just very clear that congress thinks that a crime has been committed here in the doj should investigate it. >> and i'm forgetting, look at brand-new pictures of britney griner's first moments on u.s. soil. she is meant to her first weekend back on the u.s.. it comes as we get some new insight today with the negotiations with russia that secured her release, earlier today, national security council spoke when john kirby revealing how the u.s. tried to get both griner and paul whelan back to the u.s.. >> there was a very serious specific proposal made to the russians to try to get both of them altogether. it just didn't land anywhere, it didn't go anywhere with the russians, and as we progress through the summer, and into the fall, again, the conversations ongoing with the russians, it was clear, martha, that they were treating paul very separately, very distinctly because of these sham espionage charges they lobbied against him. it kind of came together last week in the endgame with just a

boot for griner deal. >> and the reaction cause democrats shake -- have a shake up on the senate. we kyrsten sinema saying she's leaving the democratic party to become an independent. -- expressing confidence that it won't change how things work in the upper chamber. >> look, how surprised she made the change but functionally, i don't think the change is a thing. i think we're going to continue to do the same thing that we were doing whether she's independent, or part of the democratic caucus because she's going to continue to caucus with the democrats. >> i think it really has to do with her political aspirations for the future and arizona. but for us, i think nothing much has changed in terms of the functioning in the u.s. senate. >> let's head right to capitol hill right now, and we're joined by nbc's julie tsirkin. julie, welcome. the one committee members -- meeting virtually in an hour from now on p.m.. why this sunday session?

>> alex, look, it's no secret that the clock is ticking on this committee. the expiration date is coming up. in the start of the new year when house republicans take control of the lower chamber, effectively dismantling the january 6th select committee. but look, today they're meeting virtually. i'm told that the members have been texting, have been communicating, in one form or another, at nearly every single day as they get down to the wire here. but, today's meeting is a very special focus. we know that they're going to try to decide whether they should make criminal referrals. that's a serious step. members on the panel have been weighing. they're thinking about it very heavily since the last several months. it could be viewed as a political decision, especially with democrats that to lose control of the house in just a month from. now but i want you to take a listen to a panel mammal adam schiff had to say, and how they're going to lay out their decision-making and their thought process when it comes to this issue. >> we're looking at, what is the quantum of evidence that we

have against the individuals? what is the impact of making a referral? i'm going to create some suggestion by referring some, that others there wasn't sufficient evidence when we don't know, for example, what evidence was in the position of the justice department. so, if we do make referrals, we want to be very careful on how we do them. but i think we're all certainly in agreement that there wasn't evidence of criminality here. and we want to make sure that the justice department is aware of that. >> look, ships suggested that they are all in agreement, generally, on what to do with this process. but, look to be clear the department of justice, doesn't really need congress to make any kind of plume of this, right? all of this is really a matches jing tool for the committee to put their last stamp and mark on this investigation when they've been pursuing for more than 17 months. now this all comes, just days before the committee is set to issue that final reporting, and potentially announce whether they're making any criminal referrals on december 21st. alex? >> yep, a week from wednesday.

we have a circled on our calendar. thank you so much julie tsirkin. more developing news right now with the release of some new pictures today of britney griner's escape from russia, and her first moments on u.s. soil. also, new word from her wife as griner spent another day at a military facility in texas. nbc's marissa park is outside of brooke army medical center in san antonio for us. welcome, first of all when you hear about how brittani's doing? >> well, as we know she's in the process of decompression before reintegration. a lot of this process involves staying away from the public eye and talking to people about everything that she's been through behind closed doors. but we are learning more about those moments when she first learned that she was coming back home. of, course some of the first moments when she did land on u.s. soil. take a look. this is an instagram post from her wife, cherelle griner, and largely it was just expressing gratitude to everyone who brought. here quote >> --

of many, she continued as beachie and i start our journey to heal our minds bodies and spirits. i want to personally say thank you to some of the hands seen and unseen that help make it possible for me to see my white again. >> it was really special to see just as long, long list of everyone that they were thinking. you can take a look yourself. but now within the last hour, you mentioned the voters that we are seeing, this very first photo that we're seeing from the plane that she was on her way home. and nbc actually spoke to the u.s. special presidential envoy for hostage, false that's roger parsons. he explained his moment on the plane. actually, one of the more interesting ones what he was talking about how he was trying to give her space, thinking that she would need that, instead, he said that she was craving human connection. she wanted to talk. take a listen to what he had to say about her very first moments on u.s. soil. >> what brittani got off the plane, she of course connected with charles. shortly thereafter, she stood in front of a huge american

