in a court in southern illinois because maybe he felt he had the advantage. and one thing they did here was take the dispute out of there and into federal court. and is often the case, then plaintiffs fight to get that kicked out of federal court and back down to state court so they can enjoy the forum that they selected. >> so to be specific here, danny, in this case, who has benefited from it being seen in the federal court? >> in this case, the defendant has chosen to remove this case to federal court. essentially the illinois governor is taking this case up

to federal court and arguing essentially that it involves constitutional or federal issues. but that isn't always enough to keep a case in federal court. if you are a plaintiff and you alleged only state causes of action, you're saying, look, i don't want my case in federal court. this doesn't implicate any federal or constitutional issues. so then a defendant has to make some really compelling arguments to keep this case in federal court if there was never a state -- or if there was never a federal issue implicated. federal courts are courts of limited jurisdiction. they're designed that way. they're really only supposed to have jurisdiction over a very narrow area of issue. >> danny cevallos, my friend, thank you, as always. please try and enjoy your memorial day ahead and my best to your family. still ahead, president trump claims his weekend golfing was his way of exercising. but as you would imagine, that is not stopping questions over

visit hope.tidecleaners.com to learn more. welcome back, everybody. president trump once again took to twitter yesterday where he asserted that mail-in voting leads to criminality. he tweeted this, the united states cannot have all mail-in ballots. it will be the greatest rigged election in history. people grab them from mailboxes, print thousands of forgeries and force people to sign. also forge names. some absentee okay when necessary. amid all of this, there is a growing concern among some that the president and his allies could disrupt the november election as he continues to attack mail-in voting and insinuate that the voting system

is rigged. a group of mostly democrats and some anti-trump republicans have been gaming out various doomsday options for the to 20 presidential election. just last week, trump threatened to withhold funding from states that expanded mail voting and repeated unfounded claims of voter fraud in battleground states. trump's campaign for their part has dismissed the zoet among some as the inability to accept the president's vick forefour years ago. while democrats are cautious about voicing their concerns too loudly, fearing it could depress voter turnout. also, the president turning his

attention to the november election attacking joe biden's mental state on friday. >> what do you think joe biden's strongest feature is with joe biden? >> i would have said experience, but i don't think he has experience because i don't think he remembers what he did there yesterday. he's been there a long time. he was never known as a smart person. he's not mentally sharp enough to be president. he has china, all these countries, russia. i will get alo i get along with putin. i think he likes me, but i'm sure he doesn't want me to win. china doesn't want me to win. but biden doesn't know he's alive. i'm against somebody. think of it. i'm against somebody that can't answer simple questions. i've never seen anything like it. >> let's get to the president's

welcome back, everybody. we're going to begin this half hour with president trump's called for a, quote, essential places of worship to reopen this holiday weekend. openly defying governor's orders for churches, synagogues and mosque toes remain closed amid virus concerns. >> i am identifying houses of worship, churches, synagogue, and mosques as essential places that provide essential services. some governors have deemed liquor stores and abortion clinics as essential but have

left out churches and other houses of worship. it's not right. so i'm correcting this injustice. i call upon governors to allow our churches and places of worship to open right now. if this is any question, they're going to have to call me, but they're not going to be successful in that call. the governors need to do the right thing and allow these very important essential places of faith to open right now. for this weekend. if they don't do it, i will override the governors. in america, we need more prayer, not less. >> so trump does not say what legal authority he had to force governors who maintain the power to order establishments to remain closed during public health emergencies in their own states, to make such a move if they disagreed with him.

