good afternoon on the saturday, i'm yasmin vossoughian. we've got a lot to cover right now. stick with me through these next two hours. help may soon be on the way to parents desperate for baby formula. a key plan reopening just today. three trump continents all defied subpoenas from the january six committee. so why is the doj only charging one of. them we are also watching south florida, as a tropical system brings potentially delicate deadly flooding there. plus -- new revelations that resee -- then a shocking new attack.

on transgender athletes in the state of ohio. a republican bill calls for inspecting the gel entirely of students. all of that plus a star studded concert set to begin shortly, as the queen's platinum jubilee celebration. we're live at buckingham palace. let's begin with breaking news out of delaware. president biden is spending the weekend in encouraging -- josh is good to talk to. i know this happened in the last few minutes. let's get to the news now. talk me through what we know. >> well courting to a secret service spokesman, who spoke to our producer, there was a small aircraft, were told it was a says now, a four seed or, that was accidentally in the restricted airspace over ravi beach, where the president and the first lady are spending the weekend. according to a secret service, the pilot made a mistake. was on the wrong radio channel.

didn't have the update information. there was a u.s. military airplane, that escorted that plane out of the airspace. according to a white house official, president biden and the first lady were evacuated from their beach home here in delaware to an undisclosed location that we believe, based on what we can see, was this fire station right behind me. this is rehoboth avenue, which was quickly shut down by secret service. secret service vehicles came to this fire station. president biden was there for a short time, while the white house officials and secret mater everything was safe and escorted the aircraft out of the airspace according to white house officials, the president and first lady are safely back at their home here in rehobeth. >> thank you if anything breaks please bring it to. us i want to get now to the new

reaction to the decision by the doj not to charge several top officials from the trump white house for contempt of congress. it comes hours after peter navarro, peter navarro was indicted for refusing to comply with the january six committee. the doj announcing it will not file charges against dan scavino, mark meadows, and others who are found in attempts of -- in a statement dense given as attorney said this, we are grateful the doj exercise sound judgment and deciding not to prosecute this case given the substantial flaws in the legal basis of the committee subpoena and the issues -- yesterday the doj indicted peter navarro for declining to -- and the other for refusing to -- he faces up to one year for presenting each count. here's navarro's at the

think there are distinctions between the cases and the department of justice owes it to us to explain more fully based said it was based on individual facts and circumstances on each of the cases i'd like to know with those distinctions are, there is an office of legal counsel opinion that of course could be reviewed and could be amended could be completely changed about not going against people who are top level advisers in the white house. but in the was an active member of the white house top level when he refused to testify, or about the time he refused to testify. he was indicted. so why is it something special about meadows and scavino? well they cooperated a little bit. that's maybe the only difference. but in the, and they did not fully comply, i think they are subject to being indicted for

not letting america know the facts that america needs to know about an attempt to overturn the election, which is what this is all about. >> we know meadows provided a heck of a lot of emails back and forth text messages, paper trail, i should, say i believe it was thousands of pieces of communication that he provided to the committee, and yet they did refused to testify because they both cited this executive privilege with the president. that is obviously the defenses they continue to stand by. i do want to play for you what we heard from congressman louis gohmert, talking about an everest indictment. quite puzzling to say the least. >> we have a two tier justice system. if you're a republican, you can't even lie to congress, or lie to an fbi agent, or they're

coming after you. >> that's accurate. do you shouldn't really be allowed to lie. republican or democrat. to congress or the fbi. fairly accurate. >> that is for sure. and you should not be able to lie ever, even to the american people. but that's a question of how we vote, not about whether you get indicted. when he said doesn't make any sense. it makes no more sense than the claim that there is executive privilege for discussions of committing a crime or insurrection or planning to overturn the results of a free and fair election. so i don't get the claim of executive privilege even by the two that are not being indicted, because they are not being asked about conversations with the president about their work. they're being asked about what they know about, also about

conversations with other people, as shown in the meadows communications. they were people from congress and people, ginni thomas from example, those can't have any executive privilege. executive privilege falls flat. >> let me ask you this before i let you go. we know public testimonies beginning this week. we are being told this is yet unseen testimony, yet unseen documentation that is gonna be revealed by the january six committee. what are you expecting to hear? to see? what are you gonna be looking for as this public face of this destination begins? >> first, i would love to see live witnesses. i would like to see the testimony in person, i don't want to see a recording of it. i think there is nothing as powerful as the witness themselves. we've heard things like, well, i heard that trump said. it might be a good idea to hang

