good evening, and welcome to "politics nation." tonight's lead our rights under attack. millions of women in texas woke up this week to the news that the supreme court inaction it allowed their -- inaction had allowed their constitutional right to have an abortion eroded essentially out of existence. and in the following days, millions of other people in other republican-controlled states watched as their own legislaures rushed to follow texas' lead. in a blistering dissent, justice sonia sotomayor called the court's order stunning. but while the texas law and court's decision might have

stunned us with this brazenness, we cannot be surprised. the current court with five of his nine members appointed by republican presidents who did not win the popular vote. while they've shown nothing but disdain for the fundamental rights of america's most marginalized people, this court has continuously disregarded not just the right to choose but also the single-most right of citizens in a so-called democracy. the right to vote and choose their own leaders. the two are inextricably connected. both fundamental issues about the right to self-determination, and in a truly free society people should get to decide whether and when to become parents without interference from the government just ads we should have guaranteed access to the ballot box.

without fear of intimidation, suppression, or retaliation. that's why we marched on the capitol last saturday, last week today, and why we will not stop. we cannot wait and watch as our rights are stripped away. by next year's midterm election, it may be too late. conservatives on the court in congress and in state legislatures across the country are determined to defile the sanctity of the voting booth and the privacy of your doctor's office. so we start tonight in the state of texas where without further action they have so far succeeded in both. joining me now is congressman al green, democrat of texas and member of the homeland security and financial services committees. congressman, first of all, thank you for joining me. i want to start in your home state where the supreme court's inactions has allowed the most

draconian abortion law in nearly a half a century to stand. i particularly want to ask you about the part of the law that turns ordinary people into vigilantes because the state does not enforce this ban but rather deputizes texans into suing anyone involved in aiding and abetting the procedure for $10,000. what will this look like on the ground, and do you expect to see republicans try this trick for things other than abortion? >> well, thank you for having me, reverend. and i'm wearing my mask simply because i have staff working with me, and in our office we have a policy of wearing our masks when we are in the office together. thank you all for your intro. i would like to associate myself with your comments, and the portion wherein as you said that we should not be surprised is

entirely correct. texas is where roe vs. wade took place. this was up in dallas county. the wade in roe vs. wade was henry wade, the district attorney there who you seed. texas is the place, reverend, where we had white primaries. you're right that it's linked to voting, as well. and after white primaries were outlawed by the supreme court, texas had white free primaries. texas had been a bad actor for a long time. yes, i believe that there are those who will seek to have this reward accorded them. they will go out and try to find ways to literally bring people before the bar of justice in court in a civil lawsuit to try to acquire $10,000 because they may suspect that someone has sought to get an abortion within this six-week period. i would also say to you that i don't understand how rape or incest can be eliminated. if a young teenager daughter is

raped, what parent would not want to help that daughter receive the choice that she might have of not carrying to term? it's just amazing to me. and i support totally the opposition to this. speaker pelosi has said that we would codify this law so that it would not become something that the supreme court might act on in this arbitrary way, i support that. we need to codify the law. >> as you mentioned, this law says even if the case of rape or incest you can't get an abortion if you have been pregnant over six weeks. and many women don't even know they're pregnant the first six weeks. other states are looking to follow texas' example on this. south dakota governor noem has directed her staff to look into emulating this attack on the constitutional right to choose. and other republican-led states aren't far behind. what actions can congress take

to stop this assault on reproductive justice since the supreme court has refused to step in? >> yes, sir. of course we can codify laws that protect the rights of women. we already have such a law pending. and speaker pelosi has already indicated that we'll have a vote on it. i'm convinced that we can pass it in the house, and i'm optimistic about the senate because i believe that there are republicans who are concerned about the lack of an opportunity deal with incest and rape. and i'm also eager to say to you, reverend, there is a higher court than the supreme court that has to rule and has to make its opinion known. and had is the court of public opinion. it's time for the court of public opinion to issue its thoughts. it's time for people to do what is lawful, and that, reverend, is engage in peaceful protests. if the public says this is not something that we want, the supreme court eventually will come around. maybe not immediately, but

