10 am eastern. don't go anywhere, we'll have more news in a moment. a moment. >> hello everybody, good morning to you, i'm yasmin vossoughian. right in early for you here in los angeles, california. that the former president this morning firing back, continue to repeat election lies and calling the department of justice rigged after attorney general merrick garland appointed the special counsel to take over two major criminal investigations into donald trump. first, for the storage of documents at mar-a-lago, and seconds, of course, for his role in the events leading up to and on january six. the man appointed special counsel, longtime prosecutor jack smith, said in a statement the pace of the investigations will quote not to pause under his watch. and that they will move towards quotes, whatever outcome the facts and the law dictate. let's get right into.

which i want to bring charles pullman in, civil rights attorney, local prosecutor, and msnbc legal analyst. charles, as i was going to get to talk about this. before we get started, i want to play for folks a little bit at the press conference yesterday from the attorney general, and then we'll chat. >> based on recent developments, including the former presidents announcement that he is a candidate for president in the next election, and the sitting presidents stated intention to be a candidate as well, i have concluded it is in the public interest to appoint a special counsel. >> so, there are a lot of thoughts, reporting around the fact that this was a possibility after the announcement the former president making was going to run for reelection in 2024, and yet, here we are with the appointment of the special counsel. give us first your gut reaction to this appointments. what it means going forward. >> well, i think the initial reaction i and many others had

was a little bit of disappointment, but the disappointment was i think there was an expectation that merrick garland was going to move forward with this on his own, because he had as much as he needed to move forward with respect to charges and indictment and prosecuting former president donald trump, but at the end of the day, he decided to do what he believes was going to be the most apolitical thing. i don't think that's going to matter in the court of public opinion. i don't think it changes the narrative from what donald trump was going to say about this being politicized. i think that's going to be the same thing. in my mind, there's no difference from merrick garland 's doj inditing him and putting charges against donald trump than i special prosecutor. that being said, i do say at this point, we will see the special prosecutor move forward with this investigation and also likely with charges and a prosecution against donald trump. if merrick garland was unwilling to do it, but knew it needed to be done, this is the result and this is where we find ourselves. >> so, you said something

important there. the likelihood of charges coming down, i think that's the 1 million dollar question here that everyone is wondering with the appointed of the special counsel and the timing of that, when the doj would come forward. if they would actually come forward, something like that. before we get into the nuts of that conversation, barbara oked made a case on twitter this morning, which i thought was fascinating. while she says, essentially, she doesn't necessarily think there was a necessity for a special counsel, she says this does provide kind of an extra layer of independents this appointment of a special counsel from those that were appointed by this administration. also, more importantly, freeing the attorney general up on this team to focus on other things that are more important right now, we're not necessarily more important, but important nonetheless, one of which is voting rights. but do you make of those two arguments? >> the irony of this case is merrick garland has shown, throughout the course of this investigation, his doj can handle a multitude of things at one time. we've seen his civil rights division under the direction of kristen carr, for example,

indict the officers responsible for the death of breonna taylor. that took place in many cases, lost steam, because the backdrop of donald trump and how he sort of sucks the air out of the news cycle. so, the notion that this would have somehow inhibit said the doj from doing their job in other areas i, think it's a bit overblown. they have a number of different resources, and they can handle that. as far as the additional layer, i do think it does gets merrick garland himself and the doj an additional layer so this is now not overly politicized. i do think, in a certain way, again, the narrative is not going to change. there is still going to be a conversation that joe biden's political opponent is now facing charges under a special prosecutor who is supposed to be independent, but was appointed by the doj. that conversation is still going to be in the air. it's still going to be a narrative the right and donald trump himself will attempt to paris over and over again. ultimately, i don't know that even with this additional layer of protection, there is a

significant net gain on behalf of the doj in terms of saying look, we are apolitical and we're saying out of it from that perspective. given everything else that we now is taking place, donald trump is still running, joe biden it's still saying he is going to run, so those factors are still going to be present even as this investigation proceeds. >> tell me about the difference in the game here, charles, if he. we'll quickly. because this is the time we had a special counsel appointed. the first time around, we all know at this point, was bob mueller. at that point, donald trump was president, he is no longer president right now. he is technically, essentially, a private citizen running for president, come 2024. how does this change the game when it comes to this appointment? >> significantly. we have, throughout the course of his post tenure in office, been asking the question, what sort of rights and protections that's a former president have after he has lost office? resoundingly, the courts have repeatedly led to the notion that, not much. not many protections. i think that's something that

