of our special low a very good day to all of you monthly payment financing. from msnbc world headquarters here in new york. welcome everyone to alex witt reports. we begin with new developments in the mar-a-lago classified documents investigation. and a new filing from special counsel, jack smith. shooting down an argument from donald trump's lawyers. smith wrote his letter on thanksgiving and file that what the court yesterday. attorney harry lippman will tell us what this all means in just a few minutes. also new fallout today, after he and a white supremacist walked into a restaurant of mar-a-lago. the pre-thanksgiving dinner has left donald trump on the defensive claiming ignorance. and still not denouncing racism or antisemitism. meanwhile, another trump ally mike lindell is floating a run for leadership of the oren sea.

yielded the most evidence so far. >> police said the shooter who killed six of his coworkers and injured three others at this walmart super center purchased a nine millimeter handgun used and the attack, legally on the morning of the rampage. and investigators also released a letter they found on the suspect's phone titled death note. police could not say when the note was written and a motive in the shooting is still not clear. and the letter, the government singled out his coworkers. saying that he felt harassed, betrayed and last. >> this particular letter named names. he actually identified people that he had issues and grievances with. that is tremendous lead material for investigators. >> according to walmart, the suspect worked at the store since 2010. and was the overnight team leader. >> you shop at this walmart? >> i shop at this walmart yang battlefield nearly every day. i did not know the shooter but i all did walk by him and say hi to him.

he was always looking very disturbed and very upset. >> people gathered in grief to mourn those who were killed. and police released the identity of the youngest victim. fernando chavez beroun was just 16 years old. according to the gun violence archive, there have been 610 mass shootings in the u.s. this year so far. president biden again, vowing to try and ban assault weapons. and chesapeake, and said i'm enjoying the holiday weekend, people are struggling to comprehend this country's latest episode of gun violence. >> it is like ready sensitized to know? to all of these events, they just keep happening. what will happen next to no? >> now at the city of jazzy peak will continue to remember the victims of the shooting, on monday there's an emergency city council meeting, as well as official to remember those who died. >> it is heartbreaking, thank you cal for that report. as we give you a look right now, at president biden, there he is

a holiday shopping in nantucket. the second thanksgiving in a row that the president spent time there for the holiday weekend. with his family, with hunter biden and we see their shopping with them as well and one of those shops. as a really charming place, looks like a little drizzly and cold though in nantucket which would be expected. let's go to nbc ali vitale who is in washington, covering the president for us as well. although she did not get to make the trip to nantucket, i don't know maybe the not have the jacket for it. but let's talk about what the president hopes to get done before congress adjourns next month. he made a pretty powerful statement about gun violence and controlling that. >> yes efren kelly o'donnell got the shot to go to nantucket and she was there listening as we all were when the president talked so angrily, you can hear this vest roll, a motion reaction and his voice talking about this latest and a string of mass shootings and what he hopes to do about it. watch. >> the idea that we still allow

semiautomatic weapons to be purchased is sick. it is just sick. and has no, no social redeeming values, none. not a single solitary rationale for it except profit from gun manufacturers. >> can he do anything about gun laws? >> i will try. >> what will you try to do? >> i will try to get rid of assault weapons. >> this is not the first time that alex that we heard president biden said that he wants to return to the assault weapons ban. it is still a low barrier unlikely for that to happen, even during this laying duck period. yes the house has passed this bill but it still remains the reality of the senate that they don't have the votes to pass this. and frankly, you think about just in the last few months, we saw targeted, narrow, moderate gun legislation passed by the senate and the house just a few months ago. it was targeted and narrow but still, praised as one of the most significant pieces of legislation on gun violence prevention and decades. it's a reminder of the landscape here that even as

democrats would like to do more, would like to push forward with this policy front, there is little to no opt out on the republican side. it would need to be done as bipartisan fashion to happen. >> it is remarkable despite the rash of mass shootings, there is to your point little to no opposite on the republican side for that. hard to fathom but thank you for reporting it nonetheless. that tally, we have some new aftermath of a russian missile strike on ukraine. this is the very latest attack, comes in the dnipro, similar attacks are happening in kherson as well. many of these assault or leaving ukrainians without power in cold weather. and bc alison barber has the very latest. >> blackouts continue and regions all across kyiv, about 6 million customers are still without power. that is according to president zelenskyy but he says that number is a 50% improvement compared to the number of customers, people who are without power wednesday evening. >> power in ukraine is slowly coming back. the chairman of ukraine's national energy company says

