a very good day to all of you from msnbc world headquarters in new york. welcome to alex witt reports. i'm gonna tell you that it may not be a good day for some of you. we have disappointing news breaking right now for the u.s. national soccer team. just moments ago, their world cup dreams ended at the hands of the netherlands. they lost three to line. the u.s. team fought back valiantly throughout. but the eagles would not fall. in the end, again, the netherlands moves on to the next round. the united states will head home. we have more for you later in the show. stay tuned for that. let's go to today's big political headlines. déjà vu in georgia. another weekend of closing arguments by senate candidates. squaring off in tuesday's won of election. the incumbent democrat senator, raphael warnock, he rallied workers and union members

today. >> my opponents said that if you are able bodied, if you have a job, you had health care. i am not mad that he does not know what he is talking about. i am mad that he does not know what he is talking about and he thinks he should be a united states senator. >> he is talking about the republican, herschel walker. he will appear in a football watch party this afternoon. he spent time making his case to fox news viewers. >> i am one of those candidates. i believe that it is not what your country can do for you, it is about what you can do for your country. right now, we need warriors. we don't need politicians. we need people who want to fight for this country, fight for your kids, fight for my kids, and fight for the right people to have the right to speak. >> georgia is one of the states being elevated in indian see new primary calendar. south carolina would go first, and new hampshire, nevada, georgia, michigan. new hampshire officials are already is threatening the rebellion to change its date.

meanwhile, prosecutors told manhattan jury yesterday the documents show donald trump explicitly sanctioned tax fraud. that came during the closing arguments in the criminal tax fraud case against the trump organization. trump himself has not yet been charged. the house january six committee met yesterday to discuss, among other things, possible criminal referrals. the committee has been racing against the clock to complete its work before the end of this month. that is when the gop takes control of the house. for more on this, let's go to msnbc's allie raffa on capitol hill. ali, the big question, did the committee reach any conclusions on criminal referrals yesterday? >> yeah. alex, the short and simple answer is no. that is still one of the major issues that the committee is still thinking about and contemplating as they go through there to do list they. have to finish it off before they dissolve as a panel under somber 31st. we have to figure out what doable former president trump in those house republicans. that includes the likely next

speaker of the house, kevin mccarthy. he ignored the committee subpoenas to come forward and testify to provide documents the committee. that is how to present the final length of the port of their chairmen. benny thompson says they're ready to be released. mers have left the door open to the possibility of another public hearing. they could present the findings in a more digestible way to the public. in turn, the justice department. there are several things still on the committee's plate that we know are still in talks. we know they are still overreach discussions. even when they are not physically here on capitol hill. these major decisions are really able to shape the lasting legacy to this committee leaves. at the same time, houston accra sorrow also facing this big decision. they receive six years were the

former president trump's tax returns this week. it is possible for them to be able to release this to the public. that would require a vote on this committee to be able to do so. whether or not they decide to do that is still unclear. we know it does take time. that is something that democrats are in short supply of. we know that house republicans will take over a majority. they will then control this committee on january 3rd. >> okay. setting us off there from capitol hill. we appreciate. that meanwhile, another new legal blow over donald trump. it is a win for the department of justice. see separate court of appeals stop these special review of documents received from the mar-a-lago resort. the ruling on -- a new judge appointed the senior judge -- they review documents at the request of trump's attorneys.

-- that is a major hurdle oh. they say they slow down major -- >> join me now is the professor and an msnbc legal analyst. welcome. glad to have you here. the appeals court issued unusually harsh language against judge cannon for interfering to the investigation. what did the panel conclude? >> you are right. this was a stunning review. the court made clear that federal records are course of limited jurisdiction. that means they cannot do everything. what judge cannon did, he intervened. it is known as equitable jurisdiction. that is something the appeals court characterizes as extraordinary. it should only be granted in the most extraordinary circumstances. it went far beyond. the court basically said it in a situation like this, she is making precedence. she is basically saying that she can intervene because the

equitable nature of this moment requires her -- there is this master. they're doing so in this situation. the court said it would literally open this up to any person who is subject to a search warrant. they're exercising beatable jurisdiction in a situation like this. -- we are a country where the rule of law continues to be the force that holds us all together. the appeals court says that this was way beyond the bounds of what this district court judge could do. they immediately ended it. >> you know this clearly we. have these appeals courts rulings. by the way, they are all nominated by republican president by donald trump himself. specifically, it goes like. this it is indeed extraordinary for a war to be executed at the home of former president. but not in a way that affects our legal analysis. it gives the judiciary license the privilege to interfere in an ongoing investigation.

