oval office. we'll look at which you can do from the outside. also this hour, the biggest primary of the week is on the democratic side. they will decide who gets the chance to knock around desantis out of the florida governor's mansion. this hour, i'll talk to the two democrats voting it out tuesday for that honor. nikki freed and charlie crist join me live this hour. we begin right now in georgia where a circuit court of appeals has just temporarily blocked senator lindsey graham from having to testify before a fulton county special grand jury on tuesday. that comes just two days after a judge had denied grows attempt to delay the testimony. fulton county district attorney fani willis whose investigating possible election interference in georgia during the 2020 election will now have to wait possibly months to question graham about calls that he made to georgia secretary of state brad raffensperger after the election. ad raffensperger after the election joining me to discuss is congressional reporter, luke broadwater. what do you make for this investigation in georgia? >> i will slow down the

questioning some with regards to lindsey graham but it will probably not ultimately prevent him from having to testify as these appeals go up the chain. other witnesses have attempted to block the subpoenas from testifying. by and large -- graham has been told that he is a witness and not a target. the da is interested in the calls that he made to raffensperger that the sticker terry of state says that graham tried to influence him to throw out legitimate votes. graham denies that. he says he was just checking on the election integrity and that ultimately he voted to certify the election. but he is known on capitol hill as one of the people who was closest to donald trump. if this investigation is making its way up to trump, lindsey graham would be someone with

direct knowledge and conversations of what donald trump was doing at what he was asking of lindsey graham. >> i want to also turn to the investigation in florida. we are juggling, covering so many investigations across the country regarding the for president. what is the latest you learned about it? and the collection of white house documents from mar-a-lago? >> so, what we know is that it's gonna take some time for the fbi and the justice department to go through all of these boxes of documents that they brought back from mar-a-lago. and as they're going through them, they are finding some evidence that they are going to send back to donald trump that was maybe over collected. we learn about the passports that they collected, which weren't necessarily made to the search. now we're going to see a series of motions and these redactions of the affidavit for this search warrant. we're gonna see exactly how much the public can learn about

what the fbi was looking for and what they wanted. we, at the new york times, and other media outlets, we filed a motion to try to get as much as that affidavit public as possible. we want people to know exactly what donald trump had, exactly with the fbi was looking for. at the same, time we don't want to compromise any secretive sources or things like that that could be touchy. so, yeah, we, like, you want to get to the bottom of this and see all the answers. >> look, you also have a new story about how the january six grand jury has issued a subpoena to the national archives for all materials in whatever form they have provided to the house select committee. this is in regards to yet another investigation regarding former president trump and with these materials would -- files of trump's top aides, his daily schedule, phone, logs a draft text of his speech before the riot. what have you learned about the request for these documents?

>> there is so many investigations into trump and his allies. it can be hard to keep track of the mall. this was a clear sign that the justice department's probe into january 6th was beginning to catch up with the house select committees investigation. for months on capitol hill, democrats have been decrying that the justice department hasn't been moving as quickly as the house committee. now we are seeing this request from the national archives for every single piece of paper from the national archives that was sent to the january six committee to go to the justice department, to go to federal prosecutors. we also know that the justice department has asked for interviews and issued subpoenas to at least five top trump white house officials. some of whom have already testified for the january six committee. it does seem like, as the mar-a-lago investigation is heating, up as the georgia investigation is heating up, so

too is the justice department probe of the activities of january 6th. all of them are moving up the food chain. >> some potential movement there, despite some delays in georgia. luke broadwater, with the new york times. let's bring in congressman, jim himes, democrat from connecticut. we appreciate you being here. as a member of the intelligence committee you've been highly critical of donald trump's claims that he declassified all the material in question. what do you make an out of his fourth amendment claims? >> he didn't declassify them. if he had, and i think john bolton, who's his formal national security advisor made this case a lot better than i, did his national security adviser might have actually heard about it and those of us operating in the company day in and day out of classified information we might have heard about it. it's important for us to know. first of, all he didn't do that. shocker of shock or! donald trump not being honest about what he did! there's no guarantee whatsoever that all the material down in

mar-a-lago was subject to some fantasy declassification. it is interesting, to the u.s., about the process here, was the president -- were the presidents rights guard it? there's no evidence to suggest that the president has been treated any differently at all than you or i would be or joe public would be. or the fbi, or the police, forced to go before a judge with probable cause. that is a really important point because in a rule of law country, it really is important that common people, regular joes, they get treated exactly the same way that the president of the united states or a member of congress or media individual gets treated in front of the law. >> now, a judges are so indicated that that he will likely release part of the fbi search affidavit used to obtain their warrant. here's what your colleague and adam schiff had to say about this. >> the question is, at what

