good afternoon, i'm lindsey reiser in four yachts. new revelations in the herschel walker story. his current wife now getting involved in the back and forth with the woman who says the georgia senate candidate asked her to have an abortion. as the interim prepares for a weekend of rallies out west, the doj is raising new concerns about whether he has really turned over all the documents he took from the white house. breaking news, we're following from ukraine, and attack on a key lifeline for russian troops. it comes as president biden

senate race. in just the last few days it is turned from a state that was too close to call to being roiled with allegations. >> reporter: the crucial senate race between herschel rocker and incumbent -- role in congress. after bombshell allegations this week by the daily beast that walker paid for former governance abortion in 2009. a new york times report friday that walker pressure the same woman to have and other abortion two years later. she refused. walker, who is running on a staunch antiabortion platform repeatedly denying a both claims. >> i'm not going to back down. the stakes are way, way too. high >> reporter: in a new twist overnight, the former football star confirming to nbc directly that his wife and the woman making the allegations revealed to be the mother of one of his children were in contact friday morning. the woman telling walker's wife that he paid for her abortion.

walker sharing copies of the text exchange with nbc news and saying quote, i'm not saying she did or didn't have one. i'm saying i don't know anything about that, i don't know. walker telling nbc that this is the first time that the woman ever mentioned the abortion to him. the woman showed the daily beast a copy of the receipt from atlanta abortion clinic. a check that she said was reimbursement for the procedure. a get well card which she claims came from the former football star. we should note, we have not seen this documentation. walker telling nbc news quote, i don't remember any card or check or anything. but i was dating her, i could've since a money, i could've sent a card, but not for the reasons she is saying. despite the spectacle, most congressional republicans are still backing walker. >> herschel walker is going to win that race. this is an effort from democrats to hold on to power. >> reporter: frustrations only grow. >> even the most staunch republicans are rallied. >> reporter: just 32 days

before voters have their say. >> and lindsey, as of now there are no plans for walker to meet up with a voters this weekend. ultimately, the decision will be there. in just over a month republicans on the ground in georgia tell me they don't think these controversies will have any significant impact on this senate race. this is just another reason they think that he is unfit for office, lindsey. >> allie, thank you for that report. breaking news out of north korea, the communist country launched a suspected ballistic missile just a short time ago which was in the early hours of sunday morning. according to south korean and japanese officials, the missile was launched towards eastern waters, the same direction as the missiles the country launched on tuesday. that launch led japanese officials to urge citizens to seek shelter. this launch marks the sixth round of weapon tests in just two weeks. joining us over the phone is foreign correspondent matt bradley.

matt, what we know here about what has happened? >> wednesday, this is all just coming in and this is the latest in a tit-for-tat response between north korea. this has happened years past, between north korea, testing intercontinental medium range ballistic missiles, and the united states, south korea and japan engaging in military exercises and land exercises in an effort to try to respond to intimidation, to keep them from launching more tests. we've been talking about his four years, this is been going on for years, this is the exact same type of pattern and what makes this unique and this different, the tempo has increased this year for the first time since 2017. the reason why so many observers are watching this so closely right now is because in 2017 this increased tempo of

military exercises, as i said, this eventually led to the testing of a nuclear weapon by north korea. that was back in 2017. now, there is some evidence, including some satellite images of some of the nuclear testing facilities being dusted off, if you will, prepared for what could be another nuclear test. that would be very threatening and would really raise the stakes, certainly outrace -- again, it is entirely unclear where this could lead. the fact that we are seeing this kit for tack military exercises by north korea doesn't bode well for what could become a new attempt by the north korea to test yet another weapon. this really is a threatening situation, it is one that the united states, the south koreans, and the japanese are

all engaged in. they are part of this increasing tension. the north koreans appear to be determined to win the staring contest. >> matt bradley, we know these details are just coming in. we know you will stay on top of it, thanks for joining us. now to ukraine where there has been no formal claim of responsibility for a deadly explosion on the bridge linking the crimean peninsula with russia. take a look at this, close circuit cameras caught a shocking moment, a huge fireball without the sky. russian officials say three people were killed. mclaughlin is live. what else are we learning about the cause of this blast? >> russia and its investigative committee, the main law making body is pointing the figure at a truck explosion saying that a truck exploded while crossing the bridge. no word on what caused the explosion on the truck. also, no claim of responsibility at this point

