politicsnation. tonight celine, on separate tracks. right now, knives are coming out on the republican side as torches are being passed by democrats. on the heels of donald trump's announcement this week, that he will seek the presidency for a third time. attorney general merrick garland responded with a bombshell of his own. his announcement yesterday that a special counsel will now oversee dual criminal probes by the justice department into

trump's potential mishandling of classified documents retrieved from his mar-a-lago residence. and separately into his role and the events of january 6th. what that means politically for congressional republicans remains to be seen. specifically for kevin mccarthy who has gunning for how speakership and will remain stuck with, if not stuck to donald trump. and what the mar-a-lago weighing of the party currently complicating things for him, more on that later but meanwhile, congressional democrats are plotting their cost to the future. new york congressman hakeem jeffries who might have known and worked with for many years launching his bid this week to become the first black man to lead the house democrats as the first woman speaker of the house, nancy pelosi retired from house democratic leadership this week.

and senate democrats are waiting the final configuration of the next senate, which will hinge on the georgia senate runoff between democrat raphael warnock and republican herschel walker in two weeks. vague show tonight so let's begin. >> joining me now is senator tina smith, democrat of minnesota, senator thank you for joining us tonight. another eventful week and washington, certainly but before we get into politics in a moment, i have cause have to ask you about the special counsel appointment by attorney general garland to oversee the doj probes into donald trump's potential mishandling of classified documents retrieved from his mar-a-lago residence. and separately, into his role in the events of january six. now given that garland's decision was precipitated by trump's announcement this week

that he will seek the presidency a third time, what impact do you see to special counsel appointment having on the 2024 presidential race which appears to have already begun? >> thank you reverend sharpton, so glad to be with you again today. i think that attorney general garland did exactly the right thing in naming this special counsel. making a clear that the investigation into the former president is going to be following the rule of the law and that will be completely independent. and of course it is laughable to hear the house republicans go after this and threatened to take away funding from the justice department and retribution or retaliation for this. i'm going after their candidate donald trump who is the face of the republican party so i think that it will have a clear impact and i think for the american people that the choice is so clear to have these

extreme republicans and the house, attacking the department of justice and saying that the number one priorities are to defund social security and medicare. now apparently the law enforcement of the department of justice. >> of course while democrats were successful and retaining the majority and this election cycle, there is still the impactful runoff pending in the georgia senate race. when your colleague democratic senator raphael warnock and his republican challenger, herschel walker. it shouldn't be forgotten that this contest is still ongoing, big name democrats and republicans are expected to return to the state to stop for both candidates who are still vigorously campaigning. of course it goes without saying that a 51 seat majority would be better than 50 seat majority, democrats currently hold after the midterms, as one of the senators and leadership,

in a leadership position and i wonder if you can tell our audience why georgia is still so important for senate democrats? >> i think really there are so many reasons and reverend warnock sits right in front of me on the floor of the united states senate and i've come to know him as a man of such great integrity and character. he also is a highly affected united states senator so having him in the senate means that we will be in a better position to pass important registration like the work that reverend warnock has done on putting a cap on insulin at $35 a month. for people who require insulin to live so in that sense, his presence in the senate is so important as the strong, effective force for good. of course the senate democrats. >> that is beyond politics when you're dealing with insulin caps. >> exactly, that's not about politics doubts about whether the senate is working for their gutted the american people and the good of the citizens and the residents of georgia.

but you know also reverend sharpton, we have 51 democrats, senate votes and that means that we have a majority on senate committees. it will be easier for us to move forward positive legislation and that is also a very important thing. i am optimistic about senator warnock winning this election but it is going to be tight, it's a serious race and this is real, live, it's very much and very urgent that we all focus to do everything that we can to make sure that he. winds >> out of come down to turn out the people in georgia will have to come back out, congresswoman nancy pelosi our first woman speaker of the house, having all the speakership four terms announcing retirement from the democratic leadership this week. though not from congress. now new york congressman and current democratic corporate chair hakeem jeffries who i've known 30 years has launched his bid for house minority leaders.

