documents discovered at mar-a-lago. >> i struggle eve that the normal processes of this department can handle all investigations with integrity. and i also believe that appointing a special counsel at this time it's the right thing to do. the extraordinary circumstances presented here demand it. >> and that special counsel be jackson as he most recently prosecuted war crimes for the international criminal court at the hague, frank lucie is an msnbc national security analyst and a former fbi assistant director. joining me now, frank as always great to talk to you about the stuff. gave me kind of your first reaction to the appointment of jack smith and do you think it was necessary for the attorney general to appoint a special counsel here? >> short answer is no, i don't think it is necessary. i think for me as minutes an example of two things being true at the same time. by that i mean merit karlyn may have made a reasonable and

smart to in appointing jack smith. that is true. and at the same time, it can also be wholly unnecessary. similarly, it could be that jackson myth was the most stellar qualified lawyer available to be a special counsel. and at the same, time it could be that the gop as we have already seen including former president trump will be attempting to knock holes in him and tear him down as this unreasonable, far left wing extremist which by the way there is no evidence of. and then lastly it could be true that marriage garland has really put up a shield to help mitigate any perceptions or political partisan decision-making and true at the same time, that it will not make one iota difference to people who are insistent on seeing any investigation of trump us political nature. what a blood, probably smart and reasonable thing to do, also bottom line not going to make one bit of difference and

how people perceive this if they choose to. >> you're talking about of course of the former president reacted, let me read this quote for folks. i have been going through this for six years, and i am not going to go through it anymore. i hope the republicans have the courage to fight it. what are you most worried about with that statement from the former president? >> well he is already saying look, we will fight and i want everybody to fight, i don't like the word fight because we know from history that trump can actually incite violence and that could happen. here's what i'm worried about long term, trump has successfully eroded public credibility in our institutions. here he has been able to literally dictate what the attorney general the united states does. it church asking we are watching. his decision to announce early that he is running as a candidate for president, and mitt ali garland has told us but was a part of his decision-making on appointing a special counsel. we have somebody who now is that hey, i am a candidate for president. he is in that early, hasn't it

against the wishes of many of the leaders of this party. he is doing it because he thinks it's some kind of shield and it will help and portray himself as a victim. that bothers me as a career doj official right? a bad guy, someone under investigation can dictate high-level decision-making. and ultimately jack smith is going to have to make recommendations to the very man who appointed him the attorney general and that attorney general will have to say yay or nay. we are really kind of playing a game here and it is being dictated sadly by a former president who appears to be the subject of an investigation. i worry about that because for the longer term, we are going to see more calls for special counsel. you mentioned a clip earlier, hunter biden issue well okay, if there is a pending case that doj we believe there is, a pending case that doj against hunter biden. if that will necessarily have to involve looking into whether joe biden benefited from international business dealings of his son, while then you will hear demands for a special

counsel appointed by merrick garland. how far does this go? can we have a department of justice that resources credibility and says look, we are the neutral finder of fact and we are going to be that institution, you can rely on or no, we will have to keep appointing special counsels every time somebody cries politics. that is my concern. >> it really is astounding when you put a like that frank because we have never been in an era like this, in a moment like this one that of justice and the winning credibility if we have seen -- begetting of course with bill barr, and now kind of what it seems to be disappointment of a special counsel for a need to not politicize an investigation. which as you put it either way, if you see this thing is being politically motivated, you will see the thing is being politically motivated one way or another. i wonder though if you look back right to bob mueller, and special counsel the investigation then under the department -- attorney general bill barr and

how he wants that probe was complete, not move forward with any charges against the former president. how is this going to be different now that he is no longer president and merrick garland as the attorney general? >> it's a great example to talk about. i got, and we had a stellar person as special counsel right everybody understanding that mueller was the guy, from fair, neutral objective. fantastic and look we still had a manipulation of his findings by an attorney general who answered to the current president. we don't have that here, the person being investigated is a former president, the pressure that evil barr has admitted to, who told us publicly in this book financial views that he had immense pressure from the white house. we don't have that here, so that is good news and we appear not to have somebody as

