don't worry, we won't go far. we'll head over to ohio for a bit so i can introduce you to josh mandel, the former state treasurer and senate candidate. if you really want to understand today's republican party, you need to understand this guy. josh mandel is currently the front runner in ohio's crowded republican senate primary field, filled with maga cult devotees and former state party chair. this is mandel's third try at becoming united states senator. the first time he lost to sheriff brown and called out for his campaign's caual relationship with the truth which is a nice way of saying they lied. bad enough. mandel goes further. there is nobody more shamelessly and pathetically devoted to donald trump than josh mandel because, let's face it, you're not going to go anywhere in the republican party unless you pledge undying fealty to trump's

claiming their behavior is destructive so to review, the official arm of the national republican party is punishing two diehard conservative republicans because they dare to defend the constitution. that's bad, really bad but you know what is worse? the way the party defended the move. in their censure, the rnc described them as participate income a democrat led persecution of citizens engaged in legitimate political discourse. did you hear that? what you just heard would be more at home in the soviet union, cut kremlin foes. they're like will smith in "men of black" with the flash thing to erase the brutality we saw with our eyes as plain legitimate discourse. this here what you'll see now is

and maria teresa. matthew, pretty stunning. i was shocked to hear mike pence actually say something so bluntly true but let me add what liz cheney had to say. the leaders of the republican party made themselves hostages to a man that tried to overturn a presidential election and said he would pardon january 6th defendants. i can't recognize those in party. i do not recognize those in my party that abandoned our constitution. rather than focus efforts how to help the american people, my fellow republicans chose to censure two members of the party and triable to hinder their ability. your thoughts on all of this? >> first of all it's a

[ laughter ] we should talk movies. we should talk movies. this is a movie we're seeing unfolding. what i think what is a good thing i think is that we're getting quite a bit of clarity about who the republican party is. donald trump is obviously an proximate cause. donald trump was basically a reflection of who the republican party is as opposed to a cause of it. like saying jefferson davis was the reason why the state seceded. no, the state seceded because the people in the states wanted to secede and he happened to run the show after they seceded in this. to me, that's what is a reflection. having worked during the republican party in a brief time that i did with george w. bush, the rnc, people keep this in mind is the people most in touch with who the republican party base is. the rnc is closest to the republican party activist and

the republican party grass roots so when they put out a statement like that, they're a complete reflection of the republican party and the unicorns like adam kinzinger and what mitt romney said today and liz cheney, they're the complete exception to the rule in this. you know you're in a bad place when the person today who has moral fiber in the republican party is mike pence. you know you scraped the bottom of the barrel of integrity because i wish, i wish he had had the courage to have done this a year and three months ago in the middle of this organization of the coup. >> yeah. and he -- right. but he also did the right thing. he did it twice. he did the right thing on january 6th. he's doing the right thing now. let's see how long he can hold that up and whether it will be on lindsey graham time where 48 hours from now he says i didn't mean that. trump is gone. let me bring you in, maria. i think it's an important part about the rnc, right?

i can't remember who it is from the lincoln project who says the sound you hear distantly is the republican souls leaving their bodies, right? the rnc who are souls of god, they have gone. on january 6th, they also condemned the violence. they condemned it, too. they put out a statement saying uh-uh, wrong, this is wrong. wrong thing to do. the members of the republican national committee strongly condemn the violence around the capitol building in d.c. violence does not represent acts of patriotism but an act on our country. fast forward today, they are saying kinzinger and ch cheney wrong and the chairwoman may realize how bizarre they sound. she tries to soften it. says will the violence maybe not so great, do, do, do, but she's already said it. what do you make of all this? >> let's remind our audience

what happened on that day on january 6th. there is 724 individuals right now that have arrest warrants, they are getting processed because they violated and tried to create a coup. if you talk to members of congress, if you talk to our colleagues in the press, they have ptsd from that day. you can't deny it. the rnc now is trying to change what the american people witnessed. i remember the day after january 6th, i had to explain to my daughter what was happening live and went on a zoom call and her teacher was talking about it. he was in third grade. can you imagine talking about what we were witnessing to children? this is what -- again, i recognize pence is now doing the right thing. i agree they should have done it 13 month s ago but the fact he's breaking with the republican party's base and so is mitt romney and kinzinger, it

demonstrates that there is a fraction of the republican party that can splinter off and there are a lot of moderate republicans that need a place to live and allows them to not only bear witness but demonstrate to the broad republican base that not everyone has to be party of trump. >> yeah, absolutely. >> this is a long shot but also creates that possibility of a truly third party and that's going to be a lot harder because there is a party of what allows for this to happen is the democracization doesn't happen because of party states but individual donors and fundraising so there might be an opportunity again to splinter the republican party where individuals play into the liz cheney view. >> we'll see. this is a party that publicly condemned colin kaepernick for kneeling. they said that was unamerican. they condemned black lives