and i wonder what you have heard about that heel, on the hill about the potential succession. do you think jeffers will become the first black to lead the house democratic caucus if successful? >> well i have not own hakeem jeffries as long as you have but i do know him and i am so excited to anticipate his leadership in the house as the minority leader. my sense from the conversations that i've had with my colleagues in the congress as that he is on a good path and it's exciting to see this transition of leadership. from just eminently capable and history making speaker of nancy pelosi to this new generation of leaders. who are going to be in a position to leave the house forward and i'm quite excited about it and i know also that we have such strong leaders and that congressional professional congress with -- other great leaders around the house that will be able to work with in the senate. >> senator before you go,

democrats and minnesota had an especially good midterm run taken control of the state senate for the first time in six years. while holding on to the state house, many black women elected to the state senate for the first time added to those winds of course was a resounding victory for governor tim walz. and his reelection race so i met several times and the state attorney general there, while i worked in minnesota around the george floyd case. how do you assess the minnesota democratic sweep? >> well i want to shine a light on the exciting, a young at candidates. three black women who ran for the minnesota state senate and won and they were so exciting and zaynab out mohammed will now be the state representative for my family and my grandson. claire olmert her beaten was been elected and those young and talented organizers ran to

turn out voters in democratic districts that contributed to the victory of governor walz and the attorney general, chief ellison. the man who prosecuted the murder of george floyd. this is a big moment. >> yes and you are right, he successfully prosecuted that case and took a lot of flak for it but the people reelected him. thank you for being with the senator tina smith of minnesota. switching now to focus on two major announcements regarding former president donald trump, joining me now is former counsel to the president and former president and author of revenge and the host of the podcast, vehicle poll. someone i would say is a friend of mine. onwe've got to be very friendly and i know him and we pray together and talk together when he was away. i stand touch with the son, michael cohen and thank you for being with us michael. >> got to see a reverend.

>> i want to start by getting your reaction to the big news this weekend. attorney general garland's appointment of a special counsel to decide that former president trump should be charged and connection with the mar-a-lago classified documents case or the january six insurrection. now you are trump's personal lawyer but special counsel robert mueller was appointed to investigate the russian election interference. you eventually found yourself caught criminally and that case. how do you think the former president is reacting behind the scenes as you would know till the announcement of a special counsel again. what can we expect from him in the coming days? >> okay so the first part, how is he feeling about it? he is not happy and i can assure you that he is not happy at the multitude of matters that are now being brought to the court. it is one thing when they are investigations and he puts not to the side because he is very

myopic in that way. to the point where an investigation does not mean anything until it goes to the court. that is where we are right now. so then we get to the second half which is how is she going to react to this? we have already seen. it we have seen that 100 times when there was mueller or any of the other investigations. deny, deny, deny and deflect. now it is not only that it is not legitimate but worse than, that this is the weaponization of the justice department by the biden administration against on all trump. and what is he doing there? he is basically now angering his base and angering the republicans so that when they come in, now what will they do? it will go after the biden. stillwater hunter biden and they will go after the laptop and the same story we have been hearing now forever. but now donald has a way to get it in there. >> now you spent more than a year in prison and another year and a half under house arrest for convictions related to trump campaign finance

violation. we when you look at the people in trump's inner circle now, what do you think is going through their minds with all of the investigations going on? and now second special counsel investigation of trump. do you think it is possible that some of them might turn on the former president? >> maybe that they've already turn, let's not forget and again i maintain this and this is my opinion that i think both jared and ivanka have also been participating and providing the fbi in the doj with information. >> wait a minute your opinion is that jared and ivanka, donald trump's daughter and son-in-law maybe providing information to the fbi? >> yes i'm in my opinion again, why? because jarred who is known as the secretary of everything had his hands in every dirty matter that was going on. but you don't see any investigations. you also don't see ivanka showing up and supporting her father with this third campaign? why?

