hey everybody, good afternoon. i am yasmin vossoughian. former president donald trump holding his first rally since the search of his home any doesn't hold back. happening as we continue to await, of course, the judge's decision on whether a special master will be appointed in the case. the president about to hit the campaign trail on labor day,

just days after his speech taking aim at trump and maga republicans. we are following new developments interest in the case of missing -- a missing heiress who disappeared while jogging. we have new details on the man who stole a plane and turned to crashed into a walmart. he is doing due in court for the first time this hour the democrats who did the impossible -- will join to discuss her historic win in the state of alaska against former governor sarah palin. you will want to stay tuned for that conversation. we begin, though, with the former president and his first rally since the fbi search of mar-a-lago. he spoke in pennsylvania for nearly two hours last night. it is coming three days after president biden's primetime speech also in the state of pennsylvania. trump lashing out at the fbi, bashed biden for going after, quote, maga republicans. trump was there campaigning for gop senate candidate doctor oz

and fbi vicious monsters, as he put it. he called the raid shame full and a travesty of justice. pretty public attack against the fbi since the raid, just a couple of weeks ago. what do you make of it? >> yeah, it's a pretty brutal attack. i think merrick garland is probably going to try to avoid getting stuck into the blood with trump on this one. he is going to speak generally, about threats against the fbi, the doj the importance of law enforcement. i don't expect them to get into a back and forth. what do you expect from the justice department is that they will continue to sneak through the legal process and through these court filings which are laying out pretty devastating case against trump, frankly. all of this is because of donald trump's decision to go public with this in file that litigation about the execution of the search warrant on his home on august 8th. if he hadn't made that move, had publicly disclosed somebody

facts the doj would have stayed silent because he has not uncharged parties to this point. he's the kind of set him up for that blistering report that and the facts of coming out from the doj in terms of how exactly he was handling classified documents. the facts are really stunning when you look at them. >> a couple things i want to take through here barbara, as we heard from the former president last night and as we await the decision on the appointment of a special master. first and foremost is this allegation made by the former president that the folks that were actually searching mar-a-lago also went into barron's room searching mar-a-lago? is this part of par for the course when you issue a search warrant? you are on this property looking for classified information that you know exist there mar-a-lago that you know would search a child's bedroom, for instance? >> absolutely. they had a search warrant for the premises. they would have described the premise and be permitted to look anywhere documents could be found.

if he had stashed them in his sons room, then the fbi has every right to go in there look. maybe it turns out there weren't tiny, but the authorization he got from the magistrate who issued the search warrant is to search the premises. if there were something too large to be held in someone's bedroom like a stolen car for example they can search a bedroom. if a documents can be stored there, they are authorized to look. this is just enough they're effort to fuel the flames. it's incredibly dangerous and incredibly selfish by don trump to say these things. he knows right now there are unhinged people who are out there and will say these things and take action. there is a pipe bomb in florida, the january six insurrectionists, the man cincinnati who brought in the organ and an assault weapon to an fbi office. it is incredibly dangerous to engage in this kind of rhetoric. >> you mentioned barbara in one of your tweets the changing defenses of the former president. right? that could feasibly cause a problem going forward. i wonder this will apply it all to the decision that the judge

-- will make when it comes to the special master it is something she is considering as well. you mention this tweet saying trump is now saying he was keeping government documents for his library. that's not what his lawyer said in june when they said they had returned them all the defense keeps changing because the conduct is indefensible. draw more on that, if you could barbara. >> one of the key elements in these cases is a willful violation of the law and so while there is a crime for being grossly in a new legend in the handling documents, it's in your briefcase, you bought a white accident. typically the consequences are not criminal prosecution, it's loss of clearance, termination, discipline. if charges are filed criminally criminally as somebody acted willfully. not only do you have this long duration, 18 months of back and forth we have now you know more than 10,000 documents at mar-a-lago. you have shifting defenses. if there was really some true, innocent here i think we would've heard it right now. instead we have things like

