4:33 am
they're gonna blame trump for any losses that the republicans take anyways. he might as well be out there being front and center when trying to turnout his supporters. the argument that is being made against it is, look, you are making it all about you instead of these other issues that republicans think they have a better chance of winning on. we are focusing on president biden's record in office. we are focusing on inflation. there are all of those issues that they would rather talk about. >> isaac, thank you so much for being here this morning. i want to say thank you for being so flexible with our live cut. we appreciate you taking the time. >> absolutely, thank you. >> coming up, former dayton, ohio mayor joins me to talk about the ten year old abortion case that is drawing worldwide attention. this is how the conservative right tried so hard to shut

not going to want donald trump to be anywhere near being sworn under oath. he is a compulsive liar. i think that he was lying at the rate of something like eight or ten lies a day before he left office. >> representative jamie raskin has a point. getting a former president to testify under oath would be huge. many this morning are wondering whether or not it will be a pointless exercise. committee chair benny thompson told nbc news just last night of the panel is still deliberating on whether they will subpoena trump and his vice president, mike pence. the interest hearing from pence has been heightened since pat cipollone praised pence for fusing to meddle in the electoral college certification. >> i thought that the president did not have the authority to do what was being suggested. i think he understood my opinion, i think he understood my opinion afterwards as well.

record as much as anything. we all remember when hillary clinton testified in the very silly hearings, she testified for 11 hours straight. she answered every question, she cleared the record. the fact that neither the former president or vice president would sit down and speak with congress about an event that is so central to the future of the country, it came very close to being an armed insurrection. that fact deserves to be on the historical records of these subpoenas may serve a purpose that far transcends any hope of actual testimony. >> breaking overnight, the january six committee subpoenaed the secret service after learning that the agency allegedly a raised text messages from january 5th and sixth of 2021. talk to us about why the committee has now moved to subpoena these missing text messages. what could possibly come of all of this? >> we don't really have clarity

on what happened here. there are two different versions. it looks awfully suspicious that messages that were sent on the fifth and 6th of january, right as the insurrections are happening, those messages were destroyed. honestly, katie, if you step back from what we know about this situation, what we know about the secret service, they were entering into a long planned migration. any erasure in their view was inadvertent. someone in the secret service should've had a good sense to pump the brakes. wait a second. we need to preserve everything for the last couple of days. this will be a crucial part of the records. the fact that that alone does not happen, i think it is suggestive of some lack of vision of the top of the organization. what we -- we don't know the truth here. congress's intent at getting to the truth. was there some form of inadvertent failure to save these messages? was there something more

hold meadows in criminal contempt for his noncompliance with subpoenas. what should we make a choice of this latest development. -- they declined to charge mark meadows with contempt. >> this is a perplexing situation. katie, you and i have discussed this. you know my feeling, the doj got the balance wrong here. they declined to enforce against meadows. likely, what they had in mind why they made this consideration, whether or not we agree with them, it is the difference in the burden of proof that they have in the civil case. they are seeking to enforce the subpoena. congress only has to establish that it is more likely than not they had a good thing. they had reasons for issuing the subpoena. in a criminal prosecution, the doj would bear the burden of proof of guilt beyond reasonable doubt. that is the only logical distinction here.
