dogs helping families and survivors of the parkland school shooting. you don't want to mess. it all of that and more is coming up. and the good sunday morning to you. i am katie fang. this morning, waiting to see if trump's legal team finally gets around to filing a motion calling for a special master to review the evidence that was seized from his mar-a-lago estate. trump's attorney said friday the neutral person is needed to help, quote, vindicate the fourth amendment rights of the president. this comes as and bc learned that trump is also considering releasing the surveillance footage of the fbi search. so far, though, none of that has happened. meanwhile, the doj has until thursday to propose redactions for the affidavit supporting the document seizure. for more on all of this, we

turn to nbc news justice reporter ryan reilly. ryan, good to see you this morning. thanks for being here. give us the latest of what is going on. >> there is a call for the special master. and i think that the special master had a bit of a complicated issue. because if you look at the most prominent example in trump's world of a special master in recent history, it would be with rudy giuliani. and in that case that was an instance where rudy giuliani had other materials that were protected by attorney client privilege, which would have to be sorted out after his foes were seized by the fbi. that was more of a complicated matter. in this case i am not sure -- it is not the same scenario. trump is a lawyer. trump's not having communications protected by attorney client privilege. all the documents that were seized from his home were supposed to be possession of the national archives. i think there are many fourth amendment claims here. but i also don't think that it

is a street for does the giuliani issue, or make sense for a special master to be employed in that issue because there were these complicated issues. the overarching theme here in the trump instances that all these documents should about in the possession of the national archives. he was not supposed to have possession of them. so while there might be questions about what's documents could be used in a prosecution, the fact is that none of these documents were supposed to be documents that were retained, ultimately, by him. they were supposed to be in control of the national archives altogether. it is a bit of an unprecedented sort of issue. it is not often that you see litigation surrounding the presidential records act, because presidents in the past have generally just complied with this and follow the rules, and taken efforts to make sure that all the documents that were created during their work as presidents were preserved for history in the position of the federal government, rather the sitting at a presidential estate in mar-a-lago.

katie? >> well, ryan, i guess you would agree with me. we broke the mold when it came to donald trump. not necessarily in the best of ways. our thanks to ryan riley, nbc news justice reporter for giving us the latest. moments away, i mean this week with george conway about all of the blast are coming from trump's legal team regarding the mar-a-lago search, and why they have yet to take action. breaking overnight, the daughter of the putin ally killed when her car exploded near moscow. this according to russia's main investigative authority. plus, there are signs of a new ukrainian defense of this morning, with drones hitting russians boxy headquarters in crimea. for more on all of this we turn to nbc news correspondent josh lederman in dnipro, ukraine. >> katie,, russia's investigative committee has opened a murder investigation today into the death of the daughter of alexander duggan,

who is a close ally of president putin, who is believed to have helped shape his views on key matters, including the war in ukraine. there is no indication at this point that her death is all connected to the war in ukraine. and in fact adviser to zelenskyy this morning saying that ukraine had nothing to do without. would not assassinate a civilian like that. in the meantime, there are new suspected ukrainian strikes in crimea with the official government in crimea, that russian-backed governor there. saying that they are defense system was once again activated last night. just shortly after there was ukrainian drone strike that targeted the black sea naval headquarters of russia in crimea. at the same time, there are still heightened concerns about the possibility of a clear disaster here in ukraine, with new shelling reported in the last 24 hours. both of these operation clear power plant, which we talked a lot about in the last few days, but also the southern ukraine

nuclear facility. in the meantime, both countries, russia and ukraine have been holding nuclear disaster drills. that really sets the stage for what ukrainians are anticipating could be a very violent week. because on wednesday, ukraine will celebrate its independence day. that they also happens to mark the six months anniversary of this war. so lewinsky has warned that russia may be planning what he calls vicious attacks on that day, trying to mar ukraine's independence day and make clear that this war is not ending anytime soon. katie. not endin >> josh lederman in ukraine. thank you. here in florida, the students are back in the classroom for the first time since ron desantis's don't say gay bill, becoming law. terminated, shows it is still unclear what is a lot in the classroom. this is a florida governor spending today promoting when he calls a pro-parent, student first education engender across the state.

