12:00 am
. welcome back, right now on capital capitol hill capitol hl what is normally a proformer event, meaning you wouldn't normally care, the counting of electoral votes has been turned into an absolute circumstance e this included a mob
12:01 am
of pro-trump rioters breached the capitol setting off mayhem and destruction and death. four people were killed. . it came after the president urged his followers to march on the building as they physical followed his order it a tee laying siege on law enforcement contingent and taking over. it was a coup attempt in broad daylight but it back fired big. even supporters of the president saying enough is enough. >> when it's over it's over, it is over. the final thing, joe biden, i've travelled the world with joe, i hoped he would lose, he won, he's the legitimate president of the united states. >> i want to go to garrett hank who is on capitol hill, we're getting closer and closer and
12:02 am
closer to the end. the end is inevitable. you see joe biden with 244 electoral college votes. 157 for trump. that's as far as the count got. got to joe biden with 306 votes with it to end. >> this is the last o objection we're going to see, in the process of being voted down, just a handful of votes outstanding, it's not clear we'll wait to see all of those votes come across the threshold here. you have more than a house republicans voting to uphold the objection, pennsylvania electors, really the start this gamut which was always going to feel, republicans felt like pennsylvania was the state they wanted to focus on the most and had the most concerns about, that's why you saw them use two
12:03 am
hours of time on the house debate time long after midnight, long after the senate had given up, they fought on in this perm ative battle against electoral reality on the house side. all of that said, when this vote concludes, the remainder ought to be preprefunctory you will see mike pence return to the chamber and they will pick off where they left off, with pennsylvania, not a ton left, they're going to go through pulling the names of the states out, certifying the counts are accurate as presented, and the whole rest of this should be pretty anti climatic. i hesitate to say that after the day we've had today's. but there's not a lot of congressional surprises, actual political surprises left in store in this process at this point. >> right, we're going to stick together until this happens,
12:04 am
garrett, you don't go home, i don't go home and let's pledge to the viewers you nor i will attempt math on tv we're waiting for the final gaveling on the decision on capitol hill. a lot of movement there. looks like something will happen soon. former congressman joe walsh of illinois, one of three republican candidates to run against donald trump innent 2020 primary. joe, the only good thing is that happened -- by the way, nothing good happened because there was an assault on congress and four people are dead as a result, but it caused some supporters of donald trump's fantasy coupe coup to back off. he got less support than expected on the pennsylvania move in the house and less on the arizona move. >> by the way, i want to commend
12:05 am
you from the very top for calling this out for what it is. using words like insurrection and coup, thank you for that, it's important. i'm in agreement with your prior guest last hour, ben collins, i worry that this is the beginning of something. it was such a shock today that i think it shocked a number of my former congressional colleagues to do the right thing today but let's not fool ourselves what happened out there today that's no longer the fringe of the republican party. that's closer to the base of the republican party and these congressman, these republicans know that. >> what do you do about it because they're activated by
12:06 am
donald trump he has sway over them like i've never seen before, he's got a scorched policy when it comes to american politics so somewhat do we do about these people, a lot of people say, when joe biden is sworn in these people won't be a problem, but if you agree with ben collins this problem doesn't get go away. no this problem doesn't go away and trump doesn't go away. i believe his hold of 40% on republican party vote is going to be strong as ever. because of where i come from, the world of trump supporters, i engage with thousands of them every day, i engaged and heard from thousands of them today and i can tell you the vast majority of trump supporters either made excuses for or had no problem
12:07 am
with what happened today. the vast majority. i can guarantee you my former republican colleagues know that. so even though a number of them sucked it up and did the right thing today because it was so jarring they're going to pay attention to their base in the next three to four years. it's why i believe the republican party is the trump party now. a lot of people compared this to black lives matter protests i was in a lot of those in the summer in minneapolis, chicago, new york and other places and from a bunch of brown people storming capitol hill with weaponry we probably wouldn't be talking about four people dead. >> you taught me on this issue. if a bunch of black and brown people marched on the capitol they wouldn't have gotten anywhere near that building.