manipulated and merrick garland as bill barr appears to have been. don't forget, bill barr appointed john durham in a special counsel to do something that was totally unnecessary to do and it resulted in essentially nothing. we have a different scenario, here former president but it's a candidate for president who will actually use this special counsel case as part of why he should be elected. everybody is up to get him and he is the victim and i want to see a doj that eventually returns to make a neutral, objective decisions without the need for special counsel's. >> that's exactly what the former president's teams will be campaigning, on so long as this goes on until of course, there is a decision made either way whether not they will file charges. frank nick lucy as always, thank you sir, appreciate it. let's continue this conversation to folks if we can't. want to bring in lawrence tribe, professor at harvard law school and author of two and a presidency, the power of impeachment.

lawrence, thanks for joining us on this. we appreciate it. i kind of want to start first about the timeline here with the appointment of the special counsel. and with that i want to play for you some sound from the attorney general talking about this appointment, how it will, go how it will be handled and then that will have you weigh in. >> i will ensure that the special counsel receives the resources to conduct this work quickly, and completely. given the work to date and mr. smith prosecutorial experience, i am confident that disappointment will not slow that completion of these investigations. >> do you agree with the attorney general there lawrence? >> absolutely. i had recommended back in march that a special counsel be appointed more recently, i have said i did not think it was necessary and in fact it might be too late. but now it seems to me that this was exactly the right move. not just for appearances, that

is not what merrick garland is all about. he is not into performance art and in fact, we have already seen the president has made up claims that this nonpartisan, non political special counsel was somehow a lack did. the that's not true, the reason that it makes sense that it will actually speed things up and the circumstance because merrick garland and lisa monaco's deputy are running a department up 115,000 employees. they have hundreds and in fact thousands of investigations and prosecutions going on around the world. they cannot engage in day-to-day coordination's, tactical decisions, which witnesses to be called before the grand jury? to make the charge for the mar-a-lago documents and mar-a-lago? or because the documents were stolen in washington. we bring those in washington post? all of those decisions need to be coordinated by somebody and

that somebody is jack smith. he has extraordinary experience, he is very aggressive. nobody can question his objectivity. and without, him there really is no head of that process. other than the attorney general and the deputy. and every time a decision is made by a u.s. attorney, burying on a part of this far flung and -- and prosecution, they would have to go up the totem pole, through the celebrant, sort of democracy and i've been a part of it and i have seen it in the justice department, before they get the final say so. from the attorney general, this cuts out the middleman and in fact, it basically says full speed ahead. that is exactly what's going to happen. so this indicates that we are close to indictments and this is the way to get them if the evidence and the law point there, they appear to. we don't know everything from the outside not jacks mid is

going to see from the inside, is a very quick study. i am very glad that this was done when it was done and the way it was done. >> so you know what's interesting, we know jackson myth as bob mueller did, he will have to keep his head on and be investigating the saying that he will deliver his findings and his results to the attorney general. and then subsequently, at the surge will be made as to whether not that can move forward with criminal charges right? talk about the precarious position at the attorney general finds himself in or will eventuality find himself in as the investigation comes to completion? he is deciding whether not to move forward with charges against a former president of the united states. a divisive former president of the united states, who incited an insurrection in this country. and who is currently running for president once again in 2024. >> well it seems to me that merrick garland is not an enviable position but i've known him for decades.

it was my student, he has a very stiff spine, he is not going to bend and response to those political pressures. he will do with the facts and the law and the cape and this that is just another indication that he is doing that and i don't agree that he was letting former president call the shots and he did not say there was a conflict of interest. he said it's an extraordinary circumstance and it is. the regulations of the justice department say that in that situation if he thinks it's in the best interest of the public then asked to appoint a special counsel. the reason is on the best interest of the public is that it makes smoother and less bureaucratic ironically. a process that was made more difficult in the past by special councils who had the set up a whole new office, hire a whole staff this guy has everything going for him from