and one of the reasons i believe is simply because at the end of the day, could you imagine if there is an fbi informants not now they're going to take a position with the campaign and then if somehow donald trump won that they would be senior advisers again but they also would be undercover fbi informants. the whole thing is like a house of cards on steroids. so it is really not something that i see. >> now let me ask you this, but would you think when you saw tuesday night's announcement that trump is running again in 2024. what was running through your head? >> i maintained all along that i did not think he would make the announcement. to be very honest with you, i was wrong about that. what pushed him to do it? i don't know. and it is not about being able to announce that you are a candidate in therefore you can go ahead and you can bring charges against a candidate for the president. could you imagine everybody that commits a crime is saying i will run for the president.

therefore echoes the, way there is no stay and he knows it. the reason why he ran? and i think it was to clear the field of all republicans, especially ron desantis who has been getting tremendous press and has shown to be more favorable than donald trump's and the republican party. >> now you know trump voters very well. do you think there are special prosecutor will hurt his political standing or will they rally around him as they seem to be doing after the fbi search in mar-a-lago the summer? >> i think one of the things we are seeing now is a lot of the republican support, not just the voter pull but also members of congress, they are leaving the trump camp. as favor billet-y is getting worse, literally by the week. so the hope is of course that at the end of the day, that is favor billet-y is so low that he is not even going to be able to be the nominee and then you

will step down as democratic leader at the end of this term. we will discuss the mark couple legacy later on the show but first i want to focus on her likely successor as. current republican minority leader kevin mccarthy. it is rare to see a politician and sent to such a powerful position based on a record of shameless subservience. this is my kevin we are talking about, the man who picked pink and red star burst out of a pack to empress former president donald trump. the man a rush to mar-a-lago a week after trump's presidency was over to take a picture, welcoming trump back into the gop full before his impeachment for the january six committee was even over. a man who vanished liz cheney from leadership for breaking the republican vow of silence,

over the capital insurrection. and when it came to racist rhetoric and outlandish behavior from far-right lawmakers, like representative marjorie taylor greene, leader mccarthy handles them with kid gloves. mccarthy placated the maga mob even as they jeopardized his shot at the majority. saddling him with the extreme candidates who lost winnable races all over the country. now the republicans have poised to take charge what the slimmest margin, the same branch character -- to undermine mccarthy speakership unless he does their bidding. the far-right is challenging him because they know he is not really mag and so do i. quietly behind the scenes this year, mccarthy helped assemble a slate of 67 republican candidates of color to run for house seats. i might be this man privately

by reducing swelling in the sinuses. try vicks sinex. welcome back to politicsnation, there are several topics to discuss so let's turn to my political panel for their analysis. joining me now our political analyst susan el presidio and juanita to alabama. susan, i want to get your take on the justice department's appointment of jack smith as the special counsel to consider charges against former president trump and the january 6th and mar-a-lago documents cases. attorney general garland said his decision to name a special counsel was influenced by trump's announcement of the third presidential campaign. we have heard numerous reports that trump believes his candidacy will shield him from criminal charges. as a former president

miscalculated as michael cohen says, is this special counsel a nightmare scenario for him? >> it absolutely is and former president is used to miscalculations. look at what happened in 2020 and look what happened this midterm elections. but he doesn't care because in his mind, by announcing when he did it and if got him in the press, maybe an as money thought it would deflect from the investigation happening but it won't and i know there's a lot of legal scholars and really great legal minds on why this was a good thing or a bad thing for the attorney general to do name this special counsel but i think that's important to also remember from the american public's point of view, by having the special counsel you now have especially best occasion, you now have one step removed from biden. and that is very important for the american public to see. biden has been bending over

backwards to really say there is a line between the justice department and the white house, completely opposite of donald trump. but this event takes it one step further and i think will make a different when the findings come out, how they come out. >> juanita, your quick take on this new development in the trump investigations? >> slug of course republicans are hesitating to try and paint jack smith in a negative light here but what i am excited to see islam do this work and do the work quickly because we know the repercussions of trump continues to be able to maneuver and behave the way that he does without any type of accountability. my number one hope is that this is nothing like the mueller investigation, which yielded no accountability but the big difference there and that's his point out that one trump is not a sitting president and two he cannot leverage to doj to do his bidding and interfere in the investigation. so i think jackson with us a big opportunity here and i think we're all waiting for the accountability because we see the evidence and we see the crimes, we just want trump to be held accountable.