12:08 am
i think one of the stories here, i love the capitol police, they protected me when i was a member but they got lax because we had a bunch of white supporters and they weren't on guard and thought something might happen. whole different story if it was black or brown protesters and that's got to be addressed. joe, i know there's going to be viewers that won't love the way i say this, but there are some of those people out there today who are filled with grievance, and talk to the right way about where their grievance comes from. or what the origins are of why they're not prosperous. they may be led to believe their jobs are taken by african-americans or women or opportunity to get into college taken by asians or somehow gay people threaten their livelihood if they're caused to have conversation about trade and how
12:09 am
it hasn't treated them fairly with some empathy is there some chance they could be brought over into a world that's not about violence in favor of what donald trump is talking about, they have grovances, so do a lot of african-american and a lot of poor people, there's a lot of grievances that we as a society should fix. >> yeah, and it's such an important question. we have 30 to 50 million americans who are living in an alternative reality of lies, conspiracies, and as you said, resentment. they've got to be reached. we can rescue some of them. there will be some we can never rescue. respectfully msnbc is not going to rescue them, joe biden's not going to rescue them, it's going to be up to, i believe, republicans and conservatives to have really hard conversations with these people and put the truth in front of
12:10 am
them. >> that's you more than me, they're much more likely to listen to you than me so what's the structure of is that conversation? who runs it? do you start a new party? are there conservatives who say we've got answers for you? >> yes, i'm a reformed gang banger, i got out of that gang. it's go the to be people like me approaching these gang members and telling them this is no way to live, this is getting ugly and violent, this isn't good for you, and by the way, he's lying to you, all these resentments you have. but it's got to be that kind of a concerted effort from people like me who before trump i was a conservative that they loved. >> joe, good to see you, thank you for staying up so late for me, former republican congress joe walsh of illinois. want to bring in -- want to go to the floor, jim stand by.
12:11 am
i want to go to the fleury to see what's going on see what's going o -- floor of the house with nancy pelosi talking. >> that motion to be considered is laid on the table and will notify the senate of the action of the house informing that body that the house is now ready to proceed in joint session with the further counting of the electoral vote for the president and the vice president. >> because that's exactly when garrett hanks said it would happen, it's now 3:11 a.m. they've called for joint session the house and senate, nancy pelosi and mike pence will over this and roll call will continue until we get to the number of electoral college votes that joe biden and donald trump received.
12:12 am
numbers on the bottom of the screen reflect that. 244 for joe biden. barring anything unusual and everything unusually that can happen has happened, but barring anything unusual that 244 will become 306, someone will hand mike pence a piece of paper, he signs it and that is the end of this thing and i am going it go home regardless of what time it is on the clock when that happens. i think i'm supposed to go home at 5:00 a.m., so bottom line that's probably going to happen at 5:00. let's listen in. >> may be the last time we're in session before the new administration comes in. we are losing an extraordinary, young woman who has been with us, been with me for over a decade and who is
12:13 am
our floor leader, our floor director and all of you know her, she's been with me for a significant period of time. she's a wonderful, wonderful person. >> that's hoyer giving a testimonial to a staffer who will be leaving. we'll keep an eye on any procedural stuff that will happen. next thing you will see mike pence and senators and the roll call continue. we finished with pennsylvania. rhode island will come next and we'll make it to the end of the alphabet and that will be over and as i said i'm leaving. that ends before 5:00 i am so out of here. so you have to have another plan. let's bring in jim kavanaugh standing by, an msnbc terrorist analyst and former agent in charge in what we call atf.
