got what will likely be our only debate between the candidates in the united states senate race that could determine control of the u.s. senate. last night republican senate candidate and raphael warnock faced off in the stage in savannah, georgia. there were plenty of remarkable moments including walker, sponsor the abortion scandal surrounding his campaign, as well as warnock's stance on abortion rights. >> i said that is a lie, and on abortion, i have a christian and i believe in life, i will tell you this. georgia is a state that respects life and i would be a senator protects life. i am not backing down. >> we are witnessing, right now, what happens when politicians, most of the man, pile into patients rooms. you get what you are seeing right now. the women of georgia deserve a senator who will stand with them, i trust women more than i

trust politicians. >> we have ms nbc correspondent ellison barber, who has a closer look from savannah, georgia. >> katie, both candidates campaigns are declaring victory this morning, walker's campaign saying their candidate dominated, warnock's campaign saying their candidate showed why georgia voters sent him to washington in the first place. this was the first, likely only debate, and things got pretty fiery onstage. lee candidates clashed over their positions on abortion. herschel walker was asked about his allegations of past domestic violence. and also, that allegation that he encouraged and paid for the mother of one of his children to have an abortion. the abortion allegation, he once again denied it, saying that that is a lie. and he will not back down from saying it is a lie. walker was asked about reports that he and his church evicted residents from an apartment building, a building the church

owns. he says that is a desperate smear launched by walker and his supporters because, he says, they are in a position in this race where they need to stoop to that level and attack, again, in his words, the home church of martin luther king. throughout the debate we saw warnock try to focus on legislation that he has supported in washington, d.c.. highlighting a number of different points, bicep partisan legislation that directly impacted georgians. herschel walker tried to keep the focus on the economy, talk a lot about inflation. warnock tried to paint his opponent and someone who is wholly unqualified to serve in the united states senate. and, tried to point out and said at some point that herschel walker has a problem telling the truth. herschel walker tried to tie warnock to president joe biden, biden has a low approval rating in the state. he continuously brought that up, saying that in his view warnock

and biden are one in the same. ultimately georgia voters have the say and early voting begins on monday. katie? >> alison barber, in savannah, georgia. thank you. here's my question, have politics in our country gotten to the point where controversies just do not make a difference anymore? our voters now always willing to hold their nose and vote for their party's candidate? no matter what? coming up, i will bring in my panel of political experts to dig into that very important question. now to the latest on january six investigation, nbc news has extensive reporting that the committee is looking to get records from the secret service of all of the communications between some of its agents and members of the far-right oath keepers group. this is on and around the day of january 6th. this coming on the heels of the panels extraordinary decision to subpoena donald trump to testify about his role in the insurrection. nbc's allie raffa is on capitol hill with more. ali, good morning, first, let's

get to that exclusive reporting. what more can you tell us? >> good morning, katie, yes, one revelation from thursday's hearing that left more questions than provided answers was really how much information they secret service had and did not initially share with the january six committee until subpoena about these warnings of violence while before the january 6th attack on the capitol. since then we learned that at least one agent had communications with a far-right group. the oath keepers well before the january 6th attack. and now, nbc news is exclusively learning that the committee is asking the secret service for any and all communications between the agency and the oath keepers before and on january 6th. this comes after the agency told the committee one agent had, quote, numerous contacts with the oath keepers leaders and other members as early as september of 2020. the secret service is saying that this was something that was regular, that secret service agents would have these

calls with members of the group to let them know what they could and could not bring into events at these trump rallies. where they could and could not stand, the agency says once the group had the phone number of this agent that this became a regular phone calls. but, that is exactly what is concerning committee members, the regularity and frequency of these phone calls, committee members even saying on thursday that this is causing them to want to speak again with some members that they have already interviewed. listen to what one committee member had to say about this. >> let me just say i have a lot of questions about all of it, about coordination among witnesses, about the advice that they may have been receiving from some attorneys. about their veracity. i just think there are more questions than answers at this point. >> this, of course, comes as

the committee prepares to officially issued a subpoena that they unanimously voted to issue to the former president. but, in this whopping 14-page letter addressed to the january six committee chairmen, it was issued yesterday, the former president slams the committee's work. continues to spread these false claims of election fraud. but, notably, katie, he does not say whether he would or would not comply with this eventual subpoena. >> that is the open question, isn't it? our thanks to allie raffa. now we are going to turn our attention overseas to ukraine. this morning ukrainian military officials saying a rocket attack hit the capital city of kyiv while drones took aim at the southern city of zaporizhzhia. no victims were mediately reported but it comes as vladimir putin continues to defend his invasion, calling it correct and timely. yesterday the president of neighboring belarus spoke exclusively to nbc news senior international correspondent

election in 2020. and, this week, lukashenko supported russia at the un. >> civilians being targeted, women and children, how can belarusian elsa five voting against the un resolution to condemn the russian offensive? >> you know, there is an information war going on, ukrainians talk about mass graves, and the russians similarly reveal mask crimes from the ukrainian side. >> and now we have our thanks to kier simmons and breaking news this morning out of turkey. at least 40 people have died in a coal mine explosion. the blast happened in the town of -- in the northern part of the country friday evening, 110 miners were working inside when the explosion happened. authorities have been doing everything they can to help anyone who is trapped inside as relatives with outside in the news, 11 miners are in the hospital and 58 were either rescued or managed to get out on their own.

