hearing though now said to determine whether an independent third party will be appointed to review some of the documents the fbi obtained from trump's mar-a-lago. u.s. district judge, aileen cannon, a trump appointee has ordered a hearing. she has already signaled that she could be inclined to grant trump's request for a special master. she has also given the doj until tuesday to file a public response to that request and present a more detailed list of items taken from mar-a-lago. julie ainsley, more with us. he thank you for joining us. let's talk more about what this means for the doj's review of documents. the possibility of this third party being appointed. >> that is right, yasmin. that would mean there would be another party reviewing these documents. of course, this is already a pool that the justice department wanted to keep a small as possible. we also know now that the director of national townsend

valant. going through the documents, figuring out what should have been handed over to national archives, what should've been classified. what should've been handled differently because of the classification. all of those things would mean that a bigger pool of people would be going through that with a special master was appointed. that might be something we would hear from the justice department and the response from tuesday. the former president trump is calling on special counsel trying to show that, perhaps, the party investigating him is biased and is targeting him. if they are going to continue the attacks on the integrity of the vacation, the justice department might want to say, have had a. we think any independent third party would come in here and come to the same realizations that we have on the fact that this information should have been kept the way it was. right now we know, we will hear more about this throughout the week. we hear more from the justice department on tuesday, and thursday from the judge himself. >> what type of person, what type of individual, julia,

would be appointed a special master? >> oftentimes it is someone who is retired. think about like, special counsel robert mueller. he had been the head of the fbi. already been tapped by the nfl to do end with the geisha. someone who is seen as independent but with a long record of doing something like this. it could also be a sitting u.s. attorney. we know that was the case when john durham was asked by barr to look into the origins of the russia investigation. in that case there was someone who had been appointed under the president. there were some questions of course a political affiliations, if it was someone currently been appointed by people in power. it is always tough to find someone truly independent when you have to have government experience but you have to be able to sit outside the government in make an unbiased opinion. of course, that is why the justice department would say their career prosecutors and

investigators are uniquely positioned to do just that. these are people who -- they should be in this position. of course, former president casting doubt on their ability to do so. >> julia ainsley, thank you. we are also following reaction to the intelligence review of potential national security damage from the documents being held at mar-a-lago. every crew -- requested by members of congress. ali is on capitol hill for us. ali, what more are you hearing about this? >> yasmin, really a range of reaction from lawmakers since this announcement that the director of national intelligence, of rural haines, will be working with the department of justice to assess whether any of these documents, these classified documents seized from mar-a-lago pose a national security threat if they were to be disclosed. two lawmakers that really that this whole effort and called for this action two weeks ago, house oversight carolyn maloney and adam schiff responded in a

statement reacting to this yesterday. saying they are pleased with this action. calling for this review to be done swiftly, to assess and if necessary mitigate the damage done. this move just in general is significant, yasmin. it is really the first connection between the biden ministration and congress on this topic. it also represents the intelligence community really knowledge-ing that there could've been some serious harm done by the fact that these documents were not being held by a government entity. they were being held as, as we, know former president trump's mar-a-lago home. we also think it's notable how republicans are responding to all of this. we've seen so many run to the former president's defense after the fbi seizure of these documents. others have remained quiet as these investigations run their course. now some are shifting the focus to how long it took the intelligence committee to actually take the documents. some within the republican party are calling within their own party hypocrites.

you. my next guest. msnbc legal analyst, barbara mcquade put out the following tweet in reaction to these developments we've been talking about on this potential of the special master appointment. seems ill-advised. what happens when d.o.d. says they have already reviewed the documents? and how to assess the damage to the intelligence community if they need to wait for review by a special master? we want to bring in barbara mcquade now who is joining us. barbara, let's just pick up on your tweet and expand on that if you can for. us what are some of your concerns here for the appointment of a special master? >> they are just practical consequences to a decision like this. regardless of any procedure irregularities here or even this desire by the justice department to try to show that they are bending over backwards to be fair there is a cost to appointing a special master here. number one, i would be stunned if the justice department has not already reviewed these documents. they've had them since august 8th, three weeks. if i haven't looked at them

already than shame on them! as you just discussed, there is a request by the intelligence community to assess the damage. that is an urgent need. to find out whether sources have been compromised, our lives in danger in overseas post that need to be removed from the positions of that their lives won't be lost? another message of collection that have been compromise that could be used in a way to send false information through those channels? that work needs to be done immediately. a special master, even working rapidly, is going to take a fair amount of time to go through all the documents. i think there are some negative consequences to national security to have to be considered here. >> where that damage assessment have to wait until the special master reviewed the documents? >> yes, the whole point of the special master to review is to say, i'm going to filter out anything that doesn't belong to the government. there are potentially trump's attorney client privilege documents. things over which he's claiming executive privilege.