gives donald trump a sense of two unspoken ways of truck, and filing police to block the investigation, he's going to find very little success if any recent precedent is an indicator, because most courts have decided that you are civilian. you are a private citizen. and the executive privilege, any privilege protection you had, enjoyed, you no longer do. >> let's get to the million dollar question, charles, if he. well everyone kind of waiting with bated breath. will they or won't they file charges against the former president? he seemed pretty assured that they will. is it because of the evidence you feel this way? where because of the appointment of the special counsel, or the combination of the two? >> i think it's both. i think we are likely going to see some charges filed against donald trump. to me, it's not a question of whether, it's a question of which. i'm trying to figure out which of the charges that we have in front of us are the strongest and will be of greatest interest in to the special prosecutor throughout the course of this investigation. i think it is going to happen.

>> you have a sense of timing? >> sooner than merrick garland was going to do it, and i know that's not saying much, but with the special prosecutor in the mix, i would expect that we will see something sooner than later, in terms of charges against donald trump. it's impossible to predict, because we don't know the status of where those investigations were, and how much more needs to be completed in order for him to feel confident, but i do, think again, it will be what we have seen before. >> charles, you are a smart man. we all know that, obviously. that is a very easy, safe guess, i would say when you are saying sooner rather than later, but i'll put that on the record. charles coleman junior for us, great to talk to you this morning. appreciate you joining us. ahead, everybody, a state of emergency still in effect for parts of buffalo and across western new york as well, after a deadly snow storm slams the area. we're going to go live to buffalo later on in the show, but up, first you got republicans now in control of the house. they have big plans for the

republican fight is brewing. cupe leader kevin mccarthy is the most likely candidate to replace nancy pelosi as speaker, now the republicans have crunch control of the house. so far, at least fort mcmurray's colleagues have publicly said they will not support his bid. this is happening after a historic speech on thursday by pelosi, announcing she would not stay in leadership. instead, she would pass the mantle to the next generation, with representative hakeem jeffries set to lead democrats. i want to bring in my guest now, joining me, nicholas wu. congressional reporter for political michael hart way, former spokesman and communications director for representative hakeem jeffries. welcome to both of you guys. thank you for joining us. nicholas, let start with you on this. one you have kevin mccarthy, who won't even say on the record that he is going to endorse former president donald

trump's bid for the white house on 2024. this is a guy who stood by him. we know where he stands when it comes to donald trump. but it is obvious right now he is trying to vie for the votes to become the next leader of the house, between the right and left wing of his party, the center and right wing of his party. where do you make of where he stands right now? >> right now, kevin mccarthy has amounting the problems. he has to win 218 votes on the house floor on january 3rd to become speaker, and we are still figuring out the exact final math of the house, or you can only afford to lose a handful of votes at most. right now, there's three or four house republicans who openly declared they won't support him for speaker. so, the question for mccarthy is, it's this going to be in? is that going to be all the republicans who say they won't support him, or is he going to have to try to find a way to bring these people over to his side? what sort of concession to see

going to have to make with that, whether that's pledging to do investigations or seating marjorie taylor greene on the oversight committee? that's the question. >> we already know what the republican agenda is. coming into this next session, and it is launching an investigation. they have made that completely clear. you have the gop heading into the midterms, that campaigned on quote unquote fixing the economy with no plan in mind. that quote unquote plan campaigned on crime, fixing crime, with no plan in mind, and gets here we are, and they're talking first and foremost about investigations into the biden family. nicholas, let me play for you representative james comer from a press conference on thursday, talking about these investigations. >> the biden family swindled investors of hundreds of thousands of dollars. >> hunter biden is not this innocent guy who got a bad breath. >> this is kind of a big deal. if we could give you that hunter biden, that would be great. >> you get control of the house, and this is what they are leading with, nicholas. >> well, this is going to be

the tight rope republicans will have to walk next year. the seats that gave them the majority come from these pretty blue areas of the country. several of them came from seats in new york, where president joe biden won by a fair amount. so, questions for republicans is going to be, how do you balance these demands for -- investigations, calls for impeachment of biden and his cabinet members, with the fact that you have these very swing seat republicans who perhaps don't want to see that, at least not at the outright? >> michael, let's talk about the new leadership on the dam side, if we. way and see pelosi's making that historic announcement, she is obviously not going to be a leader. steny hoyer and clyburn are stepping down as well. was that new leadership going to look? like you have jeffrey humphreys, your former boss, pete aguilar as well. talk to me about jeffrey humphreys and how you sees potential leadership playing out. of course, many people remember him as one of the house impeachment managers in the

