right now, the country is in name celebrating its independence from tyranny and absolute rule but today's july 4th is likely to feel different for millions who watched the supreme court decisions, pointing the nation down an uncertain path. among them millions of women now subject to the court's decision

overturning roe v. wade. many have already watched trigger bans on abortion take effect in their states. while conservative lawmakers have a cartoonish message to keep women from fleeing to blue states where abortion is still legal. and president biden must not only preside over this chaos, but use it to drive voters to the polls leading up to crucial midterm elections in november. across the national abortion fight, it is far from his only domestic challenge. as this july 4th weekend has been curtailed by the same record inflation, rising gasoline prices, that have hampered democrats' agenda and dented the president's approval numbers for months now. i would be lying if i said our democracy was not in peril this independence day. and i won't patronize you with the easy prescription of vote

harder, because marginalized communities will tell you, it's not that simple. so as we mark the nation's 246th birthday, what does fighting back look like? and do democrats have enough time to do so before it's too late? that's the big question on "politics nation". also, tonight, police in akron ohio just released body camera footage of a police shooting last week, and it cast a shadow all over the city's july 4th weekend. we will bring you the latest. first, joining me now is congressman jim clyburn, democrat of south carolina, and house majority whip. congressman clyburn, we appreciate you joining us as always. and of course, we have a lot to get to tonight.

>> thank you. >> again, thank you for being here. on the eve of a tense july 4th, for the nation, i want to start on a hopeful note. ketanji brown jackson now officially installed as u.s. supreme court justice. in no small part because of, on advice of your daughter dr. jennifer clyburn reed, who lobbied you, you joined my colleague lawrence o'donnell hours after judge jackson was sworn in last week, folks at home, take a listen. >> with the nomination, we knew that representation matters a lot. and the representation just wasn't there, so it wasn't argued that the congressman had no answer for. anything is possible. and justice jackson, let's say

that again, justice jackson, is the representation of what is possible for all americans. >> now, given how close you were personally to this process, congressman, how you are processing this milestone coming just a few days before the nation's birthday? >> well, thank you very much for having me. you know, watching this, reflecting upon the discussions we've had back in 2020, and a lot of people were saying that that this kind of commitment should not be made in public, i think it is necessary for people to know the real joe biden because i urged him to do it because i thought it would help to change the narrative in his campaign, and it did. and i'm also proud of that

moment. this justice is going to do, what she will do for herself, her family, her community, this nation rea proud. and i'm so, so pleased to see it come to pass. and you're right. i have three daughters. and all three of them are involved in that, in those discussions. jennifer's a little more outspoken than the other two, and so she kind of took the lead in the argument, but i listen to my daughters, i talk to them often, jennifer is here with me now, and we spend july 4th together, and the others will be joining us. and we hope dominion is still up, she's down in new orleans. >> i'm still here. and i saw that proud fatherly look you had, and i must say you have three daughters, they came

from two activists, you and your wife, so it's in their blood, and i certainly remember that you were the one that helped to put that president there, when you endorsed joe biden and turned his campaign for the nomination of the democratic party around. i will never forget the morning of the endorsement, to the political action network in south carolina, led us in the breakfast and we gave you the award in the name of your activist wife. congressman, let me not avert too much. justice jackson joins the court, as one of three liberals, contrasting with the conservative woifb with decisions in the last few weeks, not the least of which is the reversal of roe v. wade. other than authoring dissents to future opinions from the conservative wing, how does justice jackson hold the