he is essentially saying, the government can have those. those are mine. that is why i wanted special master. a neutral -- phone to filter out my stuff from the stuff that they get. that would have to play out before the intelligence committee received this information so they could do that damage assessment. as i said, i would be to have the force haven't left the barn already. >> any concern as to who the special master might be? >> it would have to be someone with a security clearance. the idea of a special master is you have someone who's neutral so both parties can feel like they are getting a fair shake. they are not aligned with any one party. oftentimes you will see retired judge do this. that person would have to get a security clearance, if they don't already have one. a retired judge would not have one. as we discussed, these are some of the most classified information. sensitive information and governments. pressure access program it would have to be clear to the level. i think it could probably be granted in fairly short order if someone previously had a clearance, or to someone who had been a judge.

cleacorrect me if i'm wrong, barbara, my understanding is a special master would necessarily be reviewing the highest of classified documents. possibly the type that would veto human intelligence gathering on the ground. is that accurate? when they review everything? >> i think they would review everything. it is possible that they could say, i looked -- these things once or property have a cover sheet on them that say, exactly what level of classification it is. it is all stable together in a document set. it could be that they simply review the classified documents there and say, this is top secret information. this is caa information. i'm gonna put this in this pile here. that clearly government information. if that is with the judge agrees to do. these pieces of paper were all on stapleton scattered all around with newspaper clippings and napkins with ketchup on! them they need to review each and every document. that will be litigated, as i mentioned, by these parties. >> remarked the steve ladder

university professor says the possible appointment of a special master, everyone is going to read into this order more than they should. a special master is not litigating the warrant or the search. he or she would simply making sure that the seized materials the government is holding on to our material said it has a right to possess. what do you make of that? >> yes, i think that's right. other than this delay problem which i think is a national security risk, a special master is not problematic for the government's case. they would simply review it and make a determination as to whether there was anything in there that properly belongs to the donald trump and the government should not look at. i would suspect that they would get what they need. if there is a passport in their, or document protected by attorney client privilege they will get the. the justice department had already proposed a filter team. they had proposed other fbi agents on related to the fbi investigation to do this work. this would already be a

different set of eyes looking at this. they have some independents and therefore perhaps more credibility for furnace. >> how worried should the former president be considering this line from the affidavit? there is also probable cause to believe that evidence of obstruction will be found at the providence. >> i think that is very worrisome. i think the position of these prospect documents alone, even though they are incredibly sensitive documents, it's not enough for a crime. i think it really changes the calculus when it includes a obstruction of justice charge like that. we do not know all the details. it could be the fact that when the government was asking for these documents back they got assurances back in june that everything had been turned over. somehow they figured out that there were 27 more boxes there that they went in and seized. these facts are going to matter. it could make this case different than the case of hillary clinton or others. >> barbara mcqueen, as always.

start there. >> first, i just want to say this move by president biden is life-changing for so many americans. 43 million student loan borrowers will see $10,000 cancel from their student loan balances, or $20,000 if they're repel grant recipients were low background -- 20 it could mean wiping out ballots entirely. it is important to remember the student debt crisis has disproportionately harm students of color. black and brown graduates. they are $25,000 more than white graduates. we hear from people every day who are struggling to make ends meet, especially during the covid-19 pandemic. their student loan balances have prevented them from getting a mortgage to buy a home, or loan to get a car, this can be life-changing. but, where do we go from here? we really need front and protection. accountability measures to ensure we are not in the same situation five, ten, 15 years down the road. that means reinstating

regulations that prevent failing college programs that are not preparing their students for jobs. meaning that graduates donate unable to pay for the laws to continue to be eligible for federal aid forcing them to lower twitching cost -- >> tell us about the game for employment rule. i know the trump administration killed that. i'm wondering why the current president, biden, hasn't necessarily brought it back yet. what is it, how could it help? >> one of the major drivers of the student debt crisis has been large predatory for profit college change the drawdown billion dollars of federal aid every year often target low income students of color, veterans, many single mothers trapping them in poor performing programs with bleak job prospects resulting in it and the cycle of debt. to address this problem in 2014 in the obama biden administration implemented the gainful employment rule that ensure that for profit and career college programs would

only remain eligible for federal student aid if their graduates, on average, could afford to repay their loans. this was illegally repealed by betsy devos and 2019. billions of dollars have still been flowing to the poor performing programs every year. our team at student events will be at federal court tomorrow morning in san jose asking a federal judge to reinstate the gainful employment rule. we really believe that this has the potential to protect millions of students, millions of sutures to dance from attending these failing programs. taking on unnecessary debt, we hope it encourages colleges to lower their tuition so they could pass these metrics and make college more affordable for students across the country. >> isn't it also incumbent, not just on the federal government, but these private universities especially -- not just public. but private university, some of the mostly in the country we talk about averages, it is well

