morning with new details on that hour-long phone call but between president biden, and russian president putin. biden, warning the former kgb operative that invading ukraine would result in quote, swift and severe cost to russia, and cause, quote, widespread human suffering. citing anonymous sources briefed on the matter, the new york times reports that u.s. intel agencies are warning of a new russian plan, another so-called, false flag operation. then to create a false pretext to invade ukraine. the biden administration has spoken about falls operations before, and not provided evidence. but, now more than 30 russian navy ships are in the black sea conducting military exercises, according to the russian defense ministry. and meanwhile, 3000 more american troops are expected to arrive in poland this week. a lot of developments on this. so from, or we turn to msnbc news correspondent josh lederman live at the white house. so josh, what word do we know about this call between biden

and putin, and this reported russian false flag operation? >> well lindsey, it's where these days for the u.s. and russia to agree about anything, and even rare for them to agree about what happens in a call between the u.s. and russian leader. but in fact, after this, just over an hour-long conversation that president biden had with president putin, yesterday. both sides are agreeing that basically, nothing happened. nothing it changed in this phone conversation, that could really move the ball forward, in resolving this conflict. with the u.s. side saying that it was professional and substantive, but that there was no fundamental change to the underlying dynamic, that has been at play here between the u.s. and russia for weeks. and, the russians, for their part said that president putin made very clear to biden that he is still hung up on these same nonstarter demands from the u.s. and nato, such as blocking membership for ukraine in nato, bringing back nato's borders, and troop positioning to the way they were a decades

ago. and so, what we have is very few signs that anything is moving toward de-escalation, as the u.s. has been saying they want to see from russia, to avert the kinds of massive economic sanctions that president biden once again threatened against russia, in that call yesterday. if they go ahead and invade. we heard overnight from secretary of state, blanket, who is traveling overseas, who said, i will read you a little bit of what he said -- he said, no one will be surprised if russia starts a provocation or incident which is then uses to justify military action and planned all along. so, that goes right to the heart of these concerns, that have emerged through various u.s. intelligence assessments in the last couple of weeks, that is made public, asserting that russia could try to plan some sort of false flag attack, basically, make it look like ukrainians have launched some kind of attack against russians or russian interest that could then be used for the russians to justify a massive invasion

in self-defense. now that this call between putin and biden's, over the next round of shuttle diplomacy goes to german chancellor olaf scholz, who is on his way to be on a trip that's going to take him to both ukraine and to moscow. he has been really a big question mark in these discussions in the last few weeks, given his new leadership of germany, and the fact that germany has been more reluctant than a lot of these other nato allies to really specify what they are willing to do to russia, if they do invade. that is going to be very critical because germany has a very close economic relationship with the russians. germany's participation will make the difference, in terms of whether nato and the west are able to impose the kind of cost they've been threatening. lindsey? to impose the k>> we've been wt closely. so matt, how has the evacuation been going so far, of non emergency personnel? what do we know also about these continued russian military exercises? >> yeah, good morning, lindsey.

those evacuations continue. they started over the weekend. we don't know a lot of details, a course. that's part of the whole plan. the embassy isn't really talking about their personnel leaving because they are trying to escape danger. there were some images that we saw from reporters here in the ukrainian capital, diplomats with their luggage leaving. but, they will not be drawn on questions of when and how long they would be out, any details, all of that, of course, is classified. but, it's not just diplomatic personnel here. it's also all americans. that was something that was pretty shocking, today, from the biden administration saying that all americans should be leaving within the next 24 to 48 hours. again, that was also just in the past couple of days. and as for those twin exercises, we are seeing one that's happening. the most imposing, near the border where i am in belarus. that's the largest deployment of russian military troops into belarus since the cold war, 30,000 troops doing huge exercises, along with some pretty macho hardware, like the

russian signature as 400 missile defenses. tim again, that's the reason, some of these exercises, including one that's going on in the black sea, that the ukrainian government has fiercely protested, saying it's tied to a naval blockade of marion pole and odessa. that's one of the reasons why these u.s. personnel and citizens are being told to leave the country. lindsey. >> thank you both for starting us off with the latest developments. and for some more insight and analysis, we are now joined by major general danny picard, coauthor of hunting the caliphate. it's so nice to be able to talk to you. good morning. >> we just heard that a russian invasion would result in quote, severe economic cost, and reputation all damaged caused by taking innocent lives for a bloody war. your opinion. it does a warning like that make a difference to putin or just embolden him? >> unfortunately, i don't think