everybody, buffalo residents are in the middle of digging out of a massive snow storm that dumped over six feet of snow in the region. it is showing no signs of slowing down, at least two people have died as a result of the storm so far. 6 million residents from six days in the great lakes region remain under winter weather alert. travel bans, in effect and the hardest hit areas, it is the heaviest storm. the buffalo area has seen in more than two decades. all right hopefully that snow will be over before wednesday when millions will take to the roads and the skies for thanksgiving. the american automobile association of aaa is predicting that more than half to 4 million people will travel 50 miles or more from home for the holiday weekend. and bc -- miami international talking about this. guad as always great to talk to

you, if this travels forecast folds, how is this going to compared to pre pandemic levels of holiday travel? our way back to full operations? >> yasmin all quite back to the numbers we had in 2019 but i think most people have forgotten what life was like in 2019 right? they want to the pandemic, the height of the pandemic when practically nobody was traveling. and now most people will be comparing this to last year. so what we know is they are also predicting an 8% increase for air travelers. people that will be traveling by plane will notice that difference if the travel by plane last year. and by the way, as you get the update on the weather in the northeast, new york city as one of the top five destinations according to aaa. people are traveling to orlando, florida southern california, las vegas and in that category also new york city. a lot of people will have to look at their plans if this weather continues. now what we have seen at the airports here, the weekend

before thanksgiving here in miami international is a busy terminal. the terminals about a lot of flow but nothing too crazy that they were not expecting for this week. now again this is still the weekend before thanksgiving and we do expect the numbers that you mentioned to begin on wednesday. aaa usually predicts the numbers from wednesday through sunday. sunday being the busiest day. we spoke to some travelers here earlier today and this is what they had to say. >> >> yes this morning has been a little bit crazy. we got off a cruise ship so the entire crew ship all just came right to the airport. it was a little crazy right now but it's actually not awful. i've seen airports much worse. >> not a long way to drop your bag but seem to get there pretty fast and lots of people telling you where to go so it has been pretty successful so far. >> now the vast majority of the travelers of course will be moving by vehicles. the law used cars so for people

information. over the capitol everybody, democrats are making use of the current lame ducks session before the next congress is sworn in this week. announcing a landmark bill that adds protection for same-sex and interracial marriage. 12 gop senators signing on to that bill, which would repeal the 1996 defense of marriage act. and drawing same-sex marriage for the purposes of federal law. and add legal protections for married couples of the same-sex. one thing it would not do is require states to issue same-sex or interracial marriage licenses, should the supreme court overrule cases that protect these rights. talk more about this want to bring in shin obergefell at a league plane -- fee hodges, the case that made marriage equality the law of the land. jim as always, great to talk to about the stuff and thank you for joining us on a saturday afternoon. pick up there if you will. tell me what you think of the senate bill and if you think it

goes far enough? >> well you know personally, i think every couple regardless if they are same-sex or opposite sex should have the right to get a merge license in the state they call home. so of course, i think that respect for marriage act was fantastic in that it protects the recognition of marriage for all 50 states. the fact that it would once again allow states to deny couples like john and me, the right to get a marriage license in their home state is just wrong. marriages are no different than any other marriage, we are citizens of those states we are citizens of the united states. they should have the right to get married wherever we want to get married in this country. so i am thrilled that it has moved forward but i really do wish that we were not in the situation where we will lose the right to get a marriage license and get married in the states that we call home. >> i know you run for a seat in

ohio's legislature, wanting to affect legislation there in your state you came up short in fact we'd say the results were not what we are hoping for, that does not mean i will stop fighting. what does that fighting look like to you? >> well for me, right now it is continuing to be involved and speaking out on issues like this. i will continue to work with the nonprofits that i have involved with the plastic family equality and sage. so i will continue to fight to do everything that i can to help make sure that the queer community is actually a part of the people. but i know exactly what that looks like for me in the future right now? no i'm taking some time, a break from running for office and figuring out what that looks like. >> you talk about advocate for fighting for the lgbtq community quantitate continue that especially in your state as well to that point. i want to talk about the house bill that your state is considering right now, bill for

five for which would ban gender affirming care for minors. what would you say jim to lawmakers that are pushing for this? >> i would say this potential law harms children. it arms parents who want to do what is best for their children. medical science is clear. these kids need gender affirming care. this is something that we should not have taken away from us. these kids deserve the right to receive this care, their parents reserve the right to take them to a, to the experts in the scientific and medical experts who understand what these children need. this is just one more attempt by this extreme right wing majority in ohio to target, demonize and demean the lgbtq+ community. >> jim obergefell, as always we thank you and good luck in your

