>> that unprecedented moment no doubt changed the course of history. the fbi director james comey threw a gallon of gasoline of hysteria over hillary clinton's emails, reopening an investigation that had already overshadowed the entire 2016 campaign and emboldening the rhetoric that the orange hued menace, donald trump, and the devotes had been spewing for a full year and a half. >> hillary clinton should be in jail for what she did to our national security. >> the email scam -- >> crooked hillary's emails -- >> this was not just extreme carelessness with classified material, which is still totally disqualifying. this is calculated, deliberate, premeditated, misconduct. if that were a republican that did what she did with the emails, they would have been in

admonishments throughout his presidency. it is unclear how many records were lost or destroyed through trump's ripping routine as well as what consequences if any he might face. hundreds of documents, if not more, were likely torn up, those familiar with the practice say. this is by the way, very, very illegal. those documents were not his to destroy. the presidential records act, quote, establishes public ownership of all presidential records which can be disposed of only after approved by an, a i'vist. additionally the post is reporting that the national archives had the records from mar-a-lago. it is not a government property despite trump pretending it was the winter white house. the trump advisers deny any nefarious event and say the papers with kim jong-un which trump once described as love letters, as well as a letter from president barack obama. the trump spokesman declined to

comment to the post on either story and the national archives has confirmed that they retrieved 15 boxes from mar-a-lago in january. this behavior is even more damning as we continue to learn about trump's actions on january 6th. there is new reporting from the a.p. and he was so enharassment urd by the unfolding insurrection that he was confused as to why staffers weren't as excited as he was. joining me now, strategist juanita tolliver, and tim miller, writer at large at the bull warring. and paul, i hate to keep going back over this again bust we keep doing the what if obama had or what if clinton had. it is a law. as of now, not only would i be shocked if trump faced any consequences for literally ripping up publicly owned documents that he wasn't supposed to, and sending the please to the national archives or spiriting them off to his house in florida. here's what james comey a year

life, trump acts like he hates records. probably because they serve as receipts for his bad acts. so in his business life, he insisted on nondisclosure agreements. and the white house, now we know. he illegally destroyed items that don't actually belong to him. they belong, these records belong to the american people. they're property of the government of the united states. and joy, some material has been recovered, but other material may have been placed improperly in burn bags without appropriate review. that stuff is lost forever. could it be evidence in a criminal case? it could be. but we'll never know. i think it is up likely that we're going to see a prosecution for this conduct because the presidential records act has no enforcement mechanism. if you break the law, there is no remedy. >> very quickly, for those who

are not so inclined, not an attorney or former prosecutor, what is a burn bag? >> so a burn bag is where you place confidential sensitive information that you want destroyed. it is the government equivalent of a shredder. there is a process to decide what evidence gets destroyed. it is not the president's decision. the white house records office has an important role which apparently trump just ignored or discounted. >> even nixon didn't have burn bags that we know of. it is so blat am that it is comical. but it is also deadly serious. with the people like the comeys of the world, because he was president, we have to let everything slide. he can rental the local old post office in d.c. from the government and make that a private hotel. basically be bribed by foreign

officials. every time they swipe their card, they're paying him. he can do all that. say he wants to turn mar-a-lago into the new camp david. he can do all these things, break. at a laws, there is nothing he can't do. meanwhile, the actual committee that is trying to look at his criminality is using the tactics that would be used to investigate the mob. the committee is employing tactics used by mobsters and terrorists. they have quietly turned at least six lower level trump staffers into witnesses who provided information about their boss's activities. this is "the new york times" reporting. and i just wonder, juanita, i don't know where. we it doesn't seem like the criminal justice system is capable of dealing with trump. is this committee in your view stacking up to be a tool of actual accountability? >> that's what they're trying to do with intention. i'm honestly all for it.

right? i feel like this is the first bench mark. we know the mandate is to ensure accountability and prevent this from ever happening again. and that could be through legislation or criminal referrals for those responsible. and i'm so for it that what i think they're preparing to do is try to make the case to the doj. as you said, we have seen every signal from the doj that they're not already on it. that should be frightening for a lot of people. the select committee seems to be bracing itself for trying to convince the doj to prosecute trump. when they hire prosecutors, when they collect the evidence, when they're doing the hundreds of interviews, they know this comes down to the strength of their referrals to get him prosecuted. and i want to point out in that "new york times" article, an attorney said what if the gop tries to do the same thing? we just saw the gop under

trump's leadership attempt a coup. and it will be that much worse if there is no accountability. if these tactics aren't leveraged. we know the select xhae has been met with every delay tactic possible, whether it is through courts or trump's direction through his allies. so they're doing what needs to be done. >> we know the answer. they're going to do it. they're going to. newt gingrich already said, oh, wait until we're charge. we're going on investigate mrs. biden, find out what she's doing in school. they've already made it clear they're going to launch witch hunts against democrats. we know that. if they do it on the house side, with the true trump maga people are, here's what the senate will do. here's marco rubio. his picture practically pops up. here he is unable to say the words trump was wrong about the insurrection.

