>> no. >> how often do you think about jessica? >> every day. >> every day. >> that's all for this edition of dateline. i'm natalie morales. thank you for watching. >> welcome to the show, and julián castro in for zerlina maxwell. coming up, a federal judge in florida has unveiled more detailed inventory list of the documents the fbi took during its august eight search a former president trump's mar-a-lago residents. plus, two former top white house lawyers are expected to appear before grand jury investigating the january 6th attack on the capitol. we will cover those stories and more across the hour. but we begin with president biden speaking in his clearest terms yet about our current

political landscape. a landscape in which the former president has developed a cold like following that was willing to storm the u.s. capitol in order to demonstrate its loyalty. one in which a major political party, the gop, is still reluctant to condemn that following it despite the clear risk it poses to our democracy. there have been few times that a president or presidential candidate has been bold enough to outright condemn a segment of the electorate. obama in 2008 call that some republican working class voters for voting against their own self interests and it's the clinging to quote guns and religion, and of course that was a private event. still, those comments, as you may recall, prompted immediate backlash. hillary clinton in 2016 said half of trump's followers belonged in a quote basket of the portals. her comments were really against her for the rest of her presidential campaign. and now, joe biden 2022 says

trump and his supporters of maga republicans threaten the very foundations of our republic. >> too much of what's happening in our country today is not normal. donald trump in the maga republicans represent a extremism, a threat to the very foundations of our republic. maga republicans do not respect the constitution. they do not believe in the rule of law, they do not recognize the will of the people. maga forces are determined to take this country backwards. backwards to a america where there is no right to choose, no right to privacy. no right to contraception, no right to marry who you love. they look at the mob to storm the u.s. capitol on january six, brutally attacking law enforcement. not as insurrectionists, who faced a dagger at the throat of our democracy, but they look at

them as patriots. democracy cannot survive when one side believes that there are only two outcomes to the election. either they win, where they were treated. that's where the maga republicans are today. >> the question many are asking today, in the face of expected gop criticism of biden's remark, is if the president's tough talk was warranted given the current threats to our democracy. let's discuss with cristobal alex, former president latino victory project, a former senior adviser to the biden campaign, and also with us is maria in a host, a pulitzer prize-winning acre, journal -- journalist and producer and the author of once i was, you find my voice and passing the mic. >> thank you for joining, us both of you are msnbc political analysts, both of you been watching the developments very closely i know and maria allen start with you. what was your reaction to the presidents primetime address

last night. do you think that it struck a chord with americans? >> well julián, it's great to see you, i'm one of those people who has been saying the democratic party and this administration needs to be more frontal. i was saying that when they passed the recent bill, they need to tamp ticker tape for raids across the country to be saying, look at what joe biden did. and i do believe that this is a moment because i've been saying it julián, since 2015, i've been saying, this is not normal. what donald trump is doing is not normal, it is very dangerous to our democracy, in terms of being a mexican immigrant journalist, i call these, and how many people see this as hate speech what donald trump used.

i think it was about time and i think it was a refreshing and it's not like i am watching everything that joe biden is doing to be honest with you. but this got my attention. i was watching and i was like, okay let's go. >> this was a boulder, this is more direct than president biden was known for. also, he made a point that he doesn't emphasize that all republicans are major publicans, but i want to take a listen to that. >> that every republican, not even the majority republicans are my republicans. not every republican embraces extreme ideology. i'm now because i have been able to work with these mainstream republicans. but there's no question that the republican party today is dominated, driven, and intimidated by donald trump in the maga republicans. and that is a threat to this

country. >> cristobal, speak to the importance of president biden making that distinction. >> it is an incredibly important distinction, and also thank you julián for having me on, it's great to be with to my favorite people today. about last night that was a really important speech but the president was reminding us about just how close we came and we still are to losing our democracy. the image that he just showed symbolically optically, think about how powerful that that was. the president of the united states to stepped away from the direction elation of independence in the constitution, debated, adopted in where he lost his presidential campaign in april of 2019, and he also watches campaign to talk about the battle of the soul of the nation. and this distinction that he made is an important one because our quality in this

country and our democracy are both in peril. we really at this precipice or this inflection point for our democracy, and have many pointed out, it was refreshing to see the president speak in such plain terms about this threat that we have. this distinction that you made about maga republicans versus the traditional republicans, i think that what we know right now is that no matter how mccarthy and others in the republican party with these maga republicans tried to present this and try to put lipstick on a pig, they do not believe in the rule of law. they are pro insurrection and these are folks who refused to accept the results of a free and fair elections and conspiracy theirs and others and pro insurrectionists and only the hand you have a few in congress and in the public that are not these extreme maga republicans. they believe in the rule of law, they believe in our democracy,

