and a good saturday morning to you all. i'm katie fang. we begin this hour with the extraordinary investigation involving donald trump, now entering a whole new phase. just days after trump announced that he is running for president in 2024, attorney general, merrick garland. appointed the special counsel. to decide whether trump should face critical charges in two separate probes. one involves key parts of the january six investigation, including trump's interference with the peaceful transfer of power. the other? trump's retention of hundreds of classified documents at his florida home, mar-a-lago. the involvement was somewhat of hers surprise given the recent new york times reporting that garland had long proposed appointing a special counsel to oversee criminal popes into the former president. but merrick garland says that extraordinary circumstances have now led him to this point. for more on all of this, i am

joined by nbc news senior national politics reporter. john allen. john, good morning. thanks for joining us. what circumstances is merrick garland talking about here? because what has changed? >> good morning counselor, there is been a lot that's changed in the last week, one big thing in particular is that donald trump, the former president, has now become a presidential candidate. and again with donald trump, as often we are in chauncey territory. but i don't want to jump all over the attorney general, we can hear from him himself without how exactly he made this decision. >> criminal investigations, developments, including the former presidents announcement that he is a candidate for president in the next election. and the sitting president stated intention to be a candidate as well. i will conclude that it is in the public interest, to appoint

a special counsel. such unemployment underscores the departments commitment to both independents, and accountability, and particularly sensitive matters. [silence] >> and katy, listening there to attorney general merrick garland, you get the sense of this really unprecedented moment in american history, he didn't really have much of a choice is what he saying. >> you know john, you tweeted out that you think that this special counsel appointment could actually be a nightmare for donald trump, could you explain a little bit? >> absolutely, i mean, what with donald trump expecting? he was expecting the ability to hammer the doj as a tool of joe biden, his opponents in the 2024 election, to be able to say that they were being unfair. that they were targeting, him this devising him in that way. and now you have special counsel and i'm old enough to

remember, you're old enough to remember, and our viewers are old enough to remember that for years, donald trump told us a special counsel was too independent for even the president. the special counsel was robert mueller, so we have this history of trump basically undermining the idea that a special counsel would be fair to the president, yeah, undermining that idea. and so. it makes that a little tougher, the only thing is republican are not gonna look at donald trump in saying the odds of him getting a diet, the odds of him going to trial and being convicted are a lot higher. so real bad moment for donald trump. >> i'll tell you john, two-time impeached inaction denying donald trump is now entering two-time special accounted appointed donald trump. thanks for joining us this morning. i always appreciate you being here. and later in this hour, we are going to dig into the other side of merrick garland's argument.

why some legal experts are saying the doj support of a special counsel may frankly do more harm than good. msnbc's legal analyst, stanley, is standing by for that analysis. but let's move on now to the historic week that happen on capitol hill. how speaker nancy pelosi saying, she is gonna step down at the democratic leader in january, and make way for a new generation of leadership. plus, with republicans officially contain control of the house, they have begun to out their agenda, and they are making clear that they want to use their oversight power to investigate, and investigate, and investigate. we turn to nbc news correspondent, ali, who is live for us on capitol hill for more. good morning early. >> katie, good morning, democrats aren't wasting any time trying to fill their leadership positions of the, house after house speaker nancy pelosi's announcement on thursday, that she will step down from her leadership role and really pass the torch onto a new generation of democrats, while staying in a rank and file position in congress, and

now we're starting to see who's interested in these top leadership positions, new york congressman hakeem jeffries, currently the fourth ranking house democrats, announced yesterday that he is going to be running to fill pelosi's role as democratic leader, if elected. he would be the first black leader of any party to be in both the house and the senate. and we're also hearing from representatives catherine clark, and pete aguilar, who are running for the number two and three positions and democratic leadership. those democratic relationship elections, rather, that would be held in recess round of ember 30th, to december 1st. pelosi endorsed all three of them in a statement yesterday. saying that they are quote ready and willing to assume there awesome responsibility, all of this is happening as kevin mccarthy tries to solidify support for his bid for the speakership, after we learned that republicans will now control the majority of the house for the next two years. in just the last, week