above average. 60 to $70,000 a year. isn't incumbent upon them to lower the tuition cost as well? >> absolutely. we need to do more to incentivize private public, nonprofit universities all across the country to lower their called cost intuition. we need to encourage congress to do things like double the pell grant. low income students can afford these runaway tuition cause. we need the government to really re-implement front and protections. accountability metrics to ensure that these for profit college programs that are charging five, six, seven times what's community colleges and other schools charge intuition do not continue to be eligible for federal aid, unless the graduates can afford to pay their loans. >> we could have a whole other conversation with some of these indictments to some of these private universities. how much they're holding and how that could help some of these lower incomes students attend the universities.

tactics, and threatening behavior currently being employed in this community. this is literally just after nine months of working as a librarian. tell me more about what took place. >> so in february of this year we had a mom come to the library and ask about the book, gender queer. we didn't have in the collection. i told her we didn't have that book in the collection. we were not planning on adding it. and conversation went on, she wanted assurances that that book in some of the other books that had been part of the national conversation would never be in our library. i told her that i couldn't guarantee that. we are republican to two shunned, if there was enough people in the community that request of the title than we would consider putting it on the shelf. nothing spiraled from there.

more members of the communities started showing up at our board meetings, becoming louder using scripture in threatening manners. by june, at a board meeting, we had over 130 people show up. they spoke out against any books that have any lgbtq+ themes in them. they went ahead, we updated our collection policy. our collection management policy. at that time they went forward to -- starting a recall on the board movement which they are accusing us now of putting sexually explicit materials on our shelves and grooming children. >> what are these parents so

afraid of? what is your message to them? >> this is about controlling whose stories get told and what ideas get shared. access to whatever mission our community have. the fear really is they do not want children exposed to any lgbtq plus themes. characters, and seeing critical race theory, that have been put on the restricted book list. again, my concern here is this is the first time in this conversation that i've heard these very conservative groups aren't really hiding behind book bans. in order for it to be about book bans we would have to have the books. this is very much about taking

here to break it all down, tell us first, richard, about the numbers behind this half a david. >> the first thing yasmin obviously the 30 pages even talking about today. they have kept a lot of our nbc news colleagues busy. in that some important numbers to consider. here are a few have a little bit of what is behind the numbers. the first one is 300. let's start with that number. the total number of classified documents from tutorials so far this year. these are the two from this year. the first we will call the january pile, the former president gave to the national archive in january. the fbi saying that this pile contains 184 classified documents, you've been covering the affidavit released friday gave us some details in terms of what is inside of this pile. it is also what prompted the fbi to go back to mar-a-lago this month in august for what is called the second document pile from august, the eight.

this time using that unprecedented warrant as opposed to voluntary retrieval of the second set. these august documents they may comprise 116 plus new and unique classified documents. retrieved by the fbi. additional classified documents according to the new york times. nbc news has not independently verified these reports from the new york times. this week, these are the documents here that trump and the doj, in your last segment you are talking about, they will fight about with the federal judge regarding the special master. for a moment i want to go back to the january pile will more time. that takes me to the second number to look at and that is 25. as you have been discussing as well. 25, 90, to 67. all regarding national security. the words behind these top 25 documents they had top secret classification says the fbi.

this classification on the u.s. soy to kitty on intelligence can and cause exceptionally grave danger, that is the word they're using according to the senate slick committee. in addition to that there are 92 secret documents that are also in this january pile that could cause serious damage. the words again used by the senate select committee. finally you have here the on authorized location to consider amongst all of these. this last group, danger is what they attribute to the 67 confidential documents that are in there. as the fbi put it, these on authorization of all these documents is what they went back to mar-a-lago, concern over national security. yasmin and, takes us to one last number which is 45%. up to 45% of the text in this affidavit redacted, says usa today.

