control what you see and hear and the news. case in point, the right-wing firestorm surrounding special counsel john durham's latest court filing. now, durham is supposed to be looking into the handling of the russia investigation. and if you haven't heard much about durham's filing for credible new sources, well, there is a reason for that. there is nothing there. but that didn't stop republicans in their right-wing media from running wild with this story. >> if there was ever any doubt that clinton was behind the russia hoax, that is officially gone. germs documents show that hillary clinton hired people who hacked into trump's home and office computers. before and during his presidency. >> in other words, trump was right. this isn't a conspiracy theory. his claims were true. he >> was way this is even worse than watergate. not only did they hack into the

posing campaign, and steal material, like in the case of watergate. but then they hacked into the office of the president of this great country. >> because people need to be held accountable. they need to be held accountable, the primary coast conspirators, the mainstream media. i don't believe they were just simply duped, i think they are complicit in this. >> okay, so to be clear, those were all lies. and the line got so bad this week that durham himself distanced himself from the right by, you know, how they were portraying his legal filings. on thursday, he said he couldn't help, but, you know, if third parties or members of the media have overstated, understated, or otherwise, misinterpreted facts. of course, the right doesn't care if they are misinterpreting facts. that's not the point. their goal, headlined clinton

spies on trump's out there, and it's almost impossible to put the genie back in the bottle. the goal isn't to tell the truth or report the facts, but it is to get horrendous lies out there that tank future elections. and let's not let durham off the hook either. he knew his court filing would open the door for trump and his allies to make wild and unfounded accusations. he also, he's also undermining what little legitimacy his investigation has left, but that's what happens with the current gop. it's all they have. the republican party, my party, doesn't have a platform anymore, doesn't have ideas to talk to the public about. what it has is misinformation. and trump and the party, that's about all they got. the sad part is, it might just be enough for them to take back congress in the midterms.

i've got a fantastic saturday night panel to discuss it all. joining me now, jennifer reuben, she's an msnbc political analyst and a writer for the washington post. haynes brown's haynes brown, a columnist and editor for msnbc daily. and lori killed martin, she's a comedian and a former writer for coleman o'brien. this is going to be fun. welcome all. so jennifer, let's start with you. let's talk a little bit more about durham and the point that i made a moment ago, that this is exactly what trump wanted, when durham was appointed in the first instance. do you think the goal that this filing, you know, the goal of this filing was to fire up the fox base, and to get the narrative jammed up in a different direction? >> first of all, i'm glad we have comedy writer on board in this panel -- >> that's what i'm saying,

right? >> -- several things. first of all, i continue to be amazed how often they go back to the well of hillary clinton. they still have not gotten over this woman. they cannot get past her. she lost two elections ago, and they are still hung up on her. they apparently have nothing else that james up their base as much as hillary clinton. second of all, i think what we saw this week is a little bit of even overreach by fox and the rest of them. they spun themselves so badly, that they essentially embarrassed john durham, who is trying to conduct this really kind of which hike into looking for problems with the russia investigation. talk about going back in time. so i think what happens is this goes out there, they make hillary clinton, once again, that she devil. and then again, they zoom up to

her as she is giving a speech before the new york democrats, thinking that she is going to somehow confess or either take the cat out of the bag, and instead, turns into elector on actual malice, which is the standard for defamation, pointing her finger at the right-wing media. they quickly heard away from that scene. but to give you a terrific, really, rant against them. and the fact that they are not in the news business, they are in the line business, they are in the smear business. and apparently, their own voters are too lazy to tell the difference. >> you're right about that. and so, this kinds of reminds me, this filing by durham reminds me a lot of the guy who appointed them, bill barr, attorney general bill barr, and how he handled the release of the mueller report. you all remember that, right? barr got out in front of it, and was able to set the narrative before, the actual