>> another big story hours ago, the akron ohio police department released body camera footage of the fatal shooting of motorist jalen walker and last week, i must remind our viewers that this footage is disturbing, the video is showing, from an akron chase and the onfoot pursuit that authorities say preceded the officer ultimately opening fire, at least 60 times. according to akron police chief, right now, eight unidentified akron police officers are on administrative leave. akron's mayor is calling for

peace earlier as protests go into their fourth straight day. this police department maintaining that walker fired a gun during the pursuit, a claim the family disputes. congressman, police reform failed to materialize in the senate last year. despite the house passing the george floyd justice in policing act, still, there was an effort, no doubt, made possible by democratic majorities in both house and senate, but if republicans re-take congress, can we assume that even that effort will become impossible? >> well, if you were to look at what the supreme court just did to the new york law, then you've got to know that we're in for some very trying times if we do not intervene this november. and you know, i've been talking a lot these days about the sentiments made, that took place in this country, and our country

has not moved from the changing, left to right, to right, to left, to back to left again and that's the way it has been and to check that, it is voter intervention. and if the voters intercedes in november, i think we've got a real chance of changing the direction of this country, when it comes to police behavior, when it comes to guns, and if we let ourselves out of this process, and continue on the lack of voting, then we have some hard times ahead. i think the house is demonstrative of the fact that you can get things done when the democrats have got the majority. you do not have to declare majority in the senate. it's 50/50. and we have two democrats who are not willing to tackle this

anticipation of the overturning of roe v. wade. most americans support some kind of legalized abortion. but there is very little agreement on how broad or narrow reproductive rights should be. will defending a woman's right to choose be the winning issue many democrats hope it will be, or what should they be saying about it? >> let's start, i am confident to telling the american viewers that the democratic political provision has improved over the last month, is it still perilous, yes it is, but it is better today than it was a month ago. and you can take the abortion decision, but don't forget the gun decision, and this horrible environmental thing that came out, and as you know, marginalized communities are affected by gun violence far more than other communities, and far more affected by pollution, than other communes, too. both from the stands point of clean air and climate change.

and basically your supreme court has -- if you think about it, reverend al, common sense tells you, we shouldn't be restricting people's freedom. common sense tells you we don't need more guns in this country. we have 400 million guns, something like that, in the country right now. and common sense tells you we need less pollution, not more and it's just going against nonsense and if the people you mostly care about, and i would like to think that i do, too, are the people who are most adversely affected by this. >> all right, now, let's look at republicans, and specifically the top of the chart, former president trump remains the standard bearer but it does seem like the accounts of him throwing food and wrestling secret service accurates put forward in, by the january 6th committee, are getting under his skin. the best evidence of this is that he's now reportedly itching to launch his presidential campaign before the midterms are

you up to date on breaking news out of akron, ohio, now, where the akron police department has just released body camera footage of a deadly shooting involving an officer. maggie is there now. we know there was a peace march scheduled after the peace conference. what are you seeing? >> well, reverend, as you can see, we're looking at what is happening, people are moving around here, around city hall, and the police department, and when do we want justice, when do we want it, now, and the 25-year-old early monday morning was shot and killed by akron police, and the thing that is really endearing people here are the numbers of the story,nd people are confirming now, there that there are eight akron ohio police officers firing weapons, 90 wounds, wounding -- excuse

me, 60 times. 60 obviously fatal. the 25-year-old dying of his injuries. police released body camera video of that the moments and the barrage of bullets that shot and killed him. and there are details what led up to the shooting and saying that they were pulling him over for a traffic violation and they say he shot at them and it appears to show that out the car window but what people here can't get past is that again he was wounded 60 times, according to the initial autopsy report, and 90 rounds fired. and again, they say also police point out that they believe he was unarmed when he was shot, that he was actually running away from police. so this is the city of akron, right now, people are furious, and they have seen the video, they heard what police have to say and they say they don't care, and they feel the level of violence against him was

granted are now in peril by a supreme court that no longer seems to be guided by the will of the majority of americans. the house committee investigating july 6th has revealed troubling new details about a president willing to lie and cheat to remain in power. and an angry mob willing to follow him, in a way that lies beyond democracy, all while calling themselves patriots. these feel like dark times. but i remain heartened by the fact that we have been here before. in july of 1861, america had gone to war with itself. president abraham lincoln traveled to the north, and saw citizens grapped with nationalist fever, waving the flag and spiking themselves up for war with rebel neighbors to the south. but as one story notes, president lincoln was unimpressed and quote repeatedly