nbc's stephanie stanton is live on this education battle. stephanie, good morning. tell us more about what we can expect for the sciences tour today. >> good morning to, you katie. as you know, public education here in florida has become highly politicized. you talked about that so-called don't gay say gay bill which has now become law. is the parental rights in education bill, and it prevents -- prohibits teaching on gendered and he and sexual orientation from kindergarten through third grade. this has a lot of teachers concerned on how to implement this, because as part of this new, law he would also allow children to sue teachers for instructing using materials they deem inappropriate. there are a lot of questions there. teachers concerned that they could be opening themselves up to lawsuits. districts dealing with that. meanwhile, you mentioned. if the data says we're making several stops or they stay to

promote his education agenda. essentially he is facing a major stumbling block, because last week a judge struck down his so-called stop work act, which he also recently signed into law. what this does is it is nearly passed, and it restricts instruction on certain race based issues. and in a 44-page ruling, the judge called the law unconstitutional and called it a violation of the first amendment. that was a defeat for the governor who was promoting this education agenda. all of this going on, katie, as you may know, when the state of florida is facing a massive teacher shortage. and the governor in an attempt to ease that has loosened restrictions for some first responders and some veterans to be able to teach infill some of those vacancies. and that has opponents concern because they say they did see the current formerly trained teachers. there is a lot of controversy going on here. governor set to begin that

talking and no action. they are not gonna get you to the promised land, that i can tell. you >> chuck schumer and nancy pelosi did not show up for our meeting today. they have been all, talk and no action. >> typical politician. all, talk no action. sounds good. doesn't work. never going to happen. >> oh the irony. donald trump loves to accuse his enemies of being all talk, no action. but he may need to look in the mirror. for days, trump and his allies have been publicly calling for the release of the affidavit justifying the fbi search of his florida home. but in reality, his lawyers have yet to even take a position on the matter in court. nbc news has also learned that trump is considering releasing surveillance footage showing federal agencies and documents

from mar-a-lago. their son eric trump said the same thing, but so far nothing. on friday, trump's attorney van to take legal action against the doj, claiming that his client's fourth amendment rights were violated in that search. he also says he wants to appoint a special master to review the confiscated documents. but so far, not, a zip, zilch. i am sure attorney george conway has a lot to say about all of this. he joins me now. george, thanks for being here. the question straight out of the gate, is trump all talking to no action when it comes to mar-a-lago having researched by the fbi? >> well obviously here he is. any motion that he makes now for a special master's going to be denied on the grounds that it is too late. the cow is out of the barn. and the cat. the government will have had, by monday afternoon, two weeks to go through this material.

the filter team would've already gone through. they have a filter team that is privileged and relevant materials. and they do it themselves. and with the special master he pretends to be seeking would do would be to perform precisely that role. i am reasonably confident that the justice department in the fbi have already perform that by now. as you know, being a lawyer, one of the things you need to get equitable relief like a special master is that you need to show that getting that relief will make a difference. and here there is no difference. he is dramas far as that is concerned. it is just a pr play on his part. >> george, you know, you said the trump's team are being, quote, three faced about this affidavit. one reason they want it out is to learn how the snitches. but it also comes with risks if the public sees this affidavit. are they counting on major and massive redactions here? >> i do not think they expect it, that any of them expect that the judge is going to go into trying to redact this

thing. it is a futile exercise, as the government says. but i think they are going to do is say look at what the justice department is hiding, and that is the game they're going to play. as i said, they actually do want to see what is in the affidavit, too. they do not want us to see what is in the affidavit. because it is voluminous and is going to contain significant evidence against them. and third, they want to pretend that the justice department is hiding something because it does not have anything. that is going to be hard to do because one of the things we will see when the affidavit is released, even if it is released in highly redacted so she's kind of forms, is how long it is. and what we are going to see, the point of this and say, we're hiding something. well they're hiding a lot. and it is just going to add weight to the government's case, frankly, in the public eye. >> the new york times has come up with a piece in the last few days detailing the chaos in the white house. in those days before trump left

office, which reporter maggie haberman summed up with this particular tweet. trump was focus not on preserving documents for the history of his presidency, as required by law, but on payback in trying to humiliate the fbi officials whose text messages got them removed from mueller's probe. what does this tell you about how seriously trump took the handling of classified documents? frankly, the likelihood that he did in fact in the violating the law? >> i find it's shocking in very difficult to believe that donald trump could be focusing on anything other than his constitutional duties and legal duties as president of the united states. seeking vengeance and trying to maintain control over things that did not belong to him. this is just par for the course. he has the ultimate narcissist. everything belongs to him. it's all about him.

