this morning. welcome back to the fourth hour of "morning joe." it's 9:00 a.m. in theeast, 6:00 a.m. out west. elise jordan and jonathan lemire still with us. we have a lot to get to this hour, including more on that critical inflation report just released that shows consumer prices rose less than expected last month. >> yay, inflation only at 8.5%. wait a second that's sti a lot. it is lower tha expected. fuel prices droppg as quickly as they have probably helped. >> also we have the latest development on the justice department's investigation of donald trump, this as the 45th president will be questioned under oath today in the new york attorney general's civil investigation into his real estate dealings. >> release the warrant, mr.

president. if you care about transparency, release the warrant. you have it. let us see it. stop playing your followers as dupes. you know, doj needs to be as transparent as they can be while being fair to this possible criminal. we don't know yet, because in america we believe that no man is above the law, but we also believe you're iocent until proven guilty. but in thiscase, the department of justi needs to be fair to the former president, and they don't need to go out and talk all about this information. that's not what they do. it's likely sealed. so why doesn't donald trump just release the warrant and then we n see everything that's out

expected and a major sign that inflation is easing just a little bit. >> let'sring in cnbc's senior market correspondent. we're not going to be singing "happy days are here again," but it could be worse. we have gas prices going down. that obviously pulls that down a little bit. it's less than was expected. how can you say 8.5% inflation is good news? >> you can't, joe. you can't do it. that's the plain and simple truth. generally speaking if you talk about the headline numbers, 8. is the headline consumer pce number. that does imply this is a year over year number that you're seeing that prices are 8.5% higher than a year ago. if you strip out energy costs and food costs, which tend to be more volatile, many parts of the country are seeing energy prices fallnd even certain food

pric fall. if you take that out, that so-called core consumer price index, excluding food and energy, it's still up 5.9%. there's an old saying. the journey of a thousand miles gins with a single step. that's the rson economists are looking at this pticular piece of inflation. nobody has the guts yet to call a peak i inflation, because things have gotten so pervasively bad. could thise the sign that things are starting to slow down and that we could be trending lower? yet to be seen, but when you have inflation going nowhere on a month ove month basis, flat zero percent between june to july, could that be the beginning of what we're seeing here? a lot of that headline decline in terms of overall movement in inflation has to do with fl prices.

gas priced are down, so are costs for food oil. fuel is still up. the most importa things economists are keyin on is shelter costs, including rent and housing. that is sll up in july, up abou .5%. yes, the food and energy side of things i a little more optimistic we've seen real world evidence. i fill up multiple times a week at the pump and i am paying less for fuel. the issue is whether or t the fed can take its foot off the brakes a little bi here with the economy. i will say this, joe,mika, in the moments after this number came out, financial markets started to price in less of a likelihood of more aggressive fed interest rate hikes because it may show signs of at least peaking for now.

it remains to be seen whether this is a trend. by the way, il point out some of the stocks rallying the most in the premarket trade ahead of the opening bell are consumer oriented companies, retailers. because if inflation is less than expected, maybe people can spend more on things like travel and leisure, shopping. >> thank you so much. jonathan lemire, how is the white house responding? >> nothing public yet, joe. we can imagine they will focus on the good news and less on some of the more worrisome markings here. obviously fuel prices has been chief of mind for this white house for months. in fact, ron klain starts every day, i am told, by checking the price of an average gallon of gas in the country. that continues its downward slide. certainly there is some hope

that inflation here maybe has peaked, but no one's going to say that yet. even if it has stabilized, the number is still entirely too high. the white house believes it will be this summer and fall when things start to get better, but they recognize for the average american right now the cost of so many things in their lives is entirely too high. as much as democrats have been on a real winning streak, this president in particular, they are concerned prices will still be the top issue for many voters when they go to the polls this november. >> democrats on a big winning streak. red sox on a big losing streak. the one thing that doesn't cost too much, though, is the big lie. it's a great book. how crazy it just happe to be sitting right next toyou. congralations. >> i think you cld get one on

once again. >> joining us now nbc news justice and intelligence correspondent ken delanian. also with us democratic strategist and former senior advisor for the house oversight committee kurt bardella. officials have remained pretty silent on this investigation. is there a chance that changes? are you surprised so far on the silence? >> there's probably a greater chance it's going to snow this week in washington, d.c., mika. no, i'm not surprised at all. let me first explain about the warrant you guys were talking about. there's actually three parts to this warrant. the part that has the most information is the affidavit that the fbi filed with the judge to justify the search, explain all the potential criminality. that is sealed. that means donald trump and his lawyers do not have that. they have a one-page document that's essentially a warrant signed by a judge.

