deriving them when they are in pain, suffering or having a problem. what kind of governance will that lead to. governance will that lead to good evening everyone and we begin the reid out with today's breaking developments in the state of new york where embattled governor andrew cuomo announced he is stepping down. >> this situation byes it current trajectory will generate months of political and legal controversy. i think given the circumstances the best way that i can help now is if i step aside and let government get back to governing.

therefore that is what i will do and my resignation will be effective in 14 days. >> it is big news, and the right decision, but the truth is that he had no other option. cuomo's announcement comes a week to the day after the state attorney general's released a scathing report. his defiance only made matters worse. calls for resignation echoed across the state of new york, the u.s. congress and the white house with president biden joining those urging him to get gone. new york state assembly was plunging ahead with impeachment

indictments. push came to shove and it came really fast. and so with cuomo's departure, in two weeks kathy hochul will be the first woman to serve as government of new york state. cuomo did not do himself any favors either. today a damning new report in the new yorker details the heavy-handed tactics cuomo has used in the past, suggesting he even tried to quash a federal investigation. we will have more on that coming up and it points to cuomo's pattern of defiance when facing legal scrutiny and even his resignation speech, attending to discount the report that brought the incredible allegations into the sunlight. the most serious allegations against me have no place in the

report. there are many agendas and many motivations at play. if anyone thought otherwise they would be naiive. i truly believe it is politically motivated and unfair and it is untruthful. >> that said cuomo's announcement and his exit highlights a glaring double standard we have to discuss. the truth is that cuomo's exit was 100% the product of democratic pressure. democrats hold their own to a higher standard of conduc --

>> i am joined now by new york state assembly member ron kim, assembly member kim, you might have been the first person to call for cuomo's resignation. i do believe you were the first to call for it and i want to get your reaction to him finally announcing he would go. >> my colleagues and i are relieved he is stepping aside so we can get back to the work at hand in protecting new yorkers and moving the state forward. we are also worried that we might not get the accountability that is deserved. the thousands of unnecessary deaths in nursing homes. how do we make sure that we never repeat the same mistakes. >> you know, i think of dennis

hastert who resigned as speaker of the house, went on on and was living his life and ultimately was indicted in that case. sometimes there is a delay between the resignation and the accountability. do you see that trajectory here? should cuomo consider himself out of the woods legally? >> no. not at all. the resignation was so arrogant he would send the lawyer out for 45 minutes to attack the victims and attorney general before going out without any humility at all. i found it outrageous. no, he is certainly not out of the legal woods. he has criminal cases which i

guess will make that criminal case go away but the civil cases are serious and new york state will have to make a decision if they are going to settle or what they are going to do and the investigation into the nursing home deaths and the ethical practices. i think he has big, serious issues. while you are right to bring up the dennis hastert case, that was a long time ago and the world has changed. the tolerance for people to put up with the hostile work environment is dramatically changed. these are not as serious but it was a hostile work environment. the word arrogance is true. you think of the fact that during the me too era, when presumably the governor understood the environment he was working in you were at work

exposing other men who were high profile predators and here he is committing these offenses during that saying he supported me too. from your reporting he tried to stand in the way of federal investigations. walk us through that. >> it is important in understanding today's events. one of the piece of significance and the reason to return to the part of history where he was arrogant earlier, one of the authors of the attorney general's report was someone that tangled with him before. june kim was part of an investigation into him in 2014 and was someone that he then went after. june kim's boss at the time, the top federal prosecutor in

manhattan. we document in the story that he was doing everything in his power to stall this inquiry into whether he closed an anti-corruption commission he had started and in yet another example of, to echo your word, arrogance. some would say improper. experts we talked to said possibly illegal conduct. he shuttered that commission when it started to get close to a number of investigators on it said people in his orbit. so, you have layers and layers of arrogance and misconduct here. and i think that it is telling that the democratic party in new york, and politicians of all stripes allowed andrew cuomo to bully in had this way. to go, at the very least right up to the edge of obstruction of justice. we talk about him calling the white house, about the boss of the author of the report that we are dealing with this week, the prosecutor. these are actions that alarmed