2020 impeachment of former president donald trump. >> in my view, he is a start that embodies everything great about america. he grew up in this working class family in brooklyn, went to graduate school, went to law school, ended up working for a very large company as an attorney, as a litigator, and now, i think, is the voice of our party in terms of his fight for the working class and his fight for affordable housing and his fight for criminal justice reform. so, i think he is the perfect person to lead us into this next generation of democrats who are focused on items like affordable living and raising the wage and all of these other important things, but understand the idea we have to work across the aisle to get things done when we can, and i think hakeem personifies all of those things. >> i believe back in 2012, hakeem was kind of painted as the next barack obama now stepping into this leadership position. almost a decade later.

there was this amazing new york times piece that led with this idea of democrats in a ray, question mark, michael, oftentimes we think about democrats or talk about democrats being in disarray, not trying to get one messaging in their, and now looking more towards the republican party in disarray, with a very slight margin of control in the house. i want to play for you, mary haugen from last night, i believe, during the jewish republican coalition, speaking to the sense, and then we'll talk. >> a party that has lost the popular vote in seven out of the last eight presidential elections and couldn't even beat joe biden is desperately in need of a course correction. >> how does a house democratic minority capitalize on kind of republicans in quote unquote disarray, right? and now, this agenda they've put out there, they're going to pursue the biden family first

and foremost, investigate the biden administration? >> republicans in ruin, as -- said so eloquently this week. i think it's very interesting, in terms of a dynamic leaning into next year, i say that because it will be such a slim margin on every single vote, that's house democrats have significant power in terms of any agenda that is put forth. simply because the speaker will need their vote on so many different issues, and i think that also translates into what happens with committee chairs and their agendas as well, because frankly, i think you will see mr. jeffries say we are not going to support you on these particular issues. you are asking for our support on base. if you focus on these nonsensical, expensive investigations, they really do nothing for the american public. i would also like to say it's very interesting these individuals who are completely absent during the most corrupt presidency in american history, the trump presidency, they had nothing to say about the

page 46. gop mega donors have come out against trump candidacy as well. and lawmakers, the media as well, that cover them have their own telling reactions. it looks like we don't, there we go. -- it looks like we don't necessarily have that sound. we are going to try to get that time for you guys, because i think it's important to show what has been happening across the board when it comes to, especially republican reactions to the former announced president he's announcing he's going to unfortunately for. let's bring in our guest, carlos curbelo, nbc and former -- congressman, former republican strategist and nbc analyst as well. let me get with you on this one. we are obviously going to play that sound there, a lot of those turning against the former president. they're saying, a centrally, it's time for a new day, right,

turn the page on the former president. but not necessarily outright coming out and saying he is not the one for this party. i want to play for folks, also, what's his biggest ally for some time is now saying as well. that is his former vice president, mike pence. then, we'll talk. >> having seen what you saw up close for four years, do you think there is a danger in donald trump being president again? >> well, always be proud of the record of the trump pence administration. and for four and a half years, president trump was not only my president, but he was my friends. obviously, it didn't and we'll, and while the president and i parted amicably, i believe, as we look to the future, we will have better choices. >> it's actually astounding, by

the way to, see his former vice president saying they parted amicably, considering the fact you had jen six insurrectionists saying hang mike pence on the very day, and he still stands by the idea that they parted amicably. that is not the sincerely theme amicable, but they don't look like the definition. we'll get back to. do nevertheless, this is as far as his former vice president is going to go as far as announcing the former president. some republicans have gone further. some republicans have gone less. that being said, do you feel as if, susan, it is naive of us to think with all republican party is going to abandon donald trump, especially if it means in six months or so, they say, he's our guy, right? could we see folks doubling back? >> yasmin, brakes are funny things. i think what we're going to see is, will they kind of gets back together like republican elected officials have in the past, and you say to abandon donald trump, does it matter?

