georgia between rafael warnock and republican herschel walker. with early voting ending last night, more than 1.8 million voters have already cast their ballot, including those voting absentee. we're not holding more events today after campaigning with former president barack obama on thursday. walker being joined on the campaign trail by south carolina senator lindsey graham this week as nbc news reports he is in desperate need for cash as questions swirl about where he actually lives. for more on all, this we turn to nbc news correspondent ivan hillier live in atlanta, georgia. good morning, don. >> good morning my dear friend. we are in a moment in which we are talking about the final major contest of 2022. for raphael warnock and herschel walker, the difference of today compared to last some days is, they can't tell voters to go to the polls today because early voting officially

ended yesterday on friday. record early voter turnout. every single day this week, you saw a record numbers compared to even 2020. in large part, why is that? it is because the runoff period has been truncated by a nearly whole month here. you recall back in 2020 when john ossoff and raphael warnock propelled to the u.s. senate victories, election day was january 5th of 2021. this time around, it is december 6th of 2022. that is why you're going to see this all out blitz, even though early voting is over for the weekend. voters are not going to be able to go out to the polls until tuesday. we are outside union hall in atlanta were in about two hours now, raphael warnock will be holding what we are told will be at a major rally, several hundred folks. we will now be headed over to the sec football championship game where we expect herschel walker to be out among tailgaters. for all intents and purposes, there is a hold on the politics

because georgia bulldogs are in the champion ship game today. the atlanta falcons play at home tomorrow. but you're mentioning also, katie, that cash disparity here. democrats have put everything into this. they have outspent pro walker forces by greater than 2 to 1 margin. you've also seen a democratic ground game here really at the heart of this warnock effort, trying to replicate what they did in the 2021 runoff when rough warnock won. there is always been this mistake or questions rather around democrats showing up for the special elections. in 2021, they proved that they do, they turn out in a greater show out then republicans and white voters here in the state of georgia. this is what gave them the two senate seats, now they need to do it again. in the words of president obama who is here two days ago, he said i'm asking georgians to come out one more time. >> thank you, my friend.

bond hillier in atlanta, georgia. now robert shift our focus to the house select committee. investigating january 6th. it is quickly running out of time for republicans to take over the house. right now, we are awaiting their crucial final written report. their decision on any possible referrals for dollar trump are awaiting. allie raffa is live on capitol hill for us this morning. ali, good morning. the committee met yesterday, friday, what can you tell us? >> katie, good morning. members were very tightlipped when we asked about any details from these two virtual meetings they had yesterday. to go over what is left on there to do list before they have to wrap up their work as a committee on december 31st. one of the things we know they must have talked about in those meetings is that final lengthy report that chairman bennie thompson says is likely going to be released before christmas. one big question looming over all of this is how exactly that report is going to be released.

the committee members have left open the door a possibility to potentially another public hearing to be able to present this information in a more digestible way to the public. another thing that committee members are going to have to decide on is, what is going to have to happen to president trump and those house republicans, including the likely next speaker of the house, kevin mccarthy who ignored the committee subpoenas for testimony for documents? should they face possible criminal referrals to the justice department? these are all things that committee members are still considering, still deciding on over the next few weeks before their power or as a committee dissolves on december 31st. big decisions that could really shake the legacy that this committee needs. >> ali, another big topic on the hill right now, democrats finally have their hands on trump's tax returns. so, what happens next? >> this was a long legal battle that ended this week when the

committee obtained six years a present donald trump's attacks returns. there is still a lot of secrecy, a lot of sensitivity around these documents by house democrats. there is a real feel of violating some serious disclosure laws. as a matter fact, we still don't know where exactly these documents are being stored and whether all committee members have had the chance to access them, to review them. the spotlight is really on democrats and this committee, whether they will make the decision to release these publicly. technically, they can if they vote as a committee to do so. whether they decide to do that is still really unclear. we know that that does take time, that's something the democrats on this committee are very in short supply of. remember, republicans will officially take over the majority in the house, therefore the majority and control over this committee on january 3rd, katie.

swiftly, all while hosting the first state dinner of the biden administration with french president emmanuel macron this week. yes, that is big news on the political calendar front. a new plan of putting south carolina first would be a huge change to the traditional presidential trump primary system. i will any hampshire have gone first for decades. but there have long been calls to switch of the order to reflect more diverse electorates. that course only got louder after i was delayed democratic caucus results in 2020. we all remember that debacle, right? under this new proposal, south carolina would go first, president biden personally pushed for this. a key state, as you mentioned. under these proposed changes, new hampshire and nevada would follow on the same day three days after south carolina. then it would be georgia, then michigan, leaving iowa out of the early state contests entirely. this is a done deal yet, they have to approve it early next year when it meets before this becomes reality.