eventually. >> now congressman, let me turn to the aftermath of the january 6th insurrection. freshman republican congressman madison cawthorn of north carolina referred to insurrectionists as, quote, politically prisoners at a party event this week. he also falsely claimed the recent election rigged and said there would be bloodshed, this a quote, he said "bloodshed." despite denial from his office, that seems like a pretty clear threat to me. what is it like to come to work every day with someone like cawthorn? will there be consequences for his threat, congressman? >> reverend, i made a note because this is such an important issue. he also said he would dread having to pick up arms against a fellow american. that's pretty strong language, reverend. and it does make it difficult

for persons to do the things that we have to do to pass legislation. we like to believe that we can visit with each other and we can talk to each other, and that we don't have any intentionality associated with harming another american when these conversations are taking place. this is very much regrettable. it's a very sensitive issue, and i would hope that this member would retract this posthaste so as to let the other members know that this is not something that we should be concerned about. >> now, the threats aren't limited to freshmen republicans like cawthorn. this week house minority leader kevin mccarthy threatened technology companies that have been asked to preserve their phone records relating to january 6th and the insurrection. why is republican leadership so desperate to keep the truth from coming out? >> reverend, that is the question, why as opposed to what are they doing. but why are they doing this?

reverend, it's obvious that they are attempting to cover something up. some would say whitewash. others would say this is an obstruction of congress, a congressional investigation, others would say an obstruction of justice. i say this is a part of the effort to bring back a president that they have been trying to protect since he left office. remember, mr. mccarthy did not want the committee to be established, and he has fought putting persons on the committee. this is an effort to look forward to 2022 when there will be an effort to take the house back, but they will fail. and in 2024 when there will be an effort to reclaim the presidency wherein they must fail. we have to take to the streets, but more importantly, we've got to vote. this is a time for every person to register and vote, notwithstanding senate bills here in texas that are going to thwart our efforts, can't get

24-hour voting. in texas we ban things we choose not to understand. and i said choose not to because there's no one so blind as he who refuses to see. and we banned 24-hour voting. we have banned drive-through voting. we've made it difficult to vote generally speaking. and when this happens, you've got to conclude at some point that this is about upcoming elections, and they i believe are preparing for what they perceive as a return of a president who was impeached twice and should not be returned to office. >> congressman green, briefly, please. as a member of the house homeland security committee, i wonder if you could corroborate on reporting friday that homeland security is concerned about far-right groups praising the taliban in their online platforms where the takeover of afghanistan has been cast as a model for the kind of civil war many of these groups are trying

to foment domestically. it struck me in the reading that 20 years after 9/11 and all the anti-islamic sentiment that it channeled from the right wing, organized white supremacists are now looking past race and religion and seeing a violent success story in afghanistan, even as they demonize afghan refugees as part of a racial replacement campaign. have you heard these concerns from dhs, congressman? >> well, the concerns i am aware of have not gotten it directly from dhs, but the concerns i'm aware of and concerned about, and here's why -- the insurrection that took place has been something that has inspired these white supremacists. they don't see this as the last attempt to assault the capitol. many of them believe that what happened was a good thing, and i believe that we must do all that we can to make sure that the capitol is protected.

never again should such a thing occur. speaker pelosi has done an outstanding job in bringing on new personnel, new people to help with the capitol police. so i'm looking forward to doing what we can as members of congress to not only say that it shouldn't happen again but, reverend, we should memorialize january 6th the same way we memorialize 9/11. congress passed a resolution. the president signed it. we need to memorialize january 6th so that people will know where the congress stands on an insurrection that took place on our watch. >> thank you for being with us, congressman, and thank you for marching and speaking with thousands of us last saturday in washington. congressman al green. joining me now, former republican strategist and founder of rydex strategies is rena shaw, and podcast host and founder of "woke af nation,"

danielle moody. rena, let me start with you. i want to start with the texas anti-abortion law that has rattled the nation. the supreme court denying to step in by a 5-4 vote as women now face being turned down in abortion after only six weeks of pregnancy. the conservative-leaning supreme court decision was a direct consequence of the trump presidency which led to three supreme court appointments. is this just a taste of what is to come during this battle for a fight for women's right to choose? >> well, this story really epitomizes what the republican party is today, rev. it's a party of hypocrisy. on the one hand they say our body, our choice, no masks. on the other, well, women, we want to tell you what to do with your body. will be make up half of the country. what legislators have told us is freedom isn't free for everyone. what i feel today is disappointment because i'm not