flag in this aircraft hangar, in san antonio, texas. she called everyone over to take photos with her. as she was doing, that she would often with their names with, look them in the eye, shake hands with them. that to me was probably the best moment of this whole recovery. seeing brittani and from that big american flag, taking photos with all the people that would try to bring her home. it shows the kind of woman that she. is >> so when you asked how brittani is doing, i think that is just so telling. not only graciousness expressed, but also you could really see just the resolve and the grit that got her. there remember, that carson's is one of the main key players that help to get this negotiation on the ground. he also mentioned whelan. it's so important to mention him because everyone is talking about how we line is something they are also focusing on. he said that there is a meeting tomorrow happening with all the people involved in type of these negotiations. he didn't say more, just that steps are being taken to bring him home as well. back to you. >> yeah, it was important to

say the john kirby spokesman -- and how hard they tried to get pelino in this part of the tea who has. well so very interesting, thank you so much melissa power for that. joining me now is democratic congressman jamal bowman of new york. welcome search, good to see. you you have heard a number of your colleagues on the other side of the aisle criticizing the exchange, questioning if president biden made in fact, the best deal possible. something that he should have freed the former u.s. marine, paul whelan. is it dangerous, right now, for the gop to be questioning this. if negotiations are still underway, or at least discussions, what are these reactions saying to you? >> well, unfortunately the gop continues to be anti black, anti woman, an anti-lgbtq. you see the bottom line is brittani liner is a black woman, who is a lesbian. and when you look at the policies that should gop

continue to support in their constant rhetoric, they are anti-those things. so, it's a very unfortunate, but it's really good to see brittney griner home with us, back on u.s. soil. it's unfortunate that she had to go through this. it makes me think of all the people who are unjustly incarcerated, in our country, and around the world that need to be coming home as well. >> yeah, there are a lot for sure under that category. let's move, sir, to the january six committee. you know it's meeting. today i was expelled terms precisely whom to criminally referred to the department of justice, how do you want to see this handled? should the committee criminally refer the former president, donald trump? >> absolutely, yes. first of all, i want to commend the committee for being so comprehensive and transparent over the last several months in laying out exactly all of the evidence and information that

they've acquired related to the president, but not just the president, rudy giuliani, mark meadows, and many others. i think it's important for the committee to continue to be transparent and -- in terms of the referrals that it will make today. for me and for my constituents and people i speak to across the country, it is crystal clear. the president lost the election, he pushed a big lie, he weaponized social media and his base toward the january 6th insurrection that we saw. he wanted to be a part of that insurrection, and had to be held back by secret service. i expect that the committee will do the right thing and make its referral. the committees not just charged with prosecution, but it should continue to be comprehensive and transparent and sharing its information, because this is part of the historical record. people for decades to come will

read these referrals and will observe the january six committee. so, i look forward to that. i'm continuing to inform the american people as to their findings, and the referrals. >> ten days to wait until we get those findings. i know all of us, many of us are really holding our breath until it happens. but, let's get to something else. you and senator bernie sanders have done, which is led more than 70 lawmakers urging the president to take executive action to guarantee those rail workers seven days of paid sick leave. because it wasn't included in the agreement to invite a strike. what options does the president have for executive action, and do you expect him to respond? >> i'm expecting him to respond. what he can do is expand upon president obama's 2015 executive action. but this time, ensuring that rail workers are included in paid sick leave. it's unfortunate that congress even has to intervene in the

first place. you would hope that employers would do the right thing and ensure the threes paid sick leave for workers who do this backbreaking, and some of the most challenging work that anyone in the country has to do. but once we saw that we had to intervene, we wanted to ensure that there was paid sick leave for affiliated and associated in part of this bill. we got it passed the house, and we even got six republicans on the senate side to sign on. but unfortunately, the chamber of commerce and others, got involved and got into the ear of many republicans, and we were unable to get across the finish. line so, the president has the executive authority here asha president obama in 2015 to ensure that rail workers have paid sick leave. where the wealthiest nation on earth. rail road companies, if you will, are making record profits. they should be able to provide paid sick leave, which would be a small percentage of the profits that they make

annually. >> all right, thank you for ironing all that for us. let me switch to this, getting your thoughts are on course and sinema searching for the democratic party. in response you tweeted, by felicia, this is about your pharma donors, stop lying. are you unfazed? do you think this is going to have little impact on the democrats majority in the senate? >> what's unfortunate is that senator sinema has been stumping with the republican party, and fighting against the interest of the american people and the democratic party for the last couple of years. we may have got a build back better if it weren't for cinemas senator. -- big pharma donors and the wealthy elite in our country that she has the american people. so. we will. .