supporters that he's with them. there is something fishy about this election. rubio, you know, rubio was supposed to be one of the ones when he ran for re-election the last time. in 2016. you might remember this. he ran saying that he wants him to put it in there because he'll hold clinton accountable or trump accountable. and he's thrown that to the wayside. and there's no amount of evidence that could come out. donald trump said it himself. we don't need the evidence. he said it himself in a statement just last week. and so you know, these guys are being allowed to get around it by going back to the top of the segment. an imbalance in the treatment of donald trump's actions from the main stream media via what we saw in 2016 with regards to clinton. >> the media compare the

hysteria over hillary clinton's risotto emails over what trump has done collectively. when marco rubio said that, he said that he vowed to be his accountant or give him a nice massage if his shoulders get tired. you have to get the subtlies. he's a sophisticated politician. let's talk about ivanka. we're sneaking closer to the time, the january 6th committee will have to call a trump. they'll have to subpoena a trump. could she be the one? ivanka trump went on to make at least two tenacious attempts to reason with her father, bombarded with allies, begging him to quell the violence. saying they could provide access to what trump was doing during these crucial three hours when he was not stopping the insurrection. is this the window where the january 6th committee finally subpoenas someone with the

surname, trump? >> i think so. especially when we're seeing the hard core aggressive tactics, unlike what it looks like the justice department is doing. so in the real world, prosecutors all in, your family, your mom, your kids. they do that all the time. so i wouldn't be surprised again if this aggressive house committee does that. we don't know that ivanka was down and dirty with trump. so far we haven't heard any evidence of criminal activity on her part, or january 6th. but she was definitely bound with him. she was very, lindsey graham said he called ivanka, pleading that the president had to do something and she indicated that she was on it. so what did the president know? what was he thinking ivanka knows? and she could spill it if the committee subpoenas her and makes her testify.

affecting a broader position within the trump party that whatever is good for putin, is good for america first. joining me now is lieutenant colonel we alexander vindman, and former security counsel -- and senior adviser to -- naveed jamali, thank you both for being here. alexander vindman i want to start with you. love you being fired for having testified and told the truth in front of a committee that was impeaching donald trump. that note for all is today's anniversary for you. and now we face the situation where the thing trump hated the most, will not hated the most, he hated a lot of things. but nato was something that he wasn't in favor of. that idea that nato is irrelevant and not useful has taken hold of the base of the republican party. tucker carlson and josh hawley, in your view what would be the consequence of the u.s. was gonna say nato year on iran.

push further. and we should treat that seriously. these are supposed to be legitimate alliances, they should treat threat seriously. right now, we're probably not quite doing enough. as for the geopolitical situation it would be frightening. there is no such thing as nato in -- the there's a much series of alliances that are coming together and the bar for other adversaries to act is even lower their. so if the u.s. is now willing to its most critical alliances and i think everything else is up for grabs. >> right, and so the thing, i've talked about this before but we've talked about the idea of donald trump having the strongman states. each one is a strongman state in and of itself. whatever they do they do. whether they're aggressive or anti-u.s. it doesn't matter as long as they're strong-ing whether it's north korea, russia. that's what he gravitated. towards i get why trump love putin, but you tweeted a tweet

during this weekend, that asked the question why does his base, who are basically, mainly republicans christian evangelicals who came into the party with reagan by and large part. adversarial towards the soviet union. why do they love russia so much? why do they love the kremlin, and putin so much? talk a little bit about that. >> there is this idea that russian ideology sort of fits up with this republican belief. this rolling back of progressionism. let's start with the russian perspective. look, i spent three very difficult years working against the russian -- military intelligence. from a diplomatic standpoint, i'm not coming from an academic standpoint i. sat across the room from these people. i can tell, you joy, there is one thing it only one thing that drives russian ideology. that is the retraction of the united states as alex was saying from europe, from

central asia. and they don't want us. there they want to return to russian expansionism. that's it. on the other side here in the united states of disbelief because of russia. i'm surmising. here rushes an overwhelming white country, the people look at that and say hey, they must have values that align with. ours but the reality is, russians don't really go to coach in the same numbers that america does. they have a higher rate -- of there's nothing about their society, reagan called russia godless -- there is nothing about russia beyond the fact that it's -- about the russians, joy, are happy to use anyone that will cause chaos in the united states. the reason that this is happening today with russia on the precipice of going into ukraine. in my opinion is very simple. they see a window of opportunity. and that window opportunities in large part because of the chaos that is here and their main adversary, the united

