you from msnbc headquarters, in new york, welcome to alex witt reports. we begin with breaking news, democrats, defying polls and punditry, winning control of the senate, with midterm voters delivering a stunning rebuke of republican candidates. democrats now have 50 senate seats to the republicans 49, at least until the next month runoff in georgia, between warnock and gop challenger herschel walker. the house may still be in play for democrats, with 20 races still to be called as one more trump backed candidate bites the dust. nbc news projects republican joe kent will lose to democrat marie perez in washington state. kent won the republican primary and gop congresswoman --

voted to impeach trump. then in arizona, we are keeping an eye on another trump backed candidate, republican kari lake is trailing democrat katie hobbs in the governor's race, it is still too close to call. donald trump is expected to announce his 2024 run this week, here's what speaker pelosi had to say about that. >> i think it's bad news for the country. let's put it that way. this is a person who has undermined the integrity of our elections. has not honored his oath of office. he has not been a force for good. so i don't think his candidacy is a force for good for a country. that is up to the republicans to decide, who they will choose. >> last hour i spoke with trump's former white house press secretary, and he is what she said. >> >> i think that he's just absolutely angry and panicked. i think he wants to force people to stand with him. i think he wants a big amount of republicans to stand with him including the people he

didn't endorse and who did get and left id. and i think he wants to show this force of power, saying i'm in here, i dare anyone to challenge me. >> joining me now, stephanie in las vegas, and tonya hilton in atlanta, and caralee is traveling with the president in bali indonesia. welcome all of. you first to stephanie. you heard from cortez masto on her very close victory. what is she telling democrats there? >> well, you know, she spoke this morning in a union, which is very appropriate, because the unions have powers to this one, as for the latinas, she acknowledged both groups. she was the first latina senator elected to that body in 2016. she said her family would be very proud of that fact, but they're also especially proud of the fact that she was reelected. here's a little bit of what she had to say today. >> i am so grateful to every

volunteer who knocked on doors, who made phone calls, who wrote postcards and letters, and who have the courage to publicly stand up, and fight for our state. [applause] and listen to, or nevada's, whether you voted for me or not, i will always fight for you. when the national pundits said i couldn't win, i knew nevada would prove them wrong. >> you know, there were a few national pundits who also said that democrats weren't going to keep control of the senate, and you know, i started this week, or last week, it all seems like one long week at this point, in pennsylvania, john fetterman took that race on election night, and he said get to nevada. and then we saw that mail-in ballot started to get processed. and although laxalt title league of about 20,000-plus votes on election night, that got whittled away with those

mail-in ballots, until last night, you had cortez masto the projected winner. and it did not take long for the senator majority leader to take the microphone. >> this is a very happy day. we have flawed candidates, but we won because we had a really good agenda that we actually passed. that helped the american people on things that we cared about. we won because today -- the american people rejected the kinds of autocracy that the maga republicans -- not a wing of that party was talking about. >>. i wonder if they're feeling pretty fat allowed? >> i bet they are. that's a good assessment, stephanie, thank you for that. let's go to the president, helping he'd keep his senate majority.

a critical meeting for the g20 summit. nbc's carol lee is following the president, joining us from bali, indonesia. carol, senate control? that's locked in, check that box, but how does the president which is who's still feeling about the house, -- >> look at alex, he is expressing optimism that democrats could still potentially maintain control of the house. but at the same time everything would have to cut in democrats favor for that to happen. so a little bit of caution there. when he paused with his meetings to world leaders, to come talk about the midterms overseas, he had spoken with the congressman from california whose district is one of those and potentially be decisive, in terms of whether we markets could've pertain to the democrat of the house -- has the president. >> well they're well, it's a stretch. everything has to fall our way.