breaking it down for you here. of the 38 pages, 13 when we look at them were not redacted at all. 13-page partially redacted, and 11 pages fully redacted. completely blacked out. the fbi saying these redactions were needed for five specific reasons. one of which to protect the identity of civilian witnesses that could mean, former trump administration staffers. >> a lot to sift there, to say the least. richard, we thank you as always for breaking it down for us. let's talk midterms here for a moment as we march towards november. this once bleak outlook for the midterms for democrats is looking a bit better, it seems. renewed voter energy over abortion rights, as we are being told. the democratic victory for the special election in the 19 specialist right. representative sean patrick winning the chair of the dccc calling the canary in the coal mine. republicans once all too happy to bang the drum on abortion

are quieting down. arizona played master scrapping much of his extreme language from his website. chief polling robert reiner this for politico is helping us break this down and watching it for us. hopefully have some pretty declarative answers for us. talk to me about where we are right now, stephen. it seems there's no political is now predicting still the possibility of a house going republican come november. however the, senate is teetering. i'm wondering if that is because of abortion rights? >> that is part of it. i think since the supreme court's decision in the dobbs case we have seen both parties lay out the rationale for november you have republicans convinced that this is going to be an election about the economy and inflation. you have democrats convinced that this is a new issue in the issues that somewhere where they are on the offensive. we saw that play out in new york's 19th district last week.

will it be effective for that type of race in a more conservative state? >> it might be a more conservative state, but it is a slightly more liberal district. it moves north in the redistricting, one that joe biden carried by seven points in 2020, that compares to his two point victory in the old new york 19th district where the old election was held over the past week better trained for democrats. the republicans in yes steve vegas statement really echoed some of the problematic language that republicans have used about abortion over the past ten years. people like ty e. can in the missouri senate race in 2012, richard murdoch in the 2014 indiana senate race. their comments on abortion and some of these issues with rain that up costing republicans two senate seats in states that are pretty red. this is certainly an opportunity for spanberger looking at what happened in new york. a place where they want to be litigating this issue instead

officials say power generation could be impossible and could canyon dam by next year. lake mead, recreation is becoming more difficult as almost all of the boating ramps have closed. nbc news scott cohn is joining us now from the hoover dam. scott, take us there. what are you seeing? >> well, what we are seeing, yasmin is just a vivid illustration of how bad this lake drought is. how serious the problem of climate change is in general. those behind me are the intense generators were takes in the water for this hydro plants. you could see how much of the towers are exposed. if we were at the high water level you would only see the tops of them. there you see, this is not normal! yes, recreation has gotten a lot more difficult on the reservoir on lake mead. not impossible though, you can still get out there on a bow. there you start to see more of what is going on out there. the so-called bath ring which represents the difference between high water and where we

are at now. it is about 200 feet now. this is getting close to where it could be a serious problem. >> the water goes down too much, water can't flows through the dam. they can't feed water to the down river communities for agriculture and water, that's an issue. they are also not building water through the dam, which is the primary reason for the dam to exist to build hydroelectric power. the primary existence is to hold water, for agriculture and drinking in cities and whatnot -- as we get down further, it obviously becomes an issue. we are getting close to a level where we can't get through anymore. >> we are still about 100 feet away from that. we may not get to that but still it is curtailing the power that the hydro plant at the hoover dam consent three states. arizona, nevada, and california. they've already had to cut some of the power levels that come

in store or online. all right, one missouri school district, there is something new happening there for students this fall. it is the possibility of a spanking. the cassville our for school district has a new policy allowing physical force as a method for correcting a student behavior. they described it as a, quote unquote, last resort after all alternative means of discipline have failed. today show.com reporter wrote about it this week in joins me now to talk more about this. this is astounding! me being a mother of two children, i couldn't imagine being in that position hearing that someone had spanked, for instance, not child. that being said, here are the specifics of this policy.

it has to be approved by the principal, it cannot be done in front of other students. you cannot hit the kid in the face or head, of that's good -- i also says i find this curious this banking will be conducted by a certified individual. what does that mean? who is certified to do this? >> i looked at the policy which is available online, it does not specify what makes someone, quote unquote, certified to hit child. we reached out to the superintendent he just got weijia and he spoke with other media outlets and he is now dedicated to focusing on the school year. we have no idea what makes someone certified and a child. what we do know is, as you mentioned, it cannot be done in front of other students. there has to be another teacher indoor staff member president. once the spanking is finished, there has to be a report that is sent to the superintendent to essentially justify why the spanking happened to begin with.

it. i spoke to a lot of teams yesterday who are planning protests and other actions in opposition of this. saying that, the justification is this is a result of a survey that was sent out to parents teachers students and how the -- this was the quote resolve. the students say the survey was very vague, this is not actually what's students want. even if this is what parents want, they are not giving students a chance to say what they want. these teenagers at the high school are here to protest. not only for themselves, but for the younger children who might not be able to speak up. >> you cite this 2019 study. let's talk about some of the states that allow corporal punishment. 19 states in total, alabama, arkansas, texas, wyoming. missouri, mississippi. all allow some former corporal punishment. the idea that they allow it right? the question how many school districts within the states are actually implementing this type
