world headquarters in new york. welcome to alex witt reports. new this hour, heightened tensions in bowling green kentucky. officials say they have received violent threats against. the justice premise till protest scheduled to take place right now this hour. protesters say the woman who originally accused 14-year-old emmett till of making advances towards her nearly 70 years ago, now lives in bowling green. the threats against protesters prompted police to cancel today's planned kentucky jc christmas parade. that is days after the department of homeland security warned of increased threats against lgbtq, jewish, and minority communities. and, closing arguments in georgia ahead of tuesday's runoff election. incumbent democrat senator raphael warnock rallied with workers and union members today while republican herschel walker will appear at a football watch party this afternoon. georgia is moving up in the dnc's presidential nomination process. according to the new proposed schedule, south carolina would

become the first primary state, that new hampshire, nevada, georgia, and michigan. meanwhile, two former trump lawyers from the white house testify before a federal grand jury in washington d.c. yesterday. reports indicate that they were at that courthouse for more than five hours. and, another in other news donald trump in appeals court ending the special master review of documents seized from mar-a-lago, allowing the doj to resume its investigation unfold. let's bring in hugo logo, politics investigations reporter for the guardian and harry lippman, former u.s. attorney, former deputy assert assistant attorney general for the clinton administration and host of the talking feds podcast. guys, good to see you. both hugo, you first. you've been reporting on this since that ruling came down. did the judges explain their decision? we >> yeah. it was an eviscerate shun of the trump lawyers argument that trump should get special treatment even though he hadn't been charged in that he should

get a special master and join the justice department for not being a continuous criminal destination. i think the 11th circuit really bench slapped trump here when they basically said, look, in these sorts of instances, for federal courts in limited churches to action to intervene in an ongoing criminal investigation there has to be some exceptional circumstance, and the only exceptional circumstance that trump could point to here was that he was president and the sergeant was buying it. several months later, here we, are at the end of the special master. legal >> legally, speaking having a publicist of donald trump and how significant is it that two had a three judges making this ruling were his appointees? >> yes, that is certainly noteworthy. there is a republican appointee, but alex, the big point that everyone on both sides of the alley was recognized, she was really we, this is judge cannon. i agree with hugo that the trump lawyers get a pacing but the 11th circuit treats her like a disobedient third grader

who doesn't know the basics of separation of power. so it is very good for the rule of law. it is pretty good for doj we. and i only say pretty good because they had already adapted, we are going forward with their investigation. we are not so hampered by the special master. but very much wanted to be out from under her boot, here, and with the other mischief she could try to once she asserted jurisdiction properly. she could try also to. do so, pretty big and definitely for the rule of law, we very good to vindicate with, to reverse what was a very long list out there and we make it favorable to trump, legal. ruling >> which brings me to this question, hugo, how are donald trump and his legal team reacting? >> it was a bad day for them when this ruling came down. it was also the same day that they had to deal with the

potential implications of trump hanging out with kanye. connie made his most antisemitic remarks that he has to date on alex jones's show. they don't really have that many options now. i don't believe they can get a -- hearing for the win -- circuits before rogel local so they have to think of the supreme court. and it's not decided yet whether they want to do that. because the last time that the trump lawyers tried to appear on the circuit -- they got turned away. and most recently of course with the tax returns are actually lost at the supreme court. so i think there's a lot of consternation on the legal team about what will be due next. >> how big a blow, harry, is it that again two of these judges were trump appointed. one was i believe a george w. bush appointee. but all republicans. i mean, is there a sense that people are just not buying trump anymore? >> that is the important point, alex. it is not as if all of the

sudden judges are changing. it is really important to note that this was a very basic missed up by the judge below. so the key to hugo's point, what their wing is a couple more weeks of delay against the certainty that the court is going to reject doing anything here. so he will get that texture pr blow. that is the only thing going. this is finished. this misadventure is dead. >> so that is this, mean, hairy that the doj cannot proceed much more quickly? he doesn't speak things? up >> it was already i think going pretty quickly, but it certainly, it is nice to have that hurdle done. and the other point that you mentioned in passing, the testimony. this is on the january 6th side, not mar-a-lago. cipollone and filled men. this is new stuff we have never heard before. this could be the most