it then goes on to create a special exception here. it would defy the nation's foundation principle. our law applies to all people without regard numbers, we'll, or a. the big picture here, melissa, what does this tell you about -- >> there are a couple of things. he can appeal this ruling in the court of appeals to the supreme court. the supreme court has not been super susceptible to his claims. that may be a losing argument. that may be the case that they don't appeal this at all. the question of the special master was always believed by many legal commentators to be a delay tactic. he has served that purpose. it has to lead the ongoing criminal investigation. >> melissa, since we know -- how many times have you and i used this phrase? i have used it. we said it. delay, late, late. do you expect that donald trump will use that playbook to make an appeal land put all of what

is the inevitable at some point? >> i think that if he does appeal to the supreme court that it will be handled rather expeditiously on the shadow docket. i think it is unlikely that you can have the kind of delay effect that he would like. the facts still remains that he managed to delay this criminal investigation by requiring this review the documents. it took almost a month and a half, two months to actually complete. there was all of the time spent dealing with this in court. he was actually relatively successful in slowing this down. now he is back on track. he has been appointed to the special counsel. he is gonna be the special prosecutor. he is going to leave any further discussions of donald trump's liability on the many different cases where he has legal exposure. it may not be an opportunity to further slow this down. donald trump will certainly try to do so by claiming executive privilege. claiming that the documents that were seized directly declassified by him. whether formally or with his

mind. there will be more to come. i think we will see more antics from the former president. >> beyond the antics, do you see any and betterment of getting this thing done? doing it rather expeditiously? >> jack smith is a prosecutor that people regard as someone who is straight arrow, street shooter. he is not going to indict or bring criminal charges forward unless the evidence suggests that this is something that needs to happen. we need to hold the president accountable. i think you're gonna get a very careful review of what is here. again, it may take some time. ultimately, this is going to be a very meticulously tough job. at the end, we will either have a situation where the president will be held accountable, if in fact there are reasons to hold him accountable. >> let's take a look at what was happening yesterday with the former trump white house counsel, pat cipollone. former deputy, patrick hillman. they were seen yesterday after a federal judge ruin ruled that donald trump could not claim

executive privilege over certain aspects of their testimony. they indeed had to answer more questions from a federal grand jury. new york times also reports that donald trump's former social media guru -- william russell and william harrison, they were for trump when he was in the white house. they also appeared before a grand jury on thursday. melissa, what does this tell you about the status of the doj investigations? how significant are those testimonies? >> you joined the doj. the trump administration have been claiming executive privilege to prevent the testimony of these individuals at the grand jury. we do not know what particular case or investigation this is dealing with. it could be the mar-a-lago documents. it could be january 6th. either way, these individuals now have to come before the grand jury and provide testimony on certain aspects that will surely be helpful to the investigation. this is not necessarily mean that we need these indictments or criminal charges. but it will allow the prosecutor to have a better

sense of what they are dealing with and whether or not criminal charges are in the offing. >> okay. melissa, we hope you have a good saturday. come see me again soon. thank you. now, to the economy. good news for the biden administration. there was a strong jobs report. 263,000 jobs added in november. let's go to nbc's josh lederman. he is at the white house for us. josh, welcome. how much did this report exceed expectations? what is the president saying about it? >> it certainly did exceed expectations for many economists. they anticipated something more like 200,000 dog jobs. there were exceeding expectations. that is positive news. in a way, worrying news this administration. all explained why. president biden emphasized the positives. he spoke yesterday at the white house about this jobs report. he pointed out in particular the fact that wages continue to rise. in particular, there is the last couple of months or so. they went higher during inflation during that seven month period.

that means that workers are starting to play catch up a bit in terms of their wages and being able to afford them. these are the things that they were able to buy in the past. here is the way that president biden described the way his policies played into that continued strengthening of the economy. he spoke here at the white house yesterday. >> we are going into the holiday season. here's what it means. the american people are working. the economy is growing. wages are rising faster than inflation. we have avoided a catastrophic -- not mean that our plan to build the economy is working. the wealthy are still doing very well. >> president biden cast at this latest support as a growing body of evidence that his policies have worked to help secure the economy. they have steered it away from a recession.

