political opponent. it raises two questions of historic con kwens. does this put us one step closer to criminal charges against president trump? and could he after hinting as recently as this past weekend going to run for reelection be barred from holding off ever again? these are questions not only facing him, but also his mote fervent supporters. we saw a bit of their anger when a small group of protesters gathered after the news broke. and republican senator tim scott of south carolina reminded us of this. >> certainly as the largest voice of republican or democrat will continue to be the more focus you put on him, the more likely supporters will rally around him. >> meanwhile on capitol hill, a furious reaction from some other big name republicans. right after the news broke, house minority leader kevin mccarthy threatened an investigation in writing against

attorney general merrick garland and the justice department. and just this morning, nbc news learned that more than a dozen members of the republican study committee are going to bed minister to have dinner with donald trump tonight. it had been planned for awhile, but takes on added significance given mccarthy's the threat. we don't know exactly who is invited, but committee members include solg some of the most aggressive defenders. marjorie taylor greene, paul gosar, bottom line, it's clear. 24 hours after the fbi first entered mar-a-lago the battle lines are being drawn with far-reaching consequences. the question now, what will this reveal about america's institutions and how well they survive what's coming next? we will also get very quickly to the heart of the republican party. how many will embrace their traditional law and order roots and how many others will continue to pledge loyalty to donald trump, whatever the cost.

so we have a lot to discuss. vaughn hilliard is at marla ga. ali vitali is on capitol hill. josh dots sit is reporter for "the washington post" and charlie sykes is editor at large. thank you for being here on such an important day. we don't know the details of the search warrant. it would have to be meticulous. a judge would have had to have sign off. but to a lot of these republicans, none of it seems to matter, does it? >> no, and that's why you don't hear republicans giving defense of actual allegations of trump team's understanding is that this is at least in part related to the potential material that was taken from the white house and brought here to mar-a-lago. then some of these materials would be classified documents. you don't hear these elected officials from ron desantis,

mike pence, ted cruz, lindsey graham, defending the actual substance of the matter here. instead, they are taking shots at the department of justice and the fbi. we heard last night steve bannon on fox news talking about when the republicans were to take back the house this next year. that jim jordan, that he should work to have funding cut off to the fbi here. that essentially this is all part of what we have heard over the past year that the idea that the deep state is out to undermine the republican party and undermine donald trump this this so-called america first movement. eric trump lafs last night was saying that this has led him to say publicly for the first time he wants his dad to run for president again. this has been a sewing of distress for years now. and when you see republicans, they are some of them are suggesting they want the

department of justice to come out and lay down the case in front of the american public as to what probable cause they had to ultimately go through with the search warrant. the same time, you have seen in lock step the republican party. it's not only political apparatus but leaders continue to stay behind the former president and potential 2024 nominee for the party. >> it seems like we're old enough to remember this there was a time not too long ago where in a situation like this, members of the party of a person under investigation would at least lay low, but maybe even run the other way. in this case, we're already seeing them run toward him. what does that tell you? >> well, exactly what vaughn just mentioned. donald trump has spent years trying to delegitimize these law enforcement agencies. the last 24 hours we got how deep his campaign has gone in the republican party. i mean, it's one thing for the

heart core me maga verse to react, but what you're seeing is across the board, elected republicans not giving the benefit of the doubt to the fbi. not observing the studied silence that you'd normally do when evidence is being gatherered, but attacking the fbi, undermining the fbi, feeding this anger out there. ask this is ironic, number one, for political party that claims to back the blue. it's also worth noting that donald trump's campaign in 2016 was largely built around that chant "lock her up." so this outrage about the weaponization of law enforcement does seem to be ironic. but there's no question about it that you are seeing the degree to which this party is prepared to rally around donald trump, no matter what the evidence is, no matter what crimes may be