matter. they don't think that's legitimate police discourse. so they are particular what they condemn, right? they're trying to erase things like the actual history of the country. that's not right. they're not quite consistent with these things they're saying. i want both of you to comment on the fact they're doing this for a reason. rnc gets what they're dealing with and demographically, there are fewer and fewer particularly white rural and white non-college voters. they are a diminishing number and republicans are over performing with that smaller and smaller number and it's a dramatic decline. that's what they're dealing with. they're trying to over perform with a shrinking electret. >> well, i think they're trying to do two things, joy, simultaneously. they're not trying to over perform but also as you know through state after state after state, they're trying to pass laws of the composition of the

electret more closely matches what they want, which is not a diversity of the country and not what the majority is but trying to pass laws to restrict the vote so people have harder access they don't want to vote so that then they have a better ability to win elections. as you brought up colin kaepernick, i wrote this column today. today in the nfl reminds me of the conversations going on around the rooney rule, this brian flores thing that you have to at least interview a diverse coach, a coach of color because right now there is only one african american coach. the republicans talk about democracy and the constitution like the rooney rule. they basically want to check the box and do everything opposite of what the ronnie rule is. they say don't look over here because i'm doing everything possible to hurt democracy and the constitution. >> yeah, very quickly, maria.

the right of the people to be secure in their persons, houses, papers and effects against unreasonable searches and seizures shall not be violated and no warrants shall issue but upon probable cause and particularly describing the place to be searched and the persons or things to be seized. for anyone unfamiliar with the constitution, that's the fourth amendment. the man that wrote the constitution included it specifically to remove what the british government and military had, namely the right to enter and search any britain's home at will. now while we no longer have to fear the red coats breaking down

our doors, we still have to worry about authorities busting in and maybe killing us, those of us, let's face it who are black or brown due to the issue of no knock warrants. we've seen too many examples of no knock warrants ending innocent lives. two days ago minneapolis police used a no knock warrant and within nine seconds ended the life of a 22-year-old black man named amir locke. police released the video. it's disturbing. take a few seconds to prepare or look away if you need to. police also blurred the faces of the officers involved. >> police! search warrant! police! search warrant! police! get on the ground! get on the [ bleep ] ground! et on the couch was shot three times. locke was not even one of the person police were searching for. he didn't live there. he was holding a gun and while police claim it was pointed at an officer, the footage doesn't make that clear. the shooting is the latest example of violence including the minneapolis police department under intense national scrutiny following the death of george floyd in 2020. joining me now is maya wiley, former assistant u.s. attorney and msnbc legal analyst and former detroit police chief who is currently running for congress in michigan. thank you both for being here. tonight the mayor jacob frey announced he's halting no knock warrants saying he'll work with national experts to review and suggestion revisions to the department's policy. want to throw that out there. maya, the reason i wanted to start by reading the fourth amendment, it feels the fourth amendment might be a thing on

pipe there sounds really good when i read it on television. i don't understand how we have a fourth amendment if police can do what we saw on that video when a man is asleep on the couch, bust in and shoot him in nine seconds. is the amendment a dead letter at this point? >> it's not a dead letter but constitutional provision that had the supreme court create many, many exceptions to it and depending on your point of view, shooting a lot of holes in it. because essentially, what the supreme court said is well, you know, yes, there is -- you generally have to have a warrant but here are all the exceptions to when you don't have to have a warrant. and that means, that means that he then states for example to have laws that say, you know, you really should get a warrant before you go and we will actually feel very uncomfortable about no knock warrants, if there is what justice stevens in

1995 called circumstances, that's a reasonable standard. you read and read out loud probable cause reasonableness is less than probable cause. even in these other situations there can be exceptions why elections matter and matters how we have a conversation about the laws we need to keep us safe. i want to make one point that often gets missed talking about no knock wants but 94 civilians regular folks were killed because of no knock warrants because of 2010 and 2016 were the years. 16 police officers were killed. it also engangers police officers to create conditions and more violence and so if we

care about creating more safety for everyone including law enforcement officers, we have to take a serious look at these practices and policies. >> yeah, chief, i cannot imagine being asleep on the couch and there are a lot of people, i wouldn't do it but a lot of salespeople sleep with a firearm near their bed. some people do that. whatever. i can't imagine being asleep on the couch or my bed and having any sound of somebody busting through the door and then having somebody come in and react in a way -- how do think think people will react? i don't understand what this has done. i think of breonna taylor, botham john. >> it is not. maya did a wonderful job setting the table.