in. a federal appeals court ruled that she overstepped when she granted trump for a review of the documents received at mar-a-lago. the court ordering that trump's case be dismissed. it is obviously a huge setback for trump that will allow federal investigators to move full steam ahead with their investigation. of course, trump still has the chance to appeal and we have seen him use that tactic repeatedly. we will get into what this means in a moment, but let's talk a little bit about judge cannon. take a look at some of the headlines in the aftermath of this decision. different outlets said kenya's ruling was evaporated and slammed, they point out the growing calls for her impeachment. canada represents one of the most significant legacies from the trump presidency, the sheer number of conservative judges now in place across the country. but all three of the judges on that panel were appointed by republican presidents with two of those judges being trump appointees. so, what does this week's ruling signal?

i'm glad to welcome my good friend, former federal prosecutor and legal analyst and the host of the podcast justice matters, glenn kirschner. glenn, good morning. thank you for being here. with the caveat that trump can and will likely appeal, where does the doj's investigation into the documents seized from mar-a-lago now go? seeing how a special master has been eliminated and we now have special counsel. >> i think most importantly, katie, this clears the deck for jack smith. let trump appeal, how many times recently has he tried to bubble up a case or an issue to the supreme court only to be a pretty quickly slap down. this appeal will go nowhere, but the good news is, jack smith and his prosecutorial team now have unfettered access to all the documents, all of the evidence of a crime that was seized from donald trump's florida home in mar-a-lago. i have to believe that they are

full speed ahead working towards indictments. >> glenn, there are some calls for judge cannon to be impeached. you and i as former prosecutors, and his lawyers, we know that sometimes judges just get it wrong. in this instance, it is not unfair to say that canada looks like she was an additional member of trump's legal team here. as the 11th circuit noted, it seems like judge cannon overstepped greatly. sometimes even inserting arguments on behalf of trump that didn't even exist. but really, glen, how realistic is it to expect judge cannon to face any professional repercussions for her bad rulings? >> katie, as you say, we both know judges sometimes get it wrong. but they usually don't get it lawless. that is what judge cannon did. she acted in a lawless way. i think the most devastating line in his whole 21-page opinion appears on page 20. if i could urge everybody to just read the few paragraphs on page 20 and 21 of this opinion,

it is about as close to an accord opinion comes to what i would call rule of law poetry. here is the one line that i think is devastating to judge cannon. the three judge court panel unanimously said, just because the search warrant was executed on the home of the former president, quote does not give the judiciary license to interfere in a criminal investigation. that is going to leave a mark, katie. that is a three judge appellate court panel saying, judge cannon acted in a way that was a lawless and she interfered in an ongoing criminal investigation, not just any investigation, one that has us national security implications. because of the nature of the documents so trump stole from the white house and unlawfully concealed at mar-a-lago. i don't see how that doesn't give rise to a judicial

misconduct investigation. now, can we expect the -controlled house to move away on articles of impeachment? unlikely, but there has to be an investigation of some sort of what prompted alien can into act lawlessly. >> you know, glenn, you are a busy man making sure that we understand everything that is going on. but you also sat through that oath keepers trial. another big headline this week, a jury, as you know, convicted oath keepers leader elmer, i love saying that part by the way, people always say stewart, elmer stewart rhodes in one of his associates for seditious conspiracy in connection with january 6th. glenn, this is a case that you've been tracking closely. what stood out to you that our viewers need to know about this verdict, what does this mean for the doj's trump investigation? >> probably the single biggest takeaway is the federal

prosecutors have been vindicated. not that that is our job to look for vindication when we make a decision to bring a difficult case and challenging case, a politically-charged case. the jury sought the prosecutors, they believe they had enough evidence to meet their burden of proof beyond a reasonable doubt. the oath keepers, this organization committed a crime of seditious conspiracy. they violently tried to overthrow the government, they tried to violently tried to resist the laws of the united states, which is precisely what they did. they tried to stop the certification of joe biden's presidential win. this will embolden, it will energize the federal prosecutors because katie, this week coming up, there is part two of the oath keepers trial. we saw that infamous military formation going into the capitol. this trial only held

accountable half of that stack. the other half of the oath keepers stack is coming up for trial next week. the proud boys are coming up in their seditious conspiracy trial. these verdicts i'm quite sure will inspire all of those descendants who are pending trial to perhaps think about reopening plea negotiations, maybe with cooperation. i think is gonna have a ripple effect and those ripples may now ensnare people like roger stone, alex jones, mike flynn, and others who were closely aligned with the oath keepers. with the proud boys. we don't know where those ripples will stop, but this is a good development, not just for the prosecutors but for the american people and for democracy. >> glenn, when i have legal analysts like you who are so in tune with what is going on, i want to ask the following question. you don't get have an explanation, yet to give an