committed. they basically are arguing that donald trump should, in fact, be above the law. and kevin mccarthy seems to have fully embraced the idea that he will threaten the department of justice and apparently in an attempt to intimidate the attorney general and will retaliate if it goes after donald trump, which is an extraordinary by in measure. >> we should note not everyone is jumping feet first to his defense. trump allies tweeted that suspicion is warranted, but he added some caveat like no one is above the law and time will tell. give us your sense on the hill as you have been talking with sources. i know folks have gone home for a little break, but how seriously are republicans taking this? what are you hearing from them? >> reporter: they have to take it seriously. whether or not they buy into the reason that the doj or the fbi did this search of mar-a-lago,

this is something that's happening and captured the attention of the entire country. it's certainly puts trump, again, at the forefront of the republican party and forces them to grapple with that image that charlie and vaughn were both just talking about. this idea they are the party of law and order, but with an asterisk for when it a applies to someone who is inconvenient for them. the loudest voice and the leader of their party, the former president. lindsey graham's tweet is instructive if we're looking at the different caveats for republicans here. because in the same tweet thread, he says that no one is above the law. but at the same time, this is problematic because we're close to an election, which by the way trump is not on the ballot in 2022 or get an active political candidate. though we have all talked about the idea that trump's eminent candidacy is in many ways tied to these legal threads because it's easier for him to explain away and politicize these different threads from doj and

now from the fbi that if he is an active political candidate. so that's one of the next things that we're looking for here. but on the hill, it tells the story too of what we see the republican majority, if they were to retake the house, what that would look like. we always knew that kevin mccarthy was likely going to be on the attack against democrats. but now in that tweet that vaughn laid out, the fact that he's telling the doj to preserve documents if we retake the house we're doing hearings, that's instructive. as much as democrats don't want this to be the referendum issue of the midterms, you saw from chuck schumer and nancy pelosi as they were being asked about this late last night, they didn't have much to offer or say. this kind of cuts the momentum that democrats had after the veterans pact after, after the chips bill and the reck subtleuation movement over the weekend. it cuts the momentum they felt they were building. but at the same time, this is also an instructive moment for voters. do you want a party that's only going to rally around and defend the former president or do you

want something else. it's a hit will litmus test. >> if you run for congress, you're used to revel in operating in a political spear. not if you're doj or fbi. you want to say, i'm having nothing to do with this and yet after we saw members of the republican party tweeting about this after we saw what kevin mccarthy wrote, there's actually a statement. they quoted this in your paper. so let me read it. the president of the fbi agents association brian o'hare issue ed a broad defense of the investigators who carry out court-approved searches without commenting specifically on the trump case. what is the tight rope that these agencies are walking now? they were in it a little bit, but when you go and have the fbi enter the home of a former president, it kicks it up to a whole new level. >> right. yesterday the news cycle was

dominated by what former trump and his supporters said. you had a blogger who broke the news on twitter. maybe seven minutes later, you had the former president put out a statement that characterized it his way and they have not said anything publicly since then. and there's a protocol of not talking about ongoing investigations. that's been changed at certain times. they talked about hillary clinton investigation. you remember the james comey press conference. they have talked about other investigations in the past. but the usual practice and protopsychological they do not publicly comment on what they are doing privately behind the scenes. you're seeing a lot of folks demand that they do. you're seeing the trump critic republicans demand they do another saying that they just will not be able to sustain themselves for them not to say anything. you also have folks say figure you start talking about ongoing

investigations, you open pandora's box. should the government be doing that? we have seen more details come out. we know more about what they wanted. it was about the classified documents he took down there. the agents were there for many hours. the former president was not there himself we know a little bit about this. none of this a is coming from official channels. you have merrick garland who is viewed as a cautious man who is going to be at the center of this struggle. you'll see republicans demand information. you'll see probably some democrats demand more information about what's going on. when you take such a step as going in the home of a former president and asking for all of these documents, in the eyes of many, you better have something good that you're looking for. you better have something important to take such a step like that. >> trump's former deputy white house chief of staff tweeted last night, do it-45!