i just got off the phone with congresswoman levin, who just won. seven my seat in california. i'm not predicting this but we might be perilously close. and with the amazing winner will be around santa. >> now look, even if democrats don't love control of your house, this outcome is much better than the white house had been anticipating. or were expecting to lose the house to republicans. and so, even if the margins are just an error and smaller. republicans have control, that is still in their view of a bit of a victory. yeah phone -- propelled democrats into this position, where they couldn't get control of the house and now have maintained control of the senate, it's now focus on georgia and alex. >> thank you carroll, for that,

well everyone, tomorrow we are going to with for, it and see what's happening with the president and chinese president xi jinping. they are going to be sitting down for the first time. carol, i didn't mean to abruptly dismiss, you talk about what is going to happen in this meeting, what is the most accomplished -- thing that can be accomplished or should our expectations lower? this is the first meeting since biden became president. >> that's right, it's the first deal eating sitting out face to face, many times before when biden was vice president biden, and she jinping was posed to come. white house set very low expectations for this meeting. and a a list of agenda items,

anything from the time, one to north korea's nuclear program. and just figure out where each of the stands and where they may need, to figure out a strategy. that is not necessarily where the two kentucky and i. so it's really taking a stop, big joint statement, nothing like that. in that sense, it really underscores,, alex how low that relationship is at this point, and they just trying to level set it and get it off on a point where they can communicate about the issues it's over two in the morning. thank you for joining me right now, kamala torres. department of the homeland security mitchell systems much better time zones how

significant is this for the party? >> the fact that the democratic party will not lose a single incumbent senator is unprecedented. in history. we fared well in the midterms because we exceeded expectations. but not for the overturning of roe v. wade, and trump, the republicans may have had the benefit of the red wave, but what we are witnessing is the republican party that is self destructing at the hands of donald trump. >> so you served in the house, this has gotta be something you're keeping a very close eye on. because control of the house, it's very close to call. what are the devil chances? do you think of keeping a majority? how confident are you in your colleagues feeling this weekend. >> look, i'm cautiously optimistic, that we can

maintain control of the house, and the lesson needed in the mid to election is to -- weave unproven the ability to overcome the odds. >> a few more days until we find everything out given how slowly the ballots are being counted in california. because i want to be correct. i will say. that there is a new article, it is an axios it's that democrats spoil [inaudible] [inaudible] backfired in spectacular fashion this spring. do agree? that's your state,. you've been analyzing it carefully. do you think democrats would've already won the house and not for new york? >> new york is more complicated

than its reputation deep to the states, we had keating comments from competitive districts restaurateur the court of appeals struck down the congressional lines and then a special master appointed by a republican drawbridge, to -- drew lines that were much more favorable to the republican party. which was the stands no one, not even the pundits saw coming. and then the third is the daulton effect. it had the same effect in new york 2022, that donald trump had nationwide in 2020. even though the two of them lost, they were down -- >> yeah i'd like you to weigh in on this exchange. sean patrick maloney, told aoc,

quote, she's an important voice in our politics but when it comes to passing agenda through the congress, are standing our ground on a political ballot battlefield, she was nowhere to be found. aoc responded with a lengthy to say, many moderate dams and leaders made it very clear that our help was not welcome, nor wanted. despite our many, many offers respecting their approach and their districts is laughable. >> do you agree with one over the other? >> i see no value in descending into a pointless blame game and info party warfare, that we have democrats should be united as a party and we should name a fire, we had a midterm poll, the house to okay, is there any sense as to whether speaker

pelosi wants to remain the house democratic leader? and if she does not, anyone talking about who might take the post? >> well there is layers and layers of unknowns, right there is no telling what's gonna control the, house there's no telling what speaker pelosi will ultimately decide. and bryan? i look forward to one day seeing becoming the first african american man of the house. i know she would make a great speaker and i would love to see this happen. >> interesting for you to talk about him, his mention -- that's not the first time i've heard hakeem jeffries name hundred out of there. let's take a look at nbc news nbc news voter poll two thirds don't want to see biden run for reelection. though i know you voice your support for via another biden run. how should this factor into his consideration and what do you

