joining us this hour. tonight, polls have just now close in new york. home to seven consequential primaries into special elections that may tell us a lot about the role abortion will play in the midterms. steve kornacki joins us at the big. board florida political girl, mark caputo is here as for the democrats choose their pick to take on governor ron desantis. plus, breaking news tonight about the top secret document trump had at mar-a-lago, information being called quote, among the most sensitive secrets the u.s. ole. donald trump reportedly wouldn't show some of the material, even to some top eight. one of the washington post reporters who broke that story, carol lanning joins us live. the jury finds two men guilty of kidnapping -- as the irs -- because of threats from the far-right. we start tonight with what you might call a quintessential new york moment. >> --

i will take you out. >> you can take me? out how are you gonna do that? >> watch. >> that would then republican candidate for new york governor, carl palladino threatening to take out a reporter way back in 2010. if you follow near politics over the last decade or so you may remember carl palatine oh, he became nationally famous during that race. thanks to a host of scandals. most notably, for sending racist, sexist and bc audi laden emails that were too graphic for me to describe. palatine all went on to get crushed in the governor's race. he lost by about 30 points. now both new york and florida are holding primary elections ahead of this year's midterms. one candidate looking to make a comeback in those primaries is none other than karl palatine oh. this time, palatine o is running for a congressional seat in western new york. because the republican primary in the year of our 2022, he has

a real shot at winning. even as he begins to make the kind of outlandish statements that lost in that governor's race a decade ago. recently, in a radio interview he was praising rate all -- eight of health. nursing he's the kind of leader we need today. and just last, week he called for merrick garland to be executed following the fbi search of donald trump's florida home. carl paladino it's not the only scandal played republican on the ballot. nbc news projects that matt gaetz is sending off his chat -- despite the fact that gaetz is being investigated for potential sex crimes, including the alleged human trafficking of a minor. in the final days of that campaign, congressman gaetz suggested it was an fbi informant -- which to be clear, is considered a very bad thing. but honestly, truly, some of

the most important raises tonight are on the democratic side. there is the race to try to replace florida governor ron desantis, nbc news projects charlie crist has b in florida agriculture -- nikki fried for our democratically for governor. the two candidates have been blasting each other over their respective ties to republicans and parties -- chris -- of former republican -- and then a democrat in 2012, criticize nikki fried -- and working with congress when matt gaetz. and then there's also the democratic congress race in florida -- [inaudible] and then the race to fill -- maxwell craft has prevailed over a crowded --

to win the democratic primary. at age 25, he'll be the youngest member of congress should he -- in november. he'll also be the first member of generation z to enter congress. and then of course, there is -- earlier this, year a court battle over redistricting essentially sent new york's congressional map into state appear chaos. now, in new york's 12 congressional district -- jerry madeleine has been forced to enter a primary against -- carolyn maloney. two sitting chairs of two very important committees forced to face off against each other's because of distracting. that kind of dynamic is playing out all across new york state. in new york 17th district -- democratic congressman sean patrick maloney and -- jones, were almost forced to run against each other as well. congressman jones ended up agreeing to run for congress in

a different district, when they didn't have an incumbent. which was -- but now, both of those incumbents are watching -- against different appointments. maloney is facing a [inaudible] she has the support of -- cortez. and jones has lost an out wide open primary against a bunch of chap -- and dan goldman, the former house -- on top of all of that, there's also us federal general election for a -- district in new york. former new york candidate for government -- is facing off against pat riley in a race against -- many are expecting to be on a test around the democrats messaging around abortion and abortion impact on the public

in candidates -- heading into november. pat ryan -- with yard side like this one that says choices on the ballot. like i said, there is a time to get into tonight. maybe even -- steve kornacki is getting the first results from new york. my friend. >> alex, yes, we're getting the quickly here. in that special, action -- we have a ton right now in the 12th district. -- each in the house for 30 years. both elected in 1992. pitted against each other. you can see -- with a lot of votes -- a 2 to 1 advantage here for maloney. we're looking at nearly 30,000

votes, here they've been reported out in this district again. -- for folks in omaha, i'm -- he's represented the upper west side -- maloney has represented the upper east side of manhattan for the last 30 years. the two sides were merged in the district. there's also a -- who would run against maloney a couple years ago. [inaudible] they suggested nadler might be pulling ahead. that's what we're seeing in the earlier -- i say, early with this a substantial amount of votes to begin here in the 12th district. -- nadler has advantage -- there is some complicated dynamics in the tenth district. the democratic primary, we talk about manhattan, and a little bit of brooklyn as well. daniel goldman, though. you'll remember, him the lawyer of the former president --