. if there was any question about whether he was going to run again, does this vast escalation of legal pressure seal the deal, in it your mind? >> it's hard to know what's going on in donald trump's mind. but i would think it is certainly moving it toward that with one big caveat. that donald trump was taken by surprise. so he's got to be asking what are they looking for, what are they going to do, what charges might they face. having said that, i think you're seeing in the are republican reaction how difficult it will be for any other republican to run against donald trump or to take him on. because he relishes running as a martyr. he relishes running as a victim of the deep state. he would run a campaign of redemption who is going to be

more than 24 hours after the fbi showed up at mar-a-lago, we're only beginning to learn about what really happened there. we know from nbc's own reporting it's related to government files, potentially highly classified information taken from the white house to mar-a-lago. we know the search resulted in agents spending the majority of the day at the estate and leeing with several boxes. we don't know what was in those boxes, but if it was classified, taking them from the white house is illegal. and a potential to national security. we have a lot to discuss. jacqueline alamany is reporter for "the washington post." and tally weinstein is a former federal and state prosecutor in new york and an msnbc legal

analyst. you broke the story happening back in january. i thought about that when this first broke yesterday. i thought so why are they going back now. do we have a clue? >> it's a really good question. it's thee question what exacly the fbi was looking for when they executed their search warrant yesterday. we know initially in january at the end of january after extensive back and forth between the national archives and lawyers to former president trump that 15 boxes were eventually recovered. a combination of classified items and classified items that inventory is 100 pages long detailing the very things that were improperly taken to mar-a-lago and not archived inned a heernsz to the presidential records hah act.

we also know the separate inventory of classified items is a roughly three pages long, according to an estimate from a person familiar with this inventory. but after this process was handed over from the national archives to the fbi and there was a realization that there were classified items in the documents that were taken to mar-a-lago, a lot of questions remained about what else potentially might be missing from there. we're still trying to figure out what they were looking for, whether it was information that would have been under the presidential records act or whether it was classified information. but at the end of the day, even a very small item or a snippet or portion of a document, that is improperly stored could do some serious damage to national

security and to any potential military or covert operations that the federal government has been conducting. >> does the fact that the doj felt a search warrant was necessary that the time had come to do this? help us understand the motivation for the search, how far along the investigation might be, what does it tell you? >> i think it does give us some clues. when the national archives reached out to trump and said please submit the information that you can properly taken from the white house, they also asked trump to continue to look for other documents that may have been in his possession somewhat indicating that they were not sure he had actually given them everything he should have. and then the fact that the justice department has issued a search warrant is really interesting. often times as a subpoena will do the trick. the government reaches out to somebody and says please furnish all the information and documents. and they expect the person they have spoken to to respond with

some sort of speed and to comply. so the fact that they chose the search warrant route, meaning they had to show there was some evidence of possible criminal activity and also indicates they don't think somebody will comply. there's also will go before a judge allowing them to search the property tells us a lot about what they thought of trump and his willingness to furnish them with documents. >> so when jim jordan goes on tv last night and says, i demand to know what they were looking for at mar-a-lago. and why not talk to president trump and have him give the information you're after. the answer is they did. >> they did not feel he would be willing to give the information with a subpoena. i think if jim jordan wants to know what the fbi took and what they were look for, he can reach out to trufr's lawyers and find out for himself because when the federal government takes things,

when they execute a search warrant, they leave an inventory list saying what it is they took. >> to that same thread, in the last hour and a half, former vice president mike pence tweeted this. yesterday's action undermines public confidence in our system of justice and attorney general garland must give a full accounting to the american people as to why this action was taken and he must do so immediately. is that a fair request? >> it's not. it's really backwards. i worked on lots of search warrants. usually when people have federal agents come into their home to execute a warrant, that remains secret for a long time because you don't want to broft that to the world. the justice department is certainly not in the habit of talking about investigative steps they take. the only reason we know about this one is because mr. trump himself said that the warrant was executed, but that the

