thanks so much. >> i could get used to it. 10:00 eastern tonight, jonathan capehart speaks with lgbtq members of the biden white house. you can watch pride of the white house. it's right here on msnbc. a very good day to all of you joining us. we're here at msnbc world headquarters in new york. we begin this hour with more breaking news on the tower collapsed. the south tower there in surf side florida. the death toll is now at nine. 156 people still unaccounted for. miami dade mayor said a big breakthrough in the search came when first responders were able to cut a trench 125 feet long, 25 feet wide and 40 feet deep. >> they did it starting during the time when the fire and the smoke were really overwhelming and they were trying to create a

separation so they could go to the side of the trench that had less smoke and clearly this is become a major conduit where they have been able to identify different layers and places where there could be crevices and they were able to find bodies. >> private donors have come through with a million dollars to relocate residents. some residents are concerned about new cracks developing in recent days. here is part of a report from sam brock. >> the south building has two sister buildings. the north towers built in the same year which officials say may be evacuated and the east tower which is 13 years younger. >> there's a crack in a column that was not here before the collapse. >> robert says this crack in the east tower parking lot with debris below it has been determined structurally sound as the building has taken steps to maintain safety. he wants to know why engineers won't arrive here until next week. >> they knew about a lot of the

issues in the building for slong and they allowed it to go and get past a point it collapsed. i would like to prevent that. >> miami dade county is undertaking an audit of buildings 40 years old. >> buildings don't fall down in america. there's a third world phenomenon. the last time we saw manager like this where we had, we had two sections of building fall down, pancake style separately and you've all seen that video and we saw fire. it's very disturbing. there's something very, very wrong at this building and we need to get to the bottom of it. >> chris, the big question right now and the focus is the agonizing wait for families and loved ones. what are you hearing on that front? >> reporter: put yourself in their shoes. since 1:30 wednesday night into

thursday morning, these families, 150 of them have been waiting for any sort of word about the fate of their loved ones and most of them have not heard a thing at all. all they know is right now that most of them are in this family reunification center. we're a good six or seven blocks away. they haven't been able to see the scene themselves. it's an agonized wait. we know that some have said until they hear some news about their family members, they are choosing to believe that their loved one is alive in the rubble and searchers and city officials have given them hope that that is the case saying that in other collapses around the world or earthquakes, things of that nature, some victims have been pulled more than a week later. still alive after being caught in a hole or crevice. others know that the odds are getting longer. their loved one will be found

alive. they are trying to hold out hope. we're getting a little insight into what the briefing meetings are like for city officials, search teams and the families going on every few hours in the center behind me. the mayor brought in one of the members of an elite israeli search and rescue team who have joined this search and families had some questions for that member of that elite search team. >> the room is packed with loved ones who are waiting to hear about their relatives. there was encouraging news we had the israeli team that arrived just this morning. they were asked some questions, including whether or not they thought the miami dade team had been doing a good job. the gentleman who was speaking, the head of that search and rescue team did not hesitate a moment and said they've done an excellent job, which was a great relief for the family and a

validation and something we probably already know because the miami dade team is a world class search and rescue team and we're very lucky to have them. >> reporter: as you mention, there's now a trench into the debris after finding one additional body yesterday. four more found between last night and this morning. families have hope that this process will start to speed up in the coming hours. >> okay. as the hours turn into days, the agonizing wait continue for family and friends of the more than 150 missing residents. we showed you this yesterday. my next guest met with the surf side mayor who offered her comforting words while her mom is among the missing. i want to thank you for joining me and start by saying thoughts, prayers, all sorts of embracing hugs for you and all you're going through coming from us and my team here in the studio. what is the latest update from officials on rescue efforts?