republicans have had several press conferences where they've announced what they plan to investigate over the next two years, take a listen to a bit of that. >> i want to be clear, this is an investigation of joe biden, and that is where the committee will focus in this next congress. >> so this is the focus on the judiciary committee, that political nature of the justice department. >> we can impeach secretary mayorkas. we can impeach merrick garland. >> i'm introducing articles of impeachment against joe biden on monday. >> house republicans vowing to investigate everything from the biden administration and his family, the u.s. mexico border, the department of justice, and the u.s. withdrawal from afghanistan. katie? >> allie raffa, happy to see republicans had their priorities in order, of course and saw how the violent, thank you for joining us this morning. we're also following the big

business move this morning. theranos founder elisabeth holmes sentenced more than 11 years in prison, this after holmes was found guilty in january. and for charges of defrauding investors by overhyping the capabilities of a failed blood testing device, the judge has ordered her to surrender to authorities on april 27th. now to western new york, which is getting hammered by a historic winter storm. so far, snow totals reaching more than five feet in most locations, in the snow is still falling. officials say at least two men have, died as a result of the lake effect snow storm that is expected to create dangerous conditions throughout the weekend. for more on all of this, we turn to nbc news correspondent marie separ who is live in buffalo. >> good morning, yeah, even though things may look calm, now this is still very much a very dangerous situation, and in fact just a few minutes ago is found out that the city of

buffalo is under a travel ban. just know that the travel bans around here in erie county have been off and on, and it really just depends on how much snow has fallen. and what the state of the roads are. so you can pretty much guarantee all of this surrounding area is either under a travel ban, or travel advisory. and the way's lake effect snow works, is that things look calm right now, but and five minutes we could be getting zero visibility with gusts of, winds and snow that's falling. making it really hard to see. and you just mentioned what we've already seen in terms of the danger, so we've had a roof that collapsed, that was in hamburg, it's a little further south. that's where they're really seeing the heaviest snowfall, and that is a big fear around here. of course. because of that heavy snow, and we also had those two people that you talked about, they unfortunately did pass away. they were trying to shovel that heavy snow. and that is something that is a big concern, because the snow is far from over. we are going on our 36, and we're already seeing roughly

with the decision by the attorney general garland, to speak of special counsel. i don't think it's needed under the regulations, and i think it risks delaying the investigation needlessly. >> grateful for that unique insight from msnbc contributor, and former u.s. acting solicitor general neil cattle. neil drafted regulations for appointing a special counsel in one of his first jobs at the department of justice. and he does not think that garland's justifications meet the threshold of appointing a special counsel, especially given how far along the

mar-a-lago documents investigation has already advanced, but merrick garland once the de politicize the situation as much as possible, and in his view, appointing a special counsel underscores the departments commitments to independents, so who is right? i have just the person to ask, my friend at msnbc, leah analyst danny solace, danny good morning. as always thank you for spending your time with us and lending your insight, you know neil castile is not alone in this, there was a lot of stuff going on and twitter yesterday about this, i'm sure you cite, former u.s. attorney and senior fbi official -- also wrote a -- appointing a special counsel's unnecessary, and it can be far more proper maddock than completing it within the regular channels. i have to ask what is your take on disappointment? >> you could take this as merrick garland being extra cautious, but it's pretty easy to also see it as a punt. as kicking the can. as passing responsibility down the lane for a difficult