here's the flip side, allies, there is the fact that the labor market is still surround hot. that is probably unlikely to lead the federal reserve include, all right, we have done enough to take the foot off the gas pedal. they will try to prevent a recession. there is the possibility that the fed will continue to raise interest rates. that is probably more likely than last likely as a result of this job support. even if those increases in the future are smaller than the ones we have seen the past. that is a particular concern. especially here at the white house. the farther the fed go is in trying to raise those interest rates to prevent the economy from overheating, the greater the risk that they could go too far and end up pushing the economy into a recession. alex? >> happy holidays, america. yikes. okay. josh, thank you very much. so, did hell just freeze over? president biden got a complement from someone that you would least expect to give

worsening candidates are making their final pitches to voters ahead of tuesday's runoff election. democratic incumbent, senator raphael warnock just ran up a rally at a labor event in atlanta. as republican challenger, herschel walker is gearing up for a campaign stop later on this afternoon as he attempts to close in on warnock's narrow four point lead. that is the latest cnn poll, which is nearly within the march -- let's go to nbc seville kapoor who is joining us now from atlanta. so he'll, welcome. a strong, actually very strong showing from early voters. what can we expect for the remaining voters head to the polls, just three short days from now? i am understanding that we might have a little bit of a all right, little bit of a sound issue that. we will get back to him. we do have some others who are

enlightenment if you will from cambridge, is it's effort to try and explain away that shock of no red wave? >> if yes first of alex, thank you gingrich for rewriting with democrats have been saying all along. look i'm in the question to your point, is all republicans going to pay attention? i mean they are so focused on giving debating these cultural. as having fights on twitter and fighting the freedom caucus will lead the charge or more moderate wind of the party will succeed. my guess is on this. my bet is on the freedom caucus. as opposed to actual legislating and the dems, we talked about this on your show where the day that nancy pelosi said i am no longer running for you know the democratic leader, at the same time republicans in the house held a press conference saying the first thing that we will do is examine hunter biden's laptop. that is not what the american people want, that is not what they told republicans that wanted in the midterm election

cycle. they want to competent and effective government. that is exactly what luke getting bridge reiterated. he is getting things done and he is you know, going in the lines of ronald reagan and dwight eisenhower in terms of actually getting things done. and doing what he said he would do. so you know again, i can't believe i am actually agreeing with cambridge on something, the big question as well republicans actually follow suit and listen to their former leader. >> he, listen not stopping there with gingrich court because he goes on to say that the biden team had one of the best term offer elections in history. take away the fact that gingrich says that he opposes virtually every biden and mission in. as on the key is saying four more years and by the way, i know also a new l.a. times op-ed about the gop failure. give me overall your reaction to gingrich. >> well again like adrian i can't believe i'm saying but luke gingrich is right. when you consider the fact that joe biden, is something that i think democrats like adrian or

i in the thrust hold with the press about it, it doesn't get the credit that he deserves for the historic accomplishments and he has presided over was one of the narrowest majorities and congress that we have ever seen any united states history. and that he has gotten historic investments and infrastructure. -- >> hang on kurt, who's fault is it that you are talking about a messaging issue. why is that not getting out because we do talk about it in a granular way, the three of us has done so. i have done it with different dress. we talk about the accomplishments. why is that message not getting out to your satisfaction? >> well i think honestly this is where the mainstream, beltway media kind of gets caught in the process. so much of the narrative for the better part of the, year is what democrats in disarray? and it was focusing on figures like joe manchin and the sinema. it was about the republican with than ever materialized. that there are so much oxygen

and then here we are at the end of the year looking back and going wow, do you know what? there was not a disaster for democrats. the biden administration did not under perform, in fact they overperformed expectations. republicans are in complete meltdown mode. listen since the election, you would think after is to work on a performance, what they had in 2012 and this is what i wrote about the l.a. times piece. the rnc commission of an autopsy, they said they need to get more diverse and reach out to different communities. they cannot just talk to one another in a circular echo chamber. and what have they done? they've doubled down on the strategy that failed them. they lost in 2012, and the races. that could've taken out -- they failed. they elected sick people like todd ache talking about legitimate rate, they failed. ten years later, they nominate people like oz in pennsylvania. disasters in arizona. what we are about this with herschel walker in georgia and they fail and how do they respond? alex they try to figure how to talk about white nationalism and nazism. >> luck the op-ed title is a perfect summarization, it's groundhog day for the gop.

