getting our early morning justice on. very excited. this is beyond a head-scratcher. when i read some of the reporting on it, it just kind of knock the constitutional wind out of me. because, as you've set up, sb8, that horrific law in texas which private ties is citizens who can go out marauding the texas countryside trying to deprive women of their constitutionally protected privacy interests. to make decisions about their own pregnancy. that is a civil law, it's not a criminal law. here's what i think we need to know. let's do a quick schoolhouse rock separation of powers discussion. there are nine, states i believe, that still have laws on the books criminalizing abortion. but katy, those lives pre day roe v. wade. they were put on the books before 1973, when you could
4:42 am
still criminalize abortion. i was a prosecutor, so that made me a member of the executive branch. when i was deciding what criminal charges i could or could not bring, i had to take into account with the supreme court had said about what is constitutional and what is not. if there is a law on the books that had, basically, been ruled unconstitutional by the supreme court, the legislature might not have repeal that law, it might still be on the books. but i had an absolute obligation as a prosecutor not to bring what was an unconstitutional charge. so, this is a real curiosity. because this doesn't seem to be directly a product of hp eight but maybe miss herrera was trying to avoid having one of these privatized marauders do something to her, because she wanted to engage in constitutionally protected activity but she decided to
4:43 am
stay home, self induce and, as a result, she caught a criminal charge in texas. now, here is the other complicating factor katie. the texas law of homicide actually has a specific exception saying that, if the homicide of the on board child is a product of an abortion or of the mother doing something, it is also not criminal. so, i don't think anybody can yet unravel how in the world texas data 30's have a lawful right, an ethical right, to bring a homicide charge against miss herrera for engaging in itself abortion. >> yeah, glenn, really quickly, i have a little bit under a minute left with you. but i really want to talk to you about ginni thomas and justice clarence thomas. his farm, liberty consulting, it takes up work from right wing anti abortion groups. it's an unavoidable reality, she is married to the supreme court justice clarence thomas. when scotus make this decision in june on the dobbs case,
4:44 am
should justice thomas actually recuse himself from that decision? >> yeah, we need to look long and hard about the law of conflict and recusal. because what the supreme court has proven, katie, is that it cannot be trusted to police itself. we have a real crisis of legitimacy in the supreme court. justice thomas decided it was okay to preside over a case that, directly, involved his wife potentially incriminating, and certainly inappropriate, texts. if supreme court justices cannot be trusted to remove themselves from cases in which they have an interest, whether on the chase x front, the interaction front or the abortion front, then the legitimacy of the supreme court is basically all but gone. >> glenn kirschner, fellow justice warrior, thank you so much for being here this morning. coming up, florida's becoming the epicenter for the nations culture wars. as ron desantis pushes a