just as he basically cared nothing about the constitution and they 12th amendment, and the peaceful transfer of power, and was concerned, basically, about his own personal well-being, he launched an attempted coup. precisely because he was, to the very last say, focused on obtaining vengeance against the fbi and people who he thinks conspire against him to produce the russia investigation. he was focused on that and not actually getting ready to prepare the office for the successor. which was his constitutional duty. it is par for the course. it is the ultimate self dealing, we alternate self concern. the ultimate narcissism on the part of donald trump, which just reached a huge crescendo in the last 2 to 3 months of the administration, and within the last couple days. and now he's going to pay the price. sooner or later, if you are

behaving illegally for your own benefit and you keep doing that and you keep doing it and you keep doing it, sooner or later it catches up to you. >> i also, think george, he was a bit busy planning a coup as well back in january. the new york times article also highlighted mark meadows's role in overseeing the presidential transition in the preservation of documents. i frankly think meadows is cooperating with the doj. we have heard nothing from him lately. not a peep. what are your thoughts about this? th i subscribe, i am an early subscriber to the katie think theory about mark meadows. we cannot possibly know for certain. it is absolutely speculation. but the fact of the matter is, he has not been out there in the public making supportive statements for former president trump, as he normally would be. and i would know that a year ago he was at mar-a-lago with this summit of former cabinet

and former administration officials, that were together until meadows, to map at the 2024 campaign. in the most recent event, a few weeks ago here in washington, trump made his first return in washington and major major speech. meadows was nowhere to be found. in fact, he ran away from the press the friday before. so something is going on here. meadows is quite deeply exposed in the january six investigation. he appears to have a central role with respect to the documents. it is not clear to me what his liability might be, here. he is in the middle of it. he is in the thick of it. he is at least a witness of not a potential defendant in these cases. so he has a lot to gain by

are at. it cheney calling him out to, saying he is, quote, completely unfaithful to the united states constitution. can you protect herself against this nasty virus when she became one of the most vocal anti trump members of the gop. now the congresswoman has been hinting at a 2020 tour for presidential bid. on the today show, she told nbc 's savannah guthrie the troublemaker decision in the next few months. but other republicans are already questioning her chances. senator mitt romney said that cheney is not becoming a nominee if she won, saying, i can't imagine that without her. no talk about all, this former gop strategist and looking project cofounder rick wilson. rick, good morning, nice to see you. let's speak frankly. you and i are friends. let's, training issuance, is not going to win. she lost so badly in her last place. what is the point of her running, frankly, as a republican?

i asked -- when she was there a few days ago in the peacock show, whether she thought maybe list to think about picking any other party. do you think it was a possibility for her? >> i think if you have a center right candidate in incredible conservative run, outside of the gop, you might track off a couple percent here or there. of people who are just exhausted and tired and terrified of the damage in the destruction that trump could do in a second term. i think that's pathway could lead to liz cheney having significant opportunities to break the very narrow margins that trump would need to win in 2024. but i also think, and i've said this the other day, that it is training has already won a battle against trump. and that is a battle in the media and for attention, and to have the position of a principled center-right conservative out there front and center. and trump despises and loathed that so much. not only because he does not want to ever have to think

about policy or ideology, only his own power and aggrandizement, but he hates the fact that liz cheney put on a better show than he has put on when it comes to telling the story of january six. and telling the story of his utter betrayal of the country in the constitution. >> rick, i give the ten house republicans who voted to impeach trump, only to have survived the primaries. if you dig deeply, enough is because, frankly, they had open primaries. they don't have to run against some of the republican for. that we now know this is still the party of, trump but, where does this mean that the party's policy is not whether you are trump supporter or not? >> that is a. it katie, that is the only pretoria now for a republican candidate. are you loyal to trump, will you accept the big lie that the election was stolen, are you willing to tolerate the craziness, cruelty, conspiracies in the republican base today. are you all in all the time about whatever comes of donald trump's month mouth. are you all in nodding and

winking the trump camp about things like killing fbi agents. are you all in on the learners or conspiracy theories that define every single day, and they change by the moment. you have to catch up with. it you always play that ball game. the party is now -- the majority of the public in congress, caucus, whether you take the house or not, are going to be election deniers. they are going to be trump truthers. they are going to be much more similar to marjorie taylor greene and matt gates and andy bags on the rest of the mutant parade than they are to liz cheney. this is not a republican party as we once knew it. it has been eaten from the inside out by a parasitic infection called trumpism. >> yes. we were diagnosing that disease of trumpism at the beginning of the segment. washington post, i'm gonna put up something for you to check out. they washington post as a quarterly ranking of possible gop candidates. unbelievably, i have rhonda scientists now in the number