what are they telling you? >> the information is limited. i'm in the car actually with my family going back to the site now and back to the center. the information -- i'm really happy that the israeli team is there. i have a lot of faith that they are doing their best and they are going to do everything in their power to continue to help the search effort and my concern is that there hasn't been a great number of folks that have been rescued yet. that's hard to digest. i really want to be reunited with my mom. that's all i really care about. that's all i really want. my dad lost all of his belongings, all of his clothes. all of our pictures, we had stuff there. obviously, that's just materialistic things but i just

really want to hug my mom. i pray she's okay. >> of course. i know yesterday as i was listening to you, you talked about wanting to protect your daughter from having to know what was going on. is your daughter really aware? has she been to the site with you? >> no, no, no. she's not coming to is site. she is very much aware what's going on. i have not really been home a lot. i've been out of the house a lot. we took a walk in the neighborhood this morning to get some fresh air. she ran into two of her classmates and the first thing she told them this morning was did you know that my grandma is missing. they both said we did hear that. we know. she said, they don't know where she is. she's clearly very upset. my mom does everything for me. i work full-time. my mom does pick up for me.

my mom takes her to dance class. i have a younger daughter but she stays home with a nanny but when it's time for activities and the dance teacher tells me this morning that scarlet would say things are very hard. she would say, you can do it, scarlet. you're doing amazing. she's a very encouraging person. she's so loving. she's the ultimate grandma and she is the ultimate person. she's done so many great things. the response has been incredible. it's just -- sorry. i'm sure you can imagine my phone has not stopped ringing. text messages and facebook messages and instagram. my mom has touched so many people. >> that has to be at least somewhat rewarding to know your mom, her story is getting out there and so many people are thinking about her and embraing you as well. how are you doing now?

when you just described your relationship with your mom and how she does everybody for your daughter, her granddaughter and how support ifr she is. this is hard. i love my mom so much, i can't imagine. >> this is the most devastating, heartbreaking thing i thought i'd have to experience. i'm heartbroken for myself, my brothers and for my dad. my mom is really healthy. she's thin. she works out. she takes walks on the surf side boardwalk every single day. people have told me they said, i recognize your mom. she's a really fast walker. she is just zero -- she takes zero medication. chef supposed to live forever and be by my side forever. the reality is, that a lot -- i

know that the rescue efforts are speeding up now and i know that there's a lot of comparison to other countries but my concern is the fire and the smoke . i was there and i know how bad that smoke was. i wore my mask because of the concern that i had for the smoke. if i felt that one to two blocks away, how are people feeling there on site? >> yeah. we're showing some pictures of your mom. she's in great shape. she looks so strong. something that god willing will help her get through these horrible days, if she's able to found a pocket there and we're all praying for that. let me ask you about the reports that there was instability or certain concerns found there in the structure of the condo building. are you concerned about that? are you angry about that? are you hearing people talk about that there in the center where every one is gathering to

wait for word? >> of course people are talking about it. i didn't know of anything ahead of time. i remember being in the garage and being like there's water on the floor but i was in the garage on saturday. i said that. it's also june in florida. it rains all the time. the garage sloped down. i don't know. it's so hard to tell. obviously, i'm disappointed there were red flags that were made and brought to light and there wasn't action that was taken and ultimately i'm concerned about who is the leader. i'm unclear on who is the leader driving the ship. someone needs to -- when ever that type of things happen, yes, they said there were issues, but no one said it was unsafe to

bill alongside it. now he says he will support the bipartisan plan on its own. today lawmakers on both sides of the aisle say they can get this plan through the senate. >> every week there's probably going to be another problem that arises. we'll work through those problems like we work through them in our gang of ten folks and i think we'll get good support from both sides of the aisle. i think we'll get far more than 60 votes in the end. >> mitch mcconnell wants infrastructure as much as anyone else. he wants the jobs this will create. i think leader mcconnell will be for it. >> we're watching capitol hill this week for a house vote on a select committee to investigate the january 6th insurrection. one of the biggest questions is whether this will see participation from republicans. >> i hope mccarthy makes it bipartisan and he has to decide who he wants on the select

committee. hopefully, first of all, republicans will participate. we're not sure that they will. >> i hope he appoints people that are seen as being credible and are willing to look at the evidence on a clear eyed basis. i think the american people are interested in getting to the bot -- bottom of some of the outstanding issues. i voted in favor of a bipartisan commission. donald trump back on the political stage for a rally in ohio last night. he threw his support behind a candidate challenging an ohio gop congressman who voted to impeach trump. throughout the evening we heard trump still pushing a false narrative about the 2020 election. >> the crime of the century, which i consider to be the election of 2020. the big lie is what took place on the evening and the morning november 3rd, november 4th, november 5th. we'll never stop fighting for the true results of this election. >> nbc josh letterman is in