first in denial then the fbi planted them here then falsely saying that obama had documents on his home, then i'd classify them all, then another story if i was just retaining these for my library. you know who actually develops presidential libraries? the archives. that's who wants them back. i think this long string of changing stories bills like will fullness against donald trump. >> i wonder, barbara, as you're taking this into consideration the changing narrative of the former president as well as his attorney -- when it comes to the appointment of a special master. i would point it seems like he was leaning in the direction of doing that very thing, but a lot changed over 72 hours between then and thursday when the proceedings officially started. where do you expect the judge to land on this and what is she considering? are these things going to play into her decision? >> i think they might, yasmin. i think the more time goes by, the less there is likelihood of appointing a special master. one tell here is that, i think

if she thought the review should stop she would've said so when the motion was filed on monday. instead, she is allowed almost a week to pass while the justice department and fbi have possession of these documents. as the justice department says in his filing they have already reviewed all of the material, so it seems futile at this point i'm a special master at this point to decide what the government gets a look at when they've already looked at it. there may be an argument that she could retain authority to review these materials that have been reportedly separated based on attorney-client privilege. that's from that wouldn't harm the investigator at all investigation at all. >> ryan, what are your sources when it comes to this coming down? we know this could happen any day whether it's saturday, sunday, or possibly this coming week. we thought it would be eminent at the end of last week. obviously that did not come. do we know the hold is holdup is at this point?

>> we don't. i checked the daca just before i appeared and nothing at. and we are all waiting in anticipation of filing. >> i want to talk about ryan nichols's case, you referred to it in your tweet, i think it's fascinating. you talk specifically about how don jr.'s mccarrick mischaracterizing the sky, right? there been a lot of rallies like the value last night where folks that stormed the capitol pretty quiet quietly are being seen and talked about it's heroes instead of what they are in the actions they engaged in on that day, january 6th, capital. you could tweeted this about ryan nichols. to don jr. is promoting the false claim that a violent tenuously fighter without cops at the capitol on video right about the important violence, once again, on video, is being held in pretrial for protesting. that is not why he is being held. you actually tweeted out video

ryan nichols confessing to what he took part in on january 6th. talk to us, exactly, about who ryan nichols is and what he did despite the care mischaracterization happening from the trump camp? >> yeah released honest that they're making ryan nichols out to be a poster boy as opposed to well for a legit government overreach in this matter. there's a much evidence against him. an individual who filled himself talking about dragging politicians through the streets before he got to the capitol. he's walking to the capital with a mob timeout dragging politicians out on the streets. then he gets to the capitol and there are several videos of him -- talking about how riders need to get their weapons. he takes a canister of what -- the say was a spray sprays that the cops and the tunnel outside of january six. there are some of the more violent action that took place

there. he's doing all this well carrying a crowbar at the u.s. capitol and holding it up that's not exactly a sign of peace holding a crowbar in the air it swinging around. afterwards he there is himself again with the crowbar, the deadly endangers muffins as the government classifies it. he talks about his support for violence he says this enlisted person saying ryan nichols did this, ryan nichols did that. it is an overwhelming amount of evidence and one of the weirdest cases like possibly choose to focus on if you're going to try to make these allegations that the government is overreaching about january 6th, yasmin. >> -- the president is heading to two states crucial in the midterms tomorrow where he is expected to deliver labor day speeches in wisconsin and pennsylvania as we mark the start of campaign season. let's get ready. -- west with us the white house, what are we going to hear is tomorrow, julia? >> that is right, yasmin.