12:14 am
jim, you and i have spent many an hour together where we are uncovering something that is happening that appears violent and we're trying to make sense of what it is. never before have we talked about that violence perpetrated by a mob on the united states congress which is actually protected by its own very specific force of police. given what you have seen today, the video you've been able to review, what happened? >> well this was an attempted over throw of the duly-elected president-elect of the united states, it was a coup insurrection, it was terrorism, it was an over throw of our democracy is what tried to happen today, by the president standing at the ellipsis in front of the white house and telling these violent people, he knew who they were, the proud boys, neo-nazis,
12:15 am
the oath keepers, he knew who a lot of them were. some of them may not have been in those violent groups and just trump supporters, a lot of qanon people and one with a sign, save the children, that's how they entrap the women into the qanon conspiracy by playing to their feelings about saving children and of course they twist their minds but anyway, he knew what he was doing, he would have hoped they went in there, if that one staffer didn't save the slate of the electorals off the dais there we might have a different night. we might have trump saying we got it and it was doctored or something else. so it's not over. i don't think it's over. i've been following, arresting and chasing these nazis and militiamen my whole life, this
12:16 am
is not new in their world it's just new because it expanded into our world so large and politicians have embraced it, so it's big because they wanted it to get big, they wanted the votes. that's where we are. >> how do you think about this? how do you deal with this? in all of your career, which has been many years, how do you think about this kind of terrorism? this kind of attempts over throw of a government. encouraged by the president of the united states. you've never faced that before? >> no of course that's very unusual but these people are not unusual and 40 years ago they were talking about the second civil war and over throwing the government. i mean, we got that in under cover meetings, on tape, on pamphlets, written documents, any in the atf or fbi can tell
12:17 am
you this is the light motif of their life. the militiamen who want to over throw the government. they don't really care, the hard core about trump, there was a report of pipe bomb at the national committee office in washington. they don't care about trump if he told them not to go, they gont, necessity li -- y li - still wouldn't go. they live for the violence. it's the monster these senators have played to. and i always love talking to you, you're one of the straightest shooters in the news media, i always love getting up in the morning and listening to meeka and joe who shoot real straight too. john meachemum was on and had a great line, he said what these politicians do is they deny s f self-evident truths for power. that's what they do, the self-evident truth that there was no fraud in the election,
12:18 am
they deny that for power. that's what they're doing they're selling out their country for power. because they want this foe and they got it you're not going to change the minds of any of these people even if you show them the fact with a thousand commissions and million pages, it's not going to change anything. >> why is that? who are they that they're susceptible to this qanon nonsense and stuff that the proud boys put out there. when the internet came out i remember thinking no one will be able to lie, the truth will be available to everyone and they'll research everything and know when you're lying, who are these people for whom there's no conversation, that they can be tricked into this behavior by donald trump or by q, or by proud boys? >> well, the first thing is, it's the drip, it's the drip, drip, drip, drip, drip.
12:19 am
all day on the internet. all night on cable news. on one american network. or news max. where this is reinforced. even on fox. they're reinforcing this talk and they hear their leaders, senators in congress reinforcing the talk. look at the signs, stop the steal. this is the exact same thing in 30's germany. the stab in the back. the biggest lie that the german soldiers were betrayed by their leaders after world war i. it was a total lie. germany was vang wished, vanquished the army defeated but they were told a lie. this lie, stop the steal, is the same exact lie. and qanon is really, goes back to the blood liable that's been played
12:20 am
on the jewish people going back hundreds of years from the protocol of the elders of zion, forgy by the czar russian police that jewish people were drinking the blood of children and this is what qanon is about, it's the same old conspiracy, hundreds of years old, this hate. they drip, drip, drip it on people, and the politicians reinforce it, and their circles -- their circles only talk about this. >> i came across this when i was traveling across america during the election talking to people and asked why they were voting for donald trump and they said because he's against child sex trafficking, so is joe biden, we're all against child sex trafficking that's not actually a thing but they have this set of beliefs, i'm the sort that thinks you can solve everything with dialogue and empathy and you can talk to people and get
12:21 am
there. but when you're dealing with absolute false information i'm very, very worried they're susceptible to the kind of nonsense that donald trump has tapped into and i don't know how you fix it after january 20th. i know joe biden will be sworn in as president. but i don't know that this goes away. >> it's not going to a i fast. we're in a very critical period in two weeks when trump is president, the congress really needs to step up, impeach him, convict him and say he can never serve in office ever again and you ought to be able to do that in a week, just do it, impeach him, all you need is the tape of the georgia secretary of state and his ralph troops against the -- his rally of troops against the congress. biggest thing
12:22 am
-- i think president-elect biden will think of having cyber disinformation teams in some of the departments to address this stuff, always tell the truth, you know, they have lots of lies that todd freedman in the "new york times" said there's big lies but there's bigger truths and we got to always talk the truth. these congressman, these cowards that support saidition, they're evil. you remember when john mccain was told he's running for president and lady run up -- >> i remember it well barack obama, muslim. >> which would have been okay if he was a muslim, nevertheless, the woman thought it was evil but john mccain said he's a good, family man, just different on policy. >> old days.