failure after the defeat is becoming a republican hallmark. so adrian, let's move to you and ask you about the change that is pending by the dnc. moving iowa entirely out of the early primary voting and elevating south carolina to number one. this is the prompting of the president. and all sort of plays into the strength of this president post-midterms right? i mean he's got greater license now to decide who goes first. >> yes alex, it's a really smart move by the dnc and by president biden. i think for the first time in the long time, black voters and latino voters will have been much bigger say in terms of determining who the nominee is and the democratic party. weather for south carolina, nevada which was already up there but keeping nevada at the forefront but also, incorporating states like michigan which is a large diverse state. it's a really smart move and look you know alex, we are never going to forget of course the disaster that was the iowa caucuses in 2020. part of this plan also gets rid of largely, gets rid of caucuses.

i think will be a few states of the caucus but far more democratic, far more equitable way for democrats to choose our nominee. i think it's incredibly smart and i think it's frankly overdue. and you know i will not miss knocking on doors and iowa and some degree temperatures. i think a lot of democrats feel the same way. and you know again and i think it's something that was a priority of president biden's to make sure that more diversity was at the forefront of choosing our nominees. and now again, once again president biden is spending his money where his mouth is and making really important critical changes to our democratic process. >> switching up a bit with you, kurt i want to ask you about that dhs sounding the alarm about new, domestic terror threats. this again migrants. and the jewish communities. and when asked directly, whether antisemitic remarks by kanye west. contributed to increased threats, a senior dhs official said any high-profile pitiful -- trafficking in conspiracy theories only serves to ignite

violence among extremists, this is someone who had dinner days earlier with donald trump and known what the promises nick fuentes. how do you interpret all of this? >> what we have been talking for a while now, ever since really donald trump came on to the states and tried to mainstream really extreme rhetoric. this is someone who oftentimes targeted the prize as the enemy of the american people and treated violent images, depicting violence against the press. and as we have seen the rise of characters like marjorie taylor greene, like the lauren boebert, like the matt gates. almost like the shock djs, where they put out content designed to and set their base and generate a conversation that are really uncomfortable things, there's only continuing to grow in part because they downright refusal of the main leadership or just outright condemn the stuff. and say knock it off, and it sends a signal that that type of conversation and dialogue is acceptable and the republican

party. and again i go back to something i said earlier, how difficult is it to condemn somebody who says, i like hitler? and not see has to get the run of the deal historically. how hard is it to say yes, you shouldn't be dying with known white nationalists. you shouldn't speak out there conventions. and instead of condemning them, people like marjorie taylor greene who spoke at nick fuentes produce event, kevin mccarthy will reward her by putting her on the oversight committee. by giving her more power. by pandering to that extreme viewed within the party, rather than set them straight. the republican party is so terrified of their own base. they are stuck in this pattern of just saying nothing well continues to grow and expand. >> absolutely extraordinary but i think you guys adrienne, kurt, good to see you. let's head back up to nbc's hill kapoor who is joining me now from the head -- so here we go with you. let's talk about the strong showings to heal from their early voters. when you think we can expect

for the remaining voters out of the polls again that happens on tuesday. >> good afternoon from running atlanta, the early vote turnout here in georgia for the senate runoff has been huge. million voters have turned out according to the georgia secretary of state office. it has broken multiple single day records, and the name of the game for both of these candidates in the last few days is to turn out their base. georgians are exhausted by the sheer volume of tv ads and direct mail that they've been bombarded with. and i looks like they'll get a few more days of it, as the two candidates off of the door closing messages. for raphael warnock, it is portraying herschel walker as unfit, unqualified and someone who says doesn't know what he's talking about. doesn't understand the issues and does not know the law in the united states senate. for walker, he still comparing warnock or connecting him to president biden, slamming the two of them and all democratic government and washington for crime and inflation. arguing he should be elected to republicans could have more power to put a check on the biden agenda.

