former president trump saying he is gearing up to file a major motion in connection to the fbi search of mar-a-lago. now, that motion will pertain to the fourth amendment, according to his truth social post. he says it's constitutional rights against and reasonable search and seizure were filing it. that's not all. trump is threatening to release the video of the search, which has federal prosecutors concerned about escalated threats against federal agents. the department of justice said it hopes that the faces of law enforcement officers are blurred if trump were to make that footage public. joining me now, nbc news reporter julie tsirkin. julie, welcome in. get us up to date on that footage and where do things stand with his potential unsealing of the search affidavit? >> yet, while former president trump and his team are keeping their cards pretty close to their chest, besides, of course, from what president trump is putting out there on his social media platform. but look, as it relates to this video, the doj is very concerned for the safety of their agents that entered mar-a-lago on august 8th. they already saw increase

threats not only on social media with democratic lawmakers here in washington, but pressing social media companies to kind of monitor the stress better, but we saw an ohio man, and armed, man tried to break into an fbi building, actually killed in a shootout with police. this is definitely escalating in that regard. meanwhile, you have the same judge that actually authorized the fbi search, now considering potentially unsealing the affidavit. he, this was in a lawsuit filed by the media companies, including nbc, news on thursday. that the judge said he is inclined to release portions of that affidavits, giving federal prosecutors some time to propose protections. of course, trump's team is saying they want that affidavits out in full, without redactions, and released to the public. cory? >> julie, trump is also now saying he will take legal action pertaining to the way the search was carried. out does he have a case here? >> well, this is a first major motion potentially, filed by

the trump team. so far, they have not made any major strides in courts. trump's lawyers overnight, was on fox news saying a little bit more of a plan to do. take a listen. >> we need a special master. that's a rare step when it comes to search warrants being executed but this is something we have to pursue. we have to get somebody in the middle, because we're not going to leave it to doj to tell us they are doing their filter search, and that they're the guardians of what's privileged or not. >> so, this special master is a neutral third party that will review classified documents the fbi said they took from former president trump's home, and as you saw in his post on truth social, he is calling this a quote, illegal break-in of his home. so, he clearly does believe the fourth amendment was violated. as you saw from the unsealed search warrant last week, the fbi is, of course, investigating trump for possible violations of the espionage act. >> julie, taking this if step

further, nbc news has reporting that trump thinks this will give him a boost in 2024, because it fuels his message about the corruption of the washington the sample strength. so, what do we know so far about how he's handling all of? >> there is a new poll by the economist, you think of, that shows about 57% of republicans support former president trump in this in the days after the fbi search of his mar-a-lago home. he is seeing increased momentum mri publicans, because of this and combined with other court challenges he's facing in georgia, in florida, in new york, excuse, me and his close allies, including senator lindsey graham and rudy giuliani, his former attorney, he is clearly taking this as a fight against the establishment, which is what got his supporters so fired up behind him in the first place. also his, allies say investment make him more inclined to run in 2024. a decision we don't expect to make until after the midterms. >> it doesn't hurt he is now back in the news media cycle with people quoting truth social and continuing to talk

about his efforts. julie tsirkin, thanks for starting us off. and later this hour, i'll be joined by former federal prosecutor glenn kershner to talk about the possible unsealing of that mar-a-lago search warrants, and the legal implications for trump as he's transit you square off of washington institutions. the january six committee is working off their next star witness. by starlets cheney says they are in conversations right now with former vice president mike pence to give him testimony about the capitol riot and the efforts to overturn the election. pence said he would give, quote do consideration to any invitation to testify. so, fort more on this, let's bring in and be neat news capital correspondent ali refer. what else do we know about this? what else did we hear from cheney about pence's possible testimony, and what info are they looking for from pence? >> yeah, cory. abc is releasing some early clips of congresswoman liz cheney's interview that will

terms of what might happen in the senate. so, we are going to hope to bring allie back here in just a moment to continue this conversation. for now, oh, we've got ali back. ali, welcome back in! thank you so much. i'll give you the floor to continue your thought. >> thanks,. cory so, a committee murmur going back to that soundbite, committee members have said since january that they have been in talks with former vp mike pence counsel about possibly testifying before the committee, whether that happens is still unclear. it's also still unclear whether the committee will need him to testify, because we've seen in these past eight hearings by the committee testimony, from several people within former vice president pence's inner circle. people like his former counsel, greg jacob, former chief of staff, marc short, who have talked about how the former vice president mike pence felt when he was dealing with before, during, and after january six. there are definitely things the committee still want to ask him about, like the pressure campaign on him to unilaterally