with presidential adviser to volodymyr zelenskyy, the president of ukraine, pointing the finger tonight at russia, pointing to divisions over the war effort in ukraine in russia. also, pointing out that the ukrainian government now believes that the truck came from russia crossing the bridge into crimea. that being said, while ukrainian presidential advisor tonight is blaming an element within russia for this attack, at the same time they're very much celebrating damage to this bridge, comparing it to the downing -- the signature vessel of russia's black fleet. this particular adviser taking to twitter earlier today saying, crimea, the bridge, beginning, everything illegal must be destroyed, everything stolen must be return to ukraine, everything occupied by russia must be expelled.

that really gets at, not only was this the only bridge connecting russia to crimea, it was also a key supply line that has been damaged to help russia get supplies to the front line from the west, western side of ukraine. not only is that damaged, but it is also a hugely symbolic win for ukraine. the presidential adviser in this tweet and elsewhere on social media sending the message that ukraine is not going to stop at the donbas, zaporizhzhia, they're going for crimea as well. that is the idea of a ukrainian victory in this role, reclaiming all this lost land. premier of course was illegally annexed by russia in 2014. >> erin mclaughlin, thank you so much. later in the hour, president biden's warning about nuclear armageddon, i'm going to talk to ukrainian parliament member bureaucratic about her countries concern that putin

will use nukes. we are reporting that the doj told trump lawyers in recent weeks that they believe trump still has more documents and has not return them to the national archives. the new york times reporting that it is quote, the most concrete indication yet that investigators remain skeptical that trump has been fully cooperative in their efforts to recover documents. trump is busy this weekend campaigning for his endorsed midterm candidates in nevada and arizona. joining me right now is vaughn in phoenix. you are at a women's march there where the focus is not necessarily on trump's legal battles but abortion. what's been the reaction overnight that a court overturned arizona's abortion ban? >> you really can't separate all of these issues in the political backdrop in which it is happening. just four days from now is when arizona's ballots reach voters here, early voting begins in the state of arizona. that is why when you're talking

about the abortion issue, is happening in realtime, you said it just last night, they issued a stay on what is known here as the territorial ban. it is 1864 law here in arizona that outright ban abortion except in the cases in which a woman's life is in jeopardy. with that being issued, now it goes into effect is a 15-week ban here. of course, that is what brings this woman's march to the importance to the folks that i'm talking to. right now in fact, katy is the democrat running for governor. she's been to this crowd here outside of the arizona state capital. there is several hundred folks here who are in attendance. when you're talking about with the stakes are, you have each of these republican candidates, they have been backed by donald trump. they're going to be campaigning alongside of him tomorrow. you have a blake in a debate this week, he said that he stood by that 15-week abortion ban in arizona. carrie like who is running against him, the republican, she says that she would defend

that law as governor. that is why so much is at stake here despite the investigations into donald trump that are ongoing here. he continues to be a key provocateur but also someone that is able to turn out voters at those very republicans are looking to in order to fend off some of these democrats they're trying to challenge them. >> bond, you touched on this a little bit, because trump is out campaigning in nevada and arizona this weekend, what has been the impact that you've seen so far on those races? >> you know, there is a reason why those individuals are campaigning with him. because we saw evidence, not only in 2016, but even more so in 2020. yes, joe biden won the arizona by that 10,000 votes, at the same time there was record turnout in rural parts of the state, a very red county here. it turned out because of donald trump. there is a recognition among these candidates that they need those voters to turn out to remain competitive against their democratic contenders

are being called to testify in the georgia election probe. former house speaker -- former national security adviser to trump michael flynn, former white house lawyer eric herschmann were all asked to testify. the --

house yesterday. the washington post is reporting that willis is requesting to testify sometime in middle to late november. the georgia grand jury has already heard from rudy giuliani, john eastman, and boris epstein. and as the legal troubles now, donald trump now asking the supreme court to intervene in his mar-a-lago case. he wants the justices to reverse and circuit court ruling, that granted doj access to about 100 classified documents before the special master reviews them. his lawyers were arguing that the lacked the jurisdiction to make that decision. if trump gets his, why could pose yet another roadblock in the doj's criminal probe. justice clarence thomas who oversees emergency appeals to the 11th circuit has given the doj until tuesday to respond. joining me to discuss, harvard law constitutional law professor at lawrence tribe. lawrence, thank you for being with us. >> good to be with you lindsey. >> over at the washington post is among those calling on thomas to recuse himself and he

