vote on turning this into federal law. but it is not going to pass, so it is the real plan to fight back? from canceling disney to abortion bans, the extremism of the gop, is it inadvertently alienating a key block of their own voters? that and much more is coming up. and a good sunday morning to you. happy mother's day to those who are celebrating. i am katie feng, we begin today's show with a victory day in russia. established to commemorate the defeat of nazi germany. on the eve of this annual celebration, prudent is far from victory in his own war with ukraine. in his own words he thought this would be a quick takeover, but is coming face to face with stiff ukrainian resistance, and ironclad support from western allies. now 72 days into the war he began, putin does not have much,

if anything, to show fort. but the one thing he does have is a long list of incredible losses. in the first six weeks of fighting, the kremlin failed to counter ukraine's capital, kyiv, positioning forces to focus on the eastern southern part of the region where the valley ranges on. so far, the only major city to fall to the russians is kherson but will that make up for the more than 10,000 russian soldiers that had been killed since the war started? of the estimated 12 russian generals that ukrainian officials have said have died in combat. for this historic loss of the russian flagship, mocks for. i don't care about patriotic a russian you may be, this does not paint the most victorious picture. let alone on one of russia's own biggest holidays it is supposed to be about a victory. what is there to do at this stage of the war for putin? there is much speculation about his next move. i will get into that ahead,

when talking to the former ambassador to ukraine. but first some video coming in. joe biden the sylvan ukrainian border. she's been meeting with -- part of a four-day trip to eastern europe. -- joins us by phone now with more details. >> hey there katie. i am actually traveling with the first lady right now. taking pictures, as we are at a border checkpoint on the slovakian side of the town, just over the border. a place where tens of thousands of ukrainians have been fleeing into slovakia, one of the many european neighbors of ukraine. you were talking about it being a significant today in russia. for the first lady is also obviously a significant day, mother's day. it is really an opportunity --

she felt she is an obligation to personally convey her admiration and support not just for the ukrainians before their neighbors, welcoming in hundreds of thousands of refugees. just a few hours ago, earlier today, she went towards a refugee center further into slovakia in the town of -- where she actually heard some firsthand compelling personal stories. one mother describing how difficult it was to explain to her children what is actually happening. the first lady calling it cruel, with the russians have been doing to the ukrainian people. she also took part in a mother's day celebration with mothers and their children, on one is a very special day for her. one of the mothers, i asked her she competed with the first lady. what is it like to have the first ladies united states of visiting her? she and so many other ukrainian mothers are tired. and she said, this is really emotional support for them. first lady is going to be meeting with some of the ngos, and you can see she is

accompanied by the prime minister of silica, who joined her for this visit today. significant moment for the first lady, becoming the most senior official in the biden administration to endorse the war torn nation of ukraine. >> quickly, mike, i appreciate you taking the time to be with us. can you tell if there is a probable uplift in the morale? with the first lady being there? especially on the eve of a huge holiday in russia. >> it was really significant. we've seen this in every stop of the way. we began this trip in romania. the military base, where there were u.s. service members. but also meeting yesterday in romania, the school becoming a point where they have integrated ukrainian children. firstly is focused, there were two visits and questions that she has been asking other officials, what kind of resources have been available? talking about the emotional toll that fleeing your home country, fleeing your home with your children without knowing what the future holds, is really bringing to them. and what we have seen across

this potential nationwide ban? >> good morning katie. that interview with usa today minority leader mitch mcconnell said quote, if the leak opinion becomes the final opinion, legislative body is not only at the state level but at the federal level certainly could legislate in that area. that his when he said to usa today. if you come as no surprise to anybody who has been following this story this week that the republican leader would have these thoughts and support these are ideas of a national abortion ban. 13 states around the country all the of trigger laws that would make abortion illegal, should this opinion become final and be fully released. other states are certainly working towards that and. that is for senate democrats come in here. on wednesday they are going to be holding a vote in the senate to codify roe v. wade. they need 60 votes to pass. they don't believe they are going to get those 60 votes. majority leader chuck schumer has a plan there. that is to get every single united states senator on the record on this issue so that