overturn the election results on january 6th. definitely what he was doing in that bunker underneath the capital, making calls, essentially acting as commander-in-chief on january six throwing the hours that the capital was under attack. i think it's important to remember here that pence is a likely 2024 presidential candidate, and he's really teetering a line here. he's defending the working as done with the former president during the four years of the administration, but he's also condemning the violence of trump supporters on january six. so, it's quite possible he is leaving the door open, extending this olive branch to the committee for possible talks to maybe make his candidacy more palatable for more moderate republicans or never trumpers after january six. cory? >> it would be fascinating to hear from him directly. and something we mentioned, just moments ago, ali, senate minority leader mitch mcconnell this week when he warned republicans might not take control of the senate in

november. i want to play you what he said. we'll talk about that. >> i think there is probably a greater likelihood the house votes than the senate. the senate races are just different. they're statewide. candidate quality has a lot to do with the outcome. >> all right, ali. what's the state of the race for the republicans right now, and test been any reaction to mcconnell's comments? >> candidate quality has a lot to do with the outcome. so, he didn't name names but it's very widely believed that this was a dig at the former president and his backing of candidates in senate races that republicans are now struggling to maintain in the poll numbers as they tighten here. these are states like arizona, where democratic senator mark kelly is now 8 to 10 points ahead of his trump backed challenger. states like pennsylvania, where trump backed minute oz is now lagging behind democratic candidate john fetterman.

in ohio, j.d. vance is now neck and neck with his democratic challenger, in georgia, herschel walker now behind democratic senator raphael warnock. these are concerns that mcconnell has about his positioning to regain the majority. so, at the end of the, day this was definitely supposed to look like an easy grab bag for republicans, but as you saw in that mcconnell soundbite, he's an engine that may not be so easy. >> still, 80 days to. go a lot left, twists and turns will be ahead of. us allie raffa on capitol hill, thank you so much. >> to the war in ukraine. attacks are stepping up in the russian-controlled region of crimea. overnight, russian air defense took out a drone above the headquarters of russia's black sea fleet instead possible. now, the mayor there said no one was injured, but at the same time, tensions are growing at a key nuclear power point in eastern ukraine. the united nations voice is warning of a potential radioactive disaster strikes on the now russian controlled

power plant continue. abc -- 's life in key for us. megan, what more do we know about that drone strife, or that drone was shut down? >> exactly. what we know is that happens earlier this morning. and so we know that the drone hit the roof of russia's black sea fleet there in crimea. ukraine has not said anything about this. of course, the details around it are still unclear at this hour, but. look what we've seen over the last two weeks is several attacks by ukraine into crimea. of course, crimea being sacred ground for vladimir putin. he annexed the peninsula back in 2014. we know that crimea is home to a lot of these military thanks, along with ammunition. it is a hub for russia as they wage this war against ukraine. so, really, when you take a look at the last two weeks, it has really shifted the battlefield, shifted the playing field here for ukraine, posturing them in the position of the offensive.

>> and megan, talk to us about the situation at the nuclear power point right now. we know that international inspectors have been trying to get that plant for weeks, get their, be able to assess the situation. has there been any progress on that front? >> yes. this continues to be a very serious and critical situation here. ukrainian officials say they do have intelligence that suggests that the russians are actively working to try to shut this points down, and we have been speaking with experts who really can't stress enough just how critical this situation is, how dangerous this is situation is, because the concern is that there could be a leak. any little mistake could be this catastrophic effect, and a leak would mean we could be seeing radioactive material seeping out of this plant, spreading throughout ukraine, of course, deep into europe as well. which is why we've seen the un secretary general, who is here in ukraine over the last couple of days, calling once again, on russia to allow international

inspectors to go inside that plant. we know that was what was discussed yesterday in a call between france's president, emmanuel macron, and president putin. putin saying he is open to this idea, but russian officials say they are not going to allow this to happen until some kind of early september. ukraine is saying that's just too long to wait. >> it certainly is. megan fitzgerald and key for us, thank you, megan. the people of cuba are facing a severe energy crisis. a massive fire broke out, following a lightning strike at an oil storage facility that quickly spread to several oil tanks. 16 people, mostly firefighters, have died trying to contain it, as large explosions erupted around the fuel depot. that fire finally was brought under control, but not before about half of cuba's main fuel depot was destroyed. the country is now dealing with widespread blackouts, which can last up to 18 hours. they have affected millions of cubans. joining us now, live, from havana, is nbc news reporter ed augustan. ed, what's the situation like they are now?