west if you didn't know stunned the world this week when he praised adolf hitler during an interview on infowars. it was an extreme combination of nearly a decade of antisemitic comments, some getting as far back as 2013. but what isn't shocking is how we got here. the republican party legitimizing him and his nonsensical views ever since he threw support behind donald trump in 2016. two years later, trump invited ye to the oval office and it's not a hyperbole to say that it was one of the most bizarre events ever hosted from a president's office. in october, fox news and tucker carlson held up ye as a champion of a conservative views after he wore a white lives matter shirt to paris fashion week. it was later revealed that the interview that was aired was edited to leave out ye's many negative comments about jewish

people. then came this tweet from the gop house judiciary committee, tanya, elon, trump. seeming to affirm that these three unholy trinity perfectly represents the modern republican agenda. that was up for nearly two months, two months. even when the rapper brought a holocaust denying white supremacist friend to mar-a-lago to break bread with donald trump, who some consider to still be the leading gop presidential candidate for 2024. that gop judiciary committee tweet was finally deleted after ye's pro hitler's remarks. the anti-defamation league found 2021 have the highest number of antisemitic incidents in the united states since 1979. with 2022 on track for similar numbers. while some republicans are now publicly condemning a, i'm left wondering, where is the accountability when it comes to those who enabled him and those who continue not to speak out against the antisemitism?

on his terms, in just under two years, biden has signed into law the unprecedented 9 million dollar investment plan to help combat covid. he secured the passage of the largest infrastructure investment in united states history, signed the most sweeping gun reform bill since the clinton administration. he made the largest investment to combat climate change ever. president joe biden was able to do all of that with the country split into. while also having one of the best midterm performances for a party in power in u.s. history. what do republicans need to do to regain power? newt gingrich says the party needs to entirely rethink how they are going to defeat democrats and quote, looked much more deeply at what worked and what didn't work in 2020 and 2022. let's bring in mice out it morning panel, democratic strategist basil, and republican strategist susan. good morning both my friends. thank you for being here.

susan, i like to start with you this morning. do you agree with newt gingrich that the problem for republicans is that they have underestimated joe biden? or frankly, are the lack of republican policies the real problem? >> i would say yes, yes, and add to the fact that the candidates who have been running in 2020 and 2022, and in the trump factor. i think what newt gingrich, trump is a problem. extremism is a problem. americans will choose confident governance, even if they don't agree with all policies over incompetent extremism. i think that is one thing that newt gingrich should've added, but maybe wasn't prepared to do. it is an honest assessment. i've been saying for over a year, the successes that joe biden has had have made him one of the most effective presidents, whether we like it or not. let me just add, those

successes will be seen in 2023 and 2024. democrats run for reelection, including maybe joe biden himself. when we look at prescription drugs lowered for seniors, they are going to see you next year. infrastructure, they are going to see those shovels in the ground next year and in 2024. so, i think newt gingrich was right, but he didn't go far enough. >> basil, building on this team, congressional chair told political quote, he was not my first choice for president, but i am a convert. i never thought i would say this, but i believe he should run for another term and finish this agenda we have laid out. it's some democrats, not just republicans, did some democrats also underestimate joe biden? >> absolutely. look, nothing succeeds like success. while joe biden ian, to some parts of the democratic party

may not have been able to accomplish all they wanted, he was able to deliver on more than they thought he could. that is incredibly important, particularly for a president who campaigned on bringing back some version of normalcy. to be able to have pushed through the legislation that he did and be able to do that by, in some a contrast. talking to a voter, whether it's in the midterms, 2023, 2024, the key here is to draw the contrast. look at the choices that you have, you want someone, you want a party who is governing and actually producing legislation and policy, or party on the right that is doing something completely different. >> you know, susan, trump on thursday publicly supporting insurrectionists, saying that they were treated unconstitutionally, very

unfairly. trump dined with andy some matt kanye west. he uses qanon music at his rallies. he's facing criticism, but instead of pivoting, trump just doubles down and even more openly embraces the extreme right. susan, has trump shedded any pretense that he stands for anything moderate anymore? >> i never thought he stood for anything, so except for himself and trying to win whatever it took. it is not surprising to see him go to the extreme because he knows that is the only lane, even though i don't think you will be on a ballot in 2024, that if he were to win a primary, he has a hold, he could win it with 20%. assuming that there are ten other republicans running for president. he is doubling down on the baseless report. in the end, the question is, will republicans continue to support donald trump, that base of republicans, or those elected officials that have lived in fear? will they continue to support

donald trump as he goes more and more extreme? >> basil, quickly, biden is not gonna be able to pass much in the senator much republicans take control the house, what is the white house strategy for years three and four? especially if joe biden is going to run again? >> i think part of the strategy is to do what we have always done which is to put forward good legislation, good policy, and be able to say if it comes to this, hey, look at what we've done in the first two years. look at what we are doing in the second two years, the difference between those two is that republicans stop us from doing all that we could be doing. again, continue to draw those contrasts, continue to put up good candidates. that is critically important. and again, do exactly what they've been doing in drawing those contrasts. accounting for good, solid solutions to some of today's problems. and governing in the modern ways that he campaigned on.