a name that's missing from your list. she was killed when detroit police were executing the search and arrest warrant for a murderer and a 9-year-old ends up dead. my predecessor was relieved of his duty after that and i became chief of police so i'm super sensitive to this and the no knock warrant has to be a relics of the past and it's amazing to me, as well that you don't have second amendment standing up for castile and amir locke. they possess weapons but absent in the conversations when there are black persons armed legally and killed by the police. so this is another example of just the eblgties in the crime 'til justice pham. >> we know the officer actually fired the shots, mark has been the substance of three

complaints since his hiring in 2015. all were closed without discipline. no listing on what the allegations were. he is on paid administratve leave. how do police chiefs and the sergeants, et cetera decide who gets to be on these no knock warrant completes? who gets to be on the team. you would think you only want the most pristine officers, the best sense there and what are officers trained to understand about the fourth amendment? >> your seniority will dictate the unit you get to work in. in a swat team or special response team, this is a training mechanism that goes with that and there should be a strong assessment to use of force issues with officers assigned to the specialized units. i can't say for certain there are because there are 18,000 different police departments across the country. each having their own chief and

governing bodies and there has to be standards to such things. you can go -- look in the minneapolis area. you have amir locke, castile, brianna taylor. you look at the different incidences and unfortunately, there are black people that end up dead, there has to be an active standard and we can't continue to allow our staff to 18,000 different chiefs. >> we need a new way of thinking and looking at policing in this country. come up with something new. thank you both very much appreciate it. the winter olympics begin in celebrations and controversies where we're talking boycotts, concerns about human rights abuses and global tensions and covid. speed skating medalist apollo ono joins me to talk about that. o ono joins me to talk about that.

the winter olympics kicked off in beijing that was quite a december distraction. the crowd was limited due to china's strict rules and the government is barring ordinary citizens from attending but vladimir putin was attending and closing his eyes when the delegation was introduced. he met with ping facing pressure from the west. a cross country skier was one of the final torch bearers for china. the u.s. is staging a diplomatic boycott of the games with several other nations over a number of human rights concerns. the u.s. in particular cited china's attention to the wiegers which was called a genocide and

protests in hong kong. meanwhile, team usa marched in today's parade of nations while here at home, nancy pelosi reiterated a warning for athletes. >> as i say, i wish the athletes well. i do not encourage them to speak out against the chinese government there because i fear for their safety if they do. >> joining me now is apolo ohno, eight time medalist and entrepreneur. great to meet you via the television and great to have you here particularly today because, you know, the olympics is open. it's a much more low key sort of olympic opening and china is a very particularly troubling venue, right, given human rights issues. as somebody that competed at a very, very high level, how do you think all of that controversy on top of the pressure to perform impacts this? >> i think it would be remiss if

you didn't acknowledge the fact there are a lot of both out sized events and things that are unlike any normalized event that has happened in the past. the olympics has always been a place where we try to separate sport from politics, we try to kind of corral and unify behind team usa in a way we can cheer these and we also live in a time these issues are sensitive and real effect the athletes for biracial, triracial. they have opinions. this is an unprecedented time. the rise of social media, the access to information and misinformation is challenging. i look at this from a zoomed out perspective. i deeply obviously believe in the olympic movement to bring all humans together, to bring people together to compete and to parlay and to participate in these sports in an effort to

showcase what the human spirit can overcome and be but again, this is a real issue. these are real topics and there is a lot of discussion that is happening. >> yeah, the idea in 2006 in turn, 2010 in vancouver, medaled like crazy. you competed at a high level. you have a lot of athletes dealing with stresses back home and people dealing with a very toxic racial climate in this country. some of those athletes are over there. you reached out to naomi osaka dealing with the pressure on her and racialized pressure on her. covid exacted a real toll mentally and emotionally on everyone but especially on younger people. do you -- what do you make of how these athletes are responding to that? i know the competition makes that even harder. >> there is definitely an added

pressure and layer of context that's never existed but i do think the athletes are trained properly psychologically, they have this opening now to speak out in ways that perhaps weren't really characterized as being acceptable ten years ago, right? the fact to be able to talk about mental health in a way that in the past seemed weak or unacceptable today they're really being embraced with open arms. that's a good thing. we cannot recognize the athlete as being a superhuman figure but also being human at the same time that shares the same type of insecurities and self-doubts and fears and prison in the prison of her own two ears. unprecedented whether you agree with certain mandates or not, it's taken a toll on this country and around the world. the athletes are truly no different. so the one point here that i would make is that we still look to these athletes as incredibly representative of the best versions of ourself. and so that is what i hope to see from these olympic athletes

as they walked, by the way, into an opening ceremony with no fans. there was no families here. this was the first time that happened. we seen some instances in tokyo during the summer games but these are unique times. i can only imagine what that must have felt or not felt for them walking in. their mission to be the best never wavered and they want to go there to represent themselves and team usa to the best capability. wiping away the noise and effect of what is actually happening and it's hard to do, what remains is this deeply unifying opportunity for i think all of us as americans to say, go there, be your best, regardless of outcome, we will be here supporting you in every instance to hold you to stand up as tall as possible. >> apolo antoine, ohno. uplifting measure.

there is great news for the economy today. with a much better than expected jobs report, the economy added 467,000 jobs in january despite the spread of omicron. now, of course, minutes before the report was released, the kids on the comfy couch got themselves all geeked up for shade. >> so peter, how will the white house spin this? if it is true as adp, the paycheck cutter is suggesting it could be a loss of 300,000 jobs, how will the white house put a happy face on that?