and the white house pretty secretary clashed with reporters on friday while defending if president's decision to override governors and reopen places of wierp. >> what federal you law allows a -- >> the president will strongly encourage every governor to allow their churches to reopen and boy, it's interesting to be in a room that desperately wants to see these churches and houses of worship stay closed. >> i object to that. i go to church. i'm dieing to go back to church. the question that we're asking you and would like to have asked the president and dr. birx is is it safe? and if it's not safe, is the president trying to encourage that or does the president agree with dr. birx that people should wait? >> jeff, it is safe to reopen your churches if you do so in accordance with the guidelines which are laid out in stringent detail here about promoting hygiene practices and clothe face coverings. if social distancing is not

possible, it's recommended. intensifying cleanings, promoting social distance, we lay them out meticulously. >> so some republican governors are warning against politicize american's choice to wear masks to stop the spread of the virus. in north dakota, governor bergan issued a plea to avoid the idealogical or political divides. >> if someone is wearing a mask, they're not doing it to represent what political party they're in or what candidates they support. they might be doing it because they've got a 5-year-old child who hash going through cancer treatments. >> in ohio, governor mike dewine dismissed the politization of wearing masks in public. >> this is not about politics. this is not about whether you're liberal or conservative, left or right, republican/democrat.

you wear the mask not to protect yourself so much as to protect others. this is one time when we truly are in this altogether. >> so as the country's death toll nears 100,000, the president spent yesterday tweeting about reopening schools in this country, most of which have been closed since march as a result of this pandemic. shortly before the president tweeted fox news host steve hilton was talking about this topic, urging schools to reopen, quote, reopen now before you do more unneeded damage. later that evening, trump tweeted this, schools in our country should be opened asap.

much information now available. what do you make of the president's push now to reopen schools, especially in the midst of this question mark so many doctors have about this inflammatory disease children are developing as a result of covid-19? >> well, first he doesn't have the legal authority to require schools to be open in the fall. that is something that sits with the governors and that's something that's been fact checked by my colleague extensively.

so he can do nothing more on this issue than to make an opinion. about but the call to open schools sits on the broader narrative that he and his advisers want to move on to the comeback story and certainly by the fall to have the virus behind us. so in his telling, in his narrative, there would there will not be widespread narrative in the fall so in that situation, schools could theoretically be open. when dr. anthony fauci was asked about this, he said essentially schools might not be able to open in the fall if they're in an area that's having an outbreak or that still has widespread virus going around. and the president's solution to this has been older teachers to

stay home, but as you mentioned, now we're finding out there might be issues with children here. so a lot of public health experts say it's too early to know what's going to happen in the fall. >> and we know a lot of schools across the country are preparing for the possibility that they may not be able to reopen come september. i quickly want to circle back to your piece on the president deeming places of worship essential and threatening governors to reopen them in their prpive states. tell us more about this move and the newly reissued cdc guidelines for these institutions. >> like with schools, the president doesn't have the legal authority to force churches to open. even though he said he wanted this weekend churches open immediately, many churches weren't opened. the issue of churches is quite significant because there's been a number of documented cases where this virus has spread

rapidly throughout a church. the cdc guidance was issued friday afternoon, a few days before the president wanted the churches to reopen. those guidelines tried to get into some of the ways that they feel the virus has spread, communalhymnals, having the congregant singing is something churches should reconsider as well as the broader distancing measures and hygiene. >> shannon pettypiece, thank you. so the white house announcing a travel ban for most non-u.s. citizens from brazil as the south american country is quickly becoming the next epicenter for the pandemic. now only second to the united states in overall cases. the president's order states fourteeners who were in brazil

"the washington post" reports the study published friday is the largest analysis to date of the risks and benefits of treating covid-19 with the anti-ma layeral drugs.

according to the post, for those given hydroxychloroquine, there was a 34% increase in a risk of mortality and a 137% increase of a risk. there was a 411% increased risk of heart arrhythmias. bill, as we are approaching this incredibly grim milestone of over 100,000 deaths from the coronavirus, looking at that "new york times" yesterday was just sad, it was astounding and just incredible to see in print. we're seeing some light in parts like the east coast of the united states. we are seeing the death toll

tick down. >> yeah. there is some good and there is some bad. going into that 100,000 number, and what really gets me is since this began, those people haven't been mourned properly, they haven't been buried properly. and not just them, but anyone who has perished over the last several months. that brings the number up to like 10 million people or so. so let's get into the number of yesterday. yesterday was by far the lowest reports. it's a sunday, it's a holiday weekend. some people thought we would hit the 100,000 mark yesterday. we had 617 fatalities reported sunday. that was the lowest going back since march 29th. that's really when things started escalating. that was a bit of good news. if we have a low number today, he with might not quite hit that 100,000. if it's not today, it will likely be tomorrow. as far as the new cases went, this number was not as low as i was hoping.

