lost their son that day about this victory. how to keep the momentum going. let's get started. it has been a bad week for anyone with the last name trump. on thursday, a new york judge issued a bombshell ruling in that state's investigation to donald trump's finances. not only must trump now produce a troll of documents that he's been hiding. his children, ivanka and don jr. are being ordered to testify in the case. that ruling, following the messy public breakup between trump and his now former accounting firm, mazars. last week, mazars cut ties with the trump organization after it said nearly a decade's worth of trump counting statement should no longer be relied upon. the trump can't try to claim that this means that there is no need to continue an

investigation into trump organization. manhattan supreme court judge was having none of it. in a scathing ruling he compare trump's argument to lewis carols humpty-dumpty. basically saying that trump uses words to mean whatever he wants them to mean. and other words, he is presenting a case not grounded in reality. in thursday's hearing trump's lawyer said that if he was compelled to testify, he would advise his client to plead the fifth since his testimony could incriminate him in a separate criminal investigation from the manhattan district attorney. let's roll the tape to see what trump had to say about pleading the fifth back in 2016. >> the fifth amendment. fifth amendment. fifth amendment. horrible. horrible. it five people take the fifth amendment, like you see on the mob, right? you see the mob takes the fifth amendment. if you're innocent, why are you taking the fifth amendment? >> now, that is a great

question, mr. trump. you have less than three weeks to answer that for yourself. that is only some of trump's mounting legal problems. this week, a d.c. superior court judge added that the trump organization is back into the ongoing lawsuit about the trump inaugural committee. just yesterday, national archives confirmed it's classified material is found in the boxes at mar-a-lago. that was after president biden ordered the national archives to turn over trump to white house logs to the genesis committee. on top of that, a d.c. judge declined to throat a lawsuit against trump by members of congress over the insurrection. the growing legal pressure seems to be pushing trump up against a wall. can someone remind me what happened to humpty-dumpty when he found himself back on that wall? joining me now is democratic congressman -- he is a member of the judiciary committee and a former manager

for trump's second impeachment. congressman, welcome. it's so great to see you tonight. >> thank you, michael. >> absolutely. let's start with the at national archives. that story is really significant because the agency has acknowledged that its communication with the department adjustment over the box is found in mar-a-lago ... do you think that the department should open up a formal investigation? where do you see that going? >> thank you, michael. for your question. when i started active duty in air force, i had top security clearance. if i ate classified documents, as alleged against donald trump or flush them down the toilet, or if i took classified documents to my home, i would have been court marshaled. donald trump is a former commander in chief. i would hope that the justice department would open an investigation pecans trump remains and is a walking

national security liability. >> i know a little bit about eating that paper thing. we had a little fun with that last week. it really speaks to where trump 's mind is in a lot of this. he is also having to deal with the national archives. look, you have to turn over the white house visitor logs. why is that information so viable in the investigation into the insurrection? >> so, when i was a house impeachment manager, we knew that january six wasn't just a one day thing. it was something that, not only was an attack on the nation's capital, it was planning for the january 6th attack and there were consequences that flowed from. it so, we would like to know who visited donald trump at the white house, who communicated with him, potentially, about january six. and this information will be turned over to investigators. >> after the statement from tribes former accounting form, mazars, your house colleagues

on the oversight committee urged administration and the -- trump hotel leads to terminate his contract before the former president can sell that property. now, if they don't, trump is looking to make over 100 million dollars on that sale. are you satisfied with how the gsa is handling this because, you know, there could be some profit here for trump for probably putting some bad information into the deal. >> so, there's no problem if it is a legitimate transaction transaction. we want to know if it is legitimate if the documents and their finances were wrong. that is what is so specific about the accounting firm, mazars, did. fraud is fraud. it doesn't matter if you are the former president or if you are an ordinary american. if you cajun fraud, i don't see how any future bank or business should be able to trust you. >> so ... just a follow-up on what you mentioned earlier, as a manager of the 2020 while an

impeachment, second impeachment, of donald trump. you were our manager of that, in which he was acquitted. during that proceeding, a year later, what do you think of where donald trump is being held accountable for the actions that he took as president at that time? >> so, i want to know. it was the most bipartisan his -- bipartisan impeachment in the house. in the senate, he actually wasn't acquitted. he wasn't convicted. you need two thirds vote in the constitution to convict him. we had an overwhelming majority, bipartisan, of u.s. senators who did vote for conviction. now, what we are seeing, we are seeing local and federal investigators look at other things that he did, some of which, potentially, could be crimes. we will see but these offices do. we will see where the

