dead and at least 18 hurt. the club says it was customers who subdued the gunman. we have the very latest. plus, jobs may not have been the only supreme court decision that was leaked. shocking new reporting about another breach in 2014 landmark case and why conservative justice samuel alito is at the center of those allegations. and, later donald trump facing a barrage of thinly veiled and very direct attacks from prominent republican governors, senators, and his own former cabinet secretaries. what does this mean for the 2024 run? we begin our hour with us breaking news in colorado springs. where a gunman opened fire at the gate nightclub, killing five people and injuring 18 others. you are looking at some of the first images from the scene of that shooting, nbc's emily pickett has. more emily. >> hey, there we are learning

some devastating developments overnight from colorado springs. it's where five people were killed in a shooting at club q, and another 18 people were injured according to colorado springs police. this is being considered a mass casualty incident. to give you an idea of the scope of the, incidents some of the victims were transported to hospitals by ambulance. others by police car. we are learning that the initial 9-1-1 call came in just before midnight local time. and when police, arrived officers immediately entered the. club they identified who they believed was the suspect. and this was not an officer involved. shooting officers did not fire their. gazans we gain more insight from club q in a facebook post, since the. shooting they think the quick reactions of heroic customers, that's up due to the gunman and ended this hate attack. now, police would not comment on the motive of the gunman. we do know the suspect was taken into custody. that individual was being treated at a local hospital. just hours before the, shooting

club q had posted on its facebook page about an event scheduled for later. today a drag brunch aimed at honoring transgender day of remembrance. the fbi, we know, is on scene assessing the investigation. what is likely to be an extensive lengthy -- more detail throughout the morning hour the news conference is scheduled for 10 am eastern time. back to you. >> our thanks to emily acadia. let us dig deeper and bring in, right, now artemis and law enforcement analyst jim kavanaugh. he is a retired atf special agent in charge, and a former hostage negotiator. jim, i'm always happy to see you. but of course, sad that this tragedy, another mass shooting, has happened again in our country. the club itself, not long enforcement is calling this a hate attack. officials have yet to confirm a possible motive. what we do, know jim, the shooter is in custody and is alive. my question is for you stated of the gate is how are

investigators going to go about figuring out the y. why did this deadly mass shooting occur. >> i will start with the eyewitnesses. club saying it is. a hate attack. sometimes when there is a hate attack, the activities committing the crime is yelling out racial slurs or expletives. or just stating the reasons they are doing the killing out loud. versus a nightclub with many witnesses, and the patrons actually subdued this killer. eyewitnesses that might have heard him say things, he could've been wearing something with a racial slur. he could've been subdued and -- just died, just started saying the reasons he did. it all of that to maybe out early for mccullough like. that because you cannot keep it in if your motive is not indeed hates. and that is one of the likely motives in attack like this. it could be revenge for some other reason but, like the

pulse nightclub, like we covered in that horrific mass murder, it was a hate motive. so this could very well be a hate motive. >> jim, today is national transgender day of remembrance and reporter amelia keïta saying that they were actually supposed to -- they were club q in colorado springs in the response to host a drag brunch today. does the timing need anything to investigators here? are they also going to be looking at the social media of the suspect to see if he is has a planned premeditated attack? >> katie, you are exactly right. police are served in a search warrant today at the colors resident, wherever that may be. they will be sweeping for all of his electronics. they will take his. phone sweep all of his computer hardware and postings on the web or twitter or facebook. or wherever he is god. is to see if he has put that motivates before.

of what he wanted to do this. maybe explicitly said he was going to do this, and somebody missed it. that will all be. dan he's searching for weapons, and the evidence of what those options. what we do not know, katie, if you went into this club with a couple of handguns or the weather was cold, could have a long gun under his coat. this could've been a lot worse. this is a horrific, nothing five dead and -- shot but there were 49 killing 53 wounded in the paul's case so the fact that the patron subdued the killer might have stopped in the carnage from being even worse and we have some heroes at play today and and we still have this horrific crime a senseless and horrific and vulgar crime, and we've got to get rid of that. hate in america. that is one fact, it. is and it looks like that. around the case like this we

will said that as a major league category. is this the motive of hate? it may split pretty quickly, if that is what it is. >> jam, you mentioned a couple times and emily acadia did report that it was actual club patrons, customers inside the club that subdued the shooter. in this case. as somebody with extensive law enforcement experience, especially dealing with active situations, what is your recommendation to our viewers? should they physically get involved and do this and try to stop a shooter with a lack of food or is going down? >> yes. the advice is always to run high to invite. if you are in a crowded room with somebody shooting and you cannot run away from the rifle or the pistol, there is nowhere to hide, then you've got to fight. and it looks like that's what these patrons did. they fought they went on them. so somebody make a talk going, there but if everybody just tries to run out the door and it's a big crowd, he's just

