this is the katie phang show. we are live from miami, florida. we have lots of news to cover. we have lots of questions answered. let's get started. it is put up or shut up time for donald trump. he is up against a new deadline to backup his claims that the fbi planted evidence during its search of mar-a-lago. the doj gets the greenlight to resume its review classified documents. the ex presidents legal demands, are they backfiring? plus, florida state senator jason is here to talk about the escalating migrant crisis and the lawsuit that he filed

against florida governor, ron desantis. he tried to stop him from making matters worse. it is not the only lawsuit that the florida governor is facing. how much legal trouble is he in? later, another trump rally, another not to qanon. we will show you what happened when trump took the stage last night in north carolina. it is what appears to be the ramping up of his support for the far-right conspiracy theory. all of that and more is coming up. and a good saturday morning to you. i am katie fang. the january six committee just scored a legal victory in its investigation of the so-called, alternate electors. we're just a few days away from the committees next and potentially final public hearing. we begin our morning with msnbc capitol hill correspondent allie raffa, with the latest live for us in washington d.c..

good morning allie. >> good morning katie. yeah, the general six committee says that it's next. and the numbers are containing, probably last year, our convening on wednesday. while they haven't dropped the theme of the hearing. they've dropped bread crumbs on what we should expect to see on wednesday. they said that they gathered more information. mark communication with the secret service on communications and movements on january 6th. during this almost two month long break in hearings. they say that this hearing will tie up loose ends. close storylines that they started to present. in past hearings. and katy, while they start to ramp up the investigation. more doors are opening for possibly more information. into their investigation into the attack on the capitol. we learned this week that the committee secured a voluntary interview with the supreme court justice. clarence thomas's wife. ginni thomas. and while chairman bennie thompson wouldn't tell me when that interview would take

place. he said that there is no rush to have this take place before wednesdays hearing. but he said that he knows that this testimony will be significant because of the firsthand knowledge of so many topics that we have already seen in percent in past hearings. and lastly, that the committee is now having access to this thread that a arizona judge granted access to an arizona chairwoman of the republican party. access to her phone records to the committee. she was one of over 80 of these so-called fake electors that the committee subpoenaed earlier. so it's going to be interesting to see how this new information could possibly make it into this next hearing, or possibly into this final interim report that the committee is expected to release over the next few months. >> our allie raffa. thank you so much for being with us live on capitol hill this morning. so that many investigations into donald trump are heating up, could his team's post for a special master now be