decision. look, when, the mueller investigation happened, a lot of things we did not know, we were surprised when paul manafort was indicted, we were surprised when michael flynn was indicted, but i have to ask, you is there anything about january 6th that you feel that you don't have a handle on? we had an entire impeachment trial in 2021 on the issue with plenty of video, then the summer the january six committee educated all of us in primetime about almost everything that you can imagine about january 6th, is there anything left that we really don't feel like we have a handle on? and then when it comes to the mar-a-lago documents, you know and initiated that investigation? the doj. they went before a court and got a search warrant which means that they felt that they had probable cause that a crime was committed, so, what is left? it seems pretty obvious by now. that trump took the documents. and it seems that he may have covered up taking the documents, he may have defenses, some

constitutional. other vice presidential. but those are all known. what is left to investigate? is jack smith just gonna come to the doj and pick up the file folder. and pump through it himself? or is there even any independent investigation let's to be done on the either of these issues? so, in terms of simply spending resources, i really wonder at the necessity of appointing a special counsel to investigate something that, everyone has already investigated and appears to know everything there is to be known about it. >> let's go old-school law school you and i right now, and i'm in a push back and say to you danny, the following, you're not gonna bring in jack smith just a turn around and declined prosecution,, it gives him cover to merrick garland who is a true institutional especially because of the announcement on tuesday that trump is now officially running for president of the united states, again, in 2024. assuming argue window as we've

been assured by, garland in jackson, it's not gonna slow down the pace, the tempo, the speed by which we come to a resolution, what is the real downside? then >> i actually agree with, you and in that sense, as i sent the, france look, it's a safe choice. merrick garland, you're right, is an institutionalist, he's always been concerned about things like separation, of powers, he's always been concerned about constitutional defenses and other issues, and in that sense, it is the safe, ultraconservative with a small seat, choice to appoint a special counsel. but i just have to wonder, is it necessary? is it really something that has to be done? i have to wonder if another attorney general, or even if this was a regular person, a regular civilian and this was the regular u.s. attorney's office, i don't know that they would spin this many wheels in arriving at a conclusion, either move forward and prosecute. or declined prosecution. >> i mean, listen, i had to give donald trump more credit

than anyone's the, but it is former president donald trump. current president candidate as well. that's underscored. that's why they made this move. but i do want to talk to you about jack smith, jack smith is a very mellow, very common name, but not a common job. what is it about jack smith that actually he would have some confidence, danny, that he is the guy for this job? he is the right man to put on the hats, as special counsel, to go after donald trump. former president of the united states? >> but katy, you know, this jacques myth is that classic doj glistening resume, x specially pedal greed. i believe. has done everything, he's worked in public integrity, he is prosecuted corruption, he has, he has done it all. so, this is of course a small choice, but most of the lawyers and doj are pretty impressive folks, and he is no exception. he's got experience prosecuting

organizations, and i think that is key in this decision, he's been a lifelong prosecutor, although he spent a little time in the private sector, look, he is an impressive person, no question. he is qualified enough to lead this investigation so, yeah, is this ultimately, just cover for merrick, garland? i think you might be on to something there but look, it's special counsel, eminently qualified. >> well as i tweeted yesterday, the best thing about america is that everybody can disagree and have their opinion as to whether or not something is good about india. jenny, thank you for joining us, as always i appreciate you being here. and coming up! surprise surprise, trump's refusing to cooperate with the special counsel, is that a sign though that he just might be scared? his former personal attorney, michael cohen, knows him all too well. michael joins me next to talk about all of it! about all of it! roster ever assembled.

know about donald trump, it is that they he is completely predictable. friday night he lashed out at the doj after merrick garland announced the appointments of the special counsel to oversee the investigations into the mar-a-lago documents case, and his role in the insurrection. >> the corrupt and highly political justice department just appointed a super radical left special counsel, this is a rigged deal just as the 2020 election was rigged. >> it's the same old schtick, and so of course and predictably, he had to throw in the false claim there that the 2020 election was stolen. also not shocking, the former president told fox news that he will not participate in the investigation, calling it the worst politicization of justice. he also urged the republican

