balart right now. >> good wednesday morning, i'm jose diazbalart. we're following a number of high take stories for you this morning. first the pressure is growing on andrew cuomo to resign but he says he is not going anywhere after he was accused of sexually harassing 11 women. >> plus, blocked. a federal judge just stopped governor greg abbott from enforcing an order on how they document immigrants. and hospitals face the covid squeeze and burnout. hospitalizations in florida have shattered records.

in moments we'll go live to a florida hospital treating 500 covid patients. and a little later, one nurse shows the intense struggle and burnout facing nurses. but first we start with a team of reporters. mora barrett is in oregon where fema is helping more people get vaccinated. the president is set to meet with his science advisor. thank you all for being with me. let me start with you what are you seeing there in florida? >> record numbers. an incredible strike.

here at memorial health there is a part of this hospital that is a children's hospital, and there is great concern about the rising numbers of children testing positive for covid. a school in florez gips a week from now. let's look at the numbers and we will compare what happened from june to july. 23 pediatric patients came to the emergencies room here with coronavirus. the following month into july, 240, of all of the children brought in here, they test them for coronavirus and the positivity rate was 18.6%. that is a very high number and it is of great concern. in the state of florida the state of florida established that kids going back to school cannot be forced to wear masks. listen to one parent where they

have been discussing can they push back on the governor? we'll get more on that in a second. >> we're going up against the governor. they seem like they have their hands tied. we have to rise up and say no, this will be deadly. for our kids and our communities. >> so the governor is finding there is push back in the state despite the fact that he said he would with hold the money that comes from the state they say they face children to go back. if the governor has his way, he will withhold the money. that could be about 7,000 per

student per year. they are releasing politicians are withholding necessary tools and funding that would help ensure a safe learning environment. they are intended for school districts to invens in recovery. so there is a growing push back against the florida governor who remains steadfast that the authority to determine if masks should be worn should be one authority. that of the governor in the state forcing people to wear masks, it is not the right choice here. jose? they say it is a crisis of the

unvaccinated. but we're seeing more vaccinated people getting coronavirus? >> yes, and if i broaden it out florida has a very high percentage of people that are elderly. one in five are over the age of 65. that was a very early effort, but what we have seen since then is a lot of people choosing not to get vaccinated in parts of the country where you have a 70% vaccination rate. in florida a 40% rate so there is a real big push for those to get vaccinated. just at this hospital talking broadly about the adults, of the people brought in and treated 92% of them are unvaccinated and the believe among the medical staff is that if people were vaccinated they may have breakthrough cases but they would not wind up with severe

reactions. >> important opponent, carey, thank you. what can we expect out of this meeting? >> we know the white house is trying to do as much as they can for these states facing dire situations like florida down there. they are asking for help from the federal government in a lot of regards. they are talking yesterday about a team of medical personnel. they sent them down to louisiana. the white house says they have been in touch with the health teams there is vaccination

support. there is only so much that the federal government can do to respond. they can put money lick pressure on the governors and here is a little bit about what the governor had to say yesterday. there is people who have been doing the right thing. i say to these governors please help. if you're not going to help at least get out of the way. >> the president using the believe pulpit there. and it appears that messaging is starting to get down to the governors. one governor saying they regret the ban on mask mandates and he wishes local governments had more control at a local level.

>>. >> it could be happening across the country soon. >> it is certainly much more transmisble. what we're seeing is incredibly concerning. and i am most concerned at this point about children under 12 who have not yet had the opportunity to get vaccinated and also our vulnerable older adults and the amino compromised. we need to communicate the benefits to the public and we should consider more vaccine mandates at this point. we need to act immediately. >> what you're saying is more

vaccine mandates are you saying there is more of a fear of a state or federal mandate. >> they are the way out of this pandemic. certainly in the jurisdictions and the locals where it makes since. what did he hear from them? >> right, jose. 7,000 of those volunteers evacuated a year and a half ago and this is only the second time in history they were activated. they also helped with assistance after hurricane katrina.

