political outsider in the vein of john mccain. let's be honest, if john mccain as a child had been dropped on his head and into a vat of acid, and you see why republican -- trying to change the conversation. mitch mcconnell knows that candidate quality really does matter. even when the political winds should be in his party's favor. look at the 2010 and 2012 election cycles. maybe remember delaware republican senate candidate christine o'donnell, who after confessing she dabbled in witchcraft has aired a campaign ad saying she wasn't a rich. or caught todd aiken, whose lead in the polls came to a halt when he said there were legitimate forms of rape. when house democrats got walked and lost dozens of seats in -- couldn't win the senate for republican, and i couldn't do it in 2012 even. mitch mcconnell knows political losers when he sees them. and it's clear he doesn't have a lot of hope for his crop of

contenders. joining us now is former democratic congressman, max rosa of new york. he's looking to retake new york's 11th congressional district. he joins me live. former congressman, good to see you. good to see you back in the fight to reclaim this district. i think people are excited to see run in this race. before we get into the specifics of your district, i want to play for you and get your reaction to something we heard from senator lindsey graham. listen now and i'll get your reaction to. >> i'm pro-life. even in an election year. so those who suggest that being pro-life is losing politics, i reject that. if you know anything about, man for 20 years, i've been supporting federal legislation banning late term abortions. >> you said it's up to the states -- >> is what dobbs says. elected officials can make the decisions. state or federal. i'm not inconsistent. >> the reason why we brought this up is because abortion is become front and center on

everyone's mind. it's become a huge motivating factor for a lot of the voters that are turning out some of the special elections. er i want to hear from you. what do you think about this issue and how it's playing for the voters you're speaking to? >> first of all, as a pretends to lindsey graham, he's an extremist. but lindsey graham is only part of the issue here. let's look at the actions of his republican colleagues in both the senate and the house. so few of them, in fact you can barely name a couple, i've been wanting to come out and say they do not support graham's bill. this is not lindsey graham bill for a nationwide abortion ban. this is the extremist -- amir few weeks ago, they were saying, look, this is just a states rights issue. this is a states rights issue. we all knew that there was a deeper held belief, even in cases of rape and incest. even in cases of the life of the mother. the life of the child, but they

would not support this. so it's horrible, and the one thing that we can say now is that we understand the stakes of this election. the states, plain and simple, our freedom. they are whether or not women have the right to make reproductive health care decisions. that, to me, is not a decision that the government should intervene in. and it is certainly not within the confines of the national republican party to put their foot down and say, we're gonna institute nationwide abortion ban. it is inhumane, it's tragic, it's sick, it's disgusting. all it does is reveal -- >> you heard mitch mcconnell talk about candidate quality. this become a big issue across the board, and the races that you're seeing in down ballot races, you have people who are election deniers running for

powerful positions in this country, people who are extremists. when you make the quality of the candidates? >> i'll leave the punditry to you. but what i do know is that even if you look at my election on staten island, my opponent, congresswoman -- has been unwilling to state her position on the lindsey graham nationwide abortion ban. and first, she claimed that she wasn't aware of the bill. she said, i haven't seen it, deliver it to my office. so a constituent delivered it to our office, and she is still not expressed her position on it. it reverberates around such a fundamental human right, and she's unwilling to come out and say what her position is, because she and so many other republicans look at their twice. i would be on the side of the vast majority of americans who believe that this is a woman's right to make this decision, or

go against the extremist leadership of the republican national party. unfortunately, she and so many other members of congress and the republican party are unwilling to do the courageous thing. side with the majority. >> you've seen, as the rest of the country has, and watched in horror, the images of migrants being trafficked, effectively, across state lines just for political theater by ron desantis and greg abbott. we're seeing it here in new york as well. what's your reaction to it? as a new yorker, when you see these migrants being used as political pawns in this republican -- >> we all know. use this word earlier. tragic. it's tragic, it's inhumane, i think it's utterly disgusting. but there's one other thing that we're not paying as much attention to. in the case of ron desantis, it demonstrates how feckless and ridiculous and ineffective of a leader he actually is. this is a guy who was so horrified by the fact that greg abbott was getting more