it really makes a difference. what will make a difference or be the unified actions of nato, and it's clear that germany isn't fully on board, which is one of the most powerful members of nato. but, uniform action, letting president putin know of the economic sanctions -- but, there could be at one point military action. it's time to up the ante, let him know that unilateral aggression is just unacceptable. >> what do you mean by upped the ante? >> you know, the movement of u.s. troops to the eastern portion of nato like romania, poland, the bulk in republics, that's upping the ante. we are doing some of that. but maybe also, not moving out our advisers. we had you know, around 160

u.s. advisers on the ground there. we warned russia that if you invade ukraine in any way, cause, you no harm to u.s. personnel, there will be even greater action. but, we've taken that off the table by removing those advisers. so, i am just a little surprised at that. >> i want to talk to you about this potential second, maybe even a third at this point, russian false flag operation. the intelligence that the u.s. has so far. why would russia go to such elaborate lengths when biden already knows putin's long-standing thoughts in ukraine? >> he needs an excuse to invade ukraine that you know some aspects, some folks in the world would understand. and of course, president putin is surrounded by yes men and women. putin and so, he is not really getting a balance view of, you know, what that potential

issues are with invading ukraine. so, i think it's a terrible idea, but i guess president putin is convinced that he needs something like that as an excuse to invade ukraine. >> in the new york times also sheds light on why the biden administration keeps revealing this intel on putin's next move. and they say quote, the hope here is that disclosing mr. putin's plans will destruct them, perhaps delaying an invasion, buying more time for diplomacy, or even given mr. putin a chance to reconsider the political, economic, and human costs of an invasion. is that a good strategy? i mean, there were kind of two sides here. some thinking there are dangers with revealing too much of what we have, and then other people who are pretty critical that no evidence has been presented. >> actually, i think that is, you know, a good strategy, which is letting not only the world to know, but president putin and russia no. we are watching you.

we are seeing every single move you are making. you are not hiding. and, it's causing some pause with russia. you know, traditionally, we've seen, you know, russia in 2008 with georgia, and 2014 in the invasion of ukraine, and taken crimea. but, they move very quickly. they move very quickly on this one. every step of the way -- especially, the u.s. has been reporting on that. that may be causing some pause. there may be some room for diplomacy. president putin, at this point, needs an off ramp. he needs an off ramp, where he doesn't completely lose face. and, that might be a moratorium on ukraine's membership in nato. >> is that something that the biden administration has already said is completely off the table? >> yes. so, maybe there's some room for compromise. it's not closing the door, but it's putting a moratorium on

a major developments surrounding the january six investigation. one of donald trump's top allies. the new york times is reporting that former trump attorney rudy giuliani is in talks with the committee investigating the insurrection about the possibility of testifying. giuliani helped lead the efforts to overturn the 2020 election results, but according to the times, citing three people familiar with the matter, the extent of his cooperation is still unclear. and bc news has still not confirmed this reporting. our office is on capitol hill with more. what are we learning about this new development? >> lindsey, it is well-known how close rudy giuliani is with the former president as his former lawyer. he helped lead the effort to overturn the 2020 election results. we've seen the committee subpoenaed other members of trump's inner circle, like former aide to steve bannon,

former chief of staff mark meadows, who have refused to testify before the committee. even being willing to face criminal charges for doing so. the times reporting that giuliani is in discussions with the january six committee about answering their questions, but the extent of his cooperation is still unknown. but lindsey, if he does cooperate, this could be the committee's biggest breakthrough yet into the investigation into what trump was doing during the hours at the capitol was under attack. trump now facing another investigation by the house oversight committee into those 15 boxes that were recovered from his mar-a-lago estate and taken to the national archives for preservation. now, house oversight dems are counting are calling out republicans for their silence on their issue. listen to this. >> something has happened to my colleagues, who i know were extremely passionate. to me, at times, overly zealous,