they spread defense devin states, they asked for help these peace corps. it is a majority spanic community. reminding people that they don't need and i wanted to hear from one volunteer that says even though this is a short term environment she feels she is making a big impact. >> yes, we're only here for three months but the amount of doors we have knocked on and people they have been able to build awareness, but you think maybe i could just save one life

or dozens of lives. >> the peace corps is an internationally recognized organization. they trust what they're saying because of the good repation that the peace corps has. now in their home country doing the service and bringing perspective of what they did abroad. one volunteer worked on the policy and it is about getting people to chance, as they talk to people back in their service countries there is low vaccination rates just because vaccines are not readily available. some clinics have to share away their perspective and expertise especially as the delta variant is surging, jose.

going to places where people like essential workers there may be working they don't have the information and they don't quite franly trust and they tell them this vaccine is not only safe but you can get it without any fear of paperwork or information being transferred to other groups. >> that's right and once more they have a tool where they can call a translator right away. so if they don't speak spanish or another language in some of these communities they have someone on call to communicate that. >>. >> thank you, transcampbell who is currently hospitalized for covid is surging his friends and family to get vaccinated and he is now in the pulmonary icu.

averted, what is your reaction to seeing that this is going on. >> this breaks my heart, i have heard stories just like this. i think at this point if you think that you can wait out this virus and refrain from getting vaccinated, you can't. they can encourage their loved ones, everyone that we know, that is our bath forward out of this pandemic. >> thank you all, texas and florida recorded one-third of all u.s. covid cases in the past

a federal judge just politicked texas from enforcing an order from the governor that would limit the transportation of undocumented migrants. pete williams is following this story from washington. good morning the judge has a new ruling affecting transportation of migrants in the state? >> yes, they issued an executive order saying only law enforcement officials could transport people that came into the u.s. illegally because he was concerned that large groups would spread covid. they say you can't do that, you're interfering, and if you

don't we'll sue. last night a federal judge blocked enforcement of the order nor now. the order would cause irreparable injury to the united states and for those in the u.s. they are challenged with protecting those in small history. so what the governor argued here basically is the federal government depends on nonlaw enforcement personnel. volunteers and others to move people here that are undocumented immigrants around to get them to their court hearings, other places where they belong, and if they can't do this any more it forces them to stay in detention centers longer than they should.

so now the judge blocked enforcement of this order and the judge's ruling is basically just on whether or not the government is entitled to have a state of enforcement. but it reflects whether or not they are illegal or unconstitutional and the state is likely to lose. >> pete williams, thank you very much. thank you. >> weeks after thousands of cubans protested for freedom. we have a brand new interview to share with you. a dramatic firsthand account for a cuban gentleman that made a decision that so many others like him had to make over the past decades to flee the island. morgan, what did he tell you.

>> a few other developments of note, one the cuban government just approved a miami based company to sell food and other consumer goods on the island. for context other foreign companies have been allowed to do business on the island in the past. and finally it is important to remember that the number of coronavirus cases in cuba on the island has continued to rise. there was another 9600 daily cases reported as of yesterday which is close to the record high number of cases it just saw

president biden, speaker pelosi, the entire new york delegation, the governors of new jersey, pennsylvania, connecticut, and rhode island all calling on governor andrew cuomo to resign after a bomb shell report. finaling that he sex julyly harrised 11 women.

tom, it was a civil matter, correct? it seemed like there was a lot of stuff in there. >> that's right to they were focused on the civil side, it was independent, it was run through the attorney general's office. they appointed to the other twos. she said yesterday we're going to keep it on the civil side. she said look, our information is now public. we have a 165 page report out there and on top of that several other pages of public exhibits and appendixes they tied to that. potentially e-mails that went back and forth within the

confines of the new york state police. so there is certainly a lot of public information there and it is up to local prosecutors. there may be something there and of course length ter holt spoke with the district attorney in albany about his investigation. and we have tleed attorneys looking at this now. someone says why are we getting involved in that. so there has to be a jurisdiction and we're focused on violations of law that occurred in their counties. >> this is her answer for why it

took so long for it to come out. >> he has been a politic figure for so long. he was scary. i didn't know where to turn, and i was still working in new york state and i vowed to myself to never speak of this. that is why i no longer work there. >> what do you make of that answer? >> she is describing much of what had been an open secret many years, he rules by a culture of fear. he knows it is bet tore be feared an loved. people are scared of him and there was a culture as outlined in the report for people incluging those that were harassed by the governor. the walls are closing in. the resporting that we just heart, and they are potentially

looking into charges here. the state attorney general made it clear that her investigation from the civil side, but the charges here are troubling and the problem here is that cuomo is losing support very, very fast. there is no one in his corner and he will have to make a decision about what to do in the next couple hours and days. >> with that situation being apparent and growing every day, is there any future for the governor? >> i mean he is going to have to make a decision. the reason i say that is cuomo has been wounded before. he has put up a fight before. he was wounded by investigations in the past. he was wounded months ago when the allegations were for made public. and he put up a fight.