they believe in a constitution, and it was important that the president made that distinction last night, if we saw a lot of work to do, you saw this incredible summer which i think is unheard of in politics in the legislature, and in the white house, to have one important piece of legislation after another passing through summer before a midterm cycle, whether it's the infrastructure reduction act, but also the gun safety reform bill that have republicans in the chips act, which is very important to rebuild our semiconductor businesses, and factories, was also bipartisan. but as a person from el paso, i'm calling for the congress to call for the chips and salsa act. one thing short, though the presidents, right we have to push back on these extremists in those trying to threaten our democracy and work with those that we can work with. >> maria i would've played other noteworthy moment from last night, from thursday's address, and it was the presidents response to the

hecklers who are outside of the venue. >> our democracy is not perfect, it always has been. notwithstanding those folks here in the other side there. they are entitled to be outrageous. this is a democracy. y. >> there was a period in which trump was encouraging his followers to beat up hecklers, go and roughhouse them, and we remember that from a few years ago. speech had a different responses helped biden make his larger point. >> interesting. one, you are right, you are like, this is what a democracy looks like in your being loud and we understand and you have the right and that is completely right then let's go bash some heads him go and sucker punched people who are at the rally that you don't

want to see. it is a completely different tone and i think that is one of the reasons why joe biden was elected. i was thinking julián about that speech, in the many ways, it was like preaching to the converted. speaking to the base and ahead of the midterms that is incredibly important. i have been spending some time talking to some people who have been pretty adamant for donald trump and it's interesting because maybe they're not going to suddenly turn around and vote for joe biden, but they are going to say, he's making sense. even speaking to are like, pro-choice, their probe gay, very, mary do you want. they are not a support of one, six and they're tired of donald trump. even though their trump supporter, they're like oh my gosh, we are kind of tired. there's something here in this moment of momentum as cristobal was saying, just building this

derived the maga wing of the republican party, house committee member mccarthy both condemned president biden's tenure as president as well as the court ordered nonpartisan search of donald trump's mar-a-lago home for sensitive government records. >> joe biden in a politicized department of justice launched a raid on the home of his top political rival, donald trump. that is ida's assault on democracy. >> the white house has repeatedly denied that had a prior notice that the fbi's mar-a-lago search, and now we know that the fbi recovered more than 100 classified

documents during the search in the trump they have tried to conceal him removed the records to obstruct the investigation, according to the doj. that doesn't seem to matter to mccarthy, who may have unwittingly proved the very point the president biden made in his primetime address. joining me now is elie moussa, he's a justice correspondent for the nation and he's a familiar face around these parts. elie, thanks for joining me. when does president biden's speech wasn't supposed to be political. we know that many congressional republicans don't agree with that but react to the republican argument that it's not moderate republicans wanting this fall of the nation, it's actually president biden's policies. >> the problem with kevin mccarthy and his band of insurrectionist coconspirators is that they now think that the country is whatever donald trump wants it to be. and so mccarthy says that the

fbi search around mar-a-lago was an attack on democracy and you can only say that because of his warped mind, donald trump is the country. if he understood that donald trump was not the country then he would see that the fbi search of a defeated criminal was not a political search and it was investigation into a president who sold documents the white house. that is a somewhat simple law enforcement position, but mccarthy can't see it that way because he is mel the trump in his own political career in the interest of the american people all into one thing. and that's why we call them a cult. that's why we call them a cult of personality. they have raised trump up to demagogue status and they can no longer disassociate what is good for trump versus was good for america. >> the speed of the search of

mar-a-lago, a former judge unsealed a more detailed list of the documents the fbi turkey during its august search in mar-a-lago. so far, the release of the property received in the redacted affidavit have only had that into potential criminal wrongdoing by trump. how me understand what we have learned with the release of this more detailed list. >> first of all, that the man stole top secret documents from the white house. you just can't do that, he had sticky fingers that took boxes of stuff, graduate every thought might be useful on his way out of the door, you can do that. at the very least, those documents need to be in the national archives. that's what we saw from the affidavit. that is what they have already gotten back. we don't know what they are still looking at, with all we've seen is what they've already gotten back from mar-a-lago. we don't know what they seized

in the latest law enforcement actions. that's one side. the other thing that we know, and i say this directly to the trump judge who seemed confused about this, but we also know that none of these documents are executive privilege, subject to executive privilege. the executive privilege stays with the president, we only have one president at one time, and that president is joe biden. i know a big shock to trump and maga people out there, but joe biden is the president, he is the one with executive privilege, and suing top secret documents is not a privilege thing, even if trump had it. the idea that we are still in this world where executive privilege might be a thing, again, that's only thing within the maga cult trump world where the interest of donald trump are the only interest that matter. >> trump's legal team has