document hit, and we could get a chance to read it and understand it. and really see the truth of what was there. fox went so far, pushing the false narrative that clinton hacked trump. that by the time the fact checkers got out there on this story, it was a little bit too late. was the narrative already set in your view? >> yeah, because durham said this on a friday, which was kind of genius, because it kind of gave the people who knew it was coming, and he did know it was coming. one of the main sources for this story that was being told in this filing, which by the way, it was a sad way in this filing about chase and saying that the law from that represents the person who was charged, whatever conflict of interest or so, so in the segway of the story, it was given to durham by kash patel, who's a former trump appointee. kash patel was able to be coming basically, and set the stage. so by the time hours got to it

on monday, this story was already out there, and fox news was ranting about it, why is the mainstream not covering this story? so it really was an amazing bit of timing on their part. and it allowed these hosts on fox news and other conservative media to basically fill in the blanks. they went from, oh, so, a lawyer who was being paid by clinton, but wasn't really cleared by clinton, met with someone who gave them third-party data about what, you know, websites were being looked up near trump tower and the white house. between times, where obama wasn't office, and that somehow, that fill in the blanks to hillary spied on trump and stole documents, which none of that happened. that is not what occurred here. no one stole anything. >> you laid that out so well. you really did. laura, lorry, lori, lori.

you know, you gotta have fun with this, right? it's not a coincidence that the trump team and fox and all of those folks sort of seized on this bs dorm narrative, given that trump's only issues defeated up this week. and it's something secretary clinton noticed the other day. take a listen and watch this. >> it's funny, the more trouble trump gets into, the wild or the charges and conspiracy theories about me seem to get. so now, his accountants have fired him, and investigations draw closer to him. and right on cue, the noise machine gets turned up, doesn't it? >> it's a classic deflection, right? >> yes, and it also seems like, you know, before it used to be where someone would tell a lie, and they would get caught, and you would stop believing them. but now, if someone tells a lie

and they get caught, and people like the lie, no one will believe it anyway. you know? that's hillary -- hillary did that -- i understand it because qanon you know tells us people that john kennedy junior's gonna come back, you know? that's a lie. that guy was hot, and i want him to come back. that is a lie i would like to believe, so i understand how these people could be caught up in these hillary lies. >> [laughs] yeah, that will work. jennifer, there is this aspect of this though, it's pretty sad when you start to think about it, because the investigation isn't the only area where republicans have tried to use a false narrative for political advantage. one of the worst examples was that biden crack by story. you see the story this week as amazing. and now, according to this theory, the biden administration was supposedly

using tax dollars to distribute free cracked vice bites, and here is how they try to spin it on fox. >> joe biden's tax dollars are going to distribute crack pipes for free to adults across the country. >> this latest idea is to pay black people to smoke more crack. >> his plan is to crack pipes to drug addicts, why? for racial equity. we're not sure if this was his idea or his way of getting his cartel partners to trust him. >> it sounds to me like they did not need a pipe over there at fox. jennifer, what's going on here? >> well, once again, they took a complete fabrication, and they kind of ran with it. and you know, all of these narratives had a definite tinge. they are either aimed at saying, well, the democrats are really the enemies of black people.

or they are aimed at painting women as the evil doers out there. and it all comes as hillary said, during this week, in which his accountants fired him. he's gonna be called for a deposition. his financial situation is now completely shattered because the accountancy statements that he relied upon, in which he got back loans, in which he got the least for the old post office has now gone up in smoke. so, what do these people do? they talk about this ludicrous story. and just think about how stupid this sounds? i mean, doesn't the audience say, this doesn't sound right. why would someone do that? no, they simply believe it, because they've been accustomed to lies. the lie of the election, but i have the crack by, it's the lie about hillary stealing, the lie about biden. and it just becomes a nonstop line machine. and unfortunately, these people who watch it day after day,

