her cast ket was walked docaske as her hearse pulled away, it started to rain. a military honor guard carried justice ginsburg. many lawmakers paid their own respects. with the motorcade departing the capital, it marks the end of a week of public memorials. she will be laid to rest in a private ceremony next week next to her husband at arlington national cemetery. the focus now switches to her successor of the high court. president trump did not attend

it has been a week lash week when you have a death of a sitle spreek court justice, there is a lot of people that would like to take a breath and mourn, but there is a pace to hurry up and start the politics of all of this. the politics speeding it up even more so. >> when i think about what it has been like for the last seven days since she passed away. what we were all doing on friday nights as the news rippled across washington. my initial reaction was that everything has changed. and in some ways it has, but the fact that her passing, when it happened, means that the court

is potentially dramatically different for a very long period of time. from a political perspective, we very quickly got right back to status quo. it has been in some ways hard to spend the time reflecting on what just happened here. i'm grateful i got to spend a few moments here at the capitol focuses just on that. i have also been chasing senators through the hallways, and the focus is how do we get it nailed down and shut in time to get a new personal in place ahead of the flexielection. it is remarkable. this is not like, you know normally we would see all four leaders at a moan of this magnitude. we would have seen mitch

mcconnell and kevin mccarthy out there today. and they weren't, we don't know why they weren't here. i need to check with our reporters, i don't know if he is campaigning in kentucky. i was told there is no updates to senator mcconnell's schedule, but if they apt ceremony like this in the rotunda, they have to have the leaders agree. this was in the former house of representatives. not to tack away from what she just received for honor and ceremony, but the reality is that no one can explain why this wasn't in the rotunda. i think it really speaks to just how divided things are. the fundamental reality is that it violates her dieing wish and

with carol lee. the president woke up this morning in miami, and while he did not supposedly have an interview scheduled, the question is is amy comey barrett a deal? or did he start thinking there is an alternative way to go? >> the president said he is close to making a decision and everyone that we speak with sees judge barrett. they have 90% of a chance on jud judge, and they are pushing for judge logoa. there is competing advice about how he should proceed, who he picks, and the timing of any

senate confirmation. there are some leaders that have been telling the white house they will only accept a white house, someone like judge barrett. someone that demonstrated they're opposed to roe v wade, and saying judge lagoa does not. others say that anyone on the slis fine, maybe some of the supporters will be less energized. the president really needs the voters to turn out for them. they are key supporters, chuck. >> i have to say, do they really think that if the judge -- the one ridge i think with judge

barrett is that abortion becomes an issue in the last three weeks of the campaign and all of the evidence seems to point, i don't know how it helps the president. his problem with women in particular, and in the suburbs, that seem to be the last thing they would want. a real fight about roe two weeks before the election. >> that is a great point, a point that some of the president's allies have been making to him. you don't want to have someone so conservative that it further alienates suburban women. but you have real religious conservatives saying to the president look, the bigger the fight the better. that will energize your supporters. on top of that some of them are saying the timing of this, they're urging the white house to not move forward with a confirmation vote. they're saying it would take away from the enthusiasm.

either way, whether or not it is a a judge or someone else, there is a feeling that if the president pushes for a vote before election day that it is one of the president's close allies they said it would be like having your kids have desert before their meet and vegetables. >> well, that is interesting. there is a lot of different theories about getting the votes while you have them or waiting to see what happens on election day. on the abortion issue i want to go to alison barber. you have spoken with some voters on this. what did you find? >> i spoke with those voters after they were leaving a prayer vigil. they were having a prayer period

to try to end abortions. they personally identify as pro life voters. they oppose abortion rights. overturning them coming from this president, it is not just a political issue, it is the political issue. they say in the words of one advocate that i spoke to, that when it comes to politics this is the issue because in their view nothing -- all of the rights in their view -- they should not assume. >> i don't care if it is a democrat or republican. it is an important issue. >> i think it will make some people more hardened in their advocacy for life. is that my top issue? it has been all of my life.

>> all of the voters identified asevangelical, but certainly what they would describe themselves as was devout christians. they point to some of trump's behaviors past and present as not in line with christian. they say because of the issue of abortion and overturning roe v. wade is so important to them, it is different. i asked voters that we spoke to if it bothered them that republicans were on the record in the past saying they didn't think a vote on a supreme court nomination should be held so close to the election year. they said it doesn't matter how we get there, just that we get there, chuck? >> alison, down there in

time. donald trump look u.s. like he will get three justices on the supreme court. in history that is a really large number for any president within less than four years. as a result, this court may end up deciding a contested election in the next couple months. what if other things happened deferently. 2016, if mitch mcconnell had not deprived barack obama of the ability to confirm a justice of his own choice. 2018, if trump and others did not lean on justice anthony kennedy, to get kennedy to leave the course in favor of justice cavanagh, and then finally if the republicans had not taken such an aggressive position this

sending $200 in drug coupons for seniors. it's unsir if he has the legal support or the power to do that. the president also signed an executive order on pre-existing conditions. he restated the law and support for obama care. all of this was in an effort to thwart criticism. and then, there was the amount of money that they decided to send to puerto rico, aid, an election year announcement. and they're concerned that he will try to use the power of the military around the election. we'll have more on that in a moment. joining me now is peter baker. he is an msnbc political anal t analyst, and matt miller.