he was in the impeachment proceedings of donald trump. they spent a lot of that money here. and he's -- just over 1000 votes. running in second here. jones listed as the incumbent. he was actually elected to a district -- in the hudson valley, because of all the redistricting in new york. he ended up moving to and running in this district. there are no constituents in this district who jones currently represents. he's listed at the incumbent, but this is an entirely new district for him. he's an entirely new congressman for the constituents in this district. and he's running in third here -- [inaudible]

and i'm just checking in to see if you have any numbers. we don't in the 17. and i'm just going to look to see. we do have our first numbers in the special election here. let me get to that. it's gonna take me one second to call it up on the screen. but let's get to the special election here. here we go, okay. we are getting our very first report here -- so we can get a sense of where this is coming from here. the republican here, okay, now we have a ton of votes here. i'm guessing we just got -- what just happen is the democrats here -- holster county executive.

and so it was just reported in all-star county. it is the single largest -- of the district. it's about one quarter of the district in terms of population. one quarter of the district in ulster county. the most democratic -- and pat ryan is the all-star county executive. this is tom. base the numbers that you just are reported in older county, this is the -- and absentee vote. this is important, we always talk about the big split and we look at democrats versus republican races. the early absentee vote, vote by mail, is the strongest -- that is what was just reported for ulster county. i want to give you -- alter counting, in the 2020 federal elections went for joe biden with 60% of the vote. overall biden won this district by two. if you are -- trying, you want to be running above biden's number.

, you want to get a few points above 60%. that's where -- he just got a big boost from the early and absentee votes. that's expected, as i said. democrats do best with the early and absentee. but, one thing i can tell you by cans paris, in this same batch of -- in 2020, joe biden got 77% of the early absentee vote in all-star county in 2020. ryan is getting basically 80% of the early absentee in holster county -- what's gonna happen, is there going to start counting up the same day votes. and in the same day vote it's only vastly more republican -- the ryan number is going to come down and the -- ryan wants the land above where biden ran in 2020. there are other parts where --

[inaudible] in this initial big batch of votes, from the biggest county in the district, ryan is getting the number he wants to get. he wants to be a little bit better and biden, he is better than biden in the early absentee component. let's see what happened with the same day votes when it comes in from the rest of the district. and let's check back to see if we got more number from the -- that's mainly we're getting right now. again, i'm just trying to see. they're not lighting up. trying to see where the of the county's. it's sullivan county. and again, to give you an example, this is sort of how it works here. mola and they are all running at the trump number already in sullivan county. and i think we're looking at early absentee here. i think marcus molinaro is expected to outperform trump and some of the parts of the district. this could be an example of that. so again, in the two counties, ulster county and sullivan, we

have numbers -- dutchess county is the second biggest county in this district. and it's where marcus molinaro is the county executive. this is going to be two, because joe biden carried dutchess county -- joe biden carried it in 2020. this is where marcus molinaro, because he's the executive, -- he's won elections here before. he's definitely expected to improve on donald trump's number in dutchess county. it just makes it that much more important for brian in a place like -- to outperform what joe biden did. so again, no numbers yet from duchess. real key question is how much marcus molinaro can outperform trump. just checking back, in again, basically they got a big chunk with that early absentee with ulster county. the number should be coming in -- >> i've spent time in the 19th at town halls when the antonio --

was representing his county. i could tell, you -- it is truly an obama, trump, biden county. for that reason alone, it is earth hour tension. -- steve kornacki, thank you as always. we'll be back to you we have more news. now i want to turn more -- market, poodle who's in florida. mark, let's talk about the headline, news which is the democrats have picked their nominee to head up against ron desantis in the fall. what do we make of a crist, given the fact that he's a party hopper? someone who is well known to floridians. what do you make of the arts here? well i'll tell you why democrats think of the odds. both consultants, grassroots activists, lawmakers, and former lawmakers, all democrats, some reporters, some for your supporters. we spoke to more than 23 -- none of them give charlie much of a chance. he said to me that basically

the power ball election. hey, we still have a chance. the chances of winning the average parable are one in 200 million. -- >> can't win if you don't play. >> this is true. you miss all the shots you don't take. so, charlie crist is taking a shot. this is his second go around for governor as a democrat. it's the second time that he has defeated a woman in the primary, in this case it was nikki freed who is the only statewide elected democrat. now, if things go as democrats fear, again if they go as democrats fear, if charlie crist loses to desantis as the polling indicates any other cabinet members who are all democrats, or underfunded for running against incumbent republicans. if they lose, then no statewide elected democrat will hold a seat since inception. it's a good idea of how