hour after hour, do not pick up and newspaper, do not flip the channel and see what's actually going off in the world. we live in this make believe world of made-up controversies and great scandals that actually haven't occurred. >> so, there is a serious aspect to this, because the white house and the associates department have both been forced to respond. they've clarified that there will be no pipes in the safe smoking kits that they are working on. but what does it say, however, about where we are that my party, and in so many elements of it, are so dead set against, you know, harming things, that have proven to save lives in the past? >> on the one, hand you are republican screening that biden does not been doing enough to fight drugs, to fight opioid addiction, to fight deaths in america, considering how it becomes the contributor cause of death among younger people in the united states. so these kids, $30 million that

oversight committee urged the u.s. government to cancel donald trump's release of the historic washington building he turned into trump international hotel. their quest comes after trump's accounting firm disavowed a decades worth of trump's organization financial statements. last year, trump made a deal to sell the money losing property for nearly $400 million, which would net him at 100 million dollar profit. as house democrats said this week, no one should be rewarded for providing false or misleading information to the federal government or for seeking to profit off the presidency. for more on all of this, our saturday at panel is back in the house with us. so, jennifer, the house oversight committee is concerned that trump organization filed an accurate financial statements to get the lease on the d.c. hotel. that stems in part from news that the accounting firm used

by the trump organization cut ties with the companies, and said it could no longer voucher ten years worth of the company 's financial statements. this was in a letter made public by new york attorney general, letitia james, as part of her civil probe on, you know, which is doing up in your. so big of a deal do you think all of this is right now? >> well, i think the latter is a big deal, because you never want your accountants to not only fire you, but say the last ten years of what we put out is probably fraudulent. there are obviously now about their own liability, concerned about not having their own reputations ruined. but, the trump hotel was a farce from the get-go. even under the terms of the lease, he was in violation. there is a clause in there that says no one who works for the federal government should be profiting from this. he was working for the federal government. so we never should've been awarded the least in the first

place. he then used, apparently, fraudulent documents to get in there. but one of the other things he use these accounting documents for, whether it was bank loans, whether it was insurance, so he has been carving trouble, and the fact that is accountants no longer want to stand aside, and they looked at what the state attorney general had done and they said, oops, signatures got quite a lot of information apparent to her, and pretty soon, i think are gonna see some other people come out of the park as well. >> i think it's an interesting point. i think that's an interesting point, hayes, jennifer is making. because nbc news think piece, michael conway, a former council with the house judiciary committee argues that mazars this about of trump's binational statements is a turning point in this new york attorney general's investigation into whether trump's company, trump in this company engaged in fraud. do you think this is a significant step in this

direction for both probes actually, the state and the federal probes? >> yeah, i think so. because i mean, do we have a situation where you really just don't want your accounting firm to say, well, we didn't find any problem. we can't say for sure that these were all legit, like all of our numbers where as they should be. like i feel really, i'm interested to see who the heck is going to be trump, trump organization's taxes, these upcoming tax season. who is going to actually be filing that and the next couple of months when those taxes are a do, and how closely is this going to be looking? maybe they're gonna be running that audit the trump spent four years saying what's happening, and then you look into the documents that are given. i think that the fact that we have all this happening at a time when letitia james, when trump and his children are now being compelled to actually

give testimony in letitia james's civil suit. i believe it's like ten days that the federal judge gave trump to actually sit down, i mean, the judge gave trump and his children to actually sit down for these depositions under oath. so it's gonna be a really interesting couple of weeks to see like how this trump organization tried to dig itself out of this mess. >> a lot of digging going on, lori. because last fall, the same accounting firm reported that from 2016 to 2020, trump's d.c. hotel lost nearly $75 million. that wouldn't be surprising, given his history of bankrupt and casinos and the like. but this is when trump was straddling the campaign, in this time in the white house, which quite literally, is down the street from his hotel. i know i know for a fact, it was the hot spot, supposedly, to go to. yet, he still couldn't make it work. where does that say about trump's business sacrament?

