there is currently ways for patients that we found. >> we're going to need an ambulance of the several of location as well. >> we're now counting possibly nine gunshot victims. >> copy, nine victims. >> we're at 7:11 at -- with a patient who's been shot seven times. >> horrifying, all of that. colorado springs officials say police responded within seconds of that first 9-1-1 call. arriving at club q four minutes later and had the suspect in custody at 12:02 am. that allowed him as teams rescue and transport 19 people to three area hospitals. >> we are the -- the police departments of doing the victim quickly and getting him cleared for us to come in and a lot of circumstances like this would be probably twice as long for us to get in there and start treating this one is as soon as we were on scene

agreeable to move in there. >> police remain on the scene at this hour. they named the suspect's 22-year-old anderson lee aldrich. and had high praise for club patrons who stopped that attack. >> we are actively processing the scene at club q. initial evidence in interviews indicate that the suspect entered club q&a merely began shooting at people inside. as he moved further into the club. the suspect was inside of the club, at least two heroic people inside the club confronted and fought with the suspect. and were able to stop the suspect from continuing to kill and harm others. we owe them a great debt of thanks. >> nbc's -- joining me now. emily, and i've been following this since its inception throughout all this breaking news. what more are you learning now? >> just really some remarkable details coming out from the timeline in terms of the response. officers bringing the suspect into custody within two minutes

of arriving on site. in large part because of that help from people inside of the club. release with response. police say the suspect identified as a 22-year-old man. made his way into club q and immediately started shooting they say. with a long gun making his way through the club. at least two people had jumped to confront the suspect. and by the suspect prevent him from harming even more people inside. here's more from the police chief this morning. >> the suspect has been identified as anderson lee aldrich. a 22-year-old male. , at least two fire arms were found at the scene. we are still working to identify the firearms and who they belong to. i can confirm that the suspect uses a long rifle during the shooting. detectives are currently seeking multiple search warrants so please be patient with the release of information. as this is a large and complex

scene and will be time consuming to process. detectives are also looking to identify if there were any other individuals who assisted the suspect. >> police at this point have not identified a motive but investigators say they are looking into whether this could be a hate crime. overnight club q1 lgbtq club known to be a safe haven for people in colorado springs posted on its website. club cues devastated by the senseless attack on our community. they called it a hate attack. the club says it will be close until further notice the timing of all of this really strikes a nerve when you consider november 20th today is transgender day of remembrance. particularly in the lgbt community just a significant day and club he was planning to hold events today in remembrance. they posted about it the event just hours before the shooting played out on facebook.

we're also hearing from colorado's governor speaking out. governor polis. notably the first governor of u.s. state. he said in a statement reading in part this is horrific sickening and devastating. going on to add we are eternally grateful for the brief individual who blocked the gunman likely saving lives in the process. for the first responders responded swiftly to this horrific shooting. colorado stands with the lgbtq community and everyone impacted by this tragedy as we mourn together. alex at this point authorities do not believe there's any kind of ongoing threat. five people killed another 18 people injured in this late night shooting. some of those victims were learning are in critical condition. police acknowledge that we could see a number of victims continue to grow. especially when you consider that some of the victims drove themselves to the hospital. in the chaos after that shooting. very much a developing situation that we will stay on top of alex. >> that one 9-1-1 call will be heard outside of a 7:11. someone a victim had been shot

seven times and had called police. it is just stunning all of this. emily, thank you for following the latest. let's bring in right now frank -- former fbi assist director for counter intelligence. msnbc national concerted contributor and analyst. i want to get to something here before we go through -- learn of this news conference. there is another apparent unconfirmed the worth exploring wrinkle. what have you learned about that >> so again, unconfirmed by local police but new york times and other outlets have found a person by the exact same name in colorado springs of matching age last year or june i believe who was investigated for a bomb threat or bomb scare involving his mother. even the complainant may have been his mother and the target of the threat may have been his mother's home. if that comes out to be accurate and confirmed, of course it will raise questions

of why this individual was permitted to possess a weapon in the larger question of what criteria should forbid or pluck lewd someone from possessing a weapon. this person appointed -- including a long gun that he used in this episode. here we are again talking about mass violence. talking about what looks right now in the early stages to be a targeted event. as the reporters said, november 20th is transgender remembrance day. it's important in the law enforcement community when are investigating things like this to look at anniversaries, days of remembrance, what does the calendar say about maybe a possible motive. fbi denver field office has already made a public statement that they are involved in this investigation so don't be surprised if as the days go by motivation as developed as they look forensically at computers and devices and talk to people and talk to him.