requested the appointment of a special master and judge can also signaled that she remained open to granting that request. she decided against issuing a final ruling on that. what do you make on her assessment that a third party would not interfere with ongoing investigations. >> she is wrong. one of the things that i tried to do so get people to understand that allowing these trump judges to burrow into our judicial system and stay there without being overtop by many more impartial appointees, is a generational problem for our justice system. drives karen is making a fully trumpian call to even acknowledge this as a reasonable argument. the executive privilege argument, the scientific term, it's dumb. it's a dumb argument. we only have one president at a

trump. don trump is not the president and they could not exert executive privilege over classified documents. it's a ridiculous argument that he's even willing to entertain it, it's troubling to say the least. will she go the full haugen actually grant executive privilege? we don't know that you would go that far. there are levels to being in a cult. you start off, it's like ice cream and rainbows before they bring out the kool-aid. we don't know where she is on that timeline but so she's kind of in for the either reading. we haven't got to the point where real, real cold the stuff is coming out of her office. and so it really stays on the basically rational side of things and does not do something provably dumb and provably wrong. >> we will absolutely be watching to see what happens with the ruling. coming up. elie mystal, coming up. a former white house counsel

-- >> he will break all this town is barbara quaid, a former u.s. attorney and msnbc legal analyst, barbara, thank you for joining me. when the house committee asked cipollone about trump's response on the capitol riot, he claimed executive privilege. do you think he will also be able to avoid answering questions on the grand jury based on executive privilege? >> i think he will not be able to big success -- successful with executive privilege. i think there's still some possibility of of attorney client privilege. there's different types of privileges, and the difference is that attorney-client privilege is not one that yields even in the face of uncomfortable questions. unless you can get into what is called the prime friday's option. but executive privilege is one that is qualified. it does yield when there is a greater need that outweighs it. we've already seen courts, including the supreme court, which has made it determined the a nation that investigating the events at least when it comes to congress, does

outweigh any interest in executive privilege. and as here, we have the executive branch investigating conduct by the invest -- executive branch, i don't think any assertion of executive privilege will fly here. but i think executive privilege will be a successful basis to preclude answers from pat cipollone. >> is the fact that the grand jury wanted to hear from both cipollone and his deputy patrick philbin, do you think that is a sign that the investigation is focusing on trump's actions leading up to him on january 6th? >> yes, i do. they are very much members of trump's inner circle. i think you don't ask these folks questions unless you are inside of the white house and looking at donald trump himself. that is among the charges will be filed, but i think they are still looking at what conversations occurred, and we know based on what we heard in the january six committee that pat philbin impassable one

we're at the heart of all of these events. for example, not only on january 6th itself, when it was pat cipollone who talked about having blood on your hands, trying to get trump to do something and make a statement to get people to stand down and go home, but leading up to, that that meeting with jeff clark of the justice department he wanted to send letters the state legislature segment we found irregularities in the elections in your state, a false statement, pat cipollone said that that was a murder suicide pact that would cause harm to anybody touch that. what was that all about? why was he here? he was also part of the december 18th meeting where we had sydney powell, rudy giuliani, and others talking about seizing voting machines and the like. hearing about that, which ultimately culminated later that night and donald trump's now famous tweet wind he said, come to washington on january six, that will be wild. he is a lot of potential information or share. >> other january six news, house committee is asked former house speaker newt gingrich to

testify about his involvement in efforts to overturn the election. they wrote that quote, you appear to be involved with president trump's efforts to stop the certification the election results, even after the attack on the capital. i think that newt gingrich news caught one of people by surprise. what is your reaction to that? >> his name is not one we've heard before. what's interesting is also the timing that it continued after january 6th. alsoi think sometimes we think t all ended on january six and that everyone was discussed about what we saw on january six, but not everybody, even the oath keepers and proud boys continue their efforts in conspiracy when it went on up until january 20th when they thought they might be able to succeed in overturning the outcome of the election. and i think that, to this day, we heard about people suggesting that donald trump will be restored to power somehow. i think he's a very interesting character, i think ginni thomas remains on the radar screen as somebody who was pressuring

wisconsin lawmakers. finding out what was going on behind the scenes is very much a part of the mission of the january six committee. >> i want to ask you about that washington post report on judy thomas, the wife of justice clarence thomas who says that she press state lawmakers and wisconsin to overturn joe biden's win there. this part of previous revelations about her efforts to overturn results in arizona, now the house january six committee previously asked thomas to testify voluntarily and so far it does not appear that she is complied. do you think the committee may not subpoena her testimony? >> i do. i think there's a tendency to treat people with kid gloves when they are well connected, the way that she is with clarence thomas, but as she has said repeatedly, i have my own career. there's no reason to recuse him from matters because i do my thing and he does his. if anything is trying to improperly influence the overturning of a election, but i think this committee needs to

