that would be an effective political strategy. the white house not surprisingly is called the reporting incorrect. what is clear, in trump's america there are two groups. our people, quote unquote, and the rest of us. keep in mind, kushner and trump are from blue states. they were both willing to toss aside friends and neighbor, the people they literally grew up because it was expedient to expose those people to sickness and death. they seem nice. there are reports however that trump has become more engaged with the crisis now that it's affecting what he and his crew call our people. the virus surging if states like arizona, texas and florida. in fact, today, florida saw its fourth straight day of record reported deaths. while florida is melting down and facing a potential hurricane, trump held a mini rally of almost uniformly maskless supporters when he landed in tampa earlier today. for more i'm joined by jonathan

lemure. this idea that the administration delineates between myself and every one else is sticking in my kraw. how would a white house think it's good politics, assuming that the virus is also a political virus and never even reach their people. >> obviously, the virus doesn't care for politics or about state borders. it doesn't know anything about the electoral college. from the beginning the administration has handled this in a politicize way. he's never been one to rally the nation in a time of crisis.

this pandemic has been no different. to be clear, the white house strongly disputes some of the details in this story. right from the beginning, there was a sort of blue versus red dynamic here and not just politics of masks bp you'll recall when the virus first struck and new york was the epi epicenter, the president floated the idea of isolating new york. sort of sealing it off from the rest of the country. he floated that while talking to reporters. he quickly backed away from that. while we reported at the time, he did so in part thinking he would be a reassuring signal to his supporters in other states he was dealing with the crisis that was over there in other places, blue states, ie, new york. there hasn't been a sense and effort to have any national plan or strategy here even as the president's poll numbers have taken a beating because of his handling of the pandemic. you mentioned florida. arizona and texas, too, are now electoral battlegrounds where

last month in florida, we had 25,000 children under the age of 18 that tested positive here in the state of florida. that's 900 kids per day in the state of florida. we're in the epicenter of this virus. we do not have it under control and a governor who has tethered himself to a secretary of education who should be dismissed because she has no background in education. she's supporting the school she's trying to undermine and underfund for the last three and a half years. we need help. we need mask mandate, testing, tracking and tracing. we need ppe. we need an infrastructure change like we've never seen. lit cost us more money to educate our kids than less. we need to get in school and now florida is in the epicenter of this hurricane. now we have two crisis going on. our governor has not given us leadership. we're looking for this but we need to do this because there's 2 tn 2.8 million children depending on us to get back in school.

trump can't delay the election. everything will be fine. we're going to have an election. they're not the only elected republicans out there. is there a concern that the even more sycophantant runs in the states would get in the way of a free and fair election and hand it to donald trump? >> there's a possibility but i wouldn't get too alarmed about it. there is a statute that congress passed that says if the election does not produce any winner in a state, then it's permissible for the state legislature itself to nominate a slate of electorates. that could happen in states like pennsylvania or texas but it would not ultimately carry the day because it's up to congress when it counts the votes in january, actually, this time

it's going to be on january 6th. it's the new congress to decide which electors to consider. there is a procedure, very elaborate procedure in every state for resolving disputes by the date of the so called safe harbor on december 8th. really all of the efforts that trump is making to both pretend that he can extend the date of the election, which ever one understands he can't do that. that date is set at november 3rd by act of congress. all of that is designed simply to cast doubt in the way that putin wants to and the way that bannon has tried to do from time to time on the ability of our system to work. they're trying to make it look chaotic but there's a fail safe mechanism built into the constitution itself. no matter how much dust he

throws into the gears, at high noon on january 20th, 2021, if there has not been a new president elected, at that point, nancy pelosi, speaker of the house become president of the united states. all of these enables and i very much agree with tom nickels that the most dangerous of them is not one of the clowns but is william barr, all of the enablers at that point woud risk committing federal felonies if they were to exercise power which they no longer have because trump would no longer be president. that's the fail safe. constitution is not designed to self-destroy but it's designed to self-preserve. the real game that i think trump is playing is a game of making us all doubt that the system will hold. making us doubt that it will

so much that nobody, there's not enough of the states counted, ballots counted by december 6th or whatever that a state says we can't complete our vote count because it's not come through the mail and lots of lawsuits. william barr files lawsuits on trump's behalf and says these elections aren't valid. say the battleground state, arizona, florida, michigan, north carolina, wisconsin say since we couldn't get a vote count, we decide the trump electors is who we will see. can congress say no, we're not taking those? >> exactly. in some of those states, i think north carolina, michigan, pennsylvania, wisconsin even though the state legislature is a republican control, the governorship is in control of the democrats. the legal procedures in those states for deciding whether there is a winner and if so, who is winner is by the safe harbor

we're losing -- it's spiking again. it's all his fault. he ignored it for two months and if you look at just how we did compared to other developed countries, south korea, i believe had it first case the same day we did. since then, they had 51 million people. since then they've had 301 deaths. florida has approximately 21 million people and yesterday they had 253 deaths. we know exactly what to do. you have masks. social distancing, testing, contact tracing and isolation. that's what other countries have done and guess what, then these countries have been able to open their economies and the disaster numbers that we got for this last quarter are all on him.