if we see even charges, state charges and federal charges. possibly related to a hate crime. >> but specifically in confirmed in terms of a motive, we don't yet know. so walk us through what is happening at the scene at this hour. give me the kind of evidence investigators are still trying to collect their. and does that evidence potentially give clues about a possible motive. if so, how. >> so law enforcement is particularly in colorado's all too familiar with how to conduct forensic scenes, crime scene here. what's going on right now is with the fbi help and state official help. they'll be reconstructing the actual scene. including trajectory of every single round of fired. they'll be gathering security camera, video from down the street. around the building. in the building. this will help determine even through the entire week or

month whether this individual was seen scouting this location. whether he tend to the location previously determined what it was like inside. in terms of the shooting environment. all of that will go on. and then simultaneously they'll be search warrants written and executed probably happening as we speak. at his residence. looking for a devices. the fbi will comb through that forensically and look whether he looked above and so this location. that goes to premeditation. even if you looked up this holiday, to stay on the calendar. transgender remembrance day. that will help focus mindset, intention, that'll get prosecutors to the potential hate crime charges. we're also. as we just, said this last year where he was elected by police for -- is their mental health. involved -- one report said that the record of that investigation was sealed. does that mean that there is a mental health funding.

all of that will be looked at. prosecutors will have to make the call. is this homicide times five. is it a hate crime on top of it. does it go federal as well. time will tell. >> delving further into potential of hate crimes charges. here's the da's response to question that was asked. here it is. >> there was a previous question about hate crimes. investigation aspect. this will be investigated and is being investigated in that ellen's. i can tell you that the current bias motivated crime statute of colorado provide some elevation. it will not elevate beyond what will likely be charged in this case. which will likely include first degree murder, extreme difference. those types of charges. what you're all class one felony murder charges. >> so tell me you have this right. this means even if hate was a motive found to be a motive of this there. maybe no hate crime charges per

se. >> prosecutors are going to sit down and now we're kind of jumping ahead here. let's assume for the moment that there is hate as motivation. sometimes, by the way, the suspects will actually speak freely to the police and say absolutely. i am against trans people or gay people. that's why i did this. even if you confess to that. it's possible that the homicide charges times five and then 18 assault charges on top of that. it would not change the sentence. we're talking about likely life or worse depending on what's available in colorado. it's not necessarily true that hate crime would actually enhance the sentence in any appreciable way. prosecutors might say look, the guy spending the rest of his life in jail. there's also an important political message here. to say to people as a deterrent. it's not just homicide that we're dealing with. we're going to punish in this state, in this nation. hate based homicide. i think there's actually a

reason societal reason to charge hate even if it doesn't enhance the sentence. the federal government will make a similar decision. it's very nice, colorado. we need to send the same message as well. we will tolerate hate based violence. we'll see where this goes. my personal opinion is charged everything you can charge. we need today in this day in age to tell our society this won't be tolerated particularly hate based. >> really always appreciate your insight. particularly the last part. thank you so much -- for getting us through this breaking news. sadly, here's something we show all of you every week. the number of mass shootings in this country. this colorado attack. it is the 601st mass shooting this year. let's go to some new development in politics now. new reaction today after attorney general merrick garland appointed as special counsel to weigh potential charges against donald trump into federal investigations. house intelligence committee

chair adam schiff heading back at the former president's suggestion a move was politically motivated. >> i think it is the right move. you make a decision like this not because you think you're going to persuade the former president are doing the right thing or even his most extreme supporters. you -- >> there are still going to say it. but is the right thing to do. most particularly. if you ensure that it won't cause any delay. >> this comes as we get new evidence today trump's influence on the republican party may be waning as he launches his third white house bid. earlier today, former republican house speaker paul ryan becoming the latest prominent gop figure to point the finger at trump. over the parties underwhelming performance in the midterms. >> we get past trump, we start winning elections, we stick with trump, we keep losing elections. that's just how i see it. he can get his people to the primaries but they can win general elections. so it's really clear i. think the republican voters are going to move on. that's why don't think he ends up winning the nomination at

a prosecutor. who had been working at the hague investigating war crimes. who now will oversee both of these massive investigations when it comes to the mar-a-lago classified documents case. which we now involves former president trump taking thousands of government records with him to his florida estate. in addition, the january six investigation. which we have seen a lot of developments and learned a lot more about. given the select committee's probe over the last year or so. he will now oversee both of these. we know how the former president reacted. he dismissed this as a hoax and a witch hunt. we know how this current house reacted which is to say that lebron is justice is independent and we will let them take the lead on all of this. we heard more from the former vice president mike pence this morning on the sunday show. in addition to adam schiff who was also part of the january 6th committee and has some very important and relevant context in terms of where that investigation may be going.