falling in parts of the southern plains. right now, more than 100 flights have been delayed in dallas fort worth and houston. but just a few of them actually canceled. today is the day to watch for more storms though. in several major airports, they could be impacted. in the morning, the wall of rain will shift to the gulf coast of the great lakes. the rain will then eventually arrive northeast, by that lunchtime. then in the early afternoon. the major hubs impacted will stretch from chicago to boston, then new york down to charlotte and atlanta. be aware everybody. every -- and rest up in maryland, that's where holiday shoppers have hit the roads. talk about what you're seeing there. we saw some course last hour with you. i'm seeing even more this hour. >> yeah, just to set the scene, i've got the travel stopover here. i've got to get station on the other side of the camera. then you've a steady stream of cars making their way to i-95 just in that direction. so, what we are seeing is a lot of congestion. it seems like it is actually growing. anecdotally, something i

thought was interesting was, we will hear on wednesday, the day before thanksgiving, it's supposed to be a really,. -- what we are finding is that today actually, it seems at least where we are standing, it seems like it was a busier much earlier in the day than what we saw on wednesday. something that analysts are looking at is whether or not remote work, that is the ability and the flexibility to leave different louis, maybe earlier in the week than before, whether that that is impacting travel patterns for the holiday. >> this year was different because remote working made it possible for us to go up, we all rented place together with the extended family up in philadelphia. my husband could work remotely once we got there. my brother and his wife could work remotely once we got there. instead of waiting until the day before thanksgiving.

>> i chance to speak with some of the people, they specifically left earlier, or maybe they had a family member at the deductible. who had the chance to earlier dominion remotely would. all of them, stuck on the road today. they stay traveling. we are expected to see the third highest number since aaa started tracking this in the year 2000. traveling by car is still the preferred method of thanksgiving travel with 39 million drivers on the road throughout the entire week. you're looking gas prices, yes we have the 3:57 national average right now, and yes that is higher than last year, but we are gone and on a good note. nothing to be thankful for is that it is the lowest number for gas since we saw that. >> i do like, that but i must say it is hard to leave the thanksgiving gathering first, it's kind of nice to be first in your own bed. just saying, thank you so much. it could be the end of the special master's role in the mar-a-lago documents

investigation. federal appeal courts centered on tuesday. it may side with the justice department, and and the independent arbiters review of the fbi's handling of classified material c from the former presidents resort. the circuit agreed to expedite the decision, but it is unknown when it will issue the final ruling. joining me now, harry, former federal prosecutor, i hope you had a wonderful thanksgiving, thanks for spending part of the season with us. before i get to that last part i was talking about. i want to talk to you about a new headline. in it, it says that jack smith knockdown a claim that rudy giuliani's case empowers in the mar-a-lago probe, can you explain this thinking and what is going on with this one? >> sure, at the 11th circuit argument, you're just talking about alex, judge cannon had done two things. first, she had parachuted in exercising so-called equitable jurisdiction. very, very unusual for a pending criminal cases.

and then, she had appointed a special master and said, the special master gets to review everything before the united states which is legitimately seizing all of these documents they, can do anything. so, the judge turned to be trump lawyer at the hearing and said, do you have a single case were this has ever happened? the trump lawyer said, oh yes, this is happened in the rudy giuliani case. well, guess what, that turned out to be wrong. in the true gianna case, there was a special master. but that is because the united states said voluntarily, we will do it. nobody ordered them to do it. now, jack smith, that is a judgment call and a caroling one here. something like that happens, you are new to the case. there may be some people who say, don't look too strident, don't do that, let it go. the court will figure it out. jack smith said no, he wrote a letter, very straightforward, one paragraph letter that said, this is incorrect for these

three reasons. in other words, he really did swat them down and it showed he is not gonna be cutting a lot of slack, he is holding their feet to the fire. that matters a lot for the trump team because they are very often barefoot. he is really showing his reputation for being pretty aggressive. >> two very sustained winds. >> two v ery sustainone of those are tru. not messing around, that's for sure. let's go back to what happened on tuesday, the appeals court judges were all appointed republican by republican presidents. we had two that were nominated by donald trump, by george w. bush. how did their questions signal that they are inclined not to side with donald trump and instead in the efforts of the special master? >> well, they said a number of things. by the way, the drop had already issued a stay in this case. the third, the chief judge buyer said, look, if we do this, why are you any different?

