this is the katie phang show. live from miami florida. we have lots of news to cover, and lots of questions to answer. so let's get started. breaking right now! migrants arriving outside vice president kamala harris's residents in washington d.c.. this is the second time just this week, and just days after republican governor ron desantis shipped a group of migrants to martha's vineyard. we will dig into this latest political stunt. plus, the doj fights back, asking an appeals court to block a trump appointed judges

monday's funeral, president biden and other dignitaries also arrived in london today ahead of the service. we'll have a live report coming up, but first let's go back to that news coming out of washington d.c.. a bus carrying migrants arriving literally just moments ago, outside vice presidents kamala harris's residence. it coming from texas, sent courtesy of the governor greg abbott. also this morning, the roughly 50 migrants, florida governor ron desantis flew from texas to martha's vineyard in massachusetts. he did that wednesday and they have now been voluntarily transported to a military base on cape cod. where they were have access to food, shelter, and emergency services. now the biden administration is reportedly considering litigation options. to respond to desantis and his fellow governors, greg abbott in texas, and judge do you see in -- that have been transporting from new york, d.c., and chicago since the spring.

for more on all this, we turn to msnbc reporter gary live in d.c. where migrants were just dropped off. gary, let's know what's going on. >> katie, just in the last 20 minutes, we saw one single charter bus full up to the entrance in northwest d.c., and off came more than 50 migrants. they were men, they were women, their children, they were newborns. and they came off the bus, there, largely from venezuela and nicaragua were told. someone told us that they are happy to be in washington d.c.. some of them told us that they are going to new york city, where they have family, and to the veils winner in venice or, he is here with some of those aid organizations. also the migrant services from washington d.c.. i thank you for joining us. what did you make when you saw the past 20 minutes? >> i mean, i feel, very uncomfortable. i mean, just these people they have my blood, my culture, my

language. and what i ask for dignified treatment. undignified treatment isn't essential. no matter from who it comes from. so what i'm asking is just to have a comprehensive approach to treat them in a dignified manner, and also to support them. because they are not here because they want, they have been forcefully out of venezuela for political reasons. for politicization that we're in venezuela, so that's why they just came to the united states so what i'm asking, just support them, especially the united states has been very helpful for us. and, i just want you to treat them in a decent manner. >> and talking about the response here from washington d.c., and other organizations, can you talk about what the responses? they've arrived, now what? >> he has this started yesterday, or two days ago, we have been dealing with this in the last five months, i'm talking about the d.c. area. and we've been working with

ngos, local ngos to support them. but it is not enough. we need to involve federal, regional, and local authorities on this issue. i mean it is beyond the capacity of the local ngos here in d.c., so, we need the support of the local authorities because last week, the mayor of the city, launched a new office for attention of the migration, that's only good news. so now we're getting the support of the mayor in order to receive them and to defend them. >> thank you so much for, that i appreciate it. so it's not just washington d.c. as he was saying, places across the country. we saw in martha's vineyard earlier this week, 50 migrants coming off and being, per cent biplanes. and they are now in getting food, water, legal services, medical services. so this is all a part of republican governors in the south. >> our thanks to gary who has

the latest outside of kamala harris's residence in d.c.. coming up later in the show, we're gonna have the state senator julie and who represents martha's vineyard. he's gonna be here with an update on the migrants that were dropped off in march does vineyard this week. i'm also gonna ask msnbc legal analyst charles coleman, about the requests that the department of justice consider kidnapping charges. turning now to the legal showdown of our classified material seized from donald trump's home on mar-a-lago, last night the department of justice is asking for a pending appeal. asking the court of appeals in atlanta, to ask investigators -- as trump appointed judge ailing can, and lost the access. pending an examination of the documents by a special master. meanwhile, judge raymond berry is making his first move as that special master. summoning both the doj and trump's legal team to brooklyn. for a preliminary conference on tuesday. and messy news senior political

reporter john ellen has more on all this, john good morning first let's focus on the doj filing and listened it's a motion for a partial state not the complete and total appeal. can you explain to our viewers why the doj is taking that strategic move instead of the full appeal? sure, good morning td good to be good in the fandom. >> the reason that the justice department is doing this partial appeal is the immediacy of the need of the 100 or so documents that they didn't the classify cause they're marked classified what there is saying is that they're not going to slow down this process with the special master with 11,000 documents that are marked classified, but they really want to concentrate on being able to access fact that block by the judge in the first place, at the court of appeals the majority of the judges appointed by donald trump it will be interesting to see what they do. they're arguing to say that if they don't get access to the documents, those irreparable