united states. you can declassified just by saying this is declassified. even by thinking about it. >> ever since the fbi searched his florida home at mar-a-lago, donald trump has been contacting as many defenses as he can. throwing them against the wall just as he was six. that when you just heard, being one of the more outrageous examples. turns out though, it might not be the best legal strategy. the special master, who the trump team asked for specifically, has now given trump a deadline of this coming friday to backup his claim that
4:16 am
the fbi planted evidence. of course, for reasons the senior district judge, raymond dearie, has to demand the proof? because both trump and his lawyers have publicly suggested it. without providing a shred of evidence. trump even posted on truth social, back in august. quote. planted information anyone? and that is just one of many losses served up to trump this week. the 11th circuit allow the doj to use the classified documents in his investigation. and breaking last night, the office for the director of national intelligence said that it has resumed its damage assessment of the classified materials. for a closer look at all of this, i am glad to welcome my friend, the former united states attorney. at the michigan school of law. and msnbc legal analyst. barbara mcquade. who is at the tribune festival. and i think, you borrow, for getting up early. in texas. to join us this morning. barb, let's start off with a special master. trump was the one who won it
4:17 am
day mid -- raymond dearie. he wanted a special master. now raymond dearie is calling him out. saying you need to cash accounted for all of your defenses. so it is put up or shut up for trump. are the legal strategies here legally backfiring on him? >> yeah. it seems to be the case. so often donald trump's defense is to win the court of public opinion. to win the news today. he's thinking about today. he's not really thinking about tomorrow. and most lawyers will tell their clients not to say anything. because whatever you say can be used against you. so i think we're seeing some of that come home to roost here. the public wouldn't even know about this search if donald trump himself had not publicly announced it. and in fact. i think there is a good possibility that the justice department would have been happy to just get the documents back but he has made such a battle of it. and now, i think it makes it very difficult to get the justice department to file charges here. and as you said, it was donald trump's team itself that selected raymond dearie to be
4:18 am
the special master. and he is not putting up with any of this nonsense. he is moving things along with what he referred to as reasonable dispatch. he is not going to play games, and he is making them articulate if there is some defense of planted evidence. but you need to say so. and you can't say so just in the media. i want a sworn declamation, or affidavit. by friday. going on that inventory. and letting you know which specific documents do you say were planted there by the fbi? that is a wonderful way to hold someone's feet to the fire. and not allow them to get away with these outside statements that are just as outrageous and undermine the rule of law. >> yeah, and barb. i'm glad that you mentioned the reality. of the special master and what they're are demanding. that trump team put a declaration, on an affidavit. which is an in very important nuance to actually put interest as to whether or not the fbi allegedly punted evidence at
4:19 am
mar-a-lago. that they then purportedly took out and are using against him. you know barb, at the rally that he did last night. trump called the investigations, quote, a witch hunt. we've heard that one before. a torment, a little bit new. and several other things. but interesting lee, he didn't talk about how he declassified documents. in his mind or otherwise. did nor did he make any suggestions about plant of evidence. barb, how hard do you think trump's legal team. the mar-a-lago legal team. is working behind the scenes right now to try to control what he is saying publicly. because there is a serious legal consequence for what he puts out there publicly. >> absolutely kate. anything that he says publicly can be used against him later. i imagine that his lawyers, like all the lawyers before them. have urged him not to speak about a pending case. but it seems that he can't help himself. and also, it is part of his strategy. to simply generate enough outrage that he can win the day. and the day's news cycle. and they also think that some
4:20 am
of the things that they hear from him, and others. is that if charges were filed against him there would be so much outrage. and so much violence in the streets. that you don't their file charges against them. so it's a part of the strategy. that the lawyers would say. they don't want him speaking because one of the elements of many of these charges is the willful retention of documents that pertain to the national defense. so the classification defense is not one that holds many legal water anyway. it might sound good in public. but it is not going to be a legal defense. and anytime he talks about having them in his basement. whether they were declassified, or whatever they are. he is acknowledge that he did have them. and he knew he had them. and so all of that can be used against him at the trial. so barb of course the other big headline that we've been focusing on this week is that donald trump new york attorney general letitia james is huge fraud civil suit against the former president. his adult children. and some of his businesses. james seeking a minimum of a
4:21 am
quarter of a billion dollars in damages. and to bar him and his children from doing business in the state ever again. let's start first barbed, with a quick reminder of what trump has said about his companies over the years. let's take a good listen. >> i built up one of the greatest companies and i'm very proud of it. and it's probably nothing like it. everything i touched turned to gold. i built an unbelievable business. a great, great business. some of the greatest assets in the world. i built a company that is worth more than ten billion dollars. okay? >> barb, ten years of fraudulent financial statements among other offenses. is this yet another case of trump's trademark boastfulness coming back to bite him legally? >> yeah, in fact katie. i think all of these legal challenges that he faces. this really could be the one that finally is -- . and part of that is the fact that this is a document case. it is based on false statements
4:22 am
in one document that are inconsistent with statements and another document. and so when you have witnesses in court, sometimes their credibility can be impeached by the ability to observe, or some guys that they may hold. documents don't lie and documents don't forget. and so i think that this could be a very important case. but based on the allegations, much of his empire is really just a house of cards. borrowing money based on false statements, in pleading his assets. to get money to buy another asset. and so, he's got all these things but underneath them, there are no assets to support them. he's got all the real estate, and he's got all the golf courses and other things. but according to the allegations, he's overvalued them. sometimes by a factor of ten. just to give one example mar-a-lago, is being valued on documents as $39 million. in fact, according to the complaint, it's only worth $75 million. and it's replete with dozens
4:23 am
and dozens of other examples like that. >> barb, when answer from you. and one answer only. whenever i have an amazing legal analysts like you on the show. i asked them, which is going to be the trump investigation that is going to be the first to indict him? i'm still banking on fani willis, fulton county da. her investigation. what is your thought barb on that? what investigation do you think is gonna be the first? >> until a couple of weeks ago. i absolutely would've agreed with you. because she has been moving very rapidly. and calling all the right people to the grand jury. but now i think the mar-a-lago one might be. and that's because the evidence is done. they may want to interview a few more people to see if there are more documents elsewhere. but they have got the documents, they have caught him red-handed with the documents and he has made statements that prove the case. that he was willfully retaining these. and so, he could be charged tomorrow. my guess is that they will do a little bit more investigation. but i see by the end of the year will see charges in that investigation. >> barbara mcquade, i will say
