all right, that is cross connection for today. thank you for watching at home. i will be back, not next week, jason is going to be filling in for me. stay tuned because the amazing alex witt has the latest. hello alex. >> what? okay fine, we will get over it, we will hang on for two weeks. can just say, listening to that whole kanye documentary thing, he is so polarizing but his genius cannot be ignored. i her goal digger to this day, i embarrass my children with the way i move, i'm singing. it is a great song.

best part though, listening to the ports by his mom. it completely makes you understand some things and the compassion that you expressed, i totally get that. it looks good. >> and you look good in that yellow today, alex. >> i'm bright sunny, here we go. thank you, have a good one. every good day to all of you from msnbc world headquarters here in new york. welcome everyone to alex witt reports. we begin this hour with new developments in the mar-a-lago search. first, new alarm from the doj expressing concern about what could happen if surveillance video from the fbi is made public. a doj official says the department hopes caution and care would be used by anyone with access to that video. that comes as trump's team is planning to file a new legal challenge very soon. one of trump's attorneys now claiming his client's fourth
9:02 am
amendment rights were violated when the fbi searched his resort. >> this is going to be fourth amendment day. we are going to weigh in a very strong and very hard on behalf of the president, we are going to be attacking that search warrant. >> brand-new and the -- he thinks the mar-a-lago search will help him in 2024. some allies in his orbit aren't as sure, we're gonna break down the latest with a team of reporters and experts. the war in ukraine sparking new fears in europe this weekend. ukrainian officials sounding the alarm over a possible russian occupiers could be shutting down the region's largest nuclear plant to disconnect it from ukraine's electricity grid. we'll bring you a live report from ukraine. trump allied lindsey graham will have to testify tuesday before a georgia grand jury due to election interference. the federal judge denied the republican senators latest attempt to get out of testifying. he is however, still waiting on one more deal that could postpone his appearance. we have a panel of reporters
9:03 am
and analysts for you to break down all of the latest headlines. first, we are going to the big news headlines. stemming from the mar-a-lago search. off to julie tsirkin's, julie welcome, walk us through what is new on this. >> yeah alex, this is a little bit all of the place. stick with me here. the judge, the same one who authorized the search of trump, former president trump's mar-a-lago home in palm beach, said that he is actually inclined to steal parts of the affidavit. that is a lawsuit brought on by media companies including nbc news. overnight, lawyers for president trump or actually on fox news radio stating that there are getting ready to file their first motion in this case, the first major legal sort of step for trump's team. take a listen to what jim said overnight. >> we need a special master. that's a rare step when it comes to search warrants being executed, but this is something that we have to pursue. we have to get somebody in the middle because we're not going
9:04 am
to leave it to the doj to tell us that they're doing their filter search and that there are the guardians of what's privilege or not. >> this is a big step. he played another bite from him at the top saying that this is fourth and mineral-based. remember, that amendment protects americans from unauthorized or uncalled for searches of their homes. present trump certainly believing that that is the case, even posting on his social media platform calling it a quote, illegal break-in. meanwhile, you have the trump team also potentially releasing full surveillance video of the search. that of course putting fbi agents who were there in jeopardy. already heightened threats in the base since the search on august 8th. doj responding to that, you see part of the statement on your screen saying quote, we would hope that it would only be provided in a format that obscures the faces and identifying information of law enforcement personnel. saying that their motions can come in a matter of owls and at least by monday. alex? >> julie, thank you for that
9:05 am
great set up. let's bring in on the heels of that, mark caputo. a senior national reporter for nbc news digital. former fbi special agent. welcome to you both. mark, let's get to your brand-new article in which it is titled trump things that mar-a-lago search will help him in 2024. some allies aren't so sure. you are colleagues right, one close trump ally who hopes he'll run in 2024 said the former president doesn't seem to be aware of the perilous position he's in. saying, he may get closer to the prize but reality, he slipping. can you mark, give us a sense of how trump plans to use what has been a tumultuous couple of weeks to say the least. the people around him think he is a little delusional about this? >> let's be careful in trying to forecast what don trump is going to do. careful he's been pretty unpred, even until now. i'm not sure all this reporting about the surveillance video and this chatter inside trump world is right. some of that might be very wrong. we should be careful about that. as for what trump's mind state