harm to the justice department, and potentially to united states and the public in these documents, not being able to be used for the investigation and they're saying the only real -- to donald trump's case is that he is under investigation and it could be bad for him. and that's not legally pragmatic. >> you know, john, judge raymond dairy, he is the newly appointed special master in the case and he's ordered the both sides to appear in a brooklyn court this tuesday. for his very first hearing on the case. i know he is called it a preliminary conference. what are the expectations that you are hearing about what happened on tuesday? >> really, in sort of uncharted water here in terms of the topics that are being discussed besides the former president against the current governor of the united states. and this judge who has experience with national security role. having served on the former

that. >> good morning katie, so actually you can't see it were in westminster palace, and westminster hall, where the queen is currently lying in state. that is behind me, and you can see that the line here, the queue stretches right here. i actually just shouted down to a woman who is down here. she says she has been waiting in the line since 1:30 in the morning. so that is about ten and a half hours if you can imagine. this woman, i think she was in her 60s or 70s, she wasn't great spirits, she had been waiting all night, long and she was totally chatty talking about our kids with me, these are die hard royals fans and for them, waiting, which is to us feeling like a long time is a pleasure. because they are dying to see their queen lying in state, and pay tribute to her. so what we are also seeing today is a series of meetings but i became, and the king will be meeting with his basically admirals and generals, and the

the fight over the 100 classified documents seized from donald trump's home now heads to a federal appeals court. they want immediate and unfettered access to approximately 100 classified documents. a delay could cause we operable harm to the investigation. could the department be facing an uphill battle? of the 11 judges on the board in atlanta, chuck appointed six of them. we saw what happened when chuck appointed alien cannon. she handed trump two legal wins in the past two weeks. that allowed the special master to review documents seized by the fbi. that essentially blocked the doj investigation into the vetting process is complete. in her order, she appeared to say that trump deserves special treatment because he was once president of the united states. she is also called into question the doj credibility when it says that the documents are, quote, classified. trump himself also claimed that he declassified them. the ruling sparked criticism from many legal experts.

>> the decisions are literally 82 most ferocious decisions i have read by a trial judge. that is saying a lot. they are really bad. >> once again, the judge seemed to be going out of her way to favor donald trump and what he wants to get out of a litigation. >> >> i still think it is a terrible, terrible, and i will say the third time, a terrible decision. >> it is a disturbing decision. it is one drawbridge -- we have courts of appeals's. the rulings of the lower court federal judges run astray from the rule of law. >> joining me now for more is my friend, msnbc legal analyst charles coleman. charles, good morning. thank you for joining us. i want to get your reaction straight at the gate to the doj late night filing. we have this motion for partial state relief. what it could be moving forward for the doj investigation.

>> well, good morning, thank you for having me. i think that the doj is doing everything they can to preserve the interest of national security. they are moving in a way that simply underscores their previous assertions that, listen, there is irreparable harm that can be resulted from this terrible, terrible ruling if there is nothing done about what access they have to the documents that are of a sensitive and classified nature. they are moving with haste and speed. they are trying to ensure that they are able to protect those things. right now, they are remaining unprotected because of this terrible ruling. we have already appealed the special master's. there is the decision around the special master's. in addition to that, they are looking to get to the state. they are looking to try and preserve anything that they can around their ability to continue to conduct an investigation and protect national security interests. >> i want to read again from his doj filing.

the department did not hold back. they said this about trump. the plaintiffs is only possible injury. it is the government investigation. that injury is not legal. >> they went on to say that the cost, anxiety, an inconvenience of having to defend against the prosecution cannot be considered irreparable in the special legal sense of the tour. you are a trial lawyer. what are the chances? the court of appeals could agree with the doj, they could give this day of relief. they could allow the access that they are seeking. especially considering that six of 11 charges on a court were appointed by donald trump. >> katie, i think that it is fair to say that this is a long shot for the doj. they do have a puncher's chance. you have just laid it out. they really made a strong argument that there is very little prejudice to donald trump and his lawyers by allowing this decision to take place. they really put forth a strong argument to say, listen, they

don't really have a strong pathway through the law and order to actualize this. there's very little prejudice. it leaves the appeal of court with a decision. how do we explain upholding this decision by the lower court? that is gonna be the challenge. i do think they have given themselves as much as they can. it is a very wonky decision that they received from the trial court. it is a hurdle. you almost have the appeals court. it has been appointed by donald trump. that in of itself raises questions about how impartial these charges are. we know they should be. they might choose to overturn a lot of the other verdicts. -- >> charles, i want to have a little bit less than a minute left. i want to ask you about this special master, judge raymond erie. he has summoned the doj in trump's legal team to according brooklyn for the first