inculpatory testimony about trump yet. because they are not allowed to claim executive privilege. what did they tell you? what did trump tell you when he told you it was unlawful? they have to answer that question. now that is going to be really weak prohibitive. >> let me ask, you this closed-door meeting it was just reference, there what can you tell me about it? were there any decisions made by this 16 committee. we >> we'll, if you are referring to the appears before the grand jury by pat filament, that we don't have any insight into. we the grand jury appearance, they were there for very long time, by the way, both of. them they kind of overlapped for round two and half hours. they may have been testifying to potentially to grand rapids. it's not exactly clear. we always on the mark in that courthouse, and we saw them walk out. but the general six committee on capitol hill we had its own close meeting on friday in the morning when the subcommittee presented its recommendations to the full committee as to

what they should do with respected potential criminal referrals. it's also what you do when the republicans group a subpoena. >> let me ask you, harry, as a former deputy assistant ag, how much weight does a criminal referral from the committee have with the doj? if a panel concludes trump should pay face charges, is it taken as a recommendation that is likely to be followed? with >> the short answer, is no. the truth of it is that they looked at it independently unless it. they want to, they want the evidence in the referral but they don't give it special weight except if congress is the victim asked they are for the contempt charges, for example. so, and i think that is going to happen. the two go second point about the referrals, what do you do with those five members of congress. mccarthy, brooks, and the lake who just thumb their nose at them and do they refer them to the ethics committee, that

could be a real sort of -- and in the wake of course, just events of the republicans taking power. that will be a big decision. i anticipate criminal referrals and the doj will just take it in stride, i think. >> okay, they dina strive for the 16, but the doj is doing its own investigation. do you think that they. >> one hunted percent, very far down the. line and again, cipollone and philbin very big. and mar-a-lago, hurdling toward a decision. it looks to me within a few months. i am only saying that the congressional referral itself has the weight that any other referral from any party would have except where their victims. like when the contempt is against them. but, look, it seems to me that when things are really coalescing around a lot of legal hot water for donald trump on many fronts. >> let me ask you, quickly also about what happened this week with the five oath keepers found guilty of the crimes committed on january six.

two of whom were convicted more serious charges, seditious conspiracy. how significant are these vertex? do you think the doj uses their convictions, and does that all potentially help build their case against donald trump? >> yes, and immediately there are other seditious conspiracies in the wings against the oath keepers on the proud boys. and guys like roger stone who are communicating is now in much more trouble. but to me, alex, it is huge. even more than that, as a kind of historical. fact it makes the people like say marjorie taylor greene or even trump this morning is peter baker just explained, look like they are just on the wrong side of history and the facts. i think that this is one for the books literally. >> okay. harry, there's a reason that i talk to guys all the time, because you are terrific. so i look for to seeing you again. thank. you let's go now to simulation of the economy and it can be summed up in one word. robust, that is because the

latest jobs report revealed more new hires than expected last month. but, that's good news comes with a catch when it comes to inflation. and we see scott thomas still explains. >> we good news for mainstream. more jobs isn't always good news for wall street or the federal reserve. the government reports 263,000 jobs were added in november. far more than expected. unemployment still near 50-year lows, but with more jobs than workers to fill them, we just jumped 5.1% year over year, and that is the catch. >> well higher wages help families partially offset 40 year high inflation, bigger paychecks only make inflation worse. trying to tamp down inflation, the federal reserve has raised interest rates six times this year. now, it will likely have to keep raising rates this month and into the new year. potentially sending mortgages, loans, and credit card cost higher. the fed chairman, making it clear this week that the tight

rafael warnock and herschel walker is down to the wire with early voting over, a cnn poll puts warnock four points ahead. it is just outside of the margin of error. warnock spent the morning rallying union voters as warnock launches a final call for campaign cash. we >> will think sometimes i'm crazy when i said go to team herschel.com because, what senator warnock is trying to do is by this race. he is trying to buy this raise. he can't run on the policies. >> joining me now from atlanta, so he will kapoor once again. how are the candidates appealing to voters in these last few days before the election? >> alex, as you just showed,