to demonize this person who had not followed protocol to protect the documents that they were interested with. and now, it's radio silence. >> for his part, former president trump responded in a statement to these boxes being recovered from his mar-a-lago home. saying in the statement, that the boxes were covered without conflict. now the committee is asking him to answer a list of questions about their recovery by february 18th, lindsay. >> ali roth mint, thanks so much. let's bring in our panel, legal analyst danny's of all us and political analyst and democratic pollster a molly. good to see both of you. danny i want to start with you, this could mark a major breakthrough for the investigation. if giuliani offers substantive information, which we still don't know yet a field. what sort of insight could he provide? >> in all likelihood, the only

information that anyone is looking for from giuliani's substantive information. so, if he's not interested in providing that the snow is interested in hearing it. the interesting thing here is that giuliani was with trump that day, he actually was involved in the rally and, to the extent that they're going to try to show or establish, whether or not there was some kind of collusion to incite some kind of riot. then, this is the genesis of that theory. especially because, we've heard a lot of snippets of giuliani speech where he said, essentially, something to the effect of trial by combat, something like that. and whether or not that amounts to him inciting a riot. >> sorry, you have a visitor trying to pop up make her tv debut. >> she promised she would be quiet, she broke her promise, and now here she is. >> she is quiet! >> she is quiet, that's true. she's a lawyer already, she got me on a technicality.

>> well she's adding some needed levity to this. danny i want to ask you also, giuliani signal to his lawyer that he, quote, plans to take a less confrontational stance toward the committees requests, rather than fight subpoenas or refused to cooperate altogether. unlike some members of trump's inner circle. so, some motives here. avoiding costly legal fees, maybe avoiding a criminal referral. do you think both of those are at play here? >> absolutely. listen, rudy giuliani only wants to help as much as it benefits him. he has not been treated all that well by the trump team in the last few years. at least, if you believe what's been written about the relationship and books. whether be refusing to pay him. reasonably, giuliani's loyalty only go so far, it has to end at some point. if it means he might get in trouble, then look for him to maybe enter into some kind of deal and save his own skin. after all, rudy giuliani like

everyone else in the world doesn't have limitless money. he's got to either pay lawyers forever or eventually do something to benefit himself. >> fernandez, this could mean a major breach in the relationship with trump. do you agree with it being an attempt to save his own skin? >> no question, i think the committee could anticipate a lot more substantive testimony from danny's beautiful daughter than from rudy giuliani. he's got a tremendous credibility problem, as we've seen. just a half statements, mistrust, outright lies. even when the other defamation suits either middle he's been making up as he goes along. i anticipate that he invokes the fifth amendment and attorney client privilege. there is no question, rudy knows where the bodies are buried. there's a lot of incriminating information, i am certain the former more mayor of new york has. but the idea that that will actually be extracted from him in a way that will put donald trump behind a legal a ball, i doubt that will be the case,

given how we've seen rudy act and given, even though he's been disrespected all the way through, his slavish loyalty to the former president i don't anticipate him breaking it off and being a cooperative witness. >> fernand, does mishandle presidential records from trump, you heard representative there saying her republican colleagues have gone radio silent. what do you make of the hypocrisy, and could it eventually catch up with them? >> well, the hypocrisy is total and utter, that doesn't surprise anyone watching this process. unfortunately, the republican party has been acting in bad faith on this, and a lot of other issues, for the last four years. where i think this is a politically compelling development is that this mishandling of federal records, not only is it a felony, not only is it criminal activity, we've heard words and reports about trump shredding documents, even using burn bags. this actually carries a political weight of possibly disqualifying trump from running for federal office or

any office again, if he is prosecuted on these grounds. i think this is now a question for the justice department. you see clear cut reports of what's are, nothing more than,, criminal activity by the former president. hanging over all of this, you still have robert mueller's testimony where he said that the president could be indicted on counts of obstruction of justice, dating back to the mueller probe. so the question is, will trump ever be held accountable for these crimes committed? or, will he continue to escape with a sense of immunity that will empower his base and potentially depress the democratic base going into this election year. >> no one is safe on your twitter, fernando, including mayor garland there. thank you for your time, danny's apprentice as well. good to see you this morning. canadian truckers, they are still defying a court order and refusing to go home, as the blockade continues for a