think the president can do on changing the minds of voters who hold this opinion? ignore the polls. the pundits have a long history of underestimating president biden. he has had the most productive presidents in recent memory. he presided over the american rescue plan and a bipartisan gun safety plan. a bipartisan infrastructure plan. and a bipartisan veteran health care plan. and the inflation reduction act. and the semiconductor bill. he did much better in the midterm election than any president before him. so one of the lessons learned from the midterms is never underestimate the president biden -- much more than people give him credit -- >> what do you think the mandate is from your constituents of reelected when they say congressman richie torres, we want you back in office to represent us? what is that they want -- what is that you want to accomplish? >> i represent what is officer to be the poorest congressional district in america. i'm focused on -- delivering for my constituents.

of the house is up for grabs. six days after the election at this hour. nbc news estimates republicans will win the majority with 219 seats to the democrats to 16. plus or minus four seats. but given that plus or minus, democrats still have a potential path to victory. right now, in 20 house races remain uncalled. republicans need to win seven of these to win back control of the house. democrats are two and 14. democrats currently lead in ten of those 20 races. joining me now, nbc news senior national political reporter -- so hello, welcome. if you had to choose one race that ends up going democrat that you think suggests the party as a whole could hold on to the majority what race would that be. >> such a good question. a tough one.

i'll give you two races. california 41. east of los angeles that's riverside county. it includes new portions of palm springs. which is giving democrats hope that republican -- is locked in a very close race with a democrat will rollins. by about 2000 votes. there is still plenty of vote to be counted. democrat's can prevail there, that would be a good sign for them. the second is colorado three. lauren boebert. the maga republican is locked in an unexpectedly tight race in a republican friendly district. democrats should have no business competing. yet the democrat adam fresh is just 1000, 122 votes behind. that's within the 0.5% threshold for a recount. that race looks like it's going down to the wire. it's still not called. there's still some more votes to come in. democrats can win those to race in the house. i would say they're in a very good position. >> lauren boebert must be going what is happening right now as we talk about this race.

it's really close this one in colorado third congressional district. give me a sense of how long until we're going to know the outcome in that one. >> oh leave that one to our decision desk as spurts. but what we do know is next thursday's will get a readout from remaining ballots. one of the big counties in that district -- were looking at provisional ballots. overseas and military ballots. the rule is as long as they're postmarked by november 8th, which is election day. they will be counted. the question is, are there enough at those and which way do they break for the democrat -- to potentially have a shot there? >> that'll be thursday. we'll keep our eyes on that. meantime, walk us through what's happening in the race for alaska's lone house seat. democratic incumbent mary paul total -- at this point short of the 50% to win outright. how does alaska's rank choice voting work? does it possibly than go to a second round? >> that's right, alex. this is a rematch of the late

august fight between the same two candidates. mary peltola and the republican sarah palin. 2008 vice presidential nominee. and the last time around, mary portola prevailed in a large part because of alaska's ranked choice voting. the rule is that if neither candidate gets 50% on the first ballot, you go to second choice preferences. and those get tabulated -- both candidates are -- the democrat has a lead here. the rule is it will be november 23rd. the day before thanksgiving at the second choice ballots would have related. if neither candidate gets 50% of the first. >> let's turn to the breaking news about the dems keeping control of the senate now. this new article that you've written. a senate in democratic hands clears the path for biden to keep remaking the courts. how significant is it for the democrats to have this ability to keep remaking the courts. what does that reshaping look like? >> enormous, alex. this is when the most

consequential thing is president biden has done. now he gets two years of a clear runway to do it. knowing that democrats control the senate. republicans -- simply refused to hold votes on those judges. so far, the president has appointed 84 judges including supreme court justice ketanji brown jackson. there's a lot more democrats want to do. which actually, majority leader, going to keep his job now. told me last night quote with two more years of a senate democratic majority, we will build on historic pace of judicial confirmation. and ensure the federal bench should better reflect the diversity of america unquote. he's talking about personal ethnic diversity. more women, more black latino asian americans. as well as professional diversity. more civil rights. more public offenders. biden has changed the paradigm of what kinds of judges ultimately make it to the bench. looks like democrats will have two more years to persist in that without any threat of republican obstruction. >> thank you very much.