it doesn't really tell us much. they also have the inventory of everything that was seized. i agree they should release those documents. even if they do, it won't explain why this search happened. that is probably the first reason that the justice department is not in a position to talk about this right now. this is a secret investigation and there are a lot of implications here when we're talking about highly classified information and things donald trump may have taken from the white house and why he did that that maybe the justice department does not want donald trump and the people around him to know exactly where they are in the investigation. merrick garland, chris wray and the people around them are adamant they're going to follow the ironclad justice department policy, which is you don't comment on pending investigations no matter what, in part out of fairness to the people being investigated, in part because it's just a bad idea. the best example is what jim

comey did back in 2016, which at the time i remember thinking it's a reasonable thing he's doing. you have the investigation into the hillary clinton private e-mail server. they weren't going to charge her, so comey is going to get out and explain in public everything that went into it. that turned out to be a disaster. some people think it influenced the course of the election. merrick garland and chris wray are absolutely not going to go there. >> is there political risk here for democrats that they could overplay the raid in that if it's over classified documents and there's limited information the public gets to know, does this give trump an opportunity to paint himself as the martyr victim that he oh so loves to be in politics? and could it be something he turns to his advantage?

>> well, i think we've seen the tactics in the first couple days of this, that trump is goingo cast himself as thevictim. that what he always does. i' never seen someone who on on hand insists he's the toughest guy, while at the same time he'slways the victim. how is that even possible? republicans are going all i y again on a guy who's under federal investigation, who's under mtiple investigations, testifying before a grand jury toda on a separate issue and they don't know what law enforcement has. th one thing we've learned when it comes to donald trump over the years is there's always more. there's always a shoe to drop. are you really comfortab putting all your political eggs in donald trump's basket? it's going to be a something a year or two years from now another bk comes out and we hear privately republicans were cheering on this investigation, hoping this would be the thing

that would bring donald trump down, yet publicl they're lining up behind him. they've been given every opportunity to divor themselves from donald trump. we read in every book that that's what they want, yet they keep repeating the same mistakes ov and over again. it ends up wrecking them. any time a election is about donald trump, they lose, they go down they are doubling down on a strategy that has failed them time and again. >> you look at every election since he was elected. you look off your elections i 2017, county elections in the philly suburbs going back to 2017 midterms 2018, southern governors races in 2019,f course all the races in 2020, donald trump helps republicans se time and time again.

governor how they both talked about the 2020 election, because this could be a live issue in wisconsin going forward if a republican were to win the governor's race in november, republicans potentially through the legislature would have the means to change some election procedures, that sort of thing. kleefisch at one point called the 2020 election rigged, but she said there was nothing that could be done with it. michaels has simply said that all options would be on the table for him, but he hasn't leaned so hard into that kind of rhetoric. trump said that michaels is the one, in his view who could beat tony evers. he claims republicans would then seek to change the rules to allow t legislature in wisconsin to pick the slate of

electors in 2024. >> so big night for donald trump. mika and i, of course because of our connecticut es, we're looking at the connecticut race. a real shocker in the connectit republican primary as well. it shows against yet another republan candidate that the republican establishnts absolutely loved and had for a very long time -- this wasn't evenlose, but trump had some problems early on in this primary season, but man, we've gotten to a stage now where donald tmp endorses you in a republican primary, you're most likely going to win. talk about that. >> we're not expecting this to be a particularly competitive general election race in connecticut in november, but levy comes in here. at the last minute donald trump

weighs in with an endorsement in this race and all of a sudden levy wins with a 16-point margin in the republican primary. i'm not expecting this to be an election we're talking about in november. it's hard to say she wins without that trump endorsement. we showed you wisconsin a minute ago. the other piece of news donald trump picked up last night, this is in washington state. remember, it takes them about 16 1/2 years to count up the results in congressional races in washington state. we did finally get top two primary jamie butler, incumbent republican congresswoman, she's one of the ten who voted to impeach donald trump, she conceded last night to joe kent, a trump-backed republican who backs up trump's claims about the 2020 election.