>> juanita, new york representative of hakeem jeffries announced yesterday that a historic bid to become the first black person to lead a major political party and congress following the announcement of speaker pelosi that she would be stepping down from her helena. jeffries represents a significant three decade generational shift from current house democratic leadership and plans to prioritize retaking the house majority of 2024. jeffries quickly received support from speaker pelosi, house majority leaders steady hoyer and house majority whip jim clyde burke. and currently he is not facing any opposition. so juanita what those jeffrey's historic bid say about the future and trajectory of the democratic party? >> it is saying we are ready to move forward, isn't we recognize for the democratic base is and saying that jeffries is the right voice to

take on what we know will be a very hostile republican controlled congress in the next session. and what i really appreciate about hakeem jeffries is that he has never missed words one calling out the destruction abusive, harmful actions and attention that republicans and that's the exact type of energy that democrats in the house are going to need over the next two years. i also appreciate that overwhelming support from pelosi, from hoyer, from claiborne. climate said earlier today look we are all in the 80s and it's time to step aside and i think hakeem jeffries is a big voice to do that. and i'm excited to see how we carve out his own unique path and leadership as the first black person to lead a party in congress? >> i have known him over 20 years and maybe more, he has never missed words at all. susan, as speaker of pelosi specks down from her leadership, let's stop to take a look at her legacy. first female elected to the speaker of the house with a ten-year spanning the iraq war, a financial crisis, a world

pandemic. she expanded alvin sharon's to millions of americans. broken legislation, a regulate wall street and work out on nuclear arms treaty with russia. even the republicans who demonized her four year, it could be noted that kind of grudging respect people like trump and mitch mcconnell have for political savviness. what are your thoughts on the legacy she will leave behind? >> well first, she is a political genius so you cannot take that away from her. look at how long she lasted in washington state. the other thing was she was also pragmatic. she knew how to go for winds and more importantly, she did not let her ego get in the way. when our members were running and they had pelosi problems and their district if you will, she said say i am horrible. i don't care but just go win. i really see that is political -- she did not pick herself first when it came to democrats

holding the majority. as far as a legacy goes you know, she really had one heck of a run and her government service and that is what it was. i don't care if you're a democrat, independent or republican, it was government service. one thing if you listen to her speech, that thing that shines through and i think we really lack so much of in this political environment, was there patriotism. her love of country. and i just think that she will leave a legacy that will be very hard for any speaker to phil and the sense that our people loved her. they feared her at times and they always respected her. >> juanita, staying on congress, the senate procedurally voted at this wednesday to protect same-sex marriage in a 62 to 37 vote. while the vote was enough to break a filibuster and the as dark bipartisan bill is expected to pass through both chambers later this year,

supposed rational republicans like mitch mcconnell still voted against it, even as a national support for same-sex marriage reached a new high this year at 71% according to gallup. it will likely continue to trend as such. why do you think republicans like mitch mcconnell keep chasing after these dead and options like voting against basic civil liberties? am i missing something here? >> i think you are right in staff rev, the reality that mitch mcconnell does not care about delivering anything for the people. he is fixated on trying to stick it to democrats more than anything, it comes to in these moments. and honestly won 71% of the country supports him sex marriage, i hope that there is a lot of naming and shaming about how harmful mitch mcconnell and those other 36 republicans who oppose this bill are. the other key factor here reverend is that there is also language in this legislation protecting interracial marriage.