shooting you, all massacring you all. so sometimes you have to fight. it is not a first choice, if you can get away you want to get away. if you can, hide you want to hide but if you can't you want to fight. do not let them kill you. and that is what they did. here they subdued him. the patron subdued. we do not know the answer maybe they had a window and he dropped a magazine out of his gun to reload or maybe they were just able to sneak around the back of him somehow and tackle him. we do not know the answers. but somehow they were able to stop this active killer who had a firearm. and subdue him. we do not know if another patient may have had a firearm. it is possible that employees at the club could have pulled firearms from behind the bar. or in the room and used it to get him to surrender or shoot him. we don't know the answer. or another patron could've been armed. i'm sure that will unfold later today katie when the police update us.

>> yeah, and jam, we want to emphasize that obviously this is all very preliminary. we only have some limited information because it legally happened last night 11:57 pm. colorado springs time. you did mention the pulse nightclub massacre as there is some obvious similarities there. the nature of the club both our gay clubs and both have several people and there was this idea that maybe it was centering around an event. as an, investigator, gm of a suspect in the hospital. we do not know the physical condition of the suspect. does that change the strategy by with investigators are -- to be able to get information immediately under the suspect? >> well they are going to have so much information in this case, but they are going to be able to know the direction of where it is going. katie. the first thing that commanders always wants to know is, is there another confederate or

conspiracy story. could there be another attack? when these things happen, it is the very first time in our mind. is this a lone actor or somebody else that could be acting with them? could there be another attack across town? across the state? is there somebody else? when you can establish she is the only one that kind of takes the whole thing and slows it way down. so now you can get into the criminal investigation. if it is just, him and he is not alone. actor he has the support from a hate community somewhere. a phantom hates community actually in person maybe. or online, if the motive is hates. he will have that support. he does not actually alone in his. mine but he may be a lone actor of the active killing once that is settled and investigation is not a mystery it is a matter of going through the steps and interviewing every single person in the club. getting all the video from the. club from cell phones.

getting the, gun firearm identification. you have to go to the hospital and autopsy the victims and get all of the projectiles and match them to the guns. it is a study in police forensic science interviewing techniques and sweeping his media. interviewing all his confederates neighbors. people who know him. to build the case because he is alive, so now there is going to be a case. there is clearly a state murder case if you kill five people. but if he is the, motive we are not sure yet. they're saying. but if it isn't it is prove-able than it can be a federal hate crime charges as well. so with a federal charge of haiti is the motive, and you certainly have multiple state murder. >> yes, the. from what we know as well, the fbi is on the scene of the. shooting jump, kavanaugh we appreciate you taking the time early this morning to be able to join us and let your insight. and experience. we appreciate you. thanks for being here.

leak this past spring of a draft opinion of the hobbs decision which overturned roe v. wade. that breach was unprecedented, or so we. thought this week a lady was being accused of leaking the outcome of a landmark ruling from a 2014 case involving contraception and religious rights. the new york times reports that a former antiabortion campaigner, the reverend rob shake, knew the ultimate outcome of the burwell versus hobby lobby disagree's decision weeks before it was announced. he says that he found out about it through a couple who was whining and dining. justice alito in his. why if that is according to the times to interview to the reverend and review the letter he wrote to chief justice john roberts. just like the dobbs ruling, the hobby lobby decision was a victory for conservatives. and gets this. both majority opinions were written by samuel alito. in a statement to nbc news,

justice alito said that he knew the couple in question but any suggestion that he or his wife lead to the outcome of the ruling is, quote, completely false. joining me now for a reaction is my friend and an msnbc legal analyst glenn kirschner who is also the host of the podcast justice matters. glenn, still no update from chief justice john roberts on that internal investigation into the leak of the dobbs decision. but it doesn't as latest reporting just underscore that the supreme court should not be investigating itself? >> boy, it feels like there is a pattern emerging with these leaks. katie. because both the hobby lobby decision at the dobbs decision or basically a victory of religion over the rule of law. and you, know now when you read the reporting on the lake of the earlier decision. the hobby lobby decision. with, frankly some email traffic that i have read that tends to inferentially support