investigations lead. >> congressman, i appreciate you taking a moment to stop and start a conversation tonight. thank you so much for joining us. let's continue this conversation with tim o'brien, a senior columnist for bloomberg opinion. barbara mcquade, she is a former u.s. attorney for the eastern district of michigan and an msnbc legal analyst. barbara, let's begin with you. and that ruling from the new york judge, he said letitia james has uncovered, quote, with a copious evidence of possible financial fraud. given that, how solid does a.g. james's case seem to be here? >> michael, the statement is based largely on a filing that her office made in january. she was arguing that it was necessary to obtain these dispositions. she wanted to show her head a little bit and said, look what i found so. far she documented quite a bit of detail the evidence that

she's amassed from documents, also from witnesses within the trump organization and from other business entities. it demonstrates at least seven instances of what appeared to be massive disparities between property valuations. there is an example of one property, evaluated at -- and $400 million the next. we all know that there was the assessment where trump estimated the size of his manhattan apartment and towers as 30,000 square feet, when it is 10,000 square feet. so, on its face, she has demonstrated weight appears to be just rampant fraud. what she says is, she needs to talk to these folks and see if there is an instant innocent explanation for all of this. if she can close that ... if there is an instant innocent explanations, she wants to hear. it based on what we see, just on the right documents, it looks highly suspicious. like a very strong case of fraud. >> to follow up on that, tim, during that hearing, things got a little bit heated. so much so that the judge,

mclaughlin, had to call repeatedly for a timeout. it's a reminiscent of the super bowl last week where, take a moment, take a moment. trump's personal lawyer, papa, try to make the argument that he was being discriminated against because of his political bees. last time i checked, you know, someone can call me out on this. republicans wanted to protect a class under the law. was this really the best offense the trump team could come up with? >> of course it wasn't the best offense. the trump team is not top, white collar, criminal defense attorneys here. how about his background is in real estate law in new jersey. there is a whole separate book to be written about by donald trump chooses the lawyers he does. which ones actually get paid. at the end of the day, you've seen through l these proceedings, these various, hollow attempts to drive

tension away from the fact pattern. i thought it was very useful that the judge, in this case, in the midst of this food fight started by trump's attorneys, around the idea of political bias and racial bias, at one point, so, there is an overwhelming and voluminous stack of facts here. the fact pattern alone should allow this proceeding to go forward. as it should. you know, i say the new york attorney, letitia james has made facts, she wanted to insulate herself in this criticism. be that is it may, she has assembled a very damning portrait of how the trumps do business and how the trump organization operates. this, you know, the pattern and behavior a line in these documents is nothing new. this was the substance of litigation i engaged with trump

when he sued me for a biography. we depose these same accounts in the course of that litigation. the issue at the center of the litigation was whether or not he inflated the value of his assets, which of course, he does. he has done it rapidly. he is going to be 76 and june. he has been doing this for 50 years. finally, law enforcement officials have circled and allison said, well, this is fun and games that donald trump's children have engaged in. not just fun and games. actually fraudulent. are they ripping off bankers and investors who have relied on these documents to make loans or invest money? have they defrauded taxpayers? local governments and federal government by lowballing the value of those assets? for the first time in donald trump's career, these very issues now are in the hands of prosecutors who are well resourced, aggressive, not going to let him go. >> so, barbara, is that pattern of behavior that tim refers to,

that is the subject of two mastications going on in new york, one criminal and one civil. trump pleads the fifth and then a civil investigation, how could that impact the criminal case against him? >> yeah. it is a really interesting dynamic, michael. as you pointed out. donald trump has famously criticize people for invoking the fifth amendment privilege against self incrimination. of course, it is a legitimate privilege. all of us have the ability to do it. if you invoke it and say a deposition, it means that the fact that you invoked it can't even be used against you and any subsequent criminal case because you have a presumption of innocence. no duty to testify. a jury can't know that you have the ability. if there should be civil trial and the question came up about what trump's answer was during his deposition, the jury would be permitted to know that he had invoked his fifth amendment right against self incrimination. they can draw an adverse