washington, d.c. he's following the sfrur -- infrastructure negotiations. where does this stand after some of the conflicting statements from the president? >> reporter: president biden accidental through a wrench into the negotiations last week with the comments suggesting he might veto the piece of infrastructure legislation reached in a compromise between republicans and democrats. if he didn't at the same time have that democrats only bill to sign. the president and his aides spent the next couple of days feverishingly working the phones trying to calm democrats and republicans into clarify his comments before ultimately putting out the statement at the end of last week that made clear he does not intend to hold one piece of legislation hostage for the sake of the other. this morning we're hearing from republicans who seem to have accepted that with senator mitt romney saying he believes the president, trusts the president

and his walk back from the comments and joe manchin is at the center of all of this saying he does see the need for a second piece of education to deal with what democrats have called human infrastructure but warning he does not plan to sign onto a blank check. take a listen. >> we have two tracks and that's what i believe will happen. we worked on the one track. we'll work on the second track. there's an awful lot of need and everything they talked about is something we need. we have to take into account where we are in this country. we're $28.5 trillion. we cannot continue do add on things we can't pay for. >> reporter: i think every one is pretty much accepting the possibility that there will be more hiccups in the process going forward. this isn't all necessarily a done deal as progressives keep saying this isn't far enough and we need to keep pushing for really huge amounts of spending in that second bill.

republicans that have done absolutely nothing about it. they have basically winked and said, you know what, we're okay with this. it's intolerable. it's dangerous. >> yes. how do you stop this? you've said it's dangerous. she may incite violence against your specific colleagues that she's referring to, if not others. how do you stop this? >> well, you know there are all kinds of things that have been tried. there's a censure resolution. it hasn't been brought to the floor yet. there's a resolution to kick her out of congress. at the end of the day, i think we do have to also make this about the republican party because they are allowing this to continue to happen. we will also have a letter out on this topic but i don't know the answer to that, alex, because she is out there with donald trump. let's not forget whose rally

that is. continuing to foment violence against members of congress just like was done on january 6th. >> i don't know. i think word has to be sent directly to those people who voted her into office. that's where it all started, if you think about it. let me talk about something else that she has to say yesterday which was she is showing interest in being involved in the house select committee that will establish and investigate the capitol riot. >> look, there are questions that need to be answered. there are things -- sdp you ask questions about anything. would you like to serve? >> sure. she should put me on the committee. >> you would show up and ask questions? >> absolutely. of course i would. >> let's make the point again she serves on no committees but thinks she should be placed on the select committee. she has also promoted the underfounded claims that antifa or the fbi might have been

involved in the capitol riot. what goes through your mind when you hear she wants to be on the select committee that investigates this attack? >> well, i try not to waste much time on her because she's ludicrous and dangerous. the idea that she would serve on committee would be a giant slap in the face to the families who lost loved ones, who were wounded during the january 6th attack. it would be like putting the defendant on the jury. it's absurd. clearly she had not really thought about it either in the way she answered the question. >> the letter you mentioned, what's the letter about? to whom was it sent? what's the purpose of the letter? will it will sent? >> it will be to the house majority leader, kevin mccarthy. it will clearly lay out a number

of things that marjorie taylor greene has done, that put all of our members into grave danger. the death threats go up when she does these things against our members. that's unacceptable. it will specifically say to kevin mccarthy he needs the take issue on this issue. >> who is signing that letter? >> you'll see. we'll get it out and i promise i'll come back and talk to you about it. >> i'll hold you to it. when it comes to this committee, how much appetite do you think the american public has for information on january 6th, versus the politicians who down play the riot? what do you think the american public wants? >> i think the american public wants accountability. i think they have been very clear about that all along. i think they want answers and you see it in a bipartisan way. you see it with the people who worked on the bipartisan