preliminary case. he has until november 30th to sift through documents. what do we know about him? for my understanding, both sides agreed to him to be used. what might he be looking for when reviewing these documents specifically? >> katie, for people who have been looking at this from afar, they have been wondering what is going on. you are not gonna have those types of questions with the judge. you are going to find that he is much more straightforward in terms of getting to the bottom of some of the shenanigans that we feel like trump's legal team has been engaging in. he has already asked for each party to lay out what their issues are. he can have a very streamlined approach for reviewing these documents as is necessary. he can deal with any of these issues out front. i think that we are gonna see a very different type of straightforward approach ms. judge. a no nonsense approach from the judge. a much more even handed approach. he has previously served in intelligence service court. as you can against there is that he is going to have a much easier time getting clearance

in washington, d.c.. this is after sending two buses of migrants there earlier this week. in total, texas has shipped almost 11,000 migrants to d.c., new york, and chicago. the ap reports that arizona has passed almost 2000 migrants to d.c.. earlier this week, ron desantis flew 50 migrants from texas to the wealthy liberal enclave as he likes to call it, it was martha's vineyard. he did so on the dime of florida taxpayers. these relocation efforts do nothing to address the problems at the border. there are new signs that using migrants as political pawns could be backfiring. the migrants flown to martha's vineyard were from venezuela. according to miami herald, some venezuelan voters in florida are now very angry with the governor. we are joined by massachusetts state senator, julie insia. he represents martha's vineyard. we are re-joined by civil rights attorney, charles coleman.

he has stayed come back with a. senator, i would like to start with you. the latest wave of migrants is now being passed in courtesy of greg abbott from texas. they are arriving at the vice president's home. what are your thoughts about the fact that this is now the third time this has happened this week? it is courtesy of greg abbott. >> good morning. look, this is a cruel ruse. they are manipulating vulnerable people. and martha's vineyard, we have been focused in massachusetts on welcoming these unexpected visitors. we want to make sure they are treated with dignity and respect. there was a tremendous outpouring of support for these migrant families on martha's vineyard in massachusetts. that really has been a sliver of good. it was once a terrible situation. you speak to the migrant families like i have. it is clear that they were manipulated. they were tricked. one of the migrants was a

woman. she sent me that she felt like she had been kidnapped. this is a pretty awful thing that is going on here. >> senator, one of these changes things about this we shouldn't stories, there is the fact that florida government desantis took migrants from east date of taxes. he put them onto planes. they ended up in martha's vineyard in that small village. that will happen on florida tax paradigms. he was questioned about this yesterday. take a quick listen to what his response was. >> how do you justify using the money from texas? >> most of them are intending to come to florida. they are coming to florida. we are taking them from florida to sanctuary jurisdictions. the issue, if you want to do it effectively, you cannot police if you have two people in a car. there are 100 different cars that come in different weeks. it looks like your cars are

like everybody else. we put a lot of emphasis on this. there has been a lot of investigation to try and figure out how this is going. >> what? that was literally my reaction when i heard that. senator, what do you make about this response that came from governor desantis? >> look, this is clearly a calculated political stunt. it is a got you moment. we have seen these fundamentally racist and xenophobic tactics used before. in the civil rights movements with the freedom rides, we have seen these same instances used in the 1960s. really, this is not about -- this was about alleviating capacity at the border, this is about helping those families. there would be a degree of coordination. actually, massachusetts has stepped up in the past to help migrant families. there was a period several years ago where we helped except a number of minors.

this is not about that. this is about maximizing attention for ron desantis and four others. it is really shameful. we are talking about human beings. these are peoples lives. they are effectively being trafficked across the country for a political gain. >> you know, charles, to the state senator's point about what these migrants have been through in terms of them being induced to get on these planes, to get on these buses where they eventually end up in destinations where they were never intending to go, there have been reports that some of those migrants and up at martha's vineyard. they were lured on airplanes with the false promises of getting work permits and having homes. they were misled about where they were going. california governor gavin newsom is now going investigating the doj to see whether this violated federal law. that includes kidnapping chargers. greg abbott responded yesterday.

take a listen. >> what we have done in the state of texas, we have followed the law to the tee. we want to make sure that everything we have done comports with federal law. we were cev written authorization by everybody that we transport. they agree to exactly what we are doing. >> i find that to be saw specht. charles, what do you think about the probe into the? there is the idea that they would be looking into a case of human trafficking or worse. >> katie, i don't think that it rises to the level of human trafficking as of yet. however, with respect to kidnapping, a potential kidnapping charge, i absolutely believe that the doj should launch an investigation. i think there are considerations that should be applied with respect to investigating something of this sort. consider the civil rights of each of these individuals. i have a lot of questions. one of where, these authorizations, where they in the native language of these individuals that were coming