coverage than him that he decided to use millions of dollars of public funds to charter a plane just so he could enter the national debate. i think sensible americans, and that's the vast majority of human beings, understand that human trafficking, kidnapping people, is absolutely wrong. we also, on the same, hand can come together and execute comprehensive, sensible immigration reform that involves, yes, of course, a secure border, but as humanity and compassion built into its very core. that's what this country is all about. and it's not too much to ask. >> let me ask you about the midterm elections. you're specific rates here for a moment, if i can. what have you learned this time around from your previous election? as i mentioned -- it back in the fight. when you bringing this time around that you didn't

first-time? >> here's what i understand. the stakes could not be higher than where they are right now. continue and continue. starting from the beginning of 2021, when we saw the republican party actually spit on the constitution. the very same constitution that i swear to uphold and defend as an army officer. i've watched people get hurt and combat fighting for it. they don't care, because donald trump said something -- over the course of the last two years. the bipartisan infrastructure bill, never would've happened. comprehensive gun reform never would've happened. we never would've seen the massive, massive bill to finally do something about climate change. all of these things, many of which are bipartisan, never would've occurred. so the stakes are incredibly high. i think that people across the country, to include in my

trump are entering a critical phase. this week, we learned -- letitia james rejected an offer from trump's lawyers to settle her civil investigation into trump's business, setting the stage for a long awaited lawsuit. it could be a family affair. sources tell the new york times that the ag is considering suing at least one of trump's adult children. also this week, and a exclusive interview with the washington post, fulton county district attorney fani willis -- investing getting trump's

interference in the 2020 elections says her team has hurt her-able allegations that serious crimes have been committed, and she believes some invite the vigils may see jail time. she told the paper, quote, the allegations are very serious if indicted we, and people are facing prison sentences. let's break this down with -- host of the woke a f daily podcast -- caitlin burns, an msnbc columnist and writer for medium. it's great to have all three of you with us. danya, i'll start with you, with trump's civil case here in new york. what does it say that the attorney general's case, that she basically refused to settle pursuing a case against a former president, setting a very high bar. but does this mean she believes she has overwhelming evidence for a conviction? >> yes. i think that tissue james does not make moves that she can't backup. and the reality is, if you've been a new york finding

considerable amount of time, you know that donald trump is a fraud. you know donald trump has used his businesses as tax shelters and as a way to avoid paying taxes. he said it himself when he was running for president. i'm smart. that's why i don't pay taxes. that's what he told the american people. so i believe that over the course of her investigation, she has found more than enough information that will bring him down. and his children, who have of once -- one time or another, and ceo or some kind of adviser for the trump organization. >> francesca, and trump faction, it begs the question. if trump believes that he did nothing wrong, why would he attempt to settle? >> absolutely. or why would he plead the fifth 400 times in this case? why would eric trump plead the fifth 500 times? this is what he said. the fifth amendment is for people who are guilty and mobsters. i think we got both on our

hands right here. but of course, everything that the maga-verse right does as a giant projection. i'm gonna go on a limb and say i think one of the people who's gonna be sued as eric. he tried, look, he's been the most loyal. it's like the three of them are drawing straws and tiffany -- don't look at me. i love that slash hate it. look, i don't know how close we're gonna get to trump himself. but for sure, someone needs to be held accountable. here is what we have to say about the lawsuit if it comes down to that. it's all gonna be money anyways. i don't know if people are seeing prison time necessarily in this case, specifically by the trump organization -- the fab sad thing about it is that all this money, no matter how much you train this family, they turn around and drain their base. -- not donate $100 a month. what? it's very sad. >> it's a moneymaking enterprise that has its core.

what do you make of -- francesca's got her money and eric. but broadly speaking, what do you make of this? >> i mean, is anybody surprised by any of this? not really. we kind of knew who the trumps were going into the 2016 election. this is sort of old hat now for this new version of, you, no maga republicanism. but nobody is really surprised that his kids are wrapped up in this. they are pitch will attention seekers, and if anything, this puts their names in the headlines a little longer. >> daniela, let me move on to what i think, in my opinion, the more significant criminal investigation that is unfolding in georgia as i mentioned, the washington post asked the fulton county da fani willis about the possibility of trump testifying and that probe.