we haven't technically called the race yet at nbc, but she's conceded it and basically set the stage for the trump-backed candidate versus the democrat in the general election. here are the ten republicans who voted to impeach donald trump after january 6th in 2021. here is their state in 2022. you see a lot of them simply chose not to run. you've got herrera butler going to lose the primary, tom rice got clobbered in his primary in south carolina. david valadao got through his primary in california. donald trump did not make an endorsement in that race. the next one is next tuesday in

wyoming, liz cheney, you've seen the polling, you know the expectations there. so there were ten in january 2021 republicans who said they believed donald trump's conduct was impeachable and they backed it up with their votes. lookin at this, there's a chance valadao could win. i think it's possible you get the next congress and only one of them is left. >> we've been talking for some time on this show and i know a lot of other people are looking at some of these candidates and view them to be every bit as extreme as i do. it seems that the republicans are putting up the candidates least likely to win a general election race against democrats. but then i think back to 1994, i could find you news articles in "roll call" and "the hill" where everybody said i was too

>> we've got to go, but really quickly, one more data point along these lines. i'm saying we've got to go because dan keeps saying, joe, we've got to go. there is one more important data point. we've had two special elections over the past month or so in territory that donald trump won comfortably. and yet the republicans underperforming the 2020 numbers, which again, it just may be anecdotal but i look at election results leading into big elections and here are two c examples of republicans doing worse than you would expect. >> it was in the first district of minnesota last night. the bottom line is this is a special election. the republicans are going to win this thing by somewhere around five points. donald trump in 2020 won the district by ten. in 2016 he won it by 15.

that's certainly off the trump margin. the republican spin on this is that trump himself overperforms in this territory, but this territory had been more democratic recently. the republican congressman who passed away to trigger this special election had won by just three points in 2020. so it's better than the former republic congressman did, but it is not in that territory that trump was winning this district by. >> steve kornacki, thank you very much for being in this morning. up next, speaking of the midter, new signs that the issue of abortn will have an outsized impact on the november elections. voters. among t changes, abortion now one of the top five issues for latinos for the first time ever. nbcews correspondent morgan ratford joi us with an exclusive early look at the latest numbers. >> good morning. this latest poll was commsioned by two latino advocacy groups. among more than 2,700 eligible latino voters, the top issues are,one, inflation, two, crime and, three, gun violence. one striking addition to this list is the issue of abortion. of course, this is following the supreme court decision to overturn roe v wade. 19% of latino voters now say abortion is among their top issues, up from just 3% in polling from two years ago. another big take-away from this polling is that 60% of latino voters now say the country is on the wrong track. that number is even higher in

some key swing states like flora, lik nevada. we ske to linooters to hear what they thought about these issue in particular. >> i'm defitely going to vote. biggest issue for me, i mean, i think it's insane that abortion is illegal now. >> housing is a big thing for me. i think it's absurd how expensive things are getting. i'm a teacher in boston. i can't even live in boston to teach. >> rent is also really high. mine goes up in two months. i'm really scared to figure out what that's going to be like. >> housing, rent, inflation, the economy. the poll shows just 59% of latino voters say they're completely certain they will, in fact, turn out to vote in the midterms, which is down slightly from previous years. it's a sign that both political parties still have a lot to do when it comes to engaging latinos on these particular issues, mika. >> going back to the issue of abortion, did the polling take a look at who is saying that and

how big this community might be responding to this supreme court decision? >> that's a great question. it's actually pretty fascinating. one of the questions they asked in this poll had this exact wording. quote, no matter what my personal beliefs about abortion, i think it is wrong to make abortion illegal and take that choice away from everyone else. 76% of latino voters agreed with that statement that it's wrong to make abortion illegal, no matter their personal beliefs. you'll find that 55% of republican latino voters agree with that. 76% of catholic latino voters agreed with that. if you're a candidate hoping to connect with latino voters on this ise, it's a reminder that this community is anything but simple even when it comes to a big controversial issue like abortion. >> that is a great point, morgan. i ha assumed, a lot of people have assumed that hispanic

voters are more conservative on issues, whether you're talking about abortion or other wedge issues, social issues. and perhaps they are, but this reflects what we've seen overall in abortion polling, tt even people who consider themselves toe pro-life are really shaken by this supreme court decision. when you go all the way down,s you did here, into the subset of catholic hispanic voters and you still have thr o of four catholic hispanic voters, that's really eye opening. >> right? that's independent of location. mexican voters in texas versus cuban voters in miami, but to your point when you look at that issue and how significantly it has changed and the fact that it cuts through en some of those stnghold communities you would