one spot, beating donald trump for the first time. and lo and behold, don jr. coming up in the rear gear there at number 10. where, how likely is that moscow voters will actually let trump take a backseat to somebody like ron desantis, or maybe even his own son? >> washington, d.c., first, off whether or not -- ever seeing omniscient pence on whether donald trump's ally or not. but the fact of the matter, is right, now the washington establishment republicans who still work in the shadows, are still hiding out, and they are quietly whispering how much they hate trump and that they don't want to do it, while saying out loud that he is the greatest, best things as prepared mustard. there was that people have shorted enormous amount of confidence that -- is trump without the, ugliness trump without the craziness, trump without the conspiracy theories. and yet when ron desantis launched his 2024 presidential bid this week, which is what he dated by going eight to

campaign for leaders have doug mastriano, a guy who was the january six conspirator, it was to overthrow the government is promising not to certify legitimate elections, when he goes to campaign with j.d. vance, who says that women in abusive marriages should not get to divorce, if you just shut up and take. it's when you see, that you know that ron desantis is not going to be the shining star, the moderate republican, drive them all back to the paradise that donald trump pulled him from. these guys all face one of the big obstacles, katie. and that is that 75 million voters voted for donald trump. 35% of those, voters approximately, will vote for donald trump no matter what he does it all. the guy is absolutely bulletproof with those people. if you got 35% of the republican base in any primary, ron desantis and -- rick scott and ted cruz and josh hawley and nikki haley and all the rest of them will not win that nomination.

>> where, i have one minute left but i have to ask you about the national republican senatorial committee. pulling ads across the country from key states with races that they do want to win. they are currently burning through their fundraising pot of 100 and $73 million, and as of june they are spending looked a lot like this. just a few highlights for our viewers. $23 million spent on. adds 12 million on american express credit card payments. that is a lot of points there. $9 million on debt payments. and this is the one that was the real kicker for me. $21 million on text messages. i don't, know where. maybe the nra seashore looking to something called a friends and family pant plan that exists for -- companies. what do you make of blowing through this money with rick scott, of all, people at the helm? >> i know americans are shock in astounded that works, stop who over saw the largest medicaid fraud in the states,

is not a great steward of the resources of the rnc. this is an organization run by a group of consultants, people like josh holmes, mitch mcconnell's chief a. these guys are in the hour sea to get very very very wealthy. any group that is spending $12 million, in american express bills, you really have to ask, are you about to ask with the return on investment is of these millions and millions of dollars to text messages? the fact that they are now having to pull back in key states, at the same time the nrf sees plan to have a bunch of moderate candidates like mccormick in pennsylvania, or perdue in georgia, has failed. they've got a group of candidates who are so far out there in the loony atmosphere that they know they are going to have a much tougher time winning in ohio and pennsylvania and georgia and arizona. and so they are going to have to spend a lot of money, and they do not have a lot left in the bank. a lot of that money came from major corporate donors over the

years. where they were all convinced by mitch mcconnell and rick scott. ready to get the moderates, back it's going to welcome home. don't worry, it will be business as usual. nothing but tax cuts all the way down. and in fact they lost that battle internally. they do not understand that the party has changed in so they are burning money at the bonfire right now. or the rate that is just absolutely catastrophic. and it smells a lot like the same kind of physical responsibility that we saw rick scott display during the big medicare fraud. >> well, the grift is real. but i'm just going to still hold off hope there, where, eric that there is a cure for that disease, which is trumpism. i will say, thanks for being here this morning. fingers crossed. up next, from hero to zero. once dubbed america's mayor, rudy giuliani is officially the target of a criminal probe in georgia. a new recording could reveal just how much legal trouble he is in. my favorite to get glenn

in georgia. that effort by giuliani, that was at least part of the reason why he is now a target of a criminal investigation into election interference in georgia. as part of that probe, giuliani was questioned for more than six hours before a special grand jury in atlanta last week. giuliani's lawyer declined to say whether his client answered any of the questions. and the new york times is now reporting that according to a new book, an associate over the giuliani trying to pass a message along to donald trump, asking him to grant giuliani a, quote, general pardon. in the presidential medal of freedom in the days following the january 6th attack. that were tack, reportedly, never made it to trump. in a statement, -- trump did not authorize or requests the. notes and his, quote never asked for a pardon. because he did not do anything wrong. these latest developments raising the question once again, i'm a man who is once the name time magazines person of the