the case with donald trump his legal troubles tend to pile up all at once. this week was certainly no exception. the january six committee is unanimous vote to have trump testify under oath was a mic drop moment, and the fallout of that is in its early stages as members say they could still make criminal referrals of the doj. but, that is not the worst of it for trump. the most immediate threat could come from the ongoing investigation into classified documents seized from trump's home in florida, mar-a-lago. the wall street journal reports that to trump's are now witnesses. one was seen on surveillance video moving boxes. untold fbi agents he moved them at trump's request. and, a second aid had previously been subpoenaed in the justice department's january six probe. on top of all of that, the supreme court denied trump's request to intervene in the documents case. as one op-ed in political magazine put it, they lack of any dissent suggests that the

court may not give trump these protection he will seek from the justice department should end up indicting trump for violating one or more federal laws. another major setback came from a new york federal court where a judge denied his request to depose next week's definition in a defamation case by a writer who has accused him of rape. joining me to break it all down is my good friend msnbc legal analyst dan east cevallos. danny, good morning, there is so much going on. isn't there always when it comes to donald trump? >> there is always a slew of things, let's start first with my question to you. which of this week's legal developments for donald trump do you think really gives you the most exposure? >> the answer is something that was not so much in the news but was mentioned at the hearing. and that is the efforts to subvert the justice department. i know it is not part of a flashy list of headlines this week. but, that, to me still remains one of the greatest threats to donald trump. if we're picking something directly from this week it is revelations that donald trump may have been involved in

telling people to move boxes. and that is only if the doj really wants to stick him with an obstruction of justice, or a related charge in connection with moving boxes and documents from the white house to mar-a-lago. and then, of course, the bigger sandwiches the cover-up. that is going to be the bigger challenge, and as you know from suffering from criminal defense it is not only the crime, it is the cover-up that gets people cost. >> what is a saying? the cover-up is worse than the crime. >> all right, let's talk about the subpoena, it has been authorized by the january six committee, it has to be served on the acceptance of the subpoena by the council. it is probably going to happen as early as this week. >> yes, they had better hurry. >> trump and that rambling diatribe of 14 pages, did not say whether he was going to commit testifying under oath, if he does not testify than i am already disconcerted with the timing of the service of the subpoena. what are the chances that the supreme court of the united states will actually take up this issue of a former president having to testify

before a select committee? >> such an interesting issue because it has been taken up many times, presidents and ex presidents have testified and been subpoenaed. president grant testified in a deposition in 1875. 100 years later squeaky from subpoenaed president gerald ford. this is his would be assassin. there is a rich history of the painting and the president sitting for depositions. but, with all that history the law in this area is not clear. the supreme court, for example, held in one of the nixon cases that there is presidential i'm unity. but, the scope of it is not entirely clear. and, that presidential immunity is not absolute. it can give way if they subpoena and the agency, or whoever seeking the information, can show a particular eyes need. so, if this goes to the courts, and i expect it will, it might go all the way to the supreme court. and, it might be a new area of law that has developed because of president trump and this congressional subpoena. but, do not get too excited.

i think the odds are, if i were a betting person and i am not, because i am usually wrong. we may never see president trump, former president trump sit down and testify in response to this subpoena. nor provide documents, there are just too many factors. number one, the subpoena expires soon. it is not like a judicial subpoena, the congressional subpoena has an expiration date, and number two president trump will do what he does best in the courts which is delay, delay, delay, delay. even in the face of zero chance of victory. >> let's talk about delay, we mentioned in the intro to this segment with you that there is a defamation case against donald trump. he has attempted to delay the discovery process. you and i both know that the discovery process includes things like depositions under oath, eugene carroll sat for her own deposition yesterday on friday for hours. donald trump is up next, next week. what are the chances of donald trump actually providing substantive testimony in that

case? or is he going to invoke his fifth amendment privilege in any way? >> 0.0 chance he will provide anything substantive, he may provide something substantive as to carroll's case, which is not really a political one. it is a straight-up court case, in a sense. but, when it comes to anything juicy about what he did as president, doubtful we will hear anything because that is not even relevant to the underlying case. and, the other thing is he may not take the fifth amendment at all. he may use his own version of the fifth amendment. he has testified in many depositions, he has a veteran of depositions. so, the very idea, and i am guilty of this as well. when he first sat i thought oh, that is, it he cannot testify under oath because when you are under oath you are in the perjury trap and bad things will happen. but, you know, what he has done it. he knows how to do it, he is a veteran. i expect he will get in there instead of his invoking his fifth amendment he will use a version of the fifth amendment i'm sure you have seen witnesses use in deposition, which is memory loss. i don't remember, i don't

