congressman but really about the dangerous rhetoric coming from her colleagues. that and so much more. today in the culture corner, we need to talk about nfl quarterback, the cleveland browns, yes, deshaun watson. issuing an apology after months of the line allegations of sexual harassment and assault from dozens of women. okay? self preservation? i'm simone and i have something to say. unprecedented. a word that has been thrown around a lot in the past week. unprecedented fbi search of the former president's home of their unprecedented concerns that the former president took and mishandled top secret hat documents that could pose a security threat to the country. and potentially break laws

including the espionage act. your reaction on both sides this pouring after those classify government documents were found in donald trump's mar-a-lago resort. now, trump was saying the fbi took boxes of material that was, quote, attorney client privilege. and executive privilege, and is demanding they be returned. it's not immediately clear whether that is true. and the department of justice policy is not to discuss specifics of an investigation. trump says he's done nothing wrong and he has done many times before, he has done this. he takes himself as the victim of a witch hunt. here's the former white house official stephanie grisham. >> it was, i did nothing wrong. then it was the fbi planted it. now it's oh, they're declassified. now i guess he's asking them back. this is out of the trump playbook. they're throwing anything at the wall to see what sticks and they're trying to distract people from the truth, which is

search warrant from mar-a-lago. hiding, moving, or destroying classified material, destroying or falsifying evidence in an investigation, and gathering or transmitting national defense materials. to explain, that i brought in an expert, former federal prosecutor and msnbc legal analyst. cynthia, let me talk to you about that claim that he posted on his social media platform true social. the reality is, when agents took the boxes from former president trump's home, some were attorney client privilege, according to donald trump. we don't know the exact context of the boxes. donald trump knows where this in this boxes, but we don't know. talk to us about the fact that this is unlikely to be confirmed, donald trump knows, that what is he doing? >> he's just trying to delay, that's the game. to recognize when the department of justice comes, in

there is a clean and a dirty team. they come in, look through the documents first, and then they make sure that there are no attorney client privileged documents. and then they go to another team once it has been cleansed, so that there is no taint. it probably happened at some point was that a trump demands that a judge looks at, it would have to go through that process. that's why i'm glad he got it started, so it can get moving, all of those profits his can get moving in the background. before the midterms when he can't do anything until the midterms. everything has to be quiet before the midterms. >> is this a victimization ploy? >> that's all he ever does. there is so much that has to happen now, and i'm so pleased that he got this search warrant done before that 90-day period before the midterms, but because so many things have to happen in the background. you have to deal with privileges, the different classifications, what's there, it has been declassified?

probably nothing. how did those documents get there? who has touch the documents, who has seen the documents, who has shown the documents to somebody else? has anybody shown them to any non-american citizen? is there any compromise in their? why do we have that in there, there are 1 million questions. they all have to be answered very quietly, and discreetly by the department of justice without any buddy knowing it. >> i want to ask you some things about the warrant, but what is the next step in the process? the clean teams have to go -- >> the dirty team goes to first, then to the clean team. this is the beginning of the investigation. if there are nuclear secrets in those boxes, how did they get there? they have surveillance footage, we know they have that have about 60 days of surveillance. it's not clear in the media

what's 60 days it is. and supposedly, according to reports, they were moving boxes in and out, who is moving the boxes? why are they moving them out? it's not just what's in them, it's what's happened to the information, which is critical to the national security of the country. that's what's happening right now. >> the new york times is reporting that at least one lawyer for former president trump signed a written statement in june saying that all of the material mark that classified had been returned. that's true, but can you get any dom or? we know that the fbi found classified documents at mar-a-lago. >> you have an obligation to tell the truth as often as possible. what lawyer would sign? no good lawyer would sign. i think that's ridiculous. donald trump has lied so many times, and the fact that he tells you there is nothing in there, you should never sign that.

you should say, have trump sign it. >> all, right breaking it down, thank you very much. i have said it once and i will say it again. the threat to democracy is ongoing, and a group of historians agree. the washington post reported that historians privately warned president biden that america's doc democracy is teetering. want to bring in one of those is drawings who is in that meeting, sean willis, he's an author and contributor for the new york review of books. shawn, we have been going to get to that white house meeting in a moment, but first, i think that we need some historical perspective on what we are seeing with former president trump. is there any precedent for how the country should deal with the former president having top secret documents in his home? >> first of all, it's a delight to be here. no! the answer is no. wet other former president has taken the fifth amendment 470 times?