disclosure he made was really partial because he would have received an inventory of what they took. he would have received a copy of the warrant. usually there are attach thes that detail where they are allowed to look, what they are allowed to look for, what they are allowed to take. and almost nauls my experience the warrant that's left behind also at least delineates, it says the top charges. so all of that information right now is in the hands of mr. trump and mike pence could ask him to make that disclosure that he asked the justice department to make. >> the obvious stuff ha they seized is in the hands of doj. so help us to understand who are the people who are looking at this right now, how does this fit into the lrgeer investigation? what are they doing right now

with what they got yesterday? >> would guess there's ab enormous team at the fbi going through this material in consultation with and in partnership with prosecutors i'm assuming they took some electronic information as well. if they did, that takes time to go through. but think this is the important thing. there's been a lot of reporting about what is likely the investigation here. what are likely the charges that are being pursued here. they have to do with the mishandling, the concealment, possibly the destruction of classified or other government information that would be subject to various criminal statutes if he took it in an unauthorized way. when you execute a warrant and following the rules of the warrant and pick up other evidence of criminality that can feed into investigations for other crimes, that's fair game. and it is totally in the normal

course of things to look for that, to seize on it, and to expand other inquiries. i'm sure all the people going through the materials have that on their mind as well. >> so back to sort of this doj thread. because merrick garland, i think it was in may, issued a memo to his staff urging caution about the appearance of trying to effect an election by the timing of doj statements, investigations and charges. similar memos were put out by predecessors. it's nothing new. given that warning of caution and given everything that's out there and the pressure that's been on, what does it mean they decided to take this step so close to the the miterms and in the middle of what aren going primaries. >> we are in an unusual situation. donald trump is not the president. he's not even a politician. he's the not declared himself a candidate in a race. and yet he is the leader of the republican party.

he's still possibly the most possible politician. and as we have seen from the responses from republicans after the search warrant was executed, he has power over them. even the former vice president. so he's extremely important. the justice department going back several administrations has strict poicy about when to take the kind of investigative step like executing a search warrant that could inevitably become public. you don't want to do that before an election. and so the window within which the justice department could execute this search warrant and not interfere in an election is pretty slim. it's generally speaking up until labor day. so if we're going to see more action like this, there's only a couple more weeks during which we would see something as overt as this. >> thank you all very much. we appreciate it. loyal supporters of the former president are outraged

social media is flooded today with threatening poetss in the wake of the fbi searching mar-a-lago, and it raises real questions about what law enforcement could be facing. those threatening comments started pouring in within minutes of donald trump revealing the fbi was at his home. online supporters writing, "lock and load." when does the shooting start and they will cry out in authentic pain soon. ben colins tracks disinformation and extremism and says he hasn't seen comments like this since january 6th. as you can see, ben is here with us. also with us is the assistant director. >> they are ready to go.

the same people who organized this stuffer around january 6th, some of them are literally the people from january 6th. one of those comments you saw right there was a man who was -- >> can we put those comments up again? >> one of the comments that was posted last night, the second one there as you can see on the skbreen, that was posted by a guy who is awaiting sentencing for entering the capitol. >> he's already pled or been convicted. >> he's pled down, but this might complicate some things. >> you don't want to be his lawyer right now. >> he posted about how this was the civil war. he said, by the way, later on, i would say more, but i'm awaiting sentencing. so not particularly bright people, but these are people who are ready to fight. these are people who are ready to go is and have proven it in

the past. just a year and a half ago. they don't have their leader sending directions and giving specific dates and getting everybody riled up for one big day anymore. that's the big difference, but the -- >> but the level, but do you have the volume? in other words, did this serve as a cautionary tale for many of them or most of them january 6th and the fact that so many of them are convicted? >> there was a time three or four months after january 6th where these people calmed down and they realized that the feds were watching their spaces. but now they don't care. that's the difference. thousand they are ready to fight regardless if they are being watched by the fbi or not. >> if they don't care, what alarm bells go off for law enforcement when there are comments like this, especially given the experience of january 6th? >> one would hope so. one would hope the lesson has been learned from tail juries leading up to january 6. january 6th was not a failure of intelligence, but a failure to