9:06 am
is, and what he is telling other people, he is gloating about his poll numbers. he had ten percentage point increase over ron desantis before -- in a hypothetical 2024 presidential primary matchup. then there was a pool he had seen, and then the poll he'd seen as well in florida, central florida congressional republican primary. they also pull tested trump versus desantis before the mar-a-lago search. trump was essentially tied with desantis at 30 8:37 after the search. he was up 50 to 20 over at desantis. he is seeing an increase of republican support. meanwhile, he is raking in more money. and then his liz cheney got seriously defeated in wyoming. so, for trump he is kind of on cloud nine. yes, we talk to some people who were like, we are not sure that he realizes what is happening here. this is unprecedented, perhaps
9:07 am
the most precedent thing now is to say something about donald trump as unprecedented. if you think about it, in just two weeks he had his home search by the fbi, he had to plead the fifth more than 444 times in a civil investigation by new york state. his former cfo in his eponymous organization pleaded guilty to tax fraud charges in another case in new york. he is planning to give testimony there. and then he is in pretty perilous condition according to his own allies. when it comes to a georgia election interference case where he was called caught on tape asking the secretary of state, hey, find some extra votes so i can win. it certainly doesn't sound very good. trump apparently has an explanation for this but if this makes it in front of jurors, his voices on the tape and that is gonna be a hard case for him to defend. >> that makes sense. what about your present there in the courtroom on thursday, mark. the federal judge says he is inclined to unseal parts of mar-a-lago search affidavit,
9:08 am
orders the doj to submit that detracted version within a week. how is this going to play out over the next five days? is there any conventional wisdom behind when we might see that redacted affidavit? >> i don't know about the conventional wisdom on when we will see it. obviously, he has until thursday, judge is the one who approved the search warrant. he has read the affidavit, he said in court that he has his own opinions about what should be released and what should be released. he wants doj to do the work. so, the question is, what is doj going to do? generally, their pattern has been one of not giving the public lots of information. they are fighting the biden administration, they are fighting, i should say, over releasing a memo from the previous attorney general concerning the mueller investigation, something that two judges said should be released. it gives you an idea of doj. this is not an organization that only believes in transparency. we have that additional wrinkle as well. >> 100%.
9:09 am
tracey, as we keep in mind the doj didn't want the affidavit released in any form, can a majority have it redacted before it gets sent to the judge? how much of a national security concern is the actual affidavit? >> i think really what is going to be important about the affidavit is protecting sources, methods, and witnesses. i think those are the three things that are most important because we have to remember in the narrative that i'm seeing a lot with the republican senators, these fbi agents simply lied under oath in affidavit in order to get the search warrant. it is more than that, you don't just go and speak and hope that it is correct. you get this information that goes in the affidavit through a various different means. some of those means may pose some national security concerns. i think that is going to be really key in terms of what the judge allows and doesn't allow in the affidavit. we have to remember that the fbi agents that were involved,
9:10 am
they stand a very serious risk of violence and threats being used against them because really, that is the message that is being perpetuated through republican leadership throughout all levels of congress. i think those are the two things that the judge, he has been a victim of some antisemitic hate rhetoric. i think those are the things that he's going to keep in mind. >> you think this video, where to be released and not blurred in any fashion, tracey, it could be specific enough to show the faces, identifications, anything like that of these fbi agents that went in there? >> again, i just hypothesizing, i do not know what kind of surveillance he has at mar-a-lago. most of us have camps and stuff like that in our home. i'm guessing he probably does have a step more than that. i would suspect that there could be a lot of identifying information in this. simply leaving it in the trumps camp's hands to blur out faces is really a big which.
