"new york times" poll shows joe biden holding a small but durable lead over trump in the tar heel state. the democratic candidate leads 48 to 45. which is within the margin of error. in florida, nearly 800,000 new voters voted early. the state shows biden leading trump by four points. also within the margin of error. similar poll in september showed the race tied. at 48. less than a week left to lock in the votes, both candidates are chris crossing the country. today both in florida. a state that can make or break a candidacy on election night. biden in broward county made a closing argument. >> in the final days keep that sense of empowerment with you. that sense of optimism. what we can do and will overcome. i have never been more optimistic than america than i am today. november 3, we'll unite this country and show the worltd who

he used the party from the beginning. he's using the voters now. for a grievance campaign. i was having this conversation about leaving vote rs out in the cold and today in the heat. it is a compelling story. it's just a capstone on the fact he is drawing crowds out in the middle of a public health pandemic. and he is risking their lives. herman cane being a perfect example of somebody who lost their life because they chose to attend rally. he's lying about the public health consequence of public events. leadership matters that the power of the bully pulpit is an awesome force in america. and there are thousands upon thousands of people trusting his word and his word is a lie. it's risking their health and lives. >> to which he would say who is her man cain? i don't know him. welcome to the show. you haven't been on yet. i have watched you so i'm

excited. let's talk about the trump campaign strategy. throwing the polls out, biden is up if florida. he's still up. dhai that's dangerous for florida. up in iowa. but one point. pennsylvania he's up over 50%. up in ohio. at this point, does the trump campaign understand where they really are and do they dare communicate that? if they understand where they stand, do they dare communicate that to the candidate? >> president trump talks about this when he's out on the campaign trail. in michigan he was bragging about polls that showed him up by 3%. and goes onto say the polls are fake. not real. suggesting that there internal polling is showing better

fortunes. what we're hearing is the internal polling isn't shows things going wonderfully for the president. and not doing much better in these states like michigan, pennsylvania and wisconsin. in the way he's talking about publicly. no, we don't think those internals are showing him what he wants. it doesn't matter. you know this as well as i do. what the reelection team tells him or advises him to do. they want to talk about the economy and hit joe biden. donald trump is not doing either. he's talking about anyone but joe biden. who are increasingly women and women of color. and he's not really talking about the economy for long. because he's too busy talking about a grievances and people and institutions against him. even it if the team was talking about internals he doesn't listen to those around him. >> democrats have such deep ptsd

they seize the numbers and don't believe it. i feel bad putting them up. i don't believe that because of 2016. if you look at data. it wasn't wrong. it was there a lot of margin of e error and trump got the undecided. digging deeper into the in your opinions. i'm sorry audience. i love polls and numbers. of the people who voted early by party, democrats 40% make up 40% of the those who voted early. republicans make up 28%. and other people independents make up 33%. what that could mean is that on election day, the trump people are going to flood to the poll and because trump is driving them towards election day, and that's when he'll close the margin. that could happen. one more note specifically on florida. two most elderly states in the country are pennsylvania and florida. where the post average age is

the oldest. most senior citizens. in 2016, trump won seniors handily. 57 to 40 over clinton. that could be an older people gender situation. it could be a lot of things. now, biden is leading among seniors. 53 to 46. the drait would have to be wildly wrong. for trump to be in a better position from internal numbers than in the data. >> absolutely. i'll say something in addition to that. if even more precarious. in places like florida we're seeing republicans turn out early. throughout the country, democrats as you were pointing out are have already turned out. mostly by mail. and continue to turn out. this weekend will be an important weekend.

he's asking his voerts to vote in person on election day. as the virus rages out of control. in much of the country. in particular the midwest. he is asking people to come out vote in person. as they are facing a 40% rate. in wisconsin and iowa. in a rates are increasing tlo t throughout the country. when you are asking people to do that. if he faces a 3% of republicans anxious about coming out to vote, then he's going to face a real problem. and i think the fact that she's fed up over months the idea of people that vote in person on election day really has him in an incredibly precarious position. i have a lot of ptsd personally.

if you know someone who hasn't voted. we cannot rest, the senate is -- the presidential is one thing. the senate is very much on the ballot. i think there's a strategy of the trump campaign may well significantly backfire. >> i agree. sprint through the finish. look 100 yards past and sprint through it. let's talk about florida. we love to do. people in the villages, they vote by mail. it's not going to be like they are in golf carts. they're not lining up. set that aside. the judge supposed to be in charge of the canvassing board had to quit because his house is with trump signs. and he donated a dozen times.