[end of translation] >> russia, for its part, is still spreading the lie that they're open for democracy, to diplomacy. but the numbers speak for themselves. they've amassed over 200,000 troops at the border, as many as 50% of those troops are now in an attack position. this is a story that's evolving by the moment, and who better to discuss this with that former u.s. ambassador to russia, and msnbc international affairs analyst, michael mcfaul. ambassador mcfaul, thank you so much for joining us. don't start just right out of the gate, getting your assessment of where we are right now at this hour. you can almost feel the tension, sort of, building up a bong american diplomats and spokesman about where this thing is. how do you see it? >> well, i think yesterday's speech by president biden was a major escalation, and a major

moment of war. talking about war, i mean. which is to say, you don't have the president of the united states give an address for the american people to the world, where he says, you're showing him right there, we believe, we assess that putin has already made the decision to invade ukraine. and when asked to confirm that, the president confirmed it. and one more very important thing he said yesterday, he said that he believes kyiv, the capital of ukraine, 2.8 million people, will also be attacked. he did say that by ground forces or air forces, but that's just a-limited war in eastern ukraine from what our intelligence sources are telling the president. but something much larger. so i think you're right. everybody's embrace for war. >> so just a brush up against that point a little bit more, because is it really -- one of these things that putin finds himself, either back to a corner where he has to do something, or where do you see

that playing in his thinking of looking at the situation, because they're a lot of folks who believed early on, and i still believe this is one good point pushed by president biden. to push putin into that corner, the sort of box him in a little bit, but having been boxed in that corner, do you think putin now is gonna show face and actually do something? or is this u.s. strategy, when we put out a lot of information intelligence on this that tells us exactly where putin is and when he's doing. does that make a difference in putin's thinking? >> well, it's hard to know. it's hard to know what putin thinks. we don't have a lot of information about him. we don't have a lot of people that interact with him. but i say a couple of things. first of all, putin doesn't have to say face in front of anyone. remember, it's a dictatorship in russia. he's not facing some opposition party in the parliament, or some all of sharks, where some general are gonna say, why did you back down, mister president?

he doesn't face that. i think that's a very important thing to understand. number two, the biden administration has been extremely aggressive in the information. i would five years in the obama administration. we never did anything like this at the speed that they do. and i think in a perverse way, it gets putin a safe haven way out. think about, it biden said yesterday, putin is invading. what if he doesn't invade? he can then say, oh, biden has been meeting the drums of war. i've never intended to invade. this is all just a bunch of military exercises, and by the way, there are some critics of president biden including here in the united states, will say, see, we told you so. putin was right, biden was wrong. i think that's a small price to pay for avoiding war, but that would be a scenario under which putin could back down, and say this is all about nothing. >> ambassador, that's exactly the point i was getting to and the question, and you went right there.

because while that biden approach may have received some criticism, it may receive some criticism in the future to, but i try to get people to understand and consider just how much different and quite honestly, worst off we'd be in right now, if president trump was still in office, and handling the situation. how do you see that possibility, that reality, if you will, of how we are now, versus where we could have been? >> well, that's an interesting counter fact. i'm gonna say a couple of things. if president trump was reelected, he would be super confident in his foreign policy skills, right? he would have a mandate from the american people to say, we liked what you are doing before, do it again. you would've been relying on those generals, right? remember general mattis, general mcmaster, even secretary pompeo, you wouldn't have that team in place. you have a very different team in place that we just listen to

found a brilliant way around that. they argue that remington's marketing of the weapon violated connecticut consumer law. so, could this approach be a blueprint for future legal action? for that, i'm joined by nicole hawk lee whose son dylan was killed at sandy hook elementary. she's the cofounder and ceo of the sandy hook promise foundation. welcome, nikole. before we get to the significance of the settlement, it has been nearly ten years since you lost your son, dylan. how are you and your family doing, holding up, given where we are in this ongoing battle over guns in this country? >> well, we still grieve for and miss and loved dylan every single day. we are working as hard as we can to ensure that his legacy, part of his legacy, is to prevent violence for others at to prevent these kind of shootings, and to protect kids. that is all that we are about. just trying to make a positive change for our country. >> so, this case was very

unusual in the way that it got around the federal sealed law. by using connecticut consumer law which allows -- it irresponsible marketing, you argued that remington used a militarist campaign to market the weapon used at sandy hook, which you believe has special appeal to troubled young man like the sandy hook shooter. the remington add read, quote, consider your man card reissued. how do you believe that marketing campaign affected the tragedy? how did you decide to focus on that marketing strategy in your suit? >> well, what we saw when we were covering the documents from discovery was the story of the gun manufacturer that lost its way went side to put profits and a billion dollar industry target above safety. that is when the targeted market really started. that was not targeting purchasers, that was the targeting and user. the messaging that they were

using about, you know, you are not a man unless you have an ar-15. you have a campaign called jeffries a crier, send in one of your friends if they are not masculine enough. so that we can market at ar-15 to them. this is praying on peoples insecurities and praying on their fears that they are not man enough, or not powerful enough about having an ar-15, they can be. it was very targeted marketing. very irresponsible marketing. that is what needs to change. >> so, nicole, in the 80 immediate aftermath of the sandy hook tragedy ... it seemed like the country was, you know, ready to turn the corner in this big debate around guns. we finally would come together to do something about guns. i remember polling showing 90% of americans wanted something done. yet, nothing, if very little, has changed. as a parent, who lost a child, how do you deal with that in action?