emphasized in the 1850s, american freedom above all led to the inalien able right to life, liberty and the pursuit of happiness for any human being regardless of color or circumstance. our country founded on principle rather than race or nationality, lincoln argued deserved not only to survive but to inspire the world, unquote. and lincoln's address on july 4th of that year, he said his fellow countrymen, quote, it is now for them to demonstrate to the world that those who can carry an election can also repress a rebellion. and that when ballots are fairly and constitutionally decided, there can be no successful appeal back. unquote. his words still resonate more than a century and a half later. those who resort to violence and

he's also an msnbc political analyst. and former democratic senator doug jones of alabama. doug, let's start with the legal battle the supreme court has sparked by overturning roe v. wade. this week, judges in florida and kentucky blocked abortion bans from taking effect. but supporters of abortion rights face an uphill climb with bans and restrictions on their way in at least 22 states. do you think there are still pathways to protect abortion rights in the courts or should the focus shift to legislation? >> i think there are very few, thanks for having me this sunday afternoon, before the 4th, i think there's very few legal avenues, some of these states are going to go too far. especially when they're talking about banning travel, where they get into contraception, and those are going to be the main legal battles to be fought. there is still a lot of legal

battles out there, but the fundamental right is going to be left to the states and i think that we've got to look at trying to figure out how to do this on a federal legislative level. and otherwise, we're going to have chaos. you know, justice alito's opinion thought that we settle this issue down and what he has done is really thrown gasoline on a fire, because we are about to have chaos in 50 states. the red versus blue is going to be very strong. where people are going to try to control and influence their state legislatures to do what they want. it's going to be a real battle in the state legislatures. >> now, david, the supreme court made another move this week, that could prove to be almost as consequential in its decision of reversing ro ex. the high court said it will hear arguments in north carolina, in the north carolina case, involving what is called quote

independent legislation series. which gives states the sweeping look, legal experts warn this could open the door to more partisan gerrymandering and the theory was cited by trump lawyers in their efforts to send the 2020 election back to the states. how deeply do you think the outcome of this case could affect our democracy? >> this could be a ground-breaking case, and i would expect the conservative majority to rule on behalf of state legislatures. and rev, what this will basically do is say a state legislature could actually pass any version of voting election administration laws, so long as it doesn't trigger across the line, and the voting rights act, and protections of minority voting rights that the supreme court has declared as a federal issue and the congress has the voting rights act. what does it mean? that means in states where, for instance, citizens have petitioned to put an amendment

to the state constitution to prohibit gerrymandering, or to require geography as a fairness test, or in states that have pursued open primaries, or ranked choice voting, now if a party to a sufficient majority in the legislature, they can undo the citizen wishes. if the supreme court goes in this direction, it would suggest a state legislature can do whatever it wants with voting mation administration laws which we know in red states would ultimately be used to reduce turnout among democratically majority and minority communities. david, let's start with you and talk about the january 6th probe. in surprise testimony last week, a former aide to the trump white house chief of staff mark meadows gave a shocking account of the former president's actions that day when the two secret service officers refused to let him follow protesters down to the u.s. capitol. take a listen. >> mr. engel, grabbed his arm,

and said sir, take your hand off the steering wheel, we're going back to the west wing, we're not going to the capitol. mr. trump then used his free hand to lung towards bobby engel and recounted the story to me, motioned toward his clavicles. >> now, just as troubling as is his own violent behavior was the president's apparent knowledge of his supporters violent intent that day and he knew they were armed. the president was told many in the crowd, he had assembled, were armed. and yet, according to the testimony, he demanded the removal of the screening devices that would have detected those weapons. what should the consequences be for this type of behavior from the commander in chief of the united states? >> i think if you accept cassidy hutchinson's testimony and