everything about the presidency in the post presidency has been extraordinary. the answer is no. >> and is, it's extraordinary. at the start of the, show we talked about the term unprecedented, and this is all absolutely unprecedented. something that i have heard described it is unprecedented is the particular threat to our democracy and you are one of the historians in that august 4th meeting with president biden. the washington post says that you all compared the threat facing america right now to what was going on before the civil war and the pro fascist movements before world war ii. okay, that's a lot. >> this is a big deal, and there are these three moments. the civil war -- whet holds them all in common is that it is not just a threat for to american democracy from within, but in global crisis.

in the 1850s, the democracy was in a retreat, a lot of revolutions, all the rest of it. it's a global crisis, it's a global crisis in the 1930s admits the economic collapse, the rise of fascism, and marxism in europe. we have a global crisis today. that's number one. that's what makes this part so extraordinary. but secondly, it really comes down to a matter of the jada messy. what is happening now, and this goes to the fbi stuff, and all of the rest of in. what trump has done is call into question legitimacy of basic american democratic institutions. the things that we all have relied on. elections, starting with elections. but now, he lied to federal law enforcement. the very institutions that we count upon as americans, that are part of our -- drone out of our constitution, all of the rest of it. he is now calling that it's a question. he's saying that the government is illegitimate.

it is a regime rather than the american government. this is coming treacherously close to revolution in my view. >> sean, does this top your list of concerns? is that what you all told the president? >> i can't get into details about what we told him and what we didn't. but speaking for myself, it's very worrisome. not just the stuff that is going on around donald trump, but in the republican party. the ways in which the machinations to try and make sure that the vote will be counted in a particular way. giving state legislators, for example, the possible power to negate the outcome of the vote in various states. this is very dangerous. and it presses on a permanent tyranny of the minority, and all of these things are going on at the same time. >> give us some hope. can you think of a time in history where our country, or

another democracy that peacefully pulled itself out of a situation such as this one? >> peacefully, not always. but out of it, yes. we did not get through the civil war, it caused terrible destruction, but nevertheless, it was settled. in that case, the right side one. we got through the 1930s, and we survived. the thing that makes me most concerned today is that there is no internet in 1861, and there was no social media in the 18, 1930s. we are in a situation where, back then, we could argue about things, but we would all agree about facts. we can't agree about facts now, and that is what is of most concern to me. and where i, as a historian, i don't have a crystal ball, i look to the past. but that makes the passed a much less clear indication of what might be to come. in the end, it will be up to the voters.

be splitting over the response to the fbi search of mar-a-lago. on one hand, you have some trump allies telling republicans to tone down their aggressive criticism of the justice department. according to new york times, because it is possible more damaging information related to the search will become public. on the other hand, it has infuriated many former president supporters. even among elected officials. republican congress members have called to defund and even abolish the fbi as the bureau's offices face violence and intimidation. joining me now to discuss all this and more is democratic

congresswoman barbara lee of california. welcome back to the show, congresswoman. how concerned are you about the rhetoric being used by your republican colleagues, specifically surrounding fbi? and doesn't match what they're saying in private? >> simone, thank you again for having me on your show. i just have to tell you, i love your show, because you do a deep dive on so many issues and are educating the public in a great way. thank you. first of all, the hypocrisy is very clear. i always have to say when a black man gets killed by law enforcement, the majority of republicans believe any justification, any, without even due process, so, i mean they just -- it's the right thing to do. when donald trump is accused of an alleged crime they come up and say defund the fbi and so the hypocrisy is glaring and it is shocking to me that they would believe that this man is

of the law. no one is above the law, and i look at the layout it would be presented amid minutes -- representing the laws around classified documents. we have to comply with the law. claude you have to face the consequences. evidently, the republicans who believe that donald trump shouldn't have to pay the consequences or be accountable, really, question there in the understanding of democracy and rule of law. i guess they just don't care. >> i think what's senator amy klobuchar said this morning bears repeating. donald trump is not the king. law is king. there are so many facets of this conversation. about this right-wing rhetoric and the real world consequences. i'm just struck by the fact that the fbi and the department of homeland security, they have reported that there's been a spike in threats to law

enforcement after this search, and i think it is undeniable that rhetoric has consequences, but do you think that some of your colleagues le pen insist on escalating this type of language understand that? do you think they believe it's all social media and it's not them? >> i think they understand it, but i don't think they care. hate speech leads to hate violence. we know that the number one national security threat is domestic terrorism which is fueled by white supremacy. do they care? do they know their behavior? it tells me they really don't care. that's the danger of this. when you have people who are elected to public office and really just go away with the rule of law and create an environment where they want people to believe these lies, that just opens up the box in terms of the rule of law and not being ever adhered to. it's almost like anarchy.