that at least a leaked it. and when you just play that clip, of alito trying to engage in some misdirection, listen, i was a. victim so how could i be the lead or the dobbs case? this takes us to the core issue. and when you have somebody like then judge alito deceivingly sunsets and deceiving the american people in his confirmation testimony, and we also learned recently that he deceived the late senator ted kennedy and one on one interviews when senator kennedy was trying to assess whether alito would be good to his word. that roe v. wade had nothing to worry about if he were confirmed to the supreme court. that turned out to be a lie. the time has come now with this latest reporting on the leak and the hobby lobby opinion as well, the time has come for an investigation. i contend that should look like

a congressional hearings. i think they should be fashioned in impeachment inquiries which do not guarantee that there will be articles of impeachment or a successful trial in the senate. but there should absolutely be an impeachment inquiry and investigation. because the minute alito took the bench on the supreme court he was determined to revoke woman's constitutional privacy rights and we cannot let that stand on investigated. >> so glad to be clear he would urge congressional action in this case maybe the senate judiciary committee getting involved when we've heard people excelled in the white house saying we need to have an overhauling of the ethics and the way that the supreme court governs itself? >> absolutely. if you have no ethical rules or guardrails in place for the supreme court, what can we expect? we can expect things like

clarence thomas sitting in cases in which he has a direct and actual conflict. presiding over a case involving the interests of his wife. we cannot long endure that of our supreme court. so there have to be some hearings into a supreme court run amok. to at least put some guardrails in place to prevent this kind of thing from happening over and over again. >> glenn, let us pivot right. now i have to get your reaction to the appointment of a special counsel council i-20 general merrick garland to oversee two criminal investigations into donald trump. you say that this could signal that merrick garland thinks there is enough to charge trump. please explain. >> yeah, if merrick garland had decided that you know, what the evidence is just not adding up. and it does not look like criminal charges are in the offing for donald trump, he certainly could have just reached that conclusion and made that announcement and put that investigation to bed.

it feels like he has concluded the exact opposite. he appointed a special counsel jack smith he was a longtime public integrity prosecutor when i was actually the head of the public integrity unit at the department of justice. and here's what i like about this appointment jackson and had his public unity public integrity section prosecute some really challenging high-profile and politically -charged cases for example his unit brought charges against a republican congressman in arizona and a democratic senator in new jersey and the republican governor of virginia and senator edwards who is a democrat from north carolina. what he did was he brought difficult and politically-charged cases across the political spectrum without fear or favor it. and this is what i love, you will not often hear this from a

career prosecutor. he did not win them all? what does that tell? us it tells us he's not afraid to bring the difficult cases. really a prosecutor like that he was brave enough to lose some of those cases and not be successful in all of them, that is the kind of prosecutor i want on my team and i think this may actually forwards the ball and accelerates the timeframe as these investigations move towards indictments. >> glenn kirschner no one is above the law and we talk about that all the time. let's see what jack smith is going to deliver as a way for the department of justice because justice matters. glenn, my friend thank you for being here and as always i appreciate you. >> thank you, katie. >> we are continuing to follow that massive shooting out of colorado where a gunman killed five people at an lgbtq nightclub last night. we have the very latest on that and why some customers are being called --

police came in just before midnight local time. police had arrived and were told, immediately entered into the building where they identify who appear to be the suspect. here's more from police. take a listen. >> that initial phone call at about 11:57 in the evening said that there was an active shooting. numerous officers and medical immediately responded to the area and officers immediately made and free we did locate one individual who -- the suspect inside at this point in, time deviation wasn't is very initial stages. but i can tell you that we have

18 injured in 5 to 6 -- that number is subject to change as leave estimation continues. >> still very little information when it comes to the suspect but we have a suspect is in custody being treated at a local hospital. we also know the fbi is already on scene saying the investigation and as you point to that we should learn more about investigations throughout the evening with a news conference scheduled for 10 am eastern time.s about the club ps who help to do the gunman? it is my understanding that long forsman has reported that this is exactly how the shooter in this case was taken down. >> some pretty remarkable details coming from club q who posted on their facebook page. they first said that they were devastated by the senseless attack on the community but then they pointed out the role that the customers had apparently played. they wrote, quote we think the quick reactions of heroic customers that substitute the gunman and this hate attack. police would not comment on the

annual meeting remotely to tell us what he considers her days administrations accomplishments, and addressing the controversial decision by billionaire elon musk to restore his suspended twitter account. for more on all, this we turn to nbc news reporter julia jester. who is live in las vegas. julia. >> good morning,. katy this weekend was a who's who of potential 2024 republican contenders. and that context was not lost on several of the attendees, like mike pompeo who joked that the next time he could be seeing former vice president pence would be on the debate stage. former boston nikki haley who addressed 2024 speculation head on, saying that now that the midterms are over she will seriously look into a ron. in, will, quote have more on that soon. but of, course only one republican is officially in that 2024 race and that is former president donald trump. he was a prime target for