surprised. i knew this, i knew when senator collins said what she said, i knew that in the back of her head she knew better. if had ruth bader ginsburg today no doubt would the supreme court are had a different decision. don't lose faith, anyone listening. please don't. democracy demands that we get out there now and educate and we advocate for those who cannot do for themselves. i'm a lover of freedom. i may be pro-life myself, but i am pro-choice for other women. that i believe is the view of not many more republicans out there than we know. i hope they get out and share their stories, stories of when they needed a medically necessary abortion. some insurance companies now cover genetic testing. during both my pregnancies that was covered. genetic abnormalities show up and make a pregnancy nonviable. share stories. anyone right of center that's conservative, you know this is not a black and white issue. you know you need to share. we need to do this work now because we've seen what happens. we see what they'll do in the dead of night. >> you're right. you could be pro-life yourself but still fight for people to

have the right of choice. danielle, it's not lost on me that in texas people have more of a right to spread deadly virus and not wear a mask than women are to control over their -- have control over their own body. this week the biden administration's punching back criticiing the supreme court and calling the anti-abortion law almost un-american. as we near the midterms, will this force democrats to get their act together to prevent more laws like this? >> i mean, the reality is is that nobody should be shocked, and especially democrats should not have been shocked about where texas has gone. we have been in a constant battle to preserve roe v. wade. we've been in a constant battle to preserve our democracy. and we are at a place where we knew what was going to happen when mitch mcconnell decided to jam through the appointment of

amy coney barrett three weeks before the election. three supreme court justices that mitch mcconnell was able to put on the courts because guess what -- democrats don't talk about the courts. and it's one of the most important things that we need to talk about. when we're talking about voting rights, when we're talking about lgbtq rights, when we're talking about women's rights, where does that come from? it doesn't come from congress alone, it comes from the courts. mitch mcconnell appointed over 300 federal justices, and we have now the most conservative court that we have ever seen. and so yeah, i wish that democrats would stop playing defense and start playing offense and use the power that the people gave them in the midst of a pandemic in 2020 and came out in a historic election. look, voting is extremely important. we know that. but also the conversations and whose feet we need to lay this battle at is the feet of republicans, and democrats do not do that. i hope that we see a sense of urgency that we have yet to see.

we are not in a collaborative place. we are not in a lot me talk to my friend from across the aisle type of place. we need to start utilizing the power that the people gave the democrats and move forward because we are running out of time. >> rena, private companies are fighting back against texas' oppressive anti-abortion law, sb8 is the title of it. the ride-sharing app lyft has issued a statement saying they have created a legal defense fund that will cover 100% of all drivers' legal expenses if sued by texas for taking a passenger to an abortion clinic. they also announced they will be donating $1 million to planned parenthood. why is it that when democracy fails it's up to private companies to step in to fight? >> to me this isn't even enough. this is because the texas abortion law is so cruel. i mean, they're talking about civil lawsuits against people who drive a woman to an abortion?

this is so absolutely gray and beyond the pale that of course these companies have to step in because so many of us use ride share opportunities nowadays. and so i'm glad they did, but we need to see far more corporations do something. the cruelty of saying that even in the case of incest and rape this is going to be illegal for women to seek out abortions after six weeks, again, as was mentioned in the segment, that women oftentimes don't know they're pregnant at six weeks. for both my pregnancies i didn't know until well after six weeks. i was surprised, and i was married at that point. you know, this is just something to say that corporations owe us more. and yes, they do have the -- in this era when republicans are doing people very dirty, but we need more corporations to put their money where their mouth is. actually stop funding some of these lawmakers. >> yeah. >> and stop giving money to their pacs because we're watching. we know what you do. these corporations need to step up for american women because we hold the pocket. >> please stay with us. we'll bring you back, both of

assault on reproductive freedom that has been under way for decades in this country. it finally came to a head this week as the conservative wing of the supreme court allowed a draconian texas law to stand. one that will effectively outlaw abortion in the lone star state and open definitions by the precedent set by roe v. wade. this development is a violation of the bodily autonomy of millions of texans, and it will disproportionately hurt women of color and poor folks. i'll leave the details of the law for someone else to parse. it's been covered very well on this network. instead, i want to address -- i want to really get to the hypocrisy of the party that calls itself, quote, pro-life. but only when it comes to

