party. i'll tell you what it says, election deniers and conspiracy theorists, it's clearly their party now. tonight rudy giuliani under oath in atlanta as his legal situation looks increasingly precarious. reportedly donald trump is having trouble finding top-notch legal assistance. governor desantis suspended him for speaking his mind about abortion. now warren is fighting back, filing a lawsuit against desantis. we begin "the reid out" with the downfall of liz cheney. she was defeated by her former ally and friend harriet hageman. >> wyoming has drawn a line in the sand that if we put you in

[ cheers and applause ] >> okay. so when liz cheney, the daughter of the two-term republican vice president dick cheney last run in 2020, she won by a resounding 73%. her loss yesterday was a stinging rebuke for cheney, whose family has deep roots in the state. what's more jarring is what her loss represents, the affirmation that donald trump remainsle alpha and omega of the modern republican party. a few short years ago he was a rising start, becoming warm-up mccarthy's chief deputies. she was so popular she was urged to run for senate by, guess who, the woman who defeated her last night. last year, mccarthy standing

shoulder to shoulder with cheney, waxed poetic. >> this republican party is a very big tent. everyone is invited in. >> apparently not. mccarthy flew earlier this week to campaign against cheney. he then went on national television and with a straight face had the temerity to attack her? >> i think her whole focus has been against one individual, instead of focusing on her district itself. >> cheney is one of ten house republicans who voted to impeach trump. she joins three other republicans who lost their primaries after they were very longfully targeted by the former president. peter mare told "new york times," i can tell you the number of times that somebody said, you don't have to believe the election is stolen. the important thing isn't believing it. it's saying it. that is what a republican is

many cases, the most extreme versions of that. that's what make happened to liz cheney so epic. she not only lost yesterday. she lost by nearly 40 points. it was actually worse than it looks, because she clearly got a number of democratic voters who crossed over. so among republicans, this was even -- it was even uglier. so, as a never-trumper, i think there's no other -- there's no other thing to say other than, you know trump resisters in the republican party have been beaten. they was been routed. they have been pummelled, and you're seeing that. otherwise, liz cheney would have done better. so the question is, you know, what does she do now? i think that will be an interesting story. the idea that somehow the republican party can be recent reblgted from this, or has some rational core, you know, some

quiet core that is still resisting of donald trump, no, i mean, it has become a full-on, totalitarian, authoritarian cult of personality, and i think that will become more dramatically apparent in the next two years. >> i wonder if this will encourage more republicans who maybe have not spoken affirmative of donald trump, but have stayed quiet. you have candidates running across the country. not everyone has said they're a pro-trump republican, but seeing the writing on the wall, i wonder if they will sink deeper into it. what's your -- the. >> the quote you have from peter mire, you don't have to believe it, you just have to say the words, but also, i think, it will drive more republicans, normal republicans, college educated republicans out of the party. any of them -- there are still

republicans who i think have held out some hope that there was a spark of rationality, and that's gone. so many of them are going to leave, they're going to become independents, vote for democrats or just simply drop out of politics. >> that's where i want to bring you in, cristobal. i was frustrated in 2016, when you heard so many democrats saying i can win the trump voters, the swing voters. you want to look at the base of the party, and think how disrespected that must have made them feel. i wonder where the politically homeless folks will go. most of these folks were not anti-trump policy. they were anti-trump the tweeter. they were anti-trump. like liz cheney, she voted with him a majority of the time. what do you think about that when it comes to democrats?