at this point republicans are like i'm going to violate the law. you don't do that if you're winning. if your confident. when reagan was running for reelection. saying i have to violate laws to vote him this. >> right. you don't see it when you're winning. you cheat when you're losing. we're jumping ahead a week. litigation around precincts and counties whether in florida or else where will. i want to hit on what you were talking about. on the senior vote particularly in the state of florida perhaps pennsylvania and arizona. this could be the national story wednesday morning. the senior vote broke hard towards joe biden. and the trend at this point should it hold is really a historic trend for joe biden bringing the senior vote over. i'm intrigued by one thing. whether or not there's a tie here. joe biden down the stretch is running a messaging campaign

largely devoid of hard ideology. not saying he abandoned it. his closing argument is about unity and one america about healing. about coming together. moving the nation forward. converse that to the 2018 midterm and clintons closing message. it was healthcare, immigration and taxes. you may mobilize your more partisan voters and younger voters and activists with the ideology message where you wouldn't motivate seniors. his message might be pitch perfect for this demographic. that could hand him the election in florida, pennsylvania, arizona. >> you know who did that before and won? obama. that was his 2008 message. i don't know inside the trump campaign whether they pull their hair out or want him to do this. mocking his own fans.

necessarily purdue voters. the debit card industry. he watered down a bill regulating the debit card industry. and profited from that. it's dangerous two people from georgia profiting off the senate. when they should be serving. >> i'll let you end on texas. speaking of people who wait home with the fire light on hoping that they'll one day catch trumps eye. ted cruz. he has been abused horribly and his wife and dad. he's still there waiting for trump's love. he claims had told trump texas will be tough. he's trying to warn him. is texas a problem for republicans really or are we in the situation where it's not quite ready to tip over? >> if you were to take a look at georgia, texas and arizona. georgia is a legitimate toss up. 94% of everybody who voted in 2016 has already voted.

which means you're going to already have higher turn out than we expected in 2016. and because texas has large numbers of latino voters and young voters. and also to people who at least fit the demographic description of democratic voters. we could see a surprise to flip. regardless of what person or candidate wins the state of texas, they have a state house that can flip. this can be a huge impact on gerrymander in districts written into next year. the fact trump has to think about texas is dangerous. cruz sold his soul a long time ago. i wouldn't chase after a guy that insulted my mama and daddy and wife. he thinks he will kiss him and it's all over. >> he's a dusty side chick. >> i will leave it right there. the star of the show. welcome to her.

there is simply not enough time at this late date to decide the question before the election. reluctantly? which means we may be on the cusp of the supreme court. not the people. deciding an election for the second time in 20 years. which brings us to bush and gore. remember that? kavanaugh sure does. on monday the supreme court ruled ballots in wisconsin must be received by election day. in his opinion, kavanaugh revealed he likes controlling leks as much as he likes beer. echoing the dear leader who empowered him by suggesting a vile deluge of absentee ballots will sow chaos and flip the election. he cited a precedent an extreme opinion. saying the supreme court had the authority to decide how states run election and can over turn rulings by state court, regarding state election laws. there are three current justices

with five more days of voting it's all eyes on pennsylvania. the tipping point battleground where according to "the new york times," the trump campaign has dispatched foot soldiers to early voting sites to intimidate

voters. even videotaping them. philadelphia district attorney lar rry krasner who's investigating the police killing of walter ereer wallace didn't words. releasing this warning which said in part, "keep your proud boys, uncertified poll watchers out of our city, mr. president, break the law here and i've got something for you." joining me now, pennsylvania attorney general shapiro and ms. gupta, former head of the doj under president obama. i want to go to you, attorney general shapiro, on that, the idea the trump campaign is sending people to videotape voters. is that legal in the state of pennsylvania? >> well, i hate to give you a legal answer, but it really depends, right? 23 you stand outside and videotape a scene in center city, philadelphia, that's not illegal. even if you're videotaping a scene of people voting. now, if you're doing so with the intent to intimidate voters,