and predictions of major losses. to georgia, where the democrats are now hope to increase their control of the senate, in that runoff election, they're just over three weeks, senator raphael warnock faces off against republican herschel walker again on december 6th. and joining me now, nbc's centennial in atlanta, warnock 's high school event is about to get underway and antonio welcome, talk about the mood there. what's it like after the democrats secured the senate? are any concerns being voiced about the enthusiasm given it looks like the senate has been decided? >> you know, alex, we actually just came from church, and i spoke to some warnock supporters there, and asked them that same question. they told me, in, all they of course are democrats, they think the question is more for the republican side. now that the control is off the table, are they still feeling as enthusiastic? are they still supportive of republican herschel walker inside some of the record?

and, so that is what they are looking to see. democrats are gonna be just as energized, because they understand some of the local issues, particularly things dealing with health care that people talk about a lot on the road that are at stake here, but also, having that extra democrat in the senate would only be you, know, more useful to them. so their argument to me was that question is going to really be for republicans. but both candidates are already back on the road, taking a little bit of a listen to the message warnock had this morning at church. >> you are the church tradition that gave birth to the civil rights movement. and the voting rights law. so i'm telling you, to go vote. >> i'm not telling you who to vote for. i'm serious. i'm not telling you who to vote for. must i'll tell you that somewhere else, not here.

because i respect deeply, i respect deeply the separation of church and state. gift's >> we are likely to hear him talk about that somewhere else, and who you should vote for when it gets to this event in a little while. when we have a lot of parents and young people here, you know, this is part of a larger festival happening at morehouse today. rapper and musical artist little baby is going to be here, who is popular with the age group behind me. and you're gonna hear more talk taylor a message to a lot of young people, a lot of young parents who are here. this is all part of an effort that is part of both candidates having to jump start right now. they have to go back out to all these communities, they just circled around, they took the buses from here to there. and they have to do this all over again. there have less than four weeks to do it. a lot of this is just going to be, how do you get your base re-energized? make sure they know that december 6th is the runoff date, and early voting starts after

thanksgiving. so, there's a lot of basic education, both candidates have to do right now. so it's going to be interesting, i think, later this week, as we see herschel walker hit the road to. how does his message maybe change? since it's no longer going to be, you know we can take control of the democrats, how does his connection with voters change? what is he saying? that were not camp says a lot of his message is going to stay the same. and he's going to ride some of the enthusiasm he says from democrats. >> you know what i like about that rapper and the fact that the age group behind you you described, is going to be so excited by him? it's gonna inspire the parents and older folks, the kids are going to say, get out there and vote. that is what he was saying. they're going to have to be accountable to their kids and as a parent, i'm so accountable to my kids some days, wow, okay, thank you very much antonio, no two ways about. it my next guest is going to be adding up 1000. predicting donald trump's victory in 20. 16 and just last week right here on the show, the outcome

of the midterms. take a look. >> i'm not worried at all. this is, i think this is just a thing where people good looms, is pushing democrats and liberals, they get really nervous. in the history of valid proposals in michigan, there has never been this many signatures. they told us the same thing, what kansas told us, back in the summer. young people are gonna vote, women are going to vote, with a vengeance. and people of color know what's at stake here. not that it's not gonna be close. >> michael more joins me now, writer, filmmaker, activist, and i believe we can now officially add political prognosticator. michael, my friend, congratulations. and welcome back. you did it again. were you surprised by the extent of success for dams holding on to the senate control with the house actually no success is leaving, still employed? >> not surprised at all. i felt this way all year.