>> i think your analysis is right. what we saw last night in wyoming is a conservative leader in cheney, who is principled, and finally stood up to impeach the president, who was directly responsible for the insurrection. she paid for it. she lost her race. she put her country over her party. that's very rare among republicans. obviously i don't agree with her politics. she stood up to trump, and she lost. what that tells us about the republican party is it's turning into an ultra--naga party, this whom who beat cheney believes that joe biden is a human trafficker. these are some wild people, crazy stuff. this is the remain caucus of the republican party, right? and they're extreme when it comes to abortion, extreme when it comes to voting rights. you've got the split-screen moment. what you're seeing is this

infighting on the one hand, but then if you look at the democratic party, they are getting into a -- they are passing meaningful legislation, major wins. just yesterday the president signed the inflation reduction act. this is the largest climb change legislation in world history. it's one win after the other i'm here in pittsburgh for the start of the conference, which is the big conference that brings together activists, you feel a sea change, momentum building, whereas on the republican side, you've got this infighting, they don't know where the future of the party is going, and you have trump lurking in the background. >> yeah, i think the baffling thing about all of this for me, charlie is watching this play out in real time. i want to revisit kevin mccarthy when he -- soon after the january 6th riot happened. he engaged in a back-and-forth

claim, and called it the department of jihad instead of justice. she did align herself with trump, so i do wonder if she bearing some responsibility. when we look ahead to her future plans, what would she say to democrats who remember, who have the receipts for who she was pre-trump? >> well, i mean, she's going to have to explain it and talk about that, as many of us do. but the fact is when it came down to this moment where democracy was at risk, she was heroic. she understood it was an existential threat. you saw the contrast with her and mccarthy. she was willing to say the truth, when mccarthy chose the lie, because that's how he would keep power. the willingness to speak truth is heroic, and because you are willing to give up power, you are willing to give up the

prestige, willing to be alienated from your friends, your constituents, your donors, your allies, she paid a tremendous price about that. i'm really glad you're playing some of these sound bites from the ted cruzes and lind did i grahams. they all know. they know what donald trump has done. they know the threat he poses to the country, but when will it came right down to it, when they had to choose between power and their party and the country, they threw the country under the bus. liz cheney was unwilling to do that. well, i take your point. i think a lot of people agree with you. i would say folks like liz cheney and others are losing their donors and their positions. there are republican policies that caused people to lose their lives. twitter always agrees with you, charlie, whenever we have this

all eyes westbound are are are are are are were on the fulton county courthouse do. his attorney declined to say whether donald trump's personal lawyer invoked the right to not incriminate himself. he was informed he was a target in the investigation, being the closest person to trump to reach that status. we don't know what he was saying. grand juries, of course, are closed, but he's been speaking this week to friendly media. >> i was his lawyer of report in that case. the statements i made are either attorney-client privileged,

because they were between me and him, or they were being made on his behalf in order to defend him. >> joining me now is samara hall oran, with "the atlanta -- we're happy to have you both here. i want your legal perspective here. can giuliani actually invoke privilege here? is that even allowed? >> it is a lowed for certain kinds of communication. ordinarily what you say about a client is privilege, and you can invoke the privilege. the big exception is here, is that does not cover criminal behavior by the attorney himself. a client comes in and says, i just stole a car. you are allowed to talk about how you're going to defend him. you cannot say here's how to

hotwire a car. that's not privileged or confidential. >> do you think he's willing to go to jail to protect trump? >> he wouldn't be the first. there are a lot of people who are prepared to take the risk in order to defend him. i would imagine, before it comes to that, that he would invoke the fifth amendment, which is a different privilege. he does have the right to not incriminate himself. bob costello said it was cordial. that doesn't sound like the fifth amendment. nobody knows what went on, pend the grand jurors, the prosecutors and mr. giuliani himself. >> samara, i want to shift a bit on lindsey graham. something i find very interesting. i grew up in atlanta. fulton county is one of the most reliably democratic counties in the entire nation. it's also a county that's a majority of people of color.