-- i want to hear that witness say life. those are the kind of things that could really make a difference. i think there is a lot, i have one fear, which is of the trial lawyer, i know you never want to over promise. i worry that this will -- this is gonna blow the roof of the house, is a kind of promise that must be fulfilled by really clear and convincing evidence. and not stuff we've already heard. >> thank you as always, we appreciate you joining us at this hour. thank. you let's talk about the baby formula shortage. is there some good and breaking news about that, parents of newborns who are happy to hear one of the largest suppliers in the u.s. of baby formula has just restarted production in its michigan plant. abbott laboratories reopened its largest -- it was shut down in february at the time. the fda found contamination

i let's first address-year-old are today in san antonio. and when you plan to address. >> [inaudible] it's false promises, false recommendations, that just like every other massacre that happened in texas. we have to start getting people motivated about the policies that in some ways are killing us. that's the truth. either what they're doing or whether not doing or killing our children. as harsh as that sounds, that is what is happening in texas. >> let me ask you about the 9-1-1 call. so i mentioned that you made news. we heard essentially 9-1-1 calls were not being communicated to the police chief outside of robb elementary school. we also getting news reports from the new york times that nbc has not verified on our own

that the police chief in fact did not even have a radio on his person, and he was the third officer behind those two that were grazed by bullets by the shooter, first showing up to the school. what do you make of these new developments. have you heard anything else? >> i know what you know, i was told by law enforcement that this person did not have comps. i asked what that and then. i was not told he didn't have a radio. as told he didn't have comps. my critique of that is then who makes this guide, the incident commander? how do you become an incident commander with no comps? you just raise your hand? to my point, i think that every law enforcement agency in that room that was receiving 9-1-1 calls, it's just as responsible here for their failure of not going into the, breaching that room. it's just a colossal, colossal human error, system failure, and unfortunately it might have led to the loss of life. >> you know it's interesting,

senator, because you have a new york congressmen, a republican, essentially coming out against guns for the very first times, feeling as he have to act. he's been quoted that, he had to do. something is not come out and saying he's all about essentially putting restrictions in place when it comes to assault rifles, possibly an all-out ban, possibly raising the age of acquiring assault rifle, and because of his stance, every republican that endorsed him in his reelection bid, withdrew his their endorsement that he is no longer running. his campaign is now and. it it feels that is the backlash that republicans are worried about if they were to change their stance on gun control. specifically assault rifles. is that's what's happening in texas as well? >> [inaudible] the rest of them there are bunch of cowards. both in washington and in austin.

we've got a governors doing where them of the same. the special committee will eat absolutely no solutions on guns. not even what republican constituents who are calling me about, which is raising the age limit to 20. what you need to be 20 went by gun, but you can buy an ar-15 at 18. this is disgusting what's happening throughout this country. >> the lieutenant governor set up a special committee to prevent mass shootings, essentially looking into the ways in which they can do better. you were left off the committee. senator this is not the first time you've been left of things since the shooting at robb. do you want to be on that committee? >> this committee is a toothless tiger. i'm gonna have a committee the same day, somewhere in the building, or on the ground somewhere, and we're gonna talk to experts across this country talking about real gun solutions. we're gonna talk about what's raising the h means.

we're gonna talk about where waiting period mean-spirited. working on that and we're gonna have a committee if, leaders want to show up to our committee hearing that's where we're gonna do ours is just as much official as there is this. at the end of the day, i have no interest in taking part in a committee that is talking about a single door of a school, as if that was the answer. the lieutenant governor yesterday put out a press release, that every cop is not gonna have a ballistic shield in his car. there were ballistic shields in that hallway. a lot of good it did those kids. listen, the 18-year-old pawn that bought these guns shouldn't have bought them. i am a gun. owner i know what my constituents. wants my consist to its don't have ar-15s. they want the age limit raised to 21. they want red flags. they want common sense gun solutions. they want republicans to represent them. let me just get you on the record here, senator, before i

boulevard and 11th street, and you could see this intersection pretty heavily flooded. but water has started to recede, fortunately, so we are seeing cars make their way through the intersection. most of them are doing okay, but this, earlier, when the water was much higher, we saw several cars that were stalling out. and this has been the problem throughout much of miami, because several streets have been flooded. miami pretty much a mess. we're going to speak to the miami area fire and rescue leader, he says that they had about 125 calls for help, of people getting trapped in waterways. the good news is, no fatalities. so, no serious injuries or anything like that, but it is certainly been a mess. the good news is, you are getting a break in the rain. oh, i see a little bit of blue sky behind me. but this may still end up being the first main storm of hurricane season. they expected to move offshore, where it will strengthen a little bit and turn into alex. so, this is what's happening. hurricane season just a couple