republicans campaigning on crime, inflation, gas prices during the midterms, some senior house republicans now say that the first line of business is hunter biden. listen to this. >> this investigation will be a top priority, we are releasing a report today that details what we have uncovered, we are trying to stay focused on was joe biden directly involved with hunter biden's business deals and is he compromised? >> do you think the january six insurrection -- wrongly? >> i do not see anything, all i said was we are going to look at the politics of the justice department. >> if we can keep it about hunter biden, this is kind of a big deal. we think if we could keep it about hunter biden, that would be great. >> all right let's bring in black writer for the readout, jon jones. john, as always great to talk to you. so you are right about kind of this outside organization that democrats are essentially going to employees to fend off some of these ongoing investigations

are these investigations that will be launched by republican party, now in control of the house. and you say this, there are plans to investigate the investigators, exposed political motivations and the moneyed special interest supporting the work and hold them accountable for ignoring the urgent priorities of all americans in order to smear joe biden under the political bidding of trump and maga republicans. what more do you know about this effort? >> yasmin, thank you so much for having me first and foremost. what we are talking about here is essentially a robust clapback campaign being run by democratic strategist who specialize in messaging. these democratic strategist are leading a variety of watchdog groups that will effectively serve as a rapid response team, pushing back against the conspiratorial claims that emerge from the republican parties biden probes. unfortunately, republicans have spent the past two years tipping their hands as to what we can expect from these

conspiratorial probes, that is conspiracy theories link to hunter biden. conspiracy theories linked to the january six insurrection. conspiracy theories linked to the covid-19 pandemic and so democrats have allowed to work, with some news organizations include facts first which is an organization led by the liberal activists, david rock. another organization called the rational integrity project led by a man named kyle hairy thing the gop should really be weary of. >> you know it is not just under, biden that we keep talking about and we have heard a possible pursuing of impeachment of president biden. we have heard of impeachment of merrick garland, -- mayorkas investigating the fbi. department of justice as well of just heard from jim jordan there and the south that i played. how do democrats dodge this? how did they fend this off? >> well i think you know in lieu of having subpoena power, that is where the outside watchdog will ease are gonna have to do a lot of work and i

did just mention the congressional integrity project. i really advisor viewers to check out the work of its executive director as i mention, his name is kyle harig. he also founded an organization called accountable dot u.s. not focus intensely on at the ties between corporate donors and anti-democratic forces in america. so corporations that may have donated two antiabortion candidates or corporations anna may of donated or supported rather pro insurrectionist candidates. that kind of gives you an idea of the scrutiny that these outside watchdog groups are capable of. i think that just goes to show that democrats aren't completely at a loss here. i would take anyone's chances in a messaging war with a screaming, sweating jim jordan and marjorie taylor greene who is a cheerleader for the white nationalist movement that the democrats are perhaps in better shape than it may seem. >> joe hand jones, thank you and we appreciate it. let's continue this

with jim jordan's active participation all kinds of faux scandals which came to zero. so there was of course the emails of hillary. produce exactly zero. fast and furious and they even sent to the attorney general, this exactly zero in a so-called scandal that actually began under the previous administration, bush. and they had the lowest learner irs scandal, where filters were used to punish white wing groups, not true and won completely nowhere. and then of course exploited a tragedy in benghazi, libya for pure partisan work to try to discredit hillary clinton. it produced exactly zero. and now contrast that with what is going on with the former president donald trump and his family. they are in a criminal investigation, as we speak there is a trial going on, cfo

has gone a state witness providing evidence. we are looking at active investigations of interference in an election, and incitement to riot on january six, the january six committee. we have now a special counsel appointed not to look at hunter biden, but to look at actually donald trump and his acolytes in terms of their behavior, and interfering with the election on january six. so yes or legitimate investigations that are going on and this is not one of them. >> i want to get your reaction as well congressman while i have you to the appointment of the special counsel by attorney general, merrick garland. do you believe this was the right move within this investigation? especially for former president donald trump was now announced he is running again? >> i do. i believe there is lots of evidence that points toward criminal behavior. and i think we did a special counsel to navigate that evidence and to make a final determination as to whether

chaos, that is just a couple of the words being used to describe what is happening at twitter this week. what is happening at twitter? the company's offices are closed until monday. amongst a wave of resignations that came after several erratic company emails from elon musk. many big brands are pulling their advertisements from the site, threatening its primary source of revenue, all while his new verification system has been shelled for the time being. we want to bring in kevin collier to talk more about this.