that two candidates have been making their closing arguments, let's play what have to say starting with walker. >> well senator, what i'm trying to do is by this race. he is trying to buy this race, he cannot run on policy. he wanted that debate him, i want people at that time to see who was the senator and if anyone had watch at the bait, they would've saw that i was the senator. he cannot come up with anything, he couldn't talk any because he had someone there that was going to call him on the things that he voted for. >> a couple of months ago when i found myself standing on a debate stage where the man who is woefully unqualified. woefully unprepared. against me no pleasure to say this but as a preacher, i am in the business of truth telling, woefully unfit. >> and since the general election alex, the confidence needle has shifted quite sharply for the herschel water

campaign. they were beaming with confidence heading into the general election. they did not do as well as a thought and since then, their single most potent argument for herschel walker's election campaign has evaporated now the democrats have clinched control of the senate. our nbc news exit polls show that voters who rated senate control is very important, supported walker by a narrow four point margin whereas those who considered it somewhat important or not so important, supported raphael warnock by a huge double digit margin, as much as 20 points or more. that is where raphael warnock's seat will have the edge here, in terms of candidate contrast, he is outperforming herschel walker. the more georgia voters consider it as a simple contrast between two candidates, who they prefer to have been? senate warnock seems to have the advantage. alex? >> we will see if it holds the next three days, thank you much. so he'll kapoor. well they say timing is everything, coming up next the royal visit that came just as a clip of a controversial new netflix documentary was released. it is harry and meghan and kate and william, forget the crown.

trump and other targets of his investigation, who did not answer subpoenas. a decision on whether criminal referrals are made, will likely be announced next week. meanwhile, kevin mccarthy and republican attempting to become the next house speaker is warning the panel that his party plans to launch its own investigation into the committee's work next year. joining me now is connecticut congressman, jim hines a democratic member of the house financial services and intelligence committee. and chair of the select committee on economic disparity and fairness and growth. welcome congressman, good to see you as always. regarding this final report from the 16 committee, how significant impact do you think it'll have, what do you hope to see come from it? >> yes, thanks for having me alex. i've been around long enough to know that congressional committee reports don't often change the world and i think the work of the january six committee, particular the many open hearing that they have. what do they really show who was involved, how extensive the legal effort was around this

chaotic attack on our democracy, that culminated on january six. i think that some, ways that the real work at the committee but what you need to do now, and we do the same company with republican friends who continue to support a president you saw the story that broke today. who gets called for the suspension to the constitution a week after he had dinner with a not c and somebody who is an antisemite, it's time for our republican colleagues to join me and those technical things. the electoral contact, all of that stuff that is not gonna necessarily be at the forefront of most americans thinking. but to make sure what happened at the end of the trump administration never happens again. >> he asked kevin mccarthy tells the panel to preserve your records, are you concerned that a republican investigation into the committee's work will try to discredit its findings? can democrats do anything to ensure that that does not happen. or will getting the report into the public realm to at least some extent reveal what the country needs to know about donald trump relative to the insurrection?

>> yes look mccarthy's statement to preserve records is showmanship right? we are required by law to preserve all of the records of the operation of our official committees. what he's doing is pandering to his angry as pro trump weighing. saying we will look into these guys. , fine look into what you will find that everything is there, we'll find that you know there was no subterfuge, reaction one after and try to investigate. a coup against united states government. what's more interesting to me alex should they go there? , again here is a guy that was called for the suspension to the constitution, who dons with not season was a perfect losing record. he lost on election, he lost the senate for the republicans, he lost the house for the republicans. do you guys really want to be servile with the service of a guy who is dining with not season causing him to lose? if i were kevin mccarthy, and we think in a lot about that. >> there is that and also what would they expect to find that could be incriminating? to your point earlier, so much has been put out into the public. the hearings played out for all of us to watch.