writes, thomas that spell that is resentment of biden in his memoir. my grandfather son written 16 years after thomas became a supreme court justice. the book delved into his feelings about the treatment he received at the hands of then senate judiciary committee chairman, biden. during his 1991 confirmation hearings. one of the most acrimonious and polarizing get greszler vets decades. so what do you make of the justice handling and so far. i know a lot of people read into the timing of tuesday's deadline. >> i think that is really a sanction of course. justice tommins thought not to be involved in these cases. his wife ginni thomas was one of the masterminds really of the attempted coup but he is already in prior cases, refused to recuse. even in cases that involve the cheney thomas directly. because they involve documents

that the supreme court five out of 8 to 1, all the way to the setting. documents to the congressional committee needed. so of course, ideally should not be involved. his involvement will not really make the slightest difference here. he is basically a one stop. the first base on a sort of baseball diamond. he is handing in things, he will hand things to the full supreme court, you will not make any ultimate insurance and a whole appeal is attempts in a teapot. all they are asking, all the trump lawyers are asking the supreme court, and initially justice thomas but the full supreme court to do is to show the classified documents. to judge dearie the special master that judge cannon put in place. he's already said he does not need to see them, they are classified and there's no question that they don't belong

to the former president. it's just a distraction. the real appeal that matters is the one that the 11th circuit has expedited. in which the basic issue is, what is judge cannon doing and this picture in the first place? she is located 70 miles away from mar-a-lago. they went judge shopping, the trump lawyers found a trump appointee who really looks like she is in the tank for trump. she has rendered rulings that conservatives and liberals alike think she had no path to rig. no jurisdictions enter. her tossing if you'll pardon upon a bunch of little cannonballs. into the picture is what the 11th circuit has already indicated. and prior ruling, it is not likely to tolerate. so all of this stuff is not terribly important. what is important is that trump

has never explained what he was doing with all of those top secret documents in the first place. it is never given a reason to think that the search and seizure of mar-a-lago was anything other than legal. so in the, and the likelihood is that he will be indicted, he will be indicted for basically stealing government documents. mishandling top secret documents, in violation of the espionage act. probably for obstruction of justice, i would expect federal indictments to come down the pike. no later than early next year, all that he is doing now is trying to distract attention from what he clearly did wrong. which was played a bit documents, with over those places. up in those what he did with them. there's a lot of them that are apparently missing. that is why as you reported, the justice department says it still does not believe he has complied with their request. even though he claims to have

replied by turning them all over. so you know, watch the space. it doesn't seem likely that he is going to get away with it this time. >> so lawrence, i want to back up really quick. you kind of honed in on the expert at that hearing at the 11th circuit court of appeals. you said the court has given a hate as to where it will lean. what are exactly, what it's a decision before the court of appeals and what happens after that? the decision before the court of appeals, which will be before a new randomly chosen panel. has not given any hints. the question before. it. is whether judge cannon had the jurisdiction to appoint a special master and interfere with a perfectly lawful ongoing criminal investigation and national security investigation. what has happened is that another panel of the 11th circuit with two trump appointees made short work of judge cannon's earlier attempt

to prevent the justice department from using the documents while the matter is pending before the special master using the documents to pursue its criminal investigation. that panel unanimously said that she has no business interfering with the ongoing investigation. even though half of the 11th circuit judges were appointed, by donald trump and most of them are good lawyers. they are not like judge cannon and i don't see any prospect that they are going to uphold her unprecedented, unwarranted interference with this ongoing criminal investigation. very serious offenses. involving documents that could jeopardize the lives of american agents abroad. and those that include information, top secret information. about the nuclear capabilities, the third country. this is serious stuff, and dangerous the united states. and i don't think donald trump,