people along the way for years, and yet this is also someone that was really able to maintain a vise grip on power. i hope part of the cultural transformation includes more accountability for those forms of corruption and abuses of people's offices. >> it is interesting assemblyman kim, with trump, that there was a similar arrogance that you saw operating in the white house. did you get the sense that cuomo thought he could pull a donald trump and be the kind of person that the president was? >> i think that is precisely the point. you are talking about powerful men with a history of being in privileged positions and think they are above the law. i want to take a moment to acknowledge ronan's investigative work. he was able to do the hard work to connect the dots and

highlight how much of an abusive person andrew cuomo has been to workers, to women, to the state of new york going back many, many years. i want to acknowledge that work and congratulations on your work and now it is up to us to hold him accountable and to make sure that we do not repeat the same mistakes moving forward. >> thank you. you know, i would just add the resources that came forward, joy and anyone watching at home, i would point to the people that empower any journalist to do a story like this. everyone in the story was terrified about talking about andrew cuomo. and an anecdote like the one that you just discussed where he went after the investigators that were on the case in the present day. he had a long history of going after them or their bosses. you know, these are anecdotes that people did not want to talk about, and the facts that everyone went on the record ultimately, i think that is certainly, i hope a sign of change. and something we should all

encourage. we wouldn't get the story and the shot of accountability otherwise. >> all of these powerful men that put themselves above the law thinking they can abuse whoever and however they want. we don't see they will run out of their companies or paid or pushed out of the companies. is this a case where we will see this happen again? cuomo leaves power, but how likely is it that there is a concrete consequence? humiliated and pushed out and then what? >> the question is can he run for office again and if he runs, will he be reelected, right.

that is a political question. my hunch is that the criminal prosecution in this case will go away. if you have hundreds of cases and a lot of victims, this is not the case you are going to allocate resources now given that he has paid the price of giving up the governorship. if you are asking if there will be a criminal prosecution, i do not believe so. i believe there will be a civil and a lot of money paid. are the voters going to tolerate it? will there be more enabling. in the trump case, that is the problem. everybody knows what he did and half the country votes for him. >> yeah. >> what are you going to do with

that? >> yeah. >> that is not the prosecutor's fault. we need to have a higher standard. you know on some level you get who you deserve. you have a good sense not to elect people who are harassing women and then you get people who harass women. we all have to raise our standards. >> i think that is true. i think that you have brought up other issues, including the nursing home situation that feel unfinished. i talked to prosecutors who would say removing the politician or them removing themselves is the end of it because it takes them out of a position to do further harm. are you concerned that will be the end of it? >> i made a commitment in march when andrew cuomo goes down for

sexual harassment, i will be here to hold him accountable for the nursing home deaths. there is a pending investigation and i hope they will continue to pursue the investigations now he is no longer in a position of power. it is fair game. he can't use public resources. he uses his powerful platform to gas light the workers, the family and the public. now we can truly investigate and examine what he did wrong. >> i wish we had two political parties that had the same standard. there is a lot of accountability that needs to happen. appreciate you. assembly man ron kim who started the ball rolling. really appreciate you.

for masks options. a lot more apparents advocating for mandatory masks and we had elected officials present. we received hundreds and hundreds of e-mails for parents begging us to protect and to keep their children safe. i get to serve with a group of phenomenal women and always have dialogue about the law and about the consequences and about the health concerns and about the risks. and it kind of just came down to doing the right thing to protect the people that elect us to serve them as local school board members. you know we concluded we were not going to be bullied into self interest by the governor who is threatening to withhold

you had 19 senate republicans voting yes. most of those voting yes are not up for re-election or just got reelected like mitch mcconnell and don't have to worry for six more years or they are retiring. you only got 19 republicans to say we need roads and bridges. i wonder now given the amount of work the white house put in, is the same effort going into making sure there is not a double-cross on the other bill. that is the bill that progressives say if that does not pass, they ain't voting for this. >> absolutely. the president believes in both and that is why both taken together represent his economic policy agenda for the country. america needs roads, bridges and the rest of it. we also need to move forward on the provisions, what we have

been calling human infrastructure, some might call it a families and climate and other related policies. but we need to do it and extend the child tax cut. we have to do more on climate. i am going to make the case that that couldn't be bipartisan as well. it is unlikely to get the support. >> not only that but you have people like krysten sinema who is shrugging her shoulders at having no diversity in the negotiations for the bill. 20 white senators got together saying we are going to do it on our own. the other bill is addressing what the party really needs.