abortion because these are the same folks who have consistently been pro-gun, pro-war, and pro-death penalty. meanwhile, once these pregnancies come to term, these people are nowhere to be found for the rest of their child's life. no paid family leave, no food stamps, no universal childcare, no eviction moratorium, no funding for public education, and now no mask or vaccine mandates to keep those children safe from coronavirus. and yet they have the gall to call themselves pro-life. this is the party who spent decades stacking the courts with anti-abortion judges all while lying to the american people about their real goals. >> i think the likelihood of roe versus wade being overturned is very minimal. i don't see that happening. >> this is not a referendum on

welcome back to "politics nation." let's bring back my political panel. we have a lot to talk about. a podcast host, danielle moody, and former republican strategist rena shaw. danielle, on tuesday house gop leader kevin mccarthy warned multiple companies not to cooperate with the house select committee looking into what occurred on january 6th. now this comes after the committee asked 35 communication and social media companies like verizon and twitter to preserve their records since it may be valuable in their investigation. the reason may be to look into how gop lawmakers were

communicating with former president trump leading up to the violence. could turning over these records be why leader mccarthy is so against it? i mean, what does he have to hide? >> rev, he has everything to hide, as does every single republican that was vocal at the rally that was held right before the insurrection occurred. the reality is is that we need to know whether or not our leaders were in conversation with insurrectionists, provided them with plans of the capitol so that they knew where to go and who to attack and when. we need to understand how this republican party is currently operating. we're supposed to be in a democracy, right, that is supposed to have a two-party system that is about working for the betterment of america. and what we have come to understand about this political party under trump and before is they do not want america to be better. if they did, they would tell people to get vaccine the, if they did, they would tell their studio wear masks, if they did

-- constituents to wear masks, if they did they would be about doing everything they could do to get us out of a public health pandemic so that we can become economically stable and viable again. but that is not what they want. they want biden to fail. they want america to fail so that they can bring in and usher in their authoritarian regime. this is not something new. this is the playpeculiar that republicans have been -- playbook that republicans have been using for some time. with leader mccarthy we need to ask why don't you want us to see the phone records, why don't you want to tell us, jim jordan, what conversation you had with president trump and when? did you talk to him that day, the day before, and why? >> it goes deeper than that. we know that leader mccarthy was a person of great interest during former president trump's second impeachment trial. mccarthy is known for having close communications with trump. is it ethical for him to be encouraging private companies not to comply with the house

committee's investigation? because what i really want to underscore here is if a committee investigating what happened, there could lead to crimes. he is interfering with what could be a criminal procedure which could in itself be a crime. >> that's right, rev. this is what's really at stake here. he knows it's unethical, number one, but here he's also basically breaking u.s. code. people are saying he can be referred to the department of justice for breaking a code, and that code essentially says you cannot threaten anybody trying to comply with the orders of the select committee. the select committee has reached out to 34 corporations, they want to get those records. and i think as americans we should want to see these records. if we have people who have been in congress who said things that were part of that rioting, the insurrection on january 6th, we american taxpayers deserve to know because they're getting protection every day in the halls of the u.s. congress with our dime. so that's number one.

and i do hope this goes a step further because what we saw on january 6th, that was extremism. if leader mccarthy chooses to go this route, we need to be extreme with him and 11 others who sent a threatening letter to google, verizon, at&t, they sent this threatening letter y.? republicans are threatening corporations here? what is going on? you think you have that much power? >> threatening them about -- threatening them about cooperating with a committee investigation of the u.s. congress. let's be real clear emphasizing on what he's threatening them about. he's really telling them to defy the request of a committee. danielle, let me ask you this -- the recall election in california is just ten days away with democratic governor gavin newsom battling it out to stay in power. vice president kamala harris will be campaigning for newsom in the final stretch ahead of the election. californians must also vote on who should replace him if they

choose to vote yes to the recall. california has gone red before. what do you see happening this time? >> i mean, i got to say that i'm really concerned. i'm concerned with the radical right that they have on the ballot in california. i'm concerned with the trumpism that they are willing to follow. and the reality is this -- everybody in california has got to get out to vote. everybody in california has got to show up. everyone in california has got to say that they are not about this recall, that avin newsom should not lose a seat. we cannot lose the state -- that is what will happen -- we cannot lose the state of california. i don't think folks understand the urgency that we're in. i hope that texas is raising the alarm that needs to go around the country, not just people shrugging off and saying at least i don't live in texas. no. what is happening in texas will happen everywhere, and folks need to pay attention to what is happening there, what is