josh lederman is in wilmington, delaware where the president is spending the weekend. the white house seems to be walking back biden's comments, why is that? >> well, probably because it caused so many people off-guard and really raised the concerns that the u.s. was actually escalating after it has tried throughout this conflict to take steps that would not escalate the conflict. what the white house has said all along is that when president putin starts with this loose talk about potentially using nuclear weapons that it is a cause for concern, something the u.s. take seriously and prepares all kinds of contingencies for, but it was nothing that the u.s. saw as likely to happen or that any steps to be taken by the russians toward actually using a nuclear weapon. that is why it was so shocking when president biden, in this off camera fund-raiser, seem to suggest that he was extremely concerned about this in a much more eminent way comparing it to the cuban missile crisis and

saying that even the use of a tactical battlefield nuclear weapons by president putin could potentially bring us into a state of armageddon. we asked the white house whether there's any new information, any new cause for concern that has led president biden to have that new assessment of the risk. this is what jean pierre, the press secretary, had to say. >> no, there is no -- as i said before, we have not seen any reason to suggest our own strategic nuclear posture, nor do we had any indications that russia is preparing to imminently use nuclear weapons. >> but in the meantime we have seen other foreign leaders suggest that it would be better that we not have the president of the united states or anyone else frankly opening speculating about the use of nuclear weapons. the president in those fund-raiser comments also said

something else that has got a little overshadowed by this. he said he is actively looking for an off ramp for president putin to try to end this conflict. biden saying, he doesn't know what that is, clearly white house officials don't know what that is another. but it was the clearest window that we have had to date about how actively president biden is looking for a solution that could potentially end this war and give some weight for president putin to back down. >> josh let him, and thank you so much for that reporting. only go ahead and bring in kyra, member of the ukrainian parliament. thanks for being with us. >> thanks so much for having me. >> despite the presidents commentary, we heard the white house saying that they don't see signs putin is preparing to imminently launching frequent weapons. are you confident, how worried are you about this possibility? >> i am honestly worried and ukrainian people are worried because we know that putin made

the statements that he made a couple of times. just for his internal propaganda, it would be questionable for russian people why he is not used it yet given all the defeats that russian army's having right now in this war. this is why, same as with the beginning of the war, same as with all the atrocities that have been faced, we believe in putin watching nuclear weapons. we need to be ready. this is why i have my preparation backpack stored at home for my family because we know that it may happen and we need to be prepared. my bigger question is, is the world prepared to react? if this happens, we hope it's not happening, but it would be no time to have a discussion and strategic meetings on how to react. the react should needs to be prepared. tomorrow, discussions with

ukrainians to act and we will be ready if this happens. god forbid, but we need to be ready. >> chilling. we saw that ridge explosion in crimea. i think we have the video of it. ukraine hasn't officially said it is responsible but what you know about this? how damaging is this to russia's offense? >> the explosion is extremely damaging and the most important thing is that they damage the railway that was actually being used to bring all the supplies and weapons into crimea and south of ukraine into kherson. that was basically the main way of support of the southern front. it is a humiliation to russian forces and russian defense because the breach was known as

one of the most protected objects of the russian federation. from our side, the only thing that i can say is crimea is ukraine. we do not accept that this bridge was ever built there because crimea was illegally annexed. the bridge was illegally built. that's why it is good that it will not be there anymore. >> we talked a little bit about putin's desperation here, you posted a tweet saying, like hitler, putin is annexing neighboring lands wealth running the wider world. like kyler, putin employs the language of genocide and is putting his criminal will view into action. do you think setbacks like the one that we just saw, the bridge to crimea, like some of the setbacks that we have seen in territories that are now being take back by ukrainians, do you think these losses will curtail that threat to the water world? >> same with the story with

hitler, the only way to contradict a dictator's unity and a strong belief that we can often bite him together. we have this very clear plan. we will be fighting him back no matter what the threat, no matter what he says. we know that we are fighting for the right and we are protecting our motherland and our allies are standing behind us. if there is a backup plan, saying this is how we act so putin would not launch nuclear tax, let's discuss it. right now, i do not see any other plan other than the planned we and ukraine have. to fight him and you take back what's ours. we need not comforts territories, we can attack russia. we are fighting for our freedom and for our sovereignty. we have the full right to do so. right now, we just need to stay