terrible the democratic parties fortunes are here. he is sitting on at least 100 and $40 million, cash on hand in the bank. we've never seen that before here or in any state for anyone running for governor. national democrats, understandably so, aren't so keen about playing florida. they're not really interested. and president biden's poll numbers aren't doing much favor for democrats, that will include charlie crist. now there is a potential bright spot for democrats here, she won against token primary opposition. she will take on senator marker revere and the general election. you are going to see democrats put their hopes in eggs in that basket. >> i do, it is probably worth mentioning that popularity of governor desantis, who we talked a lot about last week in policies, they seem to be resonating with conservatives in the state. he has a new ad out today where he is pretending to be doing some cause play as american top cop gun, riding a cider jet,

breathing -- it reminds me, a lot of us who are old enough to remember of michael dukakis and his 1988 campaign when he sat on top of, but was it a military tank? is there anything that desantis can do to support between now and november or do you think, the days of florida being a swing state are being completely over. this is the, i guess the petri dish for a national republican policy and for a new kind of conservatism it sounds like. >> as for how desantis, i can't say how the ultimate races go to shake out. i can just say that there is a reason why democrats are really worried, it should be pointed out that yes, he was a jagged officer, he was a warrior. nevertheless, no difference between him and michael dukakis is that desantis is quite a brand for himself in the party, taking on the press, attacking the quote unquote corporate media, even though it certainly

does -- where he built his brand and got present trump's attention which in turn helped him win his primary in 2018. unfortunately, the governor -- the fact is is that desantis has captured the hearts of republicans in florida. increasingly nationwide, a potential 2024 primary, he is still on top. he started to surge over desantis after the mar-a-lago search warrant that was executed by the fbi that is rolling around president trump. i don't know how long this is going to last, but for the time being president trump is telling us he feels pretty good about this. the legal challenges are starting to come all-round him. >> we'll have much more on those mounting legal challenges. mark, national political reporter, thank you for always for your time tonight. we have some breaking news from the primaries this evening and from the elections this evening,

cutting off your nose to spite your face. pressing the button on self-destruct. you can call it whatever you'd like. on monday, two weeks after the fbi executed a search warmed on the former president's palm beach estate, donald trump filed a lawsuit asking for the referee's review of document taking from mar-a-lago. for that review to be put on hold until a third party, which called a special master, is appointed to review the

material. the now lawsuit, trump said he cooperated perfectly with -- and the national archive throughout the whole mess that it began in january 2021. the law shoot states close, all facts -- show that there is complete cooperation between president, trump his team in the appropriate agency. it even include a quote from donald trump himself. why raid my home with a platoon of federal agents when i have voluntarily cooperated with your every request? >> are you sure about that? last night we learn from the new york times at the national archives recovered more than 150 classified documents from trump's florida home in january. which was squirrels away and 15 boxes of documents. we also learned that trump personally went through those documents before he turned them over. in a bid to somehow help the former president, right-wing media -- sullivan published a letter from the national archive to one of trump's lawyers.

it stated me. tenth solomon hyped's letter is evident that somehow biden has fixed the and pei on trump. as it turned out, sullivan was shooting himself or rather, donald trump in the foot. for starters, this letter from the national archives confirmed the new york times reporting that over 100 documents retrieved by the government in january from mar-a-lago, that they were marked classified. the national archive has detailed it was specifically over 700 paces of classified information, just hang out at mar-a-lago. included in some of these were documents for some of the highest level of classification including special access program material. which, even if you have top security clearance, you still need additional clearance to see that kind of document. the letter, again, the letter somehow meant to exonerate trump implicate biden, it also confirmed the trump and his crew had been dragging their feet for weeks. asserting bogus claims of

executive privilege in an attempt to delay the document for being handed over to the justice department. but while the archives retrieve the boxes of documents in january, the fbi and the doj didn't get access to the contents of those boxes until the month of may. donald trump clearly has a different definition of cooperation than most of us do. but that is not all. in june, when the justice department officials went to mar-a-lago to ask donald trump, hey, are there any more classified documents lying around? trump's former crossfit lawyer said -- trump had handed over all the documents. she signed a statement saying, yes, that is the. nothing else to see here, folks. but even after the visit, even after trump's attorney swore there was no more classified documents and mar-a-lago, double pinky swear, the justice department was not convinced. so in august 8th, the fbi executed a search warrant where they found, you guessed it, more documents at mar-a-lago

marked, top secret. the new york times reported late last night that infect federal agents in total retrieved over 300 classified documents, with hundreds of hundreds of pages of classified material from mar-a-lago. that record of -- and foot-dragging, and false statements is apparently donald trump's definition of complete cooperation. and we have breaking news tonight about that supposed cooperation. the washington post reports what happens when archives first through the darkness of january. quote, would employees began opening up and sifting through material, they noticed an immediate problem. the boxes of ride without any kind of logs or inventories to describe their content, according to a person familiar with the recovery. instead, they contained a hodgepodge of documents including some did not even come from trump's time in the white house. but some of the white house records it obvious markings indicating they were classified.