how are people managing through these rolling blackouts? this long, long rolling blackouts, 18 hours? >> the blackouts, cubans are now living a crisis on top of a crisis. things are already bad for months. there had been very long, chronic power cuts in most of the country. even havana, the capital, where authorities tried to keep the situation a little better, from the 1st of august, that's before this fire, we started having a lot of governments what the called solidarity power outages to share the pain with the rest of the country. and then, this explosion. here in havana, we've been hit hard. not as hard as the rest of the country, but hit hard. now, three of every four days, there are scheduled power outages. it affects people. just today, before coming to the office, i had to throw out some chicken soup. i made it two days ago. but it's not. funny it's gone off. and here, we have power cuts that left a few hours. in other parts of the country,

in your introduction, those power cuts can go on for up to, or more than, 18 hours a day. you can just imagine, taking one example, food. how do you keep your food fresh? >> that's even due to the amount of food you have in the house, you cannot spare. you mentioned cubans are already living through a regular blackouts prior to this incident. tell me, what is next for this oil dependent country as they face a crumbling infrastructure? >> i think, to answer the question, you've got to get the causes. the immediate cause is that awful fire, and now cuba has lost a huge amount of its energy storage. that's a major cause. but there are longer term, deeper causes, perhaps, because of course, this crisis has been going on for many, many months already. i'll give you three causes. one, the u.s. sanctions. the trump administration foisted on cuba more sanctions, and that is the maximum pressure campaign, in the

administration's language. the biden administration has promised to get rid of them on the campaign trail, but they've largely not fulfill the campaign promise. >> -- there's one that's remote, the state continues departing to sanction oil tankers that travel from venezuela, cuba's main ally to cuba. i'll be speaking to industry experts and economists, and they say those sanctions forced cuba to pay a premium on all the oil it buys on the market. that's next, of, course the cuban government can't do too much to stop that right now. given the way u.s. politics is structured. the second, the war in ukraine. we talk about this all the. time around the world, we have seen the effects of rising gas prices, the government in sri lanka was ousted largely because of this. cuba, it's powerless to change that. the third cause is very, very old, decrepit infrastructure. i was speaking to an oil industry experts in the university of austin, texas. he said most of key was power plants have been built over 40 years ago, haven't received enough maintenance. that the cuban government's

taylor. she is the senate and governor's editor of the political report with amy walter. jessica, welcome in. all right, the climate, the political climate, technically in republicans favor. the presidents have a low approval rating, there are fears of a recession, and historically, the party in power usually loses in the midterms. why are you predicting a toss-up? >> well, it's because it's candidate quality. we are seeing something we haven't seen happened in a while, and it's that democratic incumbents are running ahead in double digit cases in some points of president biden's approval rating in the state. and they are winning over in states biden narrowly won, in arizona and pennsylvania and georgia, and the top of this cycles as i put republican chances in this past april, probably get 60%, because biden's numbers in the state were that bad, and they may have gotten a little bit better. democrats have sort of accomplish things with legislative successes.

the white house and congress passed the inflation legislation, and then in particularly, they have seen democratic voters and independents and republicans as the kansas vote showed us, get more motivated after the dobbs decision that set the question of abortion look alithia back to the states. so right now, given that it's a 50/50 senate, there's a possibility that democrats could feasibly so control book senate, because these candidates are underperforming, even when the ballot would usually have a republican for the states. >> let's talk specifically about three states. pennsylvania, colorado, and utah. the political report changes the raising's of those three states. tell me how and when that is decided. >> it's on a rolling basis, on a more broader look at where all of these states were heading into labor day, which is sort of the traditional kickoff of the campaign. now, not a lot of caveat is, i

expect to see these races tighten, even some pessimistic republicans i've talked to expecting these races to tighten. in pennsylvania, we see john fetterman there with a double digit lead in polling. i don't think it's that close, necessarily, but winning by four or five points? that's possible. that's where i think it might actually be. doctor oz's numbers remain very low. his favorite ability in the states that is where he is having trouble. now, he is sort of have the onslaught, as i guess, he had a bruising primary. after that, he didn't take the time to sort of try to rehab his image. he went on vacation, ireland, and was going back and forth between pennsylvania and his palm beach vacation home, spending some time in palm beach. that put a lot of republican frustration from republicans about that. he's back on the campaign trail, i think they are trying to get things turned around, but the question is, is it too late? and as released opportunities, moving off the board for

republicans like in pennsylvania, arizona could perhaps be the next one. they are looking at where other states think about in the play, and that's where colorado comes. in they have a very strong candidate in construction company owner joe day. he is running as a moderate. he does not support no exceptions to abortion, at some of these other candidates have. if you have joe de running in some of these closer states, the race could look very different. still a state where biden carried, but his numbers have gone down in the state. as have trumps. the thing here is oh day is not running a trump clone in the way masters in arizona's and doctor oz is in pennsylvania. one republican strategist mentioned to me, the never had a referendum on a former president. republicans want this to be a referendum on joe biden. that's what the president's first midterm elections typically are. but as the former president