point in time does the public get to see that f a david? and i think they make a powerful case that at the early stage of the investigation, when it could jeopardize the pursuit of justice, this is not the time to be giving the trump lawyers a roadmap into how to intimidate witnesses, or how to derail a legitimate investigation. >> with all the redactions, do you share his concern about the damage that could be done? >> yasmin, i agree with adam schiff, but for different reasons. i don't think this is necessarily about what lawyers and what team gets which information. yasmin, we can't lose sight of the fact that we are dealing with a legal investigation. typically, in legal investigations, the prosecutors, the attorneys, the department of justice, whoever it is, they don't talk about it because during an investigation they don't have all of the facts. they may not have gone in front of a grand jury, they may not be ready to indict.

an increase in enthusiasm for democrats, and by democrats, but also shows the approval rating stuck in the low 40s. is the president a drag on democrats heading into the midterms? >> yasmin, i'm a big believer that good policy leads to good politics. i'm at home right now, explaining the inflation reduction act. explaining what it means for the senior citizens to be able to count on it in the coming years, the reduction in the prescription drug, what is going to mean for the -- biggest investment we've ever made in addressing climate change. i feel the energy changing around. that i see the republicans countering that by saying the irs agents are going to be rappelling down your chimney with weapons in hand. it is just -- i've been doing this a little while, i've never seen both better policy and lame or attacks on that policy than i've seen now. there's no question in my mind, that will happen come november. >> how do you expand on that?

republicans have said that the feds would be going after the little guy. stoking fear the increase in irs agents in this legislation. can you explain with the actual goal is of the added irs agents? >> i can make two observations. number one, what they're saying is baloney. yes, there will be 87,000 new agents over a period of some years where there will be 50,000. retirements that's 37,000. yasmin, it's a fact, after half of the american population in the lower half doesn't pay income tax. they can be audited on their income taxes. people need to ask themselves, is it going to be the teacher in the firefighter who have two d w twos filing their tax return? no. it's going to be the people with investment in oil wealth. by the way, let's forget all of this. we -- ended the republican party decide that they wanted to defund the police? it's not lost at me that

the fbi because you have people like marjorie taylor greene saying defund the fbi. you have people like the governor of arizona saying, disband the fbi! you have donald trump, again, echoing the deep state conspiracy. you have an individual who tried to attack the fbi office in ohio. a pennsylvania man got arrested because he wants to target them onsite. what is going to happen if you have an entire right-wing network and the republican party target the fbi and law enforcement? you're going to get acts of terrorism and acts of criminality. this is why we shouldn't be surprised that this is happening right now. the question, is what do we, the majority, and law enforcement do about the extremists? about the mainstream white supremacist terrorism which is the number one terrorist threat in america? >> what do you do? that's the big question. congress is calling on social media companies to step up the game. the leaders of two house panels sent a total of eight social media companies, including twitter, tiktok and truth

social, demanding that they take immediate action to address the threats that are happening on their platforms. how much of the responsibility do you think lies within these companies? >> they bear some of the responsibility because, let's not forget, they have an open platform, or specifically right wing individuals and the right-wing ecosystem to promote antisemitic conspiracies like the deep state. white supremacy's conspiracies like the replacement theory. they say, oh we can't touch. it you can't touch. at your private company. you can deplatform these individuals. you don't people like alex jones. he doesn't need a platform. people who spread hate, that results in violence against law enforcement and marginalized communities. you don't need the platform. in addition to social media companies, you need law enforcement to clean house. i want to say this really quick. in 2006, the fbi created a -- that said that white supremacy had infiltrated law enforcement. they know about this for 15 years. law enforcement needs a clean house. we need to prosecute white supremacist terrorism like we

about how it has been back and forth, this rollercoaster ride. taking it to the polls, at least you will get voters a voice. before roe v. wade was overturned, you shared a personal story back in april describing the abortion that you got just 15 years old, before it was legalized. how does it feel knowing that michigan could go back to that time? >> it's heartbreaking. it's frightening. it's not what i want for my daughters or my granddaughter or for anyone out there who loves someone who needs an abortion. they should be able to have access to a safe and legal abortion, something i wasn't able to have. i think that judge cunningham recognized that. he said the only harm would be not to issue an injunction. it was a bold statement for the truth. >> michigan, of course, has long been about a ground state when it comes to elections.

it is now the center of the fight for abortion rights, with you at the center. those two things are such colliding in november. do you think we'll see a repeat of kansas where voters overwhelmingly support abortion rights? >> i do. there is no one i have talked to who doesn't support this, beside the protesters. as i was gathering signatures, i want to say, we gathered 925,000 signatures. that's a lot of signatures. from people who were pro-choice, from people who are anti choice. but clearly stated to us, i never thought roe would be overturned. and i would have to face this. or people who just don't want the government, even if they're antichoice, telling them what to do with their bodies. i think this is going to be one hell of a campaign. the other side has already started spewing lies. and we are getting prepared to respond to those.