sites. but there is an exception for, quote political messaging or get out the vote efforts. tara, do you think trump will return to twitter in one of the implications if he does? >> of course he will. he will not be able to resist the idea of being back on twitter, even as part of his revenge tour starts. that's what is going to be. and p.s., his campaign is going to exploit the rules and use them whatever this travelers or megaphone because it is all about the attention. and right now donald trump is desperate for attention because he is being -- his announcement was not welcome to the same when he thought it would be before. his consultants clearly understood he probably should not have announced. but he decided to, anyway because he is unmanageable and it has been an absolute bomb for him so the fact that he is

and the twin already is back it's almost like here we go again. it is political groundhog day. but the difference this time around is it will not be as shocking and we will not cover every single tweet every single time because we have been down this road before. it is really yesterday's news. not to say we do not pay attention to it and combat his nonsense, but i really hope that we have learned lessons from 2016 and 2020 on how to cover trump and his machinations moving forward. >> basil, to terrace point the result old adage quickly once shame on you quick me twice shame on me. if trump goes back to the weather should democrats such as president biden in his administration, engage in any way? if trump starts to spread lies and misinformation? . or should they just ignore him as they are mostly done with respect to his insanity that he is putting on truth social? >> back in the days before social media my political mentor used to tell me that if you do not address a lie within 48 hours it becomes the truth.

and there are some elements of that. i do think that some messaging coming from donald trump needs to be corrected and the record set straight but i do not think you need to engage in each and every tweet. you do not want to engage into a twitter bottle and have this sort of larger discussion into debate about what is important in america. necessarily on twitter with donald trump. the democrats still needs to do that. and i think you largely just -- you do largely just ignore him. the reality is that he could cause more damage to himself than the republicans or than the democrats can cause to him. as long as you continue to allow his rhetoric to stay out there. it is possible that other republicans may actually eight democrats in that affair. in the sense that if they are running against him for president or any of the republicans feel the need to

challenge him than they may do so as well. without democratic help in doing so. so there is a lot that can happen without democrats actually engaging. >> you know tara and bases really just at the beginning of this hit played a sound of potential contenders for the gop nomination for president. attacking trump last night at the republican jewish coalition. including maryland governor larry hogan. chris christie and former secretary of state mike pompeo and new hampshire governor chris sununu. do any of these guys in a surprisingly already crowded field have a shot against donald trump? >> no. none of them do. how many of them were already vanquished by donald trump? chris christie, i'm talking to you. and he was from. josie on from thursday to so i was a bit disappointed without quickly he folded to donald trump in the turned around and was one of his biggest acolytes and now when he thinks it is politically opinion he's back to now criticizing him again. does he really think that he is

a child against angel trump? give me a. break he has already been exposed. as far as the, others i respect larry hogan. but he gave a republican i can support of that ever came to pass. but that lane of the republican party is dead and. gone and as long as you have multiple people running down and he campaigns again like they did in 2016 then at ten or 12 republicans split the primary votes and it allows the hard-core base that still supports trump allows him to skate through the primaries. so all of these people need to think about who are their constituencies in the primaries right now because they're running as if the republican party is the same party it was in 2016. i mean, 2012. this is not mitt romney and george bush. so i am watching this with great interest but i do not think that they have learned anything. this is not the way that you take out donald trump and if they want to try to do that they need to coalesce behind one or two candidates. and consolidate their support to go after him because he is

university of idaho students in the middle of the night, here is what we know. two roommates survived the attack by the 9-1-1 calls were not made until just before noon. the phone records of one victim showed calls to a boyfriend before she was killed. the victims had spent the night out socializing in the authorities had to walk back earlier statements about the community not being an immediate danger. and at this time no arrests have been made so far. the lack of information is left the family members of the victims frustrated and distressed. >> my husband is in contact with them every day. the fbi and moscow and idaho state police. and every day he just says nothing, babe and i'm like, nothing? and he's just like, nothing. >> -- >> we want to mourn our children we can't when we know this person is out there. you know you did it you know who you are.