midterms season is kicking into high gear and president biden is spending labor day on the trail. he is going to milwaukee, wisconsin and pittsburgh, pennsylvania for labor related events highlighting the dignity of american workers. the president has long touted unions as being key to building the american middle class. it is covered look territory for him. the key races in wisconsin and pennsylvania for governor, the stakes could not be higher. president biden will be out talking to voters tomorrow. now, this is the third or fourth time that the president has visited wisconsin since being in office and the third time this week, alone, he had been to pennsylvania. his holiday visit coming of, course, on the heels of the speech he gave on trumpism as a threat to democracy. so while the president has spent much of his presidency

attempting to be a uniter in chief his remarks are facing chris criticism about being divisive. his top aides are pushing back on that saying that his speech was actually unifying bringing being together most americans against extreme ideologies. take a look at what -- said earlier this morning. >> the president spoke optimistically about who we are as americans. we are the greatest nation in the world. also, a reminder that we have to be intentional about being the greatest nation in the world that we have to call out hatred we have to call out this balance and if we don't our democracy is in danger. while president biden is reviving a key theme of his 2020 campaign the battle for the soul of the nation, we are heading into the 2022 midterms where tomorrow will be a key

everybody. so new today, an arrest in the kidnapping of a tennessee school teacher who was the heiress to a multi billion dollar fortune. -- the air has not been seen since friday morning when she went for a jog near the university of memphis. a flurry of activity led to an arrest. that is when a 38-year-old man was charged with aggravated kidnapping, but fletcher's whereabouts are still unknown and nbc's -- kershaw covers this story. what about any questions. they have somebody in custody but they don't know her whereabouts? i'm sure family just demonstrating as they are trying to figure out where she is in a few still safe.

what do we know? >> yeah, yasmin, as you mentioned this woman comes from a prominent family here in memphis. her grandfather was a local hardware store magnate. this is a family that is known, her community her church the school where she is a junior kindergarten teacher. these communities are hurting along with her family right now. i'm sitting at the intersection where police say that the alleged abduction took place thursday morning. while police say they have the man responsible for this, 38 year old theo abstain they say they are still searching for his mother of two and that the suspect, according to authorities, is not telling them where she is. this is the predicament that authorities are dealing with right now. there are surveillance video according to an affidavit that we reviewed which shows the suv showing up pulling up in this area pulling pastor, waiting for her to come by and then someone comes out of the vehicle according to the

affidavit and, in a violent struggle, abducted her and takes her to the car. the vehicle drives away. here's one of the more interesting pieces of evidence. according to this affidavit, left behind here were a pair of sandals. authorities say someone found low sandals, a mentally they got to police and by testing dna found in those shoes authorities were able to match the dna with the suspect who we have confirmed with memphis police pled guilty to a separate kidnapping incident more than 20 years ago. that's dna helped lead police to try and track this person down and authorities say they found the suv involved in this incident, they found their suspect but they are still searching for this mother close to three days since she has gone missing. she was out here on early morning on something we would understand is a typical app have it for her an avid honor. this family this community is still searching for an answer as to where she might be at this point. one other detail, which is

heartbreaking here out of this affidavit which we have reviewed that authority submitted in court is that they believe that this was a violent abduction they believe this victim was seriously injured and according to two witnesses in the affidavit this aspect was seen using floor cleared in or on the inside of this suv. obviously there are questions about what that evidence might have been that the suspect was allegedly trying to get rid of it certainly points to the possibility that this mother of two was, at minimum very seriously injured. again her whereabouts unknown as of tonight. >> well jesse, if you hear anything in the next two hours as we're on the air please let us know. certainly we will stay on top of the story as we know you are. jesse thank you. over mississippi, everybody. the first quarter parents of a man charged with stealing a plane and turning to crashed into a walmart. --

two pillow saturday something off a wave of evacuations as this plane terrorize the skies over tupelo before crash landing in an empty field. -- alexander has details on the investigation into yesterday's scare. >> well yasmin here in tupelo today there are a number of things that we're still watching. first this is the walmart. the walmart on main street where authorities say that pattison threatened basically to crash the plane intentionally. you can see a back open now serving customers, back to the bustling walmart that the usually is. for much of saturday morning this place was evacuated and abandoned for both employees and customers. not just from walmart, but a number of houses in the area. a number of seats had to be shut down. the chief told me that there were some thousands of people who really were, essentially, displaced because of the slit threats. now watching that, but also that first appearance taking place there were a number of questions not official still had. chief among them was the motive. they are still trying to determine what it is that they