herschel walker is still asking his supporters for money just through this before the general election. i should say the runoff election on tuesday. it shows the extent to which the walker campaign worries and has been out run by democrats on the airwaves. here in georgia, now walker is doing much of what he did in the run up to the general election in november blaming senator warnock for inflation and crime, tying him to president biden the democratic government. saying it is time for a change. if you watch walker on this, he seems more animated and comfortable talking about these conservative cultural issues, like so-called wokeness in the military. critical race theory, pronouns, the modern use of pronouns, transgender. athletes these are issues that stop republican voters, but have less appeal to independents and moderates who are more likely to decide this senate runoff election. and raphael warnock earlier today campaigned with labor organizers, talked about how the specific legislation that he's fighting for in is very

important to labor. about half 1 million georgia and medicaid coverage gaps. it's something that he has been trying to fix over his few years in the senate. and he sounded very confident about victory on tuesday. let's play what he had to say. >> we are on the verge of victory. but i don't want us to do the victory dance before we actually get to the end zone. we we are seeing record voter turnout all across our state. we people are showing up to vote. i don't you underestimate our opposition. >> what i was reasons to be confident down the stretch, alex, our independent model shows that the early voting electric neat leads democratic by about eight percentage points. the limited pulling that we have seen just but all shows raphael warnock leading,

although most of the polls are within the margin of error. the latest poll by cnn shows warnock winning independents in georgia by 25 points. if that margin holds or anything like that, we're not will win this race quite comfortably. there's also the fact that democrats have been out spending republicans by about 2 to 1 on the airwaves. walker's campaign of course is quite nervous about that. and there is the fact that herschel walker's strongest message, which is control the senate, has now evaporated now the democrats will hold the senate majority regardless of what happens here. none of that means that walker can't win this race. he still can, but what he needs is a very strong showing on election day. a major republican turnout to overpower these deficits that he is going to be looking at heading into tuesday when election day is here. georgia >> yeah, hunted percent. thank you for that. joining me now is my, king politics reporter coming this off the new york times. , maya looking back. early voting having wrapped up friday with a record number of votes cast, there is a poll from emerson college in the

hill. it shows that early voters break for warnock by not 29 points. and then those who haven't yet voted break for walker by about eight points. our signs indicating to you that this is warnock's race to win, or is it too soon to count a walker? >> i think we have to wait for election day, alex. and that gets to sales point earlier. if republican voters, particularly those in the northern atlanta suburbs and north georgia turnout on mass, that is really going to narrow that margins in this race. and so, the job that herschel walker has to do over these next few days is simply to encourage people to head back to the polls. but as you have noticed, that is gonna be a pretty uphill battle give the fact that republicans in georgia are being outspent by about a 2 to 1 margin, and walker has not had as many events over the past few days. and hasn't had many events this

weekend either. so that message could very well be lost on republicans. however, we know that the stakes of this race remain high even in light of who has control of the united states senate. and there are a lot of republican surrogates on the ground in georgia trying to get their people back to the polls. >> and, you can put your case back in but, as we, know it. school making that point about herschel walker. five days out off the campaign trail after thanksgiving weekend, much to the consternation of his republican allies. you wrote about that. >> yes. especially over that crucial window of thanksgiving where, again, democrats were out in the field consistently mobilizing the rotors and flooding the airwaves with the message, that was a window that a lot of conservatives saw for herschel walker to kind of close the gap between him and raphael warnock. and i talked a lot of republicans throughout this myriad of scandals negative stories about herschel walker

over the last several months. and really throughout the cycle. many times they have defended herschel walker at every turn. but when it comes to campaign strategy as such an important last stretch of this race, a lot of people were scratching their heads and wondering why us