how is it has that energize you to do the work in this space? bringing other families around making a change relative to guns? >> well, you know, every defeat energizes before the wind. just staying positive about how we can make change ... it is going to be a long haul. the change really, where we're struggling is at the federal and in some state levels. there has been a lot of change in communities. there's been a lot of kick change in terms of education and programs. that is significant in itself. we are still having a blockade in d.c., which is president causing a problem. you mentioned the percentage of people who do want gun safety measures, even things like background checks or protection orders. they are blocked in congress because of politicians that aren't quite ready to be on the right side of history. we will get there. this kind of lawsuit, this changes the game, yet again, because it is looking at the insurance industry. it is looking at marketing

practices. this isn't about stopping gun manufacturers. it is about creating safer business practices and safer and more responsible gun use. >> to your point, nicole, a lot of analysts are looking at this and saying, this is a watershed moment that is reverberating and the headquarters of every kind manufacture in the country. how significant do you believe it will be in the gun debate? it does this, and some way, get people to approach the gun debate differently? >> i think this gives us a lot of opportunity to educate people about marketing. not everyone is familiar with the way the gun industry markets its products because they think that they are immune. they think they are completely untouchable, therefore, they are above any moral ethics when it comes to their marketing campaigns. so, there is a big education campaign to do there. i don't think, i don't want to debate about guns. i want to argue for and be a discussion on gun safety. i think better marketing

running for state offices, not just arizona but around the country? how do you see that narrative taking hold? >> yeah. you are referring to mark finchem, who is a insurrectionist. he is running to replace me as secretary of state. but his narrative is indicative of what republicans across the state in big primaries are talking to their base about. so, folks in primary for government and primary for u.s. senate have all echoed this kind of rhetoric. it is pretty alarming. and shows you how continues our democracy still is. we held on in 2020 because people of both parties did their jobs. the public will of the voters. they were trying to put their thumb on the scale because they did not like the outcome of the election. depending on elections in 2022, that can determine the future for free and fair elections in

our country. >> speaking about the thumb on the scale, i want to take you back to the 2018 georgia governor's race where brian kemp was running against stacey abrams. serving at the same time as secretary of state ... was actively overseeing the race that he was in. he use that position to, you know, close some 200 polling places, block thousands of voters, voter registrations, clearly, these types of state offices are incredibly important. scores of them are about to be won by, you know, outright conspiracy theorists. how do you assess what's this country's electoral process looks like if they are successful in putting their thumb on the scale the way they claim they want to? >> well, i certainly think that folks might make the same claims about arizona. what i remind people constantly

is that i took an oath to uphold the constitution and laws in the state of arizona, and that is what we did in 2020. that is what we will do in 2022. regardless of my position on the ballot and the office i'm running for and the office i hold now. i conducting myself in a non partisan an impartial manner. working to ensure that every single eligible air arizonian has access to the ballot, as election officials across the country should be doing. we are in peril if we have people in these offices who aren't focused on the process, but rather the outcome. we have to make sure that we are doing everything to continue to ensure access to the ballots. in every way possible. >> so, as you get ready for the fall campaign, which you are on the ballot, but also serving an important role in the state, what is your greatest concern as the 2022 midterms come upon us? >> well, the misinformation, the misinformation we talked about, is certainly a grave

concern. and, you know, in arizona, we were successful in ensuring that voters had accurate information, that legislature could continue to tie my office's hands and continue to provide that accurate information is that people can participate in the process. we are going to continue to keep doing what we need to do to counter that. but this man misinformation continues to be a really big concern. >> a little bit earlier i mentioned a new polling that shows how the american people are feeling about the health of the country. 60% of democrats expressed concern. even more interesting, a greater number of republicans, 79%, have stated that the american democracy is at risk of failing. what do you make of that? is there a window of opportunity? >> well, you know, unfortunately, a lot of these people are being misled by elected and formally elected leaders who are upset about the