just end it the guilt has got to be overwhelming. it has got to be sickening. >> authorities say the attack was targeted and isolated but with the killers and or killers still at large. many of the 11,000 university about how students have been leaving campus at a fear for their own safety. angela palermo has been covering this story from the idaho statesman and she joins me now. angela, good morning. under very unfortunate circumstances we welcome you to our show and our program. one week later, there seems to unfortunately be more questions than answers. i outlined some of the key details, but where are we this morning? >> hi, kelly thank you for having me on. the police released a few additional details last night. we know that the 9-1-1 call came from one of the roommates who was in the house when the crime occurred. and today, the police were holding a press conference so

we are waiting to hear more information from that as well. >> when something like this happens the entire country gets its interest piqued. but you yourself, you are part of this community as you live in moscow, idaho. and you actually attended the same university as the victims. how is the community in moscow reacting to this tragedy? can you describe the mood of the town and what you are seeing and hearing in that regard? >> yeah, it is very sad to see what is unfolding right now and i think the community is very scared and on edge. especially with no suspect or suspects in custody it is hard to feel safe and feel like nobody is at risk. you mentioned that the police initially said there was no broader risk to the community. and they have kind of walk that statement back. i think many people are feeling on edge. >> and angela what can you share with us about the victims and their families based upon

what you have learned so far? >> the victims and their families have been really impacted by this. we know that they are cooperating with the police and are sharing any information they can to try to help whoever did this get caught. >> there is clearly not a lot of information and we understand that it is obviously still kind of recent in terms of this. but that's a lack of communication that we saw, that poor mother talking about during the interview on tv that scaring the community in moscow and at large. is there a reason why the police have not been providing more information at this time and giving it to the public to assuage their fears and concerns? >> shore, yeah. i think the police are very worried about any new details that will come out that might compromise investigation. so they are being very careful

about what details have been coming out it has been a slow trickle. and i think it is also cause a lot of speculation online which the police had to come out and debunked certain rumors about the case. >> angela, there is a detail that we mentioned in the introduction to your interview. there is actually two other roommates that we're living in this house. where this tragedy occurred. they were unharmed. is that correct? >> that is correct. yes. police believe that they slept through the stabbing. >> angela, are there any other new details or are you waiting to find it from the press conference which is going to happen later today with the police in moscow? >> we are waiting to find out more. there were a few details last night but not a whole lot so hopefully we will get more information today. it will be the second press conference sense that happens. the crime occurred about a week

situation last week with this ticket masters of all the. debacle. tell us what broke all these records with her new album she basically broke the ticket master site when her tickets went on sale on tuesday and she was actually speaking out about that. obviously from her really quickly than explain what happened. her statement is as follows. there are a multitude of reasons why people such a hard time getting tickets and i'm trying to theorize how the situation could be improved moving forward. i will not make excuses for anyone because we asked them, she's talking about ticketmaster multiple times as they can handle this kind of. demands and we were sure that they could just really amazing the 2.4 million people got tickets but it really pisses me off that a lot of them feel like they went through several bear attacks to get them. and here is what went down last week is that the tickets went on sale and people were waiting in lines for up to eight hours trying to get to get sales between $49 and $450. but as you mentioned, people work of these lines and takers are being re-sold on sites like stub hub for up to $28,000.

so it is really shameful, and ticketmaster spoken out now. to try to explain what happened. they experienced unprecedented amounts of people trying to go online and get these tickets. and they have this system called a verified fan, which is supposed to keep real humans buying tickets. and bots from not buying tickets. but they had around 3.4 billion impressions happening in that one day. a combination of bots and real humans. so a lot of real humans were not able to get to. tickets and since fans are understandably frustrated. s and since fansyou know, chrisf this whole thing, for me, not that i am not a taylor swift fan, but it is the amount that these weasel tickets are going for. $20,000 for a ticket is absurd -- absurd! have you heard anything about ticketmaster cracking down on ticket scalping, trying to weed out the box, buying all these tickets and stacking them up? >> they want to try to do better. i think ticketmaster has never

what the larger implications for the live music industry, if this monopoly gets busted up? >> listen, a lot of people in the industry, industry wide felt like 2009, 2010, when this murder happened, that it was going to be unfair to the small mom and pop ticket selling platforms, it does seem like something is awry with ticketmaster. there needs to be an investigation going on internally, we need to find a way to kind of democratized the concert going experience again. listen, i'm a huge fan of taylor swift. i'll be darned wouldn't buy on say tickets go on sale for a new concert, renaissance tour, that ian paying the premium prices we are seeing right now for these ticket scalpers. i am happy to see legislation -- legislative action happening right now, because something seems really, really off. >> well, chris witherspoon, i appreciate you being here. to quote taylor swift, there is some bad blood. we will be right back. >> really? for real? for real ♪