take a listen to them both. >> i know how the justice department works. there had to be many other ways to resolve those issues. collect those classified document. i have great difficulty with the decision that he made. i've great concerns about his judgment in leadership with the justice department in the wake of it. >> for four years when he was president, the department took the position which i think is flawed as a constitutional matter that you can't indict a sitting president. you can't now take the position while you also can't indict a former president who wants to run again. otherwise that president becomes above the law in the founders who have never subscribe to that idea. >> also in that exclusive interview with meet the press, former vice president pence that he doesn't think anyone is above the law. but that it shouldn't be illegal he said to take bad advice from lawyers. essentially defending the former president's actions a

little bit when it comes to the classified documents case. we've seen the former vice president break with his former boss donald trump when it comes to january 6th. especially in terms of how his life was put in danger on that day. the big question here, alex, is about 2024. as you saw congressman schiff alluded to there, we know from president trump is in an current president biden who turns 80 today by the way he's the oldest president in the u.s. history. still making a final decision about whether he's going to do it all over again. >> we know what he is indicated. we wait and see for sure. thank you, monitor for that. joining me now. lisa rubin, legal analyst for the rachel maddow show. a good friend -- you along with many legal analysts have expressed surprise that merrick garland's decision to point the special prosecutor. why so. don't you think it was a necessary step? >> on one hand, i think president trump gave merrick garland no other choice. his rhetoric over the last 48

hours has only reinforce that. you know that on friday night for example, he said the deputy attorney general is being controlled by a former prosecutor. he is referring to our friend and colleague andrew weissmann. there's absolutely no evidence to suggest that -- who is known for her independence in her sharp acute legal analysis is being controlled by anyone much less by andrew weissmann. that having been said. one of the reasons i was surprised is because of the delay that this could cause and the fact that if the attorney general is satisfied with the performance of this person. you can only remove that person for cause. rising to the level of misconduct. not just negligence or you don't like they're performance or you suspect there -- really has to rise to the level of -- that's why i thought with just a permit would not let this out of its site. at the same time, i fully

understand why he did it. there are some additional factors here. that will end to the extraordinary circumstances. that allowed the attorney general to appoint a special counsel. when we suggest they are beyond donald trump. they really have to do with the house -- one thing that's also extraordinary is that there are at least two members of the house that i can think of who might themselves be under investigation by the department of justice. one is scott perry whose phone was seized over the summer. he tried to sue the justice department for return policy on data. he dropped that suit and no one quite knows why. the other person's incoming house judiciary committee chair jim jordan. who we know was part of a meeting basically right after the election in november to strategize what donald trump's reaction would be to losing. to say i didn't always. this election was illegitimate. we also know that in december he along with other members of the house -- gathered with president trump

in the oval office to plot the strategy with respect to january 6th. they were going to object to the certification and try and ensure through state legislatures or otherwise that certification ever happened. given those factors i now appreciate maybe more than i double for why merrick garland thought his hands were tied. that he didn't have any other choice. >> so i appreciate this deep dive that you've done in trying to get into it. we will talk further i suspect about scott perry jim jordan and the potential reasoning for that you mentioned there were reasons beyond donald trump. what about the reason you apply to donald trump which is that he's announced his run for president. there was a suggestion he was doing it early because he was trying to delay and complicate the multitude illegal challenges that he faces. some have argued the doj suspicions open special master three days after that announcement it's rewarding trump. because it may slow things down. where do you land on all that?