americans can see where u.s. senator stands. >> gary, we are seeing imagery of you standing in front of a fence. i have been to scotus it before. there aren't offenses there, usually. tell us about the protesting that is going on there. it is not normal to have that type of barricade between the american public and the highest court of the land. >> it is not normal. we have certainly seen this around the d.c. area. we have almost become numb to it after a events and big protests here in the d.c. area. people here up and fired up. this is going to be the sixth day of protests. they have been here a day and night. making their voices known on both sides of this issue. here is what's some folks my colleague julie tsirkin, said yesterday. >> i'm a mom. she is eight months old. i also had an abortion almost 20 years ago. so i think it is extremely important that i, and that people, show their stories now, more than ever. abortion is absolutely health

care. the decision that i made to have an abortion years ago was a deeply personal to me. and my decision to have a child was equally personal. and equally important to me. and just a strongly that i felt about my decision to become a mother, and a sure of it. i felt the same way about my abortion. and abortion's health care. >> now, it is not just firing up the people that were out here protesting the supreme court. it is also impacting the people that work in this building. justice samuel toledo who wrote that draft leaked opinion, said that he canceled an event in nashville this week. and was planning to speak. because he called the appearance impractical. justice clarence thomas said that his court would not be bullied into giving the american people the opinions that they want to have. so certainly a lot of fire on both sides of this nine foot non-scalable fence. katie. >> thank you to gary grumbach, for the latest of the supreme

court. will end abortion ban forced democrats to take more dramatic action? i put this to a member of the pro-choice caucus, congresswoman deborah -- next. americans are already feeling pain at the pump. it could get worse. gas prices could beat the national average of serious today. one of the areas seeing the biggest spikes in prices, with jesse -- how close are we to breaking that record? >> we are right on the cusp. the national average, if you run up to about 432 according to aaa, for a gallon of regular. the national record is $4.33, not adjusted for inflation with what we are seeing so far. but at this point we are right there, and it continues to creep up. >> jesse, what is behind these record setting prices? we have heard a different opinion but depending on who you talk to. give us a little bit of insight into why we've got these prices and where they are heading.

>> there are a couple of factors that our team is specifically looking at right now. first of all, earlier this past week, the european union announced its proposal for a possible ban on russian oil. the price of oil factors heavily into the price of gasoline. and so that, of course, is going to pressure global markets. and then, closer to home here in the united states, we are a couple weeks away from memorial day. here in ohio it is chilly. it is chilly in other places too. we are approaching the unofficial start of summer, where we expect hundreds of millions of americans to hit the road. aaa is estimating close to 700 million people will be hitting the roads. so when you have that coming up, that's leading up to memorial day, also drives up the price of gas here in the u.s.. >> oh right. thanks to you to see courage for keeping an eye on the palms. coming up, president biden is reportedly unhappy about the continuous intel leaks that showed just how involve the united states has been in the war in ukraine.

on how putin will mark the anniversary has intensified. so, far kremlin has dubbed its assault on the neighbor as a, quote special military operation. but ukrainian officials warned that putin could use tomorrow's platform as an excuse to escalate. one dramatic option is to formally declare an all out war against ukraine, and mobilize recruits. some analysts are betting that the opposite could happen. that putin can actually seek to de-escalate, potentially by declaring some form of victory. either way, they warn ukraine is likely hours away from entering a new phase. joining me now is ambassador william taylor. he was the former u.s. ambassador to ukraine. ambassador, thank you so much for joining us this morning. what are your thoughts about putin's message for tomorrow? do you agree with the analysts that are saying both options are going to be optically and realistically bad for putin to embrace? >> i do, katie. i think he is in a bind. he has made a terrible decision,

a strategic blunder, when he invaded ukraine. he grossly underestimated the ukrainians. they have proven to be very strong. very strong. and they pushed his troops out. he doesn't have a right to talk about it. he is facing a big problem. the thing that we should watch, the, is what is going on in ukraine. president putin will do something tomorrow. as you just said, he may double down. and do something that escalates, by declaring war on ukraine, which is not done. what now he has a fiction that a special military operation, and he could double down on that, and risk alienating a large part of the russian people. that he could do. or he could declare victory somehow. he is nothing to declare on that, so he would have to spin it, but the real issue is the heroism and the effectiveness, the bravery, of ukrainians.