the real question is, where is donald trump's base going? the elected officials are irrelevant to donald trump's equation. as a matter of fact, he may even welcome it, because should he become the nominee of the party, no one will enjoy making them more miserable than donald trump. he will exact his revenge in that way, if necessary. but you know, i've been wondering for a long time, does donald trump need those crowds at the rallies, were just the crowd at the rally needs someone to follow? right now, donald trump happens to fit the bill. the question is, will the base the side there is a different type of leadership they want? at this point, noise coming out of washington, i, think is a relevant to what leads to the ultimate republican nominee. >> here's my question though, carlos. it's the republican party ultimately -- do they ultimately need donald

trump space? how big is that base, really, at this point going forward? will they just follow suit if, in fact, it is decided that donald trump is not necessarily going to be the nominee, and money and supports will be put behind someone else like a ron desantis type of person? >> well, yasmin, it's clear that the establishment, the donor class, a lot of the politicians in the republican party are ready to move on from donald trump. it's also pretty clear that the general public is kind of tired of him. this whole act has become predictable and old. it's no longer interesting, like maybe it was for people some years ago. but the big question is, this base that donald trump does still have, i'd say, about 25% of people in the united states, are they willing to follow someone else? and, if donald trump decides that he's not going to get the domination, he is going to try to destroy whoever does, which, by the way, it's something we can expect from donald trump,

what is that base going to do? are they going to turn out in respect for the republican nominee, me that ron desantis or somebody else or, are they going to listen to trump and perhaps a home or vote for someone else? that's the trap that the republican party has set up for itself. they have empowered donald trump so much, and he has all these pow followers, and people don't know what those followers are going to do yet. >> we already see, susan, c and opening. talking to voters on the trail in the lead up to the midterms, after the midterms as well, especially considering essentially how so many voters said no to donald trump and now the election lies. you've got voters out there on the election trail saying listen, we are open to hearing about other candidates. we can still support donald trump going forward, we are also open to hearing about other folks. that is the first time or seeing this during a trump era, and it seems like this should be an opening for the republican party. >> there is a really small but

viable opening their, yasmin. you bring up a great point, because the difference is back in 2016, everyone was tired of the establishments. down comes donald trump down the escalator, and he shakes everything up. he brings to voice peoples, frankly, their anger and where they have a place to kind of comb is right together. now, people are tired of donald trump. they are open to something new, which may be establishment. it may be another populist type figure, but they are tired of donald trump. they don't want the baggage. and the question is, is what do those numbers shape out like, it's how many choices will they be given? if there's ten people running in a primary, donald trump has an opening there, even if people are tired of him, because the vote gets to my debunk nine others. it's interesting to see the establishment, but many people, can't gets behind maybe one or two real front runners.

>> carlos, you think about the unprecedented nature of what we're dealing with right now. we have a former president who incited an insurrection, who was impeached twice, right? in the house, who is facing criminal probes, possibly criminal charges by the department of justice. it is unbelievable we are here. and now, a special counsel appointed jack smith to this investigation. how do you see all of this playing into the former presidents campaign going forward? >> yeah, yasmin. the support is all of this, in a way, has become normalized. we are kind of used to this. we are used to the scandals, these controversies, and i think all of that is going to be magnified and amplified or the president launches his campaign, and i guess soon he will start his rallies, which is why he enjoys the most. listening to what he says, he was extremely disciplined when he launched the campaign at mar-a-lago the other day, but we know from looking back that

that's not who he is, and that is very unlikely that he's going to continue having that kind of restraint and discipline. so, i think you can expect donald trump to continue trying to tear this country apart, to diminish our institutions for his personal gain. it's going to be up to republican voters and republican elected officials to say enough is enough. we've been waiting for years to see if they dare do that. a few have. not enough, but we will see. i think that time is coming. >> yeah. >> especially with voters, republican voters even, saying you know what? we're tired of the sky. >> you make a really good i mean >> you make a really good point. they've never said it before. the question is, will they say it now? why are they seeing it now? will they stick with it? ultimately, thank you. congressman carlos. and the rest of you. coming up next, just minutes ago, buffalo reopened its ward.

♪♪ voltaren. the joy of movement. ♪♪ >> welcome back everybody. a powerful winter storm is slamming parts of the northeast in buffalo, new york. at least two people have died of cardiac events after struggling heavy snow. more than five feet of snow has fallen in some areas. there were reports of thunderstorms. several parts of western new york are still under a state of emergency. there are travel bans currently in effect. marissa perez in buffalo for us with much more. marissa, good morning. marissa, what are conditions like right about now? the snow, wow. just insane behind you! >> all around the you can see, almost as tall as i am from the snow banks here. to set the scene we are little south of buffalo. we are in lackawanna.