and i would say in some ways he was starting to bounce back. he has been diminished inth last few weeks and months. some of his powers were rescinded. but now we're in a situation where his allies, everyone from the top is calling on him to resign. this is a something they don't want to be talking about. everyone from the city's labor unions, one of the more reliable allies of the governor, so far they have been calling on him to resign along with several others, jose. >> thank you both for being with me this hour. appreciate it. protests moving policy. progressive democrats protesting the end of the eviction

exhausted from this second or third wave of the pandemic. >> as the cases surge again how are they dealing with the stress? >> as best they can, you know? they're pulling together. to do the best they can. i think they're very disappointed because this is a very preventable wave. and what we as a public can do to support nurses can gths get vaccinated if we haven't already. >> how is this new wave of cases different from what you have seen in the past year? >> this incline, the smoke that we have seen is steeper than before. we're also seeing there is a lot

of core morbidities. there is a young healthy population they are dieing when this is preventable. it is a safe and effective vaccine. >> yeah, as a matter of fact the texas department of state health services estimates that 99.5% of deaths occurred money unvaccinated people. >> they're extremely important as well. if you're vaccinated even if you get the virus you will not end up in the hospital. the surest way to end up in the hospital is to not get the vaccine.

this morning crews are facing a big setback in their fight against the largest wildfire burning in california. the dixie fire exploded again on tuesday causing more evacuations. the fire has burned over 250,000 acres. meanwhile, as multiple wildfires are burning in that state, an unusual fight is playing out in one fire zone. in the small town of middletown, california, a lawsuit has been filed to stop the development of a luxury resort. the lawsuit says it would be a danger to residents when the next fire sweeps. nbc's jake ward joins me with more on this battle. jake? >> jose, you know, the dream of california has always been you can live in the most beautiful

place you can afford and the fight over its future is testing that promise. >> middletown, california, is in lake county which hasn't changed in generations. >> so this county is bordered on number one to number three poorest county in the state since the '70s? now developers have approval to build on a 16,000-acre site here and bring hundreds of new high-end homes and a luxury resort to the region. >> it will provide a lot of amenities for the second home or full-time homeowner. >> and the project called gwinc can bring enormous value. >> there's $20 million just in property taxes. so just the economic influx, also the number of jobs for the local community. >> but in california where wildfires are getting worse and worse, lake county has a

particularly frightening history of fire. >> how much is fire kind of part of the culture of this place? >> my house burned in 2015. i've rebuilt it. >> we live with it as people in florida know hurricanes, we know fires. >> now an environmental non-profit is suing to stop the project. >> what we have here is a project approved by the lake county board of supervisors that would locate 8,000 people in the middle of a tinderbox. >> in a statement moke simon told nbc news that as approved this project will enhance fire safety. >> how do you build responsibly in a place that could very well burn again in short order? >> i really believe that with proper planning and fire resiliency, it can create a safer land than it is today. >> the development has several fire strategies. it pays for a new fire station and helipad. it buries power lines under ground and grazing and fire breaks will minimize potential

fuel. >> someone from the outside says you guys know how dangerous this is. >> if i thought it was a danger or threat in my life for my family, i would be fighting hard against it. >> the project could mean a lot of money for the county, but the lawyers opposing it say that is the wrong math. >> how many lives are worth it? is it worth it if five people die in the next fire because they can't evacuate? what about 15? what i do know is you can't perform any type of comparison if the true risks of the project aren't disclosed to the public, and that's absolutely the case here. >> now, jose, the road you see behind me, butts canyon road is the main artery in and out of what would be a 16,000-acre site and the lawsuit basically charges that this one evacuation route is not enough. meanwhile, developers say there is adequate evacuation and it's been passed by lake county and the board of supervisors says if we simply abandon plans in wild