why doesn't mean that any criminal defendant can just come in and stop the eight united states from investigating? the trump lawyer eventually had to admit, well there's really nothing different here. that was a big one. what we just talked about was another big one. the third is, the complete absence of president. finally on the timing, the trump fellow said, just let it go. we are going to get the special master, he is going issue findings in a week. the department said yes, but then you can object to the findings, appeal, go up, this could be months. you can see that the court of peels was concerned about that and that suggests that they're going to come in pretty quickly and put a end to this whole misadventure that judge initiated pretty lawlessly a few months back. >> if that happens, harry, what happens next in the mar-a-lago investigation? >> that part just goes away and

we are left with a normal criminal case. what is happening next, it really looks like alex, is a decision whether to indict the former president of the united states on these charges, a very big question for the department of justice. do they try to do it in the district of columbia where they may have a bit of an argument on their hands? is it the proper place. do they do it in florida where there are more difficulties including judges like judge cannon around. but the next thing that happens, i think, behind the scenes of course, they complete the investigation. the next thing that we hear about, i think, is charges or no charges. the way i see it, from what has been going on today, that is going to be within a couple of months. >> shortest we today, but i'm just letting you get back to recovering from the thanksgiving holiday. >> i.d.s more pecan pies mediately. >> you are a pecan guy, we can

we should note here, nbc news has not independently analyzed the documents. we reached out for comment two attorneys for alex jones and his free speech systems company, we have not yet received any response. joining me now, the writer of this piece, jonathan o'connell, washington post business investigations reporter. along with senior attorney at -- representing sandy hook families, as well as jake westbrook, bankruptcy law professor at university of texas and austin. gentlemen, welcome to all three of you on this holiday weekend, thank you for joining me. first off, jonathan, sometimes when we talk about shifting money between companies, it sounds kind of complicated. but you say, what you found was quite simple. money started shifting long after the lawsuits were filed. some of the alleged companies that that has been paid had not been documented until the defamation trials were well underway. explain all of this. >> sure alex, you're absolutely right. lots of businesses, especially

small business owners will create multiple different companies around their main operation. also, they bring in family members to share in a business or the partners together. that part that alex is done is not really unusual. what is unusual here is that one, one of the companies that he has created which she is a majority owner of has now told the court basically that it is owed more than $50 million. by alex's main company. now, that is extremely unusual to assert. the company owes $50 million. if it's true that this other company is owed more than $50 million, then that company maybe becomes more difficult for the sandy hook people to get a hold of because it goes out of a company that is filed for bankruptcy. and then there are a number of other companies that he has started sending money to since he got trouble with the

defamation cases. there is a company that his sister manages. there are other companies that he owns with his parents. there is a company that his personal trainer started that is doing logistics for him. the court is really going to look closely at all these transactions, all these payments, and all these other businesses to see if these are legitimate companies, legitimate transfers, and whether joneses site has documented that all of this on the open of. >> you tried to reach out to the personal trainer, the sister of the parents, the heads of these other companies. what did you find out, what did they tell you? did you reach them? >> oh, i didn't, i tried my best to get hold of them. in mr. jones's camp, i did talk to people who have worked in the system for many years. some of whom who are in the story and decided not to be in the story. i reached out to a half dozen attorneys on his camp. i would've loved to have his voice in here, but for the most part, we only have his voice through the arguments he's made on the show, the argument he is

made in the depositions. and the arguments that they've made in court. >> you were well familiar that these families are coming up on ten years of torture. i want to play some reaction from one dad after the court, let's watch this. >> all i can they say is that i'm proud of what we will do accomplish. we told the truth. it shouldn't be this hard and it shouldn't be the scary. >> one of the families, what are they telling you right now? are they feeling let down again, are they concerned they are still up against a system that is designed to protect wealth? >> well, that is a tough question. i think in a lot of respects, a jury appears said unequivocally is what alex jones has done is unacceptable. it is the first step to justice. the other half of justice is getting allen jones to pay. i'm so glad that you're reporting on this. so far, alex jones hasn't paid

anything. based on our investigation, he is dead set on trying to avoid paying the sandy hook families for everything he's done. he's trying to avoid justice here. we are grateful that you are covering this, that other reporters as well or. this is an important issue. it starts with his bankruptcy efforts to avoid paying these families. >> they have put these transfers out in the open court filings. does that mean it is all completely legal? are these financial maneuvers at all unusual? >> well, -- they have no choice. the transfers are not necessarily unusual, except when you suffer a billion dollars worth of judgment, then there is very suspicious movements. the bankruptcy judge in houston has already pinpointed --

he is investigating all of this. a rather rigorous investigation. if he thinks he's home free with this, i think he will be mistaken. on the other hand, it is really time consuming to pursue these assets. we have a system that as you say is designed to slow things things down, jones is -- they get a whole lot of money out of it. >> if people routinely do this kind of thing to protect their money from losses, you protect bankruptcy courts in austin to act any differently? >> well, there is a difference in this case, there is a massive finding of malicious things. that means that -- [inaudible] i think that's a reason he hasn't filed personal bankruptcy.