speech and hate speech on twitter. it comes after kanye west, now known as the, or had his account suspended for a second time after making an antisemitic post. nbc's chief patterson is here with more. >> while the focus is certainly on kanye west and his suspension, researchers say that intimidation and harassment have increased really since elon musk took over the platform. so while researchers are saying that one man is being pushed out, they worry that a way far worse is being ushered in. >> just five weeks after elon musk took over twitter, the billionaires station for the platform is coming into focus as questions over free speech versus hate speech swirl. >> while the suspension of recording artist yay, formally known as kanye west, from the

msnbc. rev, what my friend. how do you interpret conyers antics and even taking into account his self-declared mental health issues. why do his antics mad her in the broader context of the political climate right now? >> well, i think that his antics matter because he is a big, huge cultural figure and people listen to cultural figures. and when they are given access to places, media spaces like twitter, they are able to normalize hate and incite people. we have seen any number number of hate crimes this year that those that were accused and in some cases convicted of performing and acting hate crimes were influenced by social media. and social media platforms. we just saw in the last week, a

man plead guilty for killing ten blacks in buffalo new york at the top supermarket. so this is not a time to talk about, they should have the freedom to do it. they should have freedom of speech, not freedom to incite violence which in and of itself is a criminal act. >> absolutely. and there is a great distinction there and sometimes there is a bloodline that doesn't get figured into any conversation. do you have any sense, rev, that yay learned from donald trump that you can spew outrageous things without consequences? >> i think that certainly donald trump was the first person in american political history that reached the presidency and continued to engage in this kind of incited and hateful behavior. and i think that the normalizing of it, when you have a president united states

engaged in that and then of kanye west sitting in the oval office, why would connie or anyone else feel that they cannot engage in that? for connie to say that hitler, to speak of him in very admirable terms is something you cannot ignore. hitler was a killer of people based on the rate. it was not just a mass murderer, he specifically went after jews, we specifically cataracts and castigated blacks. and executed them en masse. and to speaking in an admiring way about him is absolutely way out of bounds for any human society that believes in human rights. >> rev >> i'm curious if kanye has felt the effects of this kind of hateful speech from either loss of fans, fear of people buying's music, for your

radio stations playing's music. do you know if he is feeling the effects of this? >> i don't know if he is feeling the effects, but it's certainly been effective. the kinds of monies that he's lost, because of people. >> endorsements, yeah. >> endorsed. with people he was doing business. with people that he will it certainly is hit him in the pocket. however, has it registered from his pocket to his head is not for me to say. but it has certainly impacted him which is why normalizing this is very dangerous because it will only inspire others that i have the seeds, or of hate or had heat and feeling what they are doing is in fact permissible. and that should not be allowed. particularly when we see the increase of hate against jews, blacks, lgbtq, asian americans, native americans. we have seen hate crimes in the

last 30 days against lgbtq in the nightclub. and we have seen against asians, against all kinds of people. this is a time we ought to be uniting against racial and ethnic and sexually oriented attacks, not a time where we get them platforms. >> yeah, okay arrive, on that note let's move to the pushback. the new stuff today from democrats new hampshire against president biden and the dnc change to the primary nomination calendar. under this plan, and south carolina gets to go first. then followed by new hampshire, nevada, georgia, and michigan. how does this change the dynamic, rough? does it have any impact on the issues? >> i think it will require the candidates have to address the broader range of issues. that they may have been reluctant. in our chapters around the country, we have always argued that you can't come out of the

box. you can't come out of the gates and have a limited kind of policy platform. i remember when i ran in 2000 44 presidential nomination of the democratic party, many of the issues that we wanted to discuss were limited in iowa, -limited in new hampshire. this opens up the process to where all people and all issues will be argued, discussed, and debated early. so that democrats can then hear the range of what you want to deal with across racial and economic and gender lens. and i think that it is a healthy thing. many of us have been calling this for years. and i salute president biden in jimmy harrison and the dnc for looking into this. it is time that we talk about, if you are gonna be the party for the people to vote for you, then you ought to have a process that includes them from the first primary. and this is a good thing. >> okay, reverend al sharpton,