act on available intelligence. and let's hope that people as talented as ben is are replicated throughout the fbi, the intelligence community. >> please tell me you think they are. >> i think they are tuned in. i don't know if they have the bandwidth, and they have already said they can't be everywhere at once. they can't see every posting and every private chat room. there are laws regarding that that actually allow me and ben to look at things like this, but not necessarily allow undercover activity in some of these private chat rooms before things get violent. so what concerns me the most is that this is now on steroids with regard to what we saw in the lead up to january 6th. by that i mean we still have donald trump at the helm. we still have fox news doing what they do. but throw in all of the members of congress, throw in 24/ news cycle, anger, i will give you one example. ben may have seen this, but one

thing circumstance litting around today is a comment from former nypd commissioner bernie carr risk, who told the daily mail that he expects an assassination. i wouldn't put it past the democrats to try to kill donald trump if the fbi raid, so-called raid does not result in criminal charges. so we have someone who used to be the commissioner of nypd saying i think they are going to try to kill trump. that's very dangerous. i would not be surprised if we see the department of homeland security issue some kind of bulletin that we are entering a heightened threat environment. >> so back when i was covering the obama white house, i did a lot of coverage of islamic extremism. the big problem with them is how to differentiate between the talkers and the people who actually might mobilize, who might to something like we saw on january 6th. is that still the biggest challenge, frank? >> yeah, look. there seems to be more and less

organization to this and by that i mean you got what nine oath keepers, five proud boys charged with sedition conspiracy. the message has been sent there. the leadership understands that they are constrained. but ben just gave you a fine example. somebody already charged and already speaking out. if you think 850 people charged is a lot, understand there are thousands upon thousands more that are out there waiting and what are they waiting for? they are waiting for the signal from a very desperate former president, who says it's time. and the more desperate and cornered he gets with all his various legal challenges, the more likely it is that he's going to give that call to arms, so to peek, and that we're going to see violence. no is just around the corner with regards to all of the potential challenges and chaos that could exist around the midterms.

in just a few hours, the islamic center of new mexico will hold a memorial to honor the four men killed in a recent string of attacks within their community. all four of them are mow muslim. police say the murders were targeted attacks, maybe the work of a serial killer. they have identified this volkswagen sedan that think believe was involved in the shootings. and now albuquerque crime stoppers was offering a $20,000 reward for information that may lead to an arrest and conviction. here with me now is in albuquerque. anything new from police from the victim's families? >> reporter: yesterday we reached out to the police to see where the investigation was, and they did tell us that they received new tips this after they shared the photo of the sedan they have been looking for. they have received tips from the

hispanic. there's a lot of people in the city who are hispanic. for someone to go down the street and kill my brother or other members of the muslim community, he thinks they know who they were. now this is the brother what he thinks about the investigation and where things could lead. there's a lot of questions with the community. we also spoke with the head of the islamic center here who told us that he's trying his best to make people feel safe. this is where they are organizing that me hoirl. this is part of the conversation that i had with them. >> it's broken. reflective a lot of the community that's disheartened. they feel a sense of helplessness. their whole world has been flipped upside down. their community is very deflated. and eagerly awaiting some response, some answer to why. >> reporter: it's really been the one helping the community here as the head of this islamic center. he also told me they are

that? >> i feel like there are a lot of things to be investigated besides trump in our government. and it doesn't seem to happen that way. >> reporter: you also heard her tell me later that that was not what she was thinking about when she was voting. she was thinking about the economy, very interested on abortion. that's the frustration you hear from republican voters as they go in. think about other issues, vote on other issues in this competitive primary race. >> we've only got a minute left. it is likely to mobilize the gop. but does it stop what seemed to be for the democrats having wind at their back? or does it mobilize them as well? we got to make sure that we protect democracy. >> oh, no, look. as bad as last year's august was for biden and the democrats, this year it has been a string of successes. and that doesn't change. a lot depends on the economy.