say led patterson to hop into that twin engine plane and begin this flight of terror for many people here that would expand over five hours and mississippi. -- told me that his disposition of five hours of negotiations to cell phone that pattison's disposition was relatively calm. he didn't appear to be upset agitated towards anybody, in fact he appeared to be apologetic at times. we certainly wanted to learn more about the mindset that led to all of this. it is worth reminding you and all of our viewers exactly what took place yesterday. we are talking about just after 5 am he hopped into this plane at the tupelo regional airport, where he is an employee and has been an employee for the better part of a decade officials say. he got in and threaten crashed into this walmart then flew around for another five hours before ultimately coming to a land in that field. remember, yasmin this is labor day weekend. a chief told me that typically they only have about 15 or so officers staffed but yesterday they called in seven the

hit the campaign trail as been terms approach. when you based off pennsylvania, that's where the former president made a speech last. night it was the first time that he has held a rally since the mar-a-lago search. and bc's -- is there in pennsylvania, the site of the rally. talk to me george. among the many targets of course was the former president the doj that speed, the president as well who will be in pennsylvania as i mentioned tomorrow. what stood out to you? >> good afternoon yasmin. right now the parking lot mvp yesterday this was full of trump supporters, many arriving very early for a chance to hear by him speak. many wondered if you bring up the search at mar-a-lago, which we now know he did. he spent about two hour speaking here at the arena. he was using a lot of that time to bash the doj and fbi, he also, as expected brought up that photo released by the doj of documents. saying it was a sham, fanning a

flame thing that he would not save those photos in that array. another point, one could see as alluding are fanning flames and promoting distress to the fbi, he brought up this anecdote about the fbi searched drawers and closets, they went into barron's room which was a court approved search area of mar-a-lago. and you want to know she spent a fair amount of time just bashing president biden, and fired up as you would expect he would be after the primetime speech in philadelphia where he went after the maga movement. no surprises there. then trump sort of transition to greatest hits where he mentioned the election 2020 being stolen from him. i think when you are wondering if he would announce his run for 2024, but he certainly alluded to it. mind you he -- don't mastriano and doctor oz. it was really clear what this event was really about and what

a beer at the sky? he also comes in real contrast with so much of trumpism, this anti-immigration rhetoric. you have someone who is an immigrant who voted in the election in -- 2018. >> even the way that he explains how's family comes to this country seems inauthentic in and of itself. trying to say, okay you can relate to me that they came here legally. it seemed inauthentic coming from him in a way that he wanted to ingratiate himself with the crowd. let me read some of what you said here. trump showed everyone what a powerful tool twitter in particular could be champlain's message. -- the platform can be a library we trying to hit the flaws of a political candidate couldn't of rally in support of oz, i want to hear, on you now lost seven

social media. couldn't this kind of amplify the shortcomings? >> oh yeah. i mean he's better when he's hiding he does worse when he's up out there and you see this again and again. he just is kind of, he can't sell himself. maybe because he has never had to remember he is a surgeon. he went to ivy league college ivy league medical school, he has this incredible pedigree that is very fancy. now he needs to go out and charm people and that is kind of not what he can do. it is also interesting that i do think they are really coming up against the problem that a lot of trumpism is built on this kind of racism and in anti immigrant sentiments legal or otherwise. him saying that they were legal immigrants i'm not sure these trumpy people care so much. >> i want to play a sound from the former president last night giving this agree just, shocking claim about john john