failed. news four's local businesses -- force schools to move online. president biden created state of merging to help the city get a quickly in the head of fema, deanne criswell, visited the city on friday. here to discuss is lieutenant general russell honoré, he was commander of the joint task force that responded to hurricane katrina. general, thank you for joining us. you played a key role in the response to the twin disasters of hurricanes katrina and rita in 2005. what does that experience tell you about what's happening right now in jackson in what must be done to in this water crisis. >> while number one, keep people alive and keep them healthy. they have the right person in there in terms of fema administration, and at the request of the governor, they have a quick turnaround any presidential declaration which opens in top federal government to do everything they can to

provide safe drinking water for the immediate needs, then to find some sort of fix to the water supply systems so that people have safe water. most of us look at clean drinking water as a human right, but much of our water systems if we're going back decades needed to be repaired in replaced. this water system is inside of a flood zone, anytime we get high-water in jackson, the water cleanly station in sewage station in jackson floods. this is a multi-decade problem that hopefully and this administration they will fix. they need to fix the problem with the flooding, with the corps of engineers to prevent those two facilities from flooding, and they need to replace him train the staff. i think that has been acknowledged. but we have multiple layers of problems with the water in the sewage system in jackson. and hopefully as we get the

national tension for the people in jackson mississippi can have some confidence that the drinking clean water. >> and the mayor jackson said that this was a result of decades of neglect and underinvestment. one of the things that struck me also was a lot of other mayors and cities and towns of they're probably saying that that could be us. are you concerned the aging infrastructure together with both flooding and droughts from climate change will make water problems like these more common in the years to come? >> a couple years, ago i wrote a book, don't get stuck on stupid. i have a chapter on what's going on with drinking water. and we are in big trouble. just like when we see trouble with our infrastructure in airports and roads, there goes water and the electric grid. we've under invested in it if people in jackson have about $20 a month and water bills. that's the cost of getting water to your front door. the epa estimated some six years ago that it should cost

you about $32 to get clean water that is sustainable, that's treated properly, and as a professional staff, that the pipes are replaced when they need to, and that water is safe. well they're paying $20. you get what you pay for. unfortunately, a lot of the people in jackson that uses this are poor people. that's why the epa had programs that the jackson water systems can apply for the epa for grants and low level loans to replace the entire water systems. for over a decade, that is not happened julian, and so i hope that this incident, and i'm gonna go jackson tomorrow, and spend some time on the ground and try to make contact with the mayor, that they need to ask the federal government for the resources to replace as well as to protect the water system in the sewage system, because when the sewage system overflows, it goes into the pearl river and that ends up in

louisiana. it goes into the gulf. and we need to help jackson fix this, it goes way beyond the people to include the mayor and the governor, but it's on their watch to fix it and they need to hold the federal government responsible for helping the with grants and loans to protect it either rope relocate those two facilities. they're having irreparable impact on the quality of life of people in jackson. i do think fema will provide enough water to keep people safe in the next few days. >> lieutenant general russell on, right thank you. coming up, the cdc and fda have cleared the way for the latest redesign of the covid shot. i will ask a medical experts who should get this booster in one. next. next

first of all if your original vaccines, you get the vaccine, made by pfizer or moderna. if you have gotten pfizer where you're going to get pfizer when you go to the pharmacist or the doctor, where then you need to be 12 or older. for the moderna version of the same vaccine, you need to be 18 or older. and you need to be at least two months after your last shot and that goes where you have the primary -- or a single booster already. in another case, waiting at least two months and it could be longer, it could be up to six months, however, julián, if you've had risk factors like you're an older person or you're immunocompromised or chronic illness, you may need to get your shot sooner rather than later. that's four left the general.

i'm sparing you the back and forth in the controversies associated with this. i think what i'm saying is the summation of what the good recommendations are. >> when we ask about one detail there. pfizer's booster is authorized for people 12 and up while maternal this is authorized for people 18 and up. why the disparity there, and when will younger kids likely pee eligible for the booster? >> that's a good question, and the disparity has to do with some of the ways that they have tested, and reported their data. they don't collaborate really, and some of these details are left of the findings and they have to get the fda approval before they go to the cdc, but in that process, the company themselves are suggesting the 12 or the 18 you're eligibility. i think all that's going to change and they will end up in the same place with both of the boosters before too long. we're still waiting to get a

final word on people under 50 getting a fourth shot with another element to this whole discussion about when and how to get the booster shots. >> what should people do if they recently received a covid booster. somebody recently got one and they say hey, i want this, one because it's specifically targeted at this omicron subvariant. what should they do? how long should they wait? >> sure. a lot of people are going to see this new vaccine and think that it covers the omicron variants better than the original vaccines. there's truth to that. how much, better than it still debatable, but at least somewhat better. it may be people who say, i really want this one even though ahead another booster earlier. if they win somewhere between two and six months, as i'm tell you now as a physician, i think they should be eligible to get that vaccine. the reason is that a lot of us