101 days since russia invaded ukraine. and the nato secretary general is now calling the conflict a war of attrition. earlier, newly appointed u.s. ambassador to ukraine, brigitte brink toward the devastation outside kyiv. the u.s. will support ukraine in their investigation of possible war crimes. -- we're on the ground for you in capital city. good to see you, ambassador brink was calling for justice there. she's new to this position, even though we are continuing to see this war rage on. >> that's right,. yasmin brinks said that those responsible for war crimes committed in ukraine have to be held accountable.

she said, it's not just the people that committed those unspeakable atrocities that we've seen over the last hundred and one days, but also those commanders. the seniors who dished out the orders to those ground troops to commit these things, to break the ukrainian spirit. she said that the united states is going to do everything it can to help ukraine, to help international process before, whether it's through the state department ordered u.s. aid to bring people to account, who have committed these crimes across ukraine. let's take a listen to what's ambassador bring kathy. >> i think it's really important to bear witness to these horrible atrocities. and being here today has only strengthened my resolve to help ensure justice and accountability. i think the efforts are's efforts of the prosecutor general are very important, and i don't think they should stop or be paused, just because the war continues. i think people deserve justice, and they deserve justice now. >> and yasmin, she said this

participating in feet male high school athletics. that's according to the ohio high school athletic association. we actually video of that high school student, amber, who uses she and they as pronouns, speaking a little over a month ago about playing on the girls baseball team. >> being able to play on the girls team is absolutely amazing. it's a total dream. i feel at home and i can be myself and push myself every day to do my best. and i don't have to put on a mask or pretend to be someone else to play the sport i love. >> and ember it's joining me now with her mother, who prefer to use their first names with their interview. and with a member of the lgbt advocacy group member. thanks for joining us on this. so ember, we just heard a little bit from. you now, we're hearing about this ohio bill.

and we can hear and feel how much happiness it brings you to be able to participate in sports at your school. what is hearing about this ohio bill doing to you now? >> honestly, it's terrifying. i just want to be able to be myself and to stay on the team. i made friends and i have such a great community there. i don't want to have to leave them. >> how long did you feel as if, ember, you were not able to be yourself? >> i haven't really felt like myself for a lot of my life. i played baseball when i was younger, and i didn't fit in at all. i didn't feel comfortable there, and none of it, just with me. only in the past year or so, i've really started to feel like myself and be comfortable

in my body. >> so, just in the past year, you've started to feel comfortable in your body and feel like yourself, and you fear that might be taken away from you once again with this bill, if it becomes a law? minna, as a mom, you never want to see your kids suffer. you never want to see your kids be scared. what is this doing to you? >> it's extremely hurtful, especially when we've been told that she is the only approved trans female high school athletes in the state. so, it's incredibly difficult not to take that personally. it's awful. and it's hard. she wanted to play years ago, and i had to say, honey you can't. you won't qualify in ohio until you've been on medication for at least a year. it takes at least that long, and you're not old enough to do

that yet. so that was hard as it was. she had to wait three whole years before she was finally able to play. so she's even behind her skill development, compared to her peers, because she wasn't allowed to play until her sophomore year of high school. >> minna, let me just ask, you why did you guys not want to use your last name? why are you worried about? >> we live in a pretty rural every a, and in ohio, and we're a family with a trans kid. we have targets on our backs, and doing this video, we're afraid that we've just turn that into giant neon signs. i have to say, we've had incredible support as well, some of amazing family friends, our church is the most amazing, supportive church you can imagine. but it's still pretty scary. i have spoken to people who have told me that my kids shouldn't be allowed to live, who just live -- >> wow. >> and that is terrifying. >> yeah.

especially concerning but we're going through in this country right now, to. alanna, let's talk about solutions here. what could be done, right? let's talk about this extreme language. this is incredible to think that they are doing this as if it's a problem, when there's one transgender high school athlete in the entire state. the extreme language. we are talking to a certain extent about people being a cutest of being trans, and them being able to be inspected for gianna taylor got to be inspected, and what that would do psychologically, the harm that was due to any person who has to go through that. and i want to talk about the protections in place for the accusers. saying this, the bill does not include any language to who may disclose the athletes gender, -- justice creating penalties for people who blamed frivolous and abuse of challenges against female athletes, nor is there

any recourse for no transgender women who are hereby stripped of the right to play sports. what can be done on that? >> that's right, yasmin. it was a shameful week in ohio, truly. our legislature spent so much time attacking our lgbtq people, specifically through this bill, and two others. as one legislature elevated, they are more focused on the genitals of our transgender youth than on the business of ohio. what can be done and what we will be doing is working every way possible to stop this hateful bill in the senate. it only passed the house, and at 11 pm at night, because that's when they knew they could try to ram this through, but it will head to the senate, and we will have opportunity to stop it. there >> ember, once your next game? >> my next game is on tuesday. >> all right girl, hit it out of the park, william? show him what you've got. ember, thank you, minna you, thank you as well, and, alonna