she said, quote, a decision is gonna have to be made, and i imagine it's going to be made late this fall. how crucial is it to get the former president on the record and under ethan bout his alleged election interference? i don't have confidence that donald trump is capable of telling the truth, whether he's under oath or not. but just the mere fact that you have someone who is willing to try to get him under oath to talk about what he did in the election. >> look, i don't think that donald trump will tell the truth regardless. i think this is what we've learned about this president. what i think is most important here, though, is the fact that there are 17 other people that fani willis is gone after. and i believe that she has enough information in front of her right now the tells us, from lindsey graham to rudy giuliani and the cast of characters around donald trump, that some of them will in fact be going to jail. we know that they were doing illegal bidding on behalf of

donald trump. what concerns me, though, as it's going to be the footsoldiers around trump that end up going to prison, and not him. so i hope that with the mountain of evidence she's been building over the last year plus, i hope that it points to donald trump. you can't have a circus without a ring master. that's exactly what he's been. >> speaking of the circus, francesca, trump's not the only republican trouble here. the washington post is reporting -- matt gates, a close trump ally, told the former white house aide that he was seeking a preemptive pardon from trump relating not to elections or anything in that realm, but to the -- oh what do you make of that? >> yeah. we all knew that was happening. and his boy joe greenberg, former tax collector, is currently facing sentencing for that. and look, i honestly think it

means he's guilty, oh which -- people have to get paid to actually have sex with matt gates, and don't do it willingly. which i think is important, for the record. but on a serious note, it's creepy as hell. we're talking about trafficking of a minor, we're talking about 17 year olds. this is someone who goes on record and tries to troll teenagers for their stances around abortion, right? i think it's sad. look, when you're put below roger stone, joe or bio, michael flynn, and all the other people that got trump pardons, that sucks for you, man. you're the guy on trump's shoe. he thinks about tiffany trump more often than he thinks about you matt gates. and that's once the air. that's not even on a birthday. but if he thinks of her birthday -- you're not i'm saying? >> kayla, i'm gonna ask you about congressman ted lieu here who sits on the house judiciary community with gates.

he says -- should remove gates from the community over these allegations. what's your reaction to that? i, mean math gaetz facing a lot of serious allegations here. and the description of what he's been involved in, horrendous. >> yeah. i think it's a very fair ask to ask mccarthy to take him off the committee. you know, back when we had a normal, functioning house of representatives, which you can make arguments over when that exactly was. but this used to be a normal course of action. but as we've seen over the last five, ten years of the new conservative right, you know, this one rule for everyone else, and there's another role for republicans. so, though the request is happened, i don't expect mccarthy to actually take any action on this. it hasn't taken any action on anybody else's misconduct

as jennifer reuben points out in the washington post, saying, quote, many in the media had a meltdown when president biden called the maga movement semi fascist. they tweeted because of his speech in philadelphia, which was to devise. the reality -- he wasn't tough enough on republicans. on desantis and greg abbott are using nonwhite human beings as props, because these bigots saw that it was possible to use them and he humanize these migrants to further their personal political ambitions. just this morning, governor greg abbott sent at least six more buses filled with men, women and children seeking asylum to new york city. yesterday, he shipped human beings. yes, shipped human beings, including a one month old baby, to the vice presidents residence and washington d.c.. jennifer reuben writes it's no mystery why shows the first african american vice president as the recipient of this stunt. this is how he chooses to spend

taxpayers money. when he's not bullying lgbtq children or forcing women to give birth against their will. at least for one of these republican governors, he might be held to account for his despicable actions. in fact, lawyers representing around 30 immigrants flown to martha's vineyard asked the massachusetts attorney general and the federal government to open criminal investigations into what they described as a political stunt. it was only when the flight was in mid air that they were informed they would be flown to martha's vineyard it rather than to boston as many had been told. and the letter to the massachusetts attorney general, where he lee and rachel rollins, the u.s. district attorney from massachusetts, -- so our office is looking at any and all legal action that we might be able to take and response to the flight. this morning, new york city --

and abbott are doing. they are lying to these individuals. they are lying to these children, these families. not telling them what is actually meeting them on the other side. not telling them where they are going, so other than the exchange of money that happens when people are being trafficked, tell me what the differences. because they're being lied, to treat it as less than human. because of the color of their skin and the language that they speak. right? so, tell me the difference. i hope that we see criminal charges that are brought against abbott and desantis and it will not be a political stunt. it will be absolutely justified for the disgusting behavior that they have. these are the political leaders? this is the possibility for a 2024 presidential run? my god! i hope that americans are paying attention to what republicans are offering. because they are not offering anything other than in humanity. >> the governors of two of the biggest states in this country don't even have something better to do than wasting your time and trying to carve out these like political stance.