and pc news has not yet confirmed this reporting. the washington post report continues to draw chronicle how the fbi conducted its full investigation. and just how, just precisely how involved donald trump was personally with overseeing the document. quote, -- it came to an uneasy disk conclusion. the fbi proceed with interviews with others in trump's orbit including that lies -- [interpreter] and trump white house. staffers they said trump was a packer who had been personally overseeing his collection of white house record since even before leaving washington. and had been reluctant to return anything. the fbi became increasingly convinced that the former president continue to hold classified documents in florida. they could not beat determine who was involved with checking the boxes at mar-a-lago or why some white house documents were not sent to the archive. the people familiar with the episodes the trump oversaw the process himself. and did so with great secrecy,

declined to show some items even to his top aides. some material recovered in the search is considered extraordinarily sensitive, because it could reveal carefully guarded secrets about u.s. intelligence gathering methods. one of them said the information is among the most sensitive secrets we hold. around that time, trump attorneys evan corcoran and christina -- together provided the justice department with a written insurance about trump having returned classified materials. a person familiar with the matter said. they'd not [interpreter] a person familiar with the matter is that the document is of interest to the fbi, which is investigating the veracity of this claim. joining us now is washington post nationalist, -- carol, thank you so much for being here. it is breaking and it is explosive. i think the first thing that grabbed me in this article is just how deeply the former president appears to have been

in selecting these documents. what more can you tell us about that? >> what is clear in both the interviews you have done with sources and also as revealed in a lot of your records and letters that are coming out, is that the president was very involved, the former president was very involved in, at the last minute hastily chaotically packing up his documents that he sought were quote unquote his. and arranging for them to be taken to mar-a-lago, his private club and part-time residents. and that also importantly, alex, despite the former presidents claim that all he's done is been cooperative, what we found is that week after week he was the person resisting providing records. he was the person along with his lawyers asking for a delay in allowing the fbi, for example, to look over the classified records that they

found to their horror, to the shop, in a group of 15 boxes of records that they retreat from mar-a-lago. and so the president is really, the former president's verily very much at the center of this drama. and now, his own advisers, legal and otherwise, are growing increasingly concerned and have been since june. that this is a criminal investigation in which the former president is in legal jeopardy, ultimately of his own making. that is, perhaps, if he uttered over the records willingly and forced rightly, right away in january december, or in the fall of 2021. all of these times that it was asked for, it might not have morphed into a criminal investigation looking at the willful retention of some of the highest and most sensitive secrets our government holes. >> yeah, i think we should

focus on that a little bit. this is it like a former president sitting at his kitchen table leafing through memorabilia that he mistakenly brought home. you specifically say in the story that he was going through the documents with great secrecy, declined to show some items even to top aides. and when we talk about, carol? some of the most sensitive, secrets we hold. can you talk more about that? and just the amount of not only the recognition of that among the people reporting, but within trump's circle it sounds like nobody really wanted to touch this case with a ten foot pole. >> such a good point and i promise we will circle back to that, alex, about the 24 poll that a lot of people were avoiding taking hold of. your first question, about the sensitivity of this material, as described in the inventory, some of this material is top secret.

secure compartmented information. that means the people have to, as you described earlier so well, people have to have an absolute reason to know and access this information is part of their job. it has to be someone who's incredibly trustworthy and had this very high security clearance and usually secure compartmented information involves intelligence gathering methods the record that were seized on august 8th, just as the fbi and the department of justice feared, were some of those holiest of holy kinds of records. that is shared indiscriminately or handled carelessly in a private restaurant, club -- if ever disclosed would cause immediate, grave danger to national security. because it would reveal how the u.s. gathers the intelligence that it has. that includes, for example,

which allies provide us special intelligence people don't share with others. that includes, for example, covert programs that we have the gather intelligence and if those details were revealed to a form written adversary, our chances of protection national security would be greatly diminished, grave -- you asked that question about people who during this period who worked for donald trump or were in the trump orbit try to avoid being involved in this case. starting in the fall of 2021, donald trump was resisting turning over records he believed were quote unquote, mine meaning his. and the archives knew that he had a lot of records. the things were missing, and that they needed them. eventually, donald trump's team turned over 15 boxes of records. the shocker for people who had previously worked in president

trump's white house counsel office was that those records included highly classified materials. when they were notified, in particular patrick philbin, when he was notified in april that the national archives found that there was classified information in these documents, he was stunned. and he was being asked at that time to help team trump review the records. to go up to the national archives and review what had been turned over and figure out what are in these boxes, which you would think they would've looked before but patrick philbin and others backed away from this request by team trump and pretty soon the fbi was knocking on their doors asking the deputy white house counsel's, we need to interview you. you are now a subject witness. you may be a witness for us about what is going on in this holding of would appear to be incredibly sensitive documents.