party to stand up and fight on, his behalf and of course some of his biggest supporters came to bat for him. without any evidence to accuse president biden of weaponizing the doj to attack his political opponents, and marjorie taylor greene doubled down on her call for the impeachment of merrick garland, and called on her house colleagues to refuse any funding to the special counsel, raul and saying to press yesterday, that an extraordinary cases it is in the public's interest to appoint a special prosecutor, joining me now is michael cohen, roemer personal attorney to donald trump in the host of the successful mea culpa podcast. michael, thanks for getting out and joining us this morning. you know donald trump really well, you know how's mind works, his public reaction frankly sounds like every other public reaction, very and remarkable. but how do you think he is reacting to the news of the special counsel now. >> it's a one trick pony, it's exactly the same thing, unlike

jack smith ends up exonerating, and exonerating him completely where he can go run around the country and say i've been exonerated, i've been, exonerated he's gonna call it the same thing. this is joe biden in the administration, weaponizing the justice department to go against poor dear old donald, the victim of every single investigation, it's just a one trick pony. >> you know michael, you obviously have some insight into special counsel investigations, you are part of the robert mueller investigation back in 2017, while he was looking into allegations that trump was involved in russian election interference, what is your take on this move by merrick garland, is it the right call to appoint a special counsel in this case? >> look, right before me you had dan east cevallos on, there is not a single word that came out of his mouth that i disagree, with it is 100% accurate, first of all, they have already interviewed at the

investigation, the january six investigation, more than 1000 people, and i've sat for more than a dozen and a half of these investigations, they are all, no less than eight hours. so do the math yourself, over one year 24/7 of speaking and obtaining information, if you don't have what you need after that? could you imagine that they got me after 48 hours, simply by attacking and in threatening to indict my wife. i don't understand what's going on here, i am in total agreement with danny, and then on top of that, how about the fact that the mar-a-lago raid, yes exactly is as they said before, you're talking about that they had a warrant, they got it from the doj, but more importantly, and i want to add something to what he, said thank god documents during that raid that were marked, classified, top secret. no one can understand that donald is not allowed, the only one who doesn't understand it

is donald, right, he is the only one in his mind that is allowed to hold classified documents in his resort, it's not his home, every once has a stop calling it his home, it's not his home. it wasn't guarded, it's not his documents, it's enough already, and this is a simple, open and shut case. why are they bringing on a special counsel, and this is no disrespect to jack smith. the guy who is clearly, clearly like what do you call, it robert mullin was. as fine individual, and he's a fine lawyer but it is unnecessary. it is just the lead. and that is donald trump's tactic, anytime that there is a delay, whether he created or we foolishly create it. he will take advantage of it. and he's gonna take advantage of this as well. >> so michael, does the appointment though, because my push back to you is, i don't think that you would bring on someone like jack smith, just a turnaround into a prosecutions acclamation, saying we're not

gonna pursue charges in this case, does the special a council appointment suggest to you that perhaps the doj believes that there is sufficient evidence to prosecute, trump it creates a while to eliminate any conflict of interest and allows the doj to proceed accordingly, regardless of how far along the investigation currently stands? >> so now we have to prove to donald that there is a wall in between the biden administration and jack smith? or against an indictment simply because once again, there is more than a year's worth of 24/7 testimony by individuals, you have a warrant to search a guys property, and you find exactly the documents that she were expecting to find, top secret documents, now you need another layer to go in there and prove to donald, again unless that there is a complete and full incineration, he is going to claim, that it is a witch hunt and weaponization

anyway. >> michael, let's switch gears for a second, obviously that announcement that was that donald trump, that he was elected again, triggering the special counsel for merrick garland, but there is a huge deflection that is happening. donald trump's kids, even evangelical questions, some of the qanon saying that we are done, do you think this is some type of -- , this lack of support from donald trump that we have finally reached that tipping point of trump fatigue, thereby mitigating the power or decreasing the power of his run for the presidency in 2024? >> so far, the people in the groups that you've just indicated, they are all leaving him, and for several different reasons, one of which is they've all gotten out of him everything that they wanted from him in the administration. we'll start with the evangelicals, they got roe v. wade overturned, that's all they really wanted, they got the appointment of a series of judges that are southern white