recall, i don't remember. it is really interesting. people often think of their mind, if i do not recall i can't get in trouble. what they don't realize is often there circumstantial evidence establishing that you either knew, do recall, or should recall. but, i have to say, even with that, donald trump has been slippery and depositions before and he will be slippery again. he is probably supremely competent, he can handle himself in a deposition. if history is any indicator he is kind of right. >> well, then i guess we will have to see if he can actually take that bravado and translate it into appearing before the january six committee. because, i bet he is telling his lawyers right now that he is able to pull it off and pull it off while. >> i agree, he is going to make a symbolic demand that i will appear, but only if i get to testify live, without a net. you do not get my testimony before. and the committee will surely say no thank you. but, he will win a symbolic victory, go back to his side and say, i offered to testify and they would not let me.

difference when georgians cast their ballots next month? >> there's definitely a stand up moment of the debate, and it's a response to the report we back in june, herschel her three different times lied about law enforcement. he's brought out this voluntary badge overt over, again so i wasn't surprised when he tried to show, it but i think that there it was a little bit more clash over it before the moderator caught them off, but i totally understand why he wanted him to stop using a prop will this matter in long run? i mean this certainly gives democrats another meme or another moment to energize around, over an otherwise the debate were herschel walker's personal issues only received glancing attention there was not much focus on the report that he paid for a girlfriends abortion in 2009. there was not as much focus on his violent behavior towards women, including his ex-wife. that is why republicans kind of

a breathing a sigh of relief right now feeling like he had a make-or-break moment and didn't break. >> and michael, gop strategist and supporters of should not breathe a sigh of relief to quickly, it wasn't all about police issues, but he also talked about the issues to take a listen. >> is it time for the federal government to step in to ensure all georgians have access to health care? >> well right now people have coverage for health care it's according to what type of courage do you want. because if you have an able-bodied, job you're going to have health care but everyone else has health care as a type of health care you're gonna get. i think that is the problem. what senator warnock wants you to do is depend on the government. what i want you to do is get off the government health care get on health care he's got. >> the president biden defeat former president donald trump in 2020? >> president biden won and

senator warnock won, that's the reason decided to run. >> social walker, there is not some health care, in the big lie, and i don't know if donald trump or that but he also promised to respect the results of the election, and he said the solution to the rising prices for people to eat right. how did the debate go to herschel walker when you compared expectations actual performance. >> effectively, i think herschel walker in that meeting and perhaps even surpassing expectations for the debate if i'm a republican, a national republican right, now i'm feeling pretty good about standing by herschel walker over the last two weeks because he did not choke, and he proved that he could be a disciplined messenger in carrying out these very traditional anti incumbent and anti-democratic attacks on

warnock, and he was pretty aggressive during the debate, almost an actually, so it reminded me a little bit of the biden trump debate in cleveland, the first one, and i wish the moderators would have gotten a little bit more control over him. and i do think i agree with greg, he was let off the hook and escape some part of follow-up questions to his history of domestic violence, and his hypocrisy in the proven dishonesty over the latest allegations. i think that if you are a republican, you are breathing a sigh of relief. i don't changes the dynamics of the race, but if you are sitting on the fence, you might get off him vote for him if you are a republican. >> greg, a couple of interesting moments from senator warnock last night, it wasn't just all herschel walker, but here is one. his response to a direct question about whether he, as innocent warnock, supports packing the supreme court. take a quick listen. >> my job as a senator is to

protect the rights of ordinary citizens. and for the first time perhaps in my lifetime, we've seen those rights contract rather than expand we were talking about the reproductive rights of women, or voting rights. and i would do everything i can to protect the rights of the citizens of georgia. >> senator warnock also declined to answer whether he thinks president biden should run for reelection in 2024. was the example of raphael warnock trying not to play into herschel walker's theme of tying him very directly to joe biden and joe biden policies? >> yes, and beyond that this is part of a strategy to reach the middle. throughout the entire campaign, he's talking more about working with republicans than working with joe biden. joe biden has a 38% approval rating in georgia, according to the latest aj seat university of georgia paul became a few days ago. so senator warnock certainly knows the perils of this very

great moment but he is trying to reach the middle, and that's why he stuck in these questions, and trying not to alienate with the swing voters who are very skeptical. that was herschel walker's strategy to win back those supporters by leaning into conservative issues. >> and michael, i want to talk about the last 16, hearing specifically with another by hbo for documentarian alexander pelosi, the daughter of speaker nancy pelosi. this really gave us an inside look at how nancy pelosi interact schumer stepped up in the midst of a crisis to restore order and it also must've the right-wing talking point that nancy pelosi never called for help and there is this moment, nancy pelosi talking about donald trump on january six. take a listen. >> i want to punch the mouth.