year was affectionately called america's mayor. and even received an honorary knighthood from queen elizabeth. which ended up so and mashed in scandal. for more on all of this, we are joined by former federal prosecutor, the host of the justice mother's podcast, and msnbc legal analyst glenn kershner. of course, glenn, the most important title's friend of katie fang. thank you for being here this morning. i appreciate it. glenn, let's clear up any confusion. even if rudy had received a pardon from trump, that would not have helped him with the skate investigation in georgia, right? >> no. bingo, katie. presidential pardons only apply to federal crimes. there really is some kind of instructing synergy between the fact that da fati will, as this returning in fulton county in georgia, investigating donald trump's georgia state election crimes, has told rudy giuliani, you are the target.

what is the definition of a target? it is somebody who the prosecutor has substantial evidence linking them to the commission of the crime, and to the prosecutor intends to indict them. the language, is the person is in punitive defendants. there is a whole lot of synergy between the prosecutor deciding he is the target and likely to be indicted, and rudy having asked for a pardon. because you only ask for a pardon if you have committed a crime, you know you have committed a crime i knew it would like to get away with it. so the president is the only one who can help you get away with federal crimes. but as you mentioned, not state crimes. >> fulton county da fani wellness eventually managed to get ready giuliani to appear before the special grand jury this past week. glenn, do you think actually got anything out of them? i suspect there was probably a few minimum times, the fifth amendment in vogue, but what

charges, if any, might be facing in georgia if he was able to answer any of the questions when he was there? >> i think that even before he went into the grand jury he was potentially looking at a number of georgia state election crimes, including, potentially, solicitations to commit election fraud. he reportedly testified falsely to georgia state legislatures. so there are a whole host of crimes that might apply to rudy. i have a feeling at which was a bit surprised when i heard he was at the grand jury for six hours. i have a feeling he probably through every privilege into the mix if you could think of. executive privilege. attorney client privilege. certainly, his fifth amendment privilege against self incrimination. maybe even threw in a doctorate patient privilege for good measure. but the way granted ari testimony works, generally, is the prosecutor must ask every single question that she wants to ask.

and to see what privileges the witness offers in response to which question. the reason we have to do all of that, and we don't just let the witness go in and, say we plead the fifth to everything, is because we then have to go to court and litigate what privileges might apply, and what privileges were just thrown up as a roadblock to keep from incriminating another. in this case, to keep rudy giuliani from incriminating donald trump. there really is a method to the madness of keeping somebody in the grand jury for six hours, even if they are not answering questions substantively. but instead invoking all kinds of privileges. >> glenn, i was listening to the justice matters podcast the other day. you say that the manhattan da gave trump organizations top money man allen weisselberg a, quote, sweetheart deal for the ages. by allowing him to plead guilty to 50 felonies, but only likely, eventually serving just 100 days behind bars. now, weisselberg, he has to

testify truthfully against the trump organization in october. but glenn, do you think it's a missions will implicated donald trump, at a minimum, and perhaps even other members of the trump family? >> let's hope so. if justice means anything. but here is my real beef with that plea offer. yes it is too little time. five months, it is little as 100 days, if he gets a good time credits. while he is serving those five months. five months for 15 felonies. he defrauded the taxpayers of the city of new york, of the state of new york and the federal taxpayers. though he is not yet been charged federally. it is absolutely low. we could see a really low number, a really generous plea offer, if he was giving up everything including the big fish. but when i find inexplicable, katie, as a former prosecutor, is it apparently they let allen weisselberg set the own terms

of his plea deal, by saying, i will not cooperate against the big fish. donald trump. charles will testify against the organization. hell, i am the chief financial officer, so my guilty plea is already pretty much sealed the state state bait of the trump organization. it will be to flunk defunct. it will go belly up very shortly. but i will not testify against donald trump. katie, prosecutors do not like defendants who are conspiring cooperating witnesses said the term of their own plea deal. and they especially don't forego important information about bigger criminal fish. this plea deal state tax. >> it is a real head-scratcher for us fellow prosecutors. a tough one to stomach. but let's see what happens. it might be impossible for weisselberg to thread that needle and to avoid implicating his boss. donald trump. glenn kirschner, my fellow justice warrior, thank you for