12:23 am
i'm going to put you on hold. i see the vice president of the united states heading into the house chamber, accompanied by a lot of united states senators. they are now entering the chamber. this should be, this should mark the beginning of the conclusion of the roll call in which they consider every state, all that is supposed to happen is they count. they call out. they ask how many delegates there are for joe biden. they ask how many delegates there are for donald trump. they count it and ask if there's any objections. the normal course of events is there's no observations and they move on to the next state after rhode island. that's the way it's supposed to go. this failed two times tonight. one was with arizona. one was with pennsylvania. in both cases the objections were overruled after couple hours of debate in both chambers and were both overcome in the
12:24 am
senate and house. if you object to the electoral results in any state it has to be overcome -- the objection has to be sustained in both the house and senate. if either house does not follow the objection it dies. in the case of arizona and pennsylvania they both died because both the senate and the house overcame them. we are not expecting any more objections. we are expecting them to move through the roll, starting with rhode island next. and then we are going to make it through the end of them at which point somebody hands mike pence a piece of paper, he signs it, he hands it back, this thing is over, i go home, joshua letterman takes over anchoring from outside the halls of the capitol. josh, this may be news to you,
12:25 am
soon as this is over you're in charge. >> sign me up. >> how'd i do with my description with what's about to happen? >> i think it was pretty accurate given the number of hours of sleep you're on at this point which i imagine is close to zero. that was a pretty solid depiction of what we're about to see. >> hold on we got pence actually talking. -- >> to decide upon the vote, the commonwealth of pennsylvania to which objection has been filed. secretary of the senate will report the action of the senate. >> in the senate of the united states ordered that the senate by a vote of 7 aye to 92 nay reject the objection to electoral votes cast in pennsylvania for joe biden for president and kamala harris for
12:26 am
vice president. >> the clerk of the house will report the action of the house. >> order that the house of representatives rejects the objection to the electoral vote of the commonwealth of pennsylvania. >> pursuant to the law chapter 1 of title 3, united states code because the two houses have not sustained the objection the original certificate will be submitted as provided there in. tellers will now record and announce the vote of the state of rhode island for president and vice president in accordance with the action of the two houses. this certificate from rhode island, the parliament advises me is the only certificate vote from the state reports to be a return from the state, has

[ applause ] >> and with that, the otherwise mundane but tonight spectacularly exciting session of congress and the senate is
12:45 am
concluded. joe biden and kamala harris confirmed as the winners of the election. the job tonight was just to count the votes and even that became high drama as everything else in this administration has been. it took a long time but at 3:41 a.m. eastern time, michael r. pence said those magic words which are going to make his persona nongrata with donald j. trump after four years of remarkable loyalty that kamala harris and joe biden have the votes necessary to be sworn in as president and vice president of the united states at noon on january 20, 2021. this was the end of the road for donald trump. there are no more legal challenges available to him. this was the last thing that had to happen as per the constitution for joe biden and kamala harris to assume their
12:46 am
responsibilities. joe biden as 46th president of the united states. up until earlier today donald trump had tweeted and spoken about the fact that michael r. pence had a chance to fix this. that mike pence had the authority to turn this election, mike pence said he did not and hundreds of protesters entered that chamber you're looking at now, entered by protesters, armed protesters, four people lost their lives today in the protest that overtook capitol hill. the capitol police were overwhelmed very quickly and later assisted by fbi, by secret service by maryland and new jersey state police, by the national guard, but today did not go the way donald trump needed it to go and his line has come to an end.
