states according to the gun violence archive. that includes the shootings on an lgbtq bar in colorado, and a walmart in virginia. and, fresh off a better than expected performance in the midterms, president biden and the democrats are renewing their push for a ban on assault weapons. capitol hill correspondent -- joins us live this morning ali, this is quite a goal that president biden has set for the lane duck session. >> yeah, it is quite a goal, but it is hard to see this push go anywhere. nevertheless, you heard from the president just in the last few days, reacting to the latest in a string of mass shootings. you can hear in his voice, he is emotional, and visceral. this is what he said. >> the idea we still allow semi automatic weapons is sick, it is just sick. it has no value, zero, none,

for illegal activity is expressly prohibited, and if a package looks suspicious, drivers are advised to take it to law enforcement. in the case of alex, and over spokesperson confirmed they provided information to law enforcement in this investigation. the man who allegedly sold and sent alex drugs through brooklyn act now faces charges in connection to her death. >> what do you hope other families can learn or take away from what has happened to you and your family? >> watch their kids closely, their loved ones, our country has a serious fentanyl crisis, i would say just pay attention. nbc news, phoenix, arizona. right now house minority leader kevin mccarthy is so close to becoming house speaker, he can almost taste it. he just needs a few more extreme friends on his side. and that is what we are seeing

him pile on the threats about what he will do once this party controls the house. here's what he said about homeland security secretary alejandro mayorkas this week during a trip to the mexican border. >> secretary mayorkas does not resign, house republicans will investigate every order, every action, and every failure will determine whether we can begin impeachment inquiry. we will hold our hearings at the border, so the democrats can no longer hide from the crisis they have created. >> you heard that, right regular hearings are not good enough for kevin mccarthy, he quite literally wants to take his show on the road. it seems to fit what we are seeing so far about what republicans will do when they have the house majority, plenty of, performance not much in the way of governing substance. this morning, congressman -- democrat from massachusetts joins us. congressman, thank you so much

for taking the time to be here, look, you and i both know there's quite a difference between the two parties in the house right now. while democrats are rallying around a new generation of leaders, the top republican is doing whatever he can to check up to some of the most extreme members of his caucus. are these idle threats, or do you think mccarthy will follow through on that? >> well they are idle right now because kevin mccarthy hopes to become speaker of the house, but need to continue a trend that we have seen over the last several years. it was the gop is increasingly playing to its extremist base in order to rally out the votes here. we saw the 2022 midterms they are rejecting extremism, and i hope he heats that lesson. the gop wants to come and take the initiative and focus on lowering costs for families, and its independence, democrats are ready to work with them. we just came off the hills of one of the most bipartisan

congress in history. bipartisan investments in semiconductor manufacturing, science, gun safety legislation, when speaker pelosi's leadership and now with hakeem jeffries leadership, democrats are ready to work together to put face on the problems facing the united states monopoly tickle fear and made an embed scurrilous attacks on a president design only to weaken him. >> on top of all the investigations, house republicans are -- off of committees like eric swalwell, adam schiff. people who are actually getting the job done for americans. what is going to be the result of a party with control of the house for two years, that seems completely focused on political revanche and nothing else substantive for america? >> there are problems that we have right now the cost of housing, cost of health care, fossil fuel emissions that simply can't wait for two years. we cannot afford to do nothing for two years while kevin mccarthy engages in showmanship

and political theater for the delight of his freedom caucus and hard-core base. so just disappointing to me, but make no mistake, with hakeem jeffries, with john goose, democrats have a new generation of dynamic leaders, and we are not going to sit back for two years and let them launch hearings and allegations and attacks without merit. we are going to fight back ferociously. >> congressman, mccarthy has also threatened, as have other high-profile republicans, to reduce financial aid to ukraine if the gop were to take over a majority of the house. i know you served as a captain in the marine corps for the united states in active combat, how dangerous is this proposition to american national security if the republicans follow through with that promise? >> it is another example of brinkmanship and squabbling to the base as opposed to doing what is best for the country. ukrainians are fighting on the