from different countries? where they explain to them by attorneys? who were those attorneys? where those attorneys speaking in the native language of the people who were coming into the country? >> there are significant barriers that people have to understand. they have now been created by these people being shipped by one place to another. many of them are seeking asylum. the question is around venue. do they now seek asylum where they ultimately -- doesn't matter where they were shipped to? that is a big question. it leads to a number of different entanglements with the courts. it is quite unfortunate that these political maneuvers have put these people into political peril. they need to be safe. this has to be dealt with very delicately. i do think the doj probe is ultimately warranted. >> the state senator, thank you for being here this morning. coming up, the gop party line on abortion has been

conversation because you guys are here. we are from florida. we know sal florida very well. let's start with you, what is going on with is my green kidnapping? you may not call it that. ron desantis is taking people from texas is. he is having them touchdown for a hot second in crestview florida. it ends up with them and martha's vineyard. it is clearly a political stunt. it is venezuelans. we know how important the venezuelan voters to the gop here in florida. why risk this? you are running to maintain your seat's governor. why risk potentially angering venezuelans? >> a lot of this is about 2024. ron desantis is trying to position himself versus other republican governors, versus donald trump. they're looking at the 2024 republican primaries. this might have been an overreach. i think a lot of conservative voters understand that states like texas in arizona might be engaging in these practices. the migrants are arriving in those states.

obviously, there is a strain on social services there. an aggressive move. i think that some people say, well, we get it. for florida taxpayers to fond a very expensive operation -- >> $600,000. >> exactly. this is not chump change. to fund the job creation, to move people from texas to massachusetts, the governor had trouble explaining that. for good reason. it did not make a whole lot of saints. you introduce the cell florida angle to that. there is so much solidarity between venezuelan and nicaraguans, cubans, colombians. now i do think that the governors actually introducing some risk to his 2022 reelection process. still the strong favorite. some people in this community might start saying, hey, what is going on on this? >> i take exception to calling this a political stand. austin's mehmet oz running in pennsylvania when he lives in new jersey.

our parents came to florida under faris bryant. he was the governor of florida. at that point, first bryant, a democrat. he said come on in. make a life here. he ended up becoming a member of congress. i am sitting with you here on this program talking about these issues. a democratic governor gave our families the opportunity to live out the american dream. these are citizens who saw legal asylum. this eagle man, rhonda scent is, he is a cody engaged in human trafficking. that is what this is. to use human beings, more devilishly, children, innocent children, to use them as political pawns is something that is beyond politics. it is even beyond legality. it disqualifies them as a human being. unfortunately, it is where aspects of the republican party are right now. until that changes, our country is not going to go on the right path again. >> we saw that coverage. right now, that is the breaking news. they are ending up, courtesy of

the release of amazon's the rings of power series drew outrage from some fans who were angry at seeing diversity in middle earth. i have to point this out to the naysayers. these characters, mermaids, stormtroopers, elves, they are fictional, i hate to break it to you. they are not real. the idea that evers versions of them are not realistic, i am not buying it. >> i do want to talk about all of this. i am glad to welcome in chanel. she is an entertainment writer for the route. chanel could, morning. thank you so much for joining us. i want to focus on the positive. i have a little girl, she is seven years old. anytime that she's an asian girl on the tv or in a movie, she gets so excited. is there any better way to show that representation truly matters than those adorable videos of those little girls who see an aerial that looks just like them? >> there is no better way. first off, katie, thank you for having me. you know, they are seeing themselves in those movies.

that only solidifies the power of imagery. it allows little girls of color and little boys to specifically think that -- we are talking about hallie bailey, if this an eight beauty, prestige, admiration, i adoration, if that is possible, if that lies in wait for that person, what overwhelmingly positive thing is waiting for me? >> we have heard from other actors of color. they face similar examples of hate. chanel, what can be done about trying to totally eliminate this kind of toxic fandom that is out there? >> you know, i am not a disney executive with inside knowledge. i am not a strategist who could accurately advise on this. i do think that is needs to have a plan of action. i think that studios in general need to have a plan of action to preemptively denounce racism

and harassment. that is immediately following the announcement of these actors of color. they are taking on these very prominent roles. they also need to emphatically proclaimed their support. they have their ongoing support for these actors. they work very hard to work to where you are. they worked very hard with their skills and talent to tell the best story possible. >> chanel, i have less than one minute left. i did want to follow up on that. the reality is that these big blockbuster companies, they are putting a lot of money in. they are backing all of these actors. what else could they do other than what you have already discussed so far to make sure that they are protected? they want to make sure they are actors, their forward facing to the viewing audience. they are protected before the movies come out, even during the backlash. >> yeah. i think that they need to, you know, again, have a firm stance. make it very clear that hate and racism have no place in the fandom. hate and racism are both