taking the presidency aside, just running this thing that he still loses $75 million on the property that everyone supposedly was hanging out at. >> well, i read that article three times, and i just left a feeling that everyone in the hotel should be arrested. nothing feels illegal in that industry. but also, i am so used to trump getting away with everything, that i lost hope. and, you know, he has never been any consequences, and when he survived covid, unlike, he's gonna get away with everything. but when they decide james stopped running for governor, so she could still be attorney general, as, like oh, she's had something. so very excited to see how this plays out. >> so to that point, jennifer, you look at where trump is right now, the kind of week he has had. certainly, his legal team has been a little busy. take a pick. you know, we learned trump, two of his children's, ivanka, have

to answer questions under oath as part of the new york investigation. president biden told the national archives to turn over the trump white house visitor logs. a judge added, trump organization back to that trump inaugural committee lawsuit. and the national archives found classified material in the items trump took to mar-a-lago. so what's that out to you most of all these little legal machinations for trump? >> i think it's the mazars issue. because that has sealed across all of these issues, and has silenced loans that he presented loan applications he presented to banks, and all sorts of ways. so i think if you're really going to go to the heart of the trump stamp machine, that's really the way to do it. but i will say, one thing about all this is fascinating. and that is, it took a new administration for all of this

to come out. all of this was available last year, a year before. but suddenly, oh, lo and behold, now that you have people who are not corrupt, who are not serving the president of the united states as the personal accountants, and as their personal defense lawyers. suddenly, we have a whole bunch of new stuff coming out. so who knows what's more we're gonna learn? now that we have adults and their, and now that we have some of these basic arguments that he made about absolute immunity crumbling. i could see him starting to pay that, but as part of the deposition is concerned, i'm convinced he's gonna take the fifth amendment, which trump set himself as would guilty people really do. >> right. that, he did. lori, in the past life, you know, i'm gonna confess. i had been to donald trump tower. and i can confirm that nothing happens without his knowledge. he has his finger in the pulse of everything that comes into his orbit. so, you know, even down to

if you're starting to see a pattern, there is a growing anticipation for the upcoming premier of the dropout, about a third dose founder and business scammer, elizabeth holmes, which analysts believe will be one of the most watched series of the year. so, what is going on here? why are so many of us fascinated by the sensationalized stories of white collar criminals? are we, as consumers, helping to incentivize this kind of behavior? my panel is back to discuss it with me. so, jennifer. let me begin with this part of the conversation with you. what is it about this moment that we are in right now where we are seeing people turning to people like an adele the and, you know, turning them into influential celebrities? >> i think a couple of things are going on. first of all, this was scant by donald trump. 74 million people voted for him

the second time, after knowing who he was. there is a sense of people what, sort of, not be duped. not be seen as duke's. they're going to watch the shows. they're going to get some vicarious thrill of watching other people get scammed and telling themselves, oh, we would've been smarter. we wouldn't to fall into this. where they have been scammed at the worst place, at the ballot box. i think that is what's going on. i think the other thing that is going on is that america has always had this love hate relationship with criminals, whether was with dillinger, whether it was the prohibition era criminals, whether it was the sorts of people. this is just something that isn't the american psyche. this is totally the self made person. the self made man and woman. i think these two thanks fusing, coming together, can't give people this vicarious thrill. frankly, when people are locked in their homes and can't get

out, felt like they [inaudible] want to get out. i think they are few happens way up. less screen time, people. get out. get some exercise. >> right. right. lori, is that what we're seeing with the swindler where it is being reported that that the alleged attend durr swidler will be on a dating show, on reality tv show, that is currently in the work that would follow del me after being released from prison? these are two people who have severely damaged other peoples lives. how do you feel, how would you feel, i guess, if some people had taken advantage of you and gained fame and money afterwards. that is the space we are talking about. >> i would be outraged. i would love it if the tender swindler people would made it on a woman who was a swindler