almost certainly, he would not be able to get rid of these trials. the bankruptcy board has international jurisdiction. >> johnston, according to the documents you reviewed, alex jones followers are not just sold on conspiracy theories. they bought his supplements, up to 3000 orders a day. his best sellers include dna force plus, survival shield, and super male vitality. he claims that his company has $14 million in assets and 79 million involved abilities. and jonathan, you also found that jones transfers echoed financial moves that he made years ago when divorce proceedings, somewhat jeopardized his fortune potentially. you have seen sealed court records from that divorce case. tell us what you found there. >> jones was divorced from his wife kelly jones in 2015. having gone through extensive

things at that time, you can see the jones at the time starts creating new companies with his father that his wife is not a member of. those companies really are the basis of his financial engine right now, which is selling supplements to viewers. it is tremendously eye-opening, just to go through all the records. the amazing amount of money that he makes. he is selling $67 million of supplements every year to people who are watching his show. if you watch, even if you don't watch, what he does on there is he has a segment, then he has a commercial break where he is pleading with his viewers. listen, if you want to keep me on the air, if you want to keep broadcasting, you need to buy some of the stuff. it will keep you healthier, he argues. he also argues that he could go under if he does not continue bringing in revenue. that engine of selling supplements alongside his

conspiracy shows, that is the engine that has been incredibly profitable for him for a decade now really. >> i'm gonna give you the last word here. what do you make of the notion that so many people still support jones and buys products, make donations to him. what does that say to you? >> well, it says we have a lot of work to do in the country. really what it says is, why it's so important. at the same time, there is only a few let say that. again, a jury is so clear that what he did was unacceptable. in the court just this week in austin texas, alex jones was totally unacceptable and unprecedented. we need to keep that way. the way to do that is to hold him accountable and have him pay judgments. that is what full justice looks like in this case. you can't be allowed to find ways to dodge payments, dodge being held accountable with what he is done through bankruptcy processes and legal

threats of foreign spying on our capitol, after hundreds of chinese made drones have been spotted over the skies of washington d.c. in recent

months. unmanned aircrafts that have been manipulated to enter no-fly zone. 's it is a trend that security experts could fear are becoming a new means for foreign espionage. joining me now, brian bender, political sia senior correspondent. he's following this development. these drones seen over d.c., they are a recreational ones, manufactured by a chinese company. who is flying them? and what are the potential security risks? is it even possible that the chinese government is operating them? >> i think it's important to say at the outset that there is no evidence of these drones organized in any way by the chinese government. the concern here is that they are chinese manufactured, a company called dji, the most common recreational or commercial drone in the united states. the concern is that like a lot of, actually most, of chinese devices, there is links to the communist party, communist

government internet. recreational users are breaking the rules, because they want to fly over the national mall, where the pentagon, or other sensitive areas in the national capital region, could the chinese government use these drones by hacking into them, by manipulating them, as they developed the technology, to spy on the u.s. capital. it seems very much not. another chinese technology that could be sucking up information about americans, that's [inaudible] >> what, brian are these drones designed so that they cannot operate inside sensitive locations? that would certainly include washington d.c., the most secure airspace in the world. i, mean these restrictions are proving to be easily hacked. how easy is it? >> apparently it's quite easy. these restrictions are called d offensive. these drones would operate by

using gps. they're designed so that certain areas, particularly the nation's capital, which is very useful, our nose go zones. if drones are not designed to be operated in those areas, it's easy to go on the internet and find ways to, you know, pretty easily manipulate that. so you can basically get past some of these, and you want to go to the national mall and fly a drone, you can do that. apparently, that's been happening much more frequently, to the extent we're national security officials are concerned, could this be another means where the chinese government, if they wanted to, could spy on them? >> is the government doing anything to address this kind of threat? is there any legislation pending that's been introduced by congress? >> the essay has taken steps in the last two years. getting out on the explosion of drones in general. all over the place. those 870,000 drones,

registered in the u.s.. and that's growing. three times as much as commercial airplanes. they're trying to get a handle on it. hitting these drones out of sensitive areas. over stadiums and that sort of thing. including creating digital license plates, and things that you know where they are, but also, operating them. their members of congress that want to do more, particularly in light of these dji chinese drones, flying over the capitol. they would like to ban the drones. pentagon has already done that. >> well, they're not supposed to be there in the first place. we should know an estimated 2.3 million drones, both recreational and commercial, will be registered here in the u.s. by 2024. i think you'll agree with me, it's a pretty good chance that a lot more drones are going to be flying what they are not supposed to. making it a headache for the faa to track all of that. brian, thank you for your time, appreciate you. and for all of you, that's gonna do it for me on this