other stories around the world we are tracking this morning. kodak black, whose legal name is bill capri is recovering after someone shot him early yesterday morning. outside a restaurant in west hollywood, california. three others were also shot. they are all expected to survive. police say, this happened outside a restaurant after a concert. this was an after party, hosted by justin bieber, which the

rapper was attending. investigators are looking for the suspect who took off from the scene. a southern california multi millionaire will serve a 15 years to life after pleading guilty to killing his wife, before flying to mexico. the case of peter chadwick got global attention. at one point, he was one of the u.s. marshal's 15 most wanted fugitives. newport beach police even launched a podcast dedicated to finding him. chadwick's lawyer hasn't responded to nbc's request for a common rotation. you wouldn't think snow would be a problem at the winter olympics, but at least one event was reportedly delayed, a training sentient even canceled because of it. the new york times reports that winter olympics organizers prefer using machine made snow for events because it's easier to control. conservative politicians have been successfully tapping into the normal culture wars issue that has parents across the issue riled up, education. but, before the issue took over the campaign trail, school board meetings have become ground zero for battles over

school mask mandates, book banning, lesson plans that focus on race, gender, and sexuality. they've devolved into shouting matches, and divided communities. on one side, right wing parents who are highly organized and ready for a fight. on the, other liberal parents who are starting to push back. one group is trying to harness the power of suburban moms to fight against the republican effort to target school curriculums. it's called red wine and blue. and as you can see from their website, you don't have to be politically inclined to get involved. the organizer's head katie, harris spoke to us about the conservative parents at these meetings saying quote, i don't think they represent any kind of majority, but they certainly are part of what i would say is a pretty massive orchestrated effort to undermine public education and teachers in the country, impose a political agenda, and win back suburban voters. katie paris -- katy perry [laughs]

maybe, i've got some performances on my mind. katie paris joins us now. katie, thanks for being with us. i want to talk to hear about what concerns you most about this trend that we are seeing at our nation's schools. >> you know, thank you so much for having me on. it's just, we feel it's time for mainstream mom, mainstream parents in all this to have a voice on behalf of our kids. it is concerning to have these culture war issues come in and divide our communities, take over these school board meetings, and it all has an impact on our kids. ultimately, we are in this to protect our kids education. we don't want to have the history that they are taught to be whitewashed. we want all kids to be welcome at school so they can learn. we want kids to respect each other across their differences. and, when you have these culture wars come in, orchestrated by right wing think tanks out of d.c. and a handful of parents, you know, loudly coming in and taking over the school board meetings, we want to make sure that there is a voice for the rest of us.

>> i, mean you say some of them are coming in, practically reading from a script. so, how do you fight this? you are gathering suburban moms. you are trying to mobilize everybody. where do you do? where do you start? >> well, at red wine and blue, we engage women by helping them organize in their communities. and, we do it in a way that's really engaging and actually. fun a lot of the women who engage with us haven't gotten involved in maybe anything political before. and so, we want to make it really approachable. we want them to feel supported by each other, and create a community. el supportedso, when all of thid happening, i, mean our networks were just lighting up with this. we were hearing, is this going on at your school board meeting? is this going on in your school board meeting? it affects us all across the country. so, we knew something was going on. we knew it was orchestrated. we wanted to find that support. so, every week, we have opportunities for women in our network, and it's growing by the thousands every day now. there's so much frustration, that this is taken over our communities. and, we equip these women to

know what to expect at school board meetings. because, they don't want to go in there, and just yell back. they want -- the pandemic is exhausting enough, like, we don't want to show up at the school board meetings and just be yelling at the other side. but, we do want to make sure that mainstream moms can have a voice, and then we can stand up on behalf of our kids. so, we talk about, how can you show up in a way that you are proud of? what do you need to be prepared for, that you are going to hear at those meetings? and, it makes them feel supported. equipped, they are ready. they come up with creative ideas to maybe grab attention in the community. again, in a way that they can feel proud, of that is interest yelling back. >> you, know in this article, one of your members say, i get frustrated with the democrats lack of movement. and basically, says the republicans, they have a playbook. they have an engine that's always moving. and, the democrats don't. do you agree with that? and, what do you want to see lawmakers do? >> you know, i think that there has been so much focus in d.c.