it is going to be a battle. i do think we are going to. when i think people are going to show up and they're going to protect abortion rights for michigan and it will be a guiding light for the rest of the country. >> last few seconds, rene, what are you hearing from people who are coming into your clinic? are they worried? what's the temperature? >> michigan patients are just confused. they're hearing about abortion being illegal in the united states. and yet, we are able to provide abortion services. so we spent time explaining to them why they need to register to vote if they are not, and why they need to show up to vote. and the short cut reason why they are able to get an abortion is that. we are seeing patients for multiple states where abortions are legal. those peoples stories are terrifying. things that they have gone through to get here, things that they would do to themselves if they couldn't get

the congresswoman has amassed in the lead up to her primary race. her noting that she's gonna spend these race -- she's gonna spend it in support of democrats, looking to beat some of her former colleagues. question i have for lewis's, if she's gonna try to tip the balance so that republicans don't retake the house? personally, that's what i would exert her to do. i think we should do everything she can to keep kevin mccarthy from becoming speaker of the house. if she is opposed to trumpism, there is nothing more trumpy than kevin mccarthy winning the speakership. it will be the same as donald trump's hands being around the speakers gavel. i think that will be interesting to watch this fall. going into next, year i think there's gonna be a question about whether liz thinks she can actually win within the republican party going forward as she starts to explore her presidential aspirations. >> if she has got momentum, if she can actually do any work and make any changes specific to the types of republican candidates we see moving

forward, do you see a way in which cheney's work could duck tail with your own work with the renew america movement? >> look, i hope. so i've been involved lately and third-party politics. we just started a new party called forward. look, i hope that when liz looked at the options out there she considers that there may not be a home anymore in the republican party. i think that's quick lucian that i came to from a long hard look at the data. the data did not show that the republican party was anywhere near to reforming itself. i think liz may find a more viable path in her political future if she chooses to go run as an independent, if she chooses to run as a third party candidate. look, i would invite liz cheney and anyone out there to consider coming in that direction and joining us in the independent lane of american politics. >> let's look at numbers. looking ahead to the midterms, democrats have some strong momentum with under 80 days to go. despite biden's low approval rating, which remains in the low 40s, nbc news polling showing 66% of democrats are

enthusiastic about the election. it's up significantly from a year ago. the polling also shows threats to democracy is the most important issue facing the country. according to those polls, what does this say about the effect that trump will have won the elections? >> look, in a way it is almost an unforced error on the part of republicans. a year ago you would've looked ahead of these midterms and said, the republicans should win. it should be a sweep of the u.s. senate and the u.s. house. because of these extremist policies that are being passed in republican legislatures across the country, not to mention the right leaning supreme court making drastic decisions, trump's continued influence on the party, things are starting to cut against republicans. now, a year ago, when i was looking at some of these key races, for, instance in arizona where democratic senator, mark kelly, is trying to hold on his heat. they were worried about the enthusiasm gap last year because the right-leaning

election deniers really have the wind at their backs. as you just noted, the polls are showing -- democrats are very enthusiastic about these midterm elections. likely it signals that it's not going to be the blow that people think it's going to be. the senate is certainly a toss-up at the moment. while the house still favors republicans, it is unlikely that kevin mccarthy will win with the deep bench republicans that they were hoping they might last year when they were looking at the numbers. >> miles, i want to play for you a soundbite. mitch mcconnell made waves this week when he mentioned candidate quality why -- listen to how fox news, sean hannity, took that statement. >> you don't hear truckee schumer complaining about candidate quality in pennsylvania. how about you get out there, mitch, and fight for your team? what is your agenda, mitch? would you rather sit by and watch helplessly as democrats lie to your face, pass another 500 billion dollar green energy boondoggle next year or is it

that mitch mcconnell hates donald trump so much that he would rather see trump endorsed candidates that lose? he thinks it might hurt donald trump? his time as a leader needs to come to an end. >> miles, what is your reaction? >> wow! when shawn is up there saying that, that means the trumpers are worried and they should be. they should be worried because, when mitch mcconnell says candidate quality, but he is really saying is that they have a raft of anti-democratic candidates that are potentially a terminal threat to the party. i think that's the reality that he's grappling with, but i will put it asterisks on that, cory, and say that mitch mcconnell i know is very strategic. when he speaks to the press, he doesn't do it often, and he doesn't do it offhandedly. mitch is trying to lower expectations to raise money to try to bolster these candidates. again, they are worried about the caucus of crazies that