christian coalition evangelical community, that are going to, now have how many years, they have another 50 years that they could potentially be sitting on the bench, they got what they wanted out of it, and then you take a look at jerry, why did they leave? while jarred got everything that he wanted, and so did ivanka, they made 600 and $40 million while they were in the administration, jarred's father got a pardon that he wanted, on top of that, jarred pulled down another two and a half billion from the saudis, and it faded even on the, show i believe that jared and ivanka potentially the moles, you know, in terms of the mar-a-lago documents and so on, and it would be very interesting to have, let's say, the son in law and the daughter in law who are fbi informants, doj informants by acting as senior members of the campaign floor, and administration if he should

somehow managed to slide back, in and so they are gone as well, yes his popularity has waned because he's a maniac, and people are tired, yes it's trump fatigue, is trump's arrangement syndrome, we are already tired of the chaos and even those people who are, we will call them, the radical rights since he likes the call is the radical, left the radical, writes they are tired to, and we need to see america prosper, we need to see america move forward, and under a trump administration that could never happen. i talk about that in my book, revenge, all the time. it's, in my book one of the things that i do is i lay out and i think it's the most important not because i wrote it, because they truly believe it. it is the single most important book that you need to read right now, if you are a trump supporter, you will fully understand exactly, exactly who donald trump is and how far he is willing to go to destroy our democracy. and if you are a trump to tractor, then all of a sudden

commitments. technology reporter for the washington post, cat microscopy joins me now to sort through this chaos. cat, welcome back to the katie phang, show had to have you on because twitter is in a full meltdown, it seems like elon musk's strategy is to frankly, pro trump twitter anyone that is disagreeing with him. with over 1000 employees altering out of the ultimatum, does he have enough right yes men left to keep twitter up and running? >> it is a big question, and these departures are coming right before the world cup. which is typically one of the most popular times for people to log on to twitter. so talking to some current and former employees. there really is a concern about whether the site might experience allergists over the next week as people log on to talk about the games, there is also just a raw concern about the ability to keep twitters safe running as mask tries to make major changes to the path for him. one former employee i talked to,

brought up a bid that, you might not see the crash right away, but as mark tries to overhaul the saints, and you don't have people in the institutional knowledge about how systems, work it's very possible that when you're -- that you could end up breaking something. >> you know cat, musk could've hauled a group of engineers who actually wrote the software to come back to twitter headquarters yesterday, and overnight he tweeted that the group wrapped that code meeting and he said that they will return on saturday morning. it seems to me that his focus is on the engineers, on the infrastructure. but he's also reinstating bans accounts. whatever happened to that moderation council he said that he was going to appoint to ensure that there was actual content moderation happening there? >> we haven't heard more about their counsel, and based on the latest numbers, we heard that perhaps that half of the trust and cvt which is the team that develops the policies around content moderation, and keeping twitter save, did not sign that

he's got that consent order with the ftc, and now congress is looking into his business. >> so, both current and former ftc officials i've talked to say that elon musk should be very worried. twitter has been under a consent order with the ftc for more than a decade because of past alleged abuses of users data. when a company is under an order like this, it gives the ftc power to bring fines when it finds it violates, and again, twitter actually, earlier this year, already reached another settlement with the ftc. if twitter is found to be repeatedly violating the order, that is something that could introduce finds in the order of billions of dollars against the company, which is a big concern. i think one of the reasons why this is such a tricky and delicate effort for muskets because you have so many employees supporting the company with a lot of the concerns themselves. the ftc and federal regulators, when i look at the companies, often turn to those people to be sources of their