2024 campaign, donald trump is already a major damage control mode. on tuesday, trump posted kanye, formerly known as kanye west, and a white supremacist nick -- for dinner at mar-a-lago. one longtime adviser telling nbc news, it has been a quote death nightmare. in the statement, friday trump called the dinner quote, an eventful. trump must have different definitions of that word, let's take a closer look at that guest lists. kanye west is currently losing billions of dollars in brand deals for his recent antisemitic comments on social media, and -- is a white supremacist holocaust denier who attended the unite the right rally in charlottesville. he openly uses his platform to spew hate speech, and shout about the american population

alina, thank you so much for being here this morning. trump's own former ambassador to israel david friedman called trump out on twitter, saying even a social visit tournament and testament like kanye west and human scum like nick fuentes is unacceptable. does this dinner gives republicans more of an impetus to dump trump in 2024? >> absolutely. look, it is just a little over a week since donald trump announced that he was going to run for 2024, and already he's breaking bed with those who would spew antisemitic and white nationalist rhetoric. nick is characterized by the anti-defamation league as being a white nationalist. this isn't a time when antisemitic hate crimes are on the race, we already know that kanye west now known as ye has been dumped by his endorsers with adidas and others. just recently, got back on social media with twitter. but the larger picture here is

that donald trump knows what he is doing its base is white nationalists. this is not enough for him to play he did not know who these people are, we know that donald trump tries to claim ignorance when he is at his worst, when he is doing his most damage. we can't afford to give him a pass based on ignorance when folks like nick were present at the january 6th riot, at the january six insurrection. that is why it is so important that we have the report coming out from the select committee on january six that can capture all of trump's wrong doings all the ways in which he has fulfilled hit in this country the ways he helped to foment an insurrection and how he sought to overturn an election in order to consolidate his power. ignorance is not enough. >> elaine, i want to talk about that 16 report, shortly but it

is not funny but funny. apparently nick is the new -- because trump denied knowing who nick is, why do you think that is the case, putting aside the obvious for you and me and the most decent people of the world, because back when he was in office, trump called white supremacist who marched in charlottesville very fine people. so why the denial that he knows or knew that nick actually stands for what he does this is donald trump's mo. he always tries to claim he doesn't associate with white nationalists. he doesn't know them. he also well wink and nod and the same breaths and so proud boys, stand back, stand by. this is a man who will use the defense and ignorance all the time. but continues to further the types of violence, hate crimes, white supremacy that has helped keep him in the public eye.

and secure him in office. >> as we mentioned a year ago we switch to news about the 16 committee. they were floored to find out the final report would focus entirely on donald trump. one staffers at the 16 committee became makes cheney 2020 -- 2024 campaign. ellen, i do think it's misguided for the 16 finals report to focus exclusively on trump and not allow other parts of the investigation to be included? >> i don't think it's misguided too focused on trump. i think those important reasons, mainly that this is the first ever president, as i mentioned, who tried to overturn the legitimate outcome of an election, that tries to insinuate an insurrection, to consolidate power. this is an opportunity for the select committee to potentially

make criminal referrals to the department of justice. this is edging not only the evidence into the historic record, because as americans, our national memory, when it comes to difficult things, can be very short. and this report will make it endure. but, it also plays out the case for the department of justice, of trump's actions. i think that's important, it's important to focus the national consciousness, and the department of justice especially with that appointment of special appointment of jack smith as special counsel. who has to get up to speed. i don't think that the focus on trump should be to the ultimate exclusion of other important evidence, about the rules and -- of security and failures of intelligence and, failures of security at the capitol. or to the radicalization of extremist groups. but, there are other ways of getting the information out to the public, other ways to ensure that this is part of the

vice president mike pence lately, largely because he's been an immediate georgia promoters notebook. but the biggest prior pence related headline isn't about what he said in those interviews it's what he might say next. the justice department might want to talk to pence about the january, six insurrection, according to two people familiar with the matter. pence was reportedly open to this particular request because it came from the justice department, of the house committee and they have not come from this reporting. for the record, chopped not asked this week, if trump committed a criminal act, implementing the insurrection. >> i don't know if it is criminal to listen to bad advice from lawyers. truth is, what the president was repeating is what he was hearing from the gaggle of