so it's a very dangerous moment, simone. we have to continue talking about it. we have to really recognize that domestic terrorism fueled by white supremacy is with the highest national security threat is. we have to be very careful. and jim just department continue these investigations so they could bring to justice those who perpetrated not only january 6th during that violent attempted coup, but also what has been happening in our country for many many years. >> yes, this is not new. i've been saying, congresswoman, that there were two big stories this week and other big stories this week was the passage of the inflation reduction act. i want to talk about that with you know. it's on its way to president biden's desk. you and 219 of your colleagues wrote in favor of it. it is something that is in this bill that you think is not being discussed enough? >> well, i'll tell you, this was a major victory.

it was a major struggle to get to this point. we have such a narrow margin in both the house and senate, but i tell you, one thing in the bill that i hope people understand is that senior citizens now will have all have a 2000 dollar limit on prescription drugs. many of our seniors pay thousands and thousands and thousands of dollars for their prescription drugs. hopefully, the $35 -- on insulin drugs, it's hopefully people understand this is a big deal. our seniors spend a lot of money on these lifesaving drugs, but we have to continue to fight for those who don't have medicare. those who have private insurance. and those who don't have insurance at all. big -- their lives are just as important as any with insurance or medicare. but also, i think we also need to recognize is it does reduce

inflation. 40% of inflation is fueled by fossil fuels. what we are doing now is moving forward quickly, but i'll say not quick enough for some of us, but quickly, toward a green economy, creating good paying jobs. i hope that our communities know that these jobs, wind, solar and all energy fish and jobs that are going to search -- emerge out of this with our small minority will be a real plus in terms of not only our climate, but getting our climate under control, and beating climate change in a way it has to happen. the planet is burning. we have to make sure that our community invests and gets benefits from those resources in terms of economic activity that's going to emerge from this. >> it is a huge deal. congresswoman barbara lee, thank you very much.

twitchy. our leader this morning, the biden administration said a covid surge could lead to 100 million curse cases. the cdc is not using guidelines, even eliminating quarantines for unvaccinated people who have been exposed to the virus. what is your take on this move and i'm concerned? >> simone, thank you so much for having me on today. it feels like we are in the twilight zone because what is happening currently in u.s. in terms of the 700 -- we only have a fraction of people who are boosted with two boosters. they're still inequities and stir terms of access to paxlovid, anti virus as well. as well as even getting vaccines. then we have this lifting of these guidelines are essentially, no one needs to be quarantined unless you're in a

very high risk setting like a nursing home. asymptomatic people don't need to be tested, but we also know that covid spreads, when people are asymptomatic, people can transmit. it's a we're having this contradictory messaging, which is really concerning to me. especially as we head into the polls -- cold weather. we don't have very specific vaccines which we know will help as we enter the winter, and my question to the cdc is, what is going on? their guidelines, relaxation does not support our reality right now. they need to explain to the public what is the motivation and i think the motivation is economic. it isn't business interest to pull back a lot of these guidelines because the concern is over these destructions to society but covid always disrupts society. >> my former colleagues at the white house, i think there are many conversations happening

this weekend about these guidelines and what folks will be saying this week. we will be watching that for sure. let's talk about monkeypox no. we know that the united states vaccine supplies inadequate, i think you and i discussed that a couple of weeks ago, and we know the fda commissioner is saying that the government is not considering the use of a smaller dose. should we be concerned that that would reduce the effectiveness of the monkeypox vaccine? >> so, symon, that's a really good question. people should know that the fda did make this decision on dosing, so giving a fifth of the dose that is -- into the skin layer. intradermally. this decision was based on one study. and so, that leaves us with the question about whether or not it's still going to be effective. that data is saying we're going

to give people a fifth of a dose and give it to them intradermally, but keep note that people who are immunosuppressed or people with hiv, it will definitely need two of those doses, and the other thing is that health care providers will need to learn how to administer the interim room technique, because that is not a technique often used. people usually are given a bbb, but a lot of providers on how to use. and i would recommend that the biden administration keep data. make sure they're surveilling what happens to people when they are getting these fractional doses. to make sure it's safe and effective. >> lastly, doctor, polio, we've seen the first u.s. case of polio since 2013. the new york state department of health is now recommending a onetime booster for polio. people were traveling to the area, even if they were vaccinated as children. how concerned should we be? >> i definitely think that we

broad. doug hyde, a former communications director for the republican national committee. y'all, i'm sorry. >> great way to start it. >> there are no reports of armed trump supporters protesting outside of the fbi office in addition with violent threats being made against the judge and agents connected to the case at mar-a-lago. it seems like people in our country have learned zero lessons since january 6th? >> my biggest concern with all things trump is that somebody was going to get hurt. the quaint pre january six days, that -- targeted journalist. maybe there be some kind of violence at an event. now what we're seeing right now. where people are very fearful for their lives and we've already seen what has happened with violence in this country. from gabby giffords to steve colleagues in the -- two would culminated in january 6th, but the problem is not a combination. it's a real concern that there will be more. the problem is for my republican brethren who want to