committee in putting it together which was voted down because mitch mcconnell is beholden to donald trump and continues to be holden to donald trump. the american people want answers. this is the worst attack since 1812 on the united states capitol. the idea that we wouldn't even be able to come to a bipartisan commission to investigate what happened is stunning and dangerous. i feel like i'm using the same words again but that's how i feel about it. we're coming on the sixth month anniversary. we saw it up close and personal as did custodians and the american people. the idea that republicans would whitewash this and say it doesn't happen as some of them have been doing shows us what a teetering place our democracy is still in. >> let's turn to infrastructure now as the president said he didn't mean to suggest he would

veto the nearly $1 trillion bipartisan bill unless congress passes that larger package to include his american families plan. do you wish he didn't come out to clarify because you and many of your progressive colleagues had been advocaing for a dual bill solution? >> let me be clear, the president doesn't get to sign a bill until we send him a bill. >> good point. >> what i've been saying for weeks and what i will continue to say and what i believe the speaker is still saying and the senate majority leader is saying there will be no small bipartisan bill unless there's a big reconciliation bill. we owe it to deliver to the american. we're not going to undermine what we sent to the president's desk with a smaller bipartisan bill. i should say that we still don't know the details of this

bipartisan bill. there are some things concerning to us on the pay for side. we don't have the details yet. i want to be clear that it'sgoing to have to be a package that we can accept just as we are going to have to find 50 votes for a reconciliation package. we're not going to give up on one and pass one without the other. >> okay. i have a point to ask. if the senate passes the bipartisan bill and the bigger package is either passed or ready, would you and your progressive colleagues be on board with doing a step by step approach? first voting for the bipartisan deal. i know there's a lot of hypotheticals here but i'm trying the gauge the level of steadfastness, if you will? >> no, we would not.

our caucus said they would not vote for a bipartisan bill unless we had a full reconciliation bill that was passed as well. i do not think there's the support. the speaker knows that. i've conveyed that to the speaker for weeks. she herself has said that. that has been our consistent message for some time. we understand the president wants to do that. i'm saying we do not have the votes for that unless we have a reconciliation package that delivers on what the american people want and need and is the substantial vision with our five priorities. that's medicare expansion.

prison for the murder of george floyd. minnesota attorney general said the judge made the right decision but chauvin is a symptom of a greater problem. >> i do believe that the larger society must grapple with the bigger issues. that george floyd justice and policing act has not passed. we need it to pass. all over the united states, states are looking at police reform. we need them to act. we need departments to act. we need prosecutors and we need other police officers to look inside and say what can we do to build greater trust and greater cooperation with our communities that we protect and serve every day. >> joining me now is carmen best. msnbc law enforcement analyst and retired seattle police chief. welcome back to the broadcast. it's good to see you. i'd love to know your reaction to chauvin's sentencing from a policing standpoint. >> thank you. glad to be here this afternoon. we have to keep in mind and remember that the police chief

and several officers testified in the trial against derek chauvin. i think we all can recognition there's a need for police reform and as a stated by the attorney general that we all need to be invested in moving forward and the fact that he's severed one of the longest sentences. i recognize many of the family members were disappointed and wanted the maximum but he's received one of the longest sentences that was imposed on an officer. many officers and police officials were all in favor and all supported his conviction. >> yeah. do you think chauvin will serve as a cautionary tale? do you think this will serve as a warning to other rogue police officers in this country? >> i think police officers and the profession is paying attention to what happened here with this whole year of social reckoning. it's time for us to look at more deeper police reforms and how we can move things forward.

there's no longer this cover of the thin blue line that people refer to and i believe that police profession is just as invested in seeing justice generally speaking as every one else. know officer, no person wants to see a murderer go free. >> picking up on the word reform. on wednesday the president released his plan to curb violent crimes across the country which includes allocating millions for policing and community reforms. do you think he's headed in the right direction? >> i do. it's not just curtailing the prolific amount of guns we have but moving further upstream with jobs and training, education, community policing. he's in favor of all of those things. i think the cumulative effort will make a difference in the

rise in violent crime we're seeing across the country. >> this plan comes ahead of what biden has describeds a a potential summer of crime surge. why do you think violence is so steeply on the rise across this country? >> there's been focus on social justice reckoning. people are coming out of being locked away. more people are out and about. we can fully expect there will be more opportunity, if you will, for crime and acts of crime and that there's been some reticence that people recognize on police agencies. they haven't been able to be as proactive. i think coming together in this way, we can fully expect the combination of things will great problems for us but coming together in this way, looking forward, looking ahead and getting on top of it, i think we can curtail some of the increase in violence that we're seeing.