on what's going on in d.c.. there have been really important legislative battles. i mean, i really want to see voting rights passed. i really want to see things like more support for childcare and paid family leave happen. but, you know, no one is really talking about joe manchin at the bus stop. they are talking about the schools. so, in order to get those things done, that our democracy needs so much, we have to meet women where they are. we have to engage in these conversations, and we have to see that yes, the right-wing has successfully exploited white is a lot of apparent exhaustion in frustration to fear monger over cultural issues, divide and distract us from addressing these really big problems that we need to, and that the pandemic has exposed, with all the disparities in our communities. that, of the pandemic has made worse. but, they don't want paid family leave. they don't want more support for childcare. so, they are dividing us. now, what i want is for politicians in d.c. to see what's going on, to meet us

restrictive voting law is causing. back in september, texas republican governor greg abbott signed into law a bill that bans 24-hour drive-through voting, imposes new hurdles on mail-in ballots and -- a voting rights advocates were given only six months to familiarize themselves with the law, and they say issues are now running rampant. the rejection of mail-in ballot applications, to a temporary male in voter card shortage. on friday a judge in texas blocked the state from enforcing the part law that prevents election officials from encouraging voters to request mail-in ballots. texas is expected to appeal. for more on all of this, we are joined by anthony gutierrez, the executive director of common causes texas. anthony, good morning, thank you for being with us. from your vantage point here, what's problems has this new law caused? and, are you afraid it's making it harder for people to vote? >> yeah, absolutely. in texas, over the past few

years, there have been a bunch of studies talking about how texas is the hardest state to vote in. senate bill one, that the texas republicans passed, unquestionably made it harder to vote. a number of problems we're going to watch out for when early voting starts tomorrow. even before polls open, we're seeing a bunch of problems like you mentioned, vote by mail rejection rate is 34% of the vote by mail applications and ballots are being rejected because of, what is basically, and an even implementation by the secretary of state. there is also this paper shortage that seemed only affect texas numbers, there is a criminal penalty that was a priest in the secretary of state was telling people that they need to have a specific form that only has the new, updated information in fine print. that meant that organizations like the legal -- of voters who registered thousands of people were going to be limited to 50 forms made

available to them. there's a lot, there is a lot to unpack in sb1 as far as texas voting. >> 30 to 40% of mail-in ballots already being rejected. you already have to have some kind of an excuse as to why you need that mail-in ballot, it's not like it's universal. so, the secretary of state has pushed back against all this criticism, saying his office has held seminars to try and help officials navigate the new rules. what is your response to that? >> texas is a massive state, we have 254 counties, 20 media markets. when campaigns come here and they want to be a serious about getting the word out they spent tens of millions of dollars. the secretary of state has been doing a couple of webinars, they posted some stuff on twitter. they are not seriously trying to educate people about these changes to election laws. it falls to groups like ours, and other organizations, to try and educate the public, because

the state is simply not interested in doing it. >> the end of december, the first progress report on the audit of the 2020 presidential election in texas was released. it found no widespread fraud during the 2020 presidential election. so, why do texas still go ahead with overhauling its election laws? >> texas republicans, for decades, dating back to when our current governor was the attorney general in 2006, they work really hard to construct this voter fraud myth. of there being rampant voter fraud in the state. so they couldn't turn around and use it to create legislature that makes it harder for certain people to vote, particularly minorities. at this point, we've gotten to where it's just a self perpetuating thing that they do every election cycle. they look for anything that looks anything like voter fraud, usually it's just people making mistakes in the course of voting under some really confusing laws.

they prosecute those to the fullest, and then turn around those in a legislative session to pass laws like sb1. you are creating legislation and it's fantasyland, and then when it comes time to implement the actual laws you're going to run into problems. because, you're not just legislating all the problems you're legislating this fantasy you created. >> i have 30 seconds left with you. what is your message to texas voters ahead of early voting? >> there is absolutely no obstacle out there that cannot be navigated. we have parties running a hotline, we have voters standing by to answer your questions, or if you need legal help they can help you. we also have volunteers were training to send out to pull sites, they'll be there in black and white t-shirts. look for those guys. >> but not passing out water, or baked goods. right? >> no, not in texas. >> anthony gutierrez, thank you so much for your time. super bowl sunday, it's l.a.