which mitch mcconnell's and summary is also voting against protecting the right the represented for his own marriage. and so i think that this shows how far again, he is willing to go to oppose democrats and not deliver anything that anyone in this country wants. if that is his ethos, then you can pull expect to continue to lose senate races. >> suzanne, your thoughts on this topic of same-sex marriage legislation? they're republicans who voted against that are clearly at a step in the country. this goes to the overall concept of what we saw in the 2022 election. people don't want extremism, there is the youth vote came out because there is not a young person that does not know a same-sex couple or somebody whose parents may be in the same sex marriage. it's so backwards thinking but i will say, there was only one person besides looking at the democrats that mitch mcconnell wants to stick it to and that is donald trump. you may not have done it on this vote but i would not be surprised to see him take us

wins this week as the final votes were counted. the party made a strong showing in arizona, with senator mark kelly is sealed his reelection bid after republican viral blake rivals conceded. while caves projected the winner of the governor's race and the republicans kari lake may challenge the results. also celebrating reelection as congressman ruben guy ego. a democrat from arizona seven district and chair of the congressional hispanic caucus is bold pack. congressman joins me now. first let me start with the news of the week coming out of your state of arizona, where they defeated republican trump backed candidate for arizona governor, kari lake is refusing to concede. and said on thursday that she is assembling a team of lawyers to quote collect evidence and

data, pertaining to the electoral process. now, the same as happening with the secretary of state results where democrat adrienne fontes defeated primaried election and i are in january six attendee, mark finchem who is currently refusing to concede. what do you make of the election denialism that has become something that is becoming more and more common in arizona elections, at least of late? where do you see this go and congressman? good evening. thank you for having. the really what this has become is kind of a cottage industry for losing candidates to still be able to milk their donors out of more money. mark finchem lost by more than 150,000 votes. it wasn't even close. kari lake won by close to 20,000 votes. impossible to get any.

somebody something we should think about is next time she is closing on a campaign she shouldn't be going after republicans and telling them to get out of the party in trying to scare latinos internet voting for her. so those are the kind of things she should be doing but all they're gonna do is file these lawsuits. they're going to love of these lawsuits, find themselves in fox next and they're going to finally give up more people give up on them. >> let's turn to a history making result of these midterm elections. as congress is welcoming in its largest class of latino and hispanic members ever, historic wins by democrats and republicans combined. has the chairman of the congressional hispanic caucus is bold pack. what is your take on these historic winds? >> number one, the narrative that was going out through the heart of the year all, year largely by white reporters and pundits that latinos were sharply turning to the

republican party and that there was a realignment and that the democratic party is going to be doomed because latinos were real lining to republicans was one big narrative they were all chasing. there was bad reporting up and down the ticket, up and down the media space. number two, it does prove that the democrats, when they actually spend time and money and effort, we'll get the latino vote out and will actually have good results. this is what we saw here. especially down in texas where they assume they were gonna lose all these seats, two and comments by overwhelming margins. and it was expanding. that we added latinos and colorado, new mexico, southern new mexico, oregon, washington. so there is a lot to learn from this. but the most important thing is, invest the money, get the outcome, and number two, just because one poll says latinos are moving that way and every cool pondered and junior list is saying it, don't jump on the bandwagon. do your research.

i saw some really horrible fall in the polls of some of these pundits purposely did to be able to jump on the bandwagon. >> this would also include a number of republican latino candidates. however, democrats largely outperform republicans in heavily hispanic districts around the country, with the exception of florida, despite the months-long narrative that the rightward shift among latinos, it could propel the republican wave, the selection. what is your reaction to this turnout? and do you think democrats have done enough to appeal to this voting base even more? >> it did a lot more this time than in half past elections. i think it also tells you what the republicans didn't do. they offered no solutions. latinos are very much affected by inflation. they're largely working. class republicans didn't offer any solutions to inflation.

they just offered more fear. fear of african americans, of immigration, of the lgbtq community. but they never actually offered solutions to inflation. and that just didn't work. the assumption that republicans had is that, sorry, latinos are conservative by nature you just have to talk to them in a conservative manner was actually completely dispelled at this election cycle. >> you're one of the house members out of arizona. i want to ask you about another member representing your state, democrat kyrsten sinema. you recently told our colleague that she did nothing to help democrats. saying she only cares about herself. can you elaborate on that? why do you think that he is? >> because it's true. she didn't show up at one campaign event. she didn't help out any candidates. as a matter of fact, two weeks