continues to insert himself in these races, it becomes perilous for republicans. >> you mentioned the location and how that changes depending on the democratic candidates. it is fascinating. location, location, location. in your report, you compare this election cycle to 2010. explain the similarities and how this could be a cautionary tale for republicans. >> that's what i was hearing from republican senators and strategists, they fear they are going to be the same. the tea party wave of 2010, the house republicans flipped 63 seats. now, republicans in the senate flipped 60s, but it wasn't enough for the majority, and they left minimal races due to that candidates on the table in the vera, and colorado, and in delaware. and that was the nightmare that they were wondering if this could be déjà vu to that again this year. that's much smaller now. they only need ten that one seat. and about side of the fight cycle, it looked probable, as biden's numbers continue to go down.

but now, it's really kind of a true toss-up, where we see. that will republicans be able to rebound after labor day? will this sort of bump for democrats continue? will it return to a stasis, midterm election that is more about biden? >> the last few seconds we have, as republican pecan -- >> seats to the blame? >> i think it's president trump. he not only endorsed unelectable candidate, but he kept strong candidates out of the race. republicans had a lot of recruiting misses particularly in arizona, with doug doocy and not getting new hampshire senator chris noonan to run their against maggie hassan, which would have been a sure of a thing as they could get to flip that race. >> jessica taylor in with us today, we appreciate your time, jessica. thank. you coming up, the justice department pushes against the unsealing of parts of the mar-a-lago search affidavits over information they say would jeopardize the safety of witnesses. plus, the top trump executive

amendment will soon be filed concerning the illegal reagan of my home, mar-a-lago, right before the very important midterm elections. this comes after a federal judge gave the doj one week to provide a redacted carpet of the affidavit used to justify that search. during now to discuss me this, and deceive legal analyst and former prosecuted brett kershner. welcome. first, does the former president have a case here with his first amendment claims? >> cory, the former president clearly doesn't understand how fourth amendment litigation works. the fourth amendment does protect us against unreasonable searches and seizures, which this wasn't, because there was a judicially authorized warrant giving the fbi the right to go in and search mar-a-lago and sees the evidence of crime. there was probable cause to believe was a mar-a-lago and they did precisely that. but the thing is, a defendant can't move to suppress the evidence that was recovered

during the search warrant unless and until he is indicted, he is pending trial, and the judge set on motion hearing. that is when somebody like donald trump, when and if he is charged, and he becomes a defendant, that's when his defense team will have an opportunity to file legal motions like a motion to suppress claiming there was some fourth amendment infirmity here, which there was not. >> does this then relate to him also saying he is considering filing a motion for a special master to review and return evidence collected by the fbi? it's this something where that is also premature? how does this relate to his quote unquote case? >> he can claim that he's going to file any and all motions, but until he actually files motions, all of this is really just a bunch of pr lather by donald trump.

there are special masters, sometimes, appointed by judges to oversee the review of the documents that have been seized that might have some privilege attached to them. attorney client privilege. executive privilege. doctor patient privilege. there are lots of recognize privileges in the law, and sometimes, a court will appoint the special master. but this is just really donald trump's attempt to continue to whip up his base and say, i'm going to file all of these really compelling motions and by the way, please send me your money to help me accomplish these things. you are not going to see any of these motions, i predict, unless until donald trump is a defendant. he has been excited cited. >> what is your reaction to the judge asking the department of justice to submit a redacted affidavit? how does that impact the doj's case? >> yeah, this was a really wise move by the magistrate judge,

magistrate judge reinhardt, because rather than just decide the issue, because you have news organizations filing a motion, saying we want this stuff released in the public interest. you have the department of justice responding by saying, we can't release any of, it's because we have an ongoing investigation that has national security implications, and we have witnessed security issues, rather than just listening to those arguments and making a decision, magistrate judge reinhardt said okay, we are going to do this incrementally. prosecutors, i want you to provide these proposed redactions so i can see for myself what needs to remain under steel, and what i may be able to disclose or order disclosed without damaging your investigation, and without endangering your witnesses. the reason this is a wise, incremental step is because once magistrate judge reinhardt makes this decision, it will inevitably be appealed by one party or another, and when it's