historic clashes over criminal justice. joining me now, civil rights attorney general of black america ben crump. attorney crump, thank you for being with us. we have a lot to talk about starting with this new fbi report that found hate crimes rose again in 2020. the sixth time in the last seven years. the highest level since barack obama's election 12 years ago. nearly 7,800 criminal hate crimes reported last year by more than 15,000 law enforcement agencies. a 6% increase over 2019 and 20% increase in just the last six years. but then you add this offenses targeting black people up approximately 42% while attacks against people of asian descent were up more than 70%. we've heard from attorney general merrick garland that the prosecution of hate crimes is

being enhanced by the justice department. and i certainly understand the targeting of extremist groups. but i wonder from a law perspective how you stop individual actors before they can actually commit their crimes because this report tells me the last six to seven years have emboldened both. you're the attorney general of black america. how do you say this? >> first of all, i want to say congratulations on ten years of "politics nation." one of the most consequential important television shows for people of color, especially african-americans. and as i congratulate you, that is a segue into answering your question about the rise of hate crimes. we have seen over and over again that minority communities that have been marginalized in

america have been engaged and empowered. we saw that with the election in georgia, turning it blue. so there's this projected census that black and brown people are becoming more populous. the america that we see is becoming more diverse, and so you have an egregious reaction by those on the far right following the six or secretary of -- or seven years of make america great again. does that mean they can start making it great again when they were -- we saw in 2020 when they were discriminating overtly against asian americans, and now we see this rise in hate crime against asians. so i believe this is their response because they are afraid of a more diverse america, reverend al. >> now attorney crump, as one of

the attorneys for ahmaud arbery's family, could you elaborate on the charges now facing the former georgia district attorney who was initially tasked with prosecuting his killing last year by three white men. one of whom was revealed to be a retired veteran investigator in her office. because the indictment of jacqueline lee johnson by georgia's attorney general this week alleges that she violated her office and obstructed the investigation into arbery's death by, quote, showing favor and affection to former police officer greg mcmichael and directing that his son travis mcmichael should not be placed under arrest. both men now stand accused of felony murder. i know you, attorney lee merritt, and arbery's family held a press conference yesterday. how does the indictment impact the case? >> it is so important not only for this case, reverend al, but

also for other cases where the message is sent loud and clear that when prosecutors abuse their authority to put their hands on the scales of justice to show a total lack of respect and use their position to make sure that minority victims, black and brown victims, are not given the same due process of the law that should be enjoyed by all american citizens, that they will be held accountable. johnson that was clear from -- [ inaudible ] sent the message that she may not have killed ahmaud arbery, but as i believe she certainly played a starring role in the cover-up, reverend al, that you and i know about with attorney merritt we fought over and over

again to say that based on the video day one, we didn't see it until 72 hours later. they knew on day one that those murderous duo father and son had lynched this young man. and so this is huge. this is huge, reverend al. >> yeah. ben, as you mentioned, "politics nation" is celebrating ten years on the air. and looking back, it will be an understatement to call you a friend of the show. and we have always been grateful to have your insights on civil right abuses going back to the first case that really gave our program its voice, the delayed investigation into the death of trayvon martin in the spring of 2012 and the eventual murder trial for that death. you're no stranger to television. you brought me that case when it wasn't even really covered. and i hope that you recognize what we have tried to do on this show to set ourselves apart for the last decade.

a week ago today last saturday tens of thousands of people marched with martin luther king iii and andrea king and i around voting rights in washington to the u.s. capitol building. cbs estimated 50,000. i thought 20,000 when we started, and it swelled. before the week was out, though, before we got to the middle of the week, the supreme court refused to step in to protect women's rights to choose in texas. now some would say what does one have to do with the other, and i'd say everything because the reason the supreme court could make that decision is because a president named donald trump put three people on the supreme court. and scores of people on the federal bench. why? because of voting.

if you don't vote, people that are against our interests, whether we're women, whether we're lgbtq, whether we are black, whether we are latinx, asian, native american, they will operate against the interests of all of us. that is why those that are fighting for women's rights and voting rights and police reform must come together. we do not have to agree on all of the issues, but we have to agree to we must stand together to protect the interests of all americans that are under assault by the same forces that want limit our right to vote, limit women's right to choose, and limit other people's right to liberty and the pursuit of happiness. it is no accident texas was where voting rights and women's rights were the station that we