that's a whole different story and we simply will not tolerate any type of voter intimidation here in pennsylvania, as you correctly noted, that matter is being investigated by local authorities. and i can tell you that we are working together with our law enforcement partners at the local, state, and our federal partners in pennsylvania to make sure that there is no voter intimidation in pennsylvania leading up to the election, on election day, or during the counting. >> to stay with you just for a moment, there's a new report that says that five states are at high risk for activity by armed groups of civilians around the election. one of them is pennsylvania. the others, georgia, michigan, wisconsin, and oregon. this is an organization called the armed conflict location event data project and they put that information out saying large multistate right-wing groups could present problems to pennsylvania and other states. including the 3%ers, the proud boys, the oath keepers and the bugalu boys. are you concerned particularly on election day, trump is pushing his voters to go to the

polls that day that there will be violence and violent people and armed basically domestic terrorist gangs at the polls? >> joy, i can tell you, we've been preparing for this moment for months and we will not let any groups from the proud boys to anyone else step in and interfere with the election in any way. we're very serious about protecting the vote. and we will make sure that voters are able to vote in a safe and secure manner. look, the real problem here, joy, is that we have a president who's trying to not just sow doubt in this election process but sow division in the way people vote. and he's trying to do so because he knows if there's a straight-up vote, where all votes are counted in pennsylvania, he's going to come out on the short end of that. he's going to lose. and so first he went to court to try and make it easier to bus poll watchers in from other counties and quite literally do it in way that intimidates voters in black and brown communities. we beat him on that.

and now we're going to hold anyone accountable who shows up to the polls at president trump's behest or anyone else's to try and intimidate voters at the polls, particularly in our minority communities. we simply will not allow it. >> bonita gupta, one of the challenges here if you've had court rulings that say it's already illegal to intimidate voters so, you know, the courts aren't going to step in to give people, you know, to stay you can't bring poll -- guns to the polls in places like michigan. you also have in minneapolis a police union according to the "star tribune" the minneapolis union wants retired officers to serve as, quote, eyes and ears in polling sites and, quotes, problem areas across the city on election day at the request of the attorney for donald trump's campaign attorney. that sound like they want to send former cops into black areas. that's how i read that. >> well, i think the really important thing right now is that state law enforcement officials, local law enforcement officials, state attorneys

general have been on high alert about this. the civil rights community has. if people say anything, call 866-our-vote. report it. that kind of behavior isn't going to be tolerated. voter intimidation is very clearly against federal law. there's all kinds of ways in which intimidate can try to scare off voters, spreading misinformation, verbally or physically, blocking entrances or giving threatening appearance at the polling places. this is not going to be tolerated. i really do think there's been such heightened alert because of the clear statements the president actually didn't hide from making including in his own debate about some of the stuff so officials are on high alert about this. the good news is, and let's focus on this good news, is over 80 million americans have actually voted so, you knows , despite the kind of heightened alerts everyone's been on, we're

having record voter turnout and i think amid all of these kinds of concerns, the most important thing for voters to know is that there are a lot of -- there are officials on guard for this, and this high voter turnout i think should inspire all of us to make sure that those who have not yet cast their ballots are doing so immediately as early as possible. and can do it safely and securely. >> you know, and, you know, attorney general shapiro, one of the reasons -- that's one of the reasons a lot of people are trying to mail their votes i v. thinking it's safer than covid, than shenanigans that might happen at the polling place. now it's found out your state is still segregating ballots and that means that anything that doesn't get there by 8:00 p.m. on election day is going to be set aside for a future court case. we know there are millions, millions of mail-in ballots have not yet been returned in keys i

nevada, michigan. 1 million in the state of pennsylvania. 962,000 in nevada. we can go on and on and on. how confident would people be in the ability to make sure that their vote is counted, if they mail it in time, or are you at this point telling people don't mail your ballots? that's what we've been saying on the show, take your ballot in. >> yeah. >> is that something you would now tell people, don't mail it? >> let reme respond. number one, if you have a mail f in ballot in your hand, drop it off in a drop box. we've been encouraging people to do that all across pennsylvania. i also want to make clear to pennsylvanians whether you vote by mail or whether you vote in person, your vote's going to count the same. then finally on the issue of segregation, i want to be clear why we did that. it wasn't because of some future court case, it was -- it was done very carefully because of anticipated litigation coming from the president and his enablers. >> can i just ask you, i don't