is there in irony in the fact that lindsey graham tried to have black votes thrown out, basically, and now faces the consequence of his actions by grand jurors that likely look like some of the people whose votes he was trying to get thrown out? how careless of a sit do you think lindsey graham in down there? >> a lot of where we've seen senator graham has been in federal court. just this week a federal district court judge him told him she would not be quashing his subpoena. he's asking for a pause in that so he can appeal had ruling up to the conservative eleventh circuit court of appeals. his lawyers are insisting he was told he was not a target of this investigation, he was merely being, you know, being asked to give testimony as as a witness to all of this. so far judges have not been

willing to kill subpoenas for anyone, including members of congress, members of the legislature, and now our own governor has been moving to quash his subpoena as well. so far judges are saying, no, you have to go before the grand jury. there may be guardrails of what may or may not be asked, but they still have had to go in and testify. >> i want to stick with that. you have new reporting out today around the situation of governor kemp trying to get out. but brian kemp was not necessarily trump's favorite. trump endorsed his opponent, and brian kemp remains blindly loyal as they're known to do in the maga cult. why do you think he's so resistant to testify? >> it seems like there's been a real communication breakdown between the governor's office and the fulton d.a.'s i've about the types of questions that could be asked, the

circumstances, what is under oath, what's on the record, what is and is not allowed to be asked. remember, the governor is up for reelection this year. he faces stacey abrams of their rematch from 2018, and certainly there are political points to be scored. he's arguing that the fulton d.a. is playing politics. i'm sure she will be arguing the same in her response to the governor as well. this is a moment where you see many republicans here in georgia who are arguing this investigation is a partisan witch hundred dollars and they're trying to use it on the campaign trail. >> i would article that brian kemp has engaged in voter suppression for decades, with so many incidents i can recount. brian, take a listen. in this ballots we're seeing happen between trump and the legal system, there's also sometimes battles between he and

prosecutors, if this thing reaches to the water's edge, he does have evidence he's willing to provide. >> just hearing you talk about that, frederick, it feels like this is language used to describe a crime syndicate, "the sopranos" not a political sim or organization. one last thing i want to play, this is from ken friedman, describing giuliani as nervous. take a listen. >> he knows he concocted this false election scheme. we all know. it's clear. rudy flew too close to the sun. he got too close to trump. he got burned. at this point in life, his goal is to die a free man. >> tamar, how do you think the people of the grand jury, if they're allowed to see that, or if they've seen that, how might

they receive that and respond when hearing his testimony? >> i have no idea. this grand jury has been pretty leakproof at this point. we don't know who these folks are. joe biden won the county with something like 72% of the vote. as i've spoken to some witnesses who have come to testify before the grand jury, including the secretary of state's office, they mentioned they've had grand jurors ask them if this was widespread fraud. i'm not going to pretend to know what's in their head, but you mentioned compares this to a crime syndicate, and something that the fulton county d.a. has mentioned repeatedly, she's looking at racketeering charges potentially for this case. of course, giuliani helped pioneer that in the '80s and '90s in new york. >> well, thank you so much, tam

a hearing tomorrow in florida could determine if we see another key document about the search in mar-a-lago. there will be argument whether to unseal the affidavit. now, the former president says he wants the document released, quote, immediately, while the justice department actually opposes the move. they cite an ongoing investigation, and argue that it contains highly sensitive information about what witnesses and other information required by law to be kept under seal. as the former president's legal problems grow, "the washington post" reports that trump and his aides have spent the eight days rushing to assemble a team of defense lawyers, but the answer so far is, no. david henderson is a civil rights attorney and barbara la

wade, a professor at the university of michigan school of law. barb, i want to start with you. though everything needs to be true, there's not exactly exculpatory information. why would trump want this unsealed? do you think this is his way of figuring out who the informants are? again, it feels like thinks a crime syndicate, not a former president. >> you're absolutely right, tiffany. i think part of it is his public relations bid. he wants to frame himself as somehow broadband a victim, targeted, being treated unfairly, so this is something he can argue about, but i think there's zero% chance the judge will release it as the justice department said it would compromise the identify of