so peter, you know my first campaign, presidential campaign, was the 92 campaign. and i remember george h.w. bush. he was landing in swing state after swing state promising this government contract and this government program, but he did promise things going forward that he actually had the money to promise or it was a pledge. this is something new all together, this essentially sending cash to voters. particularly voters that he really needs. older voters. >> every president trying to use the advantage of the incumbency the best they can. sending cash in the last few weeks of the campaign, it does raise questions. and we saw time and time again examples where his

administration has been politicizing something in advance of the election. the timing of a vaccine, whether or not it is the timing of this durham informativestigation int obama era fbi. a investigator quit because he is was pressured to find results before the election. we said the other day that she was forced to endure 18 hours worth of meetings to convince her to sign what she called a false affidavit to try to stop john bolten's book from coming out. it looks like a lot of politicalization. >> the other thing he has been using the bully pulpit to do is to butt into doubt the validity

we be ignoring these threats? >> i think he does like to get us in a tizzy talking about this kind of thing. he likes to freak out the establishment. but i think there is a consequence that goes beyond just whether or not we have a tv show about it. the democracy rests entirely on the belief by the people that it is fair and that it works and that it is not corruptied. the more they say it doesn't work, that it is rupgs, ork it will sew doubt. this is the whole purpose of the intervention to make americans doubt their own system and democracy. whether or not he means to, the president's language lately has played into that rather starkly.

the name trump on them. >> they had no names on them. >> they still found them in a river whether or not they had a name or not. the others had the trump name on it and they were thrown into a waste paper basket. they put out a release, and the first included a claim that they were trump ballots. that was withdrawn, but this was highly unusual and highly political. we should not be surprised any more, but even this seemed like a new line that was crossed. >> it was highly unusual, highly political, and highly inappropriate. look there are a number of rules that the department blew through. number one there is a overall rule that the doj doesn't comment on ongoing conversations. there is stronger rules for investigations that involve elections. sometimes they don't interview

people because they're afraid of the fact that doing an interview will go public and it will cast doubt on the election. it doesn't achieve anything in terms of the investigation. there is no agency at the local election. officials here were trying to hurt the president. it is irrelevant to the investigation. the only way you would make that claim publicly is you're trying to hurt the president. i don't have any faith in bill barr. we have seen how he politicized the department. this is a press release that came out of the middle district of pennsylvania. when you think about the election is not a national election, but a series of 50 individual elections, it tells me some of the construction that we see at the highest levels have seemed out into the field

if he invokes it, there is not a lot that folks can do about it. >> technically he has some authority. the fact that we're talking about this is alarming. but act that limits his authority and the instruction, it is rarely used in history without a specific request for a governor. so the civil rights riots. the request for the governor. the only times it has been used without a request from a governor is whennize ize eisenh president kennedy were enforcing the laws. so this is a rarity in american history. the president did not talk about krusing this act in such a flippant way, and i think is very port for them to think through the scenarios. again, that deployment of the

net gene of three nat seats. that would be 50, so are there any democratic incumbents who are in danger. there is one right now trailing in the polling, not a big surprise here. doug jones in alabama, if that result holds, that would be a loss for democrats, gain for republicans. democrats then need a net gain of four. if they're unable to hang on in alabama. so the next category is what about republican incumbents in this situation? how many republicans when you look at the polling right now are trailing and the answer at this moment is five. there is five republicans in the average of polls. we have been getting polls this months. tillis, ernst in ohio.

now biden and trump are very close. you have democrats leading in the polling in these senate races. again if they lose alabama they will need a net gain of four. to take it one level further, how many races is there a republican incumbent who is ahead, but the margin is within five. so maybe striking range for democrats. you can add three more there. there is lindsey graham in south carolina. so you're seeing a lot of targets there. one more category, we call this the wild card. some races here that we don't have much polling in but folks are looking at. alaska, kansas, you have a special election in georgia.

the republican seat won't be determined until after the election, and there is one incumbent there whose lead is in the high single digits right now. the totality of that, you talk about a big biden lead nationally. it translates to a lot of opportunity there's for democrats and very few for republicans to play offense. >> you know, steve, it is a huge senate battlefield this year. the number of senate races that is going to have the winning candidate not be over 60% will probably be among the highest we have had. there is even a few other races that look they're low double digits, but minnesota, mississippi, it is extraordinary how overall competitive and part of that is just the money this year. ste steve, what a overview, thank

drive-in voter registration. it's a whole new way of looking at motor voter. >> that's right, chuck. and there was a pretty steady stream of folks this morning, eager to get in line and get that done. they have got a dj out here, sort of spinning tunes as folks do drive up or walk up if they choose to to get registered and they're giving out these houston rockets masks and also cups with some of the folks' favorite players on them, but you know, data early on showed voter registration in texas during the first seven months of this year was actually down compared to 2016. and a number of organizations were very concerned about what that would mean here, but those numbers have completely turned around. there are now more than 16.6 million registered voters here in texas. that is huge. and the real question is what impact will this have when those election results begin to come in? the houston chronicle actually did an analysis of where those new voters are coming from, and found that one third of them are

in democratic strongholds, so counties with big cities like houston, san antonio, and austin. but their analysis also found those suburban districts where donald trump won in 2016 are also seeing an uptick in registrations. it's going to be very interesting to see the impact of all these new voters and all these new ways to vote. what impact that could have on election night. i will say, i have spoken to about half a dozen voters who came in to register today. one of them told me that she was voting for biden. inothers told me they were still undecided. now, i know folks in texas like to keep those answers kind of close to their chest, so it would be that they just didn't want to share, but very interesting that folks are still considering who they're going to vote for, roughly three weeks out from early voting starting here in texas, chuck. >> well, priscilla thompson with a fascinating event there that you're covering. you know, the voter registration