at this point, it seems as of twitter has 25% of its workforce left, right? how do you manage a company at this point, going forward, with 25% of your workforce left? >> and a lot of folks that are using the platform that do not necessarily trusted anymore. >> yeah. twitter recently departed head of trust and safety, buttoned up ed yesterday, pretty bluntly shared the tenor, a lot of the reporting around the company these last two weeks. which is to say that the -- but its scope is so large that and more -- very carefully block a lot of the recent trolling, other hate speech, but with fewer people to do it thoughtfully before he left, having these scents are far more accounts which is counterproductive to musk saying that [inaudible] letting people say whatever they want. and a lot of big players are fleeing the site, at least

this. we appreciate it. let me read a little bit from your op-ed which i found interesting that europe for cnn. and you said this, following the dismal performance, a tie time that we as republicans engage in a period of introspection and reevaluating we are as a party, we must reflect on what we stand for. whether the party standard bearer who announced on tuesday he is running for reelection again, and 2024 is currently leading us forward rather than backwards. was a little austin the midterms or the poor showing in the midterms that made you write the? and abandon your former boss? >> yes i guess so much for having me and you know what i worked for donald trump in 2016, i think almost every time that a close to rally or a fund-raiser, he almost always closed with you are gonna get so tired of winning that you are going to ask me to stop. that i think among other lies, donald trump was lied about that as well because in all

reality, i think what people are going tired of especially monday republican party is losing and those losses are resulting because of donald trump. so yes answer your question, i think we saw the 2022 midterms a referendum on the president and i think it is time that the republican party enter a period of serious introspection and decide are we heading down the right path by following donald trump? or is it time for a new generation of leaders? >> i am curious though gavin, i am confused a little bit right? you say it is time for republicans to have kind of a serious introspection right? but you're having the introspection after the loss in the midterm elections and the poor showing because of the former president. and a referendum as you put it on him, not because of an insurrection? in which you had rioters storming the capitol and asking to hang the former vice president of the united states with the speaker of the house looking for speaker nancy pelosi? it was not than that you should

read direct and rethink the direction of the republican party? but now because you lost the midterms? >> yes i think that is a fair question and thank you for asking me that. i've been outspoken since january 6th, along with a number of my other colleagues, alyssa farah griffin, stephanie grisham, olivia troye and speaking out against the former president and calling him a force action on that day. donald trump was called on to lead that day after his calls for going you know down to the capitol. he needed to step up in that moment and call the protesters off, what did we see? he did not do that. so among many other moments that donald trump failed the country, he failed us on that day as well. i've been joined like i said by a number of my other colleagues and calling for him are calling for the party excuse me not to move on from donald trump and this is just another moment in which we have seen losses inflicted on the party and the party know the demise of the party right before our very eyes. i think that among many other moments, this is time for the

party to enter a serious period of introspection and decide, when we continue doing this? this is the definition of insanity or we are we going to finally move on from donald trump which is what i believe we need to do. >> i do think the voters are ready to get on board with that for republican voters? we have heard folks like mike pompeo is incredibly loyal to the former presidents because and they're tied up losing, chris christie over and over again is now saying essentially that we cannot continue as republicans losing elections. one of the reasons why we are losing is because of the former president and him making it about himself constantly. so your politicians speaking out now finally. but what about the voters? are you confident that they will be on board? >> yes i think you know and 2016, even 2012, i've been a film director on campaigns. i've been involved in presidential politics the last several elections. when i go back and talk to those voters that i was working with our county chairs and you know, the people that really are the grassroots leaders on