they are the ones who are actually victorious, at this point. >> ambassador president biden, at this point, are saying that u.s. intel sharing with ukraine stories are quote, counterproductive. until from your, story would value could actually be derived from intentional leaks? or of the really just gone too far as of now? >> katie, we have seen some value in some of these leaks, prior to this. we have seen leaks that suggests that the russians are going to try to conduct a false flag operation. do something in blame it on the ukrainians. we have seen deterrence. when we expose, it that says to the russians, maybe we can't do this. that was useful, that was affective. this is different, however. in this case, less is better. less is more. let's talk about the intelligence that we are providing to the grain. that would be better. that is we are providing

intelligence. there is no doubt that is clear. and it has apparently been effective. but to the ukrainians are the ones who decide how to use that ability. ukrainians are also getting a lot of sources, other sources of intelligence, that they are putting together with what they get from the united states and other nato allies. then the ukrainians decide what to do with that ability. >> ambassador, i want to turn back the hands of time briefly, talk about the fact that you testified in the first impeachment trial of former president donald trump. your text to -- vacate evidence against trump. you wrote, quote, i think it's crazy to withhold security selection for help -- referring to his unwillingness to provide aid to ukraine following the investigation into hunter biden. do you believe the trump's actions in july 2019 had a material effect on ukraine? emboldening pushing to invade

ukraine this year? >> good question, katie. when we do know is that holding back assistance to a partner, to an ally, who is fighting the russians. ukraine's we're in a fight with the russians back in 2019. we remember that the russians invaded ukraine in 2014. they have been fighting for five years at this point. and we have been in the united states and others, providing that assistance. then the president trump put that assistance on hold. he paused it. he wanted to use it as leverage. but in the end, he was thwarted. he was exposed and the assistance began, resumed, and flowed, and was very effective. as we see.

when it did, to katie, is discombobulated. it confuse the ukrainians, as to why the americans were really about. they thought we were there supporting them without assistance, and then somehow this assistance was paused. delayed. that was not a good message. >> quickly, ambassador, i apologize, we only have a bit of time left for you. less than a minute. you have said the nations, no matter how big they are should be able to govern themselves. and that borders are in viable, and cannot be changed by force. but when someone like putin does not recognize diplomacy or democracy, how can the united states stay on the sidelines with the prospect of russia reabsorbed ukraine, as a very real possibility? >> we are right. we cannot stay on the sidelines. and we are not on the sidelines. that is the why we are providing every bit of weapons and intelligence and training and other support. sanctions on the russians. we are engaged. there is no doubt about it. we should stay engaged for the reason that you say. sovereignty is important. individual sovereignty,

and not just the 23 to 1 immediately institute abortion bans if roe falls. a national band would effectively mean that pregnant americans would have to travel out of the united states to obtain an abortion. it is unclear if such a ban would be seriously considered by republicans, should they win control of congress. now on the flip side, mcconnell's comments come as senate democrats all renewing efforts to codify abortion rights into federal law. senate majority leader chuck schumer is promising to hold a vote this week on the women's health protection act. it would be a little more than a political message ahead of the midterms as the bill appears to lack the 60 votes necessary to advance. yes, symbolism can be powerful. this move is prompting concerns from democratic voters about where the real change is. joining me now for more is north carolina congresswoman deborah ross, a member of the pro-choice caucus. congresswoman, thanks for being here this morning. as i mentioned, there is that