opponent here in just a moment. first, make your case for why you are the best choice? >> first off thank you for having me on this afternoon. the choice is very simple. i'm the only one in this primary who's been able to win our state as a democrat. i flipped the seat back in 2018 by over 1 million votes. 20 points. right now, we know that in order to take on ron desantis we need a winner we need a fighter we need a champion for the people. as our only member of the florida cabinet i've been taken on -- for the last three and a half. here's the overturning of roe v. wade is essential, not only in this primary but the general election. and we're going to win in november, please make sure that we have a female at the top of our ticket. 100% pro-choice democrat. that's the only way that a woman of the republican party or independents here in the state of florida are willing to cross over. i am our best shot at taking the sky down and protecting democracy not just here in the state of the florida but the entire country. >> we've made abortion rights a

big part of pitch to voters. you're still likely gonna have a republican legislators, how will you make any headway on protecting abortion rights in your state? >> first of all on day when we would be declaring a state of emergency for women's reproductive health care. doing exactly the opposite of what ron desantis did. he removed the state of attorney andrew warren from office two weeks ago. make sure that we are not prosecuting doctors are any women who happen to have an abortion after 15 weeks. to be able to stop any legislation that goes further, which is where rhonda scent is wants to go. he wants to have an all out abortion ban here in the state of florida. second i've been working with attorneys and with additional members on the ground with grassroots organizations, working on a new constitutions amendment because unfortunately the florida supreme court in a chief judge who was appointed by charlie crist when he was republican governor, is going to take away that right to privacy and for women all across the state of florida.

making sure we have a new constitutional amendment, going on the 2024 ballot and of course you cut off the head of the snake the snake eyes. when you get rid of ron desantis, you have an opportunity to get back into legislature show imperil evidence and data of what has been happening in our state since that 15-week abortion ban has gone into impact in our state. we've already seen women suffering today. >> what about the don't say gay law. what would you do with that? what would you say change about what's being taught are not being taught in florida schools? >> we are seeing, not at her kids are back in school. teachers are teaching again the impact it's had not only just on our students but also on our teachers. when we have a new commissioner of education have an entire new board of education, will be able to start reversing a lot of these policies, because look my stepmother came out to me when we were in high school. the damage that is getting done to so many of these kids, making them feel less than, and making them feel marginalized, it's not the direction of our state. we need to make sure that our teachers are teaching, but also

making sure that our kids feel like there's a state and learn -- we don't need our suicide rates to be going up. but they are because of loss like this. and putting these children in harm's way, because it may not have resources in a support system to go back to. >> really quickly, if you get blocked by the republican legislature in your efforts to do this, would you put in an executive order to take away the floor? >> yes. i would utilize all the authorities given to me and the executive office and looking at ways to use my executive powers to protect our kids and teachers. we are seeing on both sides of this. i know as our democratic governor, we'll have an opportunity to really reverse not just this law, but our anti protest laws. we're banning books in the state of florida. we are not teaching history in our social studies classes. we are losing teachers here in our state every single day. we have a teacher shortage, because we have a shortage of respect and pay for our teachers, and that must stop on

day one. >> nikki freed, thank you so much for your time. i'd like to turn now to fareed's opponent in two states democratic primary. charlie crist former republican -- a democratic number of congress. welcome in. thank you so much for being in. i asked her democratic opponent the same question. make the case for why you are the best choice to beat ron desantis? >> i think we have the best chance to win this thing. i think it's electability and experience, corey. after all i've been the governor of state of florida already. i've been the attorney general of the sunshine state. fighting for civil rights. also, on the last elected commissioner of the education. protecting teachers rights. protecting public schools. making sure kids get a great education. we are the third largest state in the country, and our teachers are being paid 48 and 49 thought of 50 states. that's embarrassing in appalling. that's what desantis has brought to florida. florida deserves better than that. we need to protect a woman's

right to choose. i'm the only candidate in this race as governor who has actually vetoed an anti-abortion bill. i've got 100 percent rating from mayor, all from planned parenthood, and on the first day of the second kristen ministration, i will sign an executive order that makes sure we protect the women's white -- right to choose in the sunshine state. it's imperative. >> respectfully, congressman, you lost a senate race to mark -- he lost a governor's race and a senate race to rick scott as a democrat. why should voters trust you lead? >> because i won state -- three times. i want to ask government, attorney general. i have one as the commissioner of education. my congressional seat on the first democrat to take that seat since 1955. i can reach across the aisle. i can bring people together. we can win this thing. that was in the tampa bay market, the largest media market in the state of florida. i'm ready for the job.