>> i think merrick garland was -- i think it was important that he remove east of the senior leadership at the department of justice from these investigations. given president trump's announcement. at the same time, to your point, you don't want the justice department to be like a vending machine or you can insert a quarter and get a reward every time you act in a way that it is basically like throwing a tantrum. that respect, i think merrick garland sort of split the difference. he has indicated through his language and we'll see whether this bears out that jack smith not only is coming into investigation where his job is to complete the investigation urgently and even handedly but that completing that investigation means bringing with him a host of fbi agents and prosecutors who will work this case diligently or were these two investigations diligently i should say. and that he won't be starting from scratch and -- former special counsel mueller

did. my hope is that and bringing along that staff objects amid avoids the delay that people think would be a reward for donald trump's bad behavior. >> i've no time to ask this question but going quickly here. if the special prosecutor finds reason to indict the former president in one of the cases he's investigating. even while another one may be ongoing. does he do that. can he do that an active for the other probe concludes? >> absolutely. i think there is an expectation on behalf of people who formerly served in the parent of justice that he will. there has been an expectation before that that indictment was coming soon based on public reporting about where merrick garland's department justice is. i would not be surprised if it indictment in the mar-a-lago investigation comes to fruition within six months. alex, you can hold me to. and we can have that conversation. >> -- i'm sure was a great answer. he can appreciate. thank you lisa rubin. happy thanksgiving to you. speaking of thanksgiving.

lgbtq i a+ people but particularly in this instance the transgender community. it's the ongoing rhetoric that we continue around banning crtc, around demonizing jewish people. the anti-semitic rhetoric reaches the news right now. win a major political party shares at least 50% of the political discussion oxygen at all times. showing since this type of stuff through speeches and rhetoric and actual legislation. what they're really saying is that it is okay to be -- these people ultimately should not be living. at least not living as freely and as caralee -- typically mean white christian heterosexuals. when you have a full half of our political equation sanctioning this type of stuff, what you're doing is giving tacit approval to the sake of behavior. particularly when you're not only restricting gun access but your expanding and access. i don't know how many times

i've been with you now for five years. but more than that. -- countless times. particularly today -- particular rise one of all specific community. unfortunately we can expect more of this in our politics that seriously contributed to if not give enough tacit approval to this type of stuff. >> i want to pick up on the gun part. colorado has suffered multiple mass shootings. columbine, anti-99. 1912. planned parenthood won in 2015. what needs to change to put a stop to these repeated tragedies? >> we don't have the particulars about this incident. however, we do know that we need a stronger gun safety laws. the biden administration and the democrats made a significant step. i know a lot of people think it was small -- it was the first step towards gun safety legislation and

getting something done in 30 years. i'll take it. we need to keep going on it and i'll just break it down into raw political ways. it makes sense for republicans to get on board with this if you want to win elections. those independent women suburban women that they need to get to win, they have a gun safety was right up there with abortion rights when it came to their voting especially in a state like michigan or we saw governor whitmer make it a primary issue. gun safety acquainted with -- do something about it. i don't know if it can happen anytime in the near future but it's going to take legislation to get it done. >> with some guys i'm just getting hot off the presses of statement by president biden on this deadly shooting. i'm going to read you just the first couple of sentences. while the motive in this case -- in this attack, is it clear, to your point, susan. we know that the lgbtq communities been subjected to horrific aid violence in recent

years. gun violence continues to have a devastating a particular impact on lgbtq+ communities across our nation and threats of violence are increasing. the president goes on to state several things not only reflecting that which happened there, horrific attack in 2016 pulse nightclub in orlando. as we look at congress david it did come together this year to pass bipartisan gun safety legislation. can lawmakers again come together to address gun control or will this divided congress prevent any potential efforts to make the country safer and rain in the out of control gun problem we have in this country. >> nothing will be done. i say that with element. the difference is in the previous congress, you had both majorities controlled by democrats in the democrat of the white house. and the divided government with republicans controlling the house. you will see nothing on gun control. and the sad thing is i think you saw this in joe biden's comments.

there are two absolute truth in this moment that we don't have to distill too much further. one's gun control policy in america continues to fail our communities. particularly, our most vulnerable communities. it's not working. it's not going to do anything about it and that failure is a new. the other truth is that hate still exists in america. and particularly for marginalized communities and the lgbt community. i don't want to draw a direct line to the specific political actors. but take the environment we're in which you have a don't say gay bill in florida. that public policy is being championed by republicans in florida. did not come about out of this massive expression of the public about heterosexuality. it came about out of a fewer people identified as lgbt publicly. and kids being exposed to it. there is an innate bias against the lgbtq community that's intersection between falcon policy and hate in our culture. it's what results in the events