12:47 am
i want to go to josh letterman standing by just outside those chambers. that's it, that part is actually over. >> that's right. it's over, and you know, if you think back to the last couple days heading into today one of the big concerns was that the match that would ignite the situation that had been building up would be what we just witnessed, would be the actual moment where vice president mike pence presided over a ceremonial acknowledgment of the next president of the united states. instead it didn't happen now it happened many hours ago, during the day, when we saw this violent situation play out, and instead here in the middle of the night, with all of the protesters who caused so much damage today, having all gone home, everything played out exactly as it was supposed to.
12:48 am
a ceremonial process proceeded, mike pence never had anything more than a ceremonial role in this, performed that ceremonial role. president-elect joe biden's electoral votes were tallied up and confirmed an the process moves on. so what do we have for the last 16 hours? well we have four people dead, more than a dozen transported to the hospital, the u.s. capitol, the hallowed ground for the american body politic desecrated in such dramatic ways and yet the outcome politically speaking is exactly the same. the big question now, ali, is how much more damage can president trump potentially do over the next two weeks. even before today, our reporting today president trump according to advisors speaking to him was
12:49 am
not expected to say okay things didn't go my way today, pence didn't do what i wanted him to do, i guess it's over and i'll go home now. it was fully expected he would continue to find some rabbit to pull out the hat despite there being no legitimate way before or after for him to challenge this election and today we saw further evidence the president has no intention of putting this to bed as he inkrosighted these protests and urged them to march to the capitol and praised them as they carried out all of the bed lem we witnessed today. the real question is, how will president trump handle this moment now that his defeat has been affirmed in every way possible but still a lot of time left in the next two weeks where a lot of things could go wrong. >> speaking of a lot of time left, it's 3:49 in the morning
12:50 am
and i'm here until 5:00 so you and i have a lot to talk about. kidding. i got a couple guests lined up. but if you see or hear anything from congress about this remarkable, just remarkable day in history, this has been a remarkable 24 hours, more than that, we saw warnock become the 11th black senator in all of history. only the first one from georgia. a man who grew up in savannah and is now going to represent his state in the senate. we saw ossoff sweeck o-- squeak out a win over david perdue while all this bedlam was going on capitol hill. 2ke78s control senate. gsh senate. --
12:51 am
democrats now control the senate. let's bring in our guests. author of "a life" and a advisor of lincoln project and former spoke sperson for forehouse oversight and msnbc political analyst with us. i thought i had seen it all, jonathan, i thought you wouldn't surprise me with anything else in this trump administration and today surprised me. >> you know, i -- i of course was surprised, shocked, displayed by what has to be the most disgraceful, shameful day in all of american history. we've had darker days. including 9/11. but we've never had as shameful of a day. and yet what we just saw. this was a reaffirmation of the majesty of american democracy and i took real comfort in the
12:52 am
ritual, almost like a civic ritual, the ceremonial quality, even the boring parts of it were reassuring for me, we're still standing after this assault on our democracy. so the hope that we can take from this is that while we won't repair the breach we can begin the process of renewal. and as part of that process we need accountability. that's a longer conversation, for how these coupe riders will be held accountable and how the president will be held accountable for his incitement of violence. we'll be talking about that for long time in days ahead. >> mike pence did exactly what mike pence was expected to do. donald trump wanted him to do something else. donald trump said in a rally two nights ago in georgia that mike pence can save us.
12:53 am
he'll be very disappointed in him if he doesn't. they apparently had a long lunch together with lawyers who were trying to encourage him to do something he felt he didn't have the legal ability to do. mike pence was the ari apparent, as loyal as it gets as vice president what happens to i mike pence what does mike pence represent in this discussion 12 i think penn statmike pencpenn sm very long day when trump's twitter comes back on at 7:00 a.m. trump has already alluded to some the things he would say to mike pence. couple nights ago jokingly said maybe i won't like him after the events and i think that will bear itself out. all mike pence has to do somewhat trump said about former attorney general jeff sessions andreas attorney general bill barr and personal attorney
12:54 am
michael cohen and -- the long, long list of people who have served donald trump and loyal to donald trump and the story ends with trump dumping them. it gets ugly and personal. trump is petty and he will retaliate and lash out at pence. of course chief of staff isn't allowed to enter the white house any more. it's going to get ugly. we know from reporting, particularly a x io's donald swan that donald trump is sieging right now and can right a -- andre ethiering right now -- andre ethiering right no se -- mike pence made it through four years, seemingly unscathed, went through ridiculous lengths to be out of sight and out of trouble and in the 11th hour this puts him at the center of it. all for nothing.