we're still averaging around 19 to 20,000 new cases each and every day. the fatality rate in our country is right between 5% and 6%. so every day that we have 20,000 new cases, that's another 1,000 people that are going to lose their battle and fight with their lives to this disease. so, you know, we really need the number of new cases to significantly drop. so let's get into the weather forecast and help you out on your memorial day. we have a huge story and heat wave developing in areas of the west. it's not just going be hot. it's going be mid summertime hot. 112 in phoenix. downtown l.a. will be cooler at the beaches. vegas, up around 110. so your week ahead forecast, memorial day, heavy rain in south florida, more thunderstorm action, watch out kansas city, tulsa, oklahoma city, some could sneak into dallas. by wednesday, it's kind of the same thing. rainy and nasty in areas like

louisiana and arkansas. by the end of the week, the rain will arrive in areas of the east coast and northeast. hot conditions throughout the next couple of days. it's great to see the fatality number dropping, but the news cases, 20,000 new americans each and every day. yeah, it is astounding as you see on the east coast numbers are dropping in certain areas and in states reopening, those numbers are continue to go spike and go up. so it is just a wave of emotions every day. still ahead, we're going to get a live report from beijing. as we go to break, a positive indicator in the global battle against the coronavirus, a new study by infectious disease experts in singapore finds covid-19 patients are no longer infectious after 11 days of getting sick. even though some may still test positive. according to the study, which is based on 73 patients in the city state a positive test does not equate to an infectious or

welcome back, herb. china's move to exert greater control over hong kong caused more turmoil over the weekend as protesters defied social distancing rules and clashed with police who fired teargas and a water cannon arresting at least 180 people there. critics of beijing's move to impose a national security law in hong kong say it is an attempt to stifle dissent, putting an end to the city's independence. the white house said yesterday china will likely face sanctions for its actions in hong kong. janice is in beijing for us. good morning to you. great to see you on this monday morning. let's talk first about the

possibility of sanctions. has beijing at all responded to the u.s.'s call? >> beijing has of the u.s. saying that hong kong is a domestic affair. that it is china's right to enforce security and sovereignty. that they will put these laws into place, whether the u.s. likes its s it or not. there is growing condemnation of this plan. the u.s., uk, canada, australia, all expressing concern that the new security laws will compromise, even jeopardize hong kong's autonomy, raising questions about the future of the one country, two systems policy that has protected liberties in hong kong since the handover in 1997. but this is, yasmin, part of a growing list of problems between the u.s. and china.

this blame game that has been ramping up, in particular over the past several weeks, from the origins of the coronavirus to the trade to the expulsion of journalists from china. there are a lot of issues testing the u.s./china relationship. the foreign minister yesterday even suggesting that it is pushing ties to the brink of what he called a new cold war. meanwhile, the national security adviser, robert o'brien, was saying on "meet the press" yesterday that the u.s. will assess hong kong's autonomy. the special status that it ejoy enjoys, that makes it a special hub, that it believes china should hold dear. they say they'll watch china's next move closely, as laws are expected to be put into effect by the end of the week. >> it seeks specifically the protesters in hong kong, they don't want beijing, they don't want china to have the ability to have more power, more

security forces in their region, in their city. what has beenexplanat explana explanatoion for why now? >> reporter: i saw families, elderly people, kids. there was a different spirit that seemed to exist at the beginning of the protest by the time we saw september/october rolling around. the protests had escalated, at times becoming violent. beijing has used this as part of its argument to say that there needs to be security and stability for hong kong in order to protect the economy, which is in recession there. in order for it to be able to have the sense of control. the people in hong kong, of course, see this as a compromise of the freedoms that they have