9:11 am
i don't think it is a wish that is going to come to fruition. >> you are hearing in your article about the hearing, you quoted the counter intelligence official who said, another factor is the threat of possible obstruction and interference in the investigation. in many cases, that's purely theoretical. in this case, the court has found probable cause that there was a abaya lay shun of one of the obstruction statutes and that evidence of the obstruction can be found in the redacted version of the affidavit. meaning? what do you think trump and his lawyers know exactly what this is all about? they may not know who the mole is, mark, but do they know exactly what's incident prompted the search? >> no. there is not a lot of information that trump world's very coherent or a cohesive on. there has been reporting out there that one of his attorneys sign some sort of declaration or abdication that the fact
9:12 am
that the government had gotten anything you want it in june. obviously, the government didn't and came back with a search warrant. just what happened in a period of time we don't know. what he did say in open court was that this affidavit is fairly extensive. it draws on lots of grand jury testimony and witnesses. there is, apparently, lots of information there that can be clean. also, it warned that if this information was blocked out in an insufficient way, someone could find out who these witnesses are. that's why they want to do a thorough redacting of the information. we are in wait and see mode, we are an old story of the blocking then describing an elephant with their hands. >> what do you, tracey, make a broad statement. do you think someone unauthorized got a little too close or even worse to these classified documents? >> my gut says yes. i think that is where some of this obstruction comes into
9:13 am
play that mark was talking about. i think something happened between june and when the search warrant was executed that tipped off the fbi to realize that things were being purposely, i think that's the key here, the intent. purposely keeping these documents from the national archives and from requests to turn them in. i think that is really the issue. the issue boils down to really be intent in the situation. if they were actively being moved, then that is absolutely obstruction. >> quickly mark on this, one of trump's lawyers, that being christina bob, was also that hearing. she did attempt to file a motion regarding the affidavit. during appearance on fox news this week, she explained the reasoning behind that decision. let's quickly play that. >> we believe that some of the other parties actually had argued it quite well. we believe it was very interesting and someone encouraging that you have parties from both sides of the
9:14 am
aisle. liberal media outlets, a couple of them conservative watchdog groups really together on the same side. we were curious to see how that played out. of course, reserving a rights to try something else in the future if we want you. we really just chose to see how it would play out. >> is this a strategy, mark? or maybe the trump folks don't want to fight too hard to reveal all the affidavit details. >> i'm not getting a lot of evidence that there's a lot of shadow here. for instance, christina bob, if you look through the expenditures for save america, she's not listed as giving services. for what i'm told by people in trump's orbit, she was just a custodian of records here, not really an attorney. if you walk into court and she doesn't listen afterward, we asked her hey, give me reaction to this? she can commit, she figured out that she had some sort of remarks and played punted on tv later night at fox. that's what she did, she is saying now, there are two
9:15 am
separate things. she was part of some cohesive and coherent legal strategy, she not only would've telegraphed what he said, but the trump campaign, or better said the trump organization lower case oh in this case, would've filed this motion that trustee was talking about a lot earlier. >> well, it makes sense that it doesn't really make sense. okay mark, and tracey thank you so much both. my next guest knows don trump better than anyone, he's been to mar-a-lago dozens of times. we're gonna ask him about the pool, yet the pool at mar-a-lago and why it's location is a potential significance in the investigation. icance in th investigation. investigation. ♪♪ voltaren. the joy of movement. ♪♪

because there is more to come here. >> so, that is a very loaded question. first of all, the district attorney came to visit me in upstate new york three times. they thought it was important enough. when i was ultimately returned after the second, the unconstitutional remained that i'm now suing the u.s. government and trump and bill barr on. after that, i met again at least another half, 9:10 times with the district attorney's office regarding this. they have documents that i have gone through hundreds and hundreds, if not thousands of documents with them that all show this ongoing continuous scheme, this scheme i reference when i was before the house oversight committee two years before that. do i think that allen's sentence is justified? do i think that it is proportionate or disproportionate sentencing?

9:31 am
that donald trump is not, and i repeat, is not intimately aware of and involved in. what is he going to do? he's got to pick and choose what questions he is going to answer? that is not the way this is going to work. if the prosecutors from the da 's office, if district attorney alvin does not ask him the very specific questions that i can throw out in the next three minutes to you, that would really bury trump and so many others. it would be a dereliction of his duty. there is no other way to describe it. tomichael cohen, sadly, i am out of time. i could talk with you forever. let me get a quick look to the book. we are waiting for that one. you are coming back in october when i think it's released. michael cohen, revenge, this is how donald trump weaponize the u.s. department against his critics. that is gonna be one heck of a rain. michael, thank you so much for joining me. so you soon. >> alison, thank you. trust me, it is a good read. >> i bet. all right, the situation gets