francesca, do you think democrats like new york city mayor eric adams -- our meeting the moment because they are people who are actually responsible? they are doing things, not participating in these political stones that we are seeing from abbott and desantis. >> yeah, and i think that is a really important first step, to differentiate yourself from these republican governors, to say we don't condone this type of cruelty. but the reality is, is a cruelty on the border -- it has been a bipartisan consensus. and democrats have been dragged to the right by republicans for their militarizing the border, giving them even more money. this is one of the largest federal agencies that is insanely militarized. it has crazy jurisdiction. and so, i am looking for vision from democrats on actually, not just human -- which is just the lowest bar. but truly, how can we be better

this country, so we can dehumanize them without necessarily worrying about the political consequences. that shows you just how deprived of an act all of this is. kaitlan, republican governors, they sent these migrants north, like thinking -- that they were treating them within their own states. but i'm martha's vineyard, as i mentioned, and as you highlighted, you certainly know it better than i do, saint andrew's episcopal church took and 48 migrants for two days with open arms. do you think this has backfired on them in the way the republicans set out to do? >> i think it has. it is difficult because the modern right-wing media is going to lie about this incident anyway. the new york post's running headlines saying massachusetts deport migrants, just like texas did. when in reality, they're trying to fix the situation that was already made worse by the state governors. so, i think it has in a way backfired.

jones day could add with helping trump cement his credibility or build his credibility with the conservative establishment. and so, right from the get-go, they helped and they were introducing trump to republican lawmakers and powerbrokers on the right. and as we said, when scalia died, they were a key part of the group that hatched this plan to have trump publicly commit to selecting judges and it really was the start of what would become this long-lasting and very productive relationship that would completely transform the federal judiciary. >> you write that jones day and its lawyers were essential trying to stop votes from being counted in the election. talk to us about that. and what was it that they saw in this moment, in this opportunity, to have the election basically thwarted in favor of donald trump? >> yeah, i want to be careful here, and be clear, that they were not part of all of these

kind of crazy sydney powell type efforts after the election, trying to invalidate things for bogus reasons. they were not involved in that. what they were doing though is in pennsylvania, prior to the election, -- they were involved in litigation that was designed to make it harder for mail-in votes to count in certain situations. they were trying to make it easier to disqualify them based on the signature discrepancies. and they were trying to narrow the window of time that mail in ballots would be counted. jones day, they were simply litigating -- but nobody at all disputes the fact that if they get -- in court, which they did not, it would've made it much harder for a lot of mail-in votes, which incidentally, or by design, were leaning heavily democratic this is an election that very well could have been decided by just a small handful of votes and they were doing

that not because of voter fraud, but because they perceived an opportunity to exploit the tiny wrinkles in the law to help their clients prevail. >> this law firm, basically helped kill the biden administration's moratorium on evictions during the pandemic. it curved the governments power to regulate emissions. would you, based on your reporting and your investigation and research, would you consider them to be all in now on being a partisan tool for the gop, when you see what they're advocating and representing? >> i think that would maybe overstating it a little bit. i think at the top of the firm, there are a large number of very conservative and very influential lawyers that have made it their business to really transform, not just the judiciary and not just to help elect republicans, but they have a very distinct, and in some ways radical view, of the role that the government should

play in our society and there are a lot -- helping defend corporations when they do things that are bad. at the very top of the firm, the people who hold the power are very aggressive and very effective in what they are trying to do. what they're trying to do is to push the court even further to the right. >> let me ask you about the supreme court for a moment. vice president kamala harris has been calling -- i personally can't see it. how can someone disagree with what the supreme court is currently doing in its current format? >> i'm not sure who agrees or disagrees. but this is something that was designed in large part by once and future jones day lawyers. --

and again, now. he is the person who was basically in charge of selecting nominees, not just for the supreme court, but for lower courts as well. he plucked amy coney barrett for an appeals court. with a clear intent of one day. and the crazy thing to me is that now jones day, which has had such an important role in a shifting the court to the right, now has a very important practice, representing clients of both corporations before the supreme court. you mentioned the ethics thing moratorium. there is a case where a jonesdale client managed to neuter the environmental protection agency as it sought to regulate carbon emissions. there is a whole flurry of other cases that they are likely to be involved in.