just across from lackawanna police department. that is about ten miles south. let me set the stage. we have a couple of businesses behind me. you can see that they have done the best they could to clear the pathway, a little bit. we have a lot of fresh snow overnight. but, as beautiful as it is, you mentioned how dangerous it could be. i have my photographer, paul, panicked that camera just a little bit. look at what is on the roof. that is a big concern. there is so much snow that we have seen in the past. in 2014 we saw several roofs collapse as a result of that heavy snow. this is something that they have talked about that is a big concern. you notice when it comes to the path they stopped once they got to that. as i am talking we are all very carefully going to show you what the neighborhood looks like here. the cleanup is really just beginning. so, here is a nice presidential suite. you can see those piles of snow on the street that are very tall. there are cars somewhere buried underneath. so, let's talk about the latest updates that we just got within the hour. you mentioned the runways. some of the runways at buffalo airport.

we know some of those are now reopened. and so, there is a sign of hope when it comes to the storm. which, by the way, is not over. it is just looking better, and different. at the moment, the bands have moved further north. we have a new update from the national weather service in buffalo. they are talking about how in hordes heard perk, where the buffalo bills play, 77 inches. yes, wrap your head around that. now, just for some perspective, that is about six and a half feet. that is a full foot taller than i am, right now. you can try to wrap your head around the visual of that. we talked about the buffalo bills. how they were impacted by that. the buffalo bills were supposed to play in orchard park, tomorrow. before we even saw the first snowflake fall they moved that game to detroit. the interesting thing is, they were supposed to practice in orchard park. all you have to do is go to the buffalo bills twitter. you will see for yourself. you might be seeing it on your screen, right now. the images. the stunning images of all that packed snow. we have talked about the danger. you mentioned, two people did

die as a result of shoveling the snow. it is so important to practice, of course, good form when it comes to that. but then, the other thing to keep in mind here is carbon monoxide poisoning is always a thing here. when it gets really cold people bring in those generators. they have been saying over, and over, and over again. authorities are reminding people to take the generators outside. that is something that was a problem in 2014. buffalo still remembers what we saw back then. so, we also have, of course, the concern over the roofs. when you have the strain on the roofs. we have seen a lot of people out and about. i'm trying to see if i could spot any. you could probably, just barely in the distance, make out some of the people off in the distance. they are trying to do the best they can to clear this. however, the thing is, guys, the snow is not done yet. we are expecting to see more bands coming through. this is between now and monday. what they are doing, right now, is good for right now. however, we are probably going to see more soon. maybe by the next time we

is joining me now from the white house. josh, take us there. some happy news. to say the least, you have some behind you. it could not be a more beautiful day for a wedding like this. are you invaded? what are preparations looking like? >> it is chilly, but sunny. i am not invited. there are certainly some special things about today's ceremony, yasmin. it will be the first ever to take place on the south lawn. before that, a century, now these white house weddings have really become iconic moments. they captured americas imaginations. dating all the way back to 1886 when president grover cleveland married francis fulsome, right here at the white house. and then, of course, there was that extravagant wedding for president theodore roosevelt's daughter in 1906. that was more than 1000 people that attended. you could see former president richard nixon there. his daughter trisha nixon cox also tied the knot here at the white house, walking down the aisle. right in the rose garden. unlike some of those past white

i think everyone wakes up every morning saying, this is it, it is just a last day, is twitter going to work this morning when you go to your feet? it's still working, by the. white news update. i can't help thinking this is kind of the beginning of the end of twitter. >> it's definitely the end of something. there have been lots of times, and in the timeline of twitter, there's been lots of different changes. this is definitely, that's the longest calling its, twitter to point out. some people are calling it evil on twitter. it's a huge change, they've lost three quarters of their work force. now, tech is a little bloated sometimes, so they could have reported to lose some of those people, but that's a lot of people and there's no real vision for the company besides being a mouthpiece for elon musk and the people he thinks are worthwhile, it seems, and it seems destined to fail from a technical standpoint. lots of people are telling us, we are waiting for sort of a large moment, a large traffic moment like, say, the world cup

also, elon tweeted were reinstated. he hasn't decided if he was going to reinstate the former president. or do you expect this is going to go? >> i don't like to make predictions, but i feel incredibly comfortable making this one, that donald trump will absolutely be allowed to be back on twitter. who is allowed into isn't allowed? all we have is to peer into the mind of a posting billionaire. but who did he bring back yesterday? he brought back jorden pederson, babylon, and kathy griffin. the babylon bee in jordan peterson were taken off the path for for misgendering trans people. that policy against hate speech and harassment of trans people, that is done with. that's important. this comes at a time when trans people are being harassed and violence is aimed at them at sort of unseen levels than before. this sort of matters. trump, it seems like, this is marketing for elon, the poll that's at right now.