>> it's breaking from democrats. some of whom are looking to defund the police. the spike in homicides is causing attitudes to shift. do you see middle ground here in this situation? >> i do. i've never been in favor of defunding police departments. we do some level of police service out there for every one. in addition to that, we should also be investing in other social service issues to help some of the issues around addiction and around mental health issues. all those things are important, all those contribute to some of the violence we're seeing. it's not and or but it's a both and situation. we need to invest in social services. >> okay.

are letting grieving families visit the site. it will be a very private service. the fourth day of searching is missing up momentum after workers cut 125 foot long trench into the rubble. visitors are paying their respects. >> how in the world could something like this happen? i guess they will figure it out. >> i know they are doing a lot but i wanted to pray for them and see if they can find more people alive. that's my hope. >> hope for all of us and the death toll has risen to nine today with 156 people still unaccounted for. some new reaction now as multiple people familiar with the matter tell nbc news the former president's business could be hit with criminal charges as soon as this week. these charges would be against the company, not donald trump himself. in a statement the lawyer for the company said the corporate office will plead not guilty and make an immediate motion to dismiss the case.

joining me now, he covers the business for the washington post. let's get into this. first of all, what could be the main focus of these charges? >> it appears to be focused on a couple of different areas. one is how the trump organization, if it mislead the lenders or taxing authorities in a way it valued its property to save itself money and told lies about what properties are worth. the other focus that seemed to have been more recent is the taxization on fringe benefits. things like free apartments, free cars other sorts of things given to to executives at the company. that's interesting because it could implicate the company and the executives who got the benefits. those seem to be the two areas we know of. there could be a surprise later this week. >> an attorney for the trumps says it looks like they will come down with charges against the company and that's outrageous. they could not get allen

weisselberg to cooperate and that's why they are going forward with the charges. what could this mean for him in. >> it could be bad news for him. trump's cfo was part of every major financial decision of the company over the last 30 or 40 years. very important person to prosecutors. they want him to come over to their side and give testimony against trump. if they charge trump organization, criminally, then allen weisselberg, his legal liability could go up because he could be charged with crimes related to the company misdeeds. he could be charged with falsifying business records to cover up something the business had done. he make some sort of possible accessory to those crimes. if there's going to be charges against the trump organization, it could only make things worse for him. >> you say 30 to 40 years. it continues today. your recent article, you write about how allen weisselberg

donald trump, they will have to find something to charge him with that's worse than that. that overcomes that loyalty. i think that's one of the biggest hurdles for prosecutors is should they ever think of anything that would make him turn on the man that created his life. >> we talked about how donald trump goes in on mondays. are they working together on mondays? do you know whether they see each other? >> we don't know. they're many the same building. if trump comes into his office, they are on the same floor. this is a relationship they have talked multiple times a day before trump ran for office. it's hard to overstate how important allen weisselberg is to this company. people that know the company said he's more like the coo or ceo than cfo. trump is great at making big decisions and marketing the company but the guy who runs the company day-to-day is weisselberg. if he goes, the the company has a huge hole to fill. >> you have written about trump's company suing new york city. they are seeking to reverse the

cancellation of a contract to run a city owned gulf course in the bronx. it prevents any high profile events from wanting to book the courts and cost the city potential revenue. trump said he did nothing to break the contract and this is all about politics. do you know how much money that golf course made for the trump organization? >> we know the revenue it takes in a year is between 7 and 9 million. the profit, the last two years, we have numbers, 2018 and 2019, trump says he lost money on that property. it's opinion a money loser for trump in official papers for a couple of years. this lawsuit is basically a negotiation dressed up as lawsuit. trump thinks he should get 30 million to walk away. the city thinks he should get zero. i don't think the city has a great case. trump is right. there's nothing that says you