presidents peers. but pence's characterization of the evidence here is also berry -limited. saying only that trump took a repeated bad advice from a gaggle of lawyers. and that of course is exactly what doj will want to talk to him about, under oath in front of a grand jury. it's clear to anyone who is even, you know, engaged momentarily in watching these stories, that trump did for more than just repeat what lawyers were saying to him. and pence was involved in some one-on-one conversations with the former president, at key moments, trying circumstances, able to shed light on what trump knew, what trump was planning, and what his level of engagement was. so this will be very important testimony for the justice department. whether it tends to establish the former president engaged in criminality, or if it's exculpatory. whether it does diminish the notion that they might be

criminally was responsible pence's testimony is essential. >> i don't think it's gonna be exculpatory, but it sounds like it's crucial testimony for the department of justice. can donald trump invoke executive privilege in an attempt to prevent mike pence from appearing before a grand jury and providing testimony? >> right, not successfully. the reason for that is the individual who has the ability to claim executive privilege is the current occupant of the white house, joe biden, but even beyond that executive privilege is not absolute, that's good case law from the nixon era, that has to fall in the great need for testimony. that is the case with pence. and katy, you, know reflects of -- as a former prosecutor, i feel compelled to point out that prosecutors don't go into these during pre-judging the guilt. they listen to the evidence, follow where it leads, sometimes it establishes, guilt

sometimes it tends to provide some barriers that make it difficult for prosecutors to get their. but it's important for prosecutors that they have access to all of the evidence in this situation executive privilege is not something that will prevent that. >> let's talk about trump who has zero to be thankful this week. the house gets a look at his tax returns, and federal appeals looks like they're ready to end the review in the mar-a-lago documents case if. that happens, many believe an indictment of trump for unlawful possession could come soon thereafter. how far have viewers leave re-write these tea leaves, joyce, how important are these recent developments? >> they're incredibly important in two different ways. although this congress is one winding to a close, it's not clear the house will be able to make much use of trump's taxes, which of course could be very

important for writing new legislation to prevent abuse of the emoluments up. what they did do was establish a legal precedent, that could be used by the senate, if they choose to pursue the activity. that's important in a former, and future looking way, but when you think about the mar-a-lago case, that poses a far more immediate threat to the former president. that is the prosecution that looks like the furthest along in terms of where the investigation is headed. the evidence is a little cleaner, it's more narrowly focused in the january six investigation, which has a lot more moving parts. and, so this progress in mar-a-lago, which could be aided if the 11th circuit roles as many people including myself who heard that argument expect, then it's time for federal district judge aileen and her

interference in the investigation. once that ruling issues from the 11th circuit, doj will be able to use all of the evidence in that case, and continue to move forward towards indictment. >> joyce, i've got about 30 seconds left. i want to ask you a question i've asked you about -- on other shows i've had with you. we know lindsey graham has testified in front of the grand jury in fulton county. brian kemp, for example. there's been some high-profile witnesses appeared in front of that special grand jury down in georgia. do you think the fulton county da investigation and with an indictment sooner than we get one from the doj? >> it's a really interesting question. the fulton county special grand jury is about to wind up its investigation. and fani willis will need to go back to a regular grand jury to seek an indictment if she chooses. but prosecutors fast does never virtual. getting it right as what matters more. i think we will see all these

safer communities to the u.s. senate. took more than 60 votes, but we've got more than 60 votes. including republicans who had never voted in their career, for this kind of gun safety legislation. and i think they're reading the tea leaves already. and understand that they can't side with the gun industry, which is about profits over people, and not pay a price at the ballot box. that's just the reality, katie, as you noting. we're looking at the trends, and they're not new. this is been going on since 2018. every election since then, we've seen since those generations. millennials and gen z consistently bought for gun violence prevention champions. >> quickly before i let you go, 1994 salvo up an's ban, then joe, biden not president, able to get it done. it was allowed to lapse under george bush in a ten-year run.