senate vote this week on the women's health protection act, to quantify abortion rights on a federal level. listen it is obvious this is not going to pass. are voters getting tired of the theater and what is the realistic plan to fight back? >> well, thrilled to be with you. and by the way, congratulations on the show. really excited to be one of your early guests. so this is important that the senate votes because the house passed this putting roe v. wade into federal law we saw that months ago. we marched to the supreme court after we did it. and we need to know where the senate stands. we have a 50/50 senate right now. we know that we even have democrats that are not in favor of making sure that roe v. wade is the law of the land. we have a couple republicans who are on our side. but we need to know where the senate stands. we need to know this because this is such an important

election here. there are many senate seats that are open including in my home state of north carolina. where we can flip a seat and get a pro choice democratic women to be in the senate. and that would make so much difference. the other thing that people need to know is right now the fights are going to be in the state houses across the country. in north carolina we have a republican house in the senate. but we have a democratic governor who can veto abortion bans. as long as he is governor and the legislature can sustain his veto women will have a right to access abortion. if they're in north carolina. >> congresswoman you mentioned a couple seconds ago the fact that there are some senate republicans that are clearly pro-choice. those senate republicans include susan collins and lisa murkowski. why not as a democrat or perhaps why not the democrats embracing that much of the bill

that they have proposed as a amendment to the women's protection act caught defying roe v. wade and keeping the current holdings of the supreme court intact for america? >> well, that is a question for the senate. the senate can get the votes for that and send it back to the house. then we can have a conversation about that. but until then, the house has to make it clear. we want row in federal law. so every single woman, every single woman, in this country, has a right to reproductive freedom and safe affordable reproductive health care. the house has made a stand. if the senate sends us something else which by the way they do all the time, then we will talk about whether we can move that. if you can even move the colin murkowski bill, you need to make sure that we are telling the women of the united states that we are on their side. >> the progress that republicans have made was due,

in large part, to the prioritization of appointing antiabortion judges. many voted for trump -- in the highest court of the land. that is, said supreme court nominees have been very coy when asked about rowing confirmation hearings. let's take a listen. >> a good judge will consider, as president of the united states court, worthy as treatment of precedent, like any other. >> senator, i saw this saddled as a president of the supreme court, entitled the respect under principles of star decisiveness. one of the important things to keep in mind in roe v. wade is that it has been reaffirmed many time over the past 45 years. >> as richard fallon from harvard said, we're always not a super president because -- forts overruling has never seen ceased. but that does not mean that roe should be overruled. >> i only have a minute left, but i want to ask you this

question quickly. are we in dire need of overhauling the judicial nomination and confirmation process, in order to get the straight honest answers out of the sweetest justices? >> we are in dire need of having people but he appear before the senate be truthful. in both senators murkowski and collins, as you noted, are pro-choice. they care about roe. and they have been quoted on that. what we need to do is hold people's feet to the fire when they come and testify. it is just plain wrong that people who were testifying were not honest. remember, north bay there greensburg was a very honest. at a different time. at a time when there was not a pro-choice presence in the senate. but she felt it was important to be clear and transparent during her confirmation hearing. >> thank you congresswoman deborah ross for your advocacy and for your time this morning.

disappointing came out this week, we saw some extreme opinions being floated by the right. as we told you before they break senior minority leader mitch mcconnell said the national ban on abortion is possible. yesterday we discuss the louisiana bill that way classify abortion as homicide. let's be clear. this kind of extremism goes way beyond the abortion debate. in fact right now it seems to be a race to the bottom. by states governed by gop majorities. four republican senators led by kansas as robert marshall wanted tv ratings to warn parents about any lgbtq representation in shows. so that parents can shield their children. and a letter to the tv parental advisory board, they said they were concerned by reports the daily -- having more gay characters in their stories. in texas governor greg abbott said he does not want his state to be forced to pay to educate undocumented children anymore and he wants to take that challenge to the supreme court.