appeals, this will actually strengthen the quality of the magistrate judge's ruling. >> and then, speaking of releasing stuff, the release of the surveillance video of the fbi search, what legal implications are there for donald trump, if he does release that? >> you know, there really aren't any legal implications, but here is one thing i think he and his lawyers should consider. you know, defendants are forever complaining, sometimes filing legal motions, saying, we can't get a fair trial because there's been too much evidence put into the public square, and it will take any potential juror, and it will make it hard for me to get a fair trial. well, if donald trump is the one who begins to sort of spew the evidence into the public square by releasing surveillance tapes, he is going to have an even less robust argument that because the public has been saturated with all of this evidence, it's

going to be really hard to pick a fair jury. again, this is more bluff and bluster. it's probably designed to assist him in his fundraising endeavors, and i don't think we should credit any of it until we actually see something released. >> i also want to ask you about former cfo of the trump organization, allen weisselberg. you tweeted that the manhattan doj gave trump a gift like i'm uneasy on vital berg. what does that plea mean not just for the trump organization, but also for trump himself? >> yeah, this is another low point in my opinion, for the manhattan district attorney's office. remember, there were two seasoned prosecutors who had been working the criminal case into donald trump. they said that there was enough evidence to indict him and to convict him, and yet they resigned because they claimed in a resignation letter, but to prosecutors, and in that

resignation letter, they basically said that the district attorney killed the case that was prove-able, and her resigning. now the da's office gives this unbelievable sweetheart plea to allen weisselberg. 15 felonies, of a 15-year-long criminal schemes to defraud in the first degree, weisselberg stole, let's call it what it was, all kinds of money from the new york city taxpayers and the new york state taxpayers, and he gets a sweetheart deal where he only have to serve five months, which will actually be only 100 days for 15 felonies, assuming he gets credit for good behavior while he's serving his time, and weisselberg gets to set the terms. he said, i'm not going to cooperate against donald trump, personally. i won't testify against him, but i will testify against the trump organization, which is of little value, quite frankly. you know, prosecutors almost never, i certainly never, struck a deal that was so

investigation into high-ranking republicans who worked on to undermine the result of the 2020 election. former trump lawyer rudy giuliani testified for more than six hours before a grand jury and fulton county on wednesday. this came just days after former new york city mayor was informed that he was a target of the investigation. he had previously been informed that he was just a witness. district attorney fani willis characterized his actions following trump's defeat as, quote, coordinated attempts to unlawfully alter the outcome of the 2020 election. senator lindsey graham is also due to testify tuesday, after months of trying to fight a subpoena. a judge this week said, enough is enough. and georgia governor brian kemp by themself in a similar position, trying to get out of -- relating to criminal interference in the states election in 2020. tomorrow -- senior reporter for the atlantic join constitution joins me now. welcome and thank you for your time today. giuliani did not speak to reporters following his testimony. what do we know about what went

on during his six-hour testimony on wednesday? >> we really don't know a whole lot. district attorney willis has not spoken about mr. giuliani's testimony and his lawyers have said nothing beyond the fact that he was informed that he is fulfilled his duty before the grand jury. of course, this is a continual thing. he could be asked to come back again. six hours is a pretty long testimony time compared to a lot of witnesses. it's really unclear. we don't know how often if at all he claimed the fifth amendment to avoid self incrimination. and we don't know how many times he would have cited attorney-client privilege while discussing conversations he would've had -- >> let's talk about lindsey graham. his request to get out of testifying was denied. what can be made of his claims that the constitution protects him from testifying? and what can we expect going forward with him? >> that argument was not

persuasive before this district judge -- -- she said there were plenty of topics that were political in nature rather than simply something he would've done in a nice every day duties on capitol hill. she says there is many areas that prosecutors can still question the senator on. and she was not persuaded when the senator late last week, was asking too -- as he appeals this district courts ruling. he has now filed an additional emergency filing asking the 11th circuit court of appeals to state his testimony on tuesday. we will see if they choose to step in before that. >> you also reported this week on governor kemp's clash with the fulton county da. he is throwing accusations against the office saying -- accusations of political gamesmanship. what do we -- >> sure, there is a hearing

scheduled thursday in front of the fulton county judge who is overseeing the special grand jury. and let me just take a step back and say this was a pretty shocking filing from the governor's office. because as far as we knew, in the lead up to this latest scuffle, his office was working very well with the fulton da's office. he is not considered a target of the investigation as far as we know. he kind of came out with this episode with the former president looking pretty good, like you kind of stood his ground. he didn't given. he didn't do anything that would necessarily make the da's office be hostile with him. and his motion details a really kind of striking communication breakdown between his office and the da's office. and so, now he citing full budget privileges including -- and executive privilege in order to -- >> we appreciate you following this one for us and we will no doubt be checking in with you as more updates come out of this georgia investigation.