it is like, what are you looking for? >> that is not a question of the necessarily feel they need to answer right? many years ago and you will remember, i watched eight for nine, different republican investigation and benghazi. it turned out nothing. the fact that they refuted all of the nonsense that hillary clinton had given a standout order. they refuted all of that stuff. they needed to do that because it was purely political. that needed to satisfy their base and to try and by the, way kevin mccarthy admitted to this, to solely hillary clinton. so, again if i was kevin mccarthy, i'd be thinking to myself, do i really want to prostate myself in front of somebody who has a perfect losing record from my party? and i should be thinking about that. >> let's go to this new bulletin from the department of homeland security that once domestic terror acts pose a quote persistent legal threat, this lgbtq, jewish and migrant communities. how concerning is this violence and the threat rather than the violence and have you heard anything that you can share

from the intel committee that's a particular concern, this holiday season? >> yes of course it's of concern and you know it is not a symmetrical problem, my republican friends like to point to you know violence that may been perpetrated by black activists in portland. the fact of the matter is some people of 90% of the violent terrorist attacks in this country are undertaken by right wing, white supremacists and militias and other criminals. and by the way, you know we saw most recently very much at home with the attack on paul pelosi. so something that every member of congress needs to be thinking about and that every american needs to be thinking about alex. we need a good and vibrant debate. we really do, investigate the january six committee, go at it we should have open government but if you're in a world where we are not categorical and unconditional in our condemnation of violence, people will get killed and our democracy will be eroded. not as the question. are we going to be categorical and unconditional about our condemnation of violence.

this. so to your point earlier about congressional committee reports, not necessarily you know let's say making front page headlines all of the time, interpreted the way that we hope they are. this is different. is that what it's all about, communicating in a different way with this documentary? what is the impact you hope to get from it? >> it really is, alex for showing that clip. you know as i said before, and as you noted congressional reports no matter how good eventually doubted us on a whole lot of people show up. we have a wonderful report coming, out talking about the importance of supporting the youngest americans, children supporting families and making sure that americans have an ability to get into the middle class which many of them today don't feel like they do. which by the, way one of the big explanations for the violence out there that we were just talking about. the documentary alex is about the fact that people are moved by stories. we have three stories in this documentary of americans, i think of all political strive. you don't really know what their politics are but what really struggled to fight to be in the middle class. what it does is, we watch this

embracing extremism compared to the previous campaigns and what do you think is driving this push to the far right? >> yes i mean obviously former president trump is always florida with the fringes of american politics. he ran for office on the birther lie, suggesting that president obama was not born in this country. he talked about banning all muslims from the united states and talked about how mexican immigrants were rapists. he is often an always in some ways flooded with this, even an office we had charlottesville. but now it seems like as he is finding himself increasingly shunned by at least some of the republican establishment, he is turning more and more to those radical fringes. he is embracing the january six rioters that patriots rather than criminals. he is including kanye west and nick fuentes for dinner at mar-a-lago, even though he said the did not know who nick fuentes was. you know sukanya have wakanda west wasn't trouble for. and he is getting ready of course, sending that video to the fund-raiser and including qanon and music at his rallies and retweeting their themes.

true but it really begins to cover i think the full range of our ages and incendiary statements that things that he knew the who provoked. -- a step back and you are the things that make a movie is. he talked about and he compares a holocaust to baking cookies. he says that women who are not a beat into their husband should be slapped around. he says that you know the segregation was good for blocks. he says all kind of things like this, sometimes he says he's joking afterwards and it is not on the cues joking, he sounds like he's trying to provoke an offend eventually to get attention. i think it was important to kind of catalog what he has said that makes him controversial. watson to bergin on that is former president trump said he did not know who he was when he came to dinner. fine, he knows who he is now and has not said anything to disassociate himself or disavow himself from that news that nick fuentes has promoted. >> i have to tell, you have to read some of the things that the fact that he compares not

to capture the cookie monster. you mentioned that and that he supports russia and the invasion of ukraine, saying hey can we give a round of applause for russia? it's absolutely stunning article but my last question quickly, sometimes it feels hard to talk about this. by putting it out there and it's getting it out there. when you don't want anything like this out there. what are your thoughts on that? >> i think it's a natural reluctance on the part of the mainstream media to avoid giving boys to some of these really hateful and outrageous statements. on the other hand, if we don't at least at some point explain what people like this are saying that we in a way almost normalized them. we soften the edges of we simply say what's the premise is as if this not bad enough. but do not actually understand the content of the views he is promoting and sharing and popular for among his supporters. it is these things that really stand out and that make him you know such an important figure on the far right. if he, as we should know what he is saying.