yesterday i showed you a quote from an essay in the atlantic and it really stuck with. me talking about how republicans are trying to quantify the cultural beliefs of its largely white question older base, as the country's democratic demographics are switching under their feet. here to talk about that in so much more as msnbc and political analysis peter beinart and al -- senior adviser to jeb bush, and the former chair of the republican party of florida. i'm gonna start with you all. you have the longer you on the republican party. you are part of the transition team. as i noted in the intro, it is a mad dash to the bottom, in my opinion. what happened? >> we are not only living in this environment, but we are using the environment to be so toxic it is hard to recognize. for 50 years, the party has been convincing activists that

are antiabortion or participate, a lot of money spent. on it this is the one group that remains a single issue for voters. the promise that has been made is that we are going to be appointing justices that will overturn roe v. wade. the challenge -- a lot of the leaders of these groups have come to believe that to be the case. after a 50 year wait. but frankly, between you and i, which is mystifying to me the most is the answers the justices have given in the confirmation process. which are pretty clear. and the answer was, roe v. wade is established law. we have had that case and then we have had a case in the 80s confirming that. to understand which law, and there's a different place to go to. especially if you are going back instead of forward. >> you and i know that one of

the favorite talking points for the gop's to complain about is activist judges, on the side of the democrats. it looks awesome activist adjust on scotus. so peter, i just talked about 100 percent return on the investment if you are a single issue voter. could these extremes by the right, though actually alienates suburban white woman? who are key voting bloc. they are part of the group that delivered donald trump in 2016. >> there is a possibility. i think, unfortunately, in this midterm election, there are so many other things that are going the republicans away. problems with the democrats, i'm not sure if they are enough to say the democrats majority in congress. remember that historically, parties almost always loses this first midterm election. almost regardless of what is happening. and then the rating is very low. inflation is very high. republicans are successfully gerrymandering in house races to give themselves some big

advantages. this is probably the democrats best chance that this outrage will bring voters to the polls and maybe flip some independently ding woman to the democrats side. but i still think it is a really uphill fight. >> well, new poll from yahoo taken after the supreme court leak. it shows that when asked to decide between a democrat who supports abortion rights and a republican who does not only 31% supported the republican. despite this very loud comment from mitch mcconnell with a national ban on abortion. why are so many republicans staying quiet about the roe v. wade news? i mentioned -- wilson yesterday it is probably a result of the -- finally catching the car. >> could be. my sense is that we still live in an era of single numbered districts. where people are representing a race. and they are going to be holding on to that base. when i started out with reagan

we had up to 9800 seats up for grabs in the congress. now you are lucky to have 20. and so people have decided that -- are my biggest challenge. rather than the general election. and they have to make sure i'm not upright in early by somebody on the. write that creates a toxic atmosphere. that is why a lot of these folks are going way over where you would advise a politician to go into, frankly if they were antiabortion. they should have just been circling the -- and congratulating themselves. but they are going way beyond that. you mentioned just a little while ago. my sense is they want to make sure that they are not going to be primary, they are not right side of the audience. the audience is very small. the center of the country really doesn't have much of a voice anymore. >> you use the phrase elder statesman, but i should probably say younger statement. you are a younger statesman of the republican party. is there no advising that is going on?

>> i think that is right. i think this is actually the biggest changes it is happening to the course of our lifetime. i am 51 and i remember when i was growing up and coming into adulthood, the supreme court, there was reference for them among the people that i knew. and i think that certainly for progressives, bush v. gore was one big moment that started to change that. the sense that this is actually a partisan institution. and then, roe v. wade coming out, especially given the fact that four of these five justices have been willing to vote to overturn it, or points about presidents who did not win the popular vote. and then at least one of those cases, that patient should not have been appointed to that seat at all. barack obama should have been able to support that position. i think it has done a really dramatic, had a really dramatic impact on people. it is really tragic, as you say. even though the views of congress were always very low. but we need to see now is that