calling a match snatch. that is something i would watch. i would appreciate that criminals are getting march active. i think that they see what works. they are starting to go to the grand jim, use botox, filters. we love to watch attractive people and pain. i think that is a universal thing. no one likes attractive people. we like to watch them suffer. i think it is an incredible combination of good-looking people doing bad things and going to jail for it. just to call it back to previous thing, i'm really excited for ivanka to go to prison, as well. let's do that series, as well. >> just to put a period on that. here's another question of character that you have, sort of, opined on. that is kanye west. you wrote a piece about kanye where you say, quote, his fame

and wealth have allowed him to put his unhappiness directly into americas pop culture consciousness. we've got an unnerving view of west in our life that makes even season celebrity foyers uncomfortable. how much is he reaping the rewards of bad behavior, at this point? >> i mean, if there is one thing i feel like this last week has hammered home is that there no such thing cancel culture. i feel that people can be ... we could try and shame people in public. we can try and shame them through public action. they don't want to change, that is not happening. a lot of times, they are rewarded for it. and the case of kanye ... the way that he has gone about thanks since his divorce from kim kardashian has been atrocious, especially since last weekend when he posted many, many instagram posts that have now been deleted where he, you know, called kim his wife still. he threatened the man kim had

been dating. just acting in a way that too many women are familiar with. once they've left their partner, their partner will not leave them alone. they will not accept their agency, will not let them move forward with their lives. so, while, you know, people can say things like, that is just kanye. blame it on his mental health issues. saying he's just trying keeps family together ... the fact that he is taking the steps, doing it in such a public and threatening way, against kim's wishes, is what is really troubling to be. i really think that we need to see him as an example of how important it is that we talk to men, especially, about what not to do once, you know, you have left a relationship. this is not a rob come. like kanye seems to think it is. no to persistence is going to make him change your mind to say, oh, i was wrong. silly. me especially now with this sort of behavior that is so disturbing, at times. >> jennifer, there is a flipside to all of this. a good example of that flipside, of course, is the story of

amanda knox, who has fought very hard to reclaim her image. is that a case of tough luck when you are a public figure? you know, whether the results or pop positive or negative. how do you see people try and rehabilitate after it go sideways? >> well, this is the all-purpose, kind of, spring, the sidelines that you get from popular media and from a tabloid culture. it takes in the guilty and the innocent. but she was acquitted. she is still referred to and still in the public mind to be a murder, which she is not. of course, her life has been turned upside down. of course, it has been ruined. and this is the, kind, of popular culture that we have all come to live by and ... it's gotten worse with social media because everyone reacts to everything instantaneously.

so, you know, she didn't start off being a public figure. she was not kanye west who wanted to be a popular movie star or a music star. this was a young lady who was accused of murder. i think, you know, it behooves us a little bit to, you know, kind of get some facts before everyone jumped off the bandwagon. look and see how these things turn out. don't consider the headline. even if it is a year later, two years later, three years later, but the result was. so, i think people in the media can be unforgiving of people who, ultimately, are found to be innocent. >> so, before we get out of here tonight. hayes, i want to go with you on o'brien flores that was hired as the pittsburgh steelers -- were your thoughts about that and his lawsuit against the nfl at the moment? >> i mean ... i'm glad he got the job. i'm gonna put that out there

first. even though it is not a head coaching job. i'm glad that he is back unemployment in the sport that he clearly loves. will it make the lawsuit go away? absolutely not. nor should. it i think it is fascinating that nfl has really tried to make this go away. we're trying to downplay the effects of race on the lead. especially when you note that a former attorney general, loretta lynch, the first black woman to be attorney general, her firm has been hired by the nfl to fight back against flores's suit. so, i'm happy black history month to all of us. i'm glad that the culture has come so far that the first female, black female attorney general, can take a lot of money to push back on the idea that there is racism in football hiring practice. we really have just come a tremendous amount of space over the last few decades. i'm really proud.