the libyan national, suspected of making the bomb that blew up pan am flight 103 over lockerbie scotland on december 21st, 1988. that flight was en route to new york -- the explosion killed all 259 on. board another 11 on the. ground 190 of those victims were americans, 35 of them students at syracuse university, studying abroad. the suspect had been in libyan custody since 2012, a doj spokesperson told nbc news. the suspect is expected to make his initial court appearance in the u.s. district court, for the district of columbia. that will happen in our next hour, we're going to get a report from our london -- for you. meantime 02 have been a flannel of the recent white house state dinner, we're learning about an interaction between hunter biden and congressman kevin mccarthy and his mother. who approached whom, and do we know what the reaction was? well, it is detailed in this article. we'll discuss the implications, next. ations next

ten days until this start of winter, and it's already packing a dangerous punch. dana griffin, nbc news. >> all right dana griffin reporting over there and the reaction today to donald trump's recent engagement her mar-a-lago with far right. doctors but tuesday, -- qanon conspiracy theorist, it comes just two weeks after trump had dinner with white supremacist, nick fuentes, and yay, formally known as kanye west. yay has made a number of horrific -- don trump's niece told me this is all part of her uncles 2024 strategy. >> everything donald does is transactional. he sort of a black hole of need, and when he's not getting what he wants from some people, i think in this case, the majority of the republicans in congress who have had enough and sort of see him as electoral poison, he will go

wherever he needs to in order to get his fix, which is attention, and sick offensively. >> joining me now is peter baker, msnbc political analyst, chief health whitehorse pundits and coauthor of the traffic new book, the divide, or trump in the white house 2017 to 2021. welcome, my friend. as someone who has been following donald trump's political career and also interviewing him, post presidency at mar-a-lago, do you agree with his niece, mary trump's assessment? >> well look. i do think that he is reacting to the fact that he's being shown to some extent by when -- he's reaching out to the people who support. him his view of politics is really all about who likes him. who supportive of him, who's loyal to him? he's all less ideological and a lot less philosophical or even policy oriented but it is about his own personal leave --

need for validation. even if it means goes further to the extreme. he's going to take that support and go in that direction because these are people who are sticking with him to some degree of fervor. of course, he's always floated with differences. he's the one who promoted the -- way back in the day, after charlottesville, and all these other examples of currying favor in a fight with the far-right. even so, i think what you're seeing now is a far more open embrace, if you will, of extremist extremist elements in l.a. american society. there's no apology. he is not saying, i don't support the view even if i don't see them. he simply says, basically, at that the messages, get used to, it this is who i am and this is what i'm going to do. >> yeah, and in fact i asked mary if she expected apology and see she said, nope not gonna happen. all of this, peter, this controversy is just a piece of trump terrible, horrible, very bad three weeks as you

colleagues of the new york times called it. on wednesday it was revealed a trump search team found at least two more classified documents are in west palm beach storage unit. how did these suddenly turn up, is there any reason to believe there are more classified materials floating around? >> well i don't think anybody is willing to bet that there aren't at this point. look, this turned up because the trump team hired people to search the various places that there might be documents like this. the court actions that are going on right now. the justice department looked at that and said, this is an example of how they haven't complied with legal orders. they went to a judge this week to ask the judge to hold the trump deep in contempt. the judge didn't act on that, may not act on that, told the two sides to go back and work it among them selves. but it suggests how frustrated formative justice is with the fact that here we are two years almost after the president left office and they still don't have real assurances that they've got all the documents that don't belong to him back. >> is the fallout that you