witnesses, so i think there's no chance. imagine not what trump, bus hi followers might do to a witness who gets outed by this affidavit. we saw the attack on the cincinnati fbi field office last week. you can imagine what may happen to the person identified in the -- >> we saw that last week on friday. this week on monday we saw the social media doxing an fbi agent, where his child taints schooled and his wife. very good point. david, why do you think this has become a political flash point? i feel like those who are paid to consume the minute newtia, i think people outside the beltway probably want to know what the consequence of this president's actions. >> tiffany, i think the reason it's become a flash point is

because of the other cases that normally force us into these discussions. we're used to sealing processes where prosecutors are doing things behind closed doors, and often it's to protect add actors. we saw that in brie breonna taylor's case. what this is is the scene from every detective show, where they go to a judge's house, and they say we need to kick in someone's door, judge, this is why. and then all that information in real life, you write it down. the other side, the defendants, never get to know about it. if trump knows you're coming to mar-a-lago to pick up boxes, the boxes probably won't be there. if trump finds out who the witnesses are, he'll probably seek pressure to not talk direct already oy indirectly from those people. so it's good to not know what the doj is up to until they make

the next move. >> barbara, i want you to listen to trump's lawyer. >> the president's position is the same as i would advise him, ask them to uncover everything, so we can see what going on. i understand the witness protection issue, but at the same time these witnesses are truly not going to be concealed for very longs. that is just not the nature of the doj and the fbi. >> so this kind of -- it runs contrary to what you said. here's the thing about all of this -- trump has raked in millions off of this search. he's fund-raising off of this search. you have to wonder when so many people are watching a propaganda network, these are hard-working people i man who is flooding his coffers on a lie. your thoughts on what the lawyer said and the fact he's making

money off of this? >> well, the best defense is always a good offense. when he can portray himself as a victim, that's what he does. now he can pretend to be outraged about not seeing the affidavit, which never gets turned over at this stage. charges have not been filed. typically it gets unsealed shortly after charges are filed and the defendant is arraigned in discovery. that's when they can challenge it in court if they want to do that. this point, that it's going to be known anyway at some point, we might as well know now, is not a good point. at the time it's turned over, if there's a witness protection issue, it might not be until after the witness testifies at trial. that's the point at which the defendant gets to see all the prior statements. if there's a witness safety issue, it doesn't come out until the testimony.

that's to avoid the witness tampering that they just talked about. former vice president mike pence flirted with the idea of going before the january 6th committee. take a listen. >> if there was an invitation to participate, i would consider it. there was never any formal invitation rendered to us, we would give it due consideration. >> mike pence has tweeted out criticism of this fbi search, sand donald trump really stood aside while people were saying "hang mike pence." the fact he's giving considering, but still somewhat defending the president, and still falling in line with the extremist right-wing republican/gop party that we have now is baisming to -- behalfle -- baffling to me.

>> the longer something goes on, the more pressure builds, and the january 6th proceedings have done a remarkable job of putting pressure on people to do the right thing. if you look back at a lot of that testimony, i think pence comes out looking like a bigger hero than he actually is. i'm a trial lawyer, so it's in my nature to think how things really went down. they went to him and say, hey, we just won the election. he didn't say no. he said it's hard for me to imagine that's legal, let me have the guy check it out, and ultimately he comes around to eventually doing the right thing, which is what i think we're seeing him flirt here, but again, the pressure is mounting. he has to think through what do i look when my kids or grandkids are reading about this in a textbook one day. >> too late for that.

florida, the fifth amendment and florida's constitution have meaning, and election do have meaning. i think it's cast a dark shadow across the rest of the country. you're seeing folks -- trump the successor apparent to donald trump. -- firing someone, because he doesn't like them, essentially. the polling in florida shows that ron desantis's improvable approval rating is at 50%. that may seem low. it's a lot of people who likened support this man. what do you anticipate happening in this lawsuit, given this support that ron desantis has? >> we anticipate winning. the governor exists in a political world now. so, whether he is running for president or trying to out-trump trump, or both, the fact is, that fact's still