do you have a commitment from krysten sinema? do you have a commitment from the conservatives in the party. that they are going to support the bigger bill? are they all going to support it? >> i think that is exactly what they are working through as we move into that phase of things. i am confident that we can hold together with such important priorities on the line and i don't want to under state what it means. you look at the funding for public transit. black commuters are more likely to depend on public transit to get to work. the support for electric vehicles. cleaner vehicles for bus systems. when latina families are more likely to live there, asmais a consequence of airborne

pollution. tribal residents, more likely to have safety issues and be killed in crashes. that is one reason we care about the safety provisions here. i don't want to short that even while agreeing that we have a lot of work to do in that second track and why it is there and we want both to come to the president's desk. the president wants to sign them both. >> i respect and appreciate you said that. i believe when you say that. krysten sinema hasn't convinced a lot of people that she cares about any of that and came to the interest of voters of color in mind and isn't trying to make the case she does. senator klobuchar and senator warren. i have interviewed them both. they talked about the fact that election infrastructure could be viewed as infrastructure. should we expect there to be the white house weighing in.

getting some of these provisions into the next bill. should we expect to see election infrastructure so at least that your folks can vote? >> i don't know the finer points or what will get in. but i know this, whatever the vehicle is, the president has called on congress and america to pass real voter protections, whether the john lewis act, the for the people act, all of the things that need to happen in order to make sure that we protect the foundation. i admire the democratic infrastructure, but whatever you want to call it. it is part of what makes america, america and we have to pursue that as well. >> secretary pete, appreciate talking with you. get on the phone with krysten sinema. i don't know if she agrees with you about all of that.

covid cases. in san antonio, if your kid has lice, you have to disclose your kid has lice. yet you don't have to disclose your kid has covid. there's something wrong with that. i was reading there are about 329 icu beds in the entire state. this is failed leadership at its core. you will have the courts -- my hope is you will have the courts reverse some of these decisions, because we saw what happened in florida today. you have the biden administration sending ventilators. i won't be surprised if the same thing happens in texas soon. >> let me play a fun video for you, tim, because i know you will appreciate it. this is ted cruz. this is what he said when it comes to covid guidelines and democrats. take a listen. >> it's a weird thing. there's a herd mentality among congressional democrats that they obey chuck schumer and their only answer is sir, yes,

died for this belief system that they have decided to create. i wonder on -- i tweeted this. i will ask, at some point do the vaccinated suddenly realize that we are also a group and also a majority and start acting like it? there's only so much compassion people will have for people dying of ignorance, essentially and saying, i refuse to get the vaccine, i'm not going to wear a mask and you get covid. should democrats push back and say the vaccinated need to band together and demand that we have our local governments able to protect us and our kids? >> i think that the way that that happens -- it starts with businesses. there's how we get anywhere. you saw that united airlines said that they are going to start requiring that their employees are vaccinated. i can guarantee you southwest airlines and others are going to take a hit, because people want to move on from this pandemic.

the only way that we go to concerts, we see family members, we get our kids back in school, that we go back and hug our loved ones is if we get vaccinated. you are starting to see that with businesses. we need a few more businesses to step up and require vaccination. i think that's the only way that that happens. >> tim, it brings me back again to these old orthodoxies. you see the governor demand private businesses are not allowed to make their own decisions. they don't want businesses to protect their customers and their workers. is the new orthodoxy that the big government should tell businesses what to do? >> yeah. they are throwing those out the window. that's what their new donald trump base demands. the democrats need to go on offense. it's the right pushing culture

wars. this is a winning culture war issue for the left. >> it is. >> even about 40% of the republican base has got vaccinated or wants to. you have the democrats almost. most of the independents. almost half of the republicans who want vaccine mandates, who want this. the democrats need to be more on the cutting edge of this and turning the remaining quack republicans into the anti-vax party, that's a majority issue for democrats going into the midterms. >> 100% i agree. do you see the white house -- i think white house could do this. there's a huge federal workforce. they started with the pentagon. does the democratic party need to be more aggressive and say, we the vaccinated are taking our country back? >> i think that you will start seeing that a little bit more from the administration. they want to get people vaccinated. right? they want to make sure they're doing this as much as possible. you start to see that with the

federal government. i think that you will see the administration take an aggressive stance. >> if not, then a lot more people are going to die, a lot more businesses are going to close. if you want restaurants open, go to broadway, go to the theater, there is a way to do it. you can just freaking get vaccinated and stop believing conspiracy theories. thank you very much.