i've written about. it i've tried to get the word out, people who subscribe to my substack, or follow me on social media, i've been all over this for a long time believing there were more of us than there are of them. that's just the statistical fact. there's more registered democrats in the u.s. than there are republicans. we've won several of the [interpreter] seven of the last eight presidential elections in the vote. it is clear, the statistics were there. i don't know why i was probably the only one saying that, you know, we are going to stop this red wave. we are going to put up a blue wall. and this is going to be stopped. people are gonna come out and in states like, you know, think about this, in maryland, minnesota massachusetts and michigan, all had a trifecta. which means, for the first time in michigan, 40 years, we've got the governors chair, we've got the michigan house of representatives, and we've got the michigan senate. the democrats control it all,

and this happened on tuesday in minnesota, maryland, massachusetts. and now there's 18 states in this country. where the democrats are on the show. this is not -- >> let me i want to drill down on michigan. because we saw these really long lines, lots of young voters, you predicted that. in michigan. abortion is one of the top two issues, voters said influenced their vote. and you singled out 18 to 29-year-olds, 16% of them want to democrats. it's a higher percentage than even you expected, michael, but what is the significance of that and do you think abortion is going to stay an issue, say, two years from now? >> absolutely. in the week leading up to the election, in just a couple days before, abortion was way down the list. it was inflation, economy, crime, you, know all this stuff which is meant to frighten people and yet i said to you, when it comes to election day

or when people are filling out their ballots and women, i mean, let's -- why be so condescending and disrespectful to women to say that on their deciding on reproductive rights or milk is 20 cents more a gallon. let's see, which is -- you know? who do you think women are? you can't take human rights away from an entire gender and not expect it to blow back. and i have to tell, you the night of that supreme court decision, on june 24th, i went to bed happy that night thinking, wow, they just handed this to us. they just turned the majority of women, democratic women, republican women, independent women, against them. the vast majority. >> let me ask you this, because you saw that on june 24th. interesting that republicans in general didn't seem to see that or at least those that sit on the supreme court that they

could not see that they were handing this to democrats, because i totally agree with you. women do not want to be condescending do. women were saying, you've got gas, my bodily, rides what i can do in controlling man dustin, the one come on? >> yeah, absolutely. and i'll just say it in my language, they are cruel. they're clueless. there were coolest but where they're at but women essentially -- unlike most groups of people, when it's people of color, young people, always berated, they never show up to vote, they started showing up more, actually, after the last three elections. this is been trending towards this moment, with young people. to take the majority gender 51% of the population, and not think there's going to be blow back from that, that is just like, thank you for that gift, supreme court, and republican party, because now you know, you ignore women at your own risk now. and maybe that will be the end

of that, it might be a hard thing to be a lot of society at times. but i think, i think, alex, that we have to listen to so much being shoved down our throats from the election time. leading up to the election, you know, democrats were gonna lose in mass. constantly, they were quoting howell, in american election, the first midterm, after the presidents elected, is a bloodbath. obama lost 64 seats in the house. why did they keep repeating old stuff? we live in a new century. we live in a new era. things are different now. and the fact that they keep repeating the same old stuff, keep telling us the democrats are going to get slaughtered none of that was going to happen. we're still waiting. and you asked about the house? i'm gonna tell you what i think about the house of representatives. now we're waiting for that. have the beginning of the, week he said nevada, arizona, in

friend and family member of lined, is like, yes we're gonna lose the house. who said? it's been five days since the election and they still haven't called the house. have you ever remember that happening where the house isn't called for five days? you know why that is? because it's close. it is so close, there's so much going on, so count in california, and all the early word is, from california, we have a chance, democrats have a chance to pick up six, son, maybe even eight republicans sitting congressman in the state of california. they're gonna switch to the democratic side. help make up for the horrible mistake by the democratic party in the state of new york. which really wouldn't so much of the party, andrew cuomo's map. ordered to be redrawn, which was redrawn wrong, because, in new york state, he did not care