look for reasons to support trump on everything, operating out of fear, is there's going to be a very real event if republicans take over where they have the conference meetings. kevin mccarthy or somebody is going to have to say, look to your right, look to your left. the democrats are going to have to do the same. that's how palpable and real this is now. >> despite the rhetoric, we know from the new york times reporting there's a divide in the republican party when it comes to how to talk about this. they say that trump advisers and i'll telling republicans to watch out, because they do not know what is coming next. which might that even mean? >> they don't know what's coming next, because the reality is a lot of us are just -- as we are uncovering with the search warrant was for we are even seeing donald trump walking back on his rhetoric, and so therefore all these fox news conservatives and pundits and people who are blindly going with donald trump are having to watch their words because they're actually

uncovering some pretty problematic things that we are seeing. here's the thing that i'm really concerned about. all this rhetoric is, what we are seeing on the january 6th hearings that have inflamed insurrection. now we have all these historians talking about this rhetoric is very much like the pre-civil war rhetoric. so republicans have to be really concerned with what are they going to be a part of, this area that we saw like those protesters actually start to be emboldened and do something worse than january 6th, or are they going to -- i know are going to get to this -- sacrificed or comfortable position of power and stand up for democracy, which might mean that some of them looser of their powers and seats. >> doug, which say you? >> the supreme court is still surrounded by fencing and capitalists, for months and months. this is real. i spoke to or texted with one of members of congress who visited donald trump the next day and i said, be really careful here. here's the problem with all things trump politically. you start by defending him. this is unfair, whatever that this is.

and the next day or two days later, you find out, it's worse than we thought. that's already happened. it may will happen again. if you put yourself politically so far out there that all of a sudden you have no other place to go. you've walked too far. trump benefits every step of that way. >> let's talk about the midterms here. we know that this week president biden is set to sign the inflation reduction act, and it's a big deal, and everybody is wondering how is going to play into the midterms. there are midterm elections and primaries happening on tuesdays and wyoming. jonathan allen is with us. i want to bring him in with us. he's a senior national politics reporter for nbc news. he's on the ground in jackson, wyoming. he's talking to voters there. john, i want to chat with you about congresswoman liz cheney and the fight for her political life. we have a new university of wyoming polls that have her trailing or polling by nearly 30 points at the tuesday's primary. despite this, she is embracing her role as the top republican

and a republican party that is arguing essentially against a four dismantling. we've seen it playing out on the ground in my wyoming where donald trump got his biggest margin in 2020. >> it does look lag most of the house republicans who voted to impeach former president trump that they're not losing their primaries or they have decided to leave congress altogether. what do you think cheney's expected loss for example could mean for the future of the republican party, john? >> you know, i think if there's an important moment here in terms of what liz cheney does with the fundraising and she's done. she's raced somewhere around $15 million for this race over the last -- republicans and democrats who support what she is saying. but that is not something that's going to be viable in wyoming in the near future. however, we might see list cheney use that as a springboard in the future to run some sort of other

organization. or with some voters here are saying they hope is that liz cheney runs for president. either as a republican or independent. >> john allen for us in jackson, wyoming. alencia, doug, you just heard john. that's with the voters are saying. that's with some of our reporters are saying. why do we think the ansari that liz cheney actually does run for president in 2024? >> i don't know specifically which will do, but i tell you when you talk to her stuff, i've never talked to a congressional, political campaign, senate campaign or a presidential that is so at peace with itself and the decisions they've made. regardless of what happens tuesday, and liz cheney wants to win, no doubt about that. >> she is actively said that. >> she's working. but they are so at peace with the decisions they've made, their will move forward one way or another. jonathan pointed out really well, it could be a super pac, independent race, it could be a republican presidential race. it's a small window, perhaps, but she's going to do something we are not going to stop hearing about her come tuesday night. >> alencia? >> liz cheney is a conservative's conservative.

after allegations of sexual harassment and assault from multiple women, cleaved -- cleveland browns quarterback deshaun watson issued an apology posted by his team an aired on local television. watson's old team the houston texans settled lawsuits with 30 women who had alleged sexual misconduct by watson. take a listen. >> i want to say that i'm truly sorry to all the woman that i put in the situation. by the decisions that i made in my life that put me in this position. i would definitely like to have it back, but i want to continue to move forward, grow, learn, show that i am that you person of character and i'm going to keep pushing for. >> nikki. watson does not even say when he's apologizing for. does this video cut it? >> it does not. he has had 19 months to have a pr session to get a good apology out, there's plenty of