this new reporting in the washington report tonight from former president trump's reluctance to head to classified documents to the proper authorities. also tonight, in the latest legal setbacks, the former president, the federal judge overseeing trump's lawsuit, he was appointed by donald trump, is asking trump to clarify the exact purpose of the lawsuit that he filed yesterday, the one asking for a special master to review the documents viewed by the fbi. joining us now is the former prosecutor and the manhattan district attorney's office, current successor at new york law school, new york university law school. rebecca, thanks for joining me. we have a lot to talk about here. so first, let me get your reaction to the washington post reporting about how centrally trump was involved in this election documents, it was shrouded in secrecy, the documents themselves were highly sensitive. what do you see is the legal and pluck a shuns of all that?

>> in order to prove any kind of crime, especially there has been a lot of discussion about the espionage act that we saw. we need to show two things. the act actually happened, and that the person possessed the state of mind that required in order to have criminal liability. so, he has both of those things. he was in possession of these documents that were highly classified and highly -- we should use the term sensitive because the criminal statutes don't refer to classification level, they just refer to something that dictates national security. he had those documents, next question is, did he retain them? this reporting is so critical for that because it essentially says that he was personally involved in this. he can't play someone else. and also, all of these repeated requests to cooperate. that makes it look like it

wasn't any accident. he was really doing this on purpose. >> the fact that trump ally released one critical piece of paper in a paper trail that shows donald trump was not willing and would not as cooperative. it really fits under these definition of -- do you think that there is any credence to implicating biden in this? >> here's the thing, when trump's legal avenues start to close, when there starts to be fewer and fewer legal claims he can make, he retreats to one thing that has worked for him repeatedly which is the witch hunt. this is the democrats, they're out to get me, this is the political motivating thing. it has worked for him politically, not legally, but politically. in that regard, i suppose there are little crumbs in here that you might, if you twist around, make it look like oh, biden, who keep saying that he is

working for the department of justice -- if you look at it a little more closely, that disappears because he actually, he was only involved in a nominal way because he is president. these documents belong to the president. so how can you approve their transferal to the department of justice without confining it? he specifically said, i'm deferring to the department of justice in terms of the legal determination of whether or not it is privileged. all i'm doing is saying, this is a determination that is made, i get my okay. he is not meddling in some kind of improper way in the investigation or if it turns into an alternate prosecution, that's not what he's doing. they were trying to make it look that way. >> there is more to get to in future hours ahead rebeca, including the appointment of a special master, even though the trump appointed judge who's looking at that, former prosecutor in the manhattan --

michigan state senator took of armed protesters yelling down at them during that vote from the balcony. again, these protests were against covid restrictions and against governor whitmer herself. president trump responded to this round of armed protest by calling the protesters quote, very good people. then, a few months after that, the fbi foiled an alleged plot by two conservative militia groups to kidnap and possibly kill michigan governor gretchen whitmer. starting in june, the groups began tactical training, firearms training in combat drills. to learn how to use improvised, explosive devices. they conductive surveillance on governor whitmer's residences -- and plan to kidnap governor whitmer at her vacation home. they thought they would avoid local law enforcement i blowing up the bridge near her home and potentially escaping by boat. they called governor whitmer a tyrant who wanted to hog-tied her and take pictures like it was a drug bust. again, the fbi detailed the

the governor there were in many ways the ideological precursors to january 6th. the first real manifestation of the idea that if a civil servant doesn't do what you want, you should go physically threatened or harm them. we saw that on january 6th with the chants of hang met -- mike pence. we saw that earlier this month, when an armed man tried to attack the cincinnati fbi field office after the fbi raided president trump's florida home. everyone from the judge who signed the search warrant in that case to the fbi agents involved, all of them are facing threats of violence from the right. even county level election officials across the country are facing consistent physical threats these days. for the crime of trying to fairly administer our elections. and then tonight, we just got the news that the irs is launching a full security review of all of its facilities nationwide because of just how many threats the irs is getting. it is all concerning and it is worth remembering that donald