about helping democrats, republicans, whatever, he cared about patronage, of rewarding those who rewarded him. and that map was a mess. and now we've lost four members of new york city. i think we're gonna pick them up in california. i think this thing is really close, and my friends, even if it does come out to 18 to 17, in favor of the republicans, or to 19 to 16, there's hardly a session of congress and this last one, 117 session, there were two republicans call who died. that happens in every congress, every term, and the woman sadly in a car accident in the midwest, republican, what happened in alaska? the democrat won. even if for some reason to 19 to 16 can't hold, and all you need, you know, people quit in congress, people get indicted,

on tuesday, he's expected to descend once again into the wild walled of a white house run. the sum, around with the former president at the center of a slew of ongoing legal battles, that may not be so cold in. joining me now, msnbc legal analyst lisa reuben. good to see you, let's get into it. will donald trump's expected announcement shield him from any of the ongoing legal probes? >> i don't think so, i do think he has several objectives. one of them certainly is to demonize the investigators. both that the court of justice and the generous committee. and recognize that right now are msnbc tally in the house is 2:16 for the democrats to 19 for the republicans. it's certainly not out of the range of possibility that

democrats can continue to hold the house in which case they could reauthorize the select committee. one objective is certainly to demonize investigators. this is a man who is never as much loved as when he portrays himself as under attack. the second thing is to distract from the other guy in florida, ron desantis. who had an astonishing victory last week. and it is certainly in the sentence on trump's in decline. the third purpose here is one that i don't think folks are talking about enough. and that's to circumvent tests james who isn't your attorney general has a change of preliminary injunction in new york. that restrains trump's use of his assets and those are the trump organization. it appeared -- he explained that that is -- puts a hold on over five billion dollars of assets worldwide. and effectively grinds to a halt the business of the trump organization. the guys got to make some money from somewhere. incredibly in the united states, independent packs are super

pacs, there are no controls on whether a candidate can use those funds for personal uses. that's a subject matter that's been of concern to judge in your six committee to. where is that money going? -- surest way to make some new money. that's not within reach of attorney general tish james. >> that is fascinating. and a very important point you bring up. some reports, lisa, say that the doj is considering naming a special counsel to oversee these numerous trump probes. if he runs again. constitutional law professor -- former u.s. prosecutor dennis -- they say too late for that. what do you think could it quell some political games. i only have a few seconds francois polarize for. >> i think that it's not that it's too late but i don't think it'll happen. and here is why. there is the time the way that'll be caused by the apartment of the special counsel. a special counsel under the existing regulations can only be removed for cause. that's a danger that i don't

think merrick garland is willing to risk. and the third reason why i don't think they will is look at the staffing decisions that merrick garland has made recently in bringing back david raskin and david roddy two very skilled trial lawyers from the southern history of new york have gone on to success other places. the fact that they're backed within the port of justice -- indicate that this is a department that believes it will try a case. and needs the staffing to do so. given that the attorneys in the national security mission don't usually try cases the same way that for example other jurisdictions they do. >> the 41-page lawsuit that donald trump's team has put out there to try to quell any forcing him to say testify. you said is not the chestnut that everybody anticipated. tell me quickly about that. >> i don't think he really had to do anything at all. the reason is there is not enough time for either side here to litigate that lawsuit to completion. if you are expecting republicans to take over

communities for military families throughout the u.s.. kathy augusta have you on the broadcast after a conversation a few weeks ago. tell me briefly about your experience, your life experience in the military family and what prompted you to focus on creating community support for families. >> thanks so much for having me, alex. yes, i join the military not coming from a military family. i married my husband. became a military spouse and after 9/11, found myself in a community doing a very hard thing, multiple moves change my -- me losing my job. supporting my husband in combat. it's an honor and a pleasure to serve. but it takes a toll on your family. we need to find a way to support families better, so they can continue to volunteer their service. >> give me a sense where the most critical part is of your efforts with blue star families. what do current military families need the most as they relocate from place to place. relocating their entire lives. >> that's right, 600,000 military connected families