states. that is perhaps the biggest threat the ukraine's instability that exist here in the united states. let me just read from just security, up it's that russia has both turned a blind eye to far-right paramilitary isn't within its own borders and actively cultivated neo-nazism in the. less these decisions align with its broader project of western democracy and influence transcontinental -- despite its relatively weak military economy. this sort of idea among the top our world if we leave russian alone and stop barring, they will be aggressive towards western europe. that they're only willing, they only want ukraine back, they shouldn't let him have it. if the west were to just let them have ukraine. -- it are they not wrong that saying that russia would be satisfied and be a benign power? >> that is a preposterous

notion. tucker carlson should not be taken seriously, he has no clue what's going on. he appears with a dictator on a regular basis. i mean, i'm not just talking about hungarian dictators. but there's something else to be said about a broader class of conservative that thinks that if we just let go on this ukraine and nato situation. that is far from the truth. the fact is, russia has a series of different objectives that need. one of them is ukraine -- another is a fractured europe nato alliance. and it's such a construct that russia could course. could use its power symmetrically and asymmetrically to -- it's not going to be the enemy. this notion of going back and saying it's okay, ukraine will be part of nail well in no way alleviate the situation.

and msnbc pulmonary and banal adjust. now mr. philip, thank you for being here. your organization represents 200,000 public schools in the state of new jersey. this was the statement that came out today. we are cautiously optimistic that the current statewide school mask mandate can be safely relax in the new future, assuming current trends continue. talk to me about the feedback you're getting from educators, and school employees about the relaxing of these mandates? are people scared what's the status? >> well thanks, joy, for having me. there's no one that certainly happy in this pandemic. i think there's absolutely a lot of people that are fearful, rightfully so. we're going into an unprecedented moment with a lot of stress. certainly our colleagues have always said from the start that we need to follow the science

that at times has led to more relaxation of the rules. and there's a nor stringent of the mitigation measures, masks being one of them. we're very fortunate here in new jersey we have a governor that believes the following the science, and following the data. we continue to press that. no one can predict exactly what things look like. we'll see how things are trending. but should anything change and look different at the time, or even in the future it shouldn't be a political decision to take a mask off. and it should be one to put them back. on >> i asked whether or not people are happy about it. there's two different things working you have the fatigue that people are feeling, those are people that are doing the right things there exhausted by. it they're exhausted by having to mask up, they're exhausted by having to do all the things with so many people are doing nothing and not getting vaccinated. at the same time, there still a lot of fear especially among parents. even on our team, that have young kids. so what's the balance there. are these teachers by and large

feeling nervous to be unmask in a room with a bunch of unmask kids? >> i think the answer is simply yes. i think i'm nervous, with two young kids, and those that are eligible for the vaccine are still out there. the answer to that this is what we must need to keep looking at is what does that data tell us, are we seeing anything. because a decision should go through like this in the future where we see a case numbers change, where we see the transmission occurring in schools. we need to adapt that big quickly and follow all the data. a tool that can help us -- all options have to remain on the table. people are afraid, people are scared. and it's unfortunate that -- we will all be making easier decisions but fortunate that's not the case. >> wouldn't that be nice. doctor gupta, it's clear that this sort of smart politics for

governor, in the safe politics is permission. you're vaccinated, take off your mask live your life. that's the political decision that a lot of governors are making and places like florida it's super permissive. the most permissive possible. but at the same time you do have a lot of outbreaks. i know the states that are relaxing these mandates, these are the most vaccinated states in the country. let's put it up. their new jersey has a 73% vaccination. right connecticut is 77%, the u.s. averages is 64%, and delaware is 67%. between states that are highly vaccinated they can move like this to ease mask mandates and the low vaccination states, particularly in the south. >> joy, good evening. it's an interesting question because -- the warmer, drier air spring in summer we're gonna see a reprieve across the country come wintertime 2022, states

with low vaccinations are gonna experience -- over the past two winters. this about is about what's gonna happen in the future versus what's gonna happen in the immediate term. having said that, it's good for all your viewers to listen out there. especially those who haven't gotten their kids vaccinated a. lot of parents haven't got on. that pediatric hospitalizations as of today, in icu, but peachy after hospitalizations are still at 500 hospitalizations a day. that's double, joy, that's doubled in the delta wave. and it's important people to recognize that it's still dangerous out there but i do like what governor murphy did. starting to relax these conditions because if we need to turn them back on come wintertime at least we have that credibility. >> and very quickly, so mark said that connecticut recommend the state and the mask mandate by february 28th. i do want to talk about that