bob elementary near school a temporary building in place. talk to us about the security and the fears and anxiousness heading into this new school year. >> well yasmin, you see some other security measures behind me. the fencing that has now gone up around the elementary schools and is going to be going up around all of the schools here in uvalde, just one of the measures that the district is taking to make parents and students feel safer. there are also more than 30 state law enforcement officers who are going to be on these campuses throughout the school year. they are actually here today, training today and tomorrow, in anticipation of the first day of school on tuesday. the school district is also hired campus monitors who are going to be watching those locks on the doors, the locks on gates. hundreds of security hammers have been installed and they are thinking about how to support students mental. they are going to be comfort

dogs on campus for the first three weeks of school. they are also working to staff up on the social workers, the counselors, to be able to provide that support to students. i had an opportunity to speak to parents throughout this weekend about how they are feeling about going back to school. many of them tell me with the new safety measures in place and with having met the teachers, having been on campus, they're willing to give the shot. listen to what one father of two told me. >> we went to school to meet the teachers and we saw a lot of state troopers out there. hopefully it helps. i heard they i having six or a troopers at school nail, so hopefully things are getting better. >> and so there is hope there, but as you mentioned those students are not going to be returning to robb elementary school, they are now going to be spread out across three

let me ask you first to react to the possible protection of what fall in winter could feasibly look like in these optimistic terms. do you agree? >> yeah, yasmin, i agree. i think, in large part, because whether they've been vaccinated, infected, or both we are getting a lot of immunity around the world and hopefully that will just kind of put up a big wall of defense even against a more potent variant which is what we all fear. >> i wonder, though. i think a lot of us wonder why should i go ahead and get this booster when these variants have already come and gone, right? i had covid a couple months ago i've been boosted twice i've had two initial shots and it was twice and i had covid a couple months ago. so why get a booster that protects you from variants that are likely not to reemerge. we haven't really seen the emergence of variants, we've seen new ones being formed. >> right, so a couple of

things. number one is because that this is a strain that has been tailor to a particular coronavirus -- be a four and five trickling last couple of weeks, it's likely that a future variant is most related, probably, to that latest variant ba.4 and five. it gives the most protection. second, it is really about getting that wall of defense so we know that all the previous shots you get protect you against severe hospitalization and death, that's a good thing, but we know that the ability to protect against symptomatic infections, protecting against infections decreases with time since the boosters and these new variants. getting that booster does give you a boost and it gives your immunity an ability to potentially ward off even asymptomatic infection which is a good thing and third remember that we're trying to protect people who can't mountain immune system and millions of americans and even more around the world don't have a hope of getting that.

my mastication protects them as something we've lost sight of over the last couple years. >> let's talk about the timing of getting these boosters which is a question i think many folks who got a booster june or may, should you then be going to get boosted once again? next week, for instance, if this booster is at your local cvs or show you waited out? who should be getting boosted and who should wait? >> yeah. yeah so this is a hop topic, by the way, vaccine opponent appointments have opened up around the country. if you want to, and you could probably go on schedule. i've many patients i've scheduled one for myself this week. number one, this is authorized for 12 and above. so if you under the age of 12 or we are still using, for the 5 to 12 group, still using the old boosters. if you're above 12 there are no other options to find this updated booster, one time shot. it needs to be at least two months since your last vaccine. that is technically what the cdc and fda said. at least two months. i would encourage people to

think about their winter and fall activities. if you have been recently infected i would maybe bump that out and think about waiting three months to four months after either vaccination or infection, or both. here is why. we know that you have got some protection from that last vaccine even though it is the older one and we know you have protection from the infection. they both decrease and i don't know if we will be able to get another booster in, say, 3 to 6 months. i encourage people to think about their personal situation and spaces. of course if you're high-risk, who is high-risk? everybody over the age of 65 and then even between 50 and 65 or people with chronic conditions. get that booster now. remember it takes about two weeks were to fully kagan. if you have a special event, let's say when the wedding, something personally important to you in late october, you may want to wait and get it in about two weeks before that really important event. so this is going to be a good conversation for individual circumstances but everyone should get a booster this fall.