granted it has to be tested against other people's memories of those days, it means the department of justice needs to investigation whether or not the former president, while he was sitting in the office, knew that there was an attempt to use violence to prevent the certification of an election, and said i am going to help advance that violence. i'm going to reduce the security blanket. one of the most damning things is cassy hutchinson testified that mark meadows and pat cipollone, said that president trump agreed to the fact that mike pence should be hanged and they started this so quickly, they wanted to set the hook with pat cipollone and now we know you were in the room and heard president trump induce violence and what do you say. >> and president trump has said at that rally, we have seen it over and over again on video, where he was going to the

capitol, where the president cannot go chamber of the house and senate unless he was invited and what he was he going for. and we do know that he knew that they were armed. let me go back to you senator jones, i want to mention a significant development in the 1955 lynching, and murder of emmett till, and last week, a team searching a mississippi courthouse basement for evidence of the case found an unserved warrant charging a white woman in his kidnapping. the relatives of emmett till reportedly want her to be arrested years later. you successfully arrested kkk members in the church bombing, nearly four decades after it took place. talk to me why it is so important that justice be served in these cases even so many years later. >> well, justice should never be

denied. it can be delayed, but it should never be denied. and i think the finding of this warrant is really an important development. i have for a long time felt like it would be very difficult to prosecute that woman for murder, with the way it turned out, she has made certain admissions but the murder case in the statute of limitations, i felt it was very tough but right now with this warrant, what you've got is authorities felt at the time, in the 1950s, there was enough evidence to charge her with kidnapping and under mississippi law, understand, there is no statute of limitations for kidnapping and i think that's a very different crime that you could possibly prove, given her testimony that she lied to authorize, given the fact that she talked to her husband, and the other man who had admitted, who had killed emmett till, there are opportunities here, whether or not a local d.a., or

robin hood foundation. he is also a democratic candidate for maryland's governor. thanks for joining us today. >> thank you for having me. >> i want to start with this story out of akron today. as you have worked to address urban poverty, you understand all too well the impact of police brutality, and the criminalization of black youth. and in your home state of maryland, it has seen its fair share of these types of cases including the death of freddie gray in 2015. what are your thoughts about these incidents? >> well, your thoughts go first to the family. and to know that we have to move with a level of urgency about this. we need a thorough and an independent investigation as to what happened. and i talk openly about what has happened, we have to be able to get to the bottom of this,

because the reality right now, we keep on seeing the same things happening in our communes. and for us to be, for us to truly be able to create a situation where people can feel safe in their own community, in their own home, and in their own skin, it means that we have to have a thorough investigation. many have felt that financial burden, especially in black and hispanic communities. with your experience from being the ceo of the largest anti-poverty nonprofit, what can be done to help vulnerable communities right now? >> i mean the reality is, reverend, when people, as i'm going all around the state of maryland, and i'm hearing from

people, they say, things like this are really expensive, and the reality is it is way more expensive and many of us can't afford to put gas in the car and food in the car. it has gone up so much just in the last month. and there are a few things that you can do on a state level to address these ices and the affordability of our families. the first is you got to get people back to work. and the reality of having a broken child care system continues to bear on us, because not only, not only the state of maryland, 850 child care centers closed in total but that is one of the core reasons that we have not brought people back to work. and we have to focus on job train can and jobs to bring people back to work, in the economy, we have to raise wages and right now we are talking about a minimum wage that is still not keeping up with inflationary growth. and to make things more

affordable, we got to release this pressure valve off of people, off of working families who are struggling to survive in this environment. >> and quickly, i would like to you take on another story. in your state right now, a supreme court marshall has asked the governors of maryland and virginia to curtail protest activity outside the homes of supreme court justices. what's your take to protest? >> no, i vehemently support the first amendment. the right to free assembly and the right to free speech. and i also support safety. and i think when we're talking about the confluence of what this is right now and what we're looking at, i know people are -- intimidating and threatening judges is not going to be the