12:55 am
the last four years, silence of pence, pence deliberately turning away from his own values to quietly and condone trump a.i. be -- trump's behavior and now for nothing. and going to be blown up. any design for pence to be heir apparent in 2024 just went out the door. >> we have breaking news, we had a statement, trump can't tweet because that's been closed. avenue issue statement by donald trump quote, even though i totally disagree with the outcome of the election and the facts bear me out nevertheless there will be an orderly transition on january 20th. i have always said we would continue our -- and then it goes on, i don't have the rest of it. but he is now for the first time
12:56 am
-- for the very first time, pledging an orderly transition on january 20th. . this is the first time that donald trump has agreed to this idea. this is not a concession. he is not marginally conceded in this. he says i totally disagree with the outcome of the election and the facts bear me out nevertheless there will be an orderly transition on january 20th. there's more to this that i don't have but shannon petty probably does, what have you go the? >> as you mentioned, not a concession but acknowledging that the president will go along with the orderly, peaceful transition of power. that, you know, there has been, our reporting indicates a i lot of pressure on the president throughout the day from many, many allies, including his closest advisors within the white house to, if not concede,
12:57 am
which they know he does not want to do, to acknowledge that come january 20th, joe biden will become the president. and that is what this statement acknowledges. earlier today, you know, i was hearing concern from white house aides, former white house officials, concern the president might not even leave the white house. that seemed to be a real concern at one point this afternoon. the statement is him acknowledging, i guess, at best, that he will loaf the white house on january 20th even though he will continue to maintain that he won the election, that there was the fraud and all of the allegations, all of that will go on but he'll participate in the peaceful transfer of power. so, i mean, i think that had been anticipated by those close to him, by white house officials, by advisors, from the start, that at some point the president was not going to have
12:58 am
to be removed by the secret service or whoever else there would be and many advisors have been talking to him about some sort of exit strategy and there was an expectation that after a couple weeks the president would begin to accept his loss and start to move on and people were talking about his future, rather than accept that loss, he almost sort of went in another direction, someone after a break up starts to sit outside their ex's house. he started to go so deep the other direction that there did become a real concern among those close to him whether or not he would leave or not. throughout the day as i said, our reporting indicated there was a push for him to acknowledge that he'd be leaving the office of the presidency and this is his way of doing that, while again, maintaining that he still won the election, this was all fraudulent, he's not a loser, he's still a winner, but leaving the office of the presidency come january 20th.
12:59 am
>> i will read the rest it says even though i totally disagree with the outcome of the election and facts bear me out, nevertheless there will be orderly transition january 20th, i have always said we will continue our -- the rest of it -- we'll continue our fight to ensure that only legal votes were counted. while this represents the end of the greatest first term in presidential history it's only the beginning of our fight to make america great again. want to bring in david corn if he is still there, david, there's something it to this because donald trump has raised a great deal of money on this silly fight that he's continued. ? . we're not sure what he's going to use that money for but know he has loans coming up in excess of $400 million and he's raised, my last check somewhere in the neighborhood of $250 million from all sorts of people who
1:00 am
have encouraged him to keep this fight going. so part of not conceding allows him to continue to fund raise for whatever it is he calls this little battle. >> well also let's look at that statement for a second, it's an honor to be with an honor to be with you on this historic night. trump has often come out and, you know, not himself, but his statements have been released in his name throughout his four years as president, that sometimes seem almost reasonable, and that he almost always comes out and then says, no, that's not what i meant, or doubled down what he said originally, that the white house was trying to clean up. so, until he says this, himself, on camera, you know, this sounds like a statement that was written for him that they forced him to agree with, because they thought he was going, you know, over the deep end. so, he has still said in the past that he wants his supporters to be in washington