expect that could come from this particular discovery? i mean maybe more search warrants? >> yeah, it could be. the problem with a search warrant as lawyers will tell you, and i'm not a lawyer, is that they need to have a particular understanding of where documents might be. so, you can't just have a fishing expedition and saying we like to go everywhere and go see everything. they may not have that particular knowledge about particular doll documents at this. point but they certainly don't trust the trump team, no question about that. i think this could add to the larger legal pressure on the president but could lead to indictments. if you're looking at an instruction of justice charge, which detached department have said is looking at in this court papers, while this is one more example of how they can say that the trump team has failed to promptly and expeditiously respond request to return documents that don't belong to him. >> let's turn now to your point that out of the washington post,

it reflects my owed to be a fly on the wall of the state dinner, right? it was a very surprising moment, and it's from the white house late dinner. at one point hunter biden walked up to a group, including house minority reader, kevin mccarthy, and said hello to mccarthy's mother. according to people familiar with the exchange. okay, so first of all, what do we know about this interaction? >> yeah, it's interesting, isn't it? of course the fact that the president had kevin kathy to a state dinner, it is interesting in notable. the president who is trying to return to the normal way of doing things in which you still have people across the aisle, to your home, the home being the white house. the people's house. for events like a state dinner, you don't make that a partisan affair. has president didn't see that way. but hunter biden, obviously, is deciding at this point knowing that he's a target, knowing that he -- that the bull's-eyes on his back to confront his accusers, his attackers. in fact, he did that in a very personal way by going up to mccarron mccarthy and basically

suggesting that he is not going to shy away from. i think that that's the message he wanted to send the republicans at this point. >> but you think -- i mean the post story suggests kind of a charm offensive, maybe? do you think that's a case? do you know if it caught the leader off-guard? the question is, could it work, given everything the you know? >> i think it's harder to be mad at people who are saying mean things about people if you see them in person and you know who they are, if they seem like him in being sued. the truth of the matter is that this is all driven by forces that go beyond that. kevin mccarthy is interested in winning the speakership. in order to do that, he needs to convince the most conservative members of his caucus that he's with them. anything short of a full on investigation of hunter biden would undercut his ability to win that vote coming up in january. so of course, he's not going to show anything less than complete fidelity to that cause. after his speakership, if he

the waters very suit of about, of california. on the 50 years anniversary of nasa's first moon landing, the return of the unmanned spacecraft to mark the end of this 25-day artemis 1 mission. it's been testing the most powerful rocket yet, as well as the capsule as it was out in deep space. let's go to my fellow science and space geek friend, and colleague, lindsey reiser joining us now from the big board. okay, they're watching this thing with baited breath. all the engineers, they want to see if the heat shields work because that's super key right now. walk us through the mission, the splash down, bring it all to us. >> alex, party one they said all along was texting those heat shield. the whole thing has been a test. let's look at the launch. this was testing the sls system. the most powerful rocket system nasa has ever built. i was there in person for the launch. it was incredibly powerful. we were five miles away on a still had to brace myself. and then, once orion was successfully in space, and that

rocket, the booster, the core stage had successfully dropped off, let's go ahead and show you the flight path to show you where paul ryan went. orion went and did a close live eye of the moon, then ritual -- 40,000 miles past the far side of the moon. then, around another close five by, another 79 miles across the moon. we have incredible images that orion was able to take. images of the length we haven't seen before. you can see her earth on one side, the crescent moon on the other. then, orion used the moons own gravity, sort of slingshot effect to get back to earth and that is where we are today. this incredible splash down here. i believe we also have some images of the navy rehearsing the recovery of the ships, of this capsule. here we go, because it is an incredible feat here, a multi pronged a crutch. this capsule going to come down, 24,500 miles an hour, seven miles a second. these teams are going to be there, they're going to be

studying for hours doing imagery, making sure that those heat shields, which not only protected orion in deep space, but have to protect our ryan from the heat upon reentry held. so, alex, this is an intense credible test of the system. this is all eventually to pave the way to artemis two. and then artemis three, for humans to land back on the moon. >> okay, so i'm getting a word from the control booth. it's about three minutes till it actually lands. we would really, really like to stay with us and make sure all go smoothly. you bring up the heat shields though, what's it, like 5000 degrees that goes through earth's atmosphere? that is extraordinary! it's my understanding that they've expected to bend these heat shield, right? the metal, or whatever the composite. is >> it tiles. >> so it's about 1300 tiles that have to withstand all of this, and so that is why, this is new technology here. that's one of the reason why it's gonna take several hours once orion does splash down.
